If approved and annexed, the proposed Steamboat 700 master-planned community would be subject to many provisions that won’t exist in other areas of the city, according to a draft annexation agreement reviewed by the Steamboat Springs City Council on Tuesday. In addition to an increased tax burden and a new urbanism zoning designation being created for the project, a new development review procedure known as “large tract subdivision” would be created and would allow Steamboat 700 to sell “super lots” that could be developed by others. Through the process, tracts of any size within the development could be parceled off and sold by Steamboat 700 after annexation, so long as a certain percentage of the undeveloped project still remains under Steamboat 700’s ownership. Steamboat Principal and Project Manager Danny Mulcahy said that percentage is still being negotiated but could be 30 percent.

The large tract subdivision process would not create buildable lots, and the resulting subdivisions still would be subject to the public improvement requirements of the entire project. “I still have an interest in the property, and that obviously means these things have to be done,” Mulcahy said. Mulcahy said he negotiated for the process as a means to possibly generate income in Steamboat 700’s early years. “It’s a tool we can use if necessary,” Mulcahy said. “I have millions of dollars worth of infrastructure that need to go in relatively up-front. It just helps me get a return to help offset the infrastructure costs and ensure affordablity.” At Tuesday’s council meeting, Councilman Jon Quinn said he was somewhat discouraged by the

inclusion of a large tract subdivision process, believing super lots would be sold to deep-pocketed, out-of-town developers rather than local firms, limiting the project’s ability to create jobs locally. The annexation agreement also would allow Steamboat 700 to levy a “public improvement fee” on retail sales within the development, “the revenue from which may be used for the infrastructure and maintenance of facilities and amenities permitted under or required by” the agreement. “From the customer’s perspective, it looks like a tax,” said Jerry Dahl, an attorney the city hired to deal specifically with annexation issues. Dahl said the institution of a public improvement fee is primarily a property owner’s decision and that Steamboat 700 hasn’t expressed much interest in using it. Mulcahy said he doesn’t anticipate using it unless Steamboat 700 exceeds 380,000 square feet of commercial development, in which case the development would be subject to additional requirements. He added that the school is working on ways to do that, including possibly expanding the elective classes that are currently offered.

Christian Heritage School’s Class of 2010 graduation in the spring likely will be a joyous occasion celebrating the achievement of its class. Meaning, the achievement of Hannah Zwak. She is the only senior this year at Christian Heritage, which began classes Wednesday. It’s nothing new to her, though. She was the only sophomore two years ago and the only junior last year. So Zwak said it’s not really a surprise she’s the only senior. “I’ve been alone most of high school,” she joked. On one hand, Zwak said it’s cool being the only student in her class because it’s different, which she likes, but at times it can get lonely. But she’s adjusted, developing close friendships with the classes ahead of and behind her. Administrator Dave Entwistle said despite her distinction as the only member of the senior class, he still has high expectations for Zwak — especially being a leader for the school’s younger students. “I’m looking for her to set a good tone and example for the school,” Entwistle said. Zwak admitted that it was a big responsibility for her to be a leader, by herself, and it wasn’t always easy. “Usually there’s more people, a class to look to, so it’s a lot of pressure,” she said. “It’s kind of like ‘The Hannah Show’ because everybody’s watching me by myself instead of being in a group. It’s just me.” If anyone can handle taking on the responsibility as a school leader, alone, it’s Zwak, said Lesley McLeod, her European literature teacher. McLeod said Zwak has strong leadership qualities, including loyalty to her friends and dedication to her education. But McLeod admitted she worried about Zwak before the school year started. “I’ve thought about Hannah a lot going into the year and

Hayden Farmers Market vendors have packed away their products for the season, capping the first year of the venture led by the town’s Garden Club. The market on Walnut Street started June 19 and took place Friday evenings for 10 weeks. Suzanne Banning led the efforts, lining up barbecue and musicians for some weeks. She said she was pleased with the market but might change the frequency next summer. “I think for our first year it was really good,” Banning said. “I think next year there might be some things we might do differently. We might just do it once a month with a band and a barbecue. It just seemed like toward the end it petered out.” The Garden Club had planned to hold the market through Labor Day but opted to stop after last week, when about four vendors participated. The most popular markets were the ones that included a barbecue and live music, Banning said. Cindy LaDue, owner of RedClay in Hayden, said she sold her products at the beginning of the market. “The first two weeks was amazing; the first week was amazing,” LaDue said. “Everyone came.” She was unable to participate in all 10 markets. LaDue said she thought holding a market once a month or once every couple of weeks would work better. She also said organizers should consider a different day because people often leave town Friday evening. Garden Club member Tam-

mie Delaney said she thought the market was “fabulous” for its first year. She would have liked to see more local produce, but the weather didn’t cooperate. “I think for a lot of people who were gardening, this was a tough year because it was so cold and rainy,” Delaney said. “I was looking at pictures of our garden from early August last year, and it was huge. This year things aren’t coming up.” But the market became a social event that brought the community together, she said. “I think it’s something we need to continue as a town,” Delaney said. Connie Todd is part of the Hayden Marketplace, a Walnut Street cooperative where artisans sell their work. She said the markets drew people to the Marketplace. “It’s been very good for us,” Todd said. “I think it’s really improved the traffic on Friday. We’ve had a lot of people come in and shop.” She said she knew Banning put a lot of effort into the Farmers Market. Todd said she’d like to see more vendors as well as activities for children at the market. She’d also like to see more participation from locals. “I don’t know what we can do to get people in Hayden to come by and spend a little time, spend a little money and enjoy downtown,” Todd said. Banning said the Garden Club nearly broke even on the market, and she was satisfied with that. Banning did much of the organizational work but said she was grateful for help from the Hayden Chamber of Commerce and residents.

ID theft, pot cases continued STEAMBOAT SPRINGS

The California man accused of using the identity of a Steamboat Springs man to open store credit cards on the West Coast requested a preliminary hearing Wednesday after spending 27 days in Routt County Jail. Lawrence Chiles, accused of using local Chris Wening’s identity to open store accounts at chain home improvement stores in California, remained in custody in the Routt County Jail since he was booked July 30. During a hearing with Judge James Garrecht on Wednesday, public defender Grant Bursek said Chiles’ failing health should entitle him to a reduced bail and release from jail pending his preliminary hearing, tentatively scheduled for 2:30 p.m. Sept. 23. Garrecht declined to reduce or remove Chiles’ bail, but he said if there is a resolution in the case before the scheduled hearing, he would be willing to move the case forward. Chiles appeared via teleconference from the jail. In his last hearing, the 66-year-old was in a wheelchair with an oxygenbreathing device. In surveillance photos from the stores in California, however, Chiles was walking with a cane. Garrecht also agreed to

If I read all the vile stuff about me on the Internet, I’d never come to work. I’d scamper off and live my dream of being a cocktail waitress in a militia bar in Wyoming. If you’re written about in a nasty way, it looms much larger for you than for anyone else. Gossip goes in one ear and out the other unless you’re the subject. Then, nobody’s skin is thick enough. Dowd “The velocity and volume on the Web are so great that nothing is forgotten and nothing is remembered,” says Leon Wieseltier, the literary editor of The New Republic. “The Internet is like closing time at a blue-collar bar in Boston. Everyone’s

drunk and ugly, and they’re going to pass out in a few minutes.” Those are my people, I protested, but I knew what he meant. That’s why I was interested in the Case of the Blond Model and the Malicious Blogger. Sooner or later, this sort of suit will end up before the Supreme Court. It began eight months ago when Liskula Cohen, a 37-year-old model and Australian Vogue cover girl, was surprised to find herself winning a “Skankiest in NYC” award from an anonymous blogger. The online tormentor put up noxious commentary on Google’s blogger.com, calling Cohen a “skank,” a “ho” and an “old hag” who “may have been hot 10 years ago.” Cohen says she’s “a lover, not a fighter.” But the model had stood up for herself before. In 2007, at a New York club, she tried to stop a man named Samir Dervisevic who wanted to drink from the vodka bottle on her table. He hit her

in the face with the bottle and gouged a hole “the size of a quarter,” as she put it, requiring plastic surgery. This time, she punched the virtual bully in the face, filing a defamation suit to force Google to give up the blogger’s email. And she won. “The words ‘skank,’ ‘skanky’ and ‘ho’ carry a negative implication of sexual promiscuity,” wrote Justice Joan Madden of state Supreme Court in Manhattan, rejecting the Anonymous Blogger’s assertion that blogs are a modern soapbox designed for opinions, rants and invective. The judge cited a Virginia court decision that the Internet’s “virtually unlimited, inexpensive and almost immediate means of communication” with the masses means “the dangers of its misuse cannot be ignored. The protection of the right to communicate anonymously must be balanced against the need to assure See Dowd, page 9

The fight about health care took the most interesting turn last week. President Obama briefly switched from wonkish frippery about bending cost curves to speaking about faith. Reaching out to progressive faith leaders in two massive conference calls, Obama insisted God was on his side. Expanding health care fulfills a “core moral and ethical obligation that we look out for one another ... that I am Goldberg my brother’s keeper, my sister’s keeper.” This would be an easy opportunity to call attention, once again, to the double standards applied to Obama. When President George W. Bush invoked God as his inspiration, many liberals saw our

theocrat-in-chief taking a sledgehammer to the wall between church and state. When Obama does likewise, it’s inspiring, spiritual leadership. But, frankly, I find it refreshing. Of all the silly arguments that have been passed off as deeply profound in American politics, the notion that politicians can’t “impose” their personal morality on others tops the list. We have abortion politics in general, and former New York Gov. Mario Cuomo in particular, to thank for that. In 1984, Cuomo gave his famous address at Notre Dame in which he laid out the notion that a politician can be “personally opposed” to abortion but should refuse to translate that conviction into public policy. As political rhetoric, the speech was compelling. As a serious philosophical, theological or moral argument, it was a mess. For instance, Cuomo found inspiration in the Catholic Church’s relative silence on American slavery as justifica-

tion for keeping religion out of the abortion debate. Never mind that abolition was the most religious of political movements. “It is a mark of contemporary liberalism’s commitment to abortion,” Ramesh Ponnuru writes in “The Party of Death,” “that one of its leading lights should have been willing to support temporizing on slavery in order to defend it.” The main problem with Cuomo’s sophistry is that, once watered down into political talking points, it’s simply ludicrous. In 2004, another Catholic Democrat captured the inherent contradictions of Cuomo-ism nicely in a presidential debate. John Kerry insisted that his faith was “why I fight against poverty. That’s why I fight to clean up the environment and protect this Earth. That’s why I fight for equality and justice. Internet brings out more of the cowardly that those persons who choose to abuse the opportunities presented by this medium can be made to answer for such transgressions.” Cyberbullies, she wrote, cannot hide “behind an illusory shield of purported First Amendment rights.” Once she had the e-mail address, Cohen discovered whence the smears: a cafe society acquaintance named Rosemary Port, a pretty 29-year-old Fashion Institute of Technology student. Cohen called and forgave Port, but she did not get an apology. She had her lawyer, Steve Wagner, drop her defamation suit. But now Port says she’ll file a $15 million suit against Google for giving her up. Port contends that if Cohen hadn’t sued, hardly anyone

would have seen the blog. (If a skank falls in the forest and no one hears it ... ) But Cohen says the Internet is different than water-cooler gossip. “It’s there for the whole world to see,” she told me. “What happened to integrity? Why go out of your way solely to upset somebody else? Why can’t we all just be nice?” She said she may become an activist, and she has been e-mailing with Tina Meier, mother of Megan Meier, the 13-year-old who killed herself after getting cyberbullied by the mother of a classmate who pretended to be a teen suitor named “Josh.” The Internet was supposed to be the prolix paradise where there would be no more gatekeepers and everyone would finally have their say. We would express ourselves freely at any level, high or low, with no inhibitions.

Yet in this infinite realm of truth-telling, many want to hide. Who are these people prepared to tell you what they think, but not who they are? What is the mentality that lets them get in our face while wearing a mask? Shredding somebody’s character before the entire world and not being held accountable seems like the perfect sting. Pseudonyms have a noble history. Revolutionaries in France, American founding fathers and Soviet dissidents used them. The great poet Fernando Pessoa used heteronyms to write in different styles and even to review the work composed under his other names. As Hugo Black wrote in 1960, “It is plain that anonymity has sometimes been assumed for the most constructive purposes.” But on the Internet, it’s often less about being constructive and more about being cowardly.

By Kerry’s own admission, he seeks to legislate his articles of faith on people on nearly every issue under the sun — except abortion. Suddenly, on that issue alone, he is an adamantine secularist. But in recent years, Democratic rhetoric has been changing, for several reasons. One, many voters are put off by such double-talk. Another reason is

that many smart liberals have noticed that some religious Americans are more activist on economic and environmental issues but are turned off by what they perceive as secularism. During the last presidential campaign, Hillary Clinton was comfortable speaking the language of the social gospel movement, historically the religious wing of American progressivism. But Obama was even better. Speaking during the campaign at an evangelical church in South Carolina, he said, “I am confident that we can create a kingdom right here on Earth.” He supported Bush’s Office of Faith-Based and Community Initiatives and kept the agency when he took over, albeit with

a slight name change. He courted evangelical pastor Rick Warren. His social agenda, went a constant refrain, was deeply informed by the injunction that we “are our brother’s keeper, our sister’s keeper.” Politics has always been a contest of values, and religion remains the chief source of those values. Our political discourse has long been cheapened by the canard that only conservatives try to use the state to impose a religiously informed moral vision, while liberals are guided by science, reason and logic as well as some secular conception of decency and compassion. No party has a monopoly on such resources, and it’s about time we all recognized that.

Hankins gets life without parole CRAIG

Before a judge imposed sentencing Wednesday on Terry Hankins, who was convicted of murdering his wife, the defendant spoke with his attorneys in an empty courtroom. They didn’t talk about law or his trial. Hankins told them he had been teaching vocabulary to another inmate at Moffat County Jail and that he saw a benefit in the “team effort” of inmates working together on jigsaw puzzles. He also said he doesn’t care for sports, even skiing, because the latter tears up the “beautiful Colorado mountains.” About 15 minutes before, a jury of 10 men and two women found him guilty of first-degree murder, a Class 1 felony, and abuse of a corpse, a Class 2 misdemeanor, in connection with the June 2007 death of his wife, Cynthia. The conversation between Hankins and his attorneys was a brief moment of calm in a trial that included evidence Michael O’Hara, chief judge of the 14th Judicial District, said was the most gruesome he had ever seen. O’Hara sentenced Hankins to life in prison without parole, adding that he had no discretion in his decision. First-degree murder carries a mandatory life sentence in Colorado. According to three recorded confessions Hankins made to law enforcement, he choked his wife unconscious, hit her in the face with a crow bar and then smothered her with a pillow. Hankins said he cut Cynthia’s body into pieces and buried her remains on his gold claim north of Craig, where they were eventually unearthed by law enforcement. As the jury read the verdict — to a courtroom half-filled with Craig Police Department officers and Moffat County Sheriff’s Office deputies — Hankins gave no reaction. After the courtroom emptied, Sheryl Uhlmann, one of Hankins’ public defenders, teared up. It was a relatively quick end to a trial that began Aug. 10, more than two weeks ago, and included dozens of witnesses and more than 100 pounds of evidence. The jury reached its decision about two hours after it began deliberating at 8:30 a.m. In addition to life in prison, O’Hara levied $652.50 in fines

and fees against the defendant. Although the judge did not make any comment about the case during the verdict or sentencing, Cynthia’s mother and niece, as well as Detective Jen Kenney, with the Craig Police Department, addressed the court before Hankins was sentenced. “It’s over, but I still have a hole in my heart,” said Cynthia’s mother, Willie Fay Runnels, of Texas. “I can go back and tell the kids the good news, but I can’t bring their mother back to them.”

But she said something kept her at the school. “It’s always felt like this is what God wanted for me, God’s plan for me,” Zwak said. “Even when it didn’t make sense.” Had Zwak transferred, Christian Heritage would have been without a senior class, which Kirsten Williams, a junior, said would be weird.

“And plus, it’s Hannah. She’s been a part of the school for a long time,” Williams said. Zwak spent time Wednesday afternoon filling out college applications. Zwak said she plans to apply to the University of Colorado at Boulder, Colorado State University, Louisiana State University, maybe the University of Wyoming and somewhere in Florida. Zwak said she really wants to attend CU, however.

Being the only member of her class hasn’t only helped Zwak prepare for college. It’s made her a better person, more independent and more appreciative of the people in her life, she said. If she was in a bigger class, Zwak said, she thought she’d be just average. “It’s an opportunity to live up to my full potential and be better than average,” Zwak said of being the only member of her class for three straight years.

Before the facility was completed, VNA offered at-home care for hospice patients. When at-home care is no longer possible, the only in-county option was to move patients to Doak Walker Care Center at Yampa Valley Medical Center, Thiel said. “Our goal is to meet the community’s … needs as far as patients who are dying,” Thiel said. Patients might be recommended for hospice services for periods of as long as six months, Brown said. Personal funds, private insurance, government health care programs, memorial donations and hospice fundraising events help cover the costs, according to the VNA Web site.

Earlier this year, council members decided that big box would not be required of the development, but a land-use regulating plan attached to the annexation agreement provides for the possibility. “We are not requiring it, but we are leaving it open as an option,” said Tom Leeson, city director of planning and community development. Bentley, however, felt referencing big box in the regulating plan might encourage such uses and wanted to remove it. No other council members echoed her sentiment. Dahl also addressed concerns Tuesday regarding Steamboat 700’s use of a voluntary real estate transfer tax within the development to help pay for items such as affordable housing and a school. Concerns have been raised that such a mechanism could be ruled illegal and leave the city holding a huge bill. Dahl said that for most of the requirements of the annexation agreement, Steamboat 700 has to pay no matter what. While a voluntary real estate transfer tax is one method for Steamboat 700 to pay for things, Dahl said the development is not off the hook if that method is invalidated. However Councilwoman Cari Hermacinski asked that a backup plan be added to the agreement to safeguard against the event that the transfer fee is ruled illegal.

Feds look into pot in forests The U.S. Forest Service is looking at how much marijuana is being illegally cultivated in Colorado’s national forests after the recent discovery of more than 14,000 plants in the Pike National Forest. Forest Service officials said Wednesday they think illegal immigrants are being brought to Colorado for mass cultivation of marijuana and they are leaving behind a trail of trash, pesticides and other debris that has damaged public forests and polluted rivers. “We don’t know what we have right now. This activity is new to us,” said Michael Skinner, a law enforcement officer with the U.S. Forest Service. In July, authorities spent more than 24 hours clearing a marijuana growing operation on forest land near Cheesman Reservoir. They say the plants’ street value was about $2.5 million Authorities say there was an elaborate irrigation system at the site. No suspects have been identified in that case, but two others were arrested at the Pike National Forest site. Skinner said national forests are safe, but hikers should take precautions.

Suspected vandal once campaigned for Democrat DENVER

The windows broken at Colorado Democratic headquarters were an act of political vandalism prompted by the heated debate about President Barack Obama’s health care reform, State Democratic Chairwoman Pat Waak said Wednesday. But the man accused in the incident is refusing to tell police about a possible motive. Maurice Schwenkler, who once campaigned for a Democratic candidate for the Legislature, was arrested in Denver early Tuesday on suspicion of criminal mischief. “He’s not giving us any indication why he did what he did,” Denver police spokesman Sonny Jackson said Wednesday of Schwenkler. Most of the 11 broken windows displayed posters supporting health care reform and Obama. The headquarters was unoccupied at the time and there were no injuries reported. Party officials estimate damages at more than $10,000.

Companies get grants to use unwanted trees DENVER

Three Colorado companies have each been awarded

AROUND COLORADO a $250,000 federal grant to convert small or damaged trees into fuel sources or other uses. The recipients, announced Wednesday, are the Independent Log Co. of Alamosa, Intermountain Resources LLC of Montrose and Rogue Resources Inc./ More Lumber of Milner. The material, called woody biomass, consists of small, “low-value” trees or trees damaged by insects, disease or weather. The recipients must contribute at least 20 percent of the project cost. The grants are administered by the U.S. Department of Agriculture. Since 2005, the program has awarded more than $26.3 million for projects ranging from biomass boilers for schools and prisons to equipment to make logging companies and timber mills more efficient.

State man threatens to kill horses because of jail term FORT LUPTON

A Northern Colorado man has threatened to shoot and kill 24 horses to protest a 90-day jail sentence stemming from an order to clean up the rural property where he lives. Trenton H. Parker distributed a flier soliciting shooters to help kill the horses Sept. 5, two days before he is scheduled to go to jail. He repeated his intention in interviews with the Greeley Tribune and KUSA-TV. Weld County Sheriff ’s Deputy Shane Scofield says authorities are taking the threat seriously. Anyone who shoots a horse would face animal cruelty charges, he said. “I would like to think that after reading something like this (flier), there would not be a person in the county, or a person around in the state, that would actually be interested in taking somebody up on this,” Scofield told KUSA. Authorities said Parker was found in contempt of court for failing to remove converted mobile homes from the property around his home between the towns of Fort Lupton and Lochbuie, about 20 miles northwest of Denver. The mobile homes violated zoning ordinances, and code enforcement officers ordered Parker to remove them, authorities said. Parker told the newspaper he doesn’t own the horses or the property. He said all are owned by an investment group, which hasn’t been identified.

Bear climbs ladder to escape Colorado skatepark SNOWMASS

A bear that wandered into a sunken skateboard park and got stuck was rescued when officials lowered a ladder so it could climb out. The bear was discovered Tuesday morning in the Colorado resort town of Snowmass. Officials say it apparently was in the park all night and couldn’t get out because of the steep concrete sides. Workers from the Parks and Recreation Department lowered a long ladder. The bear eventually climbed the ladder and wandered away.

Consumers and businesses went on a big-ticket spending spree in July, sending home, car and equipment sales soaring by the largest amount in years. The sales, detailed in two government reports Wednesday, confirmed a subtle but marked shift in confidence about the economy. New home sales jumped almost 10 percent from June, and orders for long-lasting goods like appliances, planes and computers increased nearly 5 percent in July, the third increase in the past four months. “It looks like we’ve hit bottom and we’re now slowly trying to dig our way out,” said Nigel Gault, chief U.S. economist at IHS Global Insight.

Still, it remains unclear whether the growth can be sustained. Although the increases in housing sales and manufacturing last month were dramatic, they came from extraordinarily low levels and were fueled by temporary government programs like Cash for Clunkers and tax credits for home sales. Most economists now agree the recession that began in December 2007 has ended or is ending. Some say the economy is poised to grow strongly in the July-September quarter, but will probably show weaker growth after government stimulus spending tapers off. Sales of new homes surged to a seasonally adjusted pace of 433,000 in July from 395,000 in June, the Commerce Department said, providing another sign the housing market is bouncing back

from the historic bottom reached early this year. Driven by falling prices, the fourth-straight monthly increase was greater than expected. Sales haven’t risen dramatically since February 2005. While sales are still off nearly 70 percent from the frenzied peak four years ago, they are still up more than 30 percent from the bottom in January. “We can stop worrying about the housing market and start playing closer attention to other issues, such as when credit will start flowing more freely,” Joel Naroff, chief economist at Naroff Economic Advisors, wrote in a note to clients. The improved outlook could help further boost the economy. As home sales increase, builders will gradually need to hire more workers to pour foundations and pave roads.

The coffers of the Federal Deposit Insurance Corp. have been so depleted by the epidemic of collapsing financial institutions that analysts warn it could sink into the red by the end of this year. None of this means bank customers have anything to worry about. The FDIC is fully backed

by the government, which means depositors’ accounts are guaranteed to as much as $250,000 per account. And it still has billions in loss reserves apart from the insurance fund. In an era of bitter political division, Sen. Edward M. Kennedy’s death silenced a singular voice of bipartisanship at a time when colleagues are struggling with angry constituents and each other over an elusive plan to overhaul the nation’s health care system. Some lawmakers said Tuesday that the current stalemate is the result of Kennedy’s absence for the past few, crucial months. It’s not clear that the postKennedy Senate includes anyone with the credibility among ideological opponents, the dealmaking skills or the inside knowledge to strike a quick agreement. “There is nobody else like him,” said Sen. Judd Gregg,

R-N.H., who alternated with Kennedy over the years as chairman and ranking minority-party member of the health committee. “If he had been physically up to it and been engaged on this, we probably would have an agreement by now.” Kennedy lost the fight to brain cancer Tuesday at 77. But he had won countless others by embodying an increasingly rare type of bipartisanship — the kind perceived not as a threat to ideology or fundraising prowess, but as a way of getting something done. For 47 years in the Senate, Kennedy evolved into an institution himself, equal parts liberal icon and dealmaker who combined those skills to forge agreement on some of the most sweeping and controversial social

legislation of his time. Without Kennedy, the 99-member chamber lacks anyone playing precisely his role doling out the goodwill and procedural expertise necessary to make the Senate wheels spin through controversial legislation. The Democratic caucus falls from an effective supermajority of 60, enough to kill Republican filibusters, to 59, including two independents. No one is irreplaceable in the Senate, or so a popular saying goes. But John McCain, R-Ariz., called Kennedy just that in a statement Wednesday. “He had a way of sitting down with the parties at a table and making the right concessions, which really are the essence of successful negotiations,” McCain said on ABC’s “This Week.”

The popular Cash for Clunkers program generated nearly 700,000 new car sales during the past month, giving the U.S. auto industry a badly needed jolt of activity during the deepest decline in auto sales in two decades. The government, releasing final data on the car incentives, reported Wednesday that dealers submitted 690,114 sales totaling $2.88 billion, bringing the program to a close under its $3 billion budget. Japanese auto manufacturers led American companies in new car sales through the program, which ended late Monday. Many dealers are waiting to be repaid for the Cash for Clunkers incentives they gave car buyers and were allowed to submit paperwork seeking reimbursement until late Tuesday. Despite the summertime frenzy at dealerships, analysts said the growth in auto sales may be short-lived. Sales in July increased to 11.2 million when converted to an annual rate, the first month in 2009 in which sales had risen above the 10 million level. A drop in con-

sumer confidence late last year sent sales plunging to depths not seen since the early 1980s, prompting lawmakers to create the program.

To the moon, NASA? Not on this budget, experts say WASHINGTON

NASA will test the powerful first stage of its new Ares moon rocket today, a milestone in a program that has already spent $7 billion for a rocket that astronauts may never use. When that first stage is tested, it will be mounted horizontally. The engine will fire, shake and make lots of noise. But by design, it will not leave the ground. The same could be said for NASA’s plans to go to the moon, Mars or beyond Earth orbit. It’s not so much a physical challenge for engineers as it is a financial challenge for budgeters. The $108 billion program to return to the moon by 2020 was started five years ago by then-President George W. Bush. But a special independent panel commissioned by President Barack Obama con-

cluded that the plan cannot work on the existing budget schedule because it’s likely to cost at least an extra $30 billion through 2020.

Airlines may have a rough ride during fall and winter DALLAS

Airlines cut fares to get more passengers on planes and salvage the summer travel season, but now their job gets harder heading into the slower fall and winter. The nine largest U.S. carriers lost nearly $600 million in the second quarter of this year. Bigger losses are predicted in the third and fourth quarters, and some analysts have raised the possibility of another round of bankruptcies. The nation’s airlines have been in a defensive crouch for two years. They’ve cut flights and fired workers — first to absorb increasing fuel prices, then to ride out the recession. But revenue is down one-fifth or more from a year ago at the four largest carriers. Because they’ve cut costs, sold new stock and borrowed money, the airlines have plenty of cash for now.

Mexico now has one of the world’s most liberal laws for drug users after eliminating jail time for small amounts of marijuana, cocaine and even heroin, LSD and methamphetamine. “All right!” said a grinning Ivan Rojas, a rail-thin 20-yearold addict who endured police harassment during the decade he has spent sleeping in Mexico City’s gritty streets and subway stations. Schaffrick picks up best finish

It might seem a bit early for snowboarding season, but that didn’t stop Steamboat Springs’ Maddy Schaffrick from picking up the best World Cup finish of her young career Tuesday in New Zealand. “No, I’m not surprised,” said Jon Casson, director of the snowboarding program for the Steamboat Springs Winter Sports Club. “She always seems to step it up when it counts. She’s done it since she was 8, and that’s why she is such a great competitor.” Schaffrick finished 11th in Tuesday’s opening World Cup halfpipe event in Cardrona, and fourth among American riders. China’s Jiayu Liu won the event. Olympic snowboarder Kelly Clark was the top American, in second, and teammate Gretchen Bleiler finished third. The only other American to finish in front of Schaffrick was Ellery Hollingsworth, in fifth place. Casson said it was a great showing for the local snowboarder, who is hoping for an Olympic spot in the 2010 Olympic games in Vancouver, B.C. The performance was especially impressive because Schaffrick injured her tailbone at the end of last season and missed several key camps last summer. “It could have been a big setback,” Casson said. “But it looks like Maddy was able to deal with missing the camps, and it didn’t impact her in terms of getting top results.” Schaffrick is one of three elite snowboarders from Steamboat Springs hoping to make an impact early this season. Matt Ladley also made the trip to New Zealand, but a wrist injury kept him out of the opening World Cup competition. Casson said Ladley will continue to train and was

The graduation of top athletes is as much a ritual of high school sports as homecoming. But it’s difficult not to wince when looking at all the Hayden High School volleyball squad has lost. The Tigers aren’t complaining, and despite losing much of the skill and power that helped them to a headturning 9-1 start a year ago, they are set on laying out an improved season in 2009. “We had a lot of talented people last year, but we can

get further this year,” senior Jarah Woodley said. “If we put everything into it, we can get there.” There is no argument among Hayden’s coaching staff or players that things won’t be the same. The team graduated a pair of power towers in Holli Salazar and Kylee Sweetser — the team’s two kill artists. A bunch of judges Dahlberg got together Wednesday and told us so. No one was ever supposed to know they were juiced when they were hitting all those home runs just a few years back. Not Bud Selig, and certainly not the clubs paying them millions of dollars to slug balls out of the park. It was all supposed to be a secret. And it would have been if those pesky federal investigators hadn’t tried to find out what was really going on in baseball. They wanted answers, and they weren’t going to get them from the players. So they went on a fishing expedition and

reeled some big names in. Of course, now we know a few of them — some lawyers who couldn’t keep a secret and some aggressive reporters took care of that. There’s nothing in the 9th U.S. Circuit Court of Appeals ruling Wednesday that will change that. The 70 pages of legal opinion don’t change the court of public opinion, which has long since found the outed players (yes, even Big Papi) guilty. The cat can’t be put back in the bag. The unnamed players on the list can’t even breathe a sigh of relief because enough people know who they are and they might someday talk. Yes, in a perfect world certain names wouldn’t be made public while other names remain secret. But in a perfect world baseball players wouldn’t have used concoctions whipped up in a lab to make a mockery of the records that the game used to hold so sacred. So don’t feel too sorry for A-Rod and company just yet. Remember, it wasn’t those

outing them who promised their names would never be revealed. It was the union and Major League Baseball, and together they’ve been in business of telling a lot of lies to fans for a long time. The court’s ruling that federal investigators went too far in seizing the samples and names of 104 players from two labs when it was only looking for 10 players as part of the BALCO investigation came after a protracted legal battle between the union and the government over the names. Prosecutors could appeal to the Supreme Court, but odds are that part of the fight is over. The clean players are the real losers in all this, and not just because every time they hit a home run someone wonders. They’re the ones who don’t get monster contracts because they don’t put up monster numbers like their teammate using the latest magic drug. So too bad, Manny. Tough luck, Big Papi and A-Rod. Sorry, Sammy. You’ve been outed. There’s nothing the judges can do about that.
