By Lexi Cottee Consumer Affairs Victoria is urging a Bundoora couple who sold their house last month to contact it following allegations their real estate agent pressured them to change the agreed rate of commission. The Bundoora woman, who does not want to be named, posted on a community Facebook group, warning members about her “bad experience” with a South Morang agent. The woman and her partner sold their South Morang house at auction in late November and were pleased with the result. But they say their real estate agent’s “unethical” tactics left a sour note. On auction day the auctioneer, allegedly also a member of the company’s management team, asked “through smiles, excitement and nervous tension” if they would pay the company half of any price achieved above the reserve. According to the women’s Facebook post, she and her partner thought he was joking. “We laughed and said ‘sure’,” she wrote. She alleges that after the auction, the auctioneer amended the contract to reflect that they had agreed to pay him 50 per cent above the reserve price as commission. The couple refused to sign the document, saying it was an “off-the-cuff” comment. When they confronted the South Morang company, they were allegedly told they wouldn’t be held to the agreement as they were “clearly uncomfortable with it”. The woman said the agency told her it had struck the same agreement with vendors at least five times before.
Consumer Affairs Victoria director Claire Noone said commission arrangements were a matter of negotiation and were set out in the sales/auction authority before an auction campaign. “Any changes to an authority after it has been signed must be initialled by both the seller and the agent to be binding on the parties,” she said.

Dr Noone urged any vendor who has felt pressured or forced to change their agreed commission to contact Consumer Affairs as soon as possible. Consumer Affairs will not handle a dispute about commission unless it is given notice of the dispute within 28 days of the client receiving the account or notice that the agent has taken the amount in dispute. Real Estate Institute of Victoria spokesman Paul Bird advised agents to have the agreed level of commission clearly outlined in the contract. “If the level of commission, or some other aspects of the sale, such as the reserve price, change prior to the home being sold, the contract should be updated to reflect this and signed by the agent and vendor,” he said. A representative of the real estate agency believed to be involved told Star Weekly he was unaware of the complaint.

Nellie, a breed apart Nellie Patterson plans to start her own line of Charolais cattle, a breed raised for their beef and known for their distinguishable white coat. The 18-year-old from Riddells Creek has just finished her certificate III in agriculture at Salesian College, where she completed year 12 this year, and now wants to add to her 15 head of cattle grazing on her parents’ property. Ms Patterson also works part-time for her parents’ construction property and is breaking in one of her brumbies in an effort to sell it before the end of the year. “It’s pretty hectic all the time,” she said. Last month she was among a group of students awarded for their outstanding work and achievement at the Hume/Whittlesea VET/VCAL/SBAT Awards.

He completed two work placements, one at an air-conditioning company and another installing motorised gates. When asked why he thought he was nominated, the Penola College student said it probably came down to initiative. “When a problem arose I tried to fix it myself before asking someone else because I have a bit of background knowledge,” he said.

Cash bid to cut family violence By Lexi Cottee One-off funding of $150,000 has been awarded to an Epping-based community agency to pilot a family violence project with the Farsispeaking Iranian community. Mental Health Minister Mary Wooldridge announced the funding on last Tuesday’s White Ribbon Day to coincide with the International Day of the Elimination of Violence against Women. Whittlesea Community Connections has been chosen as the lead agency to deliver the program with partner organisations, including the Salvation Army Crossroads Family Violence Service and Women’s Health In the North. Although the funding was announced just days before the state election, monies were signed off before the government entered caretaker mode. The funding was also flagged in the May state budget. The scheme is one of two pilot projects funded through the national agency for the prevention of violence against women and children, Our Watch, as part of its prevention of violence against women in ‘culturally and linguistically diverse communities’ (CALD) project. The other initiative will be rolled out in Brimbank and Wyndham to empower women and engage men in newly established Indian communities as advocates to prevent violence. Whittlesea Community Connections chief executive Jemal Ahmet said the project would work with individuals and community leaders to build resilience in the Farsi-speaking Iranian
community in Melbourne’s northern suburbs. “We’ll be raising their own leadership capacity, working with them to increase their own understanding of family violence and helping them become the experts in their community, rather than a top-down approach where we’re the experts,” Mr Ahmet said. He said the timing of the announcement was a matter for the state government.

“The funding is very welcome,” Mr Ahmet said. “It doesn’t matter which government it comes from.” The project is funded until November 2015 and will provide the basis for future family violence prevention efforts Australia-wide. Whittlesea council also welcomed the funding, although mayor Ricky Kirkham cautioned against assuming CALD communities experienced more family violence. “It’s important we remember that CALD communities are no more likely to experience violence than other communities,” Cr Kirkham said. “It’s very important that primary prevention projects and messages to promote and improve gender equality are tailored to all communities, especially in a community as diverse as Whittlesea.”

The games can go on Sports clubs in Mernda and Doreen will share $2.8 million of federal grants to improve their facilities. The funding will enable construction of a new pavilion and cricket nets at Waterview Recreation Reserve, formerly known as Woodland Waters Recreation Reserve, in Mernda and new facilities at Laurimar Reserve in Doreen. Laurimar Estate developer Lend Lease gifted the reserve to the community four years ago and it has been Laurimar Football Club’s home ground since. But the reserve lacks the necessary infrastructure to cater for a rapidly growing football club. Portable showers are hired for game days and a shipping container is used as change rooms.
Laurimar Football Club president Alasdair Walker said the current facilities were inappropriate. “The new CEO of the Northern Football League says that if we don’t get new facilities they won’t schedule games here.” A $300,000 grant will pay for four new change rooms, two kitchenettes, a first aid room, two umpires’ rooms, storage facilities and more shelter for spectators. Mernda Football and Netball Club hopes to play its first football match at its new home at Waterview Recreation Reserve next year, while Mernda’s calisthenics and cricket clubs will also use the facility. Man on PSO assault charge

A 38-year-old Keilor East man allegedly assaulted a Protective Services Officer at Broadmeadows railway station last Wednesday. Police said two PSOs were talking to the man with the intention of issuing him an infringement notice when he became aggressive and struck one of the PSOs in the face. The man was taken into police custody and interviewed. He has been charged with assault-related offences and bailed to appear at the Broadmeadows Magistrates Court on January 12.

Four ‘wicking’ gardens will be established at Broadmeadows Disability Services thanks to a grant from a state government-funded initiative. The gardens, operated on raised beds with built-in reservoirs that supply water from the bottom up, will produce vegetables and provide opportunities for community participation. Produce will go to the Dallas Neighbourhood House’s food bank for residents doing it tough. Broadmeadows Disability Services (BDS) chief executive Barb van den Vlekkert said she was grateful to the government-funded Healthy Together Hume initiative for providing funding. She was optimistic about the long-term prospects of the garden project
helping the community and the 90 members of the BDS day service. “The aim is that there will be fresh produce for the food bank and benefits for the members, who will learn new skills through gardening,” Ms van den Vlekkert said. “I’m looking to extending partnerships with other people who would like to join us and give back to the community.” The garden project at Camp Road will be ongoing. Hume council is providing the materials, while Bunnings Broadmeadows is providing three staff members for two days to help establish the low-maintenance gardens. Louisa Maggio
Work on the second entrance to Melbourne Airport is on track for completion in mid-2025. When complete, the 3.3-kilometre extension of Airport Drive between Sharps Road and Melrose Drive will act as a secondary entrance for passengers using the M80 Ring Road. It will also have capacity for twin-rail tracks to run down the middle of the road.

Dave Biondo’s wife thinks he’s nuts. While many New Year’s Eve revellers may still be nursing hangovers, Mr Biondo will set off on January 3 for an 850-kilometre bike ride from Torquay to Adelaide. The Doreen resident will cycle in a peloton of 30, and aims to complete the gruelling ride in just five days. “I think it will be pretty hard,” Mr Biondo said. “We’ll be riding 180 kilometres a day. We’ll leave Torquay on the Sunday and arrive on the Thursday.” The group hopes the ride will raise about $100,000 for the Herbalife Family Foundation, which provides disaster relief and nutrition to children in need in more than 50 countries. While the 177-centimetre, 78-kilogram 36-year-old looks every bit the athlete now, an injury three years ago caused him to gain a whopping 25 kilograms. The personal trainer was forced to take five months off work to recover from a serious foot injury and he struggled to adjust to a sedentary lifestyle, having burned about 5000 calories a day in his prime. An introduction to Herbalife, a global weight management and skin care product, by former Carlton footballer Anthony Koutoufides, helped get Mr Biondo back on track. After his ride to Adelaide in January, he will keep up his training regime in preparation for an Iron Man event in New Zealand. The contest involves a punishing 3.8kilometre swim, 180-kilometre bike ride, and a marathon. After that, he plans to go to Hawaii to take on the world’s most punishing Iron Man event.
