Don’t hibernate in Taft

By Bill Taft Last Friday’s Cruise Night was a flop. Most of Taft must have been home in hibernation. The next 1st Friday Cruise Night is January 2nd so it probably will not be much better because it is so close to New Years. Cruise Night is good cheap family fun. Remember Cruise Night is the 1st Friday of each month.

The Taft Chamber started it back up to get people out and about in Historic Downtown Taft. Cruise Night is to see friends, meet new friends, drool over hot rods, do some local shopping, eat at local restaurants, see a movie at the Fox, have fun, and cruise like the old days. There are several rumors why Cruising Center ended in the 90’s.

The real reason it ended is because of vandalism, trash, fights, and kids drinking alcohol. 1st Friday Cruise Night is now a lot more mature and family friendly. Several people were mad that there was not a Farmers Market last year. There was not enough support so we lost it, let’s hope we do not lose Cruise Night too. If you have any ideas to make Cruise Night better contact the Downtown Business Association or the Taft Chamber. People always have ideas and suggestions but remember lots of these ideas take man power and money which is not always there.

Last weekend was the Annual Christmas Tea at the West Kern Oil Museum. It was jam packed with people for the first two hours. The food and company was excellent. The crew at the Oil Museum works very hard. The Museum is open Thursday thru Saturday 10am-4pm and Sunday 1pm-4pm. Admission is free and donations are accepted. The Museum is looking for new volunteers.

The Museum is also the perfect place for weddings, reunions, and meetings. They do not allow alcohol or smoking.

The Taft Petroleum Club recently formed a new great nine member board. They have several improvements planned for the future. The Taft Petroleum Club is the oldest and the best Petroleum Club in the world and they want to keep it the best. There has been so many changes over the years, let them know what can be done to improve the Petroleum Club. The next Industry Night is January 7th.

The Best Western is being built fast, the Taco Bell is being built even faster. Sandy Creek Estates is moving along great. Everything is moving along good at the Hospital Complex. Skully Field at the Rec Center is coming along and the Westside Little League has never looked better.

The Rails to Trails extension to A Street Park is looking good and so is all the improvements to A Street Park.

The Bank Sports Lounge will be open on New Years Eve. Snow White will be open in early 2015. Eye Kandi and Mi Casita have both moved into much larger nicer locations. Lots of great things will be happening at Black Gold Brewery soon. There are positive rumors about new businesses going into the old Mi Casita and next to Acme Jewelry.

Everyone loves the Christmas Season but so do the thieves. Taft is still the safest town around but we need to leave our exterior lights on, know your neighbors, know who walks your neighborhood, and look out for each one another. Keep your money in Taft this Christmas Season.

Our local businesses need to have a good Christmas Season to make it through the slow months, so please support them.

Nick Cullen has been appointed as interim Kern County Animal Services Director effective January 10,2015, the Board of Supervisors announced today.

Cullen will replace Shyanne Schull, who is leaving KernCounty to serve as Director of Washoe County Regional Animal Services in Reno, Nevada.

Cullen began his County career as an Animal Control Officer in 2005, and he has overseen daily operations of the Kern County animal shelter since his appointment as Shelter Supervisor in October 2011.

As an Animal Control Officer, Cullen investigated an equine starvation case in 2011 that resulted in two felony convictions. During his six years as an officer, Cullen was responsible for securing eight felony convictions on animal cruelty charges.

As Shelter Supervisor, Cullen organized County and volunteer resources to feed more than 200 animals rescued in an animal cruelty case, and 90% of the animals were ultimately placed in rescue or adoption. He was closely involved in planning and carrying out the relocation of several hundred animals from the former shelter on Mt. Vernon Avenue to the County’s new Fruitvale Avenue facility in 2013. Cullen’s close ties with animal welfare organizations were critical in helping the Department to intensify its efforts to secure the adoption and rescue of as many animals as possible before the move.

Following the move, Cullen supervised the start-up of the new facility, which required extensive retraining of staff, developing and implementing new protocols for animals coming into the shelter, preventing disease, and ensuring smooth day-to-day operations at the new location. Cullen developed a trap, neuter and release program for feral cats that increased live outcomes for this population by 60%.

“Nick Cullen has been instrumental in leading and sustaining a complete transformation in Animal Services operations,” Board of Supervisors Chairman Leticia Perez said.

“His practical experience and wise judgment will be crucial in continuing to advance the goals of Animal Services to provide humane treatment of animals and to reduce the number of stray and uncared for animals in our community.” Cullen’s animal cruelty investigations garnered a Humane Society grant for the department, and his work in transferring Animal Services to its new location earned an Outstanding Leadership award from the County of Kern.

I have always loved books, from the time in kindergarten when Mrs. Thompson read a book to us before nap time right on up to today. While growing up here that meant that the only place to get a book was the local County library, or on the rack at one of the convenience stores where you could find a western, action/adventure, science fiction or the whole side of a rack aimed at romance novels. So having only three sides of a carousel rack (what self respecting teenage boy would read a romance novel) left it sort of hit and miss when it came to finding something to read. One of my pleasant discoveries when I moved back to Taft was that my reading options had expanded. Now you can get a library card at the local County library branch or at the Taft College library but perhaps one of the best options is Ben’s Books at 810 Center Street.

The first time I walked into Ben’s place I was surprised at the size of its selection and yet it is still a lot like that carousel rack at the local convenience store, westerns, action/ adventure, science fiction and romance novels with a few biographies, maintenance how to do’s, some religion books and classic literature thrown in for good measure.

When you walk in you will also notice that there is a nice place to sit and chat with Ben or some of his customers who drop by to hang out for a while, discuss the news of the day or look for a reading recommendation.

I recently got the opportunity to sit down with Ben and learn a little more about his shop and of course about the man.

The Mangums, Ben and his wife Jennifer, moved to Taft from Woodland Hills, CA in 2005 to be closer to their grandchildren.

While living and working in Southern California Ben had a number of jobs including as an insurance broker but the job he liked the most was working for Bank of America as a bank examiner. “I loved working for B of A, the bank was run like a family business, during the depression they refused to lay any one off.”

When the Mangums moved to Taft the met the elderly couple who had previously owned the book store. “The store only opened on Saturdays and had two dogs that had the run of the place” Mangum said. The store was poorly maintained and probably had only a 1,000 books that the couple would trade for almost any item. People who came into the store had a challenge finding books they were interested in due to poor organization.

Mangum said “I was looking for a challenge and we decide to buy the store. Well I got one. It was a real challenge to make the store a real business that had to make money on its own.”

“We changed the way we do business, traditional used book stores will buy their stock from people selling books that they no longer want or from estate sales.”

Initially, to increase their stock Ben went to a library sale were he bought every western they had for sale, eventually though, the Mangums chose

a different model, deciding not to pay for books but relying on donations or trades to increase their stock of used books.

Today, Ben’s Books has expanded its holding significantly including the recent addition of special section of hardback books, and a nice selection of children’s books.

Their biggest sellers are romance novels followed closely by action/adventure books and westerns.

When asked about his favorite books he said he liked anything adventure related and he recommends Lee Childs, Vince Flynn and Tom Clancy for people looking for similar reading. He also recommends Dick Francis novel since their setting is so unique. “If it doesn’t grab you in the first 100 pages or so it’s probably not the book for you and all of these seem to really grab you.”

“Of course, you never really know what’s going to sell when you take in books so I try to also stock books that I might not have read but look interesting” Mangum said.

If owning and running a book store isn’t enough you might also notice that Ben is Taft’s elected City Treasurer.

“I wanted to give back to the community and I thought my background in banking would offer an opportunity to do so, I like trying to explain to people how government works.”

Mangum said.

So, if you get the chance, you should drop by Ben’s Books check out the store, buy a book or just chat with Ben about books, the news of the day or about how Taft’s finances are doing.

“Jose not only comes to class on time every day, but he goes right to work and is always the first to help others.

He asks questions when he needs help and is curious about other ways to address an issue or task. He often completes project and assignments ahead of schedule,”

At its regularly held Board meeting the Taft City School District again discussed the status of suspended Superintendent Ron Bryant. Bryant, who pled no contest this week to two counts of driving under the influence, charges that stemmed from arrests made earlier in the year.

Bryant received a sentence of 150 days of work release and three years probation.

As a part of his probation Bryant will be required to complete an 18-month anti-drunk driving under the influence course, not drink alcohol or enter bars.

The Board met for nearly an hour with their attorney in closed session to discuss these new actions. When they emerged Board President, Les Clark Jr. read from a prepared statement.

December 12 - 18, 2014 “As you may be aware, our Superintendent pled ‘No Contest’ to several charges, including driving under the influence. While Mr. Bryant remains an employee of the District, he will no longer be on paid administrative leave status. The district is pursuing its options concerning his employment status. Further details will be reported at the appropriate time.”

There has been discussion in the past if Bryant’s contract with the district allowed for dismissal under a “morals clause.” The Independent obtained copy of Bryant’s contract which does not contain a “morals clause” but does discuss termination. The Board can terminate Bryant’s contract with the District in four ways: by mutual agreement, for cause if Bryant has violated the terms of the contract, a discretionary dismissal which requires the district pay Bryant the balance of his contract or one years salary ($142,972) which ever is shorter or under State of California Education Code legal provisions.

The Board will hold a special meeting, including a closed session on December 18, 2004 to further discuss Bryant’s status.

Counselor Jana Durkan added, “Jose has not being tardy or absent since the first day of school. Jose does great work and is always helpful with others, but most of all he is always smiling!”

Jose plans to study computers after he graduates from high school. He plays right midfielder on the varsity soccer team.

Goossen, 49, a popular teacher during his 11 years at Taft High, said he was surprised to receive the award. “I try to stay positive. I try to make class interesting and fun and to be helpful and to not give up on students.”

Renaissance coordinator Tanya Mauldin, who replaced Goossen in that position, said, “Students who nominated him said that he is awesome and is always smiling. He is very helpful, nice and encouraging.”

He and his wife, Cheyenne, have three children: Eli, 7; Gage, 4; and, Beau, 18 months. He commutes from his home in Nipomo.

“I feel very lucky to be teaching video productions at Taft High. They definitely support me,” he said.

The pair each received a Wildcat T-shirt, a Renaissance coffee mug and a $5 Starbucks gift card.

Maricopa Sun Solar Complex in Kern County to be Issued Endangered Species Permit Sacramento - The U. S. Fish and Wildlife Service (Service) announced the availability of a Final Environmental Impact Statement (FEIS) for the issuance of incidental take permit (ITP) associated with the Maricopa Sun Solar Complex Habitat Conservation Plan (HCP) for their proposed solar energy facility in Kern County.

The permit covers impacts to at-risk species associated with construction, operation, and decommissioning of a 700-megawatt solar facility. The permit also covers the HCP conservation actions for the project site that covers 5,784.3 acres in southwest Kern County, California. The project is made up of multiple parcels and located approximately six to 20 miles east of Taft along South Lake Road and along Copus Road.

Under the Endangered Species Act, private landowners, like Maricopa Sun, may apply for a permit to take federally protected species while conducting otherwise legal activities on their land. To obtain an ITP, the applicant must develop an HCP that details actions to minimize impacts and specifies measures to offset the impacts of the proposed development.

The ITP requested by Maricopa Sun, LLC from the Service will cover three federally listed species: Blunt-nosed leopard lizard (Gambelia sila), Tipton kangaroo rat (Dipodomys nitratoides nitratoides), and San Joaquin kit fox (Vulpes macrotis mutica). The following two federally non-listed species are also included: Western Burrowing owl (Athene cunicularia) and Nelson’s antelope squirrel (Ammospermophilus nelsoni). These five species are collectively referred to as Covered Species.

In addition to including avoidance and minimization measures to reduce impacts, the HCP’s conservation strategy compensates for unavoidable effects to Covered Species and their habitat. Existing Covered Species habitat totaling 1,894.4 acres will be permanently conserved and conservation easements will be placed on 3,798.2 acres of proposed solar site development land.

These conservation easements will allow solar development, operation and decommissioning during the 35-year term of the HCP followed by management of these sites in perpetuity for the benefit of the Covered Species.

The HCP will result in the permanent conservation of a total of 5,692.6 acres of Covered Species habitat. The issuance of an ITP may not occur until after public review of the FEIS and formal acceptance of the HCP and at least 30 days following today’s published date.

Average Gas Prices fall to $3.06 Los Padres National Forest Seeking Students for Wildland Average retail gasoline prices in California have fallen 1.8 cents per gallon in the past week, averaging $3.06/g yesterday, according to GasBuddy’s daily survey of 10,526 Fire Science Course gas outlets in California. This compares with the national average that has fallen 2.1 cents per gallon in the last week to $2.78/g, according to gasoline price website GasBuddy. com.

Including the change in gas prices in California during the past week, prices yesterday were 51.1 cents per gallon lower than the same day one year ago and are 26.4 cents per gallon lower than a month ago. The national average has decreased 21.8 cents per gallon during the last month and stands 49.9 cents per gallon lower than this day one year ago.

“Oil prices have been demolished in the last 72 hours as OPEC decided against a production cut, which will open the flood gates to even more gas price declines,” said Patrick DeHaan, senior petroleum analyst with GasBuddy. “In my decade of watching oil and gasoline prices, I don’t think I’ve seen as steep a decline in a 48 hour time frame as what we saw on Thanksgiving Day and into last Friday as OPEC put off any decrease in production. This is perhaps one of the most astonishing weeks in watching crude prices I’ve ever witnessed, and motorists will likely be giddy at what I see in our gas price crystal ball: a 15-25 cent drop over the next several weeks, bringing the national average down to the $2.50s by Christmas,” he noted.

Liberty Under Fire Miller Time

President goes around Congress on Climate Change Harold Pease, Ph. D A new Obama executive order effectively legislates climate change. Not content with Congress’s unwillingness to legislate on climate change to his expectations, the president issued a November 1, 2014, executive order that creates a de facto legislative branch to do so. He titled it, “Preparing the United States for the impacts of Climate Change.” Neither Congress nor the scientific community is in agreement that climate change, when it is documentable, is man-made. As a result Congress is unwilling to legislate, tax and spend on this supposed problem until more confirming data is available. The President, in disagreement, seeks to make rules unilaterally as he has in other areas, despite the fact that he constitutionally is not empowered to make any law as per Article I, Section I. This executive order begins, as do of all his executive orders, without identifying a single piece of legislation authorizing the order. It begins, “By the authority vested in me as President by the Constitution (the Constitution denies the President law-making power) and the laws of the United States of America, (none are cited) and in order to prepare the Nation for the impacts of climate change by undertaking actions to enhance climate preparedness and resilience, it is hereby ordered as follows.”

In the absence of a recently passed piece of legislation authorizing the order it is little more than a presidential decree. Amazingly the multi-page decree cites eight previous executive orders, two previous Obama Memoranda’s, and his Presidential Policy Directives-21, these scattered throughout the text, as authority, in sharp contrast to executive orders of previous presidents that cited pieces of actual existing laws passed by Congress. This president makes up his own authority “on the fly” and justifies it by previously made up authority and so far Congress says nothing.

It is obvious that this de facto legislative group will make the rules and regulations with respect to everything that they interpret to have anything to do with the environment. Those areas specifically mentioned were: infrastructure, fresh water, ocean water, fish, wildlife and plants. That is a broad sweep of authority none of which can be found in Article I, Section 8, or in any amendments to the Constitution enlarging federal power or jurisdiction thereafter.

Also obvious is that the decree is aimed at maximizing federal power over local governments as well. It identifies its mission as to “identify opportunities to support and encourage smarter, more climate-resilient investments by States, local communities, and tribes, including by providing incentives through agency guidance, grants, technical assistance, performance measures, safety considerations and other programs.” Incentives and grants are mentioned and, historically, have been used as bribes to draw local governments in.

This wordage is political speak for “we plan to control you.”

The normal way to control local governments, as suggested, is to offer them federal money to accomplish federal objectives which will remain federally dominated and the locals are too often more than willing to sell their jurisdiction “soul” for a few dollars. Yes, some governors and a few selected county or tribe representatives will get invitations to serve on the task force, but the numbers will never be enough to overcome the federal majority serving.

Also always present, when the federal government is involved, is the cavalier attitude that they can make “smarter” decisions than local or state governments. This, though they often live hundreds of miles away and thus do not have to live with the decisions they impose on others and this, normally by unelected, thus unaccountable, bureaucrats.

Some defending the Presidents executive order practice of making rules may suggest, naively, that such are not laws and thus okay. The Founders made no distinction between rules and laws. The fact remains that regulations and laws have

Hi Everyone, The elections are finally over and you have a new makeup on the City Council and over at the high school. The City welcomes our two newest members to the council, Josh Bryant and Renee Bitzer Hill. Josh is a long time Taft resident who happens to work in Bakersfield but chooses to live in Taft not just reside here. Renee who was born and raised in Taft, left to pursue her interests and came back home a couple of years ago and has opened Olds Cool on Center Street specializing in all things collectable, cool, and old. They both bring new energy, different perspectives, and they represent a younger generational view on things. Two newest members on the Taft Union High School board are Paul Linder, our former mayor, and Julie Ortleib, our popular local dental hygienist and strong supporter of all things going on at the high school. Paul of course worked there for over twenty years and brings a wealth of knowledge gleaned from his 12 years on the City Council. Rick Twisselman was also re-elected for another term on the board. The water district and health care district boards did not have anyone step up to challenge the incumbents, which must mean they are doing a good job representing the interests of the residents on the Westside.

I again was fortunate and grateful to be re-elected to the Taft City Council and was deeply honored when my colleagues appointed (not anointed) me to be your Mayor for the next two years. It is especially gratifying to know as a kid born in the Fort, went through all the city schools, and graduating from Taft College to be Mayor during Oildorado, how cool is that. It is pretty much a very short list of former Mayors that can put that on a resume. I’m really looking forward to the future for Taft. We have had our concerns and problems over the past 10-12 years but the City survived and we are stronger for it. City employees are dedicated and working hard to provide the services and commitment that our citizens deserve. We are back in the CCF business again, although fraught with perils, we bein common three things, they impose a process, administer a penalty, or prohibit an activity. Congress alone can make them and has no authority to give away her exclusive power to do so, whether called a regulation or a law, nor to allow the executive branch to do it for them. The people have the right to know that every restriction imposed upon their behavior was read and voted on by three elected, thus accountable, persons—their Congressman and their two U.S. Senators.

The constitutional response of Congress to the theft of their sole power to legislate, should be threefold: 1) renounce the President’s decree; 2) the House should refuse all funding to implement the decree as per Article I, Section 7; and, 3) both houses should create a joint committee to study the executive order evolutionary process, recommending additional measures to forbid the executive branch of government Congress’s sole law-making function. If Congress does not renounce this decree, rule making in the area of climate change will be left to the President’s cronies in the de facto “Congress,” created by this executive order.

The motel will be ready soon, Taco bell has purple paint on the building, and the Snow White Drive In is coming along nicely. There is talk of a chain restaurant coming to town (not known who yet), and the industrial park south of the airport is filling up fast.

Now, the only thing we can’t control is how the oil industry is going to react to the price of oil hovering at $60 per barrel from $100+ months ago. It certainly is going to affect property taxes and the agencies whose budgets depend on those funds and will there be any layoffs for contractors and oil company personnel ??

There is a lot of things going on nationally with a new congress coming on board, revelations of CIA interrogation techniques, the great racial divide that some folks are promoting that exists, where is our water going to come from, our state legislature that just doesn’t get it, and the shootings that are going all over our great country that we are starting to get numb to. What the heck is going on ?? In the overall it seems that there are lots of folks in this country that are taking advantage of the freedoms that we are guaranteed.

Does the excuse to march and then start looting with masks and bandanas on give you a free pass ?? When does those that are in power realize that it is our tax money they are spending and not theirs ?? When were we ever taught that when a police officer confronts you that it is OK to not do what they request, use the filthiest of language at them, physically resist arrest them, and then remind them that you have rights ?? When has it ever been thought of as a contest that if you can get pass all our border protection illegally that you win and get to stay ?? How come we are the only nation in the world that grants citizenship to a child born in the USA when the parents are not US citizens ?? Why is that whenever someone disagrees with someone else’s views on a subject that we have to find a provocative term to call the other person such as a racist ?? Isn’t someone a jerk if they do jerky things no matter the color, race, or religion, but because they are my race, color, or religion I will defend the jerk, and if I do or don’t I’m not sympathetic or I’m a radical ?? It seems to me that we are heading down a shaky road in this country. There is the old saying “why can’t we just get along”. Why can’t we ?? We are the freest, best, proudest nation on earth and we seem to just becoming apart at the seams. We need to kick back, think before we react, look at the greater good, be selfish to a point, but love thy neighbor too. Look for the good not always the bad in people. Be a role model to your kids, family, and your community. Go hug someone; it’ll make you feel better.

For those kids in this community that are always saying they are bored, maybe the problem is that YOU are boring.
