Shirley Helzberg’s TIF isn’t the worst one, but it has spurred the loudest eco-devo backlash.

f all the tax-increment financing plans to get angry about, Shirley Helzberg’s Crossroads plan ranks somewhere in the middle.

After all, City Hall has approved far more egregious incentives.

The Citadel comes to mind. That mixed-use proposal for 63rd Street and Prospect wasn’t a bad idea for what it attempted and where, but that plan from the late 2000s collapsed under the weight of — among other things — the incompetence of the developers. They were later brought up on federal charges of improperly remediating asbestos. The site remains an eyesore today.

Then there’s the Freightquote TIF, in which Kansas City, Missouri, leaders threw almost every sweetheart tax-financed deal available at a Lenexa freight-brokerage firm just to stick a finger in Kansas Gov. Sam Brownback’s eye.

The blowback at City Hall for those two deals was minimal compared with the furor over Helzberg’s request for $5 million in future taxes to pay a chunk of the $13 million cost to redevelop a building that she owns at 1640 Baltimore into a new headquarters for BNIM. BNIM is a fine company, with the type of architectural jobs that Kansas City should want to keep in its backyard. Yet Helzberg’s TIF has spurred indignation from parents in the Kansas City, Missouri, school district, its teachers union and the local NAACP. Even The Kansas City Star editorial board, which espouses the virtues of urban subsidies (perhaps in part because the newspaper received one of its own), has cast a skeptical eye on this TIF.

So why have Helzberg, a respected philanthropist, and the well-regarded firm BNIM triggered what could be a crisis for taxpayerfunded private-development projects?

“I would say that project just has the unfortunate coincidence of arriving in the political crosshairs through no fault of its own,” says Terry Ward, a Park University professor who also serves on the North Kansas City school board.

Ward studies TIF extensively; arguably, no one in Kansas City knows TIF as well as he does.

“I think the issue honestly is not BNIM,” Ward continues. “I think the issue is the city’s handling of TIF projects, and this was the next one that came up that could be used as a focal point for expressing anxiety.”

To understand the anxiety that TIF can generate, it helps to understand the politics of the economic-development tool. TIF proposals first go to the Tax Increment Financing Commission before heading to City Hall for final approval. For some reason, Missouri law requires that TIF commissions have 11 members. Of those, six are appointed by the mayor. Then two people from the school district, two from the county and one representative from smaller taxing jurisdictions (usually the library system) make up the other five members.

Those five, especially reps from the school districts, are often at odds with those appointed by the city — in Missouri, schools are funded in large part through local property

Helzberg’s building at 1640 Baltimore: ground zero for a TIF debate taxes, and their leaders are often sensitive to mechanisms that cut into that revenue. Same goes for counties, libraries, mental-health programs and so on.

It’s not rare for TIF Commission votes to be split 6-5, with the city appointments having a built-in advantage over the other taxing jurisdictions. But when it comes to TIF, the non-city jurisdiction has the most to lose. TIF redirects 100 percent of new property taxes generated by a development project back into itself. That means a school district, for example, won’t receive less money than it did before the TIF was created. But it won’t see increased revenue from that piece of property for at least 23 years, which is how long a TIF lasts.

TIFs also redirect 50 percent of what are called economic-activity taxes (EATs) back into a development project. In Kansas City, those are largely sales and earnings taxes, sources of money that flow mainly to city coffers.

So while the city has a natural advantage over the 11-member TIF Commission, it also realizes increased revenue from TIF plans.

It at least gets 50 percent of EATs as people buy things and pay earnings taxes in a TIF district, while all of the property taxes that would otherwise go to schools or libraries end up in a developer’s pocket. The city sees some gain; the taxing jurisdictions see none.

Because cities have that narrow sixappointee advantage on TIF commissions, it’s

important for a mayor to keep his or her TIF commissioners in line. That helps explain why Kansas City Mayor Sly James pulled Phil Glynn off the TIF Commission two weeks ago. Glynn twice voted against Helzberg’s TIF because he believes that the Crossroads Arts District, particularly the western half of it, is thriving enough that projects such as Helzberg’s should stand on their own.

Glynn wasn’t coming from left field on this issue. The Kauffman Center for the Performing Arts was funded through private money (although its parking garage received TIF), and Chartwell Hospitality is building a hotel at 16th Street and Main without incentives.

James believes that Glynn was trying to dictate city policy, which falls under the purview of his job as mayor and the rest of the City Council, so Glynn was forced to resign. While that move may have paved the way for a more reliable appointee to the TIF Commission, at least as far as James is concerned, it threw more gasoline on the incentive fire.

“The grassroots now are unhappy,” says R. Crosby Kemper III, CEO of the Kansas City Public Library and a frequent critic of TIF. “They’re beginning to understand, from the head of the NAACP to the head of the teachers union to the head of school-district parents. … The world has changed, and the world has changed for a lot of different reasons.”

One of those changes includes activism from parents within Kansas City Public Schools’ borders. KCPS has $240 million of deferred maintenance in its buildings, just one of a host of problems facing the perennially struggling school district. That’s why it looks bad when Helzberg, one of the richest people in Kansas City, Missouri, reaches for $5 million in future taxes, to build an office for a well-heeled architecture firm, which then pays her top-of-the-market rent.

But it’s also a broader realization that the schools keep getting the short end of the stick on TIF deals.

Take the convention-hotel TIF, which is actually two TIFs on the same property. The developers of the would-be 800-room Hyatt hotel negotiated with City Hall for at least two years before reaching a deal, which city leaders say is a responsible one. They also negotiated privately with Jackson County leaders. But KCPS representatives were left in the dark until the project was announced. By then, it was largely too late for the schools to negotiate a better deal.

Other school districts don’t often get treated this way, particularly the Northland school district, which is among the best in Missouri.

Many TIF plans in the Northland reflect negotiations that lessen the financial hit to schools. Some divert only half of the property taxes that would otherwise go to the school district — which means that as a development area improves, the schools at least get a cut of the gains.

where a Lowe’s and a Wal-Mart were built near Interstate 29 and Barry Road, pays full property taxes.

“The Northland school districts have worked very hard to have a solid relationship with the business community, and the business community sells the Northland, in part, on the quality of the schools,” Ward says.

“There is a belief on the part of the business community that they need good schools.

When they sit down and negotiate, they realize the trade-off they are talking about. …

They are open to discussions, and I would say on the other side, Northland schools tend to be open to discussions and are trying to find ways to craft solutions that serve both sides.”

Most taxing jurisdictions I’ve spoken to say they would put down the swords that they have pointed at the TIF process if they received at least 50 percent of the property taxes.

This would reduce the strain on school districts. TIF proponents confuse the matter by insisting that schools wouldn’t get increased revenue if development didn’t happen (and, thus, arguing that development can’t happen without TIF). But this thinking flies in the face of reality.

Ward, who has analyzed TIF statewide, says a 2009 database he assembled showed that KCPS had $35 million diverted by TIF and other economic-development tools.

Any change in the advantage that developers have will inevitably be met with fierce resistance by the development community, which collectively makes up the biggest source of campaign cash for local politicians.

For once, however, the development community is encountering organized opposition.

Jennifer Wolfsie, a KCPS parent not affiliated with the usual crew of City Hall opponents, is leading a referendum drive against the BNIM TIF. If she can get the matter on the ballot, it will be a watershed moment for development incentives in Kansas City.

hen The Pitch profiled Sly James two weeks ago, the paper received a call from the mayor’s office. James’ spokesman, Michael Grimaldi, wanted to know how we determined that the mayor’s office budget topped $2 million.

We pointed to the city budget, which is published online.

The mayor’s office did some digging and discovered that the budget wasn’t accurate.

James’ office runs on a $1.8 million budget.

Grimaldi wanted us to correct the issue, which The Pitch has done online and again here.

In a suggested correction e-mailed to the paper, Grimaldi wanted The Pitch to say we had inaccurately reported the mayor’s budget.

But we reported what is in the budget. How else should we, or anyone else, know where public money is going?

he first time Joseph Zaroor assaulted Christy DiMaggio was the same weekend she became pregnant with their child.

They were in Jackson Hole, Wyoming. It was 2008. Zaroor and DiMaggio had met through a mutual friend at the Lake of the Ozarks, where Zaroor lived at the time. DiMaggio was living in Lee’s Summit. The two struck up a casual, long-distance romance. Three months into the relationship, Zaroor suggested that DiMaggio fly to Jackson Hole to meet him on a group motorcycle trip he was taking. They would stay there together for the weekend, take in the mountain scenery, then return together to Missouri, she on the back of his bike.

“I have pictures from that day of all of us having fun on the river,” DiMaggio says. “We went white-water rafting with friends. It was freezing cold and raining on the river. We were drinking. Everybody was having a good time.

Then, at some point, Joe drank too much, and he got aggressive and belligerent. He’s not a happy drunk.”

When DiMaggio and Zaroor returned to the Snow King Resort, DiMaggio says, he accused her of sleeping with another man. Then he locked her out of the hotel room. DiMaggio went to the front desk to get another key, then re-entered the room. Zaroor continued to scream at her. When a text alert went off on DiMaggio’s flip phone, Zaroor broke it in half.

Then, according to a Jackson police report, Zaroor punched DiMaggio on the side of her head with a closed fist. As she attempted to

flee the room, Zaroor — 6 feet 2 inches and 190 pounds — pulled her by the back of her sweater and threw her onto the bed.

“You’re not going anywhere,” he told DiMaggio, according to her account in the police report.

Though DiMaggio did not report it to Jackson police at the time — she told them that Zaroor had “held her down with his body weight on top of her” — she now says Zaroor sexually assaulted her that night.

“I’d never been put in a situation like that,” she says. “I was scared to death. He pinned me down on the bed and sexually assaulted me. I fought him a little, but I also complied with it.

I thought he might kill me. I suddenly realized I knew nothing about this person. I’d known him three months.”

Afterward, DiMaggio wrested free and bolted for the door, where she began screaming for help. She ran to the lobby and called 911. By the time she returned to the room with police, Zaroor had gathered his belongings and fled through a window. The police put a boot on Zaroor’s motorcycle, and the hotel gave DiMaggio a different room to sleep in. She booked a flight to Missouri that night. The next day, Zaroor returned to the hotel and met with police, giving a statement that DiMaggio had instigated the fight.

“It was basically his word against mine,” DiMaggio says. “I didn’t want to do the whole rape-kit thing like you see on TV. I was like, ‘OK, that was very scary, that guy is a piece of shit,

but I just want to put it behind me and move on.’ I didn’t want to press charges. I didn’t want to fly back to Wyoming and deal with all of that. I just wanted to put it in the past and forget about it.”

ack in Missouri, DiMaggio filed for a restraining order against Zaroor. Before it was granted, though, she learned that she was pregnant. She contacted Zaroor to inform him. He asked her to forgive him, she says, and begged that she not terminate the pregnancy.

“He said Jackson Hole was an isolated incident, that it’ll never happen again,” she says.

“He accepted responsibility for it, although he did try to place some of the blame on me. But, overall, he was convincing and seemed sincere.

I didn’t know what to do. I knew my life was going to change no matter what direction I took. Ultimately, I stayed with him and gave him another chance. And then another, and then many, many more.”

They resumed their relationship, but the fighting continued. Before their son, Nick, was born, the Lee’s Summit Police Department was called to disturbances involving DiMaggio and Zaroor on four occasions.

In October 2008, DiMaggio accused Zaroor of stealing her debit card and making purchases with it. In January 2009 — by which point the two had gotten engaged, one of three times that DiMaggio says they agreed to marry — Zaroor called the police and ac-

cused DiMaggio of slapping him in the face.

March 18, 2009, DiMaggio told responding officers that Zaroor had repeatedly spit on her, thrown a glass of ice water in her face and threatened to, according to the police report, “cut the baby out of me and watch me die.”

In the midst of another fight, a month after Nick was born, Zaroor went to DiMaggio’s residence to retrieve his jet-ski trailer and ripped the frame off her garage door. When the police arrived, DiMaggio asked an officer why they kept letting Zaroor get away with his bad behavior. The officer responded by asking DiMaggio why she continued taking Zaroor back, given that “his past behavior will only predict his future behavior.”

In the report, the officer went on: “I asked Christy what services I can get her to keep her from taking the suspect back. She had no response for me.”

MaryAnne Metheny is the CEO of Hope House, the largest domestic-violence shelter in Missouri. She has seen similar patterns of behavior in the 22 years she has been with the organization.

“Just because somebody experiences a situation where police are called — or several situations where police are called — doesn’t mean they’re going to automatically leave an abusive relationship,” Metheny says. “There are lots of reasons why people don’t leave: the fear factor, the guy promises to change, the woman has no money or no other options to take care of the children. continued on page 8

In September 2009, DiMaggio and Zaroor again reunited, and soon police arrived at the home they had moved into together. DiMaggio told them that Zaroor had kicked in a door, spit in her face and pushed her down a flight of stairs. The responding officer observed a door that had been split and cracked, and redness on DiMaggio’s neck and throat and the tops of her feet. Zaroor was arrested for domesticviolence assault. Nick was present in the house at the time.

A few months later, Zaroor, who owned a hail-repair business, moved to El Paso, Texas, for a job. The night before Zaroor left, he threw a brick through the window of their house.

The police returned. This time, they administered a domestic-violence screening test to DiMaggio, who answered “yes” to seven of its 11 questions. The LSPD officer contacted a Hope House representative, who suggested that DiMaggio come in and file an emergency order for custody of Nick. She agreed.

Over the next few years, DiMaggio says, she found Hope House to be a source of strength and healing. Records indicate that she sought help there 10 times from 2009 through 2013.

But it was a Hope House referral that led her to another man who would victimize her — the lawyer representing her in the custody battle for Nick.

iMaggio is now 40 years old, with dark hair and a style that communicates a beautyconscious suburban mom. (She’s a licensed medical esthetician.) Her Lee’s Summit home, where she lives alone, is clean and cookiecutter. When I visited in October, a Pandora station — which seemed to be based on Dave Matthews Band — was playing softly in the background. DiMaggio showed me the bedroom where Nick sleeps every other weekend.

He’s 6 years old and keen on astronauts; outerspace-related toys and posters filled the room.

The only thing disrupting the suburban tranquility of the home was the dining-room table, on which were stacked several dozen binders, folders and Bankers Boxes filled with tens of thousands of pages of medical records, police reports and court documents. All relate to DiMaggio’s various legal struggles.

DiMaggio has four children by three men — one with her high school sweetheart; two with her first husband, an IT consultant named Stephen Pickell; and Nick. DiMaggio and Pickell married in 1999 and divorced in 2005. They remain close, and Pickell has sporadically supported DiMaggio financially since their divorce. He estimates that he has spent $60,000 on DiMaggio’s legal bills.

“Christy has been raising kids since she was 19 years old,” Pickell told me. “When we got

divorced, I think she wanted to live her life a little and have her time, have some fun, have some new adventures. Obviously, she made some bad decisions regarding some of the men she decided to bring into her life. That’s really been the only source of tension in our relationship since the divorce. Because I didn’t want my kids around that kind of behavior.”

DiMaggio and Pickell’s two children were present for Zaroor’s domestic-assault arrest in 2009. After that, Pickell added what he calls a “no Joe” clause to their divorce agreement.

“When all that started up, I got a PI to investigate him [Zaroor], and he immediately dug up a half-dozen police-report incidents on him,” Pickell said. “So I had my attorney file a clause in my visitation schedule to where if she had the kids, Joe couldn’t be around.”

Examining DiMaggio’s past, I came across a report in which DiMaggio had called the police on Pickell around the time they were divorcing.

No charges were filed, and the report seemed to suggest that DiMaggio had attempted to turn a playful accident — Pickell’s tapping one of their children on the head with a soft toy — into an attempt to discredit Pickell as a father in light of a looming divorce proceeding. I asked Pickell whether he thought the events of that evening called into question the veracity of DiMaggio’s claims in subsequent incidents.

“Bottom line is, most divorces aren’t totally clean deals,” he said. “People act out — they get upset. We had a period where we weren’t getting along, and then we split up. But a year later, we were friendly again and going on family vacations together with our kids.”

Pickell paused. “I might be more likely to entertain the idea of Christy as this manipulative person who is faking being a victim if Joe didn’t have a documented history of beating the crap out of not just Christy but also several other women.”

O

ne of the binders on DiMaggio’s dining table contains every known police report involving Joe Zaroor over the past 13 years. The binder is black and 4 inches thick; it holds more than 1,000 pages.

Zaroor declined to comment on his history of domestic violence. Of the custody battle with DiMaggio, he says, “It has never been about custody with her [DiMaggio]. It’s only about money.” He adds that DiMaggio has a “strong desire to seek attention.”

But Zaroor’s pattern of violent behavior emerges quickly. Zaroor and his first wife, Amy, share a cops-and-courts history that is remarkably similar to his with DiMaggio. Amy is now a lawyer in St. Louis. She did not respond to requests for comment.

The first incident involving Zaroor and Amy, in 2002, reads like crime fiction: Camden County sheriff’s deputies are called to a Lake of the Ozarks home. They meet Amy outside and find that her eye is bruised. Blood is spattered throughout the house. One man is unconscious on the floor. Zaroor is discovered in a bedroom

doorway holding a Rossi .357-caliber revolver, cocked and loaded with six rounds. Zaroor tells police that he and the unconscious man, a friend, got into a fight after the friend punched Amy; Zaroor adds that he eventually beat the man in the face with the gun. Neither man ended up filing charges.

One year later, in 2003, Amy and Zaroor, now married, got into an altercation after a Toys for Tots holiday party. She made a voluntary statement to the Camden County Sheriff’s Office that, after an argument about their dog, Zaroor “threw me off the bed, choking me.”

Her statement goes on: “Once on the floor he punched and kicked my stomach, legs, and throat. After being temporarily unconscious I called my parents when Joe came in and called me a ‘fucking tattle tail’ [sic]. At this point I let him know Mom and Dad were on their way and he left our house.”

Zaroor’s version of events, as recorded by police, was that Amy had started the fight, and when he tried to leave the house, she grabbed him, at which point he pushed her away. He added that Amy had stopped taking medication that a psychiatrist had recently prescribed for her. Amy ultimately declined to press charges.

Amy did, however, file for a restraining order against Zaroor not long after the Toys for Tots fight. She called police twice to report that he had violated the order by calling her repeatedly and sending harassing e-mails.

By 2006, Amy and Zaroor had reunited. The honeymoon did not last.

Rarely used toys in DiMaggio’s home One night, Amy returned home around midnight. She told police that Zaroor called her a “whore” and accused her of cheating on him. According to the police report, Zaroor threw her on the bed and grabbed her around the neck. When Amy tried to call her mother, Zaroor took her cellphone and broke it in half.

He then fled in his truck. Their 11-month-old child was in the room during the fight.

Amy told Camden County deputies that she was unsure whether she wanted to file charges. The next day, a deputy checked back in with her. According to his report, Amy “advised that she did not want to pursue any charges against her husband, Joseph. She went on to say that her and Joseph had made up and everything had been great between them today.”

The next month, Zaroor was arrested for domestic assault in the third degree after a confrontation that gave Amy a black eye, bruises and scratches on her body. Zaroor claimed that he had thrown her sunglasses at a wall, and they had bounced off and struck her eye. He received two years’ probation for the assault.

Child-custody issues arose. Zaroor was given every-other-weekend rights to the child.

But in late 2006, Amy called the police to report that Zaroor was refusing to bring their son back at the appointed time. She made similar complaints to the police over the next few years. These were often continued on page 10

continued from page 9 rebutted by Zaroor, who would tell police that it was, in fact, Amy who was withholding the child from him. In a written statement, Amy told police: “Joe has told me if I don’t agree to what he wants for visitation he will ‘get me’ and I ‘don’t know what I have coming.’”

In 2007, Amy’s new boyfriend, a man named Ray, received, according to a statement he gave police, “10 harassing texts and two phone messages where Joe explains what Joe is going to do to ruin his [Ray’s] name in the community and that … Joe will make his [Ray’s] life a nightmare.” Records also show that Amy told police that Zaroor sent her a text message that read, “You are being judged by God and Having the Ring of Jesus Fire.” Camden County deputies visited Zaroor; he told them that he would stop sending messages.

The next of the Zaroor girlfriends in DiMaggio’s files is named Dona.

December 2007: Dona says in a written statement that Zaroor threw her on a bed, choked her unconscious and struck her on the left side of the face, leaving a black eye. “A bruise can be clearly seen above the left eye.

She states that he is mentally and physically abusive,” a police report notes. Dona further states that on November 29, 2007, Joe shattered every window in her car and let out the air in its tires.

A January 2008 sheriff’s report recalls DiMaggio’s Jackson Hole story: “[Dona] says Zaroor grabbed her by the neck and threw her

up against the wall. He then dragged her to the couch and sat on top of her as he hit her in the left ear area. She states he also choked her during this incident. [Dona] said he stopped and they started getting along once again. She stated she later apologized to him.” Zaroor was later arrested for domestic assault for this episode.

Today, Zaroor owns a car-and-motorcycle body shop called Bad Apple Customs, in Eldon, Missouri. He’s married to a woman named Jeanette. They, too, have had problems, according to records.

In June 2013, Jeanette accused Zaroor of hitting her in the face while they were drinking at a Lake of the Ozarks bar called Shorty Pants.

Five months later, police arrived at their home during a drunken fight. At one point, either Zaroor or Jeanette threw Jeanette’s child’s piggy bank into the driveway, smashing it. Nick was present at the time. Jeanette informed police that there were two handguns on the premises — a violation of Zaroor’s probation for a 2012 assault in Arizona — and gave the police permission to take them from the house. The next day, Jeanette claimed the guns as her own and retrieved them from the Sheriff’s Office.

One week later, a Camden County deputy called the Division of Family Services and shared concerns about Jeanette and any children living in the home, citing reports of Zaroor’s violent nature and the possibility that there were weapons in the home. And in August 2014, Jeanette’s ex-husband, Matt O’Neill, filed an emergency motion to modify

DiMaggio has a pending bar complaint against Spiegel. the custody arrangement of his and Jeanette’s two children, noting the “domestic violence and lack of tranquility” in the Zaroors’ house.

O’Neill’s attorney (Christopher Rohrer, of the Lake of the Ozarks) noted in the motion that Zaroor, “despite being on probation, continues to drink and be involved in violent exchanges.”

(O’Neill declined to comment for this story, due to pending litigation.)

In September 2014, Judge Bruce Colyer agreed that Zaroor should not be allowed near O’Neill and Jeanette’s children: “Given Mr. Zaroor’s significant history of violence, the ongoing discourse between her [Jeanette] and Mr. Zaroor, the continued present and unlawful conduct exhibited by Mr. Zaroor, and Mr. Zaroor’s habitual abuse of alcohol, it is in the best interest of the children that they have no contact with Mr. Zaroor.”

iMaggio knew little of Zaroor’s history in 2010, when she decided to move away with him and Nick to seek a fresh start. They relocated to Chandler, Arizona, where Zaroor planned to work on his hail-repair business and where DiMaggio would seek a beauty-school license.

Things didn’t improve for them in the Southwest.

Over the next two years, the couple moved several more times, within Arizona and also to

DiMaggio says, and e-mails between her and Spiegel confirm, that Spiegel’s strategy was to first get a change of judge. The case was initially in front of Commissioner Sherrill Rosen. Spiegel successfully got the case moved to Judge James Kanatzar’s court. Spiegel had worked under Kanatzar in the Jackson County Prosecutor’s Office in the mid-2000s, when Kanatzar was the county prosecutor.

DiMaggio says another component of Spiegel’s legal strategy was to get a friend of his, Jennifer Oswald Brown, appointed as guardian ad litem for Nick. (Guardians ad litem are court-appointed advocates who represent the best interests of a child.) Brown was not on the

Other e-mails reviewed by The Pitch appear to strongly support DiMaggio’s claims.

In February, DiMaggio to Spiegel: “Wakey wakey eggs and bakey....Nakey :) Hope you have a fabulous day saving the world. You’re my hero! xoxo. lol!”

February 22, afternoon, Spiegel to DiMaggio: “I need a hug n no one is here.”

February 23, 10:18 a.m., Spiegel to DiMaggio: “I want to c u.”

Through his attorney, Jim Morrow, Spiegel declined to comment. “This is a pending legal matter, and I don’t believe it’s appropriate to do so [comment],” Morrow tells The Pitch.

“It’s not only that he had an affair with his client. He also met Christy through Hope House, a battered-women’s shelter full of women in just about the most vulnerable position you can be in.”

Lynne Bratcher is representing DiMaggio in two separate claims against Spiegel: the aforementioned legal malpractice case and a bar complaint.

“It’s not only that he [Spiegel] had an affair with his client, which is forbidden under Missouri law,” Bratcher tells The Pitch. “He also met Christy through Hope House, a batteredwomen’s shelter full of women in just about the most vulnerable position you can be in.

That’s what’s so repugnant to me about this.

And Christy’s story is consistent, and so is her documentation.”

In May, DiMaggio says, she told Spiegel that she felt their relationship was inappropriate, and it should return to a purely attorney-client one. She says after that, Spiegel “checked out” in terms of working on her case. She says Brown, the GAL, also became less sympathetic to her point of view and concerns around this time.

In August, Spiegel dropped DiMaggio as a client.

In December, Kanatzar awarded sole legal and physical custody of Nick to Zaroor.

“You gotta understand, I’d been through years of hell with Joe,” DiMaggio says. “And now I’ve got a lawyer who’s saying he’s going to take care of all my problems. And pretty quickly, he’s got the case in front of a judge he’s known for years. He’s got his friend appointed as GAL. He also sent me over a similar case he had won where Jennifer [Oswald Brown] was the GAL, to sort of show me that he had done this before. I mean, the guy was like my savior.”

(A Jackson County spokeswoman says, “Judge Kanatzar does not have a personal or social relationship with Mr. Spiegel.”)

Almost immediately after DiMaggio retained Spiegel as her lawyer, e-mails reviewed

by The Pitch show, Spiegel began sending her intimate messages unrelated to her case.

January 4, 2013 (two days after DiMaggio formally hired Spiegel as her attorney), 12:28 a.m., Spiegel to DiMaggio: “I’m bored to death nothin on tv not tired n nothin to do.”

January 6, 10 p.m., Spiegel to DiMaggio: “U feeling all better, what wad wrong? Did ur boyfriend make it to town?” Later that night, Spiegel to DiMaggio: “U need out n have sum fun.”

In August 2012, after Zaroor was arrested and charged with assaulting DiMaggio in Sedona, an Arizona judge awarded DiMaggio temporary custody of Nick. Zaroor was allowed unsupervised visits with Nick every other weekend, but by then, Zaroor had moved back to Missouri. DiMaggio says Zaroor flew to Arizona a few times for visits. Zaroor then offered DiMaggio a deal, she says: If she moved back to Missouri — where Zaroor could visit Nick without having to get on a plane — he would agree to honor the custody arrangement in Arizona, which included child support of $1,600 a month. Zaroor would also pay her $5,000 in relocation expenses.

DiMaggio and Nick were living at the time with one of DiMaggio’s friends in Arizona. She agreed to dismiss the Arizona custody agreement and return to Missouri.

“All my friends were in Missouri, all my family,” DiMaggio says. “I wanted to come back home. So I signed the papers. I got a moving truck, Nick and I come back to Missouri.”

Zaroor told DiMaggio and the courts that he had made an offer on a house in Lee’s Summit.

But when DiMaggio arrived in Missouri, Zaroor told her that he was now living at the Lake of the Ozarks with a girlfriend. He had rescinded his offer on the house. DiMaggio also learned that Zaroor’s attorney, Kelli Wulff, had filed a motion to quash DiMaggio’s stipulations to amend the Missouri plan.

“In a week and a half, he now lives three hours away,” DiMaggio says. “So Joe’s first weekend with Nick in Missouri comes up, and I ask for the address of this house at the lake, and he gives me an address that is nonexistent, according to the police department there. So I didn’t let him have Nick.”

DiMaggio then filed a motion to dismiss the Missouri stipulation, after which she went back to Arizona with Nick. She stayed there for a month.

Outside a hearing in Yavapai County, Arizona, on Zaroor’s assault charge, Wulff had DiMaggio served with a subpoena to appear in Jackson County, Missouri, based on a claim that DiMaggio had denied Zaroor’s parenting time.

The motion stated that because Zaroor had residential custody in Missouri, Zaroor should be able to have Nick wherever he decided to live.

As a Missouri judge who ruled on one of these cases later put it: “What a mess.”

It was clearly time for DiMaggio to hire legal counsel in Missouri. She called Hope House and asked for advice. She was referred to a lawyer in Blue Springs named Michael Spiegel.

“After I got the subpoena, I talked to Michael, and he basically said, ‘Come back and fight this in Missouri,’” DiMaggio says.

“So I came back to Missouri and brought my big suitcase of files to his office, and he starts looking through everything. And soon he’s salivating at the chance to take the case. He saw how much money Joe was capable of earning

hile furiously pedaling on a stationary bike at 8:30 on a Monday morning, I started dreaming about sweet-potato casserole. Thanksgiving was a week away, and I could already taste the baked marshmallow crust dissolving on my tongue like a well-kept secret. I equated every revolution of the bike’s pedals with another guilt-free bite.

I hoped that squeezing in a few extra preholiday workouts would help my body survive the most indulgent time of the year and avoid the need for larger pants — “eatin’ pants,” as I like to call them. With the Country Club Plaza’s annual lighting ceremony one of Kansas City’s most popular traditions, I decided to see if I could get fit in the epicenter of holiday cheer.

That’s what took me to Mojo Cycling Studio, the five-month-old “high-end boutique” that “does one thing and does it very well,” cofounder Amanda Rismiller told me over the phone. Hearing this description, I assumed that everyone there would be wearing $80 gym pants, but I decided to pull on my 10-year-old tights from Target and hit it.

For Kansas City residents, the first class at Mojo is free. (After that, the drop-in price is $22; packages are also available.) The woman

at the front desk gave me a quick greeting, and I wandered into the modern second-story space.

In the cycling room, Schwinn stationary bikes in several rows of descending platforms faced an instructor and a floor-to-ceiling mirror.

Fortunately, the lights were dimmed — or off entirely — for most of the class. A soft neon glow filled the room. According to Rismiller, this is part of the plan.

“You kind of escape from the real world,” she said. “You’re able to zone out and just groove with the music.”

The experience felt like cycling in a nightclub, and I was able to turn off my brain for an hour and focus only on pedaling to the beat.

After class, sweaty and hungry, I skipped my usual coffee-shop pastry and went to T. Loft, the so-called “health café” that opened on the Plaza’s main drag in July. With its freshpressed juices, organic teas and all-natural snacks, the casual restaurant seemed ideal for a quick post-workout meal. After examining the detailed menu for what felt like 45 minutes, I ordered a veggie scramble bowl, a “Fast Focus” juice (pear, pineapple, apple, cucumber and green tea) and a pumpkin-pie “protein ball.”

Following such an intense workout, I devoured the pumpkin ball in a single bite, but it tasted too healthy to satisfy my appetite for rebellion. The juice was pleasantly smooth and sweet, but the scrambled eggs lacked a key component: hot sauce. There were no salt and pepper shakers on the tables, so I assumed that they would judge me for requesting my favorite condiment. Instead, they gave me a generous serving on the side.

The next day, I went to Power Life Yoga, a Des Moines-based studio that opened its first out-of-state location this summer in Kansas City, in the south Plaza area. I immediately liked studio manager Jenny Anderson, a KC native, and co-manager Michelle Howe, who moved here from Des Moines. They’re the kind of people who hug you the first time they meet you, and they genuinely believe in the yogabased community that their studio promotes.

“We want people to come early and hang out

on the couch,” Howe said. “Many yoga studios are quiet, but we strive to create a connection.”

New students get a free week of classes at Power Life, so I tried out Power Sculpt, a class that Anderson said “remains challenging no matter how many times you do it.” The first thing our instructor asked us to do was turn to the person to our left and tell him or her what we hoped people would say about us if we reached our 100th birthday.

After a somewhat awkward exchange, the man next to me warned that this class was “a real butt-kicker.”

He wasn’t kidding. Unlike traditional yoga, Power Sculpt involves weights and cardio in a heated room, a three-pronged attack designed to make you as sweaty as possible. If that’s not your thing, Power Life also offers beginning and advanced vinyasa classes, as well as “cardio barre” classes. Anderson said the Power 1 class is ideal for beginners.

And yoga in general, she added, is ideal for everyone over the holidays.

“It’s nice to come into a warm class on a cold day,” she said. “It’s a place to calm down but also feel like you’ve worked. Spending so much time focusing on everyone else can cause resentment, so it’s important to take time for yourself.”

It’s also important to treat yourself. With or without yoga, the holiday season will be stressful. But at least I’ll feel better about eating a second helping of sweet-potato casserole.

New Society

ast year, five former members of the Society for Contemporary Photography — a nonprofit that dissolved in 2007, after almost a quarter century — came together to discuss reviving the organization. This past June, the new Kansas City Society for Contemporary Photography introduced itself with a show at Columbus Park’s Kiosk Gallery.

“We’re getting back to our roots as photographers,” KCSCP President Angie Jennings tells me. “We want to create a community with local artists, curators and collectors.

Our main focus will be on local and regional artists.” The society, she adds, also wants to educate photographic artists about selfpromotion, finding a place in the art world and knowing how to discuss their work.

Much of what’s on display in the renewed group’s Current Works – 2015, which went up at Haw Contemporary this month, speaks for itself and shows just how many area photographers have already started to figure out their place in the art world.

Jan Schall, the Sanders Sosland Curator of Modern Art at the Nelson-Atkins Museum of Art, served as juror. Selection was blind, meaning that Schall chose 36 works by 33 people from nearly 200 images submitted with only titles and print sizes. Almost all the three dozen images in the second-floor gallery of Haw Contemporary make their own strong case for the individual talent at work.

Taken together, though, Current Works is a stunning show — a quietly powerful presentation revealing a wide spectrum of styles, themes, compositions and techniques.

Current Works – 2015 Kansas City Society for Contemporary Photography Through December 31 at Haw Contemporary, 1600 Liberty Tour and talk, 5:30 p.m. Wednesday, December 9; tickets for the free event at helloart.org Schall’s statement unifies her selections under a simple rubric: the question “What does it mean to stop time in an expanding, whirling universe?” Each of the images, presented in individual frames and lined up along four walls, repeats that query to the viewer. These photos require you to pause before each scene, block out the rest of your visual field, set aside your thoughts, and use your eyes — eyes that have become inured to the constant movement of digital interfaces, often accompanied by sound. In a screendriven culture, Current Works demands your willingness to discern the values, balance and forms that make up these images, then find a narrative in those things.

Because Schall has taken care not only with the images she has chosen but also with their arrangement in this space, it’s not hard to meet that demand. She has carefully composed the photos — which are generally of similar size, ranging roughly (but with a few exceptions) between 10 inches and 20 inches — into a logical succession. It is utterly delightful, in fact, to approach them in groups, finding similarities amid neighboring images.

holds only black-and-white prints or images washed into a monochromatic chill. In the latter camp is a Phil Peterson shot of a bluishwhite concretescape that suggests the swirl of water (or the whir of skateboard wheels) with its curving cement seams. Next to this is Larry Benton’s “Dreaming of Hummingbirds,” a sepia-toned triptych that preserves a living specimen for our eternal admiration — and bridges Peterson’s shot to one by Chris Dahlquist. In “Spinners,” three children represent blurred joy as they hang on to a play-

There’s similar centrifugal force in the beautiful, furious clouds of Stephen Locke’s “West Point Supercell.” The storm could be headed toward another impossibly huge landscape, “The Road Off Highway 191,” by Ernie Block, another view of awe-inspiring nature.

21 Humans return with Lea Murphy’s “Tension,” a view of someone’s ankles and feet poised backward on the edge of a diving board. The scene freezes a decisive moment for this would-be diver, the outcome of which is playfully withheld. The five swimmers in Chuong Doan’s “NhaTrang Beach,” bathed in the magical, golden tones of sunset, are held in a post-dive memento. The motion in the frame shows one of the figures gleefully defying gravity, at once launching up from the water and falling back to it.

These pairings continue throughout the exhibition, along with across-the-room dialogues in theme (birds, trees, transportation, industry), color and light. Pilar Law’s misty “The Space Between #22, Kansas” addresses brightness in a way that complements Mark Berndt’s untitled composition of a stark industrial wall slashed by a parallelogram of high-wattage light; together, they echo Peterson’s work and

expose the viewer to the many gradations of subtlety possible in this medium.

Elsewhere, images focus on repeating forms. The architecture of a stairwell mesmerizes in “Vanishing Point,” by Derek Slagle, as do the mysterious, UFO-like disks in Fred Trease’s “Black Holes” and the electrical towers set along the undulating ridges of Laura Cobb’s “Glen Canyon.”

There’s no shortage of straightforward beauty. Tim Pott’s “Jazz,” a high-contrast study of razor wire spiraling off the grid of a chain-link fence — like music notes on a clef or a hard-to-decipher autograph — is printed on slightly off-white paper and makes a fascinating study of form. Here, as in most of the show’s other images, the simplest details provide the deepest enchantments.

Details also shape narrative in photos that are witty, haunting or both. There’s deadpan literalism in the packaged (and unwrapped)

hair awaiting application along the top of the frame in Gloria Baker Feinstein’s “Beauty Salon,” and there’s something troubling about dark shadows and the heaped rust-colored cloth in Kenny Johnson’s “Boy in the Corner” (in which we must take the title figure’s presence on faith). Don Wilkison’s “Tonya” gives us a whole story with its easy-to-apprehend shot of a mail carrier caught in the rain and clearly loving it.

Anyone with a smartphone is an amateur photographer now. But our post-Instagram era is nevertheless made up of moments that defy easy capture. Current Works offers a potent reminder of what such moments look like when they’ve been stilled not easily but well.

If there’s something for nearly everyone to admire here, it’s because there’s something of many of us in these shots.

Creed surprises but doesn’t

early four decades ago, Rocky, an underdog box-office hit about an underdog boxer, did what underdogs do: It stole a big prize from worthy contenders, in this case the Best Picture Oscar that could have gone instead to Taxi Driver or Network or All the President’s Men. Each of those films was, and remains, better than the shamelessly cloying movie that made a star out of Sylvester Stallone and launched sequels of increasingly diminished returns.

Still, that first Rocky retains a timeless charm. Its hook may be hokum — a fighter who wouldn’t hurt a fly — but, at least at the saga’s outset, it’s a sincere hokum. The hero’s best friends are his turtles. As written and played

by Stallone, the 1976-model Rocky Balboa is an adorable lug, impossible to root against.

It’s the Rocky of the Reagan years and after that tests the patience. Shouldn’t six follow-up chapters be more than enough?

Now there’s a seventh, kind of — for the first time, Stallone has neither written nor directed a Rocky-related movie, trusting instead Ryan Coogler, who made Fruitvale Station. It’s called Creed, and it’s supposed to be mostly about the illegitimate son of Rocky’s old nemesis turned friend. Based on Muhammad Ali, Apollo Creed was Rocky’s inverse: brash, assured, successful. Unlike Ali and Rocky, however, he’s dead, taken out by the bad guy in Rocky IV. Almost 30 years later, the son, called Adonis, is ready to emerge from his father’s shadow. Naturally, he’s a boxer.

Naturally, he will need Rocky’s help.

Adonis is a born fighter but, as played by Michael B. Jordan — who starred for Coogler in Fruitvale Station — he’s also levelheaded, handsome, educated and charismatic. Thanks to Apollo’s widow, who adopted him after his mother died, he’s also wealthy and doesn’t

Stallone gives Jordan room. need boxing to support himself. In Coogler and co-writer Aaron Covington’s screenplay, in fact, Adonis doesn’t seem especially haunted by his father’s absence. The central conflict revolves instead around his quest to outrun his lineage. Near the end, he receives a gift from his foster mom. The card reads, “Build your own legacy,” and it accompanies his father’s boxing shorts, adorned with Adonis’ birth surname as well as with his famous dad’s.

That kind of confused message infects Creed, in which the tone veers from goopy melodrama to scatological slapstick and back again. Coogler inverts the original movie’s ramshackle innocence by emphasizing his hero’s desire to distance himself from privilege. But young Adonis is too ambitious to get very far in that quest, and not much about his slumming-it milieu is really very hardscrabble. His love interest is improbably talented and gorgeous, and the kids in this movie’s version of inner city Philly roll on dirt bikes and ATVs. Stallone, however, recovers his inner palooka, and he does the seemingly impossible: He makes Rocky a refreshing, humbly goofy presence again.

Coogler’s movie comes to raucous life during its fights. Maryse Alberti’s camera flows around the ring, moving behind the puncher’s shoulder as though following a conversation.

There isn’t much new about how these sequences are staged, but they’re fluid and involving — slick in a way that the original Rocky was not. Slick, in fact, in a way that’s easy to recognize in another sequel-intensive genre: If Creed is a reboot, it’s one that’s fit for the comic-book-superhero age.

n a political season now dominated by shameful anti-immigrant rhetoric, Brooklyn — John Crowley’s film version of the Colm Tóibín novel, nimbly adapted by Nick Hornby — is the big-hearted bear hug of a movie that a lot of folks could use.

It’s anchored by Saoirse Ronan’s luminous performance as Eilis, an Irish immigrant whose rough passage to 1950s Brooklyn is salved by a sweetly persistent Italian-American plumber (Emory Cohen). The crisis that lures her home isn’t overstated, and neither is the triangle that simmers with a local (Domhnall Gleeson).

Crowley saves the melodrama for an admittedly satisfying showdown with a gossipy harridan (Brid Brennan), preferring the tension generated by watching fundamentally decent people caught between their own desires and the obligations of family and community.

curl my hands around the 3975 at Jax Fish House & Oyster Bar, attempting to gauge the temperature of the cocktail so as not to singe my tongue on the first taste. The glass is hot — very hot. Kenny Cohrs, Jax’s bar manager and the co-founder of the cocktail consulting company Liquid Minded Concepts, suggests that I give his creation a moment.

The 3975 is an adult hot chocolate, he tells me, containing a housemade habanero cordial, pineapple syrup, coconut milk, Aztec chocolate (a blend he has concocted) and Del Maguey Crema de Mezcal (mezcal that has been blended with agave syrup, Cohrs explains). He has garnished his drink with a brûleéd, housemade marshmallow. It looks like a sophisticated cup of Christmas cheer.

“I blend the Aztec chocolates and coconut milk to create the hot chocolate, and then I add all the remaining ingredients and heat the drink to order,” Cohrs says. “I don’t ever really taste the pineapple notes in there, but I think it needs that little hint of acidity to balance it out.”

The name of the drink, 3975, is a nod to the miles between Honolulu and Oaxaca (where mezcal is produced). Cohrs admits another influence far closer to Jax: the (nonalcoholic) Aztec hot chocolate popular at State Line Road coffeehouse Hi Hat. “Really, I just liked the idea of pairing some of the flavors of Mexico and Hawaii together, and I was thinking about cold-weather cocktails,” Cohrs tells me. “Being in the middle of winter and thinking, ‘If I wanted to get

Ooey gooey goodness at Jax somewhere warm, where would I go?’ Either location sounded great to me. So I wanted a cocktail that would sort of take me to either place, just for a moment.”

It took Cohrs several batches of hot chocolate to arrive at just the right 3975 recipe. At my first not-too-hot sip, I taste the happy results of all that tinkering. Almost instantly I find myself wanting to sing carols and wrap presents.

There’s something about the spices and the smokiness and the burnt and gooey marshmallow that summons to the imagination a symphonic rendition of “Joy to the World.”

The 3975 has all the markings of a wellbalanced hot chocolate, and were it not for the grown-up addition of the mezcal, I would be tempted to give it an all-ages endorsement. Anyway, for the few moments that this drink lasts in your hands, Cohrs accomplishes his mission: The 3975 plays out like a liquid vacation.

On the Fly

At Fresh to Def, Eddie Moore brings the groove.

o one is listening to Eddie Moore play the piano. Not tonight, not at Sullivan’s Steakhouse in Leawood, where Moore has been playing nearly every Wednesday night for a year.

Ben Leifer, who accompanies him on upright bass, hears everything, but the bar is packed — professional types at high-tops, with martinis — and not a single head turns to pay attention to the men playing the music.

I recognize the notes of Tears for Fears’ “Mad World,” and the lyrics begin to form inside my head. Moore doesn’t present the song as a party killer — there’s a bit of bounce in his version, and it plays out with a graceful energy.

When the song ends, I begin to clap, and I find I’m the only one. The sound of my applause is no match for the chatter of patrons and the clattering of plates being cleared. And then Moore and Leifer start another song.

Loud laughter comes naturally to Moore, but aside from the occasional twitch at the corner of his mouth, he’s a bit solemn at this night’s session.

The day before this set, at the Westport Coffeehouse, Moore told me how this night would go. In his casual, jovial way, he laid out the booking’s pros and cons.

“We all have those gigs where it’s low pressure, and you can mess around and no one’s really listening,” Moore says. “It’s like personal practice. You can be experimental. And there [at Sullivan’s], it’s OK because no one really notices. The only rule is that we don’t swing.

They don’t want that. We literally just groove.

We groove jazz standards, and no one knows.”

Throughout our conversation, Moore references this: the difference between “swinging” and “grooving.” At its most basic, Moore explains, “swinging” means playing the standards, and “grooving” means improvising.

(He will later tell me that, technically, groove is a type of swing, and he will annotate this explanation with rhythmic sound effects, which the few other coffeehouse patrons politely ignore.) Grooving, Moore says, is looser — it’s more about a feeling. As a musician who grew up with one foot in hip-hop and the other in jazz, he is most interested in precisely this, this feeling.

“A lot of people think about jazz as a genre, and it has these certain characteristics, and a lot of people associate that with being classic,” Moore says. “But jazz isn’t a genre to me. It’s a freedom of expression. At its essence, it is the art of improvisation. That’s why it has so many variations — like free jazz and bebop and and post-bop and hip-hop-bop and big band and swing, all those.

“At the end of the day,” he adds, “they’re really just improvising. The feel and the concept are different musically, but they’re all

he reminds me, that’s also what hip-hop is based on. And Fresh to Def, he says, makes it easy to contribute.

“There was nothing like this in Kansas City that was happening on a consistent basis,” Coleman says. “And Eddie, he can do what a lot of people can’t do because he’s got talent as a pianist, but he’s also got an incredible ear. He can marry jazz and hip-hop in a way that’s progressive and fresh. To see someone being able to do that, taking those static beats — loops, essentially — and turning them into an arrangement, that’s hard to find.”

But Moore doesn’t view his role in Fresh to Def as all that central to the experience.

“Fresh to Def is about creating a platform, regardless of where the musician is coming from,” he says, “to be able to create on the fly and improvise, to get in the realm of improvising without worrying about the other elements that come with it. It’s really about being able to not be self-conscious and just create.”

And, he adds, at Fresh to Def, there’s an element of watching something being created in real time. It’s an environment where everyone present is there to listen carefully because no one knows what note will come next.

It sounds risky. Moore laughs — a boisterous, merry sound — and rests his arm on the empty chair next to him. “I find it liberating.”

improvising. You have to learn how to swing and go through all that to get a better idea of improvisation because that’s where that conversation starts. But it doesn’t stop there.”

Moore would know. He moved to Kansas City from Houston in 2010 to study at the University of Missouri–Kansas City Conservatory of Music and Dance, and since graduating with a master’s degree in 2012, he has plumped his résumé with an eclectic stack of experiences.

He has accompanied Bobby Watson and played with psych-rock band Various Blonde, jazz group Book of Gaia, and reggae master Zack Mufasa.

His own quartet, the Outer Circle, is one of the most recognizable outfits in local jazz. The band’s most recent release, June’s Live in Kansas City (recorded at Green Lady Lounge), plays out like an elegant, funky adventure. There’s a lot of back-and-forth between melody and rhythm, a wide landscape of highs and lows.

Moore’s music often takes a shape similar to his conversational style. When you talk with him, his wiry energy is apparent, the push and

pull of too many ideas in his head to come out all at once. Yet he’s resolutely calm, as though he knows he will get to them all eventually.

That’s where Fresh to Def comes in. For the past year, once a month at the Tank Room, Moore and the Outer Circle — usually with rapper Kemet Coleman — puts on an open-call hybrid jam session. The Outer Circle provides a live backdrop for local rappers, singers, lyricists and poets; Coleman gets things started and usually acts as moderator. The people joining him onstage, Moore says, don’t normally have the opportunity to flesh out their material with a full band.

“It’s been interesting because a lot of my friends are jazz guys, and a lot of Kemet’s friends are MCs, but those two communities are hardly ever in the same room together,” Moore says. “A lot of guys get to meet and play with each other that never would normally. The whole idea is to create on the spot, and we’re not necessarily trying to play tunes. Usually, we ask the MC what he wants to hear, and he’ll be like, ‘I wanna hear some funk,’ or whatever.

And it goes from there. That’s it, working on the fly and communicating with these people that you might not know.”

Coleman, who also co-leads the R&B-andfunk group the Phantastics, has adopted Moore’s passion for improvisation because,

Fresh Air Dear Dan: A couple of months ago, I got candida (a fungal infection) under my foreskin. I went to the doctor, picked up some cream and used it as directed.
