Lanao del Norte town to host 6th Organic Asia Congress

KAUSWAGAN, Lanao del Norte (MindaNews / 21 May)

— The once war-torn town of Kauswagan, Lanao del Norte will host the 6th Organic Asia Congress together with the International Federation of Organic Agriculture Movement (IFOAM) Organics Asia.

The convention will take place on June 4-9 at the five-hectare Kauswagan International Organic Convention Center in sitio Tangkig, a coastal village in Barangay Tacub.

Mayor Rommel C. Arnado, National President of League of Organic Agriculture, Municipalities, Cities and Provinces (LOAMPC) said the congress will focus

on organic agriculture and production of healthy food to attain food security as a key to world peace.

Arnado said over 2,000 participants, including 251 foreign delegates from 35 countries, will attend the event.

He said Interior and Local Government Secretary Benjamin Abalos Jr., had instructed all local chief executives to participate in the convention to promote organic agriculture in their respective communities.

He said only 200 local government units, including Kauswagan, are currently adopting organic agriculture.

Heavy equipment for illegal mining along Iponan River passed through 3 upland barangays in CDO

Cuenca declined to name the officials but identified the three barangays as Tumpagon, Pigsag-an and Tuburan, which share a common border with the municipality of Opol in Misamis Oriental.

He said in order to reach the mining sites, the miners have to use the roads of the three barangays since there are no roads from Opol town to Iponan River.

Confiscation of license plates prohibited: LTO chief

MANILA – The confiscation of license plates or "baklas plaka" when vehicles are apprehended is prohibited, Land Transportation Office chief Jay Art Tugade said Friday.

Tugade issued the reminder to LTO enforcers and deputized agents after receiving complaints from the public, citing Joint Administrative Order No. 2014-01.

"In all cases where the penalty includes the confiscation, suspension or revocation of a driver's license or student permit as well as the suspension or revocation of the registration of a motor Vehicles along

vehicle or impounding the motor vehicle, and the same cannot be immediately implemented, the driver's license, the student permit, or motor vehicle as the case may be shall be put on alarm until the proper penalty may be implemented," the order read.

In a news release Friday, the LTO said Tugade issued a memorandum prohibiting the confiscation of license plates.

He said LTO enforcers and deputized agents should not remove the licensed plates unless the apprehended vehicles are impounded.

Q2 nat'l simultaneous quake drill set June 8

MANILA – The Office of Civil Defense (OCD) announced on Friday that the National Simultaneous Earthquake Drill (NSED) for the second quarter of this year would take place on June 8.

In its post on its Facebook page, the OCD said the event would take place at 9 a.m.

It called on the public to participate in the drill, which targets to reduce casualties should a major earthquake strike the country.

“Sabay-sabay tayong mag-duck, cover, and hold dahil Bida ang Handa (Let us all simultaneously do the duck, cover, and hold because it is cool to be prepared),” the OCD said.

The first quarter NSED took place on March 9 with a magnitude 7.2 earthquake as the scenario.

The OCD earlier reminded the public to observe the following steps or protocols when an earthquake occurs:

• When inside a building, stay calm and do the “Duck, Cover and Hold”;

More fishers in Bataan train to become Bantay Dagat volunteers

DO, Pampanga – Seventy more fisherfolk in Bataan province have joined efforts to help the local government units protect marine resources in their respective coastal waters as well as stop illegal fishing activities.

Wilfredo Cruz, regional director of the Bureau of Fisheries and Aquatic Resources in Central Luzon (BFAR-3), on Thursday said fishers from the towns of Orion, Samal and Mariveles are undergoing a two-day Fisheries Law Enforcement Training (FLET) training in order for them to be deputized as Bantay Dagat volunteers.

importance not only in the food security but also their big contribution in the intensified fight against illegal, unreported and unregulated fishing or IUUF),” Cruz said in an interview. He said the training is geared towards providing fisherfolk with the necessary legal, logistical and technical skills through lectures on national and local fisheries laws, vessel identification, detection of fish caught by explosives, conducting

warrantless arrest and seizure and basic skills in completing legal forms.

Last month, some 40 fishers from the towns of Hermosa, Orani, Abucay, Balanga, Pilar, Limay, Bagac, and Morong have undergone similar training to become deputized fish wardens.

Aside from Bataan, BFAR-3, together with the Office of Provincial Agriculturist, also conducted the same training in Zambales and Aurora where fishing is one of the

major sources of livelihood.

“Their volunteerism is for the betterment of not just their communities but of their local environment,” Cruz said earlier.

The Bantay Dagat is a community-based law enforcement program that engages fisherfolk in coastal villages or barangays on a voluntary basis to support the detection and enforcement of antiillegal fishing policies in the coastal waters. (PNA)

DepEd-Bicol presents learning recovery program to lawmakers

of the Department of Education in Bicol (DepEd-5) on Thursday met with members of the Second Congressional Commission on Education (EDCOM II) for a consultative meeting on the implementation of the Learning Recovery Plan (LRP) at the Senate in Pasay City.

In a statement on Thursday, DepEd-5 regional director Gilbert Sadsad said being the first region to develop and implement the LRP, Vice President and Education Secretary Sara Duterte has chosen DepEd-Bicol to represent the agency and to discuss before the EDCOM II the region’s LRP initiatives including the results of the initial assessment of its

8-week Learning Recovery Curriculum (LRC).

“Our region applauds the new administration of Vice President and DepEd Secretary Sara Duterte for giving priority to learning recovery by ensuring that learning gaps are identified and addressed among all learners, especially the most vulnerable ones through the extensive implementation of the Learning Recovery and Continuity Plan (LRCP),” Sadsad said.

The late DENR Secretary Gina Lopez was absolutely correct when during her stint as Secretary, she courageously stopped without fear or favor the digging or drilling and blasting to remove resource or ore/minerals aptly called open-pit mining. As a passionate environmentalist sui generis, illegal mining and open pit mining operations must be stopped with sense of urgency. Then Sec. Lopez understood very well that the illegal mining and open-pit mining was the number one culprit on why our fishery and marine resources were rapidly vanishing.

The massive digging or drilling and blasting in the uplands through open pit mining had caused thousands if not billions of tons of soil to be carried by the rivers to the sea which had destroyed sea life. Of the 13 major bays in the country, 10 are already biologically dead; of the 25 major rivers, 15 are already dried-up or silted. Seventy-five per cent of our mangroves, the spawning ground of fish, are already totally destroyed and only 5% is in excellent condition. Gone are our corral reefs, the finest on earth.

Well, the final death blow to our fishery and marine life will happen if we allow open-pit mining as already banned by then Sec. Gina Lopez during her term. As legally defined, open-pit mining is “an opencast or open cut mining and in larger context mega-mining, a surface mining technique of extracting rock or minerals from the earth from an open air-pit known as borrow.” Knowing that alone will already give us a concrete picture on the massive destruction of our mountains which were once the forest ecosystem in an archipelago oozing with marine life. Subjecting these denuded mountains to open-pit-mining means no way can we regain back our ecological integrity. Thus, after the massive devastation and exploitation of the wealth above the ground, i.e., dipterocarp forests, agricultural lands through conventional agriculture which massively is using toxic chemicals in the 200,000-ha. plantations in Mindanao that have already polluted the watersheds, the focus now is how to extract ecological wealth under the ground, i.e., gold, ores, minerals, etc. through open-pit mining. For what? To supply the mineral needs of the people in advanced and powerful countries? Well, I will not be surprised.

It is quite a pity that while the Philippine Archipelago has been described before by the President of the UN-FAO, Dr. Kent Carpenter, as “the Center of the center of marine life on earth,” but such wealth had vanished in a “wink of an eye.” Let us reflect for a while what happened. It was then the period of Martial Law when Japanese trawlers were massively raking our seas called “Muro-Ami,” then processed and canned the fishes caught and sold to us. After Martial Law period, our archipelago, too vast to guard by our Naval Force, became a “dumping ground” of toxic wastes by advanced countries like Canada, Australia and

South Korea. Despite these horrendous death blows to our archipelago, what remains of our marine life is being taken advantaged by China as the West Philippine Sea is now the subject of massive raking by well-guarded Chinese vessels, in gross violation of our sovereignty, as stated in the United Nations’ Arbitral Ruling.

The Philippines is an archipelago of some 7,100 islands, oozing before with fishery and marine resources that were only found in our country. Our land resources are even richer with billions of megadiversity living in the 17 million hectares of dipterocarp forest.

In 2015, as presiding officer of “Task Force Kinaiyahan” in pursuance of the “Writ of Kalikasan” issued by the Court of Appeals in 2013 to stop illegal logging and illegal mining operation in Northern Mindanao, we were so aghast during our operation against illegal mining in the uplands of Cagayan de Oro to see in the campsite of illegal miners, AK-47, Armalites and grenades. The law enforcers, the core group of Task Force Kinaiyahan, who were with us, arrested three Chinese citizens who were only tourist-visa holders, doing open-pit mining operations in the uplands of Cagayan de Oro.

Some of the things it brought up I hadn’t found anywhere online. I was actually surprised about how it was able to give me information that wasn’t widely available and a different

perspective.

Since ChatGPT, a powerful, freely available AI software capable of writing sophisticated responses to prompts, arrived on the scene last year, it has prompted intense speculation about the long-term repercussions on a host of industries and activities.

But nowhere has the impact been felt more immediately than in education. Overnight, rather than labor through traditional exercises designed to develop and assess learning, students can imply instruct a computer to compose essays, answer math questions or quickly perform complex coursework assignments and pass the results off as their own.

Hundreds to join anti-drug run in NegOr capital AGGIE NEWS:

DA-NorMin distributes P62.520-M hybrid rice seeds, pilots digital monitoring system

In time for the wet cropping season, the Department of Agriculture in Northern Mindanao (DA-NorMin) held its Wet Season Rice Seeds Distribution Caravan in Valencia City, Bukidnon and in the town of Lala, Lanao del Norte.

With the cooperation of the local government units(LGUs), DA-NorMin distributed a total of 12,504 bags of hybrid rice seeds worth P62.520-million to bonafide rice farmers in said localities.

The rice seeds subsidy is seen to benefit not less than 2,500 rice farmers for the cultivation of 12,504 rice fields planted for hybrid rice.

For effective and efficient monitoring of the distributed rice seeds, the agency also piloted

the Rice Seed Monitoring System (RSMS), a digital monitoring mechanism developed by the Philippine Rice Research Insti-

tute (PhilRice).

According to DA-NorMin Regional Executive Director, Carlene C. Collado, the RSMS allows the

agency to easily gather, consolidate, process and analyze accurate and near real-time data in terms of positioning and distribu-

tion of DA-subsidized rice seeds for rice farmers in the region.

“The advent of the RSMS is DA’s latest at -

tempt at scaling up our Rice Program implementation. With the help of the system, we will be able to make strategic and timely calls for policy implementation to bolster our rice production capacity at the regional level,” Collado remarked.

The RSMS also provides for the LGUs’ active role as DA’s partners in dispensing and monitoring the utilization of DA-granted rice seeds.

At their capacity, the LGU shall collect and transmit to DA ground data relative to the rollout of the rice subsidy.

Ayala demonstrates growing presence in Central Luzon with relaunch of WeAreAyala Business Club

PORAC, Pampanga -- Ayala

Corporation Chairman Jaime Augusto Zobel de Ayala led the relaunch of the WeAreAyala Business Club (WAABC) Central Luzon, a community of Ayala group employees seeking to promote the greater good of stakeholders in the region.

Present in key business centers across the country, WAABC has chapters in Baguio, Central Luzon, Naga, Cebu, Negros, Iloilo, Cagayan de Oro, and Davao. The chapters aim to engage local stakeholders; strengthen business units' synergies; and promote the Ayala group culture among employees.

Festival showcases richness of Davao Sur town’s caves

MATANAO, Davao del Sur –

To showcase this town’s natural resources, the local government opened the Cave Festival 2023 here Thursday.

In an interview, Mayor Vincent Fernandez said the three-day festival, which runs until May 20, includes such activities as cave and photo exhibits, mural painting, tree planting, and cave exploration.

“We want the public to know that we have these beautiful caves. We have around 60 to 70 caves that are still unexplored,” he said.

“More jobs will be made available since we will be opening inns, boutiques, restaurants, shops, and others,” he said.

Meanwhile, the mayor also urged the residents of the mountainous areas to stop cutting trees to prevent erosion.

“We will assess and provide them their livelihood,” he said.

Cave country

Clover Jane Sabornido, Matanao tourism office head, said they are poised to become the “cave country” in the province, based on the DENR assessment.

She said they are relying on the DENR approval since the agency is the only authorized body to assess and provide the cave management plan.

“If the DENR approves, that’s the time the Department of Tourism would come in. Every cave has three years of preparation before it will be open to the public,” she said. (PNA)

“On record is a Motion for Leave of Court to Effect Service of Summons by Publication filed by the plaintiff and it appears from the Sheriff’s Return of Summons that defendant Jossie Fe A. Estavas-Tionko and Albien A. Estavas’ whereabouts, cannot by diligent inquiry be ascertained, as prayed for in the Plaintiff’s aforesaid motion, let summons by publication be served upon defendants JOSSIE FE A. ESTAVAS-TIONKO AND ALBIEN A. ESTAVAS in a newspaper of general circulation, once a week for three (3) consecutive weeks in a local newspaper and plaintiff is directed likewise to send copy of this order, summons, and complaint to the defendants to their last known address.

Meanwhile, the defendants are given sixty (60) days after the completion of the last publication of summons to file with this court their Answer to the complaint filed against them in the above-captioned case..

WHEREAS, Complaint reads:

C O M P L A I N T

(With Urgent Prayer for Issuance of Writ of Possession)

Plaintiff, National Grid Corporation of the Philippines (NGCP), by counsel, respectfully states that:

1. Plaintiff is a private corporation created and existing under Philippine laws, with principal office address at NGCP Building, Quezon Avenue corner BIR Road, Diliman, Quezon City. It may be served with notices and other court processes through its Right-of-Way Department (ROWD) – Mindanao Division, Maria Cristina, Iligan City, copy furnished the aforementioned principal office.

2. Pursuant to Republic Act (R.A.) No. 9511, plaintiff was granted a franchise to operate, manage and maintain, and in connection therewith, to engage in the business of conveying or transmitting electricity through a high-voltage back-bone system of interconnected transmission lines, substations and related facilities, systems operations, and other activities that are necessary to support the safe and reliable operation of a transmission system and to construct, install, finance, manage, improve, expand, operate, maintain, rehabilitate, repair and refurbish the present nationwide transmission system of the Republic of the Philippines.

3. Under Section 4 of the same law, plaintiff was granted the power of eminent domain, subject to the requirements of the Constitution and existing laws.

4. Plaintiff is engaged in the business of transmitting electric power from the generating plants of power producers to distributors. As such, plaintiff’s business is imbued with public interest.

5. To address the country’s growing power demand and ensure continuous, reliable and efficient power supply, there is a need to interconnect the three (3) major power grids of Luzon, Visayas, and Mindanao into a single national grid. Aside from the sharing of systems reserve, the interconnection will also help optimize utilization of indigenous energy resources such as natural gas in Luzon, geothermal in the Visayas and hydro in Mindanao. Owing to this necessity, plaintiff must immediately construct the transmission lines that will transmit power to distributors of electricity not only in Mindanao but also in Luzon and Visayas. This undertaking is for the use and benefit of the public and part of it is known as the MINDANAO-VISAYAS INTERCONNECTION PROJECT (MVIP) , integral part of which is the KAUSWAGAN-LALA 230kv TRANSMISSION LINE PROJECT (Project).

6. The said MVIP of NGCP is the first project certified by the Department of Energy (DOE) as an Energy Project of National Significance (EPNS ) pursuant to R.A. 7638 of DOE Act of 1992, as amended, entitled to all the rights and privileges provided under Executive Order No. 30, series of 2017, as evidenced by the Certification dated 8 May 2018 issued by the Energy Investment Coordinating Council. Hence, the immediate completion and energization of the said project is critically important.

7. Defendants HEIRS OF JAIME G. ESTAVAS, namely: Emmanuel A. Estavas, Esmeraldo A. Estavas, Ma. Ione A. EstavasLongcob, Jossie Fe A. Estavas-Tionko, and Albien A. Estavas, are all of legal age and Filipinos. They may be served with summons and other processes of this Honorable Court at their respective address indicated below opposite their names, viz:

Considering that the whereabouts and specific addresses of defendants Jossie Fe A. Estavas-Tionko and Albien A. Estavas cannot be ascertained despite diligent inquiry, plaintiff undertakes to cause the service of summons to her by publication pursuant to Sections 16 and 17, Rule 14 of the Rules of Court.

8. Plaintiff intends to expropriate portion of a parcel of registered land identified as Lot No. 1943-A-1, PSD-10-057960 situated in Brgy. Pange, Baroy, Lanao del Norte. The said property is registered and declared in the name of the late Jaime G. Estavas married to Clarita Abadiano, per Transfer Certifcate of Title (TCT) No. T-25,944 and Tax Declaration (TD) No. H-130191 (03), respectively. It is more particularly described below together with the affected area sought to be expropriated consisting of 275 square meters, as shown in the attached Sketch Plan and Technical Descriptions, as follows:

with the filing of the instant Complaint, a Notice to Take Possession (attached as Annex “A”) upon the defendants.

15. To comply with the deposit requirement, plaintiff, notwithstanding that R.A. 10752 does not specifically apply to it, shall deposit with the Honorable Court an amount equivalent to the 100% of the BIR zonal value of the land sought to be expropriated, plus the cost of improvements, in the total amount of TWENTY-ONE THOUSAND FOUR HUNDRED FIFTY PESOS (Php21,450.00) , consistent with the purpose of the said law and OCA Circular No. 113-2019 to simplify the deposit requirement in expropriation cases for the benefit of the defendants and in the interest of immediate implementation of the Project intended to benefit the public.

16. Upon deposit of the provisional amount, plaintiff would have fully complied with the requirements for the issuance of a writ of possession as mandated by law.

17. In a long line of cases and OCA Circular No. 113-2019, once the above requirements are complied with it, it becomes the ministerial duty of the trial court to issue the writ of possession in favor of the plaintiff, without need of any further hearing . Thus, as cited in the said circular:

“Municipality of Cordova v. Pathfinder Development Corporation emphazises the mandatory issuance of the writ of possession upon the receipt of the required deposit. “No hearing is actually required for the issuance of a writ of possession, which demands only two (2) requirements: (a) the sufficiency in form and substance of the complaint; and (b) the required provisional deposit x x x x Upon compliance with these requirements, the petitioner in an expropriation case is entitled to a writ of possession as a matter of right and the issuance of the writ becomes ministerial” (Emphasis supplied) .

18. Moreover, it must be emphasized that an expropriation proceeding is an action quasi in rem , wherein the fact that the owners of the property are made parties is not essentially indispensable insofar as it concerns the i mmediate taking of possession of the property and the preliminary determination of its value, including the amount to be deposited.

19. An action quasi in rem names a person as defendant, but its object is to subject that person’s interest in a property to a corresponding lien or obligation. In a proceeding quasi in rem , jurisdiction over the person of the defendant is not a prerequisite to confer jurisdiction on the court, provided that the latter has jurisdiction over the res.

20. The purpose of summons in actions quasi in rem is not the acquisition of jurisdiction over the defendant but mainly to satisfy the constitutional requirement of due process. Since the issuance of writ of possession is ex-parte, ministerial, and non-litigious in nature, the issuance thereof, even prior to the service of summons, will not violate defendants’ right to due process as the same can be done even without defendants’ participation. Besides, the issuance of a writ of possession does not prevent defendants from raising objections to and defenses against the expropriation of their property.

21. Plaintiff intends to present three (3) witnesses, namely: a) Engr. Licinio B. Capili, b) Engr. Nolito L. Notar, and c) Winsor C. Abaga, Sr. , to establish, among others, NGCP’s authority to exercise the power of eminent domain, the propriety of its exercise in this case, and the bases for the determination of the just compensation. Copies of their Judicial Affidavits (with attached Exhibits “A” to “K” ) are attached as Annexes B, C, and D and made an integral part hereof. Plaintiff intends to present additional witnesses if necessary.

WHEREFORE , premises considered, plaintiff most respectfully prays of this Honorable Court to:

1. ISSUE a Writ of Possession in plaintiff’s favor; authorizing plaintiff to enter and take possession of the property subject of this complaint that will be affected by the construction and implementation of the Project , consisting of a total area of 275-square meters , more or less, as described in paragraph 8 hereof; direct the Philippine National Police (PNP) to assist plaintiff in the implementation of the said writ of possession so that project construction can immediately commence even during the pendency of the case and/or for the conduct of the counting of affected improvements, if necessary; direct the Registry of Deeds for the Province of Lanao del Norte to enter the Writ of Possession in the Primary Entry Book and annotate the same in the Registration Book pursuant to Section 69 of Presidential Decree No. 1529;

2. After issuance of Writ of Possession, ISSUE an Order of Publication allowing plaintiff to effect service of summons to Defendants Jossie Fe A. Estavas-Tionko, Albien A. Estavas and other defendants, if applicable, by publication, pursuant to Sections 16 and 17, Rule 14 of the Revised Rules of Civil Procedures;

3. ISSUE an Order of Expropriation declaring that the plaintiff has a lawful right to take possession and acquire the affected property specified in paragraph 9 hereof;

4. After the determination of just compensation, to authorize the payment thereof by plaintiff to defendants after deducting the capital gains and documentary stamp taxes for the transfer of the affected portion of Lot No. 1943-A-1, PSD-10-057960, in the name of plaintiff, all other outstanding taxes under the National Internal Revenue Code, and all outstanding realty taxes and dues under the Local Government Code, which plaintiff shall remit to the Government;

5. ISSUE a judgment after determination of just compensation, declaring plaintiff as the lawful owner of the affected portion of the unidentified lot consisting of a total area of 275 square meters , more or less, described in paragraph 8 hereof;

6. DIRECT:

a. The Registry of Deeds for the Province of Lanao del Norte to register and annotate the Order of Expropriation and Judgment on the TCT No. T-25,944 or any certificate of title that may hereafter be issued covering the property subject of this case pursuant to Section 85 of Presidential Decree No. 1529;

b. The Municipal Assessor of Baroy and/or Provincial Assessor of Lanao del Norte to cancel Tax Declaration No. H-130191 (03) and issue new and separate tax declaration in the name of plaintiff covering the portion of the subject property sought to be expropriated herein.

9. To enable plaintiff to construct and maintain the Project, it is both necessary and urgent to acquire, upon payment of just compensation, the portion of the subject property, to ensure stability and reliability of the power supply in Mindanao and other regions of the country.

10. Plaintiff negotiated with defendants for the acquisition of the affected portion of the subject property and to pay the cost of improvements therein that may be damaged by the construction of the transmission line project. However, no agreement was reached between the parties.

11. Considering the urgent need for plaintiff to enter the subject property to implement and commence the necessary construction activities for its Project, plaintiff has no other recourse but to file the instant complaint.

12. Section 13 of R.A. 11361, Rule 67 of the Revised Rules of Civil Procedure governs plaintiff’s expropriation cases. Under Section 2 of Rule 67 of the Revised Rules of Civil Procedure, plaintiff may already enter and possess the portion of the subject property during the pendency of the expropriation case.

13. Section 2 of Rule 67 of the Revised Rules of Civil Procedure states that:

“SEC. 2. Entry of plaintiff upon depositing value with authorized government depositary. – Upon the filing of the complaint or at any time thereafter and after due notice to the defendant, the plaintiff shall have the right to take or enter upon the possession of the real property involved if he deposits with the authorized government depositary an amount equivalent to the assessed value of the property for purposes of taxation to be held by such bank subject to the orders of the court. Such deposit shall be in money, unless in lieu thereof the court authorizes the deposit of a certificate of deposit of a government bank of the Republic of the Philippines payable on demand to the authorized government depositary.” [Emphasis supplied]

14. In compliance with the notice requirement, plaintiff notified defendants through a Letter Offer of its intention to file an expropriation case if the possession over the subject property cannot be timely secured and/or issues regarding compensation for the subject property cannot be resolved except through judicial intervention. Hence, plaintiff undertakes to cause service of summons to them by publication pursuant to sections 16 and 17, Rule 14 of the Rules of Court. They are impleaded as defendants in this case since the late Timotea Pasanting is the alleged claimant of the property sought to be expropriated in this case.

Defendants MARIETTA ABALOS and HEIRS OF FRANCISCO ABALOS, namely: Marietta Florenz Galleto, Cecille Abalos, Lucio Jesus Abalos, Frank Martin Abalos, Maria Josefa Tan are all of legal age and Filipinos. They may be served with summons and other processes of this Honorable Court at their respective address indicated below opposite their names, viz:

Considering that the specific addresses of defendants Lucio Jesus Abalos, Frank Martin Abalos, and Maria Josefa Tan cannot be ascertained despite diligent inquiry, and defendants Marietta Florenz Galleto and Cecille Abalos are residing outside the Philippines, plaintiff undertakes to cause service of summons to them by publication pursuant to Sections 16 and 17, Rule 14 of the Rules of Court. They are impleaded herein as defendants pursuant to Section 1, Rule 67 of the Revised Rules of Civil Procedure, being the alleged claimants of the subject property.

12. Plaintiff negotiated with defendants for the acquisition of the affected portion of the subject property and to pay the cost of improvements therein that may be damaged by the construction of the transmission line project. However, no agreement was reached between the parties.

13. Considering the urgent need for plaintiff to enter the subject property to implement and commence the necessary construction activities for its Project, plaintiff has no other recourse but to file the instant complaint.

Since the issuance of writ of possession is ex-parte, ministerial, and non-litigious in nature, the issuance thereof, even prior to the service of summons, will not violate defendants’ right to due process as the same can be done even without defendants’ participation. Besides, the issuance of a writ of possession does not prevent defendants from raising objections to and defenses against the expropriation of their property.

23. Plaintiff intends to present three (3) witnesses, namely: a) Engr. Licinio B. Capili , b) Engr. Nolito L. Notar, and c) Winsor C. Abaga, Sr. , to establish, among others, NGCP’s authority to exercise the power of eminent domain, the propriety of its exercise in this case, and the bases for the determination of the just compensation. Copies of their Judicial Affidavits (with attached Exhibits “A” to “I ”) are attached as Annexes B, C, and D and made an integral part hereof. Plaintiff intends to present additional witnesses if necessary.

WHEREFORE , premises considered, plaintiff most respectfully prays of this Honorable Court to:

1. ISSUE a Writ of Possession in plaintiff’s favor; authorizing plaintiff to enter and take possession of the property subject of this complaint that will be affected by the construction and implementation of the Project, consisting of a total area of 2,683 square meters , more or less, as described in paragraph 10 hereof; demolish the affected improvement and/or structures standing therein; order all defendant to vacate the same; directing the Philippine National Police (PNP) to assist plaintiff in the implementation of the said writ of possession so that project construction can immediately commence even during the pendency of the case; direct the Registry of Deeds for the Province of Lanao del Norte to enter the Writ of Possession in the Primary Entry Book and annotate the same in the Registration Book pursuant to Section 69 of Presidential Decree No. 1529;

2. ISSUE an Order of Expropriation declaring that the plaintiff has a lawful right to take possession and acquire the affected property specified in paragraph 10 hereof;

3. After the determination of just compensation, to authorize the payment thereof by plaintiff to defendants after deducting the capital gains and documentary stamp taxes for the transfer of the affected portion of Lot No. 1, H-189752, in the name of plaintiff, all other outstanding taxes under the National Internal Revenue Code, and all outstanding realty taxes and dues under the Local Government Code, which plaintiff shall remit to the Government;

4. ISSUE a judgment after determination of just compensation, declaring plaintiff as the lawful owner of the affected portion of Lot No. 1, H-189752 consisting of a total area of 2,683 square meters , more or less, described in paragraph 10 hereof;

6. DIRECT:

a. The Registry of Deeds for the Province of Lanao del Norte to record in its Registry Daybook (Primary Entry Book) and Registration Book the Order of Expropriation and Judgment rendered by this Honorable Court in this case with respect to the portion of the subject property sought to be expropriated herein, pursuant to Section 113 of Presidential Decree No. 1529;

b. The Municipal Assessor of Kolambugan and/or Provincial Assessor of Lanao del Norte to issue a new tax declaration in the name of plaintiff covering the portion of the subject property sought to be expropriated herein.
