By Kent Miller Taft City Councilmembers at their meeting Tuesday evening approved spending more than $8,000 to clean-up properties at four sites in the community.

The action came after the property owners failed to respond to city Code Enforce- Clean it up! One of the buildings targeted by the city of ment Department Taft for clean-up. “At this time the city will have to pay for the clean-up and attempt to seek reimbursement of the cost,” Jones said in his materials to the council. Only one bid per property was received for the cleanups, all from J.E. Burke Construction Inc., he said.

The properties and costs are:

* 905 6th St., $2,215;

* 610 5th St., $1,057;

* 522 Kern St., $1,057;

* 407 S. 6th St., $3,822; for a total of $8,151.

Work to be done includes: disposing of trash and debris, trimming trees, cutting grass/weeds, removing or trimming overgrown vegetation, filling a sink hole at 522 Kern St., painting/removing graffiti and boarding and securing the structure at 905 6th St., and painting the walls and securing the roof for weather protection at 407 S. 6th St. ICSC Conference

City Council Approves Funding to Clean up Local Properties

Mark your calendar. This festival starts at 8 a.m. and promises fun for the entire family—what with water slide, dunk tank, music, horseshoe tournament, car & motorcycle show, decorating contest, raffles and games.

An exciting new event has been to this year’s agenda: EXHIBITION BOXING! Starting a 1 p.m. there will be 15 matches with 30 local young people participating. The winners will receive medals. This event is sponsored by SAL, the Sheriff Activity League.

Live music will provided by Mama’s Kitchen.

Thirty to 40 prizes worth $100 and $200 have been donated by various sponsors to be raffled off during the afternoon. Raffle tickets are $1, six for $5. You must be present to win.

Vendors will be selling arts and crafts, t-shirts and food. There is NO CHARGE for vendor space. The Second Annual Community Pinewood Derby August 19 The Second Annual Community Pinewood Derby will be on August 19.

Imagination Laboratories, Inc. has partnered with WSRPD and True Value to bring you this year’s event. This year’s derby will be held at the WSRPD Community Center Auditorium. Car kits are available to purchase at the WSRPD main office and at True Value home center. Registration is only $6 for a car kit and event entry. Those with their own cars will be able to register the day of the event for $4. Registration and weigh-ins are from 12:00-1:30pm and racing begins at 2:00pm. . City representatives will attend the International Council of Shopping Centers’ Western Division Conference & Deal Making Expo in San Diego in September to promote the city and its Enterprise Zone.

Terms of the city’s Enterprise Zone Memorandum of Understanding with the state require Taft officials to attend at least one ICSC-sponsored event each year, Jones told the council. In the past the city has attended the conference in Las Vegas, he said. “(But) the conference that is held in San Diego is geared toward the western United States and those companies that are seeking locations in California, whereas the Las Vegas conference has world-wide exposure,” Jones said.

The city will have a booth at the San Diego conference, while it didn’t have a booth at the Las Vegas conference, he said. The Taft Chamber of Commerce will have two of its representatives man the booth during conference hours, freeing the city manager and Enterprise Zone manager to meet with retailers and developers, he said.

Other items In other actions, the council:

* Set the 2012-13 assessment for Landscape Maintenance District No. 1 at $86 per parcel, the same as for the last several years. The fees pay for maintenance, and landscaping and lighting in the district, which covers the north side of A Street from about 600 feet west of Hillard Street to the west in the city and both sides of Terrace Drive north of A Street.

* Adopted an administrative policy for use of city credit cards and a resolution authorizing bank card services.

* Adopted a resolution creating the position of city manager/public works director and appointing Jones to the position. Jones was public works director while Bob Gorson served as city manager, then added the city manager duties when Gorson quit his post this spring.

The Environmentalists’ Misguided Plan to Repeal and Replace’ Fossil Fuels

By Merrill Matthews The Republican slogan for what to do about President Obama’s health care reform is “repeal and replace.” Similarly, environmentalists have long engaged in their own repeal-and-replace effort.

They want to “repeal” traditional energy sources - coal, oil and natural gas, which are abundant and economical - and replace them with so-called green energy sources, such as solar and wind power and biofuels.

But exactly how realistic is the environmentalists’ vision? At least for the next quarter-century, not realistic at all.

According to the federal government’s Energy Information Administration, oil, natural gas and coal were responsible for 83 percent of U.S. energy consumption in 2010. Nuclear power accounted for 9 percent.

Biofuels made up 1 percent and all other renewable sources represented 7 percent, for a renewable energy total of 8 percent - not much with which to build a dynamic, competitive economy.

But at least green energy sources will grow, right? Probably, but not by much. The Energy Information Administration estimates that by 2035, biofuels will provide 4 percent of U.S. energy consumption and renewable sources like solar and wind will make up 11 percent - for a total of 15 percent.

These estimates, meanwhile, come from the same administration that thought we would have 1 million electric cars on U.S. roads by 2015. Thus there is reason to doubt whether we will come anywhere near those Energy Information Administration projections by 2035.

Let’s see why.

- Solar Power: Solar is the clean-energy darling. On the positive side, the solar industry predicts that the U.S. will install about twice as many solar panels this year as in 2011. Prices have been declining rapidly, thanks largely to an explosion of Chinese-made panels.

There’s trouble ahead, though. The Obama administration says the Chinese are dumping cheap solar panels in the U.S. market and has slapped on new tariffs ranging as high as 250 percent, according to a Wall Street Journal report.

Never mind the political embarrassment for an administration that has poured billions of tax dollars into subsidizing our own solar industry, often with disastrous results like the Solyndra bankruptcy. Increasing the price of Chinese-made panels will depress the solar-power expansion the Obama administration is depending on.

- Wind Power: If you are driving in places like West Texas, you will likely encounter a convoy of trucks hauling massive wind turbines to their destination. But take a closer look and you’ll notice they always seem to be heading in the opposite direction of the nearest urban area.

Most people don’t like seeing or hearing those huge wind turbines. The not-in-my-backyard problem for wind power is especially acute.

Then there’s the inefficiency. Because the wind doesn’t always blow, the turbines produce only about 20 percent of the energy they could if they were able to operate 24/7. During calm intervals, the power companies have to turn to more reliable sources - traditional fossil fuels.

Plus, the wind turbines have become a bird-killing nightmare.

The U.S. Fish and Wildlife Service estimates that wind turbines kill about half a million birds a year, including raptors like eagles. That carnage is another, albeit indirect, cost of this as yet inefficient and expensive energy.

- Biofuels: Congress has mandated the use of corn-based ethanol as an additive to gasoline for years. Ethanol was supposed to be cleaner than fossil fuels. But then we learned that producing ethanol requires a lot more water, which is often in short supply. Plus it takes fossil fuels to harvest and transport it.

Oh, and using so much corn for fuel drove up demand and therefore the price, which made it unaffordable for millions of poor people in countries that depend on corn products, like Mexico.

In order to find another source, President George W. Bush, along with a Democratic Congress, decided to mandate the use of cellulosic fuel such as from switchgrass - 500 million barrels by 2012. But then the central planners discovered that the industry simply couldn’t meet any of its goals, even with billions of taxpayer dollars in subsidies.

The day may come when we can transition to clean energy, but not for decades. Until there is a real “replace” vision, environmentalists should quit trying to “repeal” fossil fuels, which are cheap and abundant, create real high-paying (non-subsidized) jobs, and are getting cleaner all the time.

Kern County Farm Bureau Votes to Oppose the High Speed Rail Project

At their July meeting, the Kern County Farm Bureau Board of Directors unanimously voted to oppose California’s High-Speed Train Project. The decision came after review of the recently released Draft Environmental Impact Report (DEIR), in which the board determined that the irretrievable loss of important farmland and the unavoidable impacts it would have on neighboring farming operations would be unacceptable to Kern County Farm Bureau’s membership.

Furthermore, the bond measure authorizing construction stressed the goal to build the system along existing transportation corridors; however, the DEIR for the Fresno to Bakersfield route is still considering needlessly criss-crossing through farms and ranches via the Wasco-Shafter bypass. The impact of which would result in the bifurcation of farming operations and rendering individual parcels of land uneconomical to farm, something the Kern County Farm Bureau had been fervently opposed to from the beginning.

The Kern County Farm Bureau joins with California Farm Bureau Federation, other Central Valley County Farm Bureaus, Kern County’s Local Governments and Legislators to protect affected farmers and our taxpayer dollars.

Orchel Krier—the Man Behind the Tumbleweed Festival

By Jane McCabe Tomorrow, Saturday, July 28th, the Tumbleweed Café in Derby Acres will be putting on its 4th annual festival. It promises fun for the entire family, what with vendors hawking arts and crafts, delicious barbecued food, and special activities for the kids like water slides and face decorating. Coveted prizes, donated by a number of Taft business people*, will be raffled off throughout the afternoon. (You must be present to win.)

An exciting new event has been to this year’s agenda: EXHIBITION BOXING! Starting a 1 p.m. there will be 15 matches with 30 local young people participating. The winners will receive medals. This event is sponsored by SAL, the Sheriff Activity League.

You can try your hand at riding the mechanical bull, listening and dancing to live music provided by Mama’s Kitchen. If you get too hot, you can dunk yourself in the dunk tank. You can view the special cars and motorcycles that will be shown. You can partake in dart or horseshoe tournaments. If you like to sing, you can participate in Karaoke. Or, you can sit at tables with your families and friends, visiting and watching the action. All told, this is an event not to be missed!

The man behind the scenes who makes all this possible is the owner and proprietor of the Tumbleweed Café, ORCHEL KRIER. Orchel is a man who wears a number of hats: He’s a farmer, a Taft City councilman, and the owner of the Tumbleweed Bar & Café. We could also add philanthropist to the list, as Orchel takes pleasure in providing special events for the community to enjoy throughout the year.

He says it’s his way of “giving back,” a principle he was taught by his family when he was growing up.

Besides sponsoring the annual Tumbleweed Festival in the summertime (probably the most ambitious event he puts on), there are annual Halloween and New Year Eve parties. He sponsors events to help young kids to stay out of trouble, providing special gifts for underprivileged youth at Christmastime.

TAFT INDEPENDENT encourages Taft employers to hire young people. He feels that Taft is unique, that its traditional values are still in place and therefore it’s not as corrupted as other places throughout the country.

Orchel is a man who likes to see others have the opportunity to succeed. That’s why he does not charge vendors or for car and motorcycle entries, and that’s why he keeps the raffle tickets to $1 each or six for $5.

The only money he makes at the festival is through the sale of food and beverages. Any profit made is returned to the community in the form of contributions to the projects he believes in.

As a farmer Orchel is a member of Kern Ridge Growers, a year-round shipper of California carrots.

Their history dates back to the early 70’s, when they started packing Cello carrots under our Kern Ridge label. Their ownership consists of six individuals who have a combined carrot experience of well over 100 years. Most of our carrots are grown in the rich, sandy loam soil near the mountain range at the southern end of the fertile San Joaquin Valley.

Kern County is one the best carrot growing regions in the country. The area is so conducive for farming, that almost 75 percent of the carrots grown in the United States are produced in California.

Almost every day, somewhere in the state, carrots are either being planted or harvested and at Kern Ridge, they can harvest up to 150,000 pounds of carrots an hour during peak season. Rain or shine, 52 weeks a year, you’ll find them picking, cleaning and packing some of the best carrots in the world.

Orchel’s grandfather developed and patented “baby carrots,” carrots that are not actually baby carrots but carrots that have been cut to size, polished, and packaged as baby carrots. Grocers will attest that baby carrots are popular-selling vegetables.

Pit Bulls: Vicious Dogs or Loving Measure C Approval Brings Pets?

Improvement Funds to Schools

By Nicole Frost Of the vast amount of dog breeds in existence, pit bulls may have the most controversial reputation.

To many families, pit bulls are loving companions and loyal protectors. For others, pit bulls pose a threat to anyone who comes in contact with them because of their strength and aggressive behavior.

Local dog-owner Bill Wickwire recently had a negative encounter with a group of pit bulls while taking his Lhasa Apso for a walk on the Taft bike path.

“There were a group of people on the lawn on the side of the path and they had two pit bull puppies and one adult pit bull with them,” said Wickwire. “As we passed, the adult attacked our dog and went right for her throat.”

There is no doubt that any unrestrained animal could be a safety issue, but for how much should the dog be held accountable?

An informal survey was given to a small amount of people in the Taft area and the results reflected mixed opinions.

Some people believed that the owner is responsible for the dog’s behavior and that pit bulls simply have a bad name.

“For anyone who gets attacked by a pit bull, it’s more than likely training issues,” said a 24-year-old Taft local. “The dogs aren’t bad if they are trained correctly and not neglected.”

On the other hand, some believed that pit bulls were more dangerous than other breeds and that they should be treated as such.

“They are dangerous! They cause more damage than other dogs and they’re harder to control,” said a 34-year-old Taft local.

There were also a few people in the survey who saw nothing negative about pit bulls whatsoever.

“I have always had pit bulls all my life,” said a 19-year-old Taft local. “They have always protected me and given me unconditional love. I have taken in ones that have been beaten, starved, abandoned, and hurt in the worst ways; never have they ever been a problem for me or any kind person that went around them. If you give an animal love, they will love you 100% times more and better.”

Even though people generally disagreed on the topic, a consensus was reached on one point: this attack should never have happened.

“People need to take responsibility for their pets,” said Wickwire. “This means they need to be able to control them, as well as clean up after them. The path is an asset to the community and it needs to be safe. I am not fully satisfied with what the city has done.”

Wickwire informed the local Animal Control about the attack, but he didn’t get a strong response.

“Animal control basically said ‘there is nothing we can do,’” said Wickwire. “What if it was a kid or if the dog attacked me? It’s mainly about safety.”

Air Monitoring Shows Pesticides Well Below Health Levels

Measure C was recently finalized and passed, allowing $23.6 million to be used by the Taft City School District to repair and renovate the district’s school facilities.

Measure C is a general obligation bond measure that was placed on the June 5 ballot this year. The measure will provide the students of Taft with a better learning environment as well as improving energy efficiency and lowering utility costs.

“The measure needed 55% approval to pass and revenue will come from homeowners,” said District Superintendent Ron Bryant. “It will cost $30 per $100,000 of assessed value per year for each property owner in the district. A large percentage of this comes from local industry.”

The first of many proposed repair projects is the addition of solar panels to each of the schools in the Taft City School District.

A large percentage of the allotted funds from measure C will be used to repair and renovate Lincoln Junior High School.

“Following the solar project, we’ll be installing HVAC (heating, ventilation and air conditioning) for Lincoln and Jefferson,” said Bryant. “We’ll also be working on a few small projects for Conely as well as renovating their bathrooms.”

The solar project is expected to begin in late August and these renovations will take approximately 3-4 years to complete.

Before they begin repairs, the district is required by law to have a bond-oversight committee.

“We need seven citizens to participate in this committee,” said Bryant. “There are spots for one bona fide tax payer group, one local industry member, two parents, two at-large members and one senior citizen. We will make more information available soon about what is expected from committee members and their duties, but the deadline to apply for these committee positions is September 7.”

Department of Pesticide Regulation (DPR) Director Brian R.Leahy announced today that air monitoring of nearly three dozen pesticides in California for the past year shows residues well below levels established to protect human health and the environment.

“We’re pleased the results indicate a low health risk to residents of the communities where monitoring stations are located,” Leahy said.

“This information is essential to help us evaluate whether our restrictions on pesticide applications are protective over the long term.”

The acrolein detections are consistent with California Air Resources Board monitoring throughout the state.

The monitoring data are posted athttp://www.cdpr.ca.gov/ docs/emon/airinit/air_network.htm and http://www.cdpr. ca.gov/docs/emon/airinit/methylbromide_2011.pdf.

DPR established the air monitoring network in February 2011 in Shafter in Kern County, Salinas in Monterey County and Ripon in San Joaquin County. Results released today also include methyl bromide residues monitored by Air Resources Board stations in Oxnard in Ventura County and Santa Maria in Santa Barbara County at DPR’s request.

Thirty-four pesticides and five pesticide breakdown products were monitored, including six fumigants and 11 organophosphates. Twenty-nine of the chemicals were detected in at least one sample and 10 were not detected. DPR selected these pesticides based on the amount of use and their potential health risks.

“Detecting pesticides in communities surrounded by farmland is not a surprise,” Leahy emphasized. “California is the only state that monitors air as part of its continuous reevaluation of pesticides to ensure the protection of workers, public health and the environment.”

The air monitoring network, the first of its kind in the nation, was established to expand DPR’s knowledge of the potential health risks of long-term exposure to pesticides. DPR scientists sought more accurate estimates of health risks based on long-term exposure rather than extrapolation from short-term monitoring data to help them determine if additional protective measures are needed.

The network is a follow-up to DPR’s groundbreaking pilot projects in Parlier in Fresno County in 2006 and Lompoc in Santa Barbara County in 2000, which lasted 12 months and 10 weeks, respectively.

DPR is using these data to compare pesticide concentrations with screening levels developed by its scientists, track trends in air concentrations and correlate concentrations with use and weather patterns. DPR set the screening levels in the absence of federal or state enforceable health-based limits on pesticide emissions in air.

Although not regulatory standards, the screening levels are guideposts for preliminary evaluations of air monitoring data.

Liberty Under Fire What if the Supreme Court Refuses to Protect the Constitution?

What Then?

By Dr. Harold Pease What if the Supreme Court became an arbitrator trying to please both sides rather than “letting the cards fall where they may,” ruling alone on constitutionality as designed? In the end neither side is really happy and the Court’s function is blurred or discredited. What if preserving its own image became more important to justices than defending the Constitution? Or worse, what if the Court forced a round peg into a square hole, so to speak, to force a decision not intended, or argued for by either side therefore creating new law—a function of Congress alone? What if all of the above were in one decision such as with the recent Supreme Court decision on National Healthcare? How can the states or people keep the Supreme Court in line with the U. S. Constitution? The answer is in the Constitution as understood by the Founders.

Our constitution first divided power between the states and the federal government with the powers given to the federal government listed, defined and limited and those of the states left undefined and not listed, as per Amendment 10. This is known as federalism and is sometimes thought of as a marriage—shared and equal—neither the state nor federal government the master nor slave of the other.

The portion of power left to the federal government is then divided between the legislative, executive, and judicial branches.

The down side of federalism (our marriage) is that the umpire is one of the three branches of government at the federal level and as such is likely to rule in favor of a strengthened federal government were it to arbitrate between the states and the federal government. It is equivalent to two adversarial teams playing basketball and the referee is a member of the federal team. The balancing component to this, potentially lopsided division of power, is the doctrine of nullification.

Is it constitutional to say no to the federal government when a state believes a Supreme Court decision to be unconstitutional?

One having a limited knowledge of the Constitution would say no and cite Article VI, the supremacy clause, as the end of the matter. On matters listed in the Constitution he would be right, but this time the Supreme Court has ruled on something where it lacks authority to rule, clearly a state issue, and as such, if left unchallenged, certainly damages, perhaps even nullifies, the 10th Amendment of the Constitution, which leaves to the states all areas not delegated to the federal government. This understanding pre-existed any law on health by a couple of centuries.

To curb the umpire (Supreme Court) should he clearly favor one side, the Founders supported the doctrine of nullification.

Rather than sue the federal government for having exceeded its constitutional power, the 26 states so doing should instead have followed the Idaho example and in essence said “not in our state.” The effort to grow the federal government beyond the listed bounds would have been unenforc able if enough states did so.

Such has two historical precedents. Thomas Jefferson in 1798 attempted to nullify The Alien and Sedition Acts created by his Federalist Party predecessors. These raised residency requirements for citizenship from 5 years to 14. Moreover, the law allowed the president to deport “dangerous” foreigners during times of peace and imprison them during times of hostilities.

Anyone defaming or impeding government officials, including the president, was subject to heavy fines and/or imprisonment.

Jeffersonians objected on the basis of the unreasonable empowerment of the president and the attack on the First Amendment, particularly freedoms of speech and press. They too said, “no will do.” Because nullification was better understood as part of the “balance formula” of the Constitution and because the offending law was designed to last only until 1801, (Federalists did not want it used against them should they lose the next election), nullification stayed in place.

Next to use the Nullification Doctrine was South Carolina with respect to the 1828 “Tariff of Abominations,” believed by them, and neighboring states, to be unconstitutional. Opponents to it declared it to be “null and void” within their border and threatened to take South Carolina out of the Union if Washington attempted to collect custom duties by force.

President Andrew Jackson prepared to invade the state. A compromise Tariff of 1833 gradually lowered the tariff to acceptable levels and the issue faded away.

One might argue that the Civil War ended the Nullification Doctrine but the real root cause of the Civil War was the practice of slavery, (I am aware that the immediate cause was keeping the union together), which practice made a mockery of the whole liberty concept. The slave issue pre-dated the Declaration of Independence and I would need another column to show why the war did not exempt the nullification argument.

Critical to the success of the Nullification Doctrine is the number of states committed to it. Obviously one state or a few, unable to prevail at least a majority to follow, would be easily overpowered by an overwhelming federal government power.

But if the 26 states, who sued the federal government on the mandate issue, now said we will not comply, the federal government would be forced to find a face-saving exit on the issue and back down. That is the final constitutional check on overreaching federal power—the one least talked about and understood.

If, at this time, the states do not care enough to preserve their power they deserve not to have it, or liberty.

Chris is survived by his mother, Lovena (Blize, Russell) Beaird, and brother, Darrin Roy Russell of Puyallup, Wa., sister Evonne (Beaird) Germano of Florida and brother John Beaird of Nevada and his children Ashley Christine Russell of Seattle, Wa., and the light of his life, William Taylor Russell age 10, of San Antonio, Tx. His aunts and uncles include, Ray and Lodema (Blize) Hatch of Taft, Ca., Leon Blize of Maricopa, Ca, Howard and Paula (Blize) Hudgins of Taft, Ca., Donnie and Jan Russell of Scottsdale, Az, Cliff and Brenda (Russell) Doenitz, of New Braunfels, Tx., and Great Uncle Max and Great Aunt Wanda Russell of Taft, Ca., and his Great Uncle Gerald and Great Aunt Karen Creason of VanCouver, Wa. Many Taftians may not recognize that Caryn Hatch Breslin and Kathy Hatch Fitzsimmons are sisters and first cousins to Chris and related to all Russells in Taft.

A Celebration of Life service was held at Chris’s church, the Covenant Presbyterian Church on Friday July 20, 2012 in San Antonio, Texas.

Chris chose University of Sound Arts school upon graduating from high school in Camarillo, Ca., which opened the door to his career in Radio which he dearly loved. He was part of the Seattle station KZOK in the 80’s as YCR (Young Chris Russell) and worked with Jimmy Kimmel for several years. He moved to South Padre Island, Tx., and was an on air personality for Charlie Trub for a few years. He then had a chance to move to San Antonio, Tx. and for the next 17 years worked for KZEP, WAOI, and Clear Channel as well. Joe Pagliarulo (Pags) was a true friend and constant supporter.

Friends of Chris share that he had a great sense of humor, was a great boss, a true professional, had an infectious good nature and not a mean bone in his body and an avid Seahawk fan. GOOOOO Seahawks!!!
