The movie will start at 8:15pm. Bring the family, your chair, blanket, snacks, or call and have your favorite pizza delivered. On August 2nd they will show the movie “Goonies” for free at A Street Park at 8:15pm.

Saturday- The High School Baseball All Star Showcase at the Taft College Baseball Field at noon. Batting practice starts at 9am. The best High School Players from around Kern County will be playing. There will be several Pro and College Scouts in attendance. Admission is $4.00 for adults, $2.00 for kids, kids under 10 are free.

Taft really is Energized for the Future

By John Swearengin Most people wonder why the Department of Fish and Game has caused so many problems for the Sandy Creek Estates. Some people wonder why we have the Department of Fish and Game at all. Anyone that drives down Highway 119 knows the Kit Fox, Kangaroo Rat, Blunt Nose Leopard Lizard, and everything else are all running wild everywhere. Every time you drive into Bakersfield you see more and more Farmlands gone with new housing tracts and shopping centers. Yet we have so much trouble getting one housing tract that is so needed and will help the entire Westside. There are hundreds of miles for our critters to roam but you can’t replace farmland. Seems like Taft is just getting picked on.

These Fish and Game problems go with all the crazy things some of our Politicians are always trying to do.

These people try to look busy and mess with our Oil, Schools, and everything else that they usually know nothing about. Please remember this when you vote.

The Taft Tea Party meets the first Thursday of every month at the Taft Veterans Hall at 6pm. I’m very glad Bob Colston never gave up on Sandy Creek Estates.

Bob has done so much for Taft over the years. I know all his hard work will pay off soon.

Taco Bell will be here soon, so will these homes, the Best Western Groundbreaking is June 30th, RV Park, Medical Plaza, and many other things are in the works. I would love to see downtown busy. Luckily the Taft Planning Commission decided to start citing vacant eyesore businesses. This will hopefully make these people fix up or sell their businesses. Also I hope the owners that do sell these buildings do not try to get an arm and a leg. With the future looking good for Taft and Oildorado coming soon people are excited. Taft is Energized for the Future. Speaking of Oildorado, post your Oildorado pics and memories on Facebook at “Oildorado 2015.”

One building that would be nice if it was sold and fixed up is the old Bank of America on Center Street.

It would be nice to see a Community Center there.

Have skating, roller derby, roller hockey, Farmers Markets, Cheerleading Competitions, Racketball, Church Events, Dances, Reunions, and so much more. There is a large parking lot across the alley that is hardly used.

This could also be a great restaurant and a number of other businesses.

On a disappointing note, someone recently destroyed the display at the Lakeview Gusher. Why anyone would destroy something with so much history is nuts. One of the best guys around, Historian Pete Gianopulos had the display put up several years ago.

Several months ago someone stole the Adams Park sign at Terrace Drive and A Street. Why do people tear up, vandalize, and steal things that mean so much to other people. You see on the news people stealing so they can eat but the things going on around town are not because people are hungry, it is because people have no respect.

NOTICE IS HEREBY GIVEN that the West Kern Water District has scheduled June 24, 2014, at the hour of 6:00 p.m. at the West Kern Water District, Board Room, Taft, California, as the date time and place for a public hearing at which time and place the West Kern Water District, Board of Directors will hear and receive comment with consideration of adopting the District’s Amended “Draft” 2010 Urban Water Management Plan.

So anyone that has gone by recently will see the mess someone made out there. Speaking of the West Kern Oil Museum they have been having Discovery Days recently for mainly Jr. High students. The Oil Museum is a place everyone should walk through every few months or so. It has so much info about Oil, all of the Westside, the Taft College Glory Days, and so much more. The Oil Museum is always looking for great volunteers, rather it is to give tours, clean, maintenance, or just about anything else.

Also if there are any schools, clubs, churches, etc, interested in a cleanup day at the Museum, it is always appreciated. Contact the Museum if you’re interested in volunteering or want any other info at 765-6664.

Best Western Hotel Groundbreaking June 30th, Planning Commission Approves Taco Bell Plan

By Jerry Livingston, J.D. Taft City Council held its regularly scheduled meeting on Tuesday where they discussed and approved amendments to the Zoning Ordinance. The Council adopted amendments to the section of the Zoning Ordinance that regulates the type of materials that may be used and the maximum height allowed when building fences or walls. Councilmember Noerr stated that it was not his desire to increase the regulations property owners must comply with but felt that “… if left on checked people in Taft will continue to use inappropriate materials.” It was noted at last month’s Planning Commission hearings, were these amendments were recommended, that materials such as refrigerator doors and pallets had been observed in use as fencing material.

Also on the agenda for this meeting was the repeal of a city ordinance that had been adopted in 2007, that limited where persons who were convicted of various sex offences could live.

A recent court case, Godinez v The People, had held that the State’s sex offender registration law, popularly known as Jessica’s Law, was the only means by which the registered offenders residency could be controlled. As a result of this change in the law, the city of Taft was sued by a registered sex offender challenging the constitutionality of the local ordinance regulating residency. registration ordinance in light of the suit. City Manager, Craig Jones, noted that there was no know incident in which this ordinance had been enforced since its adoption.

As a part of its regular consent agenda the Council also took action to adopt a preliminary budget based on the previous fiscal years level of appropriations. The Developer also announced the ground breaking ceremony for the new Best Western hotel will be held on June 30th at the projects site on 6th street. He believed that this interest was an indication that the “Economy was coming back slow but steady.”

The Planning Commission reviewed and approved an application by Rick Jahj of Prasayus Construction proposed site plan for Taco Bell on Kern Street near Hillard. Mr. Jahj indicated that they were hoping to file their request for a grading permit within two weeks. He also said that the company would be looking to work with as many local sub-contractors as possible and would be listing their request for proposals in the near future. The new fast food establishment will be only the third one in Kern County to have the company’s new external design.

The plan calls for a 2,200sf floor plan with a drive thru. The drive thru will be able to accommodate up to nine cars. When complete the restaurant is expected to employ between twenty and thirty persons. The goal for this project is to start construction as soon as possible and hopefully open by the end of the year, assuming no unforeseen obstacles.

The Commission also continued its deliberations on proposed amendments to the city Zoning Ordinance regarding sign standards. The concerns regarding enforcement of the City’s current sign standards were a topic of discussion along with further dialogue on the type and duration for temporary signs. This matter was continued to the July Commission meeting were staff plans to bring the updated language for adoption and referral to the City Council.

Mark Staples gave his Planning Director’s report were he announced the expectation that the West Side Health Care District that is working to analyze the presence of asbestos in the former hospital building and will expect to proceed to demolition of the building with-in the next few months. The District has begun working on a master plan for expanding the urgent care facility and moving their offices to a temporary building on site as well as other as yet undetermined future building plans.

Unleash America’s Energy Potential

By Michael James Barton The United States is the new Saudi Arabia. At least with regards oil and natural as deposits.

To take full advantage of our nation’s energy bounty, however, the federal government must allow the same kind of careful, responsible exploration and production now occurring on private lands to take place on public lands.

The federal government owns about 650 million acres of property -- around 29 percent of the country. Over 35 percent of this land is in Alaska alone.

Yet the government inexplicably restricts oil and gas production to just 13 percent of our federally-owned land. As a result, we are failing to reap the full benefit of innovative new technologies that have allowed unprecedented access to underground oil and natural gas.

On private lands, however, the federal government has no authority to block these job creating endeavors.

New technologies utilized on private land have created booming growth in an otherwise lackluster economy.

At the same time, they’ve reduced energy prices and our dependence on foreign energy.

Further, abundant low-cost natural gas is increasingly crowding out dirtier, more traditional energy sources, bettering the environment.

Already, natural gas and oil are directly responsible for 9.8 million jobs across the country, paying a total of $200 billion in wages. In 2010, during the worst of the Great Recession, the oil and gas industry contributed $476 billion to the U.S. economy. Throughout the recession and recovery, private-sector employment increased by only about 1 percent, but within the oil and natural gas sectors, it skyrocketed by 40 percent.

The future looks even brighter. The Energy Information Administration predicts the United States will produce an additional 8.5 million barrels of oil a day in 2014, increasing to 9.3 million barrels by 2015. Natural gas production is forecast to enjoy a 56 percent increase between 2012 and 2014. If government policy doesn’t restrict growth, oil and gas could easily create an extra 1.4 million direct jobs in the United States by 2030.

The International Energy Agency has reported that the United States is on track to become the top energy producer in the world by 2015. Moreover, natural gas is fast coming to dominate the domestic energy marketplace, contributing to a greener tomorrow.

Sadly, the federal government is doing little to encourage this domestic energy bonanza. The Department of

7 the Interior reports that the number of drilling permits issued on federal lands was slashed by 36 percent between 2008 and 2012.

Furthermore, the Congressional Research Service has found that all of the increased production in crude oil between 2007 and 2012 occurred on non-federal lands.

During that same period, the federal share of U.S. crudeoil production dropped 7 percent, despite the trumpeting about reducing our dependence on foreign oil.

In fact, in his recent State of the Union Address, Obama praised natural gas as one of the key reasons we are “closer to energy independence than we’ve been in decades,” conveniently failing to mention that this occurred despite his fierce opposition to drilling.

That comes at significant cost to Americans in this struggling economy. An estimated 26 billion barrels of oil are trapped below federal lands, waiting on permits. The Institute for Energy Research estimates that federal lands hold $128 trillion in oil and gas resources, “about 8 times our national debt.” The 10-year royalties, rents, and lease bonuses alone would earn the government around $150 billion total in revenue. And those numbers draw off a widely-considered conservative estimate by the Congressional Budget Office.

This public land must be developed responsibly, taking into consideration both the environment and affected local communities. Though state governments are best positioned to make responsible choices about permits and drilling, current policy puts the authority in the hands of distant federal regulators -- shutting out the local residents and community organizers who are most directly affected by these policies.

As a result, some states are lagging behind as the key to their economic future rests beneath residents’ feet.

In Texas, which does not allow the federal government to own territory, oil and natural gas jobs are booming.

Meanwhile, Arizona, Utah, and Nevada are left behind in this energy revolution because the federal government controls over 60 percent of the total combined land mass of these states and refuses to approve permitting.

To fully realize our potential, the Obama administration must lift its economic blockade of these affected states. We can’t afford to miss out on this golden opportunity to be energy independent, reduce our federal debt, and create the jobs Americans desperately need.

The agencies participating in the Taft operation on June 19, 2014 included the Taft PD, the Kern County Sheriff ’s Department, the Kern County Probation Department, Parole, Arvin PD, Bear Valley Springs PD, California City PD, McFarland PD, Shafter PD, and Tehachapi PD. Approximately 50 probationers/parolees were contacted during the operation, resulting in 7 felony arrests and 5 misdemeanor arrests (for a total of 12). The nature of the arrests included parole violations, open narcotic violations, and warrant arrests.

Liberty Under Fire The Constitution could still remove Obamacare

D By now there exist few defenders of the Patient Protection and Affordable Care Act, nicknamed Obamacare, which has shown itself to be neither affordable or capable of protecting the patient—especially from government managed plans. The “list of horribles” was mind boggling from day one, October 1, 2013, beginning with glitches for the first three months, then implementation extensions until December 15, then March 31, 2014, to keep afloat what clearly most Americans did not want.

President Barack Obama extended exemptions to unions and to congressional staffs to limit opposition.

The oft-repeated promises that one could keep his doctor and insurance plan came to be seen as Obama lies as 5.5 million, previously satisfied Americans, received notices of insurance cancelations because the private plans they had did not fit the new mandates. An avalanche of horror stories followed. One business manager of a distinguished medical group complained of the problem of just having a phone conversation with a government healthcare representative, “If you get through at all it’s 30 to 60 minutes, and then you have to get to the right person because rules change daily and too many times you aren’t given good information.”

Many of the government plans had no maximum outof-pocket costs on out-of-network providers resulting in surprising infinite costs. Even if you thought that all assisting your surgery were paid under your plan one or more might not be and you might get some unanticipated shocking bills. If, in some cases, costs seemed to be held down it was because providers had agreed to lower fees in exchange for a higher volume of patients, which meant less service and physician time for you.

By now most reasonable people are looking for a way out.

The answer remains as always the Constitution and there exist several options. Of course, the people could wise up and throw out of office every one who voted for it. Since only Democrats did so, this would change the composition of the U.S. Senate. Those remaining could rescind Obamacare. Obama would veto it but a veto override would be easy. This is not likely as the party is not willing yet to call Obamacare a mistake, naively believing that somehow it will get better.

The states too could end the federal government’s takeover of a sixth of the economy by implementing the doctrine of nullification used in our history three times before. Actually, it was successfully used recently in the Sheriffs’ Rebellion of 2013 when 336 elected county sheriffs signed pledges that they would not enforce any unconstitutional gun control laws or executive orders.

Also nine states refused to comply. The federal government backed down. Nullifying Obamacare has several sympathetic states including: Georgia, Indiana, Missouri, Oklahoma, South Carolina, Tennessee and West Virginia.

The Supreme Court also will get chances to rule the defective law unconstitutional. Yes, in a 5 to 4 majority it ruled Obamacare a tax, which, as such, is now very problematic and guarantees a return of the issue to them.

The Patient Protection and Affordable Care Act did not originate in the House of Representatives as required

in Article I, Section 7, Clause 1, “All Bills for raising Revenue shall originate in the House of Representatives.’’

It originated in the Senate. After the Supreme Court ruling, Senate Majority Leader Harry Reed gutted the language in a previously House bill, but with an earlier date, and deceptively replaced it with the language of the Senate bill to look like it had originated in the House, but it did not.

The Court ruling on Hobby Lobby, argued in mid March, is due any time. The question directly before the justices is whether for-profit corporations must provide insurance coverage for contraception, mandated by Obamacare. Hobby Lobby, a chain of crafts stores, challenged the requirement, saying it conflicts with the company’s religious principles. If the contraception challenge succeeds, it strikes down only a small part of Obamacare but several little challenges over time could weaken the law to oblivion. A strict interpretation of the Constitution would give an easy victory for Hobby Lobby as there exists no role for the federal government in Article I, Section 8 for contraception, insurance, or health legislation, nor in any amendment processed thereafter. Moreover, tax revenues were designed to be spent only for constitutional purposes—not for any purposes.

A potential constitutional challenge is found in the list of limitations on the Congress with respect to making law found in Article I, Section 9, “No Capitation, or other direct Tax shall be laid, unless in Proportion to the Census or Enumeration herein before directed to be taken.” Only the federal income tax (Amendment 16) is exempted from the proportional enumeration requirement. If the federal mandate is a tax, and not a fee, as stated by the Supreme Court, it is unconstitutional because Congress did not apportion that tax among the states according to population.

Yes, National Healthcare has shown itself to be an albatross around our necks but the Constitution can still protect us from our own ignorance if we will elect only those who will be guided by it and that would exclude many presently holding office.

Obituary

June 20 - 26, 2014

David Allen Russell October 29, 1930 – June 12, 2014 We are saddened to report the death of David Allen Russell, known to friends and family as “Hagen,” on October 12, 2014. David moved to Taft in August, 2006 and quickly became involved in the community. He loved Taft, and was a familiar figure at Sit and Sip and community events of all kinds. He had a long early career in film and television, played and sang with bands and Broadway musicals. But he was first and foremost a writer—of screen plays, novels and a couple of children’s books. He was delighted to have several articles published in The Independent in those early months. A major stroke suffered just 3 months after his arrival in Taft severely limited his community involvement and he spent the last 22 months of his life at Life House Parkview Nursing home in Bakersfield. As a young man he served in the United States Army Air Corps at the very end of World War II, winning two purple hearts for injuries suffered. David leaves behind his wife of 27 years, Christine, a Taft resident, as well as 5 children and 4 step-sons. He will be sorely missed.
