Governor Greg Abbott on June 16, 2022 announced the Texas Driving with Disability (DWD) Program that provides an opportunity for law enforcement personnel to interact more appropriately and successfully with Texans who may have a communication challenge. This first-in-the-nation program is a statewide collaborative effort between the Governor’s Committee on People with Disabilities (GCPD), Texas Department of Public Safety (DPS), and Texas Department of Motor Vehicles (TxDMV) that gives Texans the option to identify communication impairments on both driver’s licenses and vehicle registrations. In 2019, Governor Abbott signed the Samuel Allen Law establishing the DWD Program, formerly known as Driving with Autism. The program is administered by the GCPD, DPS, and TxDMV to facilitate stronger communication between law enforcement personnel and Texans who are deaf or have a communication challenge, such as Autism. Through DWD, Texans have the option to disclose their communication challenge when registering their vehicles through TxDMV in addition to DPS’ Communication Impediment code on state issued driver’s licenses and IDs. Communication Impediment will be privately placed in the Texas Law Enforcement Telecommunication System (TLETS), alerting law enforcement officers of communication challenges before approaching vehicles in pull-over scenarios. Final Notice and Public Explanation of a Proposed Activity in a 100-Year Floodplain To: All interested Agencies, Groups and Individuals on 6/22/2022: This is to give notice that the City of Escobares has conducted an evaluation as required by Executive Order 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under the Community Development Block Grant Program and administered by the Texas Department of Agriculture (TDA) ERR #(CDV21-0034). The City of Escobares proposes to reconstruct approximately two thousand seven hundred forty-five linear feet (2,745 l.f.) of road surface including base material and hot-mix asphalt, prime-coat, utility adjustments, related driveway repairs and all associated appurtenances on Florez Rd, Escobar Rd and Pera Lane; the city will also install one thousand two hundred twenty linear feet (1,220 l.f.) of concrete gutter and associated appurtenances. Of those proposed improvements, nine hundred fifty linear feet (950 l.f.) or approximately .67 acres on Escobar are located in Zone A, a 100 year floodplain. According to FEMA Panel No. 48427C0540C effective date 4/19/2010, the project shall include activities within approximately 0.67 acres of the 100-year floodplain (Zone A). The City of Escobares has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values: a reduction in scope, alternate locations, and no action. The scope and location of project activities were chosen based on minimum improvements necessary to correct the health and safety risks existing facilities pose to the natural and human environment. Because the project scope includes roadways most in need of repairs, the alternatives considered would preclude correction of these risks or environmental compliance violations. The best action is to proceed with the project as planned utilizing best management practices to protect the natural landscapes that serve to maintain or restore natural hydrology through infiltration and protect the proposed improvements from flood damage. The consulting engineer shall take into consideration additional specifications to minimize damage to and/ or restore the native plant species. All state and local floodplain protection procedures will be followed. Additionally, there shall be no significant increase to impervious surface and the project area will be restored to pre-project conditions upon completion. The City of Escobares has reevaluated the alternatives to building in the floodplain and has determined that it has no practicable alternative. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 are available for public inspection, review, and copying upon request during regular business hours at the 4829 Old Escobares Highway 83, Roma, TX 78584. There are three primary purposes for this notice: (1) People who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas; (2) An adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas; and (3) As a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk. Aviso Final y Explicación Pública de una Actividad Propuesta en una Lanura Inundable de 100 Años Para: Todas las agencias, grupos e individuos interesados el 22/06/2022: Esto es para notificar que la Ciudad de Escobares ha realizado una evaluación según lo requerido por la Orden Ejecutiva 11988, de acuerdo con las regulaciones de HUD en 24 CFR 55.20 Subparte C Procedimientos para Toma de determinaciones sobre el manejo de llanuras aluviales y protección de humedales. La actividad está financiada por el Programa de Subsidios en Bloque para el Desarrollo Comunitario y es administrada por el Departamento de Agricultura de Texas (TDA) ERR #(CDV21-0034). La Ciudad de Escobares propone reconstruir aproximadamente dos mil setecientos cuarenta y cinco pies lineales (2,745 l.f.) de la superficie de la carretera, incluido el material base y el asfalto de mezcla en caliente, la capa de imprimación, los ajustes de los servicios públicos, las reparaciones relacionadas con la calzada y todos los accesorios asociados en Florez Rd. , Escobar Rd y Pera Lane; la ciudad también instalará mil doscientos veinte pies lineales (1,220 l.f.) de canaletas de concreto y accesorios asociados. De esas mejoras propuestas, novecientos cincuenta pies lineales (950 l.f.) o aproximadamente 0,67 acres en Escobar están ubicados en la Zona A, una llanura aluvial de 100 años. De acuerdo con el Panel N.º 48427C0540C de FEMA, con fecha de vigencia del 19/04/2010, el proyecto incluirá actividades dentro de aproximadamente 0.67 acres de la llanura aluvial de 100 años (Zona A). La Ciudad de Escobares ha considerado las siguientes alternativas y medidas de mitigación a tomar para minimizar los impactos adversos y restaurar y preservar los valores naturales y beneficiosos: una reducción en el alcance, ubicaciones alternas y ninguna acción. El alcance y la ubicación de las actividades del proyecto se eligieron con base en las mejoras mínimas necesarias para corregir los riesgos de salud y seguridad que las instalaciones existentes representan para el entorno natural y humano. Debido a que el alcance del proyecto incluye las carreteras que más necesitan reparaciones, las alternativas consideradas impedirían la corrección de estos riesgos o violaciones del cumplimiento ambiental. La mejor acción es proceder con el proyecto según lo planificado utilizando las mejores prácticas de gestión para proteger los paisajes naturales que sirven para mantener o restaurar la hidrología natural a través de la infiltración y proteger las mejoras propuestas de daños por inundaciones. El ingeniero consultor deberá tomar en consideración especificaciones adicionales para minimizar el daño y/o restaurar las especies de plantas nativas. Se seguirán todos los procedimientos estatales y locales de protección de llanuras aluviales. Además, no habrá un aumento significativo de la superficie impermeable y el área del proyecto se restaurará a las condiciones previas al proyecto una vez finalizado. La Ciudad de Escobares ha reevaluado las alternativas a la construcción en la llanura aluvial y ha determinado que no tiene una alternativa practicable. Los archivos ambientales que documentan el cumplimiento de los pasos 3 a 6 de la Orden Ejecutiva 11988 están disponibles para inspección pública, revisión y copia previa solicitud durante el horario comercial habitual en 4829 Old Escobares Highway 83, Roma, TX 78584. Hay tres propósitos principales para esto aviso: (1) Las personas que puedan verse afectadas por las actividades en las llanuras aluviales y aquellas que tengan interés en la protección del entorno natural deben tener la oportunidad de expresar sus preocupaciones y proporcionar información sobre estas áreas; (2) Un programa de aviso público adecuado puede ser una herramienta educativa pública importante. La difusión de información y la solicitud de comentarios públicos sobre las llanuras aluviales pueden facilitar y mejorar los esfuerzos federales para reducir los riesgos e impactos asociados con la ocupación y modificación de estas áreas especiales; y (3) como una cuestión de equidad, cuando el gobierno federal determina que participará en acciones que se lleven a cabo en las llanuras aluviales, debe informar a quienes puedan correr un riesgo mayor o continuo.
