SAUK RAPIDS-RICE INDEPENDENT SCHOOL DISTRICT NO. 47 REGULAR SEMI-MONTHLY BOARD MEETING Monday, March 28, 2022 A semi-monthly meeting of the Sauk Rapids-Rice ISD 47 Board of Education was called to order by Chair Butkowski Monday, March 28, 2022 at 6:02 p.m. in the District Of ce Boardroom. ROLL CALL Members present included Braun, Butkowski, Hauck, Holthaus, Loidolt, Morse and Solarz. Others present were Superintendent Bergstrom, Director of Teaching and Learning Bushman, Director of Human Resources and Administrative Services Schoenherr, Director of Business Services Fiereck, Director of Technology Zimpel, Special Education Coordinator Haller, SRRHS Principal Nohner, SRRHS Assistant Principals Logrono and Wagner, SRRMS Principal Messerich, MHES Principal Peterson, MHES Assistant Principal Foley, Rice Principal Paasch, and PV Principal Froiland. ESTABLISHMENT OF A QUORUM Chair Butkowski asked Clerk Morse to af rm there was a quorum in attendance. Clerk Morse af rmed there was a quorum. APPROVAL OF MEETING AGENDA A motion was made by Braun, seconded by Morse and unanimously carried to approve the meeting’s “Agenda” as amended. CONSENT AGENDA A motion was made by Solarz, seconded by Hauck and was unanimously carried to approve the meeting’s “Consent Agenda”. PUBLIC INPUT There was no public input at 7:24 p.m. ACTION ADOPTION OF ENROLLMENT RESOLUTION Member Butkowski introduced the following Resolution and moved its adoption: RESOLUTION LIMITING AND CLOSING OPEN ENROLLMENT WHEREAS, Minnesota Statutes section 124D.03, subdivision 6 requires the School Board to adopt speci c standards for acceptance and rejection of open enrollment applications, which may include the capacity of a program (excluding special education services), class, or school building, but which may not violate minimum open enrollment standards established in Minnesota Statutes section 124D.03, subdivision 2; and WHEREAS, Minnesota Statutes section 124D.03, subdivision 2 states that a school board may, by resolution, limit the enrollment of nonresident pupils in its schools or programs to a number not less than the lesser of one percent of the total enrollment at each grade level in the district or the number of district residents at that grade level enrolled in a nonresident district according to this section; NOW, THEREFORE, BE IT RESOLVED by the School Board of Independent School District No. 47, Sauk Rapids-Rice Public Schools, as follows: 1. The School Board hereby establishes and limits the enrollment capacity at each grade level in the District as follows: a. For open enrollment applications that are received from April 1, 2022 through April 30, 2022, enrollment in kindergarten may not exceed 340 students for the 2022-2023 school year. For open enrollment applications that are received after April 30, 2022, enrollment in kindergarten may not exceed 300 students for the 2022-2023 school year. b. For open enrollment applications that are received from April 1, 2022 through April 30, 2022, enrollment in grades one through ve may not exceed 340 students per grade for the 2022-2023 school year. For open enrollment applications that are received after April 30, 2022, enrollment in grades one through ve grades may not exceed 320 students per grade.

c. For open enrollment applications that are received from April 1, 2022 through April 30, 2022, enrollment in grades six through twelve may not exceed 365 students per grade for the 2022-2023 school year. For open enrollment applications that are received after April 30, 2022, enrollment in grades six through twelve may not exceed 340 students per grade. 2. The District will permit open-enrollment at each grade level until it reaches the enrollment capacity established for that grade level. If the number of applications received from April 1, 2022 through April 30, 2022 exceeds the cap that is established for a grade level, the District will accept the applications in the order in which they were received until the cap is met. The requirement to hold an impartial lottery does not apply to applications that are received after the typical January 15 deadline. 3. The enrollment caps that are established in this Resolution exceed the limits established by law—that is, the lesser of one percent of the total enrollment at each grade level in the school district, or the number of school district resident students at that grade level enrolled in a nonresident district. Therefore, the District will deny any open-enrollment applications that are received for a grade once the cap for that grade has been met. 4. The District reserves the right to determine which school in the District an open enrolled student will attend. 5. In accordance with Minnesota Statutes section 124D.03, subdivision 2(b), the Superintendent or their designee must report to the Minnesota Department of Education (MDE) the number of nonresident students who are denied admission as a result of the limitations established in this Resolution. The report must be submitted to the MDE by July 15 following the school year in which the student(s) were denied admission. 6. To the extent permitted by law, this Resolution does not impact the District’s right to accept or reject non-resident students who seek to enroll in the District pursuant to a non-resident tuition agreement and in compliance with Minnesota Statutes section 124D.08. This Resolution also does not impact the District’s right to reject applications of non-resident students for the reasons stated in section 124D.08, subdivision 1(b). The motion for the adoption of this Resolution was duly seconded by Solarz and upon a vote being taken, the following voted in favor of this Resolution: Hauck, Loidolt, Braun, Butkowski, Solarz, Holthaus, Morse And the following voted against this Resolution: None Based on the vote, this Resolution was declared duly passed and adopted. Dated: March 28, 2022 APPROVAL OF FY23 BUDGET ADJUSTMENTS A motion was made by Braun, seconded by Hauck and unanimously carried to approve the preliminary FY23 Budget projections and proposed adjustments. ADOPTION OF THE RESOUTION NON-RENEWING TEACHING CONTRACTS Board member Butkowski introduced the following resolution and moved its adoption: RESOLUTION NONRENEWING TEACHERS WHO HOLD A TIER 1 OR TIER 2 LICENSE, OR WHO ARE IN A PROBATIONARY PERIOD OF EMPLOYMENT WHEREAS, the purpose of this resolution is to non-renew all teachers who are employed by the District and hold a Tier 1 license, certain teachers who are employed by the District and hold a Tier 2 license, and certain teachers who are employed by the District and hold a Tier 3 or Tier 4 license and are in a probationary period of employment; WHEREAS, Minnesota Statutes section 122A.181 states that a Tier 1 license is for a term of one year and that teachers who hold a Tier 1 license are not covered by section 122A.40 or the teachers’ collective bargaining agreement; WHEREAS, Minnesota Statutes section 122A.182 states that a Tier 2 license is for a term of two years and that teachers who hold a Tier 2 license generally are not covered by section

APPROVAL OF THE CUSTODIAL AGREEMENT FOR THE 2021 – 2023 SCHOOL YEARS A motion was made by Braun, seconded by Holthaus and unanimously carried to approve the Custodial Agreement for the 2021 – 2023 school years. The Board of Education’s Non-Certi ed Staff Negotiations Committee reached a tentative contract agreement on 12.20.21 and the custodial unit of the SEIU 284 has since rati ed the agreement. ADOPTION OF THE RESOLUTION SUPPORTING INDIVIDUALS WITH DISABILITIES EDUCATION ACT (IDEA) FULL FUNDING A motion was made by Solarz, seconded by Hauck and unanimously carried to adopt the IDEA Full Funding Act resolution, which will help strengthen the federal investment in special education by authorizing a ten-year plan to fully fund the federal share of IDEA. ADOPTION OF THE DONATION RESOLUTION A motion was made by Braun, seconded by Holthaus and unanimously carried to adopt the Donation Resolution. It is recommended by the Minnesota School Boards Association that a Donation Resolution be adopted in the Action area of the Agenda rather than in Consent. ADOPTION OF POLICY #515 A motion was made by Hauck, seconded by Morse and unanimously carried to adopt the following policy. • #515 (Protection and Privacy of Pupil Records) is a “mandatory policy” and will replace current policy #515 (Protection and Privacy of Pupil Records). This policy required two readings before adoption due to substantive recommended changes ADDENDUM APPROVAL OF THE PARAPROFESSIONAL AGREEMENT FOR THE 2021 – 2023 SCHOOL YEARS A motion was made by Solarz, seconded by Holthaus and unanimously carried to approve the Paraprofessional Agreement for the 2021 – 2023 school years. The Board of Education’s Non-Certi ed Staff Negotiations Committee reached a tentative contract agreement on 01.20.22 and the Paraprofessional unit has since rati ed the agreement.
