Responsibility to the Citizens ‘Simple Math’ could be the solution to all the front page comments about the rivalry going on between the City of Kerrville and Kerr County. While each is convinced that their historical and budget numbers are correct, they both argue that the other’s numbers are incorrect. All this with a little political ‘grand standing’ from both sides, including both parties drawing a ‘line in the sand’ on issues. This bantering dialogue comes from the elected officials on both sides: people I both know, respect, and admire for their public service. My feelings also tell me that both the City and County are sincerely convinced that their points of view are right. As a result of these things, it appears that we are no closer to a solution to the interlocal agreement controversy than we were a couple of months back. It seems that instead of marching toward some common ground and eventual agreement, the public perception is that they are just ‘jogging in place’. This lack of resolution is starting to wear on the public. Both the City and the County owe it to us, their citizens, to have open, honest, good faith negotiations on the critical interlocal issues instead of putting offers to each other on the table and then pulling them back off. And the non-responsiveness by both sides? Enough is enough. There is no reason or need for bringing in an arbitrator or mediator to settle these issues. I believe the aptitude and leadership are there for both the City and the County, but they need to develop concrete plans toward a unified resolution. While the issues of the library, animal control, environmental health, and the airport are important, they pale in comparison to the Fire/EMS issue. You 10

are dealing with people’s lives every time the alarm goes off. This is the number one priority and the citizen’s safety should be the first and overriding concern. Kerr County is not going to find a better trained and more responsive group of professionals than the Kerrville Fire Department/EMS. What is it worth to have dependable, top quality Fire/EMS? ...Priceless! You are paying premiums for Fire/EMS coverage that is on call 24/7. As for paying only for the services you use, let’s be serious. If you personally go for a year without any healthcare claims or auto insurance claims, do they give you your premiums back? Fire/EMS insurance coverage requires huge investments in fire stations, firefighting equipment and rescue/ambulance vehicles, people and continuous training. I have heard our Mayor say that our community needs a unified vision as to where we want to go. I agree with him. I also agree with him that we need an action plan to go with this vision that includes goals, objectives, strategies, and tactics. We used these same factors in the Marine Corps and we succeeded on most of our missions. Put ‘one upsmanship’ on the shelf, be open and willing in your negotiations, and be like Nike says: Just Do It! If the City and County can put all this other ‘stuff’ aside and use common sense and simple math, I feel they can reach a common consensus on the interlocal agreements. Hopefully, by the time you are reading this the City and County will have reached agreements on these issues.

Sports played an important part of my life, beginning when I joined my first basketball team, the Lady Celtics, when I was nine years old. Sports taught me discipline and teamwork. I try to apply those basic childhood lessons as an adult. How have your mentors affected you? My mother has always been my mentor. I was so proud when she had the courage to purchase her own business ten years ago. Throughout her life, Mom has also demonstrated how to achieve the right balance between personal and professional life, something I admire and am continually working on.

How are you taking Kerr County Abstract in new directions? Community outreach is an important part of my job. Volunteering provides opportunities for Kerr County Abstract to give back to the community. My job also includes staying informed and raising awareness about the title insurance industry. I oversee advertising, marketing, event planning, and public relations for the company as well. What do you like most about your job? I most enjoy volunteering in the community. Our business supports many worthy organizations, and I have had the privilege of serving as a board member for a few of these organizations. What do you like most about working with the Kerrville business community? I have enjoyed getting to know the many passionate people who work in the business community and appreciate their integrity and desire to make Kerrville a vital place to live for future generations. IN CONTROL? Power of Attorney Planning and Pitfalls by James M. McNeel

While most people understand that estate planning encompasses preparation of Wills and Trusts, lifetime instruments are sometimes an afterthought. However, a person is much more likely to become incapacitated due to accident or illness than die; therefore having a Medical Power of Attorney, Medical Directive and financial Power of Attorney in place is critical to prevent unwanted individuals or entities from dissipating or diminishing one’s assets and creating family strife. Imagine that you or a loved one becomes incapacitated, whether through illness, accident, or simply old age, and that you either have not executed any lifetime instruments (the general term for durable powers of attorney, medical powers of attorney, designations of guardians or living Wills). Or perhaps you executed such documents long ago without communicating to the agent that they would have those responsibilities. Alternatively, assume that a friend, caretaker, or other person comes in to assist you with managing your finances and/or assisting with your medical issues and has you execute such documents – specifically, a Durable Power of Attorney and/or a Medical Power of Attorney. Imagine you are in a position where you are totally dependent upon that person to assist you with managing your finances, taking you to the doctor, arranging for medications, food and other necessities. What are that person’s responsibilities and duties to you? What can you do to make changes or address concerns regarding that person’s conduct and is this the best plan heading into such a situation? 16

The Texas Durable Power of Attorney Act is found in the Texas Probate Code §§ 481-506. A Power of Attorney is a fiduciary relationship between principal and agent. Most banks will not serve in the role of power of attorney and therefore an agent under a Power of Attorney is usually an individual. Even if an agent acts outside of the authority granted by a Power of Attorney, he or she still has the fiduciary duty to the principal by the mere fact that they were named as power of attorney. An agent has the burden of proof to show that all transactions are fair to the principal. Under Texas law, an agent under a Power of Attorney is required to account under § 489B and therefore must produce an accounting of all activities, just like an executor or trustee would have to do under the Probate or Trust Code. There are two primary types of powers of attorney. One that is effective immediately upon signing the document and one that is known as a “springing” power of attorney, which only comes into effect upon the written opinion of a doctor that says that an individual is incapable of managing his or her financial affairs. While springing powers of attorney provide greater protection against abuse, they also sometimes prevent effective action as it can take time to get doctor evaluations and signatures to get the power of attorney effectuated. Powers of Attorney can also be held in escrow and only released upon the receipt of a doctor’s signature, or upon the instructions of the principal or some other third party. There is a statutory form for durable power of attorney found in § 490. The execution of a Power of Attorney requires a notary public, but does not require witnesses like a Will and therefore can be changed more easily. A new power of attorney bill is under consideration by the Texas legislature (H.B. 1858). It is based on the New Uniform Power of Attorney Act and appears to create some new safeguards from abuse.

A person can sign a Power of Attorney one day and then the next week sign another Power of Attorney revoking the prior Power of Attorney and so on and so on. This is one of the primary reasons why financial institutions are extremely careful about accepting Powers of Attorney and do not like to serve in such capacity. Powers of Attorney in the wrong hands are subject to great abuse because the individual serving as agent under a power of attorney will likely have complete control over all the principal’s finances without any oversight and without truly understanding the nature and importance of their fiduciary duties to the principal. Litigation in this area is rapidly increasing as children compete for control of their parents’ assets through powers of attorney. These situations sometimes ultimately lead to a guardianship proceeding which is cumbersome and costly. This situation can also arise with third parties that enter into the picture as a caretaker or friend and get control of an individual’s assets where immediate family members live out of state or are not available to assist with the financial and medical care of their family member. While not all such situations can be avoided, proper communication and planning can greatly reduce the possibility of a loved one being damaged by this precarious, difficult, and ultimately expensive predicament. First, proper planning while an individual has sufficient capacity is paramount. Secondly, and even more important, is communication of those plans with the individuals who have been named to serve as fiduciaries and also communications with any financial institutions regarding those designations, so that everyone is one the same page and there is no confusion should a situation arise where the power of attorney needs to step in and take action. Further, with proper planning, any sudden change in a power of attorney that occurs that is different from a long-

standing plan of which the prior principal and all financial institutions were aware of, will raise a red flag such that one of those individuals could immediately go to court and seek a restraining order or guardianship to prevent an improper power of attorney from wasting or diverting assets. Another alternative, when incapacity is expected or imminent and where a person has more time to plan for what could be a long-standing incapacity, is to set up a revocable trust naming either a financial institution or trusted individual as trustee and then placing all assets in that trust. When using a revocable trust for planning, a durable power of attorney is not necessary or only necessary in rare instances to transfer assets into the Trust. Most banks have Trust Departments willing to assist in this role. An agent serving under a Power of Attorney can also create a Trust and take the same action on shorter notice, if necessary, and if such a power is specifically granted. One might be concerned about the fees of preparing lifetime instruments and asking a financial institution to serve. However, when you consider the alternative of going to court to stop a power of attorney from wasting or diverting assets and the cost of a court controlled guardianship proceeding, proper planning in naming a financial institution or other trusted individual and communicating those plans is far less expensive. There are also significant non-financial costs where there is a failure to plan. It is very stressful and damaging to family relationships to have to go to Court to undo the actions of a third party or rogue family member simply because there was poor planning and communication. For individuals and families that spend a lifetime working to build businesses and accumulating assets, it is short-sighted to fail to plan for incapacity and to make sure that you, your assets and your family are protected. w w w. m y k e r r v i l l e . o r g

Forty years ago, the Texas Tourist

Development Agency decided that Kerrville was the perfect town to hold an annual Arts & Crafts Fair, which would feature juried fine art of Texas artists and artisans. They were right, and a tradition was born. Three years later Texas Arts and Crafts Foundation took over administration of the event. In1985 it became the non-profit Texas Arts and Crafts Educational Foundation. Through 2001 Schreiner University

hosted the fair with great success. Then a huge rainstorm of 2002 flooded the grounds. The staff of Texas Arts & Crafts immediately went looking for another location, and found a seven-and-a-half acre parcel by Flat Rock Park. It was basically raw land, thickly wooded and full of debris. But, by the time the next Memorial Day Weekend rolled around, a lot of hard work by the board, staff, and volunteers had turned the wilderness into

functioning, spacious fairgrounds with all the amenities – River Star Arts and Events Park. Penni Carr came on board in 2005 as assistant director and in 2008 when the director retired, she shifted into the executive director position. A Kerrville native, Penni and her family moved to Dallas when she was twelve. Ten years later she returned and had a variety of professional experiences: running a small print shop with her mom; working at Chili’s; being

part of the administrative team at Riverhill Country Club. None of her previous jobs were as much fun, or as much work as coordinating the Memorial Weekend Fair. “I start dreaming about it in April,” says Penni. “I keep a notepad by my bed so I can add to my to-do lists in the middle of the night!” Several days before the last weekend in May, artists from all over Texas will start arriving, plus food and beverage vendors, musicians, technicians, chefs, singers, and even ponies for the kids. Once the weekend is underway approximately 15,000 people will attend the fair. “It never seems crowded though,” Penni says, “because we have so much space.” This year the Wine and Beer Tasting Kick 26

Off Party will be held on Friday evening, May 27, with heavy hor d’oeuvres and music by the Grateful Geezers. “They’re a lot of fun!” says Penni. The winner of this year’s Commemorative Poster Contest is Kerrville artist Maureen Poorman, who received $500.00 for her fiber piece “Prickly Pear Fire” which was inspired by a painting by Clif Tinker. The image is also used on the cover of the fair brochure. A limited edition of forty signed and numbered prints, with certificates of authenticity, will be sold at the fair. Of the two-hundred artists who bring their work to show and sell, about fifty are new each year, and fifty are student artists. James Avery Craftsman underwrites $15,000 in scholarships, shared among eight of the student artists. “Many of the professional artists mentor the students,” Penni remarks. It’s a wonderful experience for burgeoning artists. Asked about challenges of putting on such a huge event, Penni remembers that, “Last year was the first year it didn’t rain. In 2007 we had the worst rain. It was actually funny. I was running around in the middle of the night, trying to save art work. We ended up moving things inside into what is now the Exhibition Hall. We almost called off the festival, but everything worked out. And people are such die-hards, they showed up anyway! Now we have sidewalks and are much more prepared.” The Children’s Activity Area has a Kids Only Art Gallery, Face Painting and a 10’x10’ “cave” where children can create cave art. They can do art projects and ride ponies. Fair-goers of all ages can watch demonstrations of painting, weaving, carving, pot-throwing and other media by Kerr County Cultural Center and Hill Country Arts Foundation. If you know someone with a beautiful singing voice, tell them to enter the Texas Star Talent Contest. If you love to cook, you can enter the Texas Star Grill-Off in steak and chicken categories. If you just like to eat, you can be a People’s Choice Judge. New this year, to celebrate the fortieth anniversary of the fair, Jack Ingram will perform in concert with the Beat Up Ford Band. The opening act is Mike Kelly and the Dirty Diamonds. The show starts Sunday at 7:30 p.m. “I’m so excited to bring a big name concert to the fair. What a great addition this will be,” says Penni. Ingram won the 2008 Academy of Country Music Top New Male Vocalist award. He’s known for his honky tonk “devil-may-care” style. Many will remember him as the writer/performer of the HEB Song which debuted at this year’s Superbowl. A ticket to the concert includes a Monday day pass to the fair. Texas Arts & Crafts Educational Foundation has eleven active board members. “I’m real fortunate to have a working board,” says Penni. “They don’t just meet monthly. Once we get


working on the fair, they’re here as much as I am. The Board of Directors really cares and they’re willing to be innovative and look for ways to make it bigger and better.” Penni is supported by assistant director Erin Lohden, and Malcolm Marcy who maintains the beautiful grounds. “One person could not do all this!” “The most fun part of my job,” says Penni, “is getting out into the community and being the face of the fair. A lot of people don’t know that this is the largest event in Kerrville.” Penni has served on the Texas Festivals and Events Association Board after completing the Texas Event Leadership Professional Program in 2008. She serves on the Kerrville on Main Street Board, Kerrville Arts Cooperative Marketing Committee, Mardi Gras on Main Committee, Kerrville Holiday Round-up Committee and the Rotary Casino Night Committee. She is a 2010 graduate of the Chamber’s nine-month long Leadership Kerr County, where she learned invaluable information about our area. In addition to the annual fair, the Texas Arts & Crafts Educational Foundation produces the Hill Country Acoustic Music Camp (with Bob Miller) in February and June; and an annual art show in Fredericksburg the Friday and Saturday after Thanksgiving. River Star Arts & Event Park is also available for private parties, reunions and conferences, and is the location of “Relay for Life” and “Bark for Life”. As if overseeing Kerrville’s largest event of the year and managing River Star Park isn’t enough, Penni will compete in “Dancing with the Kerrville Stars” on May 5th. Come root for this community dynamo who’s put Kerrville on the map as a destination for fine art, delicious food, good music and just plain fun. What can

you

do to help?

When adults think of young people, they often think of groups of them traveling together, sometimes achieving things for the good such as great plays, musical shows, or athletic performances, and other times creating havoc with negative displays of group behavior such as violence or vandalism. Regardless of how adults think of the group behaviors, though, the group “thing” or group “think” is a way our young people work through becoming an individual with a Positive Identify. They often reflect their sense of self off of those they run with. What can adults do to help a young person develop Positive Identity? How does a young person move from the group being his or her identity or identifier and develop his or her own sense of self? • Personal Power – the young person has a sense of control over what happens; help the young person set real goals, and a plan of action for achieving them. • Self Esteem – the young person feels good about him/her self; more than just saying “good job” all the time, this asset is grown by a relationship with an adult.

• Sense of Purpose – the young person believes “life has a purpose,” making a difference in the human condition by volunteering, and being listened to by adults in his or her world and being valued will grow this asset. • Positive Thinking – optimism about personal future; by engaging in conversations that look to the future and set realistic yet high ideals of what it will help look like will propel the young person past difficult, risky decisions. All of these actions can be done by all adults who interact with young people; certainly schools and parents are the first line of action, but supervisors, business owners, and the guy in the check out line can have a positive impact in growing a young person’s positive identity. Look to build assets each day to help Kerr County have positive future as the young people grow up to be our citizens and leaders of tomorrow.
