LTJG Hurtt, a native of Old Lyme, Conn., graduated with honors from the United States Coast Guard Academy in 2012 with a B.S. in government. He began his career as a Weapons Officer, Deck Watch Officer, Electronics Material Officer and Boarding Officer onboard USCGC THETIS homeported in Key West, Fla. In 2014, he transferred to Manama, Bahrain to serve as the Executive Officer of USCGC ADAK, one of six forward deployed U.S. Coast Guard patrol boats supporting Operation Enduring Freedom. While Executive Officer, LTJG Hurtt administratively supported a crew of 22 personnel while facilitating coalition force activities in the territorial waters of Iraq, Bahrain, Kuwait, United Arab Emirates and international waters across the Arabian Gulf. He will comment on the ever-evolving, worldwide mission of the U.S. Coast Guard and share some of his front line experiences maintaining the peace in foreign waters. Additionally, Skipper Hurtt will provide an update on local boating safety issues for enhancing use and enjoyment of recreational watercraft. Subject to priorities of the day, the USCGC HALIBUT may be available at the CYC Guest Dock for on-board inspection by luncheon attendees. The Los Angeles County Sheriff’s Department’s Lost Hills Station conducted a DUI/Drivers License Checkpoint on Friday, July 24, at PCH and John Tyler between the hours of 7 p.m. and 3 a.m. Checkpoints are placed in locations that have the greatest opportunity for achieving drunk and drugged driving deterrence and provide the greatest safety for officers and the public. DUI/Drivers License checkpoints have been shown to lower DUI deaths and injuries. A major component of these checkpoints are the deterrent effects it has on those who might drive drunk or drugged impaired, bringing about more awareness and encouraging everyone to use sober designated drivers. According to the National Highway Traffic Safety Administration (NHTSA), checkpoints have provided the most effective documented results of any of the DUI enforcement strategies, while also yielding considerable cost savings of $6 for every $1 spent. 90 percent of California drivers approve of checkpoints. At the July 24 stop, 1,583 vehicles passed through the checkpoint, 1,095 drivers were checked at the checkpoint, one DUI (drugs and alcohol) suspect was arrested, six unlicensed drivers were arrested and sent to court, six vehicles were released per checkpoint release procedures, five drivers driving on suspended licenses were arrested and sent to court and five warrant suspects were arrested and sent to court. The Los Angeles County Sheriff’s Department will be conducting additional DUI/Drivers License Checkpoints and DUI Saturation Patrols throughout the upcoming year in their ongoing commitment to lowering deaths and injuries upon our streets and highways. watering hole in Santa Monica. It’s played host to any number of celebrities, politicians, and noname funsters. The charm of Chez Jay’s is its consistency. The menu hasn’t changed, the lights and décor are the same as they’ve been for decades and I’d bet that there’s a peanut hiding out somewhere in there that is older than me. Walking into the darkened room with the Christmas lights blinking always seems like coming home. But after 57 years there’s something new at the Chez. It’s called Jay’s Patio and it’s an outdoor seating area that is hidden behind the iconic landmark. For most of us who love being outside, finding a good place to enjoy the sun, have a meal, read a book and enjoy the quiet is not easy in this town. Sure there’s outdoor seating at many places on the Third Street Promenade, and a few places on Montana Ave have some tables outside, but those are right up against lots of traffic, either foot or car. Finding a nice outdoor spot, with good food, decent parking and some solitude is rare, but the good news is that this new grubspot has all that and more. It’s a nice physical and emotional connection between the local landmark bar and restaurant with the beautiful Tongva Park. I had lunch on Sunday at Jay’s Patio and was
pleasantly surprised at how enjoyable it was to enjoy a huge turkey burger lunch in the sunshine. The handmade burger was amazing, it’s a giant burger with two types of cheese served on a brioche bun. It comes with Chez Jay’s seasoned fries or salad with their homemade dressings. Chef Tony De Arcos has been serving up the good stuff for Mike Anderson, the man behind Chez Jay’s, for over a decade and it’s easy to see why they make such a great team. The food is amazing and the atmosphere is enjoyable. There was music playing, but not in that annoying, overly loud, obnoxious manner that is common these days and designed to drive you out of the restaurant. My guess is the back area seats about 50-80 people, and I can see spending lots of time hanging there reading and listening to some soft jazz and blues. This is no super loud beach bar, this is a place to take a date and enjoy their company, or settle in with a good book, and have a solid meal. It’s open Thursday to Sunday for lunch from 9 a.m. - 2:30 p.m. and for dinner from 6 p.m. - 10 p.m. If you’re headed to the Twilight Summer Concert Series on Thursdays you might want to drop in to Jay’s Patio for dinner beforehand to get you in the headspace of fun and revelry. The patio
menu is Chez Jay’s take on burgers, burritos and salads, but I’ve been told if you say the magic words you might be able to order from the main restaurant food menu. There’s no alcohol on the back patio. I spoke with Mike Anderson and suggested that he bring in a jazz quartet on Sundays and I’m hoping he takes my advice. He did share with me that for the month of August he’ll be running a Sunday dinner special on the back patio of Chez Jay’s: a rack of Tony’s Famous Pork Ribs for $14.95. For those in the know, Tony’s Ribs have been a local treat on Tuesdays in the front of the house with regulars coming in just for them. There’s no real dress code for either Chez Jay’s or Jay’s Patio. What do you expect from a place that once had an elephant at the bar? But I’d suggest that if you come out at night, bring a light jacket, even though there are heaters, the evenings can get chilly and breezy. The legacy of rent control in Santa Monica THIS IS THE THIRD IN A SERIES OF ARTICLES ON
housing in Santa Monica. Other topics have included workforce housing, the role of development agreements in producing affordable housing, and the importance of providing housing for all income levels to preserve the historic diversity of Santa Monica. We cannot end this series of articles on housing in Santa Monica without talking about rent control. Although substantially weakened by state legislation over the years, Santa Monica’s rent control law remains a major tool for protecting the affordability of our rental housing and maintaining our economic diversity. In 1979, Santa Monica residents voted for an amendment to the City Charter that created one of, if not the most, radical rent control laws in the country. For years, our rent control law defined the progressiveness of the Santa Monica community and earned us the title of “The People’s Republic of Santa Monica.” Passage of this initiative was a major victory for a burgeoning group of young activists, Santa Monicans for Renters’ Rights (SMRR), and its allies, many of whom were senior citizens facing escalating rents and threats of eviction because of condo conversion. The increasing threat to secure housing for Santa Monica tenants, particularly seniors, was viewed as a community-wide concern. The question was asked whether property owners should be free to make obscene profits at the expense of vulnerable renters. The answer was “no” and rent control was born (in 1979, about 80 percent of the housing units in Santa Monica were renter-occupied, which certainly contributed to the outcome of the election). Rent control is implemented by the five-member Rent Control Board, which is elected by Santa Monica voters. The program is administered by the administrative staff and its own in-house
attorneys and hearing officers. In the early days, landlords brought hundreds of lawsuits against the Board, and most of the significant rulings were in favor of the Board. There are now a little over 28,000 rental units under rent control, which represents about 70 percent of Santa Monica’s rental housing supply (the Charter Amendment applies only to housing units built before 1979). As a result of strong lobbying by the real estate industry, the State Legislature has done much to weaken our law. The first attack came in the form of the Ellis Act in 1985. The Ellis Act allows a landlord to “go out of the rental housing business” by converting the use of the building or demolishing it altogether, as long as the replacement project is not rental housing. To date, almost 2,000 rent controlled units in Santa Monica have been removed from the rental housing supply under the Ellis Act. In 1995, the Legislature passed the CostaHawkins Act, which allows a landlord to increase the rent on a vacated unit to market rent when a tenant leaves, though the law did not go into full effect until 1999. Before Costa-Hawkins, Santa Monica’s rent control law had forbidden this “decontrol” by maintaining rents on vacant units at their rentcontrolled levels. Needless to say, vacancy decontrol has had a major negative impact on the affordability of our rental housing supply. In its 2014 Annual Report, the Rent Control Board found that almost 70 percent of rent-controlled units (almost 19,000) had been re-rented at least once since decontrol was put in place. Under Costa-Hawkins, once a new tenant moves in, the rent is re-controlled but at the new (usually higher) rent. The good news is that more than 30 percent, or about 9,000 units, remain at lower, pre-decontrol levels. This is certainly good news for seniors and
others who are the most vulnerable to major rent increases since the Rent Control Board limits rent increases to 75 percent of the Consumer Price Index (CPI). Last year, for many tenants living in rent-controlled units, that translated to a maximum rent increase of 0.8 percent of the previous year’s rent. What impact has decontrol had on rents in pre-1979 buildings in Santa Monica? A typical one-bedroom rental unit that has been de-controlled at least once now rents for $1,629 a month and requires an annual income of $81,450 to afford. A similar one-bedroom unit, which is occupied by a long-term renter and has not been decontrolled, rents for $862, which requires an annual income of only $43,100 to afford (this is assuming that people do not, or should not, spend more than 30 percent of their income on rent). But, even though the decontrolled rents may seem high, they provide existing tenants with stability, since the rents can only be increased by the annual General Adjustment adopted by the Rent Control Board, which was 0.8 percent in 2014. The City has responded to these attacks on rent control with several important measures. First, our Condominium Conversion Ordinance makes it illegal to convert existing apartment buildings into condos unless the citywide vacancy rate exceeds five percent for a period of 90 days, which is unlikely to happen in our lifetime. Since being able to decontrol their rental units is a strong incentive for property owners to “encourage” existing tenants to vacate, the City Council voted in 2014 to strengthen the City’s Tenant Harassment Ordinance and clarified behaviors that can be considered harassment. This is especially important as policies that constrain new housing from being built contribute to skyrocket-

ing market-rate rents. The Rent Control Agency has enhanced its public outreach effort by holding regular seminars, with the Consumer Protection Division of the City Attorney’s Office, for tenants throughout the city. SMRR operates a tenant hotline to advise renters about their rights. Finally, the City provides funds to our local nonprofit housing provider, Community Corporation of Santa Monica (CCSM), for the acquisition and rehabilitation of existing housing, much of which is rent-controlled. CCSM now has well over 700 units of older rental housing, which will remain affordable and rent-controlled for at least 55 years. Existing tenants, at the time of CCSM’s acquisition, are allowed to stay in their units. Renters still comprise the large majority of Santa Monica residents. Their housing security is a major policy objective for the City and of concern to many of us. The likelihood that we will see repeal of the Ellis and the Costa-Hawkins Acts is slim. We may instead consider amending these laws in
ways that protect the most vulnerable of our tenants and assure that we maintain some level of economic diversity in Santa Monica. At a local level, however, we should remember that we can help relieve the economic pressure put on long-time residents in rentcontrolled units by creating new housing where none currently exists, minimizing the unnecessary conflict between new, incoming residents and those who have lived here for many years. We believe that the collective consciousness of Santa Monica is still a progressive one. Notwithstanding strident, angry voices decrying the need to save Santa Monica that they once, if ever, knew, we are a community that believes in preserving our affordable housing through rent control, providing new housing opportunities for lower wage workers and those on fixed incomes, and retaining an economic diversity that has always distinguished us from other coastal communities. The City has repeatedly shown its commitment to these ideals. And, we are thankful for our City government and to be part of this dialogue. Pure Drift was born later, when Rennella decided to drive back to his native Ecuador. Andres came up with the idea of installing water filters in towns along the way, and so his trip evolved into the one the organization is preparing for today. “I was born and lived in Ecuador for 17 years and I could experience first hand how hard some people get it in life,” Rennella said. “Clean water access in South America is not always a sure thing. Kids in school are sometimes forced by the circumstances to drink contaminated water … a bigger problem through water related diseases.” Eichenberger shared Rennella’s passion for the clean water crisis and agreed to join him on his drive through Central and South America. “I have traveled a lot and part of being a surfer is traveling to new waves. In those travels I was able to see that not everybody is as fortunate as us here in the U.S.” Eichenberger said. “Water is a growing problem and we feel the need of doing something about it.” The duo, along with Pure Drift’s two other members, Lesley Roberts and Emelie Aggestål, have done small test installations in towns through Baja, California to gauge how effective their big trip might be. So far they’ve been very successful. “We’ve done long weekend trips to get a sense of where we’re going to find people who need filters, how they respond to it,

Staff said it has been a hit with local families and that the North Beach playground will add to the city’s offerings where there are currently few options. “We chose Montana Ave. because it will open up opportunities at the north end of the city for playgrounds. People can take the overpass at Montana and come down to the beach,” Meister said. She said the site allows ample space for construction without having to cross the bike path, it’s located near a parking lot and has restrooms nearby. Meister added that the city has had a steady focus on accessibility at the beach. In addition to building accessible walkways, the city offers free beach wheelchairs. The wheelchairs, both manual and electric, can be checked out from the 2400 block or 1200 block locations of Perry’s Beach Café. Their Go Fund Me campaign aims to raise $15,000 by the time they leave in September, which will allow them to buy the filters needed to provide clean water for 20,000 people from Mexico to Ecuador. “It has been hard getting help from local businesses and the local government, but our friends, family, business nationwide, and the people of Santa Monica are a huge part of Pure Drift,” Eichenberger said. “We’re hoping that local businesses and the City of Santa Monica can give us a hand to make this project become a solution for tens of thousands of boys and girls that can’t access clean drinking water on their daily lives.” They have been thinking about the future of their organization after they complete the trip. “The whole idea started with the trip as the focus and then it was going to end,” Roberts said. “But the process of funding the trip and meeting the people and doing the work has been transformative for all of us. A semi-retired attorney whose brain features troves of facts about history, language, literature and opera, among other subjects, Lord won five games and more than $109,000 on the long-running TV quiz show hosted by Alex Trebek. His sixgame stint on the program finished airing Monday night. “It was a pretty good run,” Lord said. “Everybody eventually loses, and it sucks to lose, but it’s so exciting. It’s fun to win money, of course. But the fact that you could stand there and have this knowledge be useful was unbelievable. I can’t believe it’s over.” Lord, 60, plans to put his winnings towards an African safari next month with his wife and their 12-year-old twin boys. Raised in the San Fernando Valley, Lord attended UC Santa Cruz, graduated from law school at Santa Clara University in 1979 and spent more than three decades doing criminal and civil trial work for clients in the construction industry. He still practices on a semi-retired basis. Since 1993 he’s lived in Santa Monica, which he discovered on regular beach trips during his childhood. (In one of his oncamera interviews with Trebek, Lord revealed that his current Santa Monica prop-

erty was previously home to actresses Bette Davis and Greta Garbo.) “I went away to school and worked in the Bay Area, but I said, ‘If I ever come back to L.A., I’m living somewhere near the beach,” Lord said. “(Santa Monica) isn’t such a little city anymore, but it’s still one you can walk around. ... It’s one of the best places in the world to live.” About four years ago, after decades of watching “Jeopardy,” Lord applied to be a contestant. He took an online test and got asked to an audition, and he was told that he might get a call in the next year and a half. Months went by without any word from the show. “For some reason they emailed me to take the online test again,” he said, and eventually he returned for another in-person audition. Shortly after that he was invited to be a contestant. But there was a catch: Since he lives in Southern California, where the show is taped, he was scheduled as an alternate in case an out-of-town contestant couldn’t make it to the studio. “It’s a little frustrating,” he said. “You sit there all day and you watch everybody else. They tape five shows a day, and I didn’t get on. But they said, ‘We’ll call you again and you’ll get on next time.’” That was December. In February, he called to check in. Still no word. Then, in the last week of April, he was asked back to the studio. “You’re nervous, and you don’t want to embarrass yourself,” he said. “That’s the main thing.” jeff@smdp.com

ON JULY 15, AT APPROXIMATELY 9:45 P.M. Officers were dispatched to the 400 block of Washington Avenue to investigate the report of a subject trespassing in the fourth floor stairwell. Upon entering the stairwell, officers smelled a strong odor of smoke when they contacted the subject, later identified as Elisio Flores, 27 year old transient. As officers were getting ready to conduct a pat down search for weapons, Flores admitted to having a pocket knife and meth pipe in his possession. An additional search of Flores’ personal belongings rendered marijuana and credit cards registered to other individuals. He was arrested for possession of drug paraphernalia, possession of access card without cardholder’s consent and possession of less than one ounce of marijuana. Bail was set at $20,000.
