High-end property sales ticking along BY DEAN WEBSTER WITH two recent million dollar-plus residential property sales in the region, new life has kicked into the high-end property market. Following on from RT Edgar's recent $1,450,000 sale in Wallington, Hayden Real Estate Torquay has sold a spectacular Ocean Acres home for in excess of $1,400,000. New home sales see September quarter gain

WITH CHRISTIAN BARTLEY FROM BELLARINE PROPERTY ACCORDING to Bellarine Property managing director Christian Bartley, many home owners are sitting on a significant financial resource and don’t realise it. “Most people are so keen to pay off their home loan as fast as possible they fail to see the advantages of staying in debt,� Mr Bartley said. “A home owner’s debt, or more particularly their debt to equity ratio, is a matter of perspective. “For example take a property currently valued at around $500,000 with $100,000 left on the loan. Some people see it as $100,000 owing, whereas others see it as $400,000 borrowing or investment power.� According to Mr Bartley, more people are turning to investment property acquisition in the realisation that the real long term value of superannuation is being eroded. “Once you have bought the first property it is easy to go on until you’ve built up a comfortable retirement package of between five and 10 properties. “Think of your nearly paid-off home as a sort of parent property and watch it grow a portfolio of dependents. Over time the dependents will not only stand on their own two feet, they will

BY DEAN WEBSTER NEW home sales increased in both the month and quarter of September this year, according to the Housing Industry Association (HIA). Total new home sales reached their highest level in over two years in September, said HIA chief economist Dr Harley Dale. “Given the recovery in sales is occurring from a record low and that the upward momentum appeared to be stalling in mid-2013, this September outcome is very positive.� The HIA New Home Sales report, a survey of Australia’s largest volume builders, showed that total seasonally adjusted new home sales increased by 6.4 per cent in September 2013, the fastest monthly growth since April last year. The increase reflected a 4.5 per cent rise in detached house sales and a 19.9 per cent jump in multi-unit sales. Victoria is leading the way with the month of September private detached house sales increasing by 15.7 per cent “There is clear upward momentum in detached house sales which grew by 3.7 per cent in the September 2013 quarter to be up by 25.2 per cent

when compared with the same quarter last year,� Mr Dale said. Hotondo Homes is experiencing renewed interest from families looking at making Torquay their home, along with investors and retirees. Hotondo Homes principal Peter Scott said that with several new housing estates coming on line recently in Torquay, competition has made land much more affordable for new home builders. “With low interest rates and increased land availability in Torquay we are seeing an upturn in enquiries and are looking forward to a busy 2014,� Mr Scott said. Meanwhile, the HIA has urged the federal parliament to give swift passage to the bill to repeal the carbon tax when it sits next month. The HIA believes the carbon tax is bad for housing affordability as there is no transparency about where the carbon tax is adding to the cost of building a home, and therefore the homebuyer can’t make decisions or change behaviour to avoid paying for it. They also question why the tax is applied to new homes which are much more energy efficient than existing ones.

Avoid tax on family home sale BY DEAN WEBSTER MOST people believe that when you choose a house as your “main residence” you effectively quarantine that property from Capital Gains Tax (CGT), but this is not necessarily the case as revealed in a recent legal decision. It is quite common for people to have their affairs subject to Tax Office review and be unable to substantiate that the home that they live in is exempt from CGT. In a recent decision before the appeals tribunal, a man claimed to have satisfied the “three month rule” in relation to a property that he shared with his ex-partner. This is a rule of thumb that suggests that once you have lived in a property for three months you have established it as your main residence. However, the tribunal did not hold in the man’s favour, it held that an extra $66,271 should be

included in the taxpayer’s income in the 2006 year resulting from the capital gain made on the sale of the property. The tribunal cited evidentiary failure of the taxpayer to produce the documents that would demonstrate that he was living in the new home, council rates notices provided were not considered as the tribunal indicated they did nothing to further the taxpayer’s claims. Accountants and Financial Advisors Crowe Horwath recommend that in order to prove that you live in a property, and have established it as your main residence, you should have some or all of the following: • A copy of utility connection advice • Receipts/print outs from VicRoads when changing addresses on drivers’ licences and car registrations • A copy of the Australia Post re-direction notice • Letters sent to local businesses advising of the

new address • A copy of removalists tax invoice • A copy of the electoral notice changing your address on the Electoral Roll. • Copies of invitations to the house-warming party and photos of the house-warming party. Paul Robson, principal of Business Advisory at Crowe Horwath in Geelong and Torquay, said individuals need to be aware that the Capital Gains legislation is wide reaching. “There is a misconception that an investment property can become a primary residence (ie: home) without future capital gains ramifications, this is not the case,” Mr Robson said. Cooling off matters RESIDENTIAL private sales still comprise 70-80 per cent of all residential sales, but it’s important to remember they are subject to cooling off periods. This means that the buyer has three clear business days to “cool off” or reconsider their offer. This begins the day after the buyer has signed the contract. Weekends and state-wide public holidays aren’t taken into account during the cooling off period. Cooling off is a buyer’s right and is mandated by legislation. The purchase can’t be finalised until this period expires. However, if buyers do change their mind and cool off, they must give written notice to the seller or their agent. Buyers will also lose $100 or 0.2 per cent of the purchase price from their deposit, whichever is greater. This is a form of compensation for the seller. For example, if a buyer signs a contract at $650,000 and pays a 10 per cent deposit, the seller is entitled to keep $1,300 if cooling off occurs. Sellers obviously face some uncertainty during the three days of the cooling off period as to whether the sale will go ahead. Cooling off begins when the buyer signs the contract, not when it’s signed by both parties. There are some exceptions to the cooling off period. It doesn’t apply, for example, if the property is purchased within three clear business days before or after a public auction.
