MEXICO

The Mexican Constitution does not allow “direct” ownership of Mexico land by foreigners within the ‘restricted zone’ of Mexico (100 kilometers from the border and 50 kilometers from the coast). Realizing the need for foreign owners and investors in Mexico, an instrument was implemented by the Mexican government that allowed foreigners to purchase property within the restricted zone and hold title in a guaranteed bank trust (known as the Fideicomiso). The Fideicomiso is a 50 year, perpetually renewable bank trust granting a foreign buyer the right to use, improve, rent, sell or otherwise enjoy the property – similar to ‘fee simple’ ownership in the United States. In order for a foreigner to purchase property in Mexico through the use of a Fideicomiso, the Department of Foreign Affairs in Mexico issues a permit to a Mexican Bank of the buyer’s choice, allowing the bank to act as the “Trustee” of the Fideicomiso and the buyer to become the “Beneficiary” of the Fideicomiso. The Fideicomiso can be compared to the common Living Trusts or Estate Trusts used in the U.S. The Trustee (the bank) of the Fideicomiso only takes instructions from the Beneficiary (the foreign buyer).

If the Beneficiary decides to sell the property, the purchaser often has the option to assume the trust or have the property vested in a new trust.

It is important to know that as Beneficiary of the trust, the buyer has the right to use, occupy, and possess the property – essentially possessing all the rights of a property owner in the U.S. or Canada. Just like Fee Simple ownership in the U.S., the buyer also has the right to improve, build, modify and develop the property according to local Mexico laws, procedures, and regulations (similar to common building codes and zoning in the U.S.).
