De zogenoemde inkeerregeling houdt in dat de Belastingdienst in beginsel een lagere boete aan een belastingplichtige oplegt als deze spontaan en vrijwillig alsnog volledig aangifte doet van niet aangegeven inkomen en/ of vermogen dan wel volledige informatie hierover verstrekt Van spontaan en vrijwillig inkeren is geen sprake als u weet of redelijkerwijs moet vermoeden dat de Belastingdienst bekend is of zal worden met de eerdere onvolledige of onjuiste aangifte

Normaliter wordt een vergrijpboete opgelegd bij niet eerder aangegeven inkomen en/ of vermogen. Indien een belastingplichtige echter uit eigen beweging alsnog inkomen of vermogen aangeeft dan wel volledige informatie hierover verstrekt, wordt in plaats van een vergrijpboete in beginsel (slechts) een verzuimboete opgelegd. Daarnaast wordt het melden van inkeer als een strafverminderende omstandigheid gezien. Dit betekent dat de boete in het geval van inkeer voor de inkomstenbelasting wordt gematigd tot 10% van het wettelijk maximum van 100%. Met andere woorden, door in te keren zal het boetepercentage slechts neerkomen op 10% van de te weinig geheven inkomstenbelasting. Verder is het van belang of het inkomen en/ of vermogen in Caribisch Nederland wordt aangehouden of in het buitenland. Er geldt een navorderingstermijn van 5 jaar voor Caribisch-Nederlands inkomen en/ of vermogen. De navorderingstermijn voor buitenlands inkomen en/ of vermogen is langer en bedraagt 12 jaar.

Voluntary disclosure scheme income tax, what do you have to pay attention to? The so-called voluntary disclosure scheme implies that the Tax Authorities in principle impose a lower fine if a taxpayer spontaneously, voluntarily and in full, declares earlier undeclared income and/ or assets or provides complete information about it. There is no spontaneous and voluntary filing if you know or should reasonably suspect that the Tax Authorities are or will become aware of the earlier incomplete or incorrect declaration.
