INTRODUCTION It is with great pleasure that we present the first edition of our revamped auction catalogue of fine wines. Spink Fine Wines, a fully owned division of Spink, will bring the expertise and integrity that we are synonymous with in the world of collectables. Spink was founded over three hundred years ago, in 1666, almost a full century before the Prince de Conti paid 8,000 livres outbidding Madame de Pompadour, the mistress of Louis XV of France, for the Domaine Romanée-Conti. Sadly, DRC was not bought in a Spink auction, but we are always looking for new ideas, in terms of business strategy, client services and technology. Like the good vine Spink has deep roots and is not averse to a bit of flamboyance from time to time. Over the years travelling to Asia, where we have been holding auctions for several decades in Hong Kong and Singapore, I was often asked by our Asian based clients, “why don’t you start a wine business? It would fit so well in your portfolio, you know where there are a lot of rare wines, we trust you, and the vast majority of your customers are also wine lovers”. Finally we did it with the recent acquisition of Oeno China in Hong Kong, and this is the first fully rebranded edition of our new catalogue, under the direction of our two wine experts Anna Lee, Vice-Chairman, based in Hong Kong, and Guillaume Willk-Fabia, Director of our Fine Wines Department. I trust you will find our catalogue slightly different from our main competitors. We shall try to stay away from the recent and speculative wines, which account for most of the market volume, to focus on rare bottles for collectors or ready to drink treasures. So our auctions

As we do in our other 60 plus non-wine auctions per year, the focus will be on provenance and quality with a special emphasis on relationships with the Châteaux. As you will see in this catalogue for example, a very rare original wooden case of 6 bottles of sought after Château Cheval Blanc 1947 and an original wooden case of Château d’Yquem 1929 are on offer. Both of these have been checked by the Châteaux and the successful purchaser will be offered a private tour of the Château. Similarly we are offering very rare Imperiales directly from the cellar of the newly classified Château Pavie as a Premier Grand Cru Classé A. It was a well deserved promotion and to celebrate this rare achievement, the owners of Château Pavie would be delighted to welcome the buyers of the Imperiales to their estate. While it is our current intention to have all our wine auctions in Hong Kong, and maybe occasionally in Singapore, a good proportion of the lots are sourced from our clients in Europe, so located in the EU. Hence our collectors from Europe and USA have a chance to compete on some lots with our clients from Asia. I hope you will recognise Spink’s unique style in our wine catalogues, and enjoy the sale.

Levels for Bordeaux Bottles HF – High Fill The standard level for young wines or older bottles recorked at the Chateau. IN – Into Neck Perfect level for a wine of any age. Indicates very good storage conditions. Outstanding level for a wine 10 years of age or older. BN – Base of Neck Good level for a wine of any age. For wines 10 years of age or older, indicates perfect storage conditions. VTS – Very Top Shoulder Acceptable level for red Bordeaux wines around 20 years old. HS – High Shoulder Acceptable for wine over 25 years old. Good for wine over 40 years old. MS – Mid Shoulder Not unusual for wines over 40 years old. Could indicate early signs of cork failure. LMS – Low-Mid-Shoulder Usually indicates deterioration of the cork. LS – Low Shoulder May indicate poor storage condition and possibly an undrinkable wine. Levels for Burgundy Bottles The shape of Burgundy bottles does not allow for a level rating system based on the shoulder of the bottle; levels are described in terms of centimeters below the cork. Generally, Burgundy bottles with a fill level of 2.5cm or above are considered normal for wines younger than 10 years of age. Wines more than 15 years old of age with fill levels of between 4cm and 6cm are generally considered to be sound provenance, though consideration should be given to the clarity and colour of the wine in the bottle, as well as the condition of the cork. Burgundy bottles with fill levels lower than 6cm may be at risk of being damaged or undrinkable. < 2cm considered an excellent fill for any age. < 3cm a perfectly normal fill for wines 10 years of age and older. It is an excellent fill level for wines 25 years of age or older < 4cm considered a normal fill for wines more than 20 years of age and excellent for wine more than 35 years of age. On the other hand, it should be the cause for concern in wines 15 years and younger. < 5cm not uncommon in older wines of 30 years and more. At this level, some oxidation is likely to have occurred and the remaining wine may be fragile at best and not enjoyable at worst. < 6cm a poor fill level for any wine and not recommended for purchase unless extremely rare.

Tasting Note: “Perhaps the most beautiful packaging ever on a Bordeaux bottle, Baroness Philippine de Rothschild literally produced a work of art in the gold-engraved bottle of 2000 Mouton Rothschild. Of course, one can’t drink the glass, but this is a top-flight Mouton Rothschild, eclipsed only by the 2006 and 2009. A rich, tannic, earthy style, with loads of crème de cassis and floral notes, the final blend of 86% Cabernet Sauvignon and 14% Merlot is a full-bodied wine with plenty of coffee, earth, chocolaty notes, and still plenty of tannin to resolve. I gave it an anticipated maturity range of 2015-2050 back in 2003, and that looks on target.” HK$6,500-11,500

Lying in a private cellar in London, England 6 bottles in original wooden case Tasting Note: “Tasted three times since bottling, the 1996 Lafite-Rothschild is unquestionably this renowned estate’s greatest wine. As I indicated last year, only 38% of the crop was deemed grand enough to be put into the final blend, which is atypically high in Cabernet Sauvignon (83% Cabernet Sauvignon, 7% Cabernet Franc, 7% Merlot, and 3% Petit Verdot). This massive wine may be the biggest, largest-scaled Lafite I have ever tasted. It will require many years to come around, so I suspect all of us past the age of fifty might want to give serious consideration as to whether we should be laying away multiple cases of this wine. It is also the first Lafite-Rothschild to be put into a new engraved bottle (designed to prevent fraudulent imitations). The wine exhibits a thick-looking, ruby/purple colour, and a knock-out nose of lead pencil, minerals, flowers, and black currant scents. Extremely powerful and full-bodied, with remarkable complexity for such a young wine, this huge Lafite is oozing with extract and richness, yet has managed to preserve its quintessentially elegant personality. Château Haut-Brion vintage 1982 1982 An Outstanding Year It is rare that a year is so conducive to vine growth: dry in April, fine and dry in May, a few storms in June, before a sunny and hot July - on the 8th of this month the temperatures reached 40C. Tasting Note: “This was one of the best showings yet for this wine, which, to my palate and mind, has never lived up to its eary potential. In this tasting, the 1982 revealed a healthy dark ruby colour with lightening at the edge. Intense, persistent aromas of saddle leather, roasted herbs, scorched earth, and sweet black currant fruit were followed by complex flavours of minerals, spice box, and cedar. Although this medium-bodied, fleshy, ripe, concentrated wine is not a blockbuster, as it unfolds, it reveals layers of flavour in addition to this vineyard’s telltale complexity. It has thrown off the backward, youthful style that existed during its first 25 years of life, and over the last 4-5 years has developed such secondary nuances as cedar and spice box. The crème de cassis, underlying floral note, full-bodied power, extraordinary purity, multilayered texture, and finish of over a minute are a showcase for what this Château accomplished in 1982. The wine is still amazingly youthful, vibrant and pure. It appears capable of remaining fruity and vibrant in 2082! Thank God it is beginning to budge, as I would like to drink most of my supply before I kick the bucket. This is a great, still youthful wine, and, on occasion, one does understand the hierarchy of Bordeaux châteaux when you see the complexity and brilliance of this first-growth. GEOLOGICAL CHARACTERISTICS : Château Pavie has diverse terroirs: - Terroir typical of the Saint Emilion limestone plateau composed of claylimestone soil on an asteriated limestone subsoil. Located at an altitude of approximately 85 metres above the Dordogne River - Terroir called “milieu de côte” (middle of the slope) located approximately 55 metres above the Dordogne and composed of very fine brown limestone. VITICULTURE : Many plots have been re-planted. The vines are trained high to increase the leaf canopy. Pruned to six spurs for old vines and 2 for young ones, green harvesting, leaf thinning, as well as picking and sorting by hand. FERMENTATION : The way Château Pavie is fermented depends on the vintage. It is kept on the skins for 3 weeks in twenty temperature-controlled wooden vats. Malolactic fermentation in barrel and the wine is aged in new oak for 18-24 months.

Château Pavie was bought in 1998 by Mr Gérard Perse, the man who turned Pavie at the top of the new Saint-Emilion classification as a Premier Grand Cru Classé (A). Gérard Perse in a few dates October 2nd 1949

BORDEAUX SWEET “A wine that is just hitting its adolescence, this spectacular Yquem is the greatest vintage of the early 1980s and the best Yquem since 1976 and before the trilogy of 1990, 1989, and 1988. The wine has a medium-gold colour and an extraordinary nose of honey-dripped coconuts, pineapple, caramel, crème-brulee, orange marmalade, and no doubt a few other items. Unctuously textured and full-bodied, with massive richness and great sweetness, this is a seamless classic that will probably be immortal. Just under half the vineyard (3.51 hectares out of 8.03) of Richebourg belongs to Domaine de la Romanée-Conti, spread over several plots. This is always a robust wine, deeper in colour than the Romanée-Saint-Vivant but not necessarily as elegant. The vines currently average 45 years old. About a third of the holding remained in ungrafted vines 1946, with two cuvees being produced - a regular Richebourg and a version labelled Richebourg Vieux Cépages. When these vines were grubbed up and replanted after the Second World War cuttings were taken from la Romanee-Conti which was also being replanted. The Domaine purchased most of the 6.06 hectares La Tâche in 1933, completing the vineyards by exchanging small plots in Les Gaudichots. It stretches from the top of the bottom of the mid slope band which contains the grands crus, thus covering a complexity of terroirs. It is a more flamboyant wine than Romanée-Conti but needs a minimum of 10 years for all its aspects, including the tannins, to integrate.

Lalou Bize-Leroy and Aubert de Villaine seem to have everything tightly within their grasps, so it is unlikely that some of the lapses in quality control that occurred previously will resurface. Tahbilk “1860 Vines” Shiraz are listed as “Outstanding” in Australia wine auctioneers - Langton’s Classification of Australian Wine V - the noted reference to Australia’s secondary (auction) wine market - being a “high performing wine in exquisite quality”. Also, in 2002 US Wine & Spirits Magazine nominated the Tahbilk “1860 Vines” plantings as one of the 25 Great Vineyards in the World along with the likes of Hermitage La Chapelle, Chateau Lafite-Rothschild, Chateau Yquem, Vega Sicilia and Krug. The vineyards selected were those where the terroir - the French term that roughly translates to the total environment of a place, including soil, climate, aspect, vine and even history - “is most clearly perceptible in the wine”. JANUARY 13, 2013 - HONG KONG Tasting Note: Penfolds Grange Hermitage 1.5L MAGNUM 1980 The 1980 Grange is predominantly Shiraz with a small amount of Cabernet Sauvignon (4%) from the Kalimna and other Barossa vineyards, the Clare Valley, Magill Estate, McLaren Vale and Coonawarra. A generally good growing season with fine and warm conditions, was followed by a cool vintage. Considered an outstanding vintage, Tim White said of it at a tasting in September 1999, Deep crimson brick red. Intense plum, blackberry/ menthol, mocha /liquorice aromas, confection-like small berries, cherries and plums has a hint of treacle. Smooth and creamy, with flavours of mulberries, cassis and plums, it’s obviously a cooler season Grange wrapped around by sweet oak. It opens up after time in the glass, the tannins are pronounced but offset by stylish, rich, concentrated dark berry chocolaty fruit. First vintage adopting consistent use of signature red Penfolds capsules. Winemaker Comments by Don Ditter: “Medium red/purple. Intense, fragrant chocolate cherry/prune dried fig aromas. Dense and chewy with generously ripe, prune/ chocolate fruit flavours, pronounced grainy tannins and superb length.” Tasting Note: Penfolds Grange Hermitage 1.5L MAGNUM 1981 Winemaker John Duval called the 1981 a big, tannic Grange. A warm to hot, drought-affected summer yielded a powerfully concentrated wine with chocolate raisin fruit, earthy nuances, and pleasant oak. The 1981 Grange is a blend of 89 percent Shiraz and 11 percent Cabernet Sauvignon from the Kalimna and other Barossa vineyards, Magill Estate and the Modbury Vineyard in the Adelaide Plains. Tasting Note: Penfolds Grange Hermitage 1.5L MAGNUM 1979 “A blend of 87% Shiraz and 13% Cabernet Sauvignon, from superior vineyards, matured for eighteen months in new American oak hogsheads. Alcohol 13.00% Acidity 5%60g/L pH 3.72 Memorable for being the last of all vintages to be bottled in the original off-white foil capsules, and the first vintage to be bottled in magnums, nowadays there are usually six hundred magnum bottled each year. Deep brick red. A complex, aromatic wine with dark chocolate aromas and lifted rum and raisin fruit characters. Developing aromas of raspberries as the wine breathes, plums and vanilla oak, deep briar, blackberry and toast, earth and amber fruit, the bouquets are varied and complex. The palate is bitey and solid with plenty of fruit sweetness, compounds of earthy chocolate complexity and ample (but drying) tannins.”

Deep crimson brick red. Liquorice, dried fig, baked red fruit aromas. Coffee chocolate oak precede a plump, juicy and straightforward palate. The tannins are soupy and dense and build up very chalky and dry at the finish. Winemaker Comments by Don Ditter: “Dense purple/red in colour. Smoky meaty/spicy aromas and some toasty oak characters, also showing vanilla and coffee overtones. A combination of rich, fleshy, chocolaty and smoky flavours are balanced with pronounced tannins and length, resulting in a wine of immense concentration and powerful structure”. Tasting Note: Penfolds Grange Hermitage 1.5L MAGNUM 1982 A very good vintage with a mild growing season, culminating in a burst of warm weather. Predominantly Shiraz with a small amount (6%) of Cabernet Sauvignon from the Kalimna and other Barossa vineyards, Clare Valley, Magill Estate and Modbury near Adelaide, this is a wine with an open-knit, seductive style. Masses of delicious super-fleshy fruit throughout, very elegant and supple but undeniably a full-bodied wine with an assertive tannin finish.” Tasting Note: Penfolds Grange Hermitage 1.5L MAGNUM 1983 This vintage was seriously affected by drought, and the devastating Ash Wednesday bushfires. Summer rainfall was half the average, following by record rains and flooding in March. The 1983 Grange is predominantly Shiraz with a small amount (6%) of Cabernet Sauvignon, from the Kalimna and other Barossa vineyards, Magill Estate, and Modbury in the Adelaide Plains. Maturation in new American oak hogsheads for twenty months. Alcohol 13.30% Winemaker Comments by Don Ditter: “Very deep black cherry red. Dense, powerful dark chocolate spice/plum/ briar and mint aromas with some oak-derived coconut. A highly concentrated wine showing pronounced extract and tannins balanced with sweet plummy fruit and showing some cigar box characters.” Tasting Note: Penfolds Grange Hermitage 1.5L MAGNUM 1984 Max Schubert’s experimental work in the 1950s determined that South Australian Cabernet was unreliable, he recognised that Grange should be based around a spectrum of fruit. One of the great strengths of Grange is, whilst mostly a Shiraz, it does not rely on the performance of a single vineyard. From fruit grown at the Kalimna and other Barossa vineyards, Magill Estate in Adelaide, and other superior vineyards in the Coonawarra, McLaren Vale and Clare Valley, the 1984 is balanced with a small amount of Cabernet Sauvignon 5%. No other red wine in Australia can rival the reputation, consistent quality or proven development pattern of Penfolds Grange. Tasting Note: Penfolds Grange Hermitage 1.5L MAGNUM 1989 A very hedonistic, almost decadent style of Grange, gorgeously opulent, almost Pomerol-like Grange with an over-ripe characteristic to the fruit. Cherry liqueur intermixed with cranberry and cassis presented in a seductive, full-bodied, very soft, forward style is truly not the classic Grange in the sense of having huge structure and massive concentration, but this wine is loaded, very corpulent, and fleshy. The wine is going to last for up to two decades, but it will be uncommonly succulent and delicious to drink young. The 1989 is already beginning to show some attractive maturation characters and is developing a little sooner by comparison to it’s more robust 1988 and 1990 counterparts. 91% Shiraz and 9% Cabernet Sauvignon from the Kalimna and other Barossa vineyards, and the McLaren Vale. It has the typical solid structure and strength of character to age gracefully over the next decade or so, with correct cellaring, to produce another classic Grange. James Halliday calls this vintage flawlessly supple. In 1990 Grange dropped the Hermitage tag, to align with the name by which it had been known internationally for many years. 95% Shiraz, 5% Cabernet Sauvignon from Kalimna and other Barossa Valley vineyards, Clare Valley and Coonawarra. A very great vintage with a perfect warm, dry growing season and harvest, yielded a Grange with solid structure and dominant fruit characters. Regardless of vintage, Grange delivers a unique experience of Shiraz, but history will record 1990 as one of the great Australian vintages of a generation. The 1990 Penfolds Grange was one of the best to date, with the potential to rival the classic vintages of 1955, 1962 and 1971. Excellent structure and integration of spicy, earthy fruit and firm oak, finishing with great length of flavour.” Tasting Note: Penfolds Grange 1.5L MAGNUM 1993 Penfolds Grange, blossoms with fifteen to twenty years of bottle age, when most other reds have past their best, and better vintages can live and continue developing for decades longer. A self-taught, practical winemaker with a natural inquisitiveness for winemaking theory, creator Max Schubert embraced a romantic view of winemaking. Though he retired as Chief Winemaker at Penfolds in 1973, Max remained involved as a mentor and Winemaker Emeritus for another 20 vintages. 1993 is an earlier maturing vintage under Magnum, kept optimumly cellared. 86% Shiraz, 14% Cabernet Sauvignon from the Kalimna and other vineyards in the Barossa Valley, and the Coonawarra. One of Australia’s national treasures, Grange is the benchmark by which all other reds in this country, vintage 1993 Grange represents over forty years of winemaking excellence. To share a magnum of mature Grange 15 to 20 years old, in fine condition, is one of the great wine experiences. A very wet growing season was followed by warm, drier conditions, resulting in a very late but sound quality vintage fruit. An Indian Summer in the Coonawarra delivered fully ripened fruit. Winemaker comments by John Duval: “Dense plum red merging to brick red on rims. Intense blackcurrant and plum with malt, fig and liquorice aromas that leap from the glass. This has all the characters of a classic Grange. What is promised on the nose is delivered on the palate - a powerful, concentrated, opulent wine. Layers of Shiraz fruit and first class oak manifest themselves into a seemingly endless variety of flavours - deep plum, liquorice, black olive, chocolate, cedar, coffee, etc, all compressed into a silken, round mouth feel. Forceful, ripe tannins are balanced by sheer weight of fruit. It is hard to believe that 100% new American oak was used - the intensity of fruit has all but soaked it up.”

Winemaker Comments by John Duval: “Vibrant plum red. A fusion of cinnamon and mixed spices with blackcurrant blueberry and boysenberry fruit; savoury, underlying aromas of earth, cold tea and roast chestnuts plus barrel-ferment richness. Archetypal young Grange with concentration, balance and powerful berry fruit flavours, with blueberry at the core. Tight and structured, although the thick, ripe tannins are shrouded beneath a veil of opulent fruit. Excellent length and persistence of flavour and masterful handling of oak. A very fine Grange that will confidently sit alongside the great 1990.”

Tasting Note: Penfolds Grange 1.5L MAGNUM 1994 Grange 1994 represents an excellent offering from an above average vintage. Layers of massive Shiraz fruit and expertly crafted oak manifest themselves. Forceful, ripe tannins are balanced by sheer weight of fruit. The Barossa experienced a drier than average growing season with rainfall at 83 percent of the 10 year mean, reducing yield in a virtually disease-free season. Ripening was slow. Good sugar levels, alcohols and ripe flavours were realised. Good rainfall in the McLaren, Coonawarra had a warm, dry autumn followed by a cool slightly wet summer. Alcohol 13.50% Acidity 7.20g/L pH 3.55%

Tasting Note: Penfolds Grange 1.5L MAGNUM 1997 A big, typical Grange and a very good wine from this vintage. Smooth, sumptuous and firmly structured, its deep, long palate of dark red and black berry flavours is wound around firm, but powder-fine tannins. The 1997 vintage is predominantly Shiraz (96%) with a small amount of Cabernet Sauvignon (4%) from the Barossa Valley and McLaren Vale. A somewhat challenging vintage combining a cool start to the season with heat in the high summer. Budburst was slightly later than usual in most South Australian regions, with mild weather through to Christmas. The onset of a prolonged heat wave in February further delayed ripening. Fortunately, a sunny, warm autumn followed, allowing vines to reach full ripeness. Maturation twenty months in new American oak. Alcohol 14.00% Acidity 7.00g/L pH 3.52

The Barossa experienced a drier than average growing season with reainfall at 83 percent of the ten year mean, reducing yield in a virtually disease-free season. Ripening was slow. Winemaker Comments by John Duval: “A deep, crimson red. Immediately engaging, with wafts of nutmeg and ginger amongst notes of blueberry and blackcurrant and a background of wellseasoned savoury oak. The fruit gains in the glass with aeration, when more subtle perfume and chestnut complexities emerge. Already showing excellent balance within the frame of a beautifully interwoven mesh of dark plum and blackberry fruits with fig and liquorice. Complex fruit and spice flavours sit against a finely focused backdrop of firm but rounded tannins, balancing acidity and seductive, perfectly integrated, smoky oak. The palate has wonderful length, with a tightly structured, tannic finish indicative of the calibre of this fine wine.”

Tasting Note: Penfolds Grange 1.5L MAGNUM 1995 The 1995 Grange is the 45th consecutive vintage of the wine that carries the flag for the Australian wine industry. Fruit from the Barossa and the McLaren Vale, the Magill Estate and Padthaway. Grange’s weight and concentration can be traced to rigorous selection of intensely flavoured Shiraz grapes from mature vines in some of South Australia’s finest vineyards. Cool spring weather followed by a warm summer and very low rainfall created one of the classic vintages of the last two decades. Fruit quality was outstanding with incredible intensity of flavour, fine tannins and structure. The 1998 vintage of Penfolds Grange ranks amongst the very finest released.

Tasting Note: “A deep, clear garnet colour. The nose is very backward, quite austere and conservative with notes of cherry and raspberry leaf, a touch of cigar box developing with aeration. It perhaps lacks a little joie-de-vivre, especially when compared to vintage in the 1970s. The palate is attractive though, with notes of raspberry, plum, white pepper, blood orange and a touch of apricot. This is a massive, magnificently rich, full-bodied port that will be far more flattering in its youth than were such Taylors as the 1983, 1977, or 1970. CONDITIONS OF BUSINESS Spink Fine Wines and Buyer hereby agree to the following terms and conditions for auctions conducted by Spink Fine Wines: 1 The Buyer The highest bidder shall be the buyer at the ‘hammer price’ and any dispute shall be settled at the auctioneer’s absolute discretion. Every bidder shall be deemed to act as principal unless there is in force a written acknowledgement by Spink Fine Wines that he/she acts as agent on behalf of a named principal. 2 The Premium The buyer shall pay to Spink Fine Wines a premium of 22% of the hammer price on all lots. 3 Bidder Registration Bidding is strictly by paddle only. All floor bidders are requested to register prior to bidding. 4 Payment Immediately after a lot is sold the buyer shall:(a) give to Spink Fine Wines his name and address and, if so requested, proof of identity: and (b) pay to Spink Fine Wines the ‘total amount due’. 5 Any payments by a buyer to Spink Fine Wines may be applied by Spink Fine Wines towards any sums owing from that buyer to Spink Fine Wines on any account whatever without regard to any directions of the buyer or his agent, whether express or implied. 6 Ownership The ownership of the lot purchased shall not pass to the buyer until he has made payment in full to Spink Fine Wines of the ‘total amount due’.

(b) to rescind the sale of that or any other lots sold to the defaulting buyer at the same or any other auction; (c) to re-sell the lot or cause it to be re-sold by public auction or private sale and the defaulting buyer shall pay to Spink Fine Wines any resulting deficiency in the ‘total amount due’ (after deduction of any part payment and addition of re-sale costs) and any surplus shall belong to the seller. (d) to remove, store and insure the lot at the expense of the defaulting buyer and, in the case of storage, either at Spink Fine Wines or elsewhere; (e) to charge interest at a rate of not exceeding 2% per month on the ‘total amount due’ to the extent it remains unpaid for more than 7 working days after the day of the auction; (f) to retain that or any other lot sold to the same buyer at the same or any other auction and release it only after payment of the ‘total amount duel; (g) to reject or ignore any bids made by or behalf of the defaulting buyer at any future auctions or obtain a deposit before accepting any bids in future; (h) to apply any proceeds of sale then due or at any time thereafter becoming due to the defaulting buyer towards settlement of the ‘total amount due’ and to exercise a lien on any property of the defaulting buyer which is in Spink Fine Wines’ possession for any purpose. 10 Liability of Spink Fine Wines and Sellers All goods are sold “AS IS”. Illustrations in catalogues are for identification only. Buyers should satisfy themselves prior to the sale as to the conditions of each lot and should exercise and rely on their own judgment as to whether the lot accords with its description.

7 Collection of Purchases (a) The buyer shall at his own expense take away the lot purchased not later than 7 working days after the day of the auction but not before payment to Spink Fine Wines of the ‘total amount due’.(b) The buyer shall be responsible for any removal, storage and insurance charges on any lot not taken away within 8 working days after the day of the auction.

11 Unsold Lots Spink Fine Wines reserves the right to charge commission up to one- half of the ‘stated rates’ calculated on the ‘reserve price’ and in addition ‘expenses’ in respect of any unsold lots.

8 Buyers responsibilities for lots purchased The buyer will be responsible for loss or damage to lots purchased from the time of collection or the expiry of 7 working days after the day of the auction, whichever is the sooner, and neither Spink Fine Wines nor its respective staff or agents shall thereafter be responsible for any loss or damage of any kind, whether caused by negligence or otherwise, while any lot is in their custody or under their control.

13 Any representation or statement by Spink Fine Wines in any catalog as to authorship, attribution, genuineness, origin, date, age, provenance, condition or estimated selling price is a statement of opinion only. Every person interested should exercise and rely on his own judgment as to such matters and neither Spink Fine Wines nor its respective staff or agents are responsible for the correctness of such opinions.

9 Remedies for non-payment or failure to collect purchases If any lot is not paid for in full and taken away in accordance with Conditions 4 and 7. or if there is any other breach of either of those Conditions, Spink Fine Wines as agent of the seller shall, at its absolute discretion and without prejudice to any other rights they may have, be entitled to exercise one or more of the following rights and remedies:(a) to proceed against the buyer for damages for breach of contract; Spink Wine (01/13)

16 Spink Fine Wines has absolute discretion without giving any reason to refuse any bid, to divide any lot to combine any two or more lots, to withdraw any lot from the auction and in case of dispute to put up any lot for auction again. 17 (a) Any indemnity under these Conditions shall extend to all actions, proceedings, costs, expenses, claims and demands whatever incurred or suffered by the person entitled to the benefit of the indemnity. (b) Spink Fine Wines declares itself to be trustees for its respective relevant staff and agents of the benefit of every indemnity under these Conditions to the extent that such indemnity is expressed to be for the benefit of its staff and agents. 18 Any notice by Spink Fine Wines to a seller, consignor, prospective bidder or buyer may be given by pre-paid mail in Hong Kong or Macau or airmail outside Hong Kong and Macau and if so given shall be deemed to have been duly received by the addressee one week after posting. 19 These Conditions shall be governed by and construed in accordance with Hong Kong law. All transactions to which these Conditions apply and all matters connected therewith shall also be governed by Hong Kong law. Spink Fine Wines hereby submits to the exclusive jurisdiction of the Hong Kong courts and all other parties concerned hereby submit to the non-exclusive jurisdiction of the Hong Kong courts. 20 In these Conditions of business:(a) ‘catalog’ includes any advertisement, brochure, estimate, price list and other publication; (b) ‘hammer price’ means the price at which a lot is knocked down by the auctioneer to the buyer; (c) ‘total amount due’ means the ‘hammer price’ in respect of the lot sold together with any premium, and additional charges and expenses due from a defaulting buyer in Hong Kong dollars; (d) ‘sale proceeds’ means the net amount due to the seller being the ‘hammer price’ of the lot sold less commission at the ‘stated rates. and ‘expenses’ and any other amounts due to Spink Fine Wines by the seller in whatever capacity and howsoever arising; (e) ‘expenses’ in relation to the sale of any lot means Spink Fine Wines’s charges and expenses for insurance, illustrations, special advertising, packing and freight of that lot. 21 The headings in these Conditions do not form part of the Conditions but are for convenience only.

NOTICE Bids If instructed, Spink Fine Wines will execute bids, and advise the intending purchaser. Lots will always be bought as cheaply as is allowed by such other bids or reserves as are on Spink Fine Wines’ books. Bids may be placed in writing before the commencement of the sale by giving to Spink Fine Wines a bid form for the lot, duly filled in with the name, contact phone number(s), full address of the buyer, number of the lot, and amount of the bid in Hong Kong dollars. All bids when placed by telephone are accepted only at the sender’s risk, and must be confirmed to Spink Fine Wines in writing, or by facsimile, before the sale. Clearance of Purchases In order to avoid delay in clearing purchases, buyers unknown to Spink Fine Wines are advised to make arrangements before the sale for payment or for references to be supplied. If such arrangements are not made, checks will be cleared before purchases are delivered. Purchase by Non-Residents Purchases made by non-residents in Hong Kong may be exported on the instructions of the buyer at his expense. Payment shall be made in the full amount equivalent to the successful bid in Hong Kong dollars. Shipping instructions may be given upon payment to Spink Fine Wines. Please note some lots are marked EU to indicate that they are lying within the European Union tax free for export from their country of origin. Applicable local tax and/or duty will apply for local delivery outside of Hong Kong. Currency Converter A currency converter will be operated at our auctions but only for the guidance of bidders. All foreign currency amounts displayed are approximations based on recent exchange rate information and may not be relied upon to calculate any invoices or statements. Upon receiving your written instructions, our representative will make every effort possible to try to acquire the lot(s) of your choice at the lowest price possible, and never to exceed the top limit you indicate. This service is complimentary and with strict confidence. Spink Fine Wines offer this value-added service as a convenience to our clients who are unable to attend the auction, however, Spink Fine Wines will not be held responsible for error, omission or failure to execute bids. PLACING ABSENTEE BIDS To place bids, please use the absentee bid form provided in the catalog. Be sure to accurately record the lot number(s) and the top price you are willing to pay for each lot “Buy” bids will not be accepted.
