Many thanks are due not only to you, but our lobbying partners at Cloakroom Advisors and Kelley, Drye & Warren that helped make this happen. Their guidance and our determination potentially supplies limitless power to shape the path of our future by just remaining engaged; power that can only to be stripped from us by our own egos. In the words of the OABA’s keynote speaker in Las Vegas, Dr. Rick Rigsby, ”Egos are the anesthesia that eases the pain of stupidity.” Let’s be smart with what we have built. Our challenge moving forward is not only to continue use this tool — our voice — but to preserve it for our future generations of showmen.

As my term draws to an end and I reflect back on this year, I will cherish the many memories made along the way, both good and bad. Leadership is sometimes difficult, and 2015 certainly presented some hard, yet important choices to make. As a result, I probably strengthened some friendships, while testing others in the process, but no matter what side of the issue you may have came down on, every decision was carefully considered with our collective best interest at heart. Extraordinary organizations are populated by ordinary people, doing ordinary things extraordinarily well. We cannot do everything for everybody, but what we choose to do, we should do well, so I hope that you recognize the benefits of this strategy.

Tom Gaylin will soon take over as your next Chairman at our Annual Meeting on February 12. You should already know by now that he possesses both the passion and determination to stay the course as he leads us into our next 50 years. His vision, moral clarity and integrity make him not only wellequipped to do the job, but most importantly, someone I am proud to have served alongside and can call my friend. I hope that you will support him and your Board of Directors, along with the organization they represent, as you have supported me. As long as they continue to earn your respect and trust, it is my belief they deserve your full support in return.

I would be remiss not to also thank Bob, Dee Dee, Brenda, Al and Tom, along with each and every one of you, for your support during our milestone 50th year. As you may, or may not know, our first Chair Glenn Wade was one of my mentors, so to follow him 50 years later, in addition to my father in 1991, has been a personal honor. It has been my distinct pleasure to serve as your 2015 Chairman, and I hope I have served you well.

May you all have a safe and prosperous 2016, and remember, our future looks brighter only because of your efforts and the support you give to your trade association. H

t the combined IAFE Awards Gala in Las Vegas, OABA Chair Michael Wood and Third Vice Chair Jay Strates presented Circle of Excellence recognition to Brown’s Amusements, Butler Amusements, Kissel Entertainment, and World’s Finest Shows (who could not attend) in front of a packed audience of fairs and others.

Other fairs received IAFE awards for competitive exhibits, fair advertising and memberships sold. All of these OABA members continue to raise the bar with their operational excellence and raise the public’s perception of their midway, from the patron’s perspective. We believe these companies are truly the “best of the best.” There is a complete list of all Circle of Excellence recipients in this issue.

We always look forward to seeing many of you at the upcoming IISA Trade Show in Gibsonton and other events in Tampa from February 7–13, including NICA, SLA and other new events. A “Florida Week” event schedule is featured this issue.

The Miami-Dade County Youth Fair & Exposition was awarded the 2015 Non-Profit Organization of the Year Award by the South Florida Hispanic Chamber of Commerce as part of its 22nd Annual Sunshine Awards.

“The Youth Fair team focuses its time on helping youth in South Florida — from providing a day of fun at The Youth Fair to granting college scholarships — and we are honored to be recognized for doing something we love,” said Robert Hohenstein, president and chief executive officer.

On The Earie Tom Powell, OABA News Ambassador

T

he holidays were a time for relaxation and enjoyment for Christine and me, but we did stay a bit busy with Christmas and New Year’s activities.

Now, like all involved in the carnival and fair business, it’s time to get back to work.

The fair season got off to a start with Tom and Mary Talley setting up Talley’s Amusements at the Fort Worth Stock Show & Rodeo, where they were just as apt to encounter snow as well as sunshine.

Let’s hope it was more good weather this year. But as Mary says, “You never know what to expect.”

The Florida season was to kick off with the 100th annual Manatee County Fair, Palmetto, January 14-24, where Daniel West is manager. Charles Panacek’s Belle City Shows again provided the carnival midway. Jim Murphy’s Mighty Blue Grass Shows played that fair for many years before Jim and his lovely wife, Linda, retired and sold the show to Panacek.

Jim, who goes to Duke University quite a bit in an effort to keep fit, was training with Hank Aaron, Paul Hornung and Bud Wendelstadt, and didn’t realize who they were. Aaron, of course, the great baseball slugger; Hornung, winner of the Heisman trophy while at Notre Dame and then starring for Vince Lombardi’s Green Bay Packers; and Wendelstadt, a legendary Major League Baseball umpire, were impressed that Murphy owned a carnival.

Would you consider that three strikes against Jerry Murphy’s little brother?

A couple of my favorite stories in Ron Kramer’s Book entitled Run to Daylight about those Packers involved Hornung, who was somewhat of a playboy. After Lombardi suspended him for missing curfew two nights in a row, Lombardi was quoted as saying “if it’s that good, Paul, I’ll go with you tonight.” Kramer was a terrific offensive lineman on that team.

He wrote that Lombardi had this thing about loyalty. At the end of a championship season, Jim Taylor, another great

10

running back, had asked to be traded.

Hornung and star lineman Alex Karras of the Detroit Lions were suspended by NFL Commissioner Pete Rozelle for gambling. At the team’s first meeting of the season, Lombardi, with tears in his eyes, addressed the club saying, “We’re really going to miss Paul (whom he considered another son). We’ll replace the other guy,” never mentioning Taylor by name. I hope you’re reading this, Jim Murphy, who is a very good friend of mine, as is Jerry. As a matter of fact, when Amusement Business shut down in 2006 after 106 years in business, the first guy to offer me a job was Jerry, but I didn’t want to go to China.

Fred Rosen, who founded Ticketmaster and ran North American Midway Entertainment for a short time, also called and wanted me to write a blog saying, “We can have a little fun with it.” I didn’t know what a blog was at the time.

During the holidays, my friend since we met at the Knights of Columbus in 1958, John A. Hobbs, held a book signing for former Los Angeles Dodger Manager Tommy Lasorda at his club and restaurant. Now 88, Lasorda is still a great ambassador for the game of baseball. He signed my book to his best friend and told the author I was a great writer. Maybe he is losing it a little, but I hope not.

Hillman and Janie Snyder, former owners of Snyder and Metts Carnival, who are now booking their mini-donuts and ice tea stand with Matt McDonagh’s Big Rock Amusements, hosted a great Christmas party and Janie cooked a fine dinner. Their daughter Jill and her husband, Mike McCormack, are key players on McDonagh’s team – she in food and publicity, and Mike in the rides department.

James Roy Pope, Pope’s Concessions, continues to be one of the busiest guys in the business as he set up a mini-carnival next to Ronnie Hobbs’s Scoreboard Sports Bar where Billy Ray Cyrus spent a week filming what will be a new television

series. Pope and his wife, Petrina, had several pictures made with Billy Ray. After Billy Tucker of Dixieland Amusements decided to leave the carnival business and open a park in Birmingham, Pope helped Willie Purdy of Amusement Attractions pick up some Tennessee fair dates. They included Benton County, Camden, which they actually acquired in 2015 from Tucker.

Pope said his 2015 season was way up.

The Popes, including his mother, Jane, have rides, food and games and booked many years with Myers International Midways. Most of their dates now are in Tennessee and Kentucky. The Popes book every year with Amusements of America at the Wilson County Fair, Lebanon, TN. When his season was over, Pope went on a businessman’s holiday, visiting several fairs.

The contract at the Jackson County Fair, Pascagoula has been held by Richard Vinson for the last 48 years. He books Purdy, who is married to Vinson’s daughter, Lisa, and Crescent City Amusements, owned by Greg and Michael Brooks, to play the spot. “It has a free gate which gets a lot of traffic,” said Vinson.

When I was editor of AB, I visited Vinson, his late wife, Margie, and his late father, Jack, at the Robertson County Fair, Springfield, TN. They owned Golden Empire Shows at the time. I took a picture of just about everybody on the show.

On the way back to Nashville, I realized I had no film in my camera so I turned around and took them all over again.

Richard remembered that occasion and we both had a good laugh.

Besides visiting Purdy and Vinson, Pope wanted to see his old pal Richie George and his wife, Judy of George’s Fine Foods. George is the current president of the International Independent Showmen’s Association, which has its trade show and extravaganza February 9-13.

As I write this in early January, a sad thing just occurred. Christine, who has been taking down Christmas decorations, asked if I would like to see my 1933 Lionel electric train run once more before she boxed it for another year.

I spent 10 minutes watching that engine, followed by six cars and a bright red caboose that were given to me at birth. The memories it stirred up in me are precious. Hell, I’ve been playing with that electric train for 82 years, or is it 83? Christine asked if I thought it was traveling to Scranton. I said no, Gibsonton, non-stop. All aboard!

Errol McKoy Inducted into IAFE Hall of Fame

rrol McKoy, retired president of the State Fair of Texas in Dallas, was inducted into the IAFE Hall of Fame. The highest honor bestowed by the IAFE, the Hall of Fame Award is presented annually in recognition of an individual’s distinguished achievement in, or contribution to, the fair industry.

McKoy served as president of the State Fair of Texas from 1988 to 2014. During his tenure, the fair ranked consistently as one of the most attended fairs in North America and grew from 17 to 24 days with annual gross revenues more than tripling. He oversaw numerous grounds improvements including a $50 million renovation of the Cotton Bowl stadium.

Raised in Tulsa, Oklahoma, McKoy attended Northeastern State University, where he received a degree in Economics. After graduation, he was selected by the Six Flags Corporation to run the Lake Amusement Area of the New York World’s Fair. In 1969, he was promoted to general manager at the age of 26, making him the youngest person to ever serve as GM over a theme park. Over the next 23 years, he managed Six Flags Over

Georgia, Six Flags Over Texas, and, during the final four years, served as executive vice president of Six Flags Corporation.

When McKoy became a leader of the State Fair of Texas, he began serving as a leader in the IAFE. He has served on numerous IAFE committees including the Nominating, Spring Management Conference, Industry Relations, and Awards Committees. In 2008, McKoy personally committed to fund 20, $500 Institute of Fair Management scholarships for each the next 10 years. Over his 50-year career, 26 individuals that worked for McKoy have gone on to be general managers of amusement parks or fairs across the United States.

McKoy serves on the boards of the Cotton Bowl Athletic Association and the Greater DFW Sports Commission.

He is also a member of the Industrial Designers Society of America and holds six U.S. patents, as well as Swiss and German patents, on amusement park rides he has invented. H

OABA Contribution Fund Program

THE OABA’S CONTRIBUTION FUND offers three different plans to meet your show’s contribution to the OABA and in turn rewards the show and concessionaires for these donations.

WHY SHOULD I PARTICIPATE? You will be given the opportunity to receive cash prizes for your contributions to this program and help the OABA protect the carnival industry.

WHAT IS IT? Fund-raising for the OABA has always been based on the generosity of its members and depends on members to pay their fair share, the theory being that the organization belongs to the members who raise relevant issues and in the belief that they will also underwrite activities. Support and participation of enough members will provide the revenue necessary to continue and improve on membership services.

HOW IS IT HANDLED? This OABA program advises member carnivals to collect funds from all office-owned and independent concessions and rides, side shows and arcades. When the show owner collects the money, they need to give or complete a receipt. The show or concessionaires then send the receipts to the OABA office, which will be eligible for monthly and annual incentive prizes.

Please note that it is important to include your phone number on your receipt, as we want to be able to contact you when you win!

WHAT IS THE MONEY USED FOR? The funds collected for this program are earmarked for legal, legislative and lobbying issues. Also, funds are used to continually upgrade member services.

CAN’T I JUST CONTRIBUTE? Sure, but then you lose out on the opportunity to participate in winning cash incentives.

SEND IT ALL IN! Funds are solicited and contributed in the name of the OABA. Once money is collected, please send it monthly to the OABA office in form of a check or money order. You may check ShowTime magazine where the contributions and monthly winners in each plan will be published monthly. H

CSA Reform. In addition, the FAST Act requires FMCSA to commission a study by the National Research Council of the National Academies on the CSA program and its Safety Measurement System.

The study must analyze the accuracy of the BASIC scores in identifying high risk carriers and predicting or correlating with future crash risk, crash severity, or other safety indicators for motor carriers, including the highest risk carriers. The study must also analyze the methodology used to calculate BASIC percentiles and identify carriers for enforcement, including the weights assigned to particular violations and the tie between crash risk and specific regulatory violations, with respect to accurately identifying and predicting future crash risk for motor carriers.

The National Academy must also look at gaps in data collection, alternatives to SMS scores, and the use of SMS alerts and scores by the public. This study and a report to Congress must be completed within 18 months. After the report is issued, the FMCSA will have 120 days to publish

Truck Size and Weight.

FMCSA Releases Final Rule on ELD and HOS Supporting Documents The Federal Motor Carrier Safety Administration has released its final rule on Electronic Logging Devices and Hours of Service Supporting Documents.

OOIDA Challenging ELD Final Rule in Court The Owner-Operator Independent Drivers Association has filed a court challenge to the new regulation announced by the Federal Motor Carrier Safety Administration on Electronic Logging Devices and Hours of Service Supporting Documents. 80 Fed. Reg. 78291 (December 16, 2015).

The Petition for Review was filed in the U.S. Court of Appeals for the Seventh Circuit, which is based in Chicago. That is the same court where OOIDA successfully petitioned to vacate a prior final rule on ELDs in 2011. The current petition for review does not contain any arguments that OOIDA will offer against the new rule; those arguments will be contained in future briefs to be submitted to the court.

ELDs. The final rule mandates that within two years, all drivers of CMVs who are subject to the log book requirements must use an ELD, except for: H Drivers who conduct driveaway-towaway operations,

where the vehicle being driven is the commodity being delivered; and, H Drivers of vehicles manufactured before model year 2000.

In addition, “short-haul” drivers who are not currently required to prepare a driver log because they meet the 100-mile (CDL drivers) or 150-mile (non-CDL drivers) exemption will not be subject to the ELD requirements, either. If these drivers exceed the limits of the log book exemption during a duty period (by going beyond the mileage limit or not returning to the work-reporting location within 12 hours), they must complete a paper log for that day. If they exceed the limits of the log book exemption more than eight times in any rolling 30-day period, then they become subject to the ELD requirements.

Drivers and motor carriers currently using Automatic Onboard Recorders (AOBRDs) under 49 CFR §395.15 are allowed to continue to use AOBRDs for four years after the effective date of this new rule.

Supporting Documents.

The final rule still requires supporting documents to verify on-duty not driving time.

Under § 395.11(d), motor carriers must retain up to eight supporting documents for every 24-hour period a driver who uses ELDs is on duty (the supplemental proposed rule had required 10 such documents). Section 395.8(k) continues to require that motor

carriers retain RODS and supporting documents for six months. New § 395.11(b) specifies that drivers must submit supporting documents to the motor carrier no later than 13 days after receiving them (the SNPRM has proposed eight days).

Under the new rule, to be considered supporting documents, records need to meet certain criteria in § 395.11(c) (2). The eight documents should contain these elements from § 395.11(c)(2)(i):

H Driver name or carrier-assigned identification number, either on the document or on another document enabling the carrier to link the document to the driver, or the vehicle unit number if that number can be linked to the driver; H Date; H Location (including name of nearest city, town, or village); and, H Time.

more than eight documents to the motor carrier for a single day, the motor carrier must include the first and last documents for that day among the eight documents that must be retained. If a driver submits fewer than eight documents, the motor carrier must keep each document.

Supporting documents consist of the following five categories, described in § 395.11(c): H Bills of lading, itineraries, schedules, or equivalent documents that indicate the origin and destination of each trip; H Dispatch records, trip records, or equivalent

documents;

H Expense receipts; H Electronic mobile communication records, reflecting communications transmitted through a fleet management system; and, H Payroll records, settlement sheets or equivalent documents that indicates payment to a driver.

The final rule also prohibits using an ELD in the harassment of CMV drivers.

The FMCSA acknowledges that sometimes drivers will not receive documents that meet all these criteria. If a driver has fewer than eight documents that include the four elements under § 395.11(c)(2)(ii), a document that contains all of the elements except “time” is considered a supporting document; otherwise, it is not considered a supporting document.

or the first time since John Ringling moved his circus’ winter quarters to Sarasota, FL in 1927, Ringling Bros. and Barnum & Bailey did not open its new season there in January. Rather, Legends continued an extended second–year tour to play Florida dates in Tampa, Orlando and Jacksonville before finishing out the month in Birmingham (AL).

Legends opens in Greenville (SC) February 3–7 and Greensboro (NC) February 10–14 before returning to Barclays Center in Brooklyn (NY) on February 26. Circus Xtreme opened its second season itinerary in Miami on January 8, appeared in Columbia (SC) January 20–24 and closed out January in Charlotte (NC). Its February itinerary includes Raleigh (NC), Atlanta and Duluth (GA).

Big Apple Circus’ The Grand Tour continued to receive rave reviews as it closed in New York City January 10 to open at the TD Bank Ballpark in Bridgewater (NJ) February 12. Two units of Universoul kicked off the 2016 season. Universoul East, featuring the Willy Family Highwire act, the Olate Dogs, My Brother’s Keeper acrobats, Lucky the Ringmaster and Zeke the Sidekick, opened in Jacksonville January 26, before playing Atlanta throughout February. Universoul West, featuring the Qiqihar Flying Trapeze artists, Axel’s Wheel of Death, the African Dream Team acrobats and Ringmaster Tony Tone, opens in Miami (FL) February 3–15, followed by Tampa (FL) February 17–21 and New Orleans February 24–28.

On the West Coast, Circus Vargas returns this year with ArleQuin, appearing in Del Mar (CA) February 11–21 before heading to San Diego (CA) for its annual run on the 25th. In Florida, Circus Pages opened its season January 9 in Port Charlotte, and Circus Sarasota debuts Red, White and Bello, on February 12 starring comic daredevil Bello Nock and an international lineup of outstanding circus artists at the University Town Center.

Other circus activities continued to dominate Florida’s Sun Coast in January as The Circus and Traveling Show Ministry, under the leadership of Circus Priest Father Jerry Hogan, held its annual meeting and circus mass January 7–12, then celebrated the first anniversary of the Showpeople’s Winter Quarters Mobile Home Park in Seffner (FL). Lee Stevens presented the Gibsonton Annual Showmen’s Circus on January 9. The Ring of Fame on St. Armand’s Circle inducted famed ringmaster Count Nicholas, the circus-producing Hamid Family, clown Kenny Dodd, equestrian George Scott and the world’s most famous performing circus animal Jumbo on January 10. On January 15 the Ringling Circus Museum named circus advocate Herta Klauser Cuneo as its Circus Celebrity 2016, and Captain William Heyer and May Wirth as Greats of the Past 2016. Windjammers Unlimited held its annual convention in Bradenton (FL) January 15, and presented a public concert at the Ringling Circus Museum the following night.

The 2nd Annual Celebration of American Circus, presented by Circus Now and hosted by the Big Apple Circus on January 5, presented the Community Impact Award to Circus Smirkus founder Rob Mermin and Executive Director Ed LeClair; the Evolving Circus Award to clown Bill Irwin; the Elevating Circus Award to circus historian Dominique Jando; and the Lifetime Achievement Award to circus pioneer Hovey Burgess.

The Circus World Museum Foundation in Baraboo (WI) recently renegotiated a long-term lease with the Wisconsin Historical Society, which owns its buildings, collections and grounds.

One provision that works in CWM’s favor is that neither party can terminate the contract without two years’ prior notice. The earlier lease provided only a 30-day notice for termination. Board members David Hoffman and Fred Pfening urged that the Foundation add a provision that would ensure that CWM could always present performing animals, but the WHS board would not agree.

Europe is also abuzz with circus excitement. The “father of the modern circus” Philip Astley was recently honored in his hometown of Newcastle, England by a life-sized bronze statue.

The unveiling kicked off a series of events slated through 2018 which marks the 250th anniversary of the circus. The statue was commissioned by Andrew Van Buren of Silverdale, England.

This year’s Festival International du Cirque de Monte-Carlo marked the 40th Anniversary of the world’s most prestigious circus festivals. This year, instead of a competition, the entire program was a showcase of recent past winners of the coveted Golden Clown Award. Among the noted winners were America’s Bello Nock (of Ringling, Big Apple and Circus Sarasota fame) and Italy’s Flavio Togni (who debuted with the 120th Ringling edition).

Nock and Togni won Golden Clown Awards in 2011 after earning Silver Clown Awards in 1998. British animal trainer Martin Lacy (brother of Ringling Legends headliner Alex Lacy), who won his Golden Clown in 2010, also showcased his famed lion act.

As a special feature, former Ringling headliner and Italian “clown of clowns” David Larible presented his one-man cabaret show in Monaco’s Princess Grace Theater as a fund-raiser for Asian elephants Baby and Nepal who were saved from euthanasia by HSH Princess Stephanie of Monaco.

The Fédération Mondiale du Cirque held its annual general meeting during the Monte-Carlo festival to review its past achievements and plan future projects. The OABA is a founding Fédération member and OABA Trustee circus producer Wayne McCary is Vice President of its board. The European Circus Association also held meetings in Monte-Carlo and presented a symposium entitled The Image of the Circus–Time to Change!

lephant Endotheliotropic Herpesvirus (EEHV) causes an acute hemorrhagic disease with nearly 80% fatality. It has been found in elephants in all parts of the globe, in the wild as well as in human care, and poses a major threat to their long-term survival. It is because of this major threat that IEF is committed to supporting projects to learn more about EEHV and find a cure, like these: The EEHV Viral Genomics and Pathogenesis project is an ongoing

study that has produced some of the more significant advances in our knowledge of the insidious disease, including

identifying and sequencing the genomes of multiple strains of EEHV. The work they do serves as the foundation for

everyone else fighting this disease.

The Therapeutic Levels of Aminocaprocic Acid in Asian Elephants project is an attempt to find a treatment for EEHV. They are studying a group of drugs that may have use in preventing bleeding in patients suffering from hemorrhage. They hope to lay the groundwork for the drug’s safe administration in elephants and are hopeful it will reduce mortality rates from diseases like EEHV.
