Your Association continues to develop new services to support you

s I write this Chief Executive’s comment, we are five meetings into the first face to face regional meetings since the initial lockdown in March 2020, with just the final meeting in the South East to complete. As reported previously we will also be adding a remote meeting to the end of every round of ARCA regional meetings for members who cannot make the face to face meetings for whatever reason, as well as providing another option to those regular attendees. The ARCA AGM was also held face to face at Lords Cricket Ground on the 8th of October. It was great to see everyone again in person at these events. At the recent regional meetings members were updated with regards to events at the AGM including the make up of the Governing Council for 2021/2022 and details of the presentation given by Sam Lord of the HSE. Sam’s presentation focused on a quick who’s who in the HSE, aspects of The Analysts’ Guide (HSG 248) which licensed contractors should be aware of, and finally an update from the Asbestos Unit, including current thinking on how asbestos licence renewals will be conducted when licence holders are assessed for the second time using the remote assessment process (page 8).

Members were also informed of three big projects which were almost ready for launch, ALFA for members directly employed operatives, the Site Audit Portal and the Asbestos Management Institute (AMI). ALFA for directly employed operatives, will allow members to schedule reviews of competency of their operatives by supervisors, or other members of the management team, and then use this information to produce an overall performance rating which will also act as a TNA. The App will also allow members to store certificate records, and copies of certificates, for each operative and the system will flag up when they are due to expire. This system has now been launched, please reference pages 10 and 11 for further information on this new ALFA LARC Employees system. The Site Audit Portal is nearing completion. Via this private portal members will be able to
log in to view and analyse the results of their membership audits, as well as any additional site audits booked through ARCA and internal audits undertaken using the Member Internal Site Audit App. The portal will illustrate trends in performance based on Plan, Do and Check, and generate action logs to record corrective actions and allow them to be signed off when complete. Both the ALFA system for directly employed operatives and the Site Audit Portal will be provided to members at no additional cost. Finally, the Asbestos Removal Management Institute (ARMI) has changed its name to the Asbestos Management Institute (AMI), to better reflect the differing roles within the industry that will be represented by the Institute going forward, such as individual asbestos surveyors, analysts, and trainers, as well as those involved in asbestos removal work. We have work still to do before we can make AMI available, so we will keep you informed of progress. I am also pleased to report that following the announcement at the AGM that the apprenticeship scheme for analysts and surveyors may yet come to fruition, I have heard (today while I was writing this piece) that following the discussions we have had with an existing provider of apprenticeships, that they have agreed to partner with us to deliver the asbestos apprenticeship programme. A project to finalise in the new year. With the new products and services that are nearing completion, as well as others in the pipeline and other initiatives yet to be announced, all of us at ARCA are looking forward to an exciting and revolutionary 2022 for the Association. I would like to wish all readers a very Happy Christmas and a prosperous and peaceful New Year.

ARCA adds Soil Remediation audit form to Member App
A
RCA member contractors now have access to a soil remediation audit form via the Member Internal Site Audit App. This new audit form has been produced to cover the criteria specific to the methods and controls used during soil remediation and will be scored automatically within the App. “We are delighted to be able to offer this additional service to our members,” commented Steve Sadley, Chief Executive of ARCA. “The new soil remediation audit form will be available to all members who currently have a licence to use the Member Internal Site Audit App. In fact, we have two members already signed up to use this new audit form. Also, as with all audits made using the App, the reports of soil remediation audits will be available within the new

member audit portal which is currently in development.” Member contractors have already registered 120 licenses to use the App to carry out audits of their asbestos removal sites, therefore using the same question set as an ARCA audit which follows the ’Plan, Do, Check’ approach to health and safety management. Geoff will be sadly missed by all who knew him.

ARCA Annual General Meeting 2021 The 36th ARCA Annual General Meeting (AGM) was held at Lords Cricket Ground, London on the 8th of October 2021. The Chairman, Scott Murray, welcomed everyone to the AGM and remarked upon how good it was to be able to finally have face to face meetings once again.

he Chairman reflected upon the last 18 months or so, when COVID-19 had impacted all our lives in such a big way, and where such things as, just getting staff to site while ensuring social distancing, had to be overcome. As well as policies, safe systems of work and risk assessments having to be written, implemented, and adhered to, just to facilitate access to site. One-way systems for personnel movement had to be considered to avoid congestion hotspots when planning transit and waste routes, and welfare areas had to be larger than normal and staggered breaks were a necessity. The Chairman then thanked Sam Lord of the Health and Safety Executive (HSE) for kindly speaking at the meeting. Sam’s presentation provided an HSE Update for members and focused on who does what within HSE as far as asbestos is concerned, HSG 248 The Analysts’ Guide and what’s new and relevant for licensed contractors, as well as an Asbestos Unit Update. Following this the Chairman introduced the Association’s Chief Executive, ARCA staff members and Committee Chairmen to report on the activities of the Association over the past 12 months and outline the plans for the future. Members present heard that the Association was resuming face to face regional meetings in November, and that remote training and assessments have been incorporated into the Association’s offerings. In fact, a blended approach was now being adopted for training and assessment delivery. Where remote

delivery is appropriate it provides a more convenient and accessible delivery method for members. Members were also informed that the Association had taken the opportunity to recruit more staff to deliver training, assessment and auditing services to meet the increased demand from members. Also, COVID has shown that the Association does not need operational staff to necessarily be based within reasonable travelling distance of offices, remote working can be utilised and is effective. As a national service is provided, having staff strategically located around the country provides a better service for members and a better work-life balance for staff. Those present at the meeting heard that ARCA has continued to develop the Asbestos Labour Feedback App, ALFA. This App allows member contractors to have advanced information regarding the competency and reliability of temporary labour they are considering using on their asbestos removal sites. ALFA was developed in response to members concerns regarding the quality of labour supplied and available. Members were told that after some initial issues with setting up accounts and registering users, the system seems to be working well. However, there does seem to have been a shortage of labour generally recently. The quality of labour may have suffered because of insufficient supply to meet demand during the notoriously busy summer period. Members were reminded that when ALFA was launched, many members had
asked if ARCA could develop a similar system for members to rate and record the competency of their own asbestos operatives. ARCA had always said that once the system for agency labour was working well, it would look to adapt the App for directly employed labour. The team has been working with the App developers, and a handful of full contracting members, to modify the ALFA system so that it now also works for directly employed labour. Members were informed that the system was now live with the pilot scheme members (page 10). Members were updated on the progress of another digital system being developed by ARCA, the Site Audit Portal. This is an online portal that members can log into and see all their site audit data and results. Conducting at least 3 audits per year on each full contracting member via the ARCA Site Audit App, generates a lot of electronic data. The Site Audit Portal will store, display and make available all the site audit data to each member company. It will allow the company to review and analyse the performance of their site teams. By logging into the portal, members will be able to see all their ARCA Site Audit Data, download the PDF reports, and create corrective action reports to close out any non-conformances. A limitation of the Site Audit App has meant that a completed audit report can only be forwarded to one email address within each member company. The Site Audit Portal will allow all authorised members of staff within a company to access the portal and view all the data and all the reports.

The Annual Awards were presented for achievements in training and for the site audit scheme. A Gold Training Award was awarded to 41 ARCA member companies that met the criteria and standards (page 33). The Supervisor of the Year Award was won by Aviaras Michnevicius of Alltask Ltd, and Fred Pienaar of Active Environmental Ltd was awarded a commendation (page 35). There were two winners of the Operative of the Year Award, and they were David Booker of LAR Ltd and Mitchell Hartrop of Phoenix (Leicester) Ltd (page 35). The ARCA National Training Award winner was Asbestech Ltd and Phill Neville accepted the award on behalf of the company.The Asbestech Ltd team achieved this with an impressive score of 94.6% with 30 individuals trained (page 37). The ATaC National Gold Training Award was awarded to Riverside Environmental with Jonathan Francis collecting the award on behalf of the company (page 37). A Gold Site Audit Award was presented to 41 member asbestos removal companies to acknowledge their consistent high performance on site. This award recognises not just one excellent audit in one year, but 6 consecutive excellent membership unannounced audits spanning up to 2 years (page 9). An Outstanding Achievement Award was presented to LAR Ltd in recognition of them achieving the ARCA Gold Site Audit Award for 10 years in succession. Bob Clarke accepted the award on behalf of the company (page 12).

he Chairman, Scott Murray of ECT Environmental Ltd, closed the meeting and stated that in his opening remarks of the meeting, he had asked when other members would start their ARCA journey?
The Chairman said that it would be nice if next year the Association could have some more new faces putting themselves forward for election to the Governing Council. He stated that the current Governing Council Members brought with them an abundance of both energy and commitment, and were diligent, enthusiastic and above all, professional. They only have the best interests of the Association and its members at the forefront of every decision made, and for that he was truly indebted.

Sam Lord of the HSE spoke at the ARCA AGM 2021
This article is a summary of the presentation which provided an HSE Update for members, focussing on the latest revision of ‘Asbestos: The Analysts’ Guide’, what’s new and relevant for licensed contractors, and an Asbestos Unit update.
Asbestos: The Analysts’ Guide The Analysts’ Guide (HSG 248) was published in July as an amended version from the one that was originally published in May. It’s a 240-page document and is very, very technical. The changes within the Analysts’ Guide really came about because of HSE undertaking the Analyst Inspection Programme and confirming suspicions that analysts were not always following good practice and inconsistent standards were being applied, as well as a lack of understanding. Chapter one focuses on the analyst’s role and responsibilities. We have suggested that there needs to be a bit more communication between the analyst and the removal contractor, to make sure that they both can plan and cost their work correctly, and do their own risk assessments, so anything that’s unusual, such as complex enclosures or asbestos that needs to remain in situ can be discussed in advance rather than on site. You will also see that there is more advice regarding the clearance process, particularly visual inspections, and there are increased auditing requirements. One of the changes, is the need to do a re-inspection of the stage two visuals. There has been some concern about this. Does it mean the whole clearance? What

if it goes on for 6 hours? It’s not about doing the whole 6 hours; it’s about doing a representative chunk of that re-inspection. So you might be seeing more auditing of analysts on site, and potentially it could take a little more time to do the clearance because of this. I don’t think it is going to put a lot of extra time on things, and at the end of the day this is all about improving standards. There’s a new template for personal sampling, which hopefully will improve the recording of contextual information and that’s in Appendix 6 of HSG 248. The handover form, which came out a couple of years ago, is mentioned in detail in the Analysts’ Guide, as is planning and scoping of the asbestos removal work, and obviously they are very relevant. The reason the handover form was introduced was that some enclosures were handed over insufficiently cleaned. The handover form also seeks to minimise the exposure of the analysts themselves, and to make sure that they don’t start the visual inspection and then have to come back out, and start the whole process again. It is an extra verification that the enclosure has been handed over and the supervisor has confirmed it is clean. There is a template of the handover form in the Analysts’ Guide for people to follow. I’d be interested to see or hear any feedback you may have about the handover form. Remember the handover form is not meant to be a tick box, it’s important that you understand the reasons for the handover form and that it is a double check before the clearance process can start. So, if a handover form is not
available it’s important not to just get one and tick all the boxes without confirming that the checks have been made. We are advising the analysts to record in writing when a form has not been given and to issue a fail if not clean enough. There have also been some changes to the 4-stage clearance. There’s a certificate of reoccupation which has more areas for contractors to sign off each stage. But more importantly, there is the estimation of the time that it takes to do the visual inspection. There is a table in HSG 248, with some example times based on some scenarios of asbestos removal jobs, such as AIB, a complex enclosure, spray coatings, asbestos insulation etc. The estimates in the table have come from data collected during UKAS audits. The table is not just designed to give people an idea of how long a clearance should take, but analysts are being told to build up their own database of how long clearances will take, this can then be used when they are quoting for the work and advising contractors of how long the 4-stage clearance is likely to take. Based on the information contractors give to laboratories at the planning stage, they can then tell you how long the proposed clearance is likely to take. Which is the reason this needs to be done at the planning stage. In addition to estimating the amount of time to conduct the visual inspection, analysts are also being asked to take photographs which document that the enclosure was clean or not as the case may be.
Asbestos Unit Update The companies who were first involved in the on-line assessment process are now looking to apply to have their licences renewed. Asbestos Unit are currently working on what the re-assessment process will look like. The intention is to have a stronger emphasis on the evidence collected during recent inspections of licensed asbestos work sites. They will also be interested in anything that’s changed since you last went through the renewal assessment process, and this needs to be flagged. Bear in mind the cycle will start again in April 2022, there is no set date for the introduction but, I would suggest it’s going to be reasonably soon.

his year ARCA presented a Gold Site Audit Award to 41 member asbestos removal companies to acknowledge their consistent high performance on site. This award recognises not just one excellent audit in one year, but 6 consecutive excellent membership unannounced audits spanning up to 2 years. “The meaning of the Gold Site Audit Award is very significant to member contractors and to end clients,” stated Steve Sadley, Chief Executive of ARCA. “This award shows that high standards and good practices are consistently maintained over a lengthy period of time and over various removal jobs, and of course all these audits are unannounced, so no warning of an auditor visiting site to review performance.” “Congratulations to all winners. This is a great achievement for all the members’ teams, both in the office and on-site.” Under the Association’s membership audit scheme, contractors must pass three satisfactory unannounced site audits each year to maintain membership. For the Gold Site Audit Award, asbestos removal contractor members need to achieve Grades A-C, with an average of at least a Grade B, in 6 consecutive membership audits. ARCA is committed to continue to drive high standards, so providing end clients with a strong level of reassurance.

New ALFA System
to Support Member Contractors Training Programmes On the 1st December 2021 ARCA announced the availability of a performance rating app for member contractors employed operatives. Following the successful development and use of the Asbestos Labour Feedback App (ALFA) for short-term operatives, this new ALFA system is now available to support member contractors in their internal training and development programmes This ALFA LARC Employees System is a stand-alone system for member contractors to use to rate and monitor their operatives’ performance on site as part of their internal training needs analysis (TNA) process. This ALFA system is a service ARCA is making available to all its asbestos removal contractor members, at no cost.
The ALFA LARC Employees System is a web-based application, provided by ARCA as a service to members to support training and development programmes. w Performance feedback – can rate an operative’s performance across nine categories, covering asbestos competency and behaviour, with all ratings used to calculate an overall performance rating. w Training Need Analysis – feedback from site supervisors can identify areas where an operative can improve, therefore supporting training and development. w Ratings can be requested at any time – the Training Manager can request a rating at any time from a site supervisor, and there is flexibility to rate an operative on a specific type of asbestos work, perhaps one they have not worked on recently. w Ratings can be scheduled – ratings for all employed operatives can be scheduled at set time intervals, for example every three months, and highlighted to the Training Manager when a rating needs to be arranged. Also, ratings can be scheduled per individual operative if required. w Comments with rating – there is the option to enable a comment to be included against a rating category. All comments are recorded for the Training Manager to review and set any actions required, such as refresher training. w Asbestos training – based on all individual ratings (minimum of two) on licensed work over the last 12 months, an operative could either undertake an operative refresher course or ARCA is offering an experienced operative refresher half day remote course, for those who meet the performance criteria (only available to operatives registered in ALFA). w Certificate management – certificate information is easy to input and copies of certificates can be uploaded, so all information is immediately available within ALFA. Also, certificates due to expire within 30 days are highlighted within the App so supporting renewal management. w Print overall performance rating per operative – when an operative has an overall performance rating this can be printed, showing the percentage rating per category and certificate information is included. Ideal for including in a site information pack.
LARC Employees System
w Automated system – ALFA provides an online system for employed operatives’ information, ratings and certificates to be in one App. This information, including ratings, can be download into an excel spreadsheet for analysis.
How does the ALFA LARC Employees System work? The main user of this system is the designated Training Manager, who along with an admin user, can input operatives’ information and certificates into the system. When it comes to scheduling ratings or arranging a rating, that is fulfilled by the Training Manager. Once a rating is requested in the system an email is sent to the relevant site supervisor informing for whom and when a rating will be required. Another email will be sent at the end of the day the rating is due requesting completion. The system is set that if one rating category is rated 3 stars or less an action will be automatically generated for the Training Manager to review and plan a solution, perhaps a toolbox talk or refresher training on that subject. Also, the Training Manager has the option to request a comment from the site supervisor per rating category. If training certificate information is inputted, ALFA enables this to be managed, as certificates are flagged when due to expire within 30 days, and can be produced to support planning and managing training requirements in a timely manner.
Asbestos Training for Operatives registered in ALFA When asbestos training certificate information for operatives is inputted into ALFA, the App will use the expiry date, together with the operative’s ratings, to review what refresher training this operative could undertake. This training information is made available to the Training Manager who can action accordingly. Following the CAR 2012 – Regulation 10 information, instruction and training (para 265), ARCA has two training options available for operatives who are registered in ALFA. “Refresher training for licensable and non-licensable work should be appropriate to the work the individual is doing. It should be based on a TNA which will inform the type of training needed. Dust Kills HSE cracks down hard on dust
D
uring October HSE’s inspectors across Great Britain targeted construction firms to check that their health standards are up to scratch, focusing on respiratory risks and occupational lung disease. This is part of HSE’s longer term health and work strategy to improve health within the construction industry. HSE looked at the control measures businesses have in place to protect their workers’ lungs from construction dust including silica, asbestos and wood dust. While the primary focus was on health during this programme of inspections, if
an inspector identified any other areas of concern, including immediate safety risks, they took the necessary action to deal with them. Inspectors were looking for evidence of employers and workers knowing the risks, planning their work and using the right controls. If necessary, they would use enforcement to make sure people are protected. More than 3,500 builders die each year from cancers related to their work, with thousands more cases of ill-health and working days lost. HSE’s chief inspector of construction,
Sarah Jardine, said: “Around 100 times as many workers die from diseases caused or made worse by their work than are actually killed in construction accidents. “Our inspection initiatives ensure that inspectors are able to speak to duty holders and visit sites to look at the kind of action businesses in the construction industry are taking right now to protect their workers’ health, particularly when it comes to exposure to dust and damage to lungs. These are mature health challenges that the industry ought to be managing effectively.“

Construction company fined for employee asbestos exposure

Properties (Northern) Ltd have been fined for safety breaches after employees were exposed to asbestos on 22 March 2019 after removing false ceiling tiles during a shop conversion at 309-315 Hessle Road, Hull. Beverley Magistrates’ Court heard that the company had not commissioned a refurbishment asbestos survey prior to the work commencing. Employees removed over 1000m2 of asbestos insulation board (AIB) ceiling tiles in an uncontrolled manner, exposing them to asbestos.
An investigation by the Health and Safety Executive (HSE) found that the company’s director, and the casual labourers they employed, spent approximately three to four weeks removing the suspended ceiling, along with the ceiling tiles which contained asbestos, to install new stud walls to divide the shop floor into separate units. The labourers were unskilled and untrained. They were provided with a claw hammer to knock the tiles down. The asbestoscontaining tile debris was then shovelled or collected into approximately 62 one tonne bags. MS Properties (Northern) Limited of Beckside Business, Beckside Road, Bradford, pleaded
guilty to breaching Regulation 5 of the Control of Asbestos Regulations 2012. The company has been fined £16,000, ordered to pay £3,011.87 in costs and a victim surcharge of £190. After the hearing, HSE inspector Trisha Elvy commented: “If the company had identified any asbestos on the site through a refurbishment asbestos survey, carried out by a competent surveyor, and had it removed by licenced asbestos removal contractors prior to the refurbishment work commencing, then MS Properties (Northern) employees would not have been exposed to asbestos. “No matter how small or large your company, there is a need to prevent exposing your employees and the public to asbestos by ensuring that it is identified on site prior to any work commencing.”

Packaging & Transporting Asbestos Cement Sheets for Disposal All asbestos waste is defined as ‘hazardous waste’ in England and Wales and as ‘special waste’ in Scotland when it contains more than 0.1% asbestos. The corresponding waste legislation is therefore subject to enforcement by the Environment Agency, Natural Resources Wales, or the Scottish Environment Protection Agency, as the case may be.
W
aste containing asbestos must be consigned under the relevant waste Regulations which include a “duty of care”. That duty of care means, amongst other things, that duty holders prevent escape of the waste whilst it is in their control. All movements must be accompanied by a hazardous/special waste consignment note. The Control of Asbestos Regulations 2012 (CAR 2012) also apply. Under ADR (The European Agreement concerning the International Carriage of Dangerous Goods by Road), some asbestos products are covered by ADR Special Provision 168 (SP 168) and are totally exempt from compliance with ADR and the Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations 2009 (CDG), as they are not regarded as dangerous for carriage, although the Hazardous or Special Waste regulations and CAR 2012 still apply. The exemption applies to waste which is either bound in cement, plastic, or another binder so that fibres cannot escape during carriage, or manufactured articles containing asbestos. Examples include asbestos cement sheets, drainpipes or vinyl floor tiles.
Packaging of large Asbestos Cement sheets Packaging for large asbestos cement (AC) sheets needs to have an Asbestos ‘a’ warning label in accordance with REACH (Registration, Evaluation, Authorisation and Restriction of Chemicals) Annex XVII, Appendix 7. There is a requirement to alert people that the package contains asbestos. For example, large AC sheets could be wrapped in polythene with an asbestos label applied, or a UN asbestos bag could be used as this has an Asbestos ‘a’ warning label on it. As AC roof sheets are a manufactured article, and therefore if they are damaged or have the potential to be damaged during carriage, they are still not subject to the requirements of ADR as SP 168 applies, providing they are packed so that no asbestos fibres can escape during carriage. There is no guidance within ADR as to what this packaging should look like, therefore CAR 2012 needs to be referred to.

guidance The Control of Asbestos Regulations 2012 states: (1) Every employer who undertakes work with asbestos must ensure that raw asbestos or waste which contains asbestos is not (a) stored (b) received into or despatched from any place of work, or (c) distributed within any place of work, except in a totally enclosed distribution system, unless it is in a sealed receptacle or, where more appropriate, sealed wrapping, clearly marked in accordance with paragraphs (2) and (3) showing that it contains asbestos. The Approved Code of Practice (ACoP) accompanying CAR 2012 provides guidance on how to package large items of waste such as AC: w 529 – Wherever practicable, large items of rigid ACM such as sheets of asbestos cement and textured coatings attached to a board should not be broken up or cut down for disposal in plastic sacks.
w 530 – The intact rigid waste should be double wrapped in suitable polythene sheeting (1000 gauge or equivalent) or other suitable material and labelled accordingly. w 531 – If the asbestos waste is not to be disposed of immediately, the wrapped package should be placed in a suitable and clearly labelled sealed receptacle, such as a lockable skip or freight container.
In summary CAR 2012 requires the employer to prevent or minimise exposure and spread of asbestos fibres, this includes handling, transportation, and final disposal. What does this mean for large quantities of intact AC roof sheets:
w Spread of fragments and dust must be minimised – either double wrapping individually in 1000 gauge polythene or placing in a suitable bag or a polythene lined skip or lorry. w Should be taken to a licensed waste facility. If going to a waste transfer station, AC sheets must be double wrapped in polythene or other suitable material, as people will be handling them.

w Must not be broken up for the purposes of waste disposal
If going straight to landfill, then the vehicle needs to be suitable to transport and tip at the face of the landfill – polythene lined skips and lorries are accepted, but waste must not be handled by operatives, it must be tipped in accordance with the site rules and procedures.
w Must be protected from damage during transport which could cause further spread (secured, contained in a metal skip or lorry with metal side panels to protect on 3 sides),
Note: a flatbed lorry would not be considered suitable as it provides no physical protection to the secured load at the sides, as provided by a skip or tipper truck.

Member Site Audit Portal Via a private portal members will be able to log in to view and analyse the results of their membership audits, as well as any additional audits booked through ARCA and internal audits undertaken using the Member Internal Site Audit App. A trend analysis graph of overall performance and the elements Plan, Do and Check, will allow members to be able to monitor progress, identify areas of good performance and any areas that may need attention. A list of priority actions will also be generated along with a mechanism to produce an Action Plan for any nonconformances. ALFA - Agency Operatives Therefore, to support asbestos removal members ARCA offers a Licence Renewal Preparation Service. To deliver this service, ARCA has a team of in-house experts with extensive knowledge in auditing and regulatory requirements, together with the experience of former HSE inspectors.
Bespoke Asbestos Training ARCA arranges bespoke training courses for members to cover specific topics which they may want to gain further knowledge on, whether it be air management within an asbestos removal enclosure or personal air monitoring. Courses can be held at an ARCA centre (practical facilities available), remotely, or if appropriate can be held at members’ premises.
Licence Renewal Preparation Service Being fully prepared to make an asbestos licence renewal application is vital for asbestos removal businesses. So too is asking for support early in the process. By asking for assistance early enough there is time to implement any suggestions, gather further evidence, as well as gaining a better understanding of the application process and how to submit evidence.
Guidance Notes ARCA publishes Guidance Notes on a variety of asbestos removal related subjects to assist in the practical application of legislative requirements, such as ‘Air Management in Asbestos Enclosures’ and ‘Provision of Welfare Facilities for Asbestos Work’. Currently there are eleven Guidance Notes available as free downloads on the ARCA website, as well as four guidance articles.
ALFA, the Asbestos Labour Feedback App, enables ARCA member licensed asbestos removal contractors to rate the performance and behaviour of operatives supplied by ARCA labour supply members. Launched in September 2020, ALFA, enables ARCA member licensed asbestos removal contractors to rate the performance and behaviour of operatives supplied by ARCA labour supply members. Having an overall performance rating for an operative provides the contractor with added reassurance of the competency of an agency operative. ALFA, a web-based application, provides benefits for all parties, including: reassurance of labour competence, training needs and certificate management, that is certificate information for operatives is available within the App, and certificates due to expire are highlighted, so supporting timely renewal.

Health and safety... demolition involving asbestos cement roof sheets
I
f a building contains any asbestos, it should be removed before any demolition work is undertaken in accordance with the Control of Asbestos Regulations 2012 (CAR 2012) and the Approved Code of Practice and guidance. Most higher risk work with asbestos must only be done by licensed contractors once they have notified the HSE. The person in control of the demolition job must make sure this has been done before starting any further removal or demolition works.
Notifiable work? Demolition involving asbestos cement sheets is not licensed work - providing the 4-hour and 10-minute control limits are not exceeded - but it may be notifiable to HSE. An employer needs to decide before starting work whether it is notifiable. To do this they will need to consider the task(s) to be undertaken, and the nature and condition of the material. That is, each job must be considered on its merits but, in general, removal of individual sheets intact by hand will not be notifiable as notifiable non-licensed work (NNLW). However, remote demolition by machine involving deliberate breakage of sheets and the consequent potential release of, and exposure to, asbestos fibres will be notifiable as NNLW.
To choose the most suitable removal method, demolition contractors have to weigh up the following factors: w the exposure of worker(s) to asbestos fibres w contamination of the surrounding environment by asbestos dust and, in particular, exposing anyone downwind of the site to asbestos fibres w the risk of falling, especially through the asbestos cement roof w how difficult the asbestos is to access w the condition of the asbestos w whether the sheets can be removed intact or nearly intact. For NNLW employers have additional requirements: w to notify work with asbestos to the relevant enforcing authority w to make sure medical examinations for removal workers are carried out w to maintain registers of work (health records).
Risk of exposure and contamination Asbestos cement is a grey, hard, brittle material normally containing 10–15% asbestos fibre. It is a dense material, with a density greater than 1 tonne/m3 and when soaked in water for at least 15 minutes it will absorb less than 30% of its own weight of water, as the asbestos fibres are tightly bound with cement.
Therefore, to release the asbestos fibres from the asbestos cement, the material needs to be aggressively abraded. Activities such as sawing, drilling, wire brushing or crushing the material by tracking back and forth with heavy machinery, are likely to produce dust containing asbestos fibres if the material is dry. Any material containing more than 0.1% asbestos is classified as ‘hazardous waste’ and can be carried on the road only by a registered waste carrier consigning it to a licensed asbestos dump. In England your local Environment Agency area office ( SEPA in Scotland or NRW/CNC in Wales) will be able to advise on disposal. Note that the 0.1% asbestos content definition within environmental legislation relates only to classification for transport and disposal. It does not relate in any way to the danger from exposure to asbestos fibres during this work.
Risk of falling Many asbestos cement products (such as roof sheets, slates, cladding, downpipes and gutters) are located at height and are fragile, and therefore present a risk of falls. Also, asbestos cement sheet is a fragile material in accordance with the test for nonfragility of large element roofing assemblies.

guidance How to demolish? Method 1 – by hand Demolition by hand is the preferred option due to the higher potential for asbestos fibre release and the need for clean-up of debris from remote demolition. When working with asbestos-containing materials, there must be a written, adequate and sufficient risk assessment. Workers must be correctly supervised, trained, and understand and follow the method statement to which they will be working. They must have a thorough knowledge of the materials, equipment and tools they will be using, all in accordance with the ACOP Managing and working with asbestos L143. If the asbestos cement sheets are in reasonable condition and a safe access and a safe work surface is provided, then take the sheets down whole – do not drop or damage them. Remove the sheets from underneath using MEWPs (e.g. scissor lifts or cherry pickers). Bolts, or other fasteners which hold the sheets, should be removed by careful cutting from underneath where possible using bolt cutters or mechanically undone. Some bolts may have to be cut from above. Lower the sheets to the ground. The sheets are best disposed of by careful transfer to lockable lorries or skips, or by wrapping intact in heavy-duty sheet plastic. Method 2 – remote In some circumstances remote demolition by machine, such as pusher arm or deliberate controlled collapse, is necessary (e.g. if the asbestos sheets are in poor condition and liable to break when handled, or if safe access cannot be provided and the risk of falling is too great). Remote demolition should give rise to personal fibre levels of less than 0.1 f/ml. Cleaning up dry dust and debris has the potential for elevated fibre levels so dust suppression and other control methods and respiratory protective equipment (RPE) will be required. To reduce the potential for airborne and physical spread of dust and fibres and
exposure for others, contractors should take precautions including the following: w Carry out and complete the work before demolishing the rest of the structure w Segregate the work area and keep out unauthorised personnel w Keep the ground clear of other items and materials w Keep the material wet with gentle spraying w Remove waste and debris from the site by hand as soon as possible to prevent it being disturbed, e.g. by moving vehicles. If you cannot remove the material immediately, cover it with heavy-duty polythene. w Take care not to drive plant over asbestos cement sheet w Pick broken asbestos cement sheet by hand where possible. If you are gathering it by mechanical means wet it well to minimise fibre release. Do not bulldoze it into a pile. Do not use toothed buckets. w Place any fine debris or waste liable to generate dust in suitable closed containers. Larger pieces of asbestos cement are best disposed of by careful transfer to covered lorries or skips w Label containers for asbestos waste (e.g. bags or skips) correctly and dispose of them at a licensed waste tip w Carry out perimeter air monitoring for reassurance purposes to ensure that there is no spread of asbestos fibres outside the work area.
Personal protective equipment PPE and RPE should be worn by all workers physically involved in the removal and cleaning-up activities. RPE must be suitable and adequate; for example, disposable masks rated at FFP3. Also, workers should be fit-tested for the RPE and males should be clean-shaven when wearing it. Workers should be provided with disposable overalls; these should be safely disposed of with the masks as hazardous waste at the end of every shift.
RPE will not be necessary for enclosed vehicle cab operators where cab air is filtered, and windows and doors are kept closed.
Training All those who carry out any work on asbestos materials must be trained and supervised properly. Training is needed even if you have worked with asbestos in the past. Training must include detailed information on: w recognising asbestos w how asbestos can affect your health w the added dangers of smoking w the uses and likely locations for asbestos in buildings w what work you are allowed to do by law w what the law requires you to do w what methods to use w what equipment you need to do the job properly w how to choose, use and look after PPE w recognising and dealing with other dangers, such as work at height w decontamination of yourself and work areas w emergency procedures w waste disposal Refresher training is needed every year or more often if: work methods change, the type of equipment used changes or the type of work changes a lot. Remember to always supervise the task – make sure workers follow the rules.
Public concerns To members of the public the remote method appears noisy, dusty and often uncontrolled. People are often concerned about this type of demolition when they know or suspect the building was roofed or clad with asbestos cement. To alleviate concerns, contractors are advised, keep the neighbours informed about the work, consult the local environmental health department and carry out regular airborne monitoring downwind of the site. What are your initial thoughts about CITB funding and grants? It’s the second time I’ve made a funding application and I found the spreadsheet application process much simpler and a lot more user friendly, than the previous process. There were no issues.
Were you filling out the application with me on the briefing? Oh yes. I filled in the basic information beforehand, as you had forwarded a copy, and then I completed the remaining boxes live with you in the briefing session. I sent the completed form back to you to check before finally submitting to CITB. They replied by email to say they had received the application and then 3 weeks later I received an email telling me that the application was successful.
So literally, you completed and sent the form off in 1 day? No, it was less than that, an hours work at most.
An important question for me, was the briefing helpful to you? Yes, really helpful. It was easy to follow. You sent out the form beforehand and I completed what I could, and then followed you filling out an example form. So really, really easy to follow.
Were you successful first time with your application? Yes. That’s brilliant, well done. It’s good you didn’t get any additional questions or queries. Yes. When I completed the form, you checked it over and I sent it to CITB the same afternoon. Then 3 weeks later CITB told me the application was successful and that funds were allocated.
If you don’t mind me asking, did you get the full amount you applied for and how much was it? Yes. We got the full amount asked for, £4,826.
Before attending a briefing, did you know the difference between CITB Grants and Funding?
How is that funding going to make a difference to the team at ARG?
I had a basic understanding of it, as I attended a CITB seminar 3-4 years ago where they explained you could get funding for courses. However, this session helped simplify the process.
We are going to use it for NVQs for Supervisors and Operatives. As an industry we’ve all had a long 18 months and any additional funding available is a welcome addition.
How did you find out about ARCA helping members with CITB Funding? The first time I heard you were helping members with funding applications was during an ARCA online regional meeting. You said that there was a CITB grants and funding briefing back in January, but with one thing and another I didn’t get it sorted till later. I emailed ARCA in August to ask if there was another session planned and was booked onto a briefing a couple of weeks later.
What advice would you give members who that are eligible as CITB levy payers? Attend a briefing. It’s easy and self-explanatory. As you’re paying the CITB levy it’s important to get some of the funding back to help the business and staff development. That’s what its there for! Thank you, Victoria for taking the time to speak with me. Hopefully you and ARG will be applying for funding again in the future.

Own or manage premises?
You have legal responsibilities to manage asbestos If you are an owner or a manager of non-domestic properties, or residential rented properties with common areas, constructed prior to the year 2000, you have the duty to manage the risks from asbestos. You are responsible for ensuring that employees and non-employees are not exposed to health and safety risks as a result of the presence of asbestos. You have legal responsibilities by virtue of the Health and Safety at Work etc. Act 1974, the Control of Asbestos Regulations 2012 (CAR 2012), and the Construction (Design and Management) Regulations 2015 (CDM 2015).
Locate, Assess and Manage Regulation 4 of the Control of Asbestos Regulations 2012 (CAR 2012) is a specific legal duty to manage asbestos in non-domestic properties (including the common parts of domestic premises, such as halls, stair wells and roof spaces). This regulation requires the duty holder to identify the location and condition of asbestos, to assess the risk, e.g. if it is likely to release fibres, and make a plan to manage that risk. To meet this, the duty holder can assume all materials present are asbestos and manage the premises accordingly or arrange for a thorough inspection in the form of an asbestos survey. This survey is carried out to locate, as far as reasonably practicable, the presence and extent of any suspected asbestos containing materials (ACMs) in the building. Also, the type of ACM (e.g. asbestos insulating boards – AIB), amount and condition. The asbestos survey can be carried out by in-house personnel or a third party, as long as they are competent to do so (e.g. a UKAS accredited surveying organisation). The information from the survey should be recorded, a document referred to as an asbestos register. This should include accurate drawings and be dated, and be periodically reviewed so an up-todate record is available on the location and condition of all ACMs. Following this, the duty holder should produce a management plan, setting out how the risks identified from asbestos will be managed, and the duty holder should ensure that the plan is implemented so the risks are properly managed. Communication of this information is vital. The duty holder, should make sure that the asbestos register is shared with any worker/contractor carrying out maintenance or other work on/in the premises.

Appoint, Plan and Remove Clients have specific responsibilities on managing construction projects under CDM 2015, and when asbestos removal is required the client needs to appoint a competent asbestos removal contractor. Therefore, they need to make reasonable enquiries to satisfy themselves that contractors are appropriately resourced and competent for the work. To provide reassurance of compliance with relevant legislation, and to support members’ performance and therefore maintain standards, ARCA introduced a membership audit scheme in 2000. Whereby, ARCA carry out independent audits (on-site verification inspections) of ARCA member asbestos removal contractors. What does this mean today? To join the Association a licensed asbestos removal contractor is initially required to complete one satisfactory site audit and an office audit. Then member contractors have their performance on site audited three times a year, with the audit criteria following the ‘Plan, Do, Check’ approach to health and safety management. Member contractors need all three site audits to be satisfactory to maintain membership and with all audits being unannounced they have no prior warning of a visit from an ARCA auditor(i). Being unannounced(ii), the audits qive a more representative view of the contractor’s day to day performance, so providing an even stronger system of reassurance for clients. Once a contractor is appointed, the client will need to provide the contractor with sufficient information, time and resources to do the job properly. For example, an asbestos removal contractor will need appropriate pre-construction information in order to prepare a suitable Plan of Work (PoW) and discuss key site information with the client. The work must be planned before it starts. For licensed asbestos removal work, the contractor needs to submit notification of work to the Health and Safety Executive (HSE) two weeks prior to work commencing. The licensed asbestos removal contractor has a duty to produce a suitable PoW. It should be a practical and useful document describing the site, location of asbestos, access and waste routes, etc. so providing a safe working method for site staff to follow. The contractors’ manager should create the PoW with the client, so both parties are aware of any site constraints, other trades on-site, etc.
Finally, a PoW is there to primarily support site staff, but should also be available for the analyst, manager, auditor, HSE inspector and client.
Clean, Test and Re-occupy After asbestos has been removed, there is a testing procedure prior to the building, or part of the building, being re-occupied. This is the ‘4-stage re-occupation test’, a series of tests/stages, which is a legal requirement under CAR 2012. Before starting the ‘4-stage re-occupation test’ a signed handover form should be obtained by the analyst from the licensed contractor confirming that the work area/enclosure has been thoroughly cleaned and the area has been inspected and is visually clean. After reviewing and accepting the handover form, the analyst must sign and date before starting the test. All four separate tests or stages need to be carried out by a qualified analyst employed by a laboratory accredited by UKAS for conducting the tests. The four stages are: Stage 1 – Preliminary check of site condition and job completeness Stage 2 – A thorough visual inspection Stage 3 – Clearance air monitoring Stage 4 – Final assessment post-enclosure / work area dismantling Once the ‘4-stage re-occupation test’ is completed and all stages have met the required standard, a re-occupation certificate will be issued by the analyst to both the licensed asbestos removal contractor and the end-client. This certificate confirms that the building, or a specific part of the building, is fit for re-occupation.

Are your employees burnt out? Spotting the signs & what to do about it
R
ecently, to mark World Mental Health Day, Howden launched a guide to help employers spot the signs of burn out amongst their employees and take action to support them. The World Health Organization (WHO) defines burnout as “a syndrome conceptualised as resulting from chronic workplace stress that has not been successfully managed” – a definition which puts the responsibility firmly on employers and managers. The HSE reported that in 2019/20, the number of employees dealing with workrelated stress, depress or anxiety had risen significantly compared to the previous 12 months. Howden highlights that the pandemic has raised the stress levels for many people who have had to deal with additional pressures such as home working, juggling home schooling and work, health and financial worries and social isolation. For some this has created mental health issues for the first time and exacerbated existing conditions for others. As more people return to the office this Autumn, Howden is urging employers to step up their mental health support and ensure line managers are trained to spot early warning signs that people are struggling so they can support them. Mark Fosh, Director of SME at Howden said, “Having a workforce that is physically and mentally well is essential for a company’s culture and performance. The World Health Organisation has estimated that depression and anxiety could cost the global economy US$1 trillion per year in lost productivity. The Mental Health Foundation[i] highlights that 70 million working days are lost every year due to mental health problems, costing UK employers approximately £2.4 billion per year. If employees are burnt out, they are likely to take extended sick leave and have
very low morale which may affect their colleagues. So, being able to spot employees who are suffering from poor mental health and putting the right interventions in place could prevent issues from escalating.”
So where should employers’ start? Howden’s guide includes the following advice for employers:

Invest in training – train line managers on how to spot the signs of mental health such as employees who are behaving differently and may be tearful, frustrated, angry, lethargic, and absent from work more frequently so they can provide support early on. Many employers are training people to become Mental Health First Aiders, who can offer practical support to employees.
1. Talking – having regular conversations about mental health with employees and highlighting what support is available, is a good start. It can be hard for people to open up about mental health and this can help to remove the stigma.
7. Improving employee engagement – ensuring employees have regular opportunities to voice their concerns. Communicate the range of employee benefits on offer, so people know what is available and how to access it when they need it.
2. Providing access to counselling – this can help employees better understand and manage their condition. The NHS offers a free counselling service, so do several charities. Bereavement care, relationship advice and victim support are all available.
8. Developing Wellbeing Recovery Action Plans – employers can implement a plan with managers and employers when a mental health condition is identified. It allows line managers to help employees – and employees to help themselves
3. Promoting your Employee Assistance Programme (EAP) – Most UK employers offer some kind of EAP as part of their Group Health or Group Income Protection Insurance. EAPs are designed to support the physical mental and financial wellbeing of employees. These often provide access to both telephone and face to face counselling.
9. Checking insurance policies to see what services are offered – Critical illness and Group Income Protection Policies often offer a range of services that provide mental health support for your employees when they need it most. If you don’t currently offer any employee benefits, then now is a good time to speak to a consultant to find out what is available and can best support the specific needs of your business and workforce.
4. Use free services – Mind, the mental health charity has lots of free resources which can be shared with managers and employees. This includes guidance for managers on how to support staff who are experiencing mental health issues. 5. Making reasonable adjustments at work – An employee suffering with mental health issues has the legal right to ask for changes to be made to their job or workplace. Simple changes such as working from home, managing their workload, or taking more breaks can really help.
10. Lastly, use days like World Mental Health Day as a reason to talk about mental health and signpost the support available and the fact that as employers you are there for your staff. ARCA Gold Training Awards Winners for 2021 At the Association’s AGM in October the winners of the ARCA Gold Training Award for 2020/2021 were announced.

ongratulations to the 41 member companies who achieved this award and to the candidates for achieving the high average scores required. “The last 18/24 months have been challenging for all, so it’s great to see so many of our members gain the ARCA Gold Training Award this year,” commented Satish Patel, Training Manager for ARCA.
