WELCOME TO OUR Christmas and New Year’s edition of the magazine, where we decided that for this issue we would promote ‘pools’ as our theme for property. We know that in other countries around the world, the winter’s cold is seriously setting in and outdoor oases will be freezing over. But here in the Virgin Islands, the soothing heat remains, drawings many ‘snowbirds’ from colder climes to soak up the wonderful sun we are blessed with seeing year-round. Our opening feature is an exclusive review of renowned hillside retreat Golden Pavilion, currently for sale in the British Virgin Islands. SANS SOUCI—the name of this property—translates from the French as “Carefree.” In keeping with this ethos, the agenda was to transform a terraced garden at this Tower’s Estate home, into a convenient, comfortable sanctuary for the older couple who are the new owners. The existing garden was wellestablished and bounded by a 12-foot high retaining wall that created a somewhat level area. The arrangement also featured stone steps down to the lower area of the site, which was left primarily as a natural landscape. The scope of the project included creating an outdoor oasis with a pool, spa, patio, and gardens, and also turning a ground floor study into a new Master Suite.

The Pool and Deck We chose to locate the pool immediately behind the existing retaining wall to create a vanishing edge with the sea-view beyond. To achieve this, we extended

The scope of the project included creating an outdoor oasis with pool, spa, patio, and gardens, and also turning a ground floor study into a new Master Suite the vanishing edge trough over the existing wall. This necessitated cutting about two feet off the top of the wall and effectively using the existing wall as formwork to cast the new pool cistern. We demolished the old generator house and storage shed, and relocated the equipment to a new utility room below the main level veranda, which now also houses the pool equipment. The curve at the garden edge of the pool, echoes the return angle of the retaining wall at the boundary and helps to establish the geometries that carry through the entire site layout. The pool is roughly 22 feet long by 11 feet wide, sufficient to swim about three strokes, but really designed for lounging. The entry steps follow the curved

wall and the stainless-steel handrail aids in getting into the water. The depth of the pool does not exceed five feet, making it comfortable for adults and relatively safe for children. Pool lights, in deck lights, and outlets, as well as lights mounted into the base of the adjacent stone wall allow the space to be enjoyed both day and night.

The Spa The spa was tucked into the curve of the original retaining wall adjacent to the stairs. It provides a comfortable seating area with massaging jets. The stainless-steel handrail provides additional stability for entry. We introduced additional curves at the patio extension, and the edge of the deck and pool. Each is an echo or

a ripple of the others, and mediate the transition to the rectangular covered patio outside the new Master Suite. The curves reproduce the natural geometries of the removed plant life, and the flow of the original stairs.

The Stairs and Stone Walls We paid particular attention to creating easy transitions between different surfaces, including creating comfortable, wide, level stairs in lieu of the original rough-hewn stone steps at the garden. These stairs are finished with nonslip tile which coordinates with the warm grey stain colour at the pool deck. Step-lights inserted into the risers also allow ease of navigation at night should it be necessary to go down to the utility room after hours. At the edge of the pool deck, the stone wall bounding the stair, forms a low stone bench adjacent to the spa. On the left side of the stairs, the stone branches off to bound terraced planting areas at different levels, while simultaneously functioning as a handrail for ease of navigation. Our new outdoor intervention respected the established levels and geometries while introducing new gracious elements. The repetition of design notes throughout the space creates a cohesiveness between the different areas and materials. IT CAN BE extremely comforting to understand the process of property purchase when taking this exciting journey. Without delay, here is the Harneys’ guide to buying a property in the BVI.

Letter of intent The first stage of most property transactions is the buyer and the seller agreeing the principal terms of the transaction such as price and any conditions which must be satisfied before the sale and purchase can proceed. These terms are typically recorded in a letter of intent—otherwise known as head of terms—and the deposit is usually paid at this stage. The letter of intent will usually be stated to be subject to contract which means that until the sale and purchase agreement has been entered into, there is no legal commitment by either party to the other. Once the sale and purchase agreement has been entered into, the buyer is legally committed to buy and the seller to sell at the stated price, subject to the agreed conditions.

Deposit In a standard property transaction, a deposit of 10 per cent of the purchase price is paid by the buyer. Paying a deposit prior to signing the sale and purchase agreement does not in itself

secure the property, but along with the letter of intent, it is an indication that the buyer is committed to the process. The deposit is paid by the buyer either to the realtor—if there is one—or to the seller’s lawyers before or upon signature of the sale and purchase agreement. The deposit will normally be placed on an interest-bearing deposit account. The interest follows the deposit and so if the sale proceeds normally, the seller will be entitled to the interest on the deposit at completion. If the sale does not proceed and the buyer recovers the deposit, then the buyer will be entitled to the interest.

Sale and purchase agreement The ‘sale and purchase agreement’ is normally prepared by the seller’s lawyers and submitted to the buyer’s lawyers for amendment or approval. Among other things, it contains a description of the land, the nature of the title—whether freehold or leasehold—and the agreed price. The buyer should always be sure to have arranged adequate financing before signing the sale and purchase agreement, or ensure that the sale and purchase agreement is made conditional on securing adequate financing. If the buyer is unable to pay the balance of the purchase price at

completion, the buyer is likely to, at least, lose the deposit. The sale and purchase of a property may be made subject to the satisfaction of one or more conditions. The nature of the conditions will depend on the particulars of the transaction, but may include the buyer securing adequate financing and/or the buyer arranging and receiving the results of various property-related surveys and inspections to its satisfaction.

Land Holding Licence For those not familiar with the BVI, the terms ‘Belonger’ and ‘NonBelonger’ can take a bit of getting used to. In broad terms, Belonger status is a legal classification that is associated with a number of British Overseas Territories, though the requirements for the status and the rights that such status confers vary from territory to territory. As far as the BVI is concerned, a Belonger is a person deemed to belong to the British Virgin Islands according to the Virgin Islands Constitution Order 2007. An understanding of the precise definition is unnecessary for the purposes of this guide, but in broad terms, the term Belonger refers to a person of BVI ancestry and other persons who have been granted Belonger status under the relevant immigration legislation.

While it is possible for Belonger status to be granted to a person who is a Non-Belonger, the circumstances in which such status may be granted are very limited. It would be unusual to be a Belonger and not to be aware that you are or at least might be. Buyers who are not Belongers are required to obtain a Non-Belongers Land Holding Licence to hold BVI property. For this reason, a sale of property to Non-Belonger buyers should always be made conditional on receipt of a Licence. Licence applications are generally made by the buyer’s lawyers, but in order to

make the application, the lawyers need to be provided with certain information about the buyer together with other supporting documents. A Licence application relates to a specific property and a specific buyer. The application process for a Licence typically takes approximately three to five months. A sale and purchase agreement will usually provision for 12 months to allow sufficient time for the buyer to secure the Licence. If the Licence is not secured within this timeframe, the sale and purchase agreement will often allow the parties to agree an extension of

time, or for either party to terminate, in which case the buyer secures the return of the deposit.

Completion Completion is usually arranged to take place within a specific period of time after the last of the conditions in the sale and purchase agreement has been satisfied. Upon completion, the seller and the buyer sign an Instrument of Transfer which records the transfer of the property from the seller to the buyer. If the buyer is borrowing money to fund the purchase of the property, then the buyer will need to sign loan documentation at completion. The balance of the purchase price is payable at completion. It is generally upon completion that the buyer takes possession of the property.

After completion Immediately after completion, the buyer’s lawyers will present the Instrument of Transfer to Inland Revenue for payment of stamp duty. Stamp duty is calculated as a percentage of the higher of the purchase price and the market value of the property. For Belongers, this is four per

cent and for Non-Belongers this is 12 per cent. In each case, a copy of a recent appraisal must be submitted as evidence of the market value. After stamp duty has been paid and the Instrument of Transfer stamped, the buyer’s lawyers will submit the Instrument of Transfer for registration at the Land Registry. After completion, the buyer will need to ensure that any accounts for utilities are transferred to the buyer’s name.

Personal Attendance None of the legal procedures associated with buying and selling BVI property requires the personal attendance in the BVI of the buyer or the seller. I HAVE WORKED in and around the Virgin Islands marine industry for the past 17 years. As a member of the Marine Studies Department at the H. Lavity Stoutt Community College, I’ve assisted in the training of students who went on to follow careers in the marine industry. Many of these students were women who became yacht captains or filled jobs in managerial positions especially with the larger firms such as Moorings and Sunsail. The other jobs available to women in the yachting field were as boat cleaners and yacht provisioners. For years—with a few

exceptions—these were the only places you would find women employed in the industry. The area of yacht maintenance and repair remained the domain of men only; these were the painters, fiberglass workers, engine repair, riggers, and electrical technicians among others. This is now changing and women are filling these positions in the boatyard. Although it began before the great storms of September 2017, it has accelerated since then. Hurricanes Irma and Maria devastated our islands and the yachting industry was dealt mighty blows along with the rest of the community. The number of destroyed boats was mindboggling and the docks they were attached to were also wrecked. The clean-up and restoration presented a daunting task and new positions were made available to meet this challenge with women showing up to apply. In my situation, I was fortunate to cross paths with two of these ground-breakers. After Irma and Maria, the traditional wooden sloops that I’ve been taking care of for the past 16 years were also damaged or destroyed. Three were sunk, two severely damaged on land, one a total loss, and the damaged sloop Vigilant built in 1880 by Willie Penn in East End was taken to the landfill by the College with no explanation. To make matters worse, my employment at the H. Lavity Stoutt Community College was terminated as of July 31, 2018. The future looked bleak for both the sloops and myself and then something extraordinary happened. In June, I was asked to teach a short vocational class for the Marine Centre called introduction to woodworking. It was to be taught at Nanny Cay and designed

to give entry level skills to anyone who was interested in working in the marine industry. I acquired permission to teach the woodworking skills as part of restoring our damaged sloops. The three sunken boats were raised with lift bags, hauled out, and placed under some trees not far from the beach at Nanny Cay. We now had five sloops awaiting repair and restoration. When registration for the course began, there were only two students who signed up and they were two young local BVIslanders— both women. One was 19-yearold Ms. Norissa De-Leon and the other was 21-year-old Ms. Chemoia Hodge; neither had any experience in woodworking or construction. Chemoia was taking a short course in fiberglass repair. What these two young women lacked in experience was soon made up for by their desire to learn and ability to do the work. I taught them the basics. They learned how to use a skilsaw, to drive nails, and to assemble saw bucks and other wooden fastenings. Along with woodworking skills, I also taught them the basics of wooden sloop construction and some of the history behind the maritime heritage of the Virgin Islands. We were joined later by two other students—one male and another female—and we ended up doing two sections of the course. By the time of completion, it was the end of July and my job had been terminated at the College. Norissa and Chemoia had been asking me to find them work. They were both anxious to earn money, so I offered to pay them to help me get

the roof back on my house, which they readily accepted. We spent the whole month of August repairing my roof and putting my home and yard back in order. I was the cut man on the ground and they worked on top. Although having never done anything like this before, they were quick learners. After the house was secure, they built a new roof over my wood-shop and I was back in action. They were truly a Godsend for me. As August closed, I wasn’t sure what we could do to continue working together. Along with a group of people from the private sector who had been helping me maintain the sloops for years, we created an NPO called the Virgin Islands’ Sloop Foundation and it is our purpose to raise funds to repair, restore, and maintain the traditional wooden sloops that are left. After consulting with them, we decided that we had already gathered enough funds to hire both Norissa and Chemoia at an hourly rate and that I would work along with them as a volunteer until January when we would rethink the project and decide whether to move forward or not. With the help of our Foundation Chairman Jamel Davies—who is a shipwright—and with the support of Nanny Cay Marina and VP Bank, who are also members of the Foundation, we have begun what we call the Virgin Islands Sloop Restoration Project. Norissa and Chemoia are now learning the skills of traditional wooden boat-building as practiced by their forebears hundreds of years ago. They are two young, strong, tough women and the future belongs to them. ■

the West Indies’ as it was the home to many battles in the colonial era. Now also a national park, Brimstone Hill is a monument to top-notch British military engineering and to the skill and endurance of the African slaves who built the well-preserved fortress. A truly unique experience on St. Kitts is revealed in a ride on the ‘last railway of the West Indies.’ The St. Kitts Scenic Railway is a former sugar transport train that now guides tourists on a three-hour tour of the island. Guests will pass over narrow

bridges, view lush rainforests at the base of Mt. Liamuiga, see countless sugar mills, and enjoy views of black sand beaches and the stunning ocean. Another memorable sight on these islands are the African green ‘vervet’ monkeys. St. Thomas’s lowland church was built on Nevis in 1643 and was the first Anglican church in the Caribbean. The historical significance of these islands is hard to ignore, and the beautiful scenery make it even harder to leave. St. Kitts and Nevis may be small in size, but the impression left on visitors is massive. ■
