Former Atlanta developer Ernie Geyer and his wife Diane have teamed up to bring Atlanta three family-friendly restaurant locations, named “Lucky’s” after their beloved canine companion and located in Roswell, Brookhaven and Emory Village. Since opening in 2013, Lucky’s keeps getting better. Recent renovations to the original Roswell location includes a huge lawn so dogs and kids can run, have fun and play a game of corn hole. Parents can watch from the nearby Doghouse pavilion, where golden retrievers Lucky and Wiley love to hang out too. Also, larger parties will have no problem finding a parking spot in the newly expanded lot behind the restaurant.

While you’re there, enjoy one of Atlanta’s favorite burgers, the Georgia Dawg Pounder, with a fried pimento cheese ball and spicy red pepper jelly on top. Or, try one of the many “breed-specific” burgers, like the Memphis Bloodhound (pickled red onions, shredded cheddar, candied bacon and mango barbeque sauce), the Retriever (sautéed burgundy mushrooms and melted Swiss) or the Mixed Breed (Lucky’s buffalo sauce and blue cheese). Diane, who also works as an interior designer at Geyer Interiors, LLC, keeps the theme at Lucky’s fun with doggie-themed art everywhere, including the garden and patio. The Stories of Three Lucky Cats

The ones who, despite crisis or trauma in their lives, are found by a knowledgeable person who helps them find their way back to safety. Would you know what to do if you found a litter of kittens under your car, a stray curled up on your front porch or an abandoned kitty in a department store parking lot? Unfortunately, this is a more difficult task than it may seem, but if you take the time to educate yourself in advance, your chances for saving a life will be much greater and very rewarding.

Here are a few real-life stories that saved lives and educated many people in the process. Nakota was a senior Bengal beauty that had lived with her family all her life until her home was burglarized and she was taken, along with many of the family’s possessions. Her family searched for her for months to no avail. Four months later, a woman noticed a carrier along the side of the highway and thought she saw movement. Dodging traffic and risking her life, she recovered the carrier and found beautiful sad-eyed Nakota inside. She had no idea what to do, so she took her to the closest animal control facility, where Nakota was assessed as a senior with health issues, and not given medical care as it was expected that she would have to be euthanized. One of the volunteers at animal control realized that Harriet’s paw was bent, she was limping and she needed immediate rescue. The volunteer called every rescue, humane society and individual she could think of, but it is very hard to find a place for a 13-year-old cat with health issues including a possible broken paw. Fortunately, the volunteer reached CatRangers, who agreed to take Harriet. She knew she was safe as soon as she arrived at La Maison du Chat, and within days became the most beautiful, remarkable kitty. Her paw injury was only a stressed ligament and began healing on its own; soon she was

on the mend. Nakota charmed the entire center as a true angel on earth. Just a few weeks later, a young girl came with her mom to meet our kitties, and out of all our wonderful cats and kittens, chose Nakota. Now she is in her forever home with a loving family, knowing she will always be safe (and looking younger every day). Nakota’s life was at risk many times, when her house was broken into, when she was left on the roadside, and when she was left at an animal control that was not a “no kill” facility. We think she is a very lucky cat.

Marshall’s story began when his family moved away, taking the dogs and leaving him to survive with a bag of dog food and a dripping water faucet. Several neighbors noticed the house was unkempt and grew concerned about the sweet orange boy peering out the window as they walked by. Finally, a young man couldn’t stand it any longer. The foreclosure papers were on the front door, so he contacted the bank and told them there was a cat trapped in the house, but he received no response.

Frustrated and angry, he broke down the door of the house and rescued Marshall. Marshall was nothing more than skin and bones and had to be carried, but he was only halfway there: his rescuer didn’t have the money for his medical care and he did not know how to find a place for a sick older cat who may have been dying. He called vets’ offices, rescue groups and humane societies with no luck. However, he happened to live in Buford, Georgia, very near La Maison du Chat and when he walked up to our center with Marshall in his arms, we couldn’t say no. Marshall became our mascot. He had gone too long without medical care and suffered from hyperthyroidism, but he lived his final years with lots of love and plenty of entertainment at La Maison du Chat. Marshal found his safe place because a kind person put him ahead of his own safety. (Note: In this situation, it’s recommended that a prospective rescuer contact local police to assist in recovery attempts). One very important lesson, however: if you rescue an animal and need to find help, medical or otherwise, ask in person. A phone call can never pull at the heartstrings of a rescue coordinator or vets’ office like seeing an animal in distress with a truly caring person can.

Harriet & The Kittens

OMG! There are tiny kittens in that tree trunk!

Harriet, a very cross-eyed girl, thought that a tree trunk beside the Hindu temple where she was being fed was a safe place to hide her kittens. However, the priest who spotted them knew that the edge of a parking lot with lots of cars meant certain death as soon as they could walk. The temple staff called every person and organization that they thought could help, but these groups needed more answers: Was the mother feral or wild? How old were the kittens? If abandoned, would the kittens need bottle-feeding? Then there was the cost for veterinary treatment and spaying and neutering the family for about $100 each if everything went well. This family needed to be trapped, it was unknown if they could be tamed enough to be adopted. The temple staff knew this was a difficult challenge, but finally they reached a volunteer from CatRangers who stepped up and led the charge to trap the family together and get them to safety. They sat for hours in the blazing Georgia heat, watching and waiting for the mother to step into the trap, but she was too smart for that. They had to try what she could not resist: moving her kittens into a carrier that was big enough for her to enter and be trapped without trampling the kittens if she panicked. Finally, their efforts paid off and the family was moved to a foster home able to keep the mother and babies together. It took a lot of patience because Harriet did not like people very much unless they had food, but Harriet and her four pure white puffballs grew up together until she weaned them. Each of her kittens found wonderful forever homes and grew into beautiful kitties; Harriet decided to stay at La Maison du Chat, where she is still looking for her perfect person. It’s easy to recognize a labor of love when you see one. Walking in through the front doors of the Dawson County Humane Society’s Resale Shop and Boutique, you only need a glance through the store to see all the work that went into this shop. It was created to help the Dawson County Humane Society raise funds and all the money made by the shop goes right to the shelter to help animals in need.

decision that didn’t have room for mistakes. “I think the ‘a-ha moment’ was when we realized that fundraising wasn’t doing enough,” Terri Tragesser, one of the managerial board members, recounted. Instead of setting up another fundraiser, the DCHS team looked over their donations and realized that the Dawson community was donating some nice stuff, nice enough that people would be willing to buy it.

Starting a brick and mortar store to help fund a charitable enterprise isn’t a new idea, but it’s always a daring one. It takes good planning, an ideal location, and a reliable team of volunteers at a minimum to even stand a chance. But for the Dawson County Humane Society team, it was a

rooms into a relatively sprawling boutique. Most important of all, the shop has allowed the DCHS to expand its operations and reach its dream of becoming a no-kill shelter ready to help rescue homeless animals in the Dawson County area. When you look around the store, it’s easy to understand why the DCHS team decided to set up a shop: so many of their donations could find a new home. Everything in the shop is well- curated, in good condition and exemplifies a sort of antique-chic aesthetic. All of it cycles with the seasons with only the most appropriate products on prominent display—you won’t find a rack of coats on sale during the dead of the Dawson summer here.


Debbie McCormick, another one of the site’s managers, and the other volunteers put a lot of work into making sure that the store is full of merchandise they are proud to sell. “We accept everything that gets donated, but we’re really exacting about what actually gets put out on the floor,” Debbie told me as I got the guided tour of the entire shop. “A lot of what we get we pass on to other charities so that they can use it. We’re only open Wednesday to Friday and a lot of that is because we spend Monday and Tuesday sorting everything we get.” In spite of moving away from fundraising for greener pastures, the DCHS still puts on one big event every year for the community: their annual Pups in the Park show. A joint project of an A-Team of North Atlanta charities like the Dawson County Lions Club, Rotary Club of Dawson County, Dawson County Juniorettes, Dawson County Interact Club, and Junior 4-H members, the dog show is open for families to enter their dogs. Interested pups can compete in events including best costume, best trick and cutest/ugliest dog in large-, medium, and small-dog categories. In addition to the main event, there are demonstrations by dogs trained for search and rescue missions, pet item vendors, arts and crafts, open market items, food, and entertainment. The DCHS’s little shop has come a long way since its humble beginning, but it still has work to do and it is always looking to grow. “I think the main thing we need right now is volunteers,” the staff told me. “Everybody on the team is doing this as volunteers as we always need more people to keep the doors open, help people find what they need, and make sure all the donations find their right place in our operation.” If you’re in the mood to do some volunteering for a good cause, the Dawson News featured the DCHS as their Best Place to Volunteer of 2016. It’s open Wednesday-Friday, 10 a.m.-5:30 p.m. The Pups in the Park festival will be happening Saturday, September 23, 2017, from 9 a.m. to 2 p.m. at Rock Creek Park in Dawsonville.

The complexity of and recovery from these procedures are very different, however, than minor surgical procedures many pet owners have experienced through working with their family veterinarian. Indeed, one of the most important aspects of the care we provide our clients is coaching them through the post- operative recovery period and creating an awareness of the issues surrounding recovery from complex surgical procedures. I routinely tell my clients that small animals are wonderful surgical patients because they generally have such wonderful recoveries. I also tell them that they are terrible surgical patients because they have such wonderful recoveries! Our pets are our constant companions and self-appointed protectors, ready to give their unconditional love and protection at all times. It is their “job;” a “job” they gladly do to the point of sacrificing their own recovery in order to be with us. A useful analogy that I share with my clients is asking if they would feel comfortable competing in an extreme obstacle course competition two weeks after having major surgery. Of course they say “no,” and many also see the my point: that in order for our pets to do their “job,” they have to jump on and off the couch and the bed to check on and snuggle with us, they have to jump up and down and bark to protect us from the doorbell, they have to run across the slick kitchen floor to check on us while we cook; and they also have to bound up and down the stairs to check on and play with the children throughout the day. Of course, none of these activities are conducive to a complication-free recovery. So how do we deal with the fact that the desire for constant companionship is the cause of such post-operative concerns? Much of the time spent during the initial consultation with our clientele is educating them on the issues surrounding post-operative care, coaching them on confinement parameters and activity restriction protocols. At times, we even suggest clients perform dry run routines at home with their pets to get everyone acclimated to the level of activity restriction we recommend. Perhaps the most notable expression of love and commitment pet owners can give their pet is a temporary medical leave of absence from their “job”—a “job” they so love to do.

According to legend, God sent angels down to Earth in the form of dogs and cats with notes that say, “Don’t judge. Just love.” Of course, the dogs ate their notes and the cats batted theirs under the couch, but they’re still trying to deliver the message with wagging tails, kneading paws, and slobbery kisses. However, 6.5 million pets are dumped at shelters each year, according to The American Society for the Prevention of Cruelty to Animals. And every 13 seconds, an animal on death row is destroyed. “Georgia has one of the highest kill rates in the country,” says LuAnn Farrell, the co-founder of Angels Among Us Pet Rescue (Angels Rescue). “That’s because most of the shelters out in the middle of nowhere have less visibility and fewer resources,” says LuAnn Farrell, the co-founder of Angels Rescue. So, after launching in 2009, the Alpharetta-based nonprofit began reaching out to rural shelters like those in Tift, Fitzgerald, Dublin, Walker, and Gilmer counties. Angels Rescue’s mission: “Rescue one until there’s none.” They don’t shy away from the dogs and cats that aren’t 16

highly adoptable. “We’ll take the ones that have been hit by a car, the black ones with one eye, and the ones that are three-legged,” Farrell said. The organization also foots all veterinary bills, using funds from fundraising events, grants, corporate partnerships, and individual contributions. Sans a brick and mortar building, this summer, they pulled their 13,000 animal (a cat named Arlyn) off of death row. “The majority of our animals are in foster care,” she told Atlanta Pet Life. At any given time, the rescue has a roster of approximately 350 fosters, who are caring for 450 dogs and cats. “Once we get an animal, we’ll list them on Petfinder and Adopt a Pet,” she said. “We also have adoption events on Saturdays and some Sundays at pet stores, shopping centers, festivals, and malls.” While Angels Rescue primarily handles healthy, adoptable dogs and cats,

they also tackle owner surrender, abuse, and neglect cases— an animal is abused every 10 seconds in the US. So, it’s no surprise that when Jill Williams spotted Mirkwood and Lorien, 10-month-old beagles named after forests in Lord of the Rings, that “they were basically skeletons.” Before being abandoned in a kennel in East Atlanta, the siblings had been fending for themselves for months, according to animal experts. Mirkwood, the weaker of the two, was so dehydrated and malnourished that he virtually had no muscle mass and was unable to stand on his own. “This is one of the worst (cases that I’ve seen),” says Dr. Marcus Smith, the veterinarian that initially evaluated the pair. Unfortunately, even after a blood transfusion and continuous fluids, Lorien became “Mirkwood’s angel watching over him from the Rainbow Bridge.” As her story took wing across the internet, Angels Rescue and the Humane Society of the United States offered a $10,000 reward for information leading to the arrest of Lorien’s former owner. In shelters, owner surrenders and abused animals aren’t the only ones on the chopping block. “Puppies and kittens...the tiniest, fluffiest ones die just as quickly,” Farrell said. “So adopt. Spay and neuter.” In a year, one dog and her descendants can produce more than 10,000 puppies while one cat and her offspring can produce 60,000 kittens — some cats, like the Siamese, reach sexual maturity at four months old, according to Monique Voelker, the founder of Animals Abused & Abandoned. Angels Rescue actually shot to viral fame in 2015 after they posted a photo of two puppies, Kala and Keira, hugging hours before they were supposed to be euthanized on its Facebook page. The pups were saved a little over two hours later. The organization also made waves in the rescue community after it lent Kylie, a 10-year-old girl battling cancer, a kitten for comfort in her final days. As soon as Kylie spotted the kitten, Liza, her smile lit up the whole room. Sadly, that smile would be one of her last. During her final 48 hours, the kitten curled up inside of Kylie’s arms, jumping back onto her whenever she was moved. Before Kylie got her own halo, she begged her mother, Robin, to adopt the kitten. “She told me to take care of Liza, but it’s also like she whispered to Liza to take care of me,” Robin said. JeanLafitte is a special needs French bulldog who was born incontinent. He is, unfortunately, a guy who will have to wear diapers for the rest of his life. Additionally, Jean Lafitte needs an owner who can help him express his bladder as often as a healthy adult dog would need to be let out. He is sweet pup who lives for naps and cuddles. He enjoys running around with toys, and is definitely NOT a picky eater. He's incredibly compliant with his potty time routine and is also very accustomed to regular bathing. Alex Andes always had a deep care and compassion for rescuing animals. This passion was further realized as a young woman attending University of Georgia in Athens, where she got involved working with the shelter dogs at the local animal control facility. After spending time learning,understanding, and caring for these special animals, she adopted a dog with severe fear and anxiety issues, and began studying animal behavior in order to better understand how to help her dog and others like her. It was during this time she met the acclaimed author and pet trainer Victoria Stilwell at a book signing in Athens. A Tale of Two Kitties Contributed by Michael D. Friedlander, DVM Many years ago now my friend Jane found Annabelle---she was not a rescued cat, but a lively little Maine Coon bundle of silver-gray love that she hoped would be a companion for her crazy little terrier. Her dog was the one who met you at the door jumping up on you, barking, and barreling around you as you attempted to enter the house. He was a nervous little guy with a big bark who desperately wanted to be the center of attention. Annabelle was supposed to be his new mate and perhaps calm him and give him company when she was away. Annabelle loved food and attention as much as the dog in the house and as it happened over time, she became more difficult to control. Several years passed and Jane lost her battle with cancer. Annabelle, who despised other cats, needed to be placed in a new loving home---she would bite and scratch and panic when held as if her life were truly in danger. Her time at Cat Care of Vinings was a tough adjustment for her---she clearly did not understand that she was a cat! Annabelle loved treats, gobbled her food voraciously and would bite if I tried to pick her up and handle her without her consent. Annabelle spent her life, though with lots of love and great care, as the second choice. I can say for certain that with some cats, affection and attention is never enough, but with Annabelle, it seems, she was afraid of separation and yet could not trust that the affection I offered was loving and real. I spent a year just picking her up, carrying her over to the floor or couch and just releasing her free to walk away. We did this for quite some time before she came to me willingly and wanted attention. As a “foodie” she knew I provided the food and water, but beyond that she did not trust me. Because I had to portion her meals throughout the day, I started experimenting with hiding treats around the house in her favorite places. She had incredible focus if food was involved! Over the course of many years now, Annabelle sits on command, jumps up and kisses me on the cheek and even gives me a “high-five” for treats. She is a haughty, rambunctious Maine Coon who loves to have her belly rubbed and hung upside down for a good “head rush.” She is focused, smart, fearless and full of unconditional love---who could ask for more, dog or cat?? Cats are amazing creatures and not so different than the dogs we love. The unconditional love of a cat is often locked away tight and difficult to find, but it has always been there waiting for the right someone to explore. Woofstock Suwanee, May 6-7 Town Center Park in Suwanee was definitely the fun place to be the weekend of May 6-7 for the annual Woofstock, truly Atlanta’s largest pet party in the park. Woofstock is a well-planned event, featuring a variety of activities for the whole family to enjoy. It’s also one of the largest pet adoption events in the Southeast, with 40,000 pet lovers attending over two days. PaWty Animals Lucy and Holly met lots of super-cool dogs and even several cats, birds, ferrets and an adorable pig. Entertainment included live music on the park’s large stage, Frisbee dog demonstrations, dock-diving dogs, dog contests, pet adoptions, unique pet vendors, a kids’ area with water walkers and inflatables, arts and crafts, food trucks, and ice- cold beverages for all, including water stops for pets. A new feature this year was complimentary pet shuttles from parking areas to the event. Over 50 nonprofit rescue groups, pet-related arts and crafts dealers, pet-related businesses and commercial sponsors were at this fun-filled event.

Angels Among Us Pet Rescue’s The Fast and the Furriest 5K Run and Festival Dunwoody, June 4

The Fast and The Furriest 5K was back for its second year on June 4th at Brook Run Park in Dunwoody, in a bigger location with more activities to engage kids and pets. This well-organized, super-fun event offers a 5K race and 5K walk for athletes, beginners, kids and dogs alike, while raising money to make a difference in the lives of homeless North Georgia dogs and cats. As a USATF-certified 5K course (GA17020WC), this race is an AJC Peachtree Road Race qualifier. The course is flat and fast—a great opportunity to PR! For their entry fee, each competitor received a custom race T-shirt, a goody bag with treats for both owners and dogs and post-race snacks.

“Get ready to race!” That’s something you’ll hear many times at the annual Georgia Dachshund Races in Marietta, which was held this year on June 24 in air-conditioned comfort at Jim Miller Park. The building is also handicap accessible, which is key because there are lots of doxie wheelie racers. For the first time this year, in addition to the doxies, other dogs under 30 pounds could enter the races. The Georgia Doxie Wieners, um, make that winners, are invited to race at the National Dachshund Races Championship in Ohio. In addition to the races, there are also oodles of doggie contests, an obstacle course and doggie weddings (a must-see). There are also vendors, raffles, refreshments and lots of family fun. Georgia Dachshund Races does not promote racing for profit, only the excitement of watching Doxies participate. This event is exclusively about fundraising and having fun! Five days a week, psychologist Nick Adams can be found sitting behind a red counter at Misfit Haven Animal Rescue, a dog rescue in Rome that he founded in 2010. About a dozen yippy puppies are across the room from him, pawing at their chain-link pens. They cannot wait to be adopted in Rome or at one of Misfit Haven’s events in Marietta. At Adams’ feet, behind the counter, is Betsy, a plump 16-year-old beagle that serves as somewhat of a mascot for Misfit Haven. If it was not for her loud snores, you would never know that she was under the counter. This small red building is her permanent home, and Adams believes that her story shows the importance of spaying and neutering dogs. In February 2015, on a snowy day at Murray County Animal Control, Adams was pulling dogs from the kill shelter to take back to his rescue when a truck flew into the parking lot. In the back of the truck was Betsy, a stray 14-year-old obese beagle who was about to give birth. Initially, Adams was hesitant to take Betsy in due to her condition, but worried about her having birthing complications and feared that she would need to be put down. “I said, ‘Put her in the back of my truck’,” Adams said. “By the time I got into Calhoun, I heard her first puppy. I knew she was gonna be in labor, but I didn’t know she was that far along.”By the time Adams got back home, Betsy had already given birth to three puppies. She had six total, after having difficulty delivering the last one. Adams called Dan Pate, a veterinarian from West Rome Animal Hospital, who helped Betsy have her last puppy via cesarean section. “I didn’t care how much money it was gonna cost,” Adams said. “All I knew was that I was gonna take care of her.”Unfortunately, while Betsy recov-

ered, none of her puppies survived past five weeks old.“There was no one diagnosis for her,” Adams said. “She was a 14-year-old dog. She was a stray dog being fed trash. Was her milk contaminated? That could’ve been what possibly killed the puppies.” Besides giving birth to six puppies, Betsy also had heartworm, congestive heart failure, and thyroid problems which caused her obesity. Overall, it cost over $8000 to save her.“Until you meet Betsy, you don’t know why she was worth it,” Adams said. A year later, she spends most of her time sleeping under Adams’ feet or on her comfy dog bed in the back storage room. Despite her ordeal, she still brings joy to both Adams and his longtime friend and assistant Joel Vinson. “She always greets me at the door when I come in,” Vinson said. “She recognizes my red car.” Betsy even brings joy to the other dogs, and according to Adams, she seems to have a calming effect on them.“With every litter of puppies, when we wean them, she will go in that puppy room and she will lay in there all day long on that concrete floor,” Adams said. Misfit Haven takes in primarily small dogs and dogs about to give birth. Last summer, Adams and Vinson took in 14 pregnant mothers from various shelters across Georgia. Adams said that his mission, besides getting dogs adopted, is to educate people on the importance of spaying and neutering. He believes that this would prevent cases like Betsy’s. “I don’t know what wrong she had done to her,” Adams said. “But for any dog to be obese and pregnant at 14 and heartworm positive, and to lose every puppy, she deserves to live.”

Who REALLY Owns Your Pet? Know Your Responsibilities According to the Law By Claudine Wilkins and Jessica Rock, former prosecutors and founders of Animal Law Source.

Ever wonder what would happen if you pet-sit someone else’s dog and that dog bites somebody or the dog attacks you or someone on your property? What if you start feeding a feral cat and a neighbor complains to the authorities about your new cat being a nuisance? What if the person you entrusted to care for your pet while you are out of town harms or neglects your pet? Who owns a stray animal?

Many things are to be considered when you take control over someone else’s pet, allow someone to take control over yours or if you pick up a stray animal. The case law in this area is very broad and voluminous and we recommend that you visit our website to learn more. Terms like “care and control,” “disclosure,” “superior knowledge,” “dangerous propensities,” “inherent duties,” “contributory negligence,” “assumption of risk,” “exercising control and custody,” and “intent” are often found in case law relevant to animal cases. The individual charged with finding facts in any case will consider how long you had custody and control, what may or may not have been disclosed between the parties and more.

Animal Protection Act (Georgia) In 2016, many changes were made to Georgia’s Animal Protection Act. Included in those amendments was the definition of ownership as “a person who intentionally exercises custody, control, possession, or ownership of an animal” (O.C.G.A. § 4-11-2 (5.1). Animal Cruelty Statutes In 2014, changes were made to improve the animal cruelty statute that clarified “who” can be charged with animal cruelty. Under that statute, “’any person’ who causes physical pain, suffering or death to any animal” commits the offense of animal cruelty. Intent is not an element under the misdemeanor portion of the statute.

The first thing to consider is how Georgia law defines an “owner” of an animal. The term “ownership” is defined in Georgia under several state statutes and also case law.

In such cases, ownership of a victimized animal is not required as a condition of prosecution. In Tiller v. State, the defendant was convicted of cruelty to animals (horses) because he failed

to properly feed them and denied them essential medical treatment. The defendant argued there was no evidence that he owned the horses, but the Court of Appeals rejected that argument, reasoning that neither ownership of the animals nor ownership of the land on which they are found are material elements of the offense of cruelty to animals (O.C.G.A. § 16-12-4). The Court found that it was adequate for the State to show merely that the defendant was responsible for the care and feeding of the horses. In cases involving neglect, however, prosecutors are required to prove that the person “intentionally exercises custody, control, possession or ownership of an animal” (O.C.G.A. § 16-12-4). Responsible Dog Ownership Law In 2012, improvements were made to the state’s Dangerous Dog law, which was aptly renamed the Responsible Dog Ownership Law. Included in those amendments was the clarification of the definition of ownership to mean any natural person or any legal entity having custody or control of a dog. In the case of dogs owned by minors, the term “owner” is extended to include parents or others with custody of the minor. (O.C.G.A. § 4-8-219(a)(4))


Animal Law In a related case, Miller v. State, a dog owner whose dogs killed a neighbor’s pet argued that he was not the owner and that his six and eight-yearold daughters were allegedly the registered owners of the dogs. The court found that ownership of the dogs is immaterial, for the evidence showed clearly that the dogs were under his [dog owner’s] custody and control. As this was a bench trial, the trial judge made written findings of fact, stating, “The Court finds from the evidence submitted that the dogs are animals owned and under the control of the Defendant. . . .”

Who owns a stray? Domestic animals are protected under our animal cruelty laws. So who owns a stray? Good investigative tactics are needed to determine if someone is exercising “custody, control, possession, or ownership” of an animal. If an investigator believes the evidence, statements or other circumstances support a person or persons having custody, control, possession, or ownership of an animal that was subject to a crime (abuse, neglect, abandonment, fighting, dog at-large, nuisance or dangerous animal, dog bite or attack, etc.), then ownership is established. An investigator should be interested in where or how the person acquired the animal and how involved he or she is in its care or shelter. Who is feeding, grooming or aiding the animal on a regular basis? The term “regular basis” could mean a temporary period. For example, a pet sitter or caretaker could be considered the “owner” at the time a crime has been committed.

We suggest that the investigator interview the apparent owner, speak to neighbors, request vet records or adoptions records if any and inquire with the local vets to see if the animal has been seen by a vet and who is listed as owner of record. Some of the things an investigator should be asking include: Who has custody and control of the animal? Who is responsible for its care and feeding and for providing shelter, and for how long the person has been doing those actions? Who owns a stray feral cat? Domestic felines are protected under our animal cruelty laws. So, who owns a feral cat? This can be a touchy subject, but as stated above, good investigative tactics are needed to determine if someone is exercising “custody, control, possession, or ownership of an animal.” It is recommended that the investigator check with the local shelter or humane society to see if a feral cat colony has been recorded, reported or established and the names of the people working with these entities to control feral cat populations. Check for complaints and any other information, including if the caregiver is a licensed rescue with the Georgia Department of Agriculture and if the feral colony is being trapped, spayed, neutered and returned as part of a program. Keep in mind that the person caring for a feral cat or a cat colony may be providing assistance or alleviating a problem on behalf of animal control or shelter in that jurisdiction. As you can see, Georgia law defines “ownership” of an animal in ways you may not have thought about before now. If you have exercised custody or control of an animal, you may be responsible for that animal’s well-being or responsible for liability to third parties for the actions of that animal. If an aquarium is a happy and growing aquarium, there is a good possibility that one or more of the fish will outgrow it. There are a couple of ways that this situation manifests. The most common way is by simply becoming so large that they don’t have room to move around, or when they do move, they disrupt the entire aquarium. I remember being called in to look at an aquarium that had been around for about a year. It was a fourfoot-long 90-gallon aquarium, and it housed a three-foot Japanese dragon eel that would move the rocks on the bottom every time it moved. However, some fish facing space restrictions become territorial and violent to the point of killing other fish in the aquarium in order to claim space for themselves. Maroon clownfish are known for this type of behavior. I have had customers call me asking me why all their fish died, but their maroon clownfish is doing just fine. My customers who own large clownfish that haven’t killed their tank mates house them in aquariums that are all more than 700 gallons in capacity and give the fish plenty of room to swim. The ones who have had problems have also had smaller tanks that were large enough for the fish when they were small, but as they grew, so did their space requirements until they outgrew the tank. There are countless stories about this, but not very many that offer solutions to the problem. Some fish owners release their fish into the wild, which can introduce problems into those waters, such as the lionfish in the Atlantic Ocean that are altering habitats and competing with native species for resources. Others put them into the freezer trying to euthanize them humanely, or in other cases, flush them if they will fit. With a little bit of planning, however, the fish don’t have to suffer this fate. There are alternatives. Solutions for fish that have outgrown their tank involve larger aquariums. Some fish owners really like their fish and their aquarium and

opt to have a bigger one put in. I recommend getting a professional to help with the switchover. The change needs to take into account the fishes’ new size as well as their potential size and space requirements. For example, the most successful aquarium I work with that has maroon clownfish is a ten-footlong tank. There is plenty of space in there for the clowns to set up shop and to call the place their own. If someone doesn’t want to get a larger aquarium, they can search for someone who already has one. Many cities have an online community of fish owners with aquariums of all types and sizes. It can be as simple as going onto one of their message boards and announcing that you have one or more fish that have outgrown their tank and that someone can have them if they will just come out to get them. When I was new to the hobby, I did this a few times with varying levels of success, but the fish were always able to get a new home. While there is not a big market for large fish, local fish stores sometimes take fish in. Many are reluctant to do so, however. The market is limited, and there is also the possibility of importing diseases or parasites into their systems. If they do accept the fish, they will give little or no store credit in exchange. Another option is to see if there is a fish rescue in your area. This kind of operation will take a fish in and get it rehomed. Our company operates a fish rescue, and when we have space available, we take fish in. An operation like this may request a donation to cover associated costs such as transport, quarantine treatment, and feeding.

Yes, you bet that was me. I guess it pays off to be #ShaggyChic! I think the nice people at Nordstrom wanted to add a little more fluff to their Spring Fashion Show because they invited me to come and sit in the front row. And you know I LOVE to sit (it's usually followed by a treat and a pet, y'all!). I did such a great job at that sitting business (one of my biggest talents), that they also asked mom if we could have a photo shoot with the theme "Retail Therapy". I don't know about the "re" part, but I certainly have a cute short tail (which I wag all the time, it's the BEST!) and I am a certified “therapy” dog, so no one better for this job than your favorite sheepish pup.
