1. The Sun Valley Museum of Art Wine Auction (herein the “seller”) reserves the right to refuse admission to, or attendance at the Sun Valley Museum of Art Wine Auction events.

2. The auctioneer is the agent for the seller.

3. This catalog, as amended by addendum or oral announcements during the sale, constitutes the entire statement of the seller with respect to the sale and the purchase of wines listed herein.

4. Seller does not warrant or represent, expressly denies responsibility for, and in no event shall be responsible or liable for the accuracy or description of wines offered or the correctness of the catalog, including but not limited to the origin, rarity, age, genuineness, or quality. All statements by the seller are merely statements of opinion and are not to be relied upon by prospective purchasers as warranties or representations of fact. Prospective bidders, if so bidding, will be bidding only as a result of their own inspection and opinion. All wine is sold “AS IS.”

5. ALL bids are per lot as set forth in the catalog, unless otherwise announced by the auctioneer.

6. A suggested minimum bid price has been established on all lots. Seller reserves the right to bid on their own behalf up to and including the minimum bid price.

7. No live auction bid shall be valid unless acknowledged by the auctioneer. At the fall of the hammer, the highest acknowledged bidder shall be deemed to have purchased the lot and therein assume full risk and responsibility. Purchaser warrants that they will then sign a confirmation of purchase and will pay the full purchase price herewith.

8. Should a dispute arise between bidders, or should the auctioneer doubt the validity of any bid, the auctioneer shall have absolute right to resolve the dispute, re-offer, re-sell, or withdraw the lot in question.

9. Bids which are submitted to the seller in writing, or otherwise left with the seller prior to the sale for execution at or below a specific price, are entertained and executed by the seller for the convenience of the bidders, but the seller shall not be responsible for failing to execute such bids or for errors relating to the execution of such bids.

10. In accordance with IRS regulations, people who purchase items at a charity auction may claim a charitable contribution deduction for the excess of the purchase price paid for an item over its fair market value. The Sun Valley Museum of Art will provide information about the fair market value of any auction purchase when it acknowledges receipt of payment.

11. The virtual auction bid closing will be announced. Virtual bid increments and “BUY IT NOW” prices are listed electronically.

12. The person who signs for a paddle number is solely responsible for payment if their number is the winning bid.

13. All payments from the successful bidder must be in cash, certified personal check, or by Visa, Mastercard or American Express. The Sun Valley Museum of Art is required by law to charge Idaho sales tax on the fair market value of all tangible items, including purchases leaving Idaho.

14. Purchases must be picked up SATURDAY, JULY 1, 2023, between 10am and 2pm at the Sun Valley Museum of Art.

15. All shipping arrangements and costs are the responsibility of the purchaser. THE SUN VALLEY MUSEUM OF ART IS UNABLE TO SHIP WINES.

16. As a condition of, and in consideration of participation in the WIne Auction, participants release the Sun Valley Museum of Art Wine Auction from any liability connected with the reproduction, adaptation, display, publication and distribution, in all media, of any video, photographs, or other images taken of participants at the Wine Auction.

17. FORCE MAJEURE: If the redemption of an auction purchase becomes impossible to perform by either party due to any of the following causes, to the extent beyond its reasonable control: acts of God, war, terrorism, civil disorder, natural catastrophes, government acts or omissions, changes in laws or regulations, strikes, or generalized lack of availability, only the fair market value as recorded at the time of purchase will be refunded to the purchaser. Because SVMoA puts all donations to work quickly to enrich our community, SVMoA does not offer refunds of any donations.
