VtSTNilt WEST, TEXAS Woodmen of the World ma svou hlavni kancelat v Omaze, ale operuji take v Texasu, kde maji kolem 75.000 Menu. Jsou tedy zastoupeni v Texaskem kongresu, maji psalm na 20 delegate do statniho sdruZeni. Podobne bratrskY spolek Zapadni C' esko-Bratrska Jednota operuje Texasu, mall pies 1,500 Ilene v Texasu a jsou opravneni na 4 delegaty. Nate Jednota je opravnena na 16 delegatft do statniho kongresu. Roclina Nemcova bydlela v Bryan a pied 7 lety odstehovala se do Hubbard, kde maji krasnY otechovY sad a mnoho jineho ovoce. Tarn ten se vSe zavodnuje. The Turn Around je pamatne misto, kde prvni vYprava v roce 1805 pod veliteli Lewis a Clark priSla v ta mista k rnori, kde se otoeili a sli zpatky. JeSte ten weer, neZli jsme odjildely, promitali celou jejich sbirku projektorem na platno. Stat Oregon je bohaty na prirodni krasy. ROWENA'S "COUNTRY DOCTOR" It was during the Youth Section Meeting, held by the Texas Fraternal Congress in San Antonio last week that one of the speakers mentioned that "a little town not far from San Angelo, named Rowena, paid a tribute to the doctor who has served the town for almost forty years." The speaker did not name the doctor, but I well guessed who the doctor was. After the session, I went to see the speaker and asked him for the details. He pulled out a clipping from the San An, gelo newspaper and showed it to me. I burrowed the clipping long enough to copy it and I gladly give it to the readers of the Vestnik. Here is the clipping: ROWENA PAYS TRIBUTE TO "COUNTRY DOCTOR." Rowena, Nov. 13. — This town paid an installment Thursday night on a debt to the "country doctor" who has served Rowena and the surrounding countryside for almost 40 years. A long line of speakers saluted the physician, Dr. John J. Schiller, and each made it clear that all they could do would not begin to pay ,back the man who had guarded the health of the community for so many years. Dr: Schiller, 75, received a plaque and citation from the local chapter of Woodmen of the World in a ceremony attended by some 350 persons at the ODI-TS Hall here. Almost a third of the crowd stood when a speaker asked how many in the assemblage has been delivered by Dr. Schiller. He estimated he has delivered 1,400 babies since he came here in 1913. EVERYDAY LEGAL PROBLEMS Most lawyers and judges are appalled at the average person's lack of legal knowledge. Naturally, no once expects you to know all the laws, by-laws, and decisions that line the bookshelves of a lawyers office. But some are important. A few basic questions about law have been gathered below. Use these facts as a guide to your legal problems. If in doubt, call a lawyer. One cardinal law to remember about contracts of any type is the following: "Read Before You Sign and Keep a Copy." Practically every business transaction involves a contract in. some form — oral or written, expressed or implied. A contract is a meeting of the minds of persons in agreement to do certain things. It is, in general, an agreement in which two or more parties bind themselves to do or not do some act, and each acquires a right to what the other promises. If a contract is entered into under "pressure" or on threat of bodily harm, is it binding? No, but it would be necessary to prove to the satisfaction of a court that you were restrained from exercising your normal judgment or free will. The burden of proving that rests upon you. Is a contract binding on a minor? No, not if the minor chooses to repudiate it. In this respect, any one who makes a contract with a minor does so at his own risk. Is a contract made with a minor binding on that person when he becomes an adult? With a few exceptions the minor, upon becoming of age, may repudiate or affirm a contract made when he was a minor. Ordinarily, if a minor does nothing to repudiate a contract promptly on becoming of age, he thereby affirms it without any action on his part. Is a written contract always identified by a heading and the word "contract"? No, and it is not necessary for a written contract or agreement to be so labeled in order to be binding. Contracts can be evidenced by receipts, sales slips, guarantees, applications, payment of money or a deposit, questionnaires, etc. What types of contracts must ordinarily be in writing? Usually, the types of contracts which must be in writing include contracts involving large sums of money; contracts for the purchase of real estate; conditional sales contracts; contracts which require more than one year for performance; promises to pay the debts of another; and contracts made in connection with settling estates. If a person signs a written contract,

The parties are presumed to have written everything down that was agreed upon., However, there are many exceptions and circumstances under which the oral promises or provisions can be proven and enforced, such as when they constitute fraud or if the meaning of the written contract is unclear without them. Is a contrast ordinarily binding when it is signed in blank and the pertinent facts are inserted later? If the pertinent facts agreed to by you are inserted, the contract is binding. If incorrect facts and promises or provisions are inserted, you will not be held liable if you can convince a judge or jury that this is the case. Why take this chance? Have contracts completely filled in before you sign them. If you sign a contract simply to get rid of a persistent salesman, is, it binding? Yes, the written contract is evidence of your understanding. You cannot break it. If you misunderstand part of a contract, is it binding? Ordinarily, yes. The written contract is evidence of understanding-and in most cases there is no reason why its terms should not be carried out. If, however, you can prove that the other party used fraud to purposely mislead you, then you may not 'be bound. Is it possible to change a contract after it has once been signed? This is possible only when your proposed changes are mutually agreed upon by all the contracting parties. Is the fact that a contract is "tricky" any argument for claiming it invalid or voidable? Yes, but whether it may be voided or set aside depends upon a court's judgment as to whether fraud is involved. Is a guarantee a guarantee of satisfaction or your money back? Not necessarily.. This depends upon the specific terms of the guarantee. It is of extreme importance to know and understand the tern's and limitations of all types of guarantees. • Are so-called "buy-back" contracts an effective protection for investors? No. Like a money-back guarantee, a boy-back contract is only as good as the integrity and financial capacity of the one who makes it.

What is a conditional sale contract? The conditional sale contract is a type of contract generally used in connection with selling goods on the time payment plan. Mainly, it provides that the seller gives the buyer possession of the goods on the condition that the buyer shall pay for them with certain agreed installments, title to the goods remaining with the seller until the last payment has been made. Among provisions serving to protect the seller in conditional sale contracts is usually a stipulation that„ if the buyer fails to make any payment when due, the seller may claim the entire balance as immediately due and payable; or repossesses the goods, and, in many cases sue for the amount of the sales price not yet paid, minus the amount of money the seller obtains when he repossesses the goods and sells them. What is a chattel mortgage? This is a paper usually signed by a person who borrows money or buys "on time," by which he transfers title to personal property as security for the amount owed. "Personal property" includes such things as automobiles, radios, refrigerators, household goods, and the like. What is a note? A promisory note is a written promise to pay a definite sum of money to a particular person on a given date. When your borrow money you sign and deliver a note to the baftk, loan company, or perhaps a friend. A note may be either negotiable or non-negotiable. If negotiable, it will contain a promise to pay to "the order of" a certain person or persons, while if it is non-negotiable it will contain only a promise to pay a Specified person and not also "to his order". If you become involved in a transactions requiring an analysis of your rights in connection with a promisory note, you should consult a lawyer. If, after signing an installment contract, you decide to pay up the entire balance in one lump sum, are you entitled to an adjustment on the finance or carrying charge? In most installment contracts an amount is added to the price at which the article will be sold for cash, which is called the "carrying" or "finance charge." `Unless a special provision providing for an adjustment of this charge is contained in the contract or required by a state law, you are not legally entitled to an adjustment if you decide to pay up the entire balance in one lump sum. If you fail to keep up payments on installment purchase, will the seller come and take the goods back? Failure to make payments is -a breach of contract and makes the buyer liable. The seller naturally is interested in obtaing payment for the goods he sells and as a rule, will repossess the goods only as a last resort. If the selleinis not able to sell the repossessed goods for as much as the buyer still owes him, the installment contract sometimes makes it possible for the seller to obtain a judgment against the buyer for the amount of money the buyer still owes on the installment contract, minus the amount of money the seller obtains from the resale of the goods. If merchandise bought on the installment plan is repossessed, is the seller ordinarily permitted to keep what payments have already been made? Yes. The seller is ordinarily entitled to such paymants in return for use or rent of the merchandise by the buyer. Must a store refund the purchase price if the buyer changes his mind? If a merchant misrepresents his goods, or if the merchandise is defective, you are entitled to relief and justified in expecting satisfactory adjustment or a refund. Otherwise, you have no more legal right to expect a merchant to refund your money than the merchant has to ask you to give him back the merchandise. A promise to refund or exchange should be honored. Must a store refund a deposit? It is the policy of many merchants to refund or, at least, to apply the amount deposited on the purchase of another article, if the customer is dissatisfied. A refund should be made if the deposit was made upon promise of asrefund. Is one obliged to return, or pay for, unordered merchandise? No. You may, for instance, receive a package of unordered, Christmas cards by mail and a notice asking that you either remit payment or return them. This does not obligate you to pay for it, unless used. In fact, after notifying the company to send for the merchandise, you may charge storage for keeping it. If you "go on" someones else's note or if you guarantee a charge account for a friend,. are you obliged to pay the obligation if your friend does not? Ordinarily, yes, because that is what you agree to do, when you sign as a comaker or a guarantor.

What statements made by a seller about his product are legally binding? Generally speaking, vague and generalized statements about he quality, superiority, value of future value of a salesman's product are considered merely "sales talk." However, specific statements if important fact made about a product, such as its tested strength, chemical analysis, etc., if proven untrue, may enable the buyer to get out of his contract. Is there a law against false advertising? Yes, most states have laws providing penalties for false, misleading, and deceptive advertising. Are you liable for payment for work you authorize? Yes, you are liable for whatever the person performing the work or labor decides to charge you, unless you can prove it is an unreasonable charge. An estimate only amounts to the worker's opinion as to what your bill will come to and -does not bind him to that amount. The proper way to handle this problem is to authorize the party who is to perform the work only to do work for which he will charge no more than a specified amount and to require him to get your consent before performing additional work. Many persons get into legal troubles because they do not consult an attorney when they should. Some see a lawyer only when they are in trouble. Some get into trouble because they fail to realize that their problems involve legal technicalities. For these who cannot afford a private attorney, them are Legal Aid Societies in many cities engaged in furnishing legal advice on most civil matters for nominal fees, or Lawyers Reference Services who may direct clients to attorneys. LETTERS SAN ANTONIO LODGE NO. 133 Ststers and Brothers: The seventh district meeting held at noresville November 16th turned out harmonious and was the, beginning of function by the district since it was established. The officers elected - by the district delegates at the recent SPJST convention were again elected, adding treasurer thereto, so just in case the Supreme Lodge got the Xmas spirit to donate to the district treasury, Oh, ,a small sum of about $500.00 for expenses, as suggested by bro. Mieulka. The, faces of the Supreme Lodge officers present were all in smiles, but neither nodded nor shook their heads, leaving the impression with some as much as to' say — try and get it.. The final agreement was that the district Would get help as needed. Ill the meantime, it was agreed that the district lodges would allow $5.00 to the treasury which, I have a hunch, probably will not be ratified by all of the lodges. As I see it from here, thinking this over' at length, the district is a function of the Supreme Lodge and any expenses incurred should be financed by headquarters. BCG appears to offer some protection against tuberculosis. but the extent of that protection is not known. Further studies are necessary to determine more exactly the true value of BCG. The Campaign Against Tuberculosis The National Tuberculosis Association was organized in June, 1904, - and launched a nationwide offensive against tuberculosis, which at that time was annually killing 194 of every 100,000 persons in the country.
