Uber is user-friendly. That doesn’t mean Uber respects you.

A

retired schoolteacher named Tom Alexander told me recently that he makes more than a thousand dollars a week driving for Uber. He wakes up at 6 a.m. on weekdays and is logged in and ready to shuttle folks around Kansas City until about 4:45 p.m., when his wife gets home from work. Occasionally, he also does weekend pickups and drop-offs.

“I tried for a long time to find a part-time job,” Alexander said. “I sent out 40 to 50 résumés and heard nothing back. With Uber, I applied, I had a new-enough car, and I was ready to go. Been doing it since September.

I’ve made $800 since Monday.”

This was on a Thursday. We were standing in the lobby at City Hall, waiting to pass through the metal detectors. Alexander and about 50 other Uber drivers were there to protest a City Council ordinance that Uber insisted would place such an excessive regulatory burden on its business model that it would be forced to cease operations in Kansas City.

“I’ve been in Kansas City 22 years, and it’s just now starting to wake up from a long, dead sleep,” Alexander said. “But when you have the City Council preventing a company like Uber from operating in the city, that’s going backwards. It screws everything up.”

Alexander’s frustration is misdirected. The reason that Uber may leave town is not because Mayor Sly James and the members of the City Council — who unanimously approved revisions to the ride-sharing ordinance on Thursday — seek to stifle competition to traditional taxis. It’s because Uber is making unreasonable demands on the municipalities in which it seeks to do business. The problem is Uber.

I wish that weren’t true. According to a quick scan of my e-mail receipts, I’ve taken roughly 40 Uber rides since the San Francisco– based company rolled into Kansas City last May. I summon Uber drivers to take me home from bars, and its services were especially convenient during the week this winter when my car was in the shop. Uber is almost always faster and cheaper than calling a cab. I’m a fan, and I found Alexander’s tale of newfound employment uplifting.

But there is simply no way for a reasonable person to review the facts and not conclude that Uber is in the wrong, both here in Kansas City and elsewhere.

Uber is a company that screens and hires people to drive other people to places they need to go, then takes a cut of the drivers’ fares. It is plainly a taxi company. But Uber proclaims that it is not a taxi company, and its entire business model is predicated on the company’s ability to convince people that what it does is so different from what taxi companies do, a whole new set of rules and regulations applies.

That is, no rules and no regulations.

Uber did not respond to requests for comment for this article, but across the street from City Hall on that Thursday, Uber’s Kansas City general manager, Andy Hung, told a crowd of reporters that Uber is “not a taxi company; we’re not a transportation company; we’re a technology company.” He later compared Uber with Orbitz, arguing that just as Orbitz connects travelers with airlines, Uber connects riders with drivers.

It sounded good when Hung said it, but the analogy doesn’t withstand scrutiny. For one, Orbitz doesn’t hire airlines as Uber hires drivers. And airlines are regulated by the Federal Aviation Administration, in the interest of public safety; pilots are required to be properly licensed and trained and to undergo background checks.

Uber doesn’t believe that cities and states should conduct background checks on its drivers and says it conducts its own rigorous background checks on its drivers. But these checks go back only seven years, and several instances point to insufficient rigor. In January, a Houston Uber driver who sexually assaulted a passenger was found to have previously served 14 years in federal prison for cocaine distribution. Late last year, the district attorney in San Francisco filed a civil suit against Uber, alleging that the company misled consumers about its background checks.

“If I have a cab driver that commits a crime, Regulated Industries is notified immediately,” says Bill George, owner of Kansas City Transportation Group, which operates Yellow Cab Co. in town. “That driver can’t hop in another taxi tomorrow because a notice goes out saying his or her license is suspended. When the city is the central clearinghouse, you can get rid of bad actors. With Uber, none of that is in place.”

The city, in its negotiations with Uber, initially proposed that it would do its own back-

ground checks on Uber drivers. Uber would not agree to that. So the city proposed that Uber share its in-house background checks with the city so that documentation could be on file.

Uber refused, citing privacy concerns: It said it couldn’t release the background checks without the consent of the drivers. The city then asked Uber to have its drivers bring their own background checks to the city. Uber: Nope.

(The city also revised the ordinance to exempt Uber drivers from having to take an Englishlanguage exam and a landmark exam.)

Another plank of Uber’s PR campaign is to characterize the city’s up-front costs for new drivers as overly burdensome. Let’s have a look.

Prior to the revision of the ordinance last week, a new Uber driver had to pay $300 for a permit; $50 for a driver’s certificate; $12.50 for an occupational license; and $22 apiece for two inspections — a little more than $400. At Uber’s urging, the city agreed to reassess those costs and went back with a proposal dropping the permit fee to $250 and eliminating the inspection costs if the company paid $10,000 up front to the city.

Uber’s answer: not good enough.

The city then offered an alternative. If Uber paid $40,000 up front, the city would drop individual drivers’ permit fees to $100. In this scenario, a new Uber driver would have to pay only $178.50 to get up and running.

Uber, a company recently valued at $40 billion, deems that amount too high.

There are some likely reasons for Uber’s preposterously rigid stance. One has to do with insurance. As taxi companies know, it is very expensive to insure a fleet of commercial vehicles. If Uber indeed has 1,000 drivers working in Kansas City, as it has said in press releases, the cost of insuring their cars would be astronomical. Instead, Uber shifts that burden onto the drivers and calls them independent

contractors, which gives Uber an enormous competitive advantage over traditional taxi companies. A recent BuzzFeed investigation found that Uber encourages its drivers not to get commercial insurance and instead to buy cheaper personal insurance, which leaves them, according to that report, “uncovered and in some cases leads them to incorrectly register their cars in violation of the law.”

Although some insurance companies, including Geico, have created new policies for ride-share drivers, most Uber drivers either can’t afford commercial policies or simply don’t purchase them. And many insurance companies are canceling the regular policies of individuals whom they discover to be driving for Uber or its ride-share competitor, Lyft.

One reason that Uber may be so resistant to sharing its drivers’ information with cities, then, is that insurance companies with access to that information might cancel the policies of contractors driving for Uber without commercial insurance. This would dramatically reduce the number of available Uber drivers, limiting the company’s business.

James indicated at the council vote that Uber was stalling in Kansas City while awaiting the passage of Missouri legislation that could allow it to disregard civic ordinances. The company has hired eight lobbyists to work in Jefferson City this session, according to filings with the Missouri Ethics Commission. In Kansas, a bill regarding background checks and insurance coverage awaits Gov. Sam Brownback’s signature; Uber is threatening to pull out if the bill becomes law.

That tactic worked in Idaho. After Boise passed regulations for Uber, the company lobbied the state Legislature and recently got a bill passed that allows it to bypass city ordinances.

It would be a mistake for lawmakers to yield to Uber in Missouri or Kansas. When I order a pizza from an app on my iPhone, the city still regulates the health and safety of the pizza place making my pie. There is no good reason that ordering a ride should be any different.

The standards that the city is asking Uber to meet are consistent with what it asks of any other company operating in the city — and, in many ways, the demands are fewer, thanks to recent amendments.

After the council vote, I found myself in an elevator with seven Uber drivers, all wearing blue shirts that read, “Save Uber.” The fact that their jobs with Uber were probably about to disappear was dawning on them.

“Unbelievable,” one said. “They just don’t care.”

He was talking about the City Council, but he should have been talking about Uber.

for his demotion, and that hard feelings about him were following him into the Sheriff's Office.

Morehead, who wouldn't comment for this story, testified in a deposition that on June 29, 2009, she e-mailed Roland the judge's criticisms of Seifert from the 1998 case. She couldn't recall when she and Roland first discussed the matter.

Rick Whitby, a deputy with the Sheriff's Office, testified that he had a conversation with Morehead in early 2009 about Seifert.

(Morehead couldn't recall that conversation in her deposition.)

Later that year, Morehead warned officers in training sessions about the pitfalls of having credibility issues, holding out Seifert as an example. (Seifert hired a lawyer, who demanded that Morehead knock it off.)

By 2010, Seifert lost his reserve commission with the Sheriff's Office, shortly after Bowling's trial against the federal government ended.

Seifert sued the Unified Government and the Sheriff's Office in 2011, claiming that he was being retaliated against for his testimony. A federal district court dismissed his lawsuit in 2013, but the 10th U.S. Circuit Court of Appeals last month reinstated his lawsuit.

n June 11, 2009, Max Seifert was summoned by Wyandotte County Undersheriff Larry Roland. Roland told Seifert that he was off detective duty with the Sheriff's Office.

Roland, according to Seifert's account of the conversation, said the Sheriff's Office had determined that Seifert’s credibility was in doubt. Seifert could be a liability for the department if he continued to work on investigations.

Seifert had retired from the Kansas City, Kansas, Police Department in 2005 after a decades-long career there. In 2006, he began helping the Wyandotte County Sheriff's Office with investigations. Until that 2009 meeting with Roland, he hadn't had any problems.

Roland, according to Seifert, had been told by federal prosecutor Terra Morehead that

Seifert had bungled a 1998 case that Seifert had handled for the KCKPD. Integrity problems spell trouble for prosecutors. By law, prosecutors are required to tell defense lawyers if a police officer testifying in a criminal case has ever been questioned about his credibility.

Seifert puzzled about why a 1998 case had suddenly created a problem for his work with the Wyandotte County Sheriff's Office.

Just six days prior to the meeting with Roland, the Unified Government of Wyandotte County/Kansas City, Kansas, had settled a lawsuit filed against it by a man named Barron Bowling.

Bowling in 2003 had been the victim of a severe beating by a Timothy McCue, a Drug Enforcement Administration agent, following a car accident involving the two men.

When Seifert investigated the accident, he reported that McCue was responsible for the collision and that the DEA man had then used unjustified and excessive force against Bowling.

Seifert believed that the KCKPD wanted to cover up McCue's actions at Bowling's expense.

The Bowling case marked a dark period for KCK law enforcement. Subsequent investigations and litigation showed signs that some members of the KCKPD feared that the department's relationship with the DEA would be harmed if McCue came off looking bad for beating Bowling. (A federal judge was sharply critical of the police department's actions, while also praising Seifert for crossing the "thin blue line" and testifying against his law-enforcement colleagues.)

Bowling was charged criminally for the altercation with McCue but was acquitted by a jury. That acquittal was due in large part to Seifert's testimony.

Seifert felt like a pariah in the KCKPD after the Bowling acquittal and ultimately resigned just before Christmas in 2005. He started to suspect that the 1998 case, in which a federal judge criticized his handling of a search warrant in a drug case, was a pretext

erry Lee Hooker was convicted in 1998 on charges of burglary, criminal possession of a firearm, and the 1997 first-degree murder of Daron “Bootsie” Lane in Wyandotte County. His trial was unremarkable, except for one fact: The prosecutor and the judge handling the case once shared a romantic relationship.

A filing in Hooker’s 2004 appeal describes how Morehead, who prosecuted Hooker when she was a Wyandotte County assistant district attorney, had once dated J. Dexter Burdette, a judge in Wyandotte County since 1988. Burdette presided over Hooker’s trial.

A stipulation entered into that appeal confirmed what many lawyers in Wyandotte County had long suspected: that Burdette and Morehead began dating in 1990, and called off their relationship early the following year. Burdette got married in 1993. Morehead did the same in 1997.

Paul Dent, Hooker’s trial attorney, didn’t have firsthand knowledge of the relationship, according to court records.

Hooker’s appeal raised the issue of impropriety, stemming from Burdette and Morehead’s relationship, but the Kansas Court of Appeals didn’t find that issue alone persuasive enough to reverse Hooker’s continued on page 9

Thin Blue Lines continued from page 7 convictions. Part of the reason: The relationship had ended well before the trial.

But a review of criminal cases in Wyandotte County shows that Morehead handled several criminal cases before Burdette throughout the 1990s, some of which occurred just on the heels of their breakup.

• In April 1991, James Massey was charged with kidnapping, attempted murder and child endangerment. Wyandotte County court records show that Morehead was the prosecutor on that case, and Burdette handled portions of the events leading up to trial.

• Morehead prosecuted the case of Lawrence Hill, accused on June 10, 1991, of sexual battery and indecent liberties with a child. Burdette presided.

• Morehead also prosecuted Kathryn Hartman, accused in October 1991 of sexual exploitation of a child. Burdette was the judge in that case.

• Morehead prosecuted the case of Willam Sells, accused of criminal sodomy in 1993, in a case handled by Burdette.

Subsequent media accounts place Morehead in Burdette’s court.

• Morehead prosecuted Sutton Lovingood’s 1995 trial on charges of sexual exploitation of a child. Burdette was the judge.

• Morehead prosecuted Charles Holmes, accused in 1995 of rape. Burdette was the judge in that case.

None of the cases between Morehead and Burdette found in The Pitch’s examination of Wyandotte County court records was overturned on appeal or showed apparent signs of irregularities. But legal ethicists say relationships between judges and prosecutors in the same jurisdiction create a conflict of interest or the appearance of a conflict.

“Judges shouldn’t sleep with prose­ cutors. Prosecutors shouldn’t sleep with judges. It’s that simple,” says Shaun Martin, a professor at the University of San Diego School of Law. “It creates too many conflicts when a lawyer is appearing in front of someone with whom he was once intimate.

If you’re charged with a crime and your continued liberty is on the line, you want your judge thinking solely about whether you’re guilty, not thinking about why the prosecutor ended the relationship or what he or she looks like naked.”

Neither Morehead nor Burdette responded to requests for comment.

Erik Oblasser, a criminal trial attorney who practices in Wyoming, says he would ordinarily ask that a judge recuse him or herself if he represented a defendant in front of a judge who at any time had had a rela-

“It’s got fishy written all over it,” he tells The Pitch.

The Kansas Code of Judicial Conduct’s Rule 2.4(b) reads: “A judge shall not permit family, social, political, financial, or other interests or relationships to influence the judge’s judicial conduct or judgment.”

Oblasser believes that rule would apply regardless of when a judge and prosecutor’s relationship transpired.

“Even after the relationship ended, you can see how Rule 2.4 could give rise to conflicts and impropriety,” Oblasser says.

“The two were together, and he knows her views, and she knows his. She will tailor her prosecution accordingly. The correct thing would be for him to recuse himself.”

Kansas judicial rules do not speak to any period of time that would pass after the relationship ended before a prosecutor could handle a case before a judge. “[I]t’s my view that a judge should never preside over a case in which one of the lawyers was someone with whom he’d previously had sex,” Martin says. “Even if it was 50 years ago. There are lots of other lawyers and other judges. There’s no need for a judge to preside over a case in which her impartiality may reasonably be questioned.”

Other jurisdictions also take a dim view of such relationships.

The Nevada Commission on Judicial Discipline leveled misconduct charges in 2013

against a family court judge in Las Vegas for carrying on a relationship with a prosecutor there.

Morehead left the Wyandotte County District Attorney’s office on September 12, 2002, after 14 years on the job. She ascended to the U.S. Attorney’s Office for the District of Kansas. During her tenure in Wyandotte County, and as a federal prosecutor, Morehead has gained a reputation for aggressively prosecuting cases in Kansas City, Kansas.

In 1997, she famously pursued felony charges against four men accused of burning a dog alive in Kansas City, Kansas, though Kansas didn’t classify animal cruelty as a felony at the time. (Seifert investigated that case as a KCK police officer.)

“She’s a controversial figure over there,” says former federal prosecutor and current private­practice lawyer John Osgood.

Osgood has his own history with Morehead. He defended Kenneth Lain, a Lee’s Summit man indicted in 2010 for driving a gun from Missouri into Kansas and giving it to an acquaintance, without a firearm dealer’s license.

Lain said he wanted to give a gun to Carroll Hill, his family minister, who lives in Shawnee.

The charge against Lain wasn’t strong to start with, and it got flimsier when Morehead added another count to the indictment against Lain. She charged that he had committed the gun crime while being under indictment in Missouri.

But a quick check of court records would have shown that the earlier charges had already been dropped. The day after Morehead amended her charge, she walked back that second count.

The case got worse when it went to trial.

Hill, Morehead’s star witness, filed an affidavit saying that in pretrial meetings, Morehead seemed interested in pressing the case against Lain because she was concerned about Lain’s erratic behavior.

The jury took less than 30 minutes to deliberate before acquitting Lain.

f Morehead had been concerned about Seifert scuttling a 1998 drug case, she should also have worried about Larry Roland’s work on a 1996 drug case.

Roland was a Kansas Highway Patrol officer when he stopped a beige Chevy truck hauling a horse trailer on Interstate 35, near 175th Street. Roland later testified that he made the stop because he had seen the truck travel briefly on the shoulder of the road.

Roland approached the driver, Raul Aguilar, to collect his license and insurance information. Aguilar was driving from Las Vegas to Iowa, with a stop on the way in Oklahoma, to drop off some horses.

Roland ran Aguilar’s name through various crime databases, none of which indicated outstanding warrants.

During the stop, the dashboard camera in Roland’s patrol car turned off. (Roland later testified that the camera had run out of tape, an explanation that a federal judge found dubious.) No longer in view of his cruiser’s camera, Roland began inspecting Aguilar’s truck. He asked Aguilar to get out of the vehicle.

Roland believed that Aguilar might be transporting narcotics. He called on another trooper to summon drug dogs.

Roland told Aguilar to follow him to the Kansas Highway Patrol office in Olathe.

Once there, Roland had Aguilar show off some rope tricks while a drug dog searched Aguilar’s truck. The dog detected a whiff of cocaine, and Aguilar was arrested.

A federal judge presiding over Aguilar’s case found that Roland had illegally detained Aguilar, and he ordered that the evidence recovered from the traffic stop be thrown out. Federal prosecutors quickly dropped their charges against Aguilar.

any of the main players in the BowlingSeifert affair have kept their jobs. Some have been promoted.

Ron Miller, the KCKPD chief during the Bowling case, was last month confirmed by Congress as the U.S. Marshal for the District of Kansas.

When asked if Barry Grissom, U.S. Attorney in Kansas, recommended Miller’s nomination, office spokesman Jim Cross responded in an e­mail: “U.S. Attorney Barry Grissom continues to think that Ron Miller is a perfect fit for the job, given his outstanding background in law enforcement.”

Grissom did not respond to a follow-up letter asking if he had personally recommended Miller for the job.

Miller testified that he had no firsthand knowledge of, or involvement in, the Bowling affair, but Seifert seemed to fall out of Miller’s good graces afterward. One day after Seifert retired from the KCKPD, Miller placed in Seifert’s personnel file a finding that Seifert had violated protocol by talking to Bowling’s defense attorneys without authorization. Because the wrap-up of the Internal Affairs investigation against Seifert coincided with his retirement, Seifert says he was unable to protest the finding.

Terry Zeigler, the captain over the KCKPD’s Internal Affairs Unit at the time, is now the chief of the entire department.

Timothy McCue, the DEA agent who beat up Bowling, still works for the DEA in its St. Louis office.

or Hayley Besheer, underwear is about more than just feeling sexy. The 26-yearold creator of MADI Apparel knows that an unrivaled pair of underpants can boost a woman’s confidence as much as a great haircut or a signature lipstick shade.

“Making women feel great about themselves is one of the main things we support,” Besheer said when I met with her and her intern, Joe Mercado, at MADI’s new West Side storefront, which opened with a First Friday celebration this month. “The MADI movement as a whole is about positivity and body awareness.”

Besheer exudes just that kind of calm selfassurance. On MADI’s opening night, she wore a poppy-colored skirt and matching lipstick, making the tall brunette easy to spot from across the room as she greeted her guests inside her clean, minimalist shop. Several varieties of black underwear were displayed on the glazed-wood table at the center of the room. Each style bore the name of an influential woman in Besheer’s life, and each made the case that MADI is the anti–Victoria’s Secret — no-frills, no-bullshit underwear that feels as good as it looks.

I first discovered MADI when I stopped by artful Crossroads lingerie shop Birdies March 5 for the brand’s retail release. (It had begun selling online last August.) An adorable, burritosize dog surveyed the scene from an antique chair in the corner, and Besheer’s mom, Pam

With Birdies owner Peregrine Honig as my guide, I bought a pair of MADI’s basic, low-rise black briefs, as well as a sexier thong with a wide lace band. donating to disaster-relief efforts and rape clinics, “hitting the sanitary need but also the intimate need,” she told me. “It’s a dream to start a company and feel passionate about it,” Besheer added. “We’re making a difference, and it’s exciting every day.”

It’s also exciting that I have a place to go when I need just the right thong to wear with my skinny jeans — and few things boost my confidence quite like that.

lassical pianist, composer and teacher Seymour Bernstein, 88, has inspired hundreds to make classical music their life and has introduced countless people to the work of old masters through his concerts in unusual venues (including war zones) and on his YouTube channel.

And now, thanks to four-time Oscar nominee and first-time documentary director Ethan Hawke, he’s also a movie star.

Hawke’s Seymour: An Introduction (which opens here Friday) follows Bernstein as he mentors students, explains his philosophy, and prepares for his first solo concert in de-

cades. It also features former and current pupils as they discuss the impact he has had on them, even if they never played grand concert halls. The Pitch called Bernstein in New York to ask him about the movie.

The Pitch: Seymour: An Introduction suggests that being a performer requires a completely different skill set from being a teacher.

Bernstein: I’m not sure that’s absolutely true. Not all performers make good teachers.

Some of us don’t even want to teach, so the ability to teach seems to be a separate ability. I think you have to want to identify with other people and help them.

In honor of the 30th anniversary of Back to the Future, co-screenwriter and producer Bob Gale is presenting a new Digital Cinema Package 2K version of the film at 7 p.m. Saturday, April 18, at Cinemark Palace on the Plaza, as part of the Kansas City FilmFest (April 16–19).

“Having supervised the post-production as well, this DCP looks better than the movie ever looked in the theater,” Gale tells The Pitch.

I realized very late in life that the reason that I love to teach is because I want to help my pupils feel good about themselves. If I can contribute to doing that, then it’s a privilege.

Some of the most interesting moments in the movie happen when you’re talking with New York Times architecture critic Michael Kimmelman, a former student of yours.

What’s your connection like?

I taught Michael when he was 5 years old, and I’m still teaching him. He’s approaching 60. You get to know a person intimately, especially when you teach them music.

Music is a language of feeling, so you deal very deeply into the emotional world of your pupils.

Do you think he wound up a better architecture critic because of the way you coached him as a pianist?

Definitely, no question about it. Michael Kimmelman, he plays like a professional.

You would think that because he’s not a professional musician that he does not play as well as a professional, but he does. He’s one of the most formidable pianists I know.

Studying music develops every part of you because it requires an emotional, intellectual and physical involvement, mainly everything that constitutes you. So when Michael develops all of his being, it tends to affect his work as a reporter and everything else that he does in life.

Watching the scenes when you recount your years of performing professionally, I wondered if performing on a regular basis got to be a lonely life.

I was never lonely. I’ve always been teaching, since I was 15. There’s nothing lonely about being with the music that was created by the greatest figures that ever walked the face of the earth.

Do you think you have a skill set that other performers might not have in getting outsiders to like classical music?

I think that I do. I think that they recognize that what I’m conveying to them is that I’m serving my art in a humble way and playing by placing my art above myself. I think that they sense that.

When describing your early life in the film, you mention that you didn’t have even a record player, much less a piano, when you were a small child. Do you think being denied music made you want it more later?

It’s possible that it’s true. I was never taken to a concert till I was 12 years old. I think, as a matter of fact, I benefited from that because I created my own world.

What was your own world like?

Well, it was sublime, and music is the most sublime of the arts. So what better world could I have created?

His concern is partially due to being a 16-year-old high school student. In less than an hour, Tappan explains how Brownback and the Legislature’s attempts to imitate the income-tax policies of Texas and California don’t work here because we don’t have the Lone Star State’s oil revenue, and the Topeka Zoo isn’t as big a tourist draw as the Pacific Ocean. Tappan also persuasively demonstrates that effective schools pay back their communities by providing employers with a workforce that can meet their needs.

The first thing Affäre’s bar manager, Chelsea Almeida, offers me when I stop by is not a beverage but a spoonful of a gooey, lumpy, brown mixture.

“I made this bacon-raisin jam,” she tells me. “I’m not sure how it turned out.”

I can smell it from across the bar, and she holds up a teeny-tiny teaspoon for me as I approach. I’m rewarded with an intense taste of something sweet, spicy and delightfully fatty.

This is Almeida’s garnish for the Strudel Deux, a toasty take on a whiskey sour.

“I wanted to use spices but still make a refreshing drink,” Almeida tells me as she begins mixing ingredients. “Nutmeg is a really prevalent spice in German cooking, and I was inspired by that and our apple strudel, which is this really incredible dessert here. So for the drink, I used a lot of the spices that we use in that — nutmeg and cinnamon and raisins. Plus some bacon, obviously.”

the River Market, and Thompson, the restaurant’s bar manager, flits between pouring beer and opening wine bottles. “I actually worked at Garozzo’s and the Midland and various concert halls. That’s when I was first able to really get creative with bartending, with dessert drinks.”

Dessert plays one serious role in Thompson’s B&B cocktail. The other chief inspiration, though, is a legendary man and his legendary snack: Elvis and his fried peanut butter–banana-bacon sandwich.

“For this one, I fat-washed Journeyman’s Featherbone [her practice bourbon] with some bananas and peanut butter,” Thompson says.

How? “I heated the peanut butter and two sliced bananas over low heat, then added a bottle of bourbon, then threw it in the freezer for a few hours,” she explains. “The fat turned to solids, and I scraped that off.”

Ah. Then come the heavy cream, the Spirits of St. Louis Vermont Night — a bitter base liqueur with a heavy maple-syrup profile — and the simple syrup. The result looks like horchata but tastes like — seriously — liquid bananas and peanut butter. I get just a hint of bourbon, enough to let me know that some alcohol is hidden away in there. The bacon sugar invites me to keep sipping until I’ve effectively licked the glass clean, sophistication be Elvis-damned.

Thompson watches me and f lashes a wicked smile. She says, “It’s good to be a little indulgent sometimes, isn’t it?”

When you find him at the Local Pig Westport, where he’s the bar manager, he’s usually smiling, pouring a beer, mixing a drink, carrying around supplies — regular bartender things. But Mariscal, who comes from a cooking background, has a lot more in common with, say, a chef than he has with his fellow barkeeps. Herbs and fresh ingredients play big roles on Mariscal’s menu.

So I knew to expect a vegetable-focused cornucopia when I asked Mariscal to whip up his B&B cocktail. But I still didn’t expect to

Rachel Freeman does not come across as a shy woman. She’s got a throaty voice, and it gives way to a deep laugh that pushes out of smiling lips that are usually painted a striking red. She’s excellent at giving side-eye, but she is also — like any bartender worth her salt — completely relatable.

Freeman’s drinks are also not what you’d call introverted. When I stop in to see her at Cleaver & Cork, just a few weeks after our bourbonfilled Bartender’s Notebook, Freeman is ready to smash me in the face, figuratively speaking, with a hard-liquor punch. In the nicest way.

“The cocktail on Thursday will have Grade B maple syrup,” she tells me as I try her terrific creation. “But here I’m doing some of my runny honey, which is half honey and half hot water, so it’s thinner and pourable and mixable. I’m also doing orange and Angostura bitters, and I’d like to use maple bitters, but I’m without those today.”

She has gone with chocolate bitters instead, making for a drink that looks deceptively like a regular old fashioned but takes a detour toward pure luxury.

“The one at Bacon & Bourbon will be a little smokier,” she promises. “You’ll have to try that one, too.”

A

pril 14 is going to be busy for local liquorstore clerks. Blame Boulevard. And praise Boulevard.

The Kansas City brewery is unloading two of its biggest releases — Love Child No. 5 and Saison-Brett — this month. And that’s not even close to all: Cans of Unfiltered Wheat, Pop-Up IPA and Ginger-Lemon Radler are on the way.

If your mouth puckered after drinking Love Child No. 4, you weren’t alone. Last year’s model was unrelentingly sour — so much so that even Boulevard’s brewers took note.

“While I enjoyed Love Child No. 4, over the course of a glass or a bottle, it never softened up,” says ambassador brewer Jeremy Danner.

Look for less acidity with Love Child No. 5 (8.2 percent ABV and 13 IBUs), a blend of a Flanders-style red ale aged in whiskey and wine barrels and in stainless-steel vessels and a foeder. Danner calls it “more balanced” than the last go-round. “I think people who enjoyed Love Child No. 3 more than No. 4 might particularly enjoy 5,” he adds. “It’s more about soft lactic acidity, which is what Steven [Pauwels, Boulevard’s brewmaster] prefers, and that’s what our tasting panel and the blending panel prefers.”

This is the first of two Love Childs in 2015.

Love Child No. 6 debuts in December.

“Our collection of barrels that are inoculated with other souring bacteria or wild yeast have grown to the point where we have

enough beer in barrels that we could do two blends this year,” Danner says. “So we figured it would be kind of cool to do that.

But first there’s Love Child No. 5. “I hope I don’t create a frenzy, but people should look for a few kegs of Love Child No. 5 to show up at beer festivals or events,” Danner says.

“There won’t be any that go into bars for regular draft, but I have a handful that we’ll pour at some of the upcoming events.”

Like, say, the Parkville Microbrew Fest Saturday, April 25. Also, there’s a good chance that Foeder Projekt No. 1 makes it to English Landing Park.

And this year’s Saison-Brett? It’s only Boulevard’s best beer, according to Danner.

“I believe that to be fact,” he says.

Strong words for a strong farmhouse beer (8.5 percent ABV and 38 IBUs) that delivers funk and fruit.

“Every bottle is kind of a tiny fermenter,” Danner says. “Each bottle is going to be slightly different due to the nature of Brettanomyces and the wild yeast and the wild fermentation.”

The funk gets more pronounced with age (Saison-Brett has already been bottle-aging three months prior to release), but don’t get carried away. Danner doesn’t recommend keeping it in the cellar longer than 18 months.

“It is neat to see, as the wild yeast comes on, a more funky, earthy, tropical-fruit,

alongside brand-new cans.

Boulevard’s Love Child No. 5 shows up

“I feel if you go too far, the body thins out, and it gets a little too funky, a little too far gone after a while. I think it’s a beautiful beer fresh.”

Also fresh are Boulevard’s new cans, which hold familiar styles — Unfiltered Wheat, PopUp IPA, Ginger-Lemon Radler. Danner expects demand to be high for Ginger-Lemon Radler, which is produced only from April through August, and which fans have long requested in six-packs. (Meanwhile, GLR and Heavy Lifting IPA will be on draft soon.) Deliveries started earlier this week, and cans should be showing up at your liquor store on the usual delivery day.

Danner admits that he takes joy in smashing the occasional Boulevard can. He took even more pleasure in seeing Boulevard cans at tailgates on opening day at the K. But he realizes that there have been some concerns about production.

“We don’t want year-round beers to be hard to get,” he says. “But it’s better to have the beer to go a little too quickly than have it sit around on shelves and get old. We want to make sure we’re doing the best thing for the beer.”

Up-Down arcaDe bar opEns Friday

ame on. The Up-Down arcade bar opens its doors at 101 Southwest Boulevard at 5:30 p.m. Friday, April 17.

Last November, The Pitch reported that Des Moines–based entrepreneurs Josh Ivey, Sam Summers and Rafe Mateer would be turning the former home of Hamburger Mary’s into a pixel paradise.

After months of renovations, Mary’s flamboyant, purple kitsch is out. In are vintage 1980s and ’90s arcade games. Ivey believes that one of the older models, Asteroids, dates back to 1979. “It still has a black-and-white vector screen,” he says.

The classic-game emporium promises arcade favorites (Pac-Man, Donkey Kong and a six-player X-Men game), 58 beer taps, craft cocktails and a food component, although Ivey says that “will come shortly after Up-Down opens.” And don’t worry, the best public patio in the Crossroads remains intact.

Be warned, parents, that Up-Down is a 21-and-older arcade. Better book a sitter before you grab that roll of quarters.

Drugs & Attics starts thinking beyond a phone-recorded EP.

onday nights at the Union in Westport are not like other nights in this bar.

Usually, the place operates as a happy neighborhood hatchery of drunken dancing and antics, the basement-level space fostering more body heat than a middle school gym class. Not Mondays, though. On those evenings, there’s no cover, and there’s a pretty dependable lineup of local bands.

It is on such a Monday that I’ve come to see Drugs & Attics, a trio of guys playing what they call, with neither much irony nor much finesse, “boogie party music.”

A few minutes after midnight, the band — outfitted in mostly matching white shirts and black neckwear — take the stage outside.

It’s warm and springlike, but there are maybe 40 people here, of whom fewer than half notice that music is about to start.

That changes as soon as Drugs & Attics begins to play.

There’s really no ignoring these guys.

Drummer Brett Livingston, 30, is a joyful maniac behind his kit. Bassist Andrew Paluga, 26, pulls some impressive bass faces, a lock of his meticulously coifed hair falling across his forehead. And 21-year-old guitarist and lead singer Willie Jordan (also of Yes You Are) is an eye-catching force, his dark, tangled curls moving with every nod of his head, his head moving with every driving guitar riff. And there are plenty of riffs.

Drugs & Attics doesn’t venture far from crusty garage punk, with scuzzy guitars and offbeat humor (see songs “Drug Party,” “Tripping Me Out” and “The Highlife”). And its output isn’t deep yet, just a six-song EP — Meltr, recorded on Livingston’s phone — on a Bandcamp page. But somehow, the band sounds unlike what you usually hear around Kansas City. The songs are punk-show short and loud as hell, and they wear their influences front and center — Jack White here, Motown there — via the jagged edges of Jordan’s guitar and the deep, knowing bend of Paluga’s bass. But sophistication also swirls through the grit.

Three-part doo-wop harmonies thread their way through a handful of songs, contrasting the enviable centerpiece of Jordan’s voice.

Jordan sings like a Muppet who has been smoking a pack a day for a decade. His voice is a wild instrument, full of scratches and character. As the band rolls through “Not So Tuff,” Jordan’s voice suggests an ace audition for a metal band; one song later, he’s back to a poppier coarseness, carrying the melody in a way that brings to mind Deer Tick’s John McCauley.

“That is not what I expected this band to sound like,” I hear an audience member behind me say to her companion. “This is awesome.”

If the members of Drugs & Attics are being honest, they didn’t really expect to sound the way they do, either. The band came together a year ago March, when Jordan — then still a student at the Kansas City Art Institute — posted on Facebook for potential bandmates. He tells me this upstairs at the Union, seated on a couch in the unused top bar, ahead of the band’s set.

“It sounds kind of funny now, but I was totally serious,” Jordan says. “Brett was the only person to respond.”

Livingston nods. “I’d seen Willie play bass in another band that he was in at the time, and I knew he could shred. And I was like, ‘I’m down. I don’t really have a lot going on right now. Let’s play some tunes.’”

“It was just the two of us for a long time,” Jordan says. “Brett had found a drum kit in the basement of his apartment, and I had a guitar and an amp. We didn’t have any microphones or a PA. I was just kind of on the outs of art school, getting ready to leave, and I was feeling kind of down. I needed something to focus on, and music had always been that.” Paluga joined them this past February.

They haven’t changed into their stage suits yet, and Jordan is wearing denim cutoffs and duck-printed purple socks. He sits between Livingston, who is wearing a paint-stained sweatshirt, and Paluga, whose leather jacket gives him a vague greaser vibe.

They seem mismatched — a far cry from the uniformed trio that will dominate the Union’s stage in 45 minutes.

High on sounds: Drugs & Attics explains, laughing. The others laugh with him but they’re not really joking. Unity is important, Jordan says. It makes them feel like they’re a little more put-together.

They need that feeling: We are speaking less than two weeks ahead of Record Store Day on Saturday, April 18, when the band is scheduled to play the free block party at Mills Record Co., and there isn’t a single hard copy of Drug & Attics’ music to sell in person. Yet. “We’re battling with ourselves,” Jordan admits. “Like, we just need to make something and have it in the next couple days and give it to people. We’ll burn CDs or find some nerd with a tape duplicator. We’ll have something for Record Store Day.” Jordan shrugs. There has been a little more recording beyond Meltr but nothing in a studio, nothing that matches the polish all three players hope to achieve.

“We want it to sound good, you know?”

Jordan says. “We want it to be a good record.

We come from a sort of punk aesthetic, but we don’t want to use that as a crutch. We don’t want to be, like, ‘Oh, yeah, we made these shitty recordings. Here you go, this is us.’”

Later, during Drugs & Attics’ set, the number of invested listeners has tripled in size.

It’s an audience of interested, attentive faces — plenty of fans in the making, ready to wait for the right Drugs & Attics album.

Renowned pianist and composer Stan Kenton said his orchestras played “progressive jazz.” These compositions weren’t jazz like what grew out of Kansas City.

Kenton experimented. From the 1940s through the 1970s, his big-band music was known for advanced harmonies performed with power, and it remains among the most respected in jazz. Locally, for more than a decade, Kansas City Jazz Orchestra (KCJO) has set the standard for big-band concert-hall professionalism and excellence. Its concert series is a staple of the Kauffman Center for the Performing Arts. Friday night, led by artistic director and trumpeter Clint Ashlock and featuring 17 of the best musicians in KC jazz today, KCJO stretches its artistic chops playing Kenton’s music.

echnically, Randy Raley is a classic-rock DJ, even if he’s not entirely sure what makes a rock song classic. But why ponder the semantics? Whatever people want to call his brand-new radio show on KKFI 90.1 is fine with him. The point of The Time Machine is to deliver a good time from 6 to 8 a.m. every Thursday.

The show, which kicked off March 19, is a return to the booth for a broadcast veteran.

Raley started in radio in 1971, when he was the midday announcer at Quad Cities station WXLP. He did time at KYYS in Kansas City and at a couple of stations in St. Louis before ending up at the helm of KCFX’s morning show here. He left that classic-rock gig to take a sales job in 2004.

Why is Raley back on the air? I called him to ask.

The Pitch: What sets Time Machine apart from the classic-rock programming we’re used to on commercial radio?

Raley: I’m not limiting myself to playing what’s strictly considered classic rock. The songs I did last week, for example, were all from 1967. The charts then had Frank Sinatra and all this Motown stuff. I played music from Marvin Gaye and the Supremes and Sinatra. I played songs that were popular in the spring of 1967, plus clips from some old TV commercials and some old TV-show theme songs.

It’s sort of a tour de force of things that were happening back at that particular time.

This week will be the spring of 1978. I’m not sticking to one particular genre or time period. I’m just moving it around and playing the songs that were popular on the radio at that particular time of year. Whatever was on the chart at that time, in the year I choose, that’s what the show is about.

The definition of “classic” just keeps growing as the years go by. How has your job changed over the years?

Yeah, it’s funny. The new songs that I was playing on the air, back from 1979 to 1985, are now classic rock. I was kind of one of those guys who got caught between, like, “What is rock and what is classic rock,” and I guess you would call my time at KCFX classic rock because that’s kind of what they do. But at the same time, I was kind of one of those guys that was like, “Wait a minute, I played all those songs when they were new!” It’s kind of strange.

To give you an idea of how that works, the songs that I listened to when I was a kid, they were called “oldies” for the longest time, and now those songs aren’t even being played on the radio at all, none of them. The thing about the show that I do is that 90 percent of the music that I play, you won’t hear it on the other radio stations in town because they’ve got the

set playlist they have. Like, 1967 wasn’t just the Beatles and the Doors and Jimi Hendrix, you know? There was a lot of stuff going on, and that’s what I try to keep in mind. I try to increase the boundaries a little bit.

The circle-of-life thing — the old is now the new — must seem redundant to you.

The thing about it is, people talk about the music being so much better way back when or whatever, but honestly, we had our share of crap, too. Radio does what radio does for a reason. They have piles of research and consultants. But I can tell you that I never want to hear “Sweet Home Alabama” or “Dream On”

by Aerosmith ever again, and that’s what this show is about. Led Zeppelin — my God, you hear the same 10 songs being played, but hell, they had 10 albums. My generation didn’t stop at one song on the album. We listened to the whole thing. There’s a lot of good stuff that’s played on Top 40 radio, but we want to do something different. There are a lot of great songs that people heard and then they forgot about, and when I play those and people remember them, it’s like an “oh, wow” factor.

You’ve got kind of an impressive radio résumé.

What attracted you to KKFI and community radio?

Here’s the thing: I’ve been doing the job for 32 years. For 32 years, I always had to follow somebody else’s playlist. And that’s fine, that’s someone’s job, and you had a pretty wicked playlist, but really, you couldn’t mess with it much. Now I get to go in and do it for fun. That’s the agreement with Barry [Lee, station manager] that I have. If it’s fun, I’ll be there every morning at 5. That’s the agreement, and Barry’s been very supportive of it.

It’s really fun. I’m not getting paid anything to do it, and that’s OK. It’s just a fun opportunity to go in and do what I do.

I went to college to learn how to be a DJ, and I had a great run at it. I was on the radio for 32 years without much of a hitch either way, but then the really cool radio jobs started to go away. I really haven’t done a regular show in a long time. So when they said, “Hey, man, just come in and play what you want,” I thought, Well, why not? It’s a pretty great slot — a lot of people listening between 6 and 8 in the morning — and if I can keep that and still do something on local radio, I’m happy.

Anyone who came of age in the 1980s will recognize the sounds on George Lewis Jr.’s latest full-length, Eclipse. It’s a synth-tastic expedition of that decade’s pearls — from the epic drum parts falling like ground-shaking footsteps to the melodramatic our-loveversus-the-world lyrics. Sufjan Stevens’ latest, Carrie & Lowell, is one of the year’s best albums. Its title is simple, but its content is not: The real-life Carrie and Lowell are Stevens’ mother (who died of cancer in 2012) and his stepfather, and the album explores the themes of death and loss.

It’s sobering and delicate, with a contemplative Stevens searching for answers (“The Only Thing”) and remembering a heartbreaking final conversation with his mother (“Fourth of July”). His voice rarely climbs above a rough whisper on Carrie & Lowell, rising just over the sweet and shimmery piano and guitar chords, but his words are always clear, and they carefully and completely break you down.

Sean Scolnick, the Pennsylvania native who performs as Langhorne Slim, has not released a record since 2012’s The Way We Move, but that’s fine. His catalog is already pretty rich and all but timeless; any of his songs would fit in between Woody Guthrie and Bob Dylan on a playlist, and it would take a serious crank to object. Scolnick may not be reinventing the wheel when it comes to folk, but his rough-hewn, mud-caked voice is a comfort. Scolnick is touring now with his band the Law, ahead of the summer release of an as-yet-untitled album.

I want to be comfortable with it, but I’m just not there. When I’ve expressed my discomfort, it has made him upset and embarrassed. Another confusing thing: My vagina always gets way wetter than usual when he puts a diaper on me.

Dear Dan: I consider myself a straight guy, but for the last four years, I’ve been having an affair with “Connie,” a trans girl I met online. It was just casual at first, but over time we developed a deeper personal relationship but kept it hidden.

At some point, I figured out she was in love with me. I love her, too, but I don’t think I am “in love” with her. Several weeks ago, I went on a couple of dates with a girl I met on match.com.

The new girl posted about our dates on Facebook. Connie saw it and was upset, and then Connie outed me to the new girl. The new girl and I weren’t dating anymore, but it still was a betrayal that Connie told her — told anyone — about our relationship and my kink. Right now, I can’t look at or speak to Connie, but her friends tell me that she is despondent. I can’t get past my anger. I’d like to keep her as a friend, but can I trust her? She reached out to me recently, but I told her to just leave me alone.

Dear STUNG: “Right out the gate, STUNG has to declare his heterosexuality,” says Bailey Jay, an AVN Award–winning trans porn performer, writer, prolific (and hilarious) tweeter, and cohost of The Jim Norton Show on vice.com. “Unless he’s trying to say that trans women are men or that he’d be mortified to be mistaken for a gay person, then emphasizing ‘straight’ is unnecessary.”

Also unnecessary: the “but” after “I consider myself a straight guy.” Guys who desire and fuck women exclusively are straight, trans women are women, so no need to drop a “but” before telling us you’ve been sleeping with a woman who happens to be trans.

“The term ‘kink’ stuck out as well,” Jay adds. “Sex with a trans woman can still be vanilla. I know lots of trans chicks who are a total bore in bed. So while something new can be exciting, sex with trans women is not innately kinky because of our bodies.”

Vocabulary lesson’s over. Now the advice …

“STUNG says he feels betrayed by Connie blabbing about their relationship,” Jay says, “but it sounds less like a betrayal and more like embarrassment. The whole tone of his letter seems to imply that it’s a given that being with a trans woman is innately shameful. But take out all of the conditioned negative associations that some have with trans people, and what are you left with? At worst, we have a young lady who got jealous and acted immaturely.”

Let’s pause to think about why Connie behaved immaturely and tried to screw up your (already DOA) relationship with the new girl.

“STUNG seems to feel that it’s a given that Connie should know better than to talk openly about their relationship,” Jay says, “because trans women are an embarrass-

ment, and Connie should know enough to keep quiet.”

So you treated Connie like she was an embarrassing secret for four long years, and that caused her pain. You caused her pain.

Then you go on a couple of dates with another woman — a cis woman — and it’s instantly all over Facebook. Connie was understandably upset, and not just by the fact that you were seeing someone else. All the hurt and anger that built up over the last four years — hurt at the way you treated her, anger with herself for putting up with it — overwhelmed her, and she lashed out. Connie isn’t a bad person. She was just angry and upset.

“And I don’t think STUNG is a bad guy,” Jay says. “His attitude toward trans women was shaped by a culture that treats trans women as either fetishes or punch lines. I’m a transgender woman, and I have my own internalized transphobia that I’ve had to navigate around. So while I can dissect and analyze STUNG, I can hardly vilify him.”

So what do I think you should do about Connie? You should call her and apologize.

You should tell her that you treated her badly and you can understand why she lashed out.

And you should tell her that, while you aren’t “in love” with her, you do love her. Then you should tell her that you’re open to meeting up and talking things out.

And what does Jay think you should do going forward? “I think STUNG should try to see every woman he sleeps with as fully human, regardless of their genitals.”

So you’re not consenting from a place of honest desire (a desire to do a particular thing, a desire to please your partner) but from a place of fear — you don’t fear him but you fear hurting him. No wonder it leaves you feeling like shit.

Here’s what you should say: “Hey, honey, it’s great that you have a fetish, and I’m glad you felt comfortable sharing it with me. But I don’t enjoy it and I don’t think I ever will.

So this is something you should explore with other people. Get yourself a diaper pal, play to your heart’s content, and then come home and have awesome vanilla sex with me.”
