County reviewing idea of short-term rentals Changes to zoning ordinance hinge on local municipalities’ response By Kellen

T

he Walworth County Zoning Agency is expected to review responses from a letter sent out to municipalities in the county relating to the possibility of amending the county’s zoning ordinances when it comes to short-term rentals. County committees began looking at the idea again after Supervisor David Weber submitted a letter to the Walworth County Board of Supervisors in February. The county again picked up the topic of short-term rentals at the May 21 county Zoning Agency meeting, looking to gauge exactly how municipalities feel about amending the county’s current zoning ordinances through a survey. Under county zoning laws, short-term rentals are only allowed in very specific zoning districts and for no less than 30 days. Weber said he doesn’t think the county Zoning Agency will come to a majority consensus on the issue unless some type of major catastrophe were to occur. “If we’ve got one of the few houses that are used and abused, a house fire, 30 people on a deck that collapses, massive injuries, all of a sudden everybody’s got our attention and somebody’s going to come forward and say, ‘Why the hell aren’t you guys dealing with this,’” he said. Weber said he’s not looking to create a fright scenario, but he feels the county needs to be able to say they have records documenting the 800 or so properties being actively advertised and rented on a short-term basis. “We need to start some place with record-keeping, licensing, inspection, meeting state standards as well as our own, and that whole list of criteria,” he said. Weber said municipalities that have determined they don’t want short-term rentals can control their own communities, though the areas that don’t have that declaration need a “broader sense of responsibility to start controlling it.” Supervisor Rich Brandl said the reasoning behind sending the letter to townships is to gauge whether or not the idea of amending the county’s code regarding short-term rentals is worth a closer look. “If the majority of them say we like things the way they are, why beat our heads against

Maybe they’re not, maybe they are.” Michael Cotter, director of the county’s Land Use and Resource Management Department, said with countywide zoning control, individual municipalities cannot allow short-term rentals

to allow for short-term rentals. “We have done our homework, we have carried it as far as we can carry it and if there’s not support for it, then it should die, and rightfully it should die,” he said. “It’s worth putting the time into it and making sure we make a wise decision at the end of the day, whatever that is.” A July 10 deadline was set for responses from the towns,

at their level if it’s not allowed on a countywide level. Zoning Agency citizen member Jim Van Dresser said it’s a worthwhile effort to check in to whether or not municipalities would support amending county zoning codes

allowing county municipalities to review the idea in their local governmental meetings. The Walworth County Zoning Agency planned to tentatively discuss the topic further, after having time to review responses from municipalities,

at its July 16 meeting. Supervisor David Weber’s Feb. 20 letter to the Walworth County Board of Supervisors relating to short-term rentals can be found online at co.walworth.wi.us, on page 26 of the May 21 county Zoning Agency packet. Concerned residents Thus far, the county Zoning Agency has already received multiple letters of opposition from county residents, a large portion from the Lake Geneva area and included in the committee’s March 19 packet. Many of the letters opposing amending zoning ordinances to allow for rentals shorter than 30 days echo similar sentiments, that the allowance of short-term rentals would undermine the culture and beauty existing in the county today. Phil Stopa, a resident of Linn Township, wrote to the board in March stating he fears changing a law that had already been passed would not be in the best interest of the county.

“I believe short-term rentals bring people who do not really care about their neighbors or surroundings,” he wrote. Stopa further questioned committee members about who would monitor the rentals, what rights property owners living adjacent to a short-term rental property would have and if the county has the financial resources and staff to oversee these rentals. Others, such as Tim Freund, a part-time resident of Lake Geneva, commented that the area already has a sufficient number of hotels, motels and resorts that would make the allowance of short-term rentals an unnecessary provision. Andy Schmidt, president of

the Sunset Hills Homeowner’s Association in the Town of Geneva, argued supporting short-term rentals would support “personal and financial agendas for a few,” while disturbing the tranquility and peace of those who have obeyed the laws in place. Schmidt also noted the allowance of shortterm rentals could create a “security nightmare” for both homeowner’s associations and law enforcement who would be forced to respond to reports of short-term renters trespassing and making use of homeowner’s association private amenities.

History of single parcel island includes hosting a wedding Flag Island is located off the tip of Jansky Island in Middle Lake. Old site maps show the existence of two islands. Flag Island has the flagpole, while the smaller island is tiny landmass with an adjacent bog area.

Flag Island was owned by Edna Jansky since 1947. Jansky sold the islands to Ed Rubinic in 1979 for $3,000. Robert “Hollywood Bob” Broitzman bought Flag Island from Rubinic for $5,000 in 2001. Shortly after, Broitzman held his marriage

ceremony on the island. Several boaters witnessed the ceremony while passing through the channel from Middle Lake to Mill Lake. After the ceremony, the wedding party headed to Lauderdale Landings by pontoon boat for the reception. Broitzman deeded 50

percent of the island to his wife Maureen in 2003. They sold their Green Lake house in 2013, but still own the islands. The island is listed as a single parcel with one tax key number. The 2014 property taxes are $63.53.

from tax income, is to regulate it in a clear way and bring it out in the open,” the association’s letter said. “Given the economic benefits and the lack of evidence that short-term rentals are a problem, we believe that improved regulation, rather than a ban, is the right answer.” Neal and Deb Siegel on Green Lake, of Lauderdale Lakes, just north of Elkhorn, said they began renting their property in 2009 after the economic down turn, something that has helped them make mortgage and tax payments on the property.

In the Siegel’s letter to the committee, they noted they have not had a single incident bringing harm to the county or community in the six years they’ve rented their property. They said they’ve paid for annual licenses through the Department of Health Services, have completed required inspections and water testing, and their rental agency, Keefe Rentals has collected all of the appropriate taxes from their guests. Carey L. Rothbardt, of Delavan, said in the years of renting out a home, no problems have arisen as Keefe Rentals manages the property

and has a strict process when it comes to renting the property. “When I talk to individuals privately, whether they’re for or against, it takes on a little bit of a different spin, a different level of understanding, if they see this bigger picture,” Weber said at the May 21 meeting. “If they’re not willing to look at the bigger picture and their attitude is ‘no, absolutely no short term rental,’ it doesn’t begin to solve the problem, unless, for some reason, you come up with an inordinate amount of money to create a huge staff that can go out at all hours of the day and night and do the inspections.”

Cathi Piwko, owner of Soleil Caffe in Elkhorn said she too has seen a rise in popularity of coffee shops since she purchased Soleil Caffe a little over two years ago. Thanks to her most popular offerings – tanning, ice cream and coffee – Piwko said she’s seen her fair share of success over the past few years. Piwko said now that she has

seating available – thanks to a recent move from a nearby storefront – the number of customers coming in for coffee and sticking around has increased. “We are getting a lot more now,” she said. working in July, but even since then, we’ve seen an increase – we have a breakfast and lunch rush now,” Manke explained. “I think it’s the word of mouth spreading that’s doing it, we’ve only been open a year and a half and a lot of people are still coming in for the first time.” Manke added, “The shop’s atmosphere and set up inside brings people back. They love to sit and do work, we have a lot of writers coming in working on things. “We had a lady the other day who said ‘I finished my novel’ and I told her she needed to bring it in when she gets published,” Manke added. “We have meetings here, friends getting together and people just chatting. What started as sidling up to the counter at a dinner, or engaging in the local coffee klatch at a café, has turned into big business. Businesses like Starbucks and Peets Coffee thrive on the expert cup of coffee, but even more so, local coffee shops have become havens for those looking not just for coffee, but for a little extra creativity on the side. The owner of Friends on the Square in Elkhorn, Kelly Odling, said she’s seen an increase in popularity of local coffee shops over the past several years. “Everybody wants to own one,” she said. Odling said her location on North Wisconsin Street in Elkhorn has had its fair share of success, growing considerably since opening three years ago. Over the past three years, she said, she’s seen just how much of a community gathering place coffee shops have become. She said she gets a lot of families coming through, students after school – whether they’re studying or just socializing – and even people meeting for job interviews. “I think a coffee shop has become a comfortable, social place to do interviews and business,” she said. Odling said she feels Friends on the Square offers a more family-friendly sort of atmosphere, steering away from being a quiet place toward more of a communitygathering place. “We have checkers out, cards, we do an open-mic night,” she said, noting they often have patrons bringing in their grandchildren to teach them how to play checkers. “So many people refer to us as the ‘Cheers!’ place because it’s just so happy and funny,” she said.

Swallowing water can be fatal hours after swimming Summer 2015 • Third Edition

Drowning is a danger any time of the year and wherever water is present. Instances of drowning escalate in the summer, when more people are apt to spend time in the pool or lake. But drownings can occur year-round, and young children are at the greatest risk of drowning. While many people are familiar with the risk factors that lead to drowning, many have never heard of secondary drowning, a related condition that can occur hours after leaving the water. According to the World Health Organization, drowning is the third most common cause of accidental death across the globe, accounting for almost 400,000 deaths annually. When a person drowns, he or she takes water into their larynx and lungs, which is known as aspiration. Lack of oxygen in the body causes bodily systems to shut down, and cardiac arrest and brain damage can result. Secondary drowning, also known as dry drowning or delayed drowning, is a post-immersion respiratory syndrome. It occurs when water or another fluid has entered the lungs but has not caused enough initial trauma to result in fatal drowning. However, water that has gotten inside the lungs may cause damage to the inside surface of the organ, collapse alveoli and cause a hardening of the lungs that reduces

strong indicator of water aspiration. Trouble breathing – Difficulty breathing long after a person has been swimming may indicate secondary drowning. Lethargy – Extreme tiredness or a sudden lack of energy may be indicative of a problem. Monitor for the symptoms

of dry drowning anytime a person swallows water. Keep the person nearby and do not allow him or her to go to sleep, as some children have died from secondary drowning in their sleep. If you notice any symptoms of dry drowning, take the person exhibiting those symptoms to the hospital, as this is not

something that can be treated at home. According to the American College of Emergency Physicians, a person would only have to inhale four ounces of water to drown and even less to injure his lungs enough to become a victim of secondary drowning. Emergency room physicians can remove residual water from the lungs

and administer life-saving oxygen. Although not all instances of swallowing water will result in dry drowning, it is beneficial to understand and learn to recognize secondary drowning symptoms so fast action can be taken if necessary. (METRO CREATIVE)

the ability to exchange air. The body may also retaliate against the foreign water by drawing more fluid into the lungs. Over time, the lungs will suffocate themselves, which is why dry drowning can occur hours after exiting the water. Children tend to be more prone to dry drowning than adults. Parents are urged to keep careful watch over children who experienced distress in the water, which may have resulted in the inhalation of fluid. Furthermore, the children who are most at risk for dry drowning are those with known breathing or lung problems, including underdeveloped lungs or asthma. The following are potential indicators of secondary drowning. Prompt action should be taken if any of these signs are noticed after an adult or child leaves the water: Persistent cough – Anyone who has swallowed water will cough and sputter as the body attempts to naturally expel the water. But persistent coughing that lasts long after the water has been breathed in may be indicative of water aspiration in the lungs. Confusion – Difficulty understanding verbal instructions or not being able to form words or thoughts may be a symptom of dry drowning. Pain – Chest pain is a

beach in his youth. This was their first trip to the beach this year and they were excited to spend a day at the lakeshore. Lifeguard Alex Halldorson has worked at this beach for the past two summers. It was obvious that she appreciates the importance of her job. As we talked her eyes continued to scan the waterline making sure everyone was okay. “I enjoy working here because everyone is so friendly. I meet so many people,” she said. “There is a steady flow of visitors throughout the day.” Like all of the beaches glass and alcohol are not allowed. Parking is available across the street without charge. Entry fee is $7 for adults and $4 for children. Fontana Fontana Beach – 505 Lake St., Fontana, (262) 275-6136 – is another large beach that attracts many visitors especially families. According to Corinne Kenny who is in her eighth year managing the beach, the beach is popular because it has deep sand and a grassy knoll behind and is kept scrupulously clean. On alternate Saturday nights a family movie is shown on the beach. The screen is brought in by Big Foot Recreation, which oversees the showing of the movie. There is a charge of $1 per person for the movie. “This is one of the special things about our beach,” Kenny said. Food and beverages are allowed but no grills, glass, or alcohol. The water has two separate lines of buoys, one to mark the shallow end up to four-feet deep and the second section for the deeper

water. Beach officials do not recommend going past the second line of buoys. Three or four lifeguards are on duty and one of the lifeguards is usually on the pier to better watch those in the deeper water. Pleasant Lake beach Pleasant Lake Beach Park, located off of Highway 12, across from Green Lake, is a semi-private sandy beach on the clear waters of Pleasant Lake. While this list is not a complete list of all the beaches available in the area, it includes some of the best and most popular. So pack up that picnic lunch, put on your swimsuits, and head to the beach for a couple of hours or a full day. A day in the sunshine filled with outdoor activity is sure to make lasting family memories.

Ways to go green on your trip to the farmers market

Summer heralds the return of farmers markets throughout the area. A trip to the market is a great opportunity to indulge in fresh, healthy produce and to expand your horizons by trying new items or preparing them in different ways. Here are eight tips from the folks at Simply Organic to make the most of your visit to the local farmers market: 1. Note the hours and dates of your local market on your calendar. Set reminders on your smartphone that will alert you when favorite items such as tomatoes, peas, beans and strawberries come into season. 2. Prepare your refrigerator and kitchen for the season’s harvest. Clean out your fridge’s produce drawer, and stock up on items that complement fresh produce, such as salad dressings and seasonings that can be used to turn basic veggies into delicious meals. 3. Proposal offers a better way to assess property By Richard Chandler CONTRIBUTOR

Should property assessment be done by 1,851 different units of government in Wisconsin as it is now? Or is there a more efficient way to perform this important function? Wisconsin now has a municipal-only assessment system with 1,851 cities, villages and towns separately assessing property in their jurisdictions. This is the highest number of property assessment jurisdictions in the country. The 2015-17 state budget includes a property assessment reform proposal to make the assessing process more efficient. Wisconsin would move to a county-based system with an option for larger municipalities to continue to

assess property. This would reduce Wisconsin’s 1,851 assessment units to about 90, which will save money at the local level through economies of scale. Forty states already have a county-based assessment system like the one we are proposing. This proposal also creates a consistent standard by requiring that all property be assessed at full market value each year. While some Wisconsin municipalities already do this, others vary widely. In 2014, assessments for residential property ranged from 75 percent to 135 percent of full market value. A consistent full market value standard would save money at the state level by eliminating the need for the current costly and complex

“equalization” process which is needed to translate the different levels of local assessments into a consistent statewide measure before tax bills and state aid can be sent out. The proposal would result in position savings in the State’s Bureau of Equalization. Property owners would see their assessments reflect the market each year, which avoids the large swings that can currently occur if assessed values have not been reviewed for a number of years. This proposal would not cause property taxes to go up because it maintains the total amount of property taxes local governments can collect. Property owners would still have local open book assessment review meetings where they could discuss changes to their

values with an assessor, and they would be able to appeal their assessments to a Board of Review, which would meet at several locations in each county. If we were designing an assessment system starting with a clean sheet of paper, we wouldn’t come up with the current complicated system, which has a multitude of small assessment units, many different approaches to valuations, and the need for complex revisions to make valuations consistent across the state. We have a chance to move to a better system, which will save money, keep assessing local, and make assessments uniform throughout the state. There are more than 12 million recreational boats in the United States. If you are a boat owner, it can be smooth sailing if you take care of the motor and follow the proper guidance when it comes to fuel. While many boaters have heard warnings that ethanol cannot be used in boat engines, nothing could be farther from the truth. A 10 percent ethanol mix (E10), which is used in

almost all transportation fuel nationwide, can be safely used in marine engines today, including two-stroke engines, four-stroke engines, inboard motors and outboard motors. In fact, a 10 percent ethanol mix has been approved for years by marine engine manufacturers such as Honda, Kawasaki, Mercury Marine, OMC (Johnson/ Evinrude), Pleasurecraft, Tigershark (Artco), Tracker

and Yamaha. “There is a myth out there that 10 percent ethanol is not good for marine engines, but we have been operating for over 20 years and have not had any issues with it whatsoever … There are absolutely no problems running on 10 percent ethanol,” Vernon Barfield, former Technical Chairman and Vice President of the National Boat Racing Association, said.

What about E15? Boaters should remember that although E10 is fine for marine engines, E15 is not approved for use in boats. E15 is approved by the Environmental Protection Agency only for use in flexfuel vehicles and vehicles model year 2001 and newer. If you have any questions or concerns about what fuel to put in your boat, consult your owner’s manual or contact your engine manufacturer.
