PRESIDENT’S PERSPECTIVE NEW IDEAS AND INITIATIVES TO BENEFIT OUR ASSOCIATION
F
or those of you that did not attend the TLW Fall Convention and Trade Show in Appleton, let me introduce myself. I am Chris Marsicano, your new president of the Tavern League of Wisconsin. I co-own and operate The Village Supper Club in Delavan located in Walworth County. My brother, Dave and I have owned the supper club for the last 30 years, taking over from our parents who started the business in 1966. We have been an active Tavern League family since we joined 51 years ago.
My father was an active member of our local league for many years and instilled in me the necessity of belonging to the TLW and its importance in helping us succeed in business. I joined my local league board in 1989. In 2002 I was elected to the position of secretary/treasurer and was urged by district leaders to run for a position on the TLW state board. Over the last 16 years I have served as first district director, southern zone vice president and senior vice president. As your new president I look forward to getting around the state to meet as many of you as I possibly can. The success of this association lies with you, the members, and I intend to serve your needs to the best of my ability. I have many new ideas for the TLW that I wish to implement to help increase your business profits and raise your visibility to new customers. We will be using social media programs that are available to us such as Twitter, Snapchat, Facebook and an improved TLW app to help increase customer awareness of your business, specials and events. One of our new ideas we will be implementing is a YouTube channel for Tavern League members. This new tool will allow us to get you the latest, up-to-date information on legislation and regulations that will affect your business in a visual and easy to understand format. An already successful Tavern League program available only to members is SafeRide. The TLW has been on the leading edge of this program to help get impaired patrons home safely. We have exciting new improvements and updates to SafeRide in the works that will help make it easier and more economical for our members and local leagues to use. Keep watching for all of these exciting developments. As always, the success of the TLW lies with you, our members, and we will use these new ideas to help our local leagues improve membership and attract new industry owners and businesses. This special issue of On Premise is another tool to help promote and educate liquor license holders. It is geared to the member as well as the nonmember and it is being mailed to all liquor license holders in the state. We hope current members will use this as a refresher of all the great things that the TLW has done and will continue to do, including the programs and incentives that are available to you. For the nonmember, I hope you will look at all the that Tavern League has to offer you and become a part of the TLW family. The cost of membership is only 42 cents a day, a small price to pay for the knowledge that someone is looking out for your interests in Madison and Washington D.C., while you are busy running your establishment. There is strength in numbers! Feel free to contact one of the Tavern League of Wisconsin Leaders in your area listed in this issue, with any questions or to sign up. As Executive Director, one of my goals is to increase the value of membership. After reading this article, I think you will agree that a $150 per year for membership is a pretty good deal. Our Member Exclusive Benefit Program lists a number of businesses that have either a product or service to offer TLW Members. They are part of this program because they offer a discount on that product or service that a non-member cannot receive. Approximately 20 businesses participate. Once you become a member, simply go to our “Members Only” section of our website and click on Member Exclusive Benefit Program for participating businesses and see if they have a product or service you can use. Time is money. One benefit that can save you time and money is our toll free number. Many members use our 800 number to get legal questions answered or they are in search of an item for their business. Occasionally someone will call wanting to know if something is legitimate or a scam. Our 800 number is invaluable and can save you time and money if you choose to use it.
The same can be said with our online bartender training. 360Training and the TIPS program are two online courses that are state approved and give a discount to our members. These discounts are not available to non-members. This is another example of how we put money back into our members’ pockets.
Finally, I would be remiss if I didn’t mention our SafeRide Program. Last year, almost 100,000 rides were given free of charge to patrons. Grant/Iowa County Tavern League Puts Together a Winning Plan By Jennifer Bradley an Timmerman, the past president of the Grant/Iowa County Tavern League says in the five years he was in that post, the county’s league membership grew by about 65. He attributes the growth to the directive given by TLW Executive Director Pete Madland for each league to appoint a Membership Committee Chair. In Grant/Iowa County, that role was taken on by Jerry Day.

“What Jerry did to drive membership was exemplary,” says Timmerman. “He and I became good friends and worked together a lot.” Timmerman says he first developed a membership log that tracked three categories: 1) Who left the league and why 2) A two-month tally of memberships that had expired in the last month and whose membership was expiring in the current month 3) A list of potential members and members whose memberships had expired
A number of individuals joined and have remained members, and uniquely, had their first year membership paid through a league fundraising trap shoot tournament. “We now have a spring and fall trap shoot, which requires host sites to be members,” he explains. Another focus for membership included area chambers of commerce that sell alcohol at events. They’ve joined and so have a number of local golf courses. Again, Timmerman says the Grant/Iowa League’s golf tournaments are rotated and must be hosted by a TLW member.
“With that we could be a bit more analytical and systematic in our approach to identify the direction to take and who to go see,” explains Timmerman, who adds that the Grant/Iowa league territory is an hour and a half drive from one end to the other.
Even Southwest Technical College in Fennimore has joined the league, as they have events where alcohol is served. Their relationship has strengthened further due to the league’s decision to give a scholarship to a student to attend the college. In addition, Grant/Iowa County also has members that are microbreweries, wineries, mini marts, cheese stores, gas stations, event hotels and reception centers.

BUILDING THE ROLODEX
There were some specific ideas the league implemented which worked well during this time. First, during the Veterans Administration scandal in 2014, where negligence in the treatment of U.S. military veterans was first reported, the team reached out to local VFW and American Legions who were not TLW members. Also, it developed a patriotic poster that showed the economic impact that member and nonmember businesses have in their respective communities in terms of jobs, taxes paid, charitable donations, etc. The poster’s title was “We Proudly Serve Those That Proudly Served” and Timmerman says this worked well.
Speaking of relationships, Timmerman believes that relationship building is the key to membership success and longevity. “The league has established and maintains open lines of communication by inviting guest speakers from county boards and sheriff departments in Grant, Iowa and Lafayette counties,” he explains. At these meetings, the league encourages members to have an “open door” policy and to talk about real issues. “We talk things out, and to that end there’s been times they’ve [sheriff departments] asked us if there’s anything we can do to identify problems and help them concerning drug issues.” Without developing relationships with members, he says it may be easy to sign up someone, but the next year they could drop off. Timmerman wants league members to fully understand why it’s important to be a part of the TLW and what type of help the league can provide.

THE ROLE OF TRADE ASSOCIATIONS THE AMERICAN BEVERAGE INSTITUTE WEIGHS IN BY RICK BERMAN
T
rade associations are a hallmark of American enterprise. Through the collective influence of businesses in a similar sector, even the smallest of industry players can contribute to legislative victories and public opinion achievements. Because in this sense, the many are always greater than the few. This is where my association plays a vital role for our membership. The American Beverage Institute (ABI), founded in 1991, is dedicated to protecting the responsible on-premise consumption of alcoholic beverages. Our membership consists of companies involved in the production and sale of these beverages — including America’s favorite restaurant chains, independent operators, brewers, wineries and distilleries. Together, we stand for the freedom of consumers to enjoy a glass of their favorite beer, wine, or spirit without being harassed by intrusive laws based on faulty science and statistics. As Tavern League members know, it is more important than ever for our industry to band together. Both our memberships are under constant attack on several fronts—most recently a ridiculous campaign from the National Transportation Safety Board (NTSB) to lower the blood-alcohol arrest level for driving from .08 to .05.
The move by the NTSB is based on a false narrative that needs to be confronted head-on. Utah recently passed legislation that imposes this illogical .05 threshold, but it doesn’t go into effect until the end of 2018. ABI has already been heavily involved with the issue in the state—most notably with an attention getting advertisement campaign and aggressive media engagement. We have a plan in place to reverse the law and those efforts have already shown promising results. The governor and some legislators have voiced their regret over the passing of .05 and plan on reopening debate during the next session. Walking back the Utah law is important, but of larger concern to us—and every Tavern League member—is the potential for copycat legislation to spread to other states. After enough states get on board a federal law becomes easier to pass. It is the history of .08. As an industry, we must work together to stop this one idea in its infancy. It’s easier and cheaper to go on the offensive now than to wait for the fight to come to our doorstep.
If implemented, a .05 BAC arrest level would destroy many business interests and the lives of social drinkers accused of drunk driving after two drinks. The risks to consumers—including jail, fines, loss of license, attorney fees, increased insurance premiums, and the social stigma of being labeled a drunk driver—are so immense that alcohol sales in restaurants, bars, and taverns will drop off dramatically. Some of our members will go out of business. And that is a goal of those activists who spend a lifetime trying to reach that conclusion.
This campaign is just one example of the role trade associations like ours can play and the results they achieve. The Tavern League is one of the best in the government game. And I call it a game because there are winners and losers every year. The TLW and its leadership have scored with an impressive string of legislative victories, including securing third party exemptions for Dram Shop Liability Insurance or reducing the penalties for members who occasionally need to refill shelves faster than wholesalers can move product. The TLW also has an impressive track record of stopping anti-business legislation where other retail groups have failed in other states. It’s an organization punching above its weight class. Anyone with a Wisconsin license to sell alcohol needs to spend some time and money supporting the TLW. TLW

WHY ASSOCIATION MEMBERSHIP? IT’S THE MOST IMPORTANT INSURANCE YOU CAN BUY FOR YOUR BUSINESS By ABL Executive Director John Bodnovich
T
he American Society of Association Executives (ASAE), which serves as the “association for associations,” defines an association as “an organization or group of individuals affiliated with one another who share a common purpose, interest, or mission and exist for the mutual enrichment and advancement of their membership.”
While there is an association for just about every industry, profession, issue and cause, the motivation for individuals and groups to participate can vary widely. All associations – regardless of their mission - play important roles for the members and constituents.
YOUR VOICE IN WASHINGTON As a single, strong voice from retail beverage licensees, American Beverage Licensees (ABL) is the Tavern League of Wisconsin’s national association that speaks for independent bars, taverns and package stores in the nation’s capital. Having a strong advocate in Washington can sometimes be hard to quantify and qualify. Questions can arise anytime there is an economic downturn or pause, and people start to take stock of how best to spend their hard-earned dollars. Even though the retail beverage alcohol industry may go through occasional downturns, I strongly believe ABL remains a worthy investment. While people never expect the worst to happen until it occurs, independent business owners still protect themselves with insurance.
ANOTHER FORM OF BUSINESS INSURANCE As TLW Executive Director Pete Madland likes to point out, a tavern owner pays for insurance for things ranging from health, life, liability, crime, fire and a multitude of others. But what some people don’t understand is that their membership in TLW and ABL is insurance from those who might make policies that would harm their businesses. Your associations – TLW and ABL – are watching out for you and your business, protecting it should problems arise. An ABL membership is an insurance policy from harm that

the federal government might intentionally or unintentionally cause you and your business. How does ABL protect your business? Among the various roles that an association plays, there are four that are nearly universal: STRENGTH IN NUMBERS: ABL serves as a single voice amplified by thousands of its members who are very difficult to ignore. ABL coordinates TLW members and other members from its 28 additional state associations to send messages on a range of issues important to beverage retailers, providing a clear, concise argument to legislators and regulators. NETWORKING: ABL works on its own and with industry allies to sponsor or host events throughout the year to spread the message of its members and to connect retailers with one another. The ABL Annual Meeting, and other events on Capitol Hill, provide opportunities to ask questions, share ideas, and learn more about the industry. INFORMATION: Through e-newsletters like the ABL Weekly, membership magazines like the ABL Insider, grassroots action alerts, and social media accounts, ABL stays a step ahead and provides members with timely updates and information on issues impacting them directly. This includes alerts and calls-toaction about new legislation that would threaten your business, to sharing news stories from a wide range of local and national publications on a daily, weekly, monthly or quarterly basis. ADVOCACY: Sharing a single message to promote and defend issues and positions before state, local and national legislators and policy makers, ABL plays a vital role in ensuring the concerns of their members are addressed. This work is undertaken on several fronts, including meeting directly with legislators and their staff, providing technical or specialized information, producing policy documents, and attending hearings or meetings.
PROMOTING THE ROLE OF INDEPENDENT BARS & TAVERNS ABL advocates before Congress on the interests and issues of beverage alcohol retailers including but not limited to .05 BAC and ignition interlocks, music licensing, debit card swipe fees, small business and estate tax reform, and labor rules. ABL also provides a unifying network for the retail tier of the beverage alcohol industry, which recognizes that while all state www.tlw.org
alcohol laws are different, they are not necessarily dissimilar. Tavern owners in Wisconsin may share a lot more in common with tavern owners in other states than it may initially appear. The tavern industry in Wisconsin has an annual economic impact of $14.67 billion, creates and maintains over 120,000 jobs, pays $4.92 billion in wages and benefits, and pays in excess of $760 million in state and local taxes and an additional $1.06 billion in federal taxes.

ABL Dispatch – The Latest Industry News From Washington By ABL Executive Director John Bodnovich 2018 ABL ANNUAL MEETING
“CRAFT BEVERAGE MODERNIZATION” UPDATE
The 2018 ABL Annual Meeting will be held March 11-13 at Harrah’s New Orleans Hotel & Casino in New Orleans, Louisiana. Registration for the meeting is open, so be sure to visit ABL at www.ablusa.org for all the latest information.
The broader conversation about tax reform on Capitol Hill could also determine the fate of another piece of tax legislation that is supported by nearly all alcohol industry supplier trade associations. As of September 10, the Craft Beverage Modernization and Tax Reform Act (CBMTRA) (S. 236; H.R. 747) has attracted 46 Senate and 258 House cosponsors. The bill, which would provide federal excise tax relief to alcohol producers, is supported by the American Craft Spirits Association, Beer Institute, Brewers Association, Distilled Spirits Council, WineAmerica and the Wine Institute. The lead lawmakers on the bills are Senate Finance Committee Ranking Member Ron Wyden (D-OR) and Senator Roy Blunt (R-MO); and Reps. Erik Paulson (R-MN) and Ron Kind (D-WI) in the House.
GOP TAX BILL PLANS Much has been made about House Republicans’ plans to reform the tax code through a sweeping reform bill that would simplify taxes while reducing corporate tax rates that are viewed by party leaders as burdensome and out of line with other industrialized countries. However, it remains unclear when the Trump Administration and Congressional GOP leaders will be able to move on tax reform thanks to a shrinking legislative calendar. For beverage licensees, a major tax reform bill could have an impact in a handful of different ways: • BORDER ADJUSTABILITY TAX: Formerly a potential source of revenue to off-set rate reductions, Republican leaders have taken this off the table, thus eliminating a highly contentious issue that had pitted dueling business factions against each other, and making passage of a reform package more unlikely. Had border adjustability been implemented, it likely would have meant an increase in prices of imported beverage alcohol products. • ESTATE TAX: As part of the tax reform principles introduced by House Ways & Means Committee Chairman Kevin Brady (R-TX), the Estate Tax would be fully repealed as part of the tax plan. Beverage licensees have long held the belief that the best way to protect all family-owned businesses from the estate tax is by repealing it permanently. • S-CORP/PASS-THROUGH ENTITIES: Most ABL members’ businesses are structured as “pass through entities” for federal income tax purposes. These sole proprietorships, partnerships and LLCs and S corporations are not subject to income tax. Instead, the owners are directly taxed individually on the income, considering their share of the profits and losses. As Congress debates lowering corporate rates from 35 percent to as low as 15 percent, beverage licensees are urging legislators to make sure that pass-through rates are kept comparable to corporate rates to encourage more job creation. It remains unclear how potential tax legislation would address pass-through taxation rates and it is unlikely that the public will know much more about it until language is released.

“DEATH TAX REPEAL ACT” UPDATE The Death Tax Repeal Act (S. 205; H.R. 631) now has 99 House co-sponsors and 35 Senate co-sponsors. The text of this legislation may be included in a larger tax reform package being worked on by House Republicans. ABL has signaled its support of the legislation via letters from the Family Business Estate Tax Coalition and the Family Business Coalition.
END DRUNK DRIVING ACT On July 24, Rep. Kathleen Rice (D-NY) introduced the End Drunk Driving Act of 2017 (H.R. 3374), which has been referred to the House Transportation and Infrastructure Committee. As of September 10, the bill does not have any cosponsors and no similar legislation has been introduced in the Senate. Rep. Rice is a career prosecutor from Long Island who in 2006 was named the “state’s toughest DWI prosecutor” after leading a number of public initiatives to fight drunk driving. Rep. Rice initially announced that she would introduce the bill in Dec. 2016. It: • Requires that within 10 years, all new cars sold in the U.S. must be equipped with advanced technology that prevents the car from moving if the driver’s BAC is at or above the legal limit. • Boosts funding for the Driver Alcohol Detection System for Safety (DADSS) program to help ensure the technology is fully developed within 10 years. • Withholds highway funding from states that don’t have mandatory use of ignition interlock devices for all offenders. www.tlw.org

On Aug. 31, Judge Amos Mazzant struck down an Obama Administration rule that would have required employers to pay overtime to most salaried workers who earn less than $47,476 annually, a marked increase from the current annual salary limit of $23,660. Judge Mazzant ruled that the Department of Labor improperly looked at salaries instead of job descriptions when determining whether a worker should be eligible for overtime pay.
• Congress continues to push forward on developing federal laws for self-driving cars. The House easily passed a bill on Sept. 6 that would give wide authority to the National Highway Traffic Safety Administration to oversee development and testing. The legislation, which was supported by manufacturers who argue that a patchwork of state laws could slow innovation, would allow for as many as 100,000 self-driving vehicles per year to be exempted from safety standards as technology is developed.
Judge Mazzant found that the Obama Administration’s proposed overtime rule went beyond Congress’ intent in determining who should be exempt from overtime pay. “If Congress was ambiguous about what specifically constituted an employee subject to the [executive, administrative and professional] exemption, Congress was clear that the determination should involve at least a consideration of an employee’s duties,” Mazzant concluded. Since taking office, the Trump Administration has asked for public comment on changing the overtime threshold instead of mounting a vigorous appeal to the judge’s ruling.
TIP POOLING REGULATIONS UNDER SCRUTINY On July 20, the Trump Administration announced that it plans to address tip regulations under the Fair Labor Standards Act (FLSA), a 2011 Obama Administration regulation that limits tip pooling. It is generally expected that the Trump Administration will recommend that the Obama-era rule, which prohibits employers from pooling or sharing tips among staff that traditionally receive tips with other non-tipped employees, be rescinded thus giving on-premise establishment owners and operators more ways to distribute tips among staff. Current regulations state: “Tips are the property of the employee whether or not the employer has taken a tip credit under section 3(m) of the FLSA. The employer is prohibited from using an employee’s tips, whether or not it has taken a tip credit, for any reason other than that which is statutorily permitted in section 3(m): As a credit against its minimum wage obligations to the employee, or in the furtherance of a valid tip pool.” From the Department of Labor announcement: “Section 3[m] of the FLSA, 29 U.S.C. 203[m], provides in part that an employer may take a partial credit [tip credit] against its minimum wage payment obligation to a tipped employee based on tips received and retained by the employee. The Department’s regulations limit an employer’s ability to use an employee’s tips regardless of whether the employer takes a tip credit under Section 3[m] or instead pays the full FLSA minimum wage directly to the employee. In this Notice of Proposed Rulemaking, the Department will propose to rescind the current restrictions on tip pooling by employers that pay tipped employees the full minimum wage directly.” As of early September, a Notice of Proposed Rulemaking – the next step in the process to rescind the regulations – has not been issued. www.tlw.org
• The “Rohrabacher-Blumenauer amendment” has received a stay of execution, but it is far from permanent. Introduced by Rep. Dana Rohrabacher (R-CA) and Rep. Earl Blumenauer (D-OR), and included by Congress in spending bills since 2014, the amendment prevents the Department of Justice from using federal money to enforce prohibition measures against states that approved medical marijuana consumption. In early September, the House Rules Committee blocked multiple marijuana-related amendments to FY 2018 funding legislation, including the RohrabacherBlumenauer amendment. However, thanks to an emergency aid package for Hurricane Harvey victims which included an extension of federal funding, the law will continue to be in place through Dec. 8. • The South Dakota Supreme Court heard oral arguments on Aug. 29 in a case that could ultimately persuade the United States Supreme Court to revisit Quill Corp v. North Dakota, a 1992 decision that prevented states from requiring retailers without a physical presence to collect sales tax. The case, South Dakota v. Wayfair, Inc., stems from a 2016 South Dakota law that requires out-of-state retailers to collect and remit sales tax if they transact more than $100,000 of business in the state or more than 200 sales. The law passed overwhelmingly by the state legislature and was introduced following a ruling issued by the U.S. Supreme Court in which Justice Anthony Kennedy noted that “it is unwise [for the U.S. Supreme Court] to delay any longer a reconsideration of the Court’s holding in Quill” and asked the “legal system [to] find an appropriate case for this Court to reexamine Quill.” • On June 8, Judge Samuel Der-Yeghiayan, writing for the U.S. District Court for the Northern District of Illinois in Lebamoff Enterprises v. Rauner, held that Illinois law prohibiting an out-of-state retailer from directly shipping beveragealcohol to an in-state consumer did not violate the Commerce Clause. The case was brought by Joseph Doust, who runs 15 wine stores in Fort Wayne, Indiana through his corporation, Lebamoff Enterprises. The ruling is in line with previous court decisions concerning retail alcohol shipping challenges on Commerce Clause grounds. he giving season is now in full swing. But as TLW members know, there’s no beginning or end to giving for the Tavern League of Wisconsin. Across the state, Tavern League members, both individually and through the activities of their local leagues, are constantly giving back, helping families and individuals in need, supporting worthy causes, and building and strengthening their local communities. Last year alone, Tavern League members donated more than $12.8 million to over 27,000 charities. “It is important for any business, not just tavern owners, to give back to the community that supports their business. It is a two-way street. When the community is strong, everyone can prosper,” says TLW Executive Director Pete Madland. “I cannot express the pride I have in our members for all of the charity work they participate in. These are not necessarily wealthy people, yet they continue to give, year in and year out. They are a very caring and giving group.” In addition to supporting thousands of local causes, the Tavern League of Wisconsin and its members are also contributing to two worthwhile organizations that touch both the state and nation: CORE, which the TLW counts as its leading charitable cause and is a sustaining member, and Fisher House Wisconsin. Here, we get an update on both of these great organizations and how the TLW is helping them help others in need.
“CORE grants support to children of food and beverage service employees navigating life-altering circumstances,” says Kilduff. “Each grant is specifically catered to be the most sustainable and impactful for a family. We’re even able to set up experiences for families that are grieving or recovering, to create a special memory.” Grant recipients work all over the country and industry, including chefs, cooks, servers, hosts and bartenders from restaurants, cafes, concession stands, cafeterias, breweries, food trucks and more. CORE can grant support to a family going through a circumstance like a car crash, house fire, medical diagnosis, death of a child, loss of home due to natural disaster, etc. The organization can also provide support by paying for medical bills and therapies
CORE HELPS A UNIQUE NICHE OF EMPLOYEES When Jordan Senrick’s son Jaxson was diagnosed with transverse myelitis, she was struggling. A single mother, her time was tight and her money tighter as she tried to balance work, life and the critical work of caring for her young son. Then, in 2016, CORE gave Senrick a bit of a reprieve. CORE, which stands for Children of Restaurant Employees, was founded in 2004 by five food and beverage service industry members who realized they were doing a lot of amazing philanthropic work, but that very little of that philanthropy was focused on supporting the actual employees, explains Emily Kilduff, CORE program director. From this realization, they started an organization that specifically focused on the core of the food and beverage service industry — its employees—and specifically, their children. Since 2004, CORE has raised over $2.5 million and granted support to more than 255 families across the industry and the country, including ten in Wisconsin. Senrick and her son are among those served in Wisconsin. www.tlw.org

for children, funerals and memorials for children, rent or mortgage and utilities, groceries, clothing, toys and more. “Many people who work in the food and beverage industry are more vulnerable when a life-altering circumstance occurs because if they don’t work, they are not getting paid. They may not have health insurance, work odd hours, or are not able to get shifts covered,” says Kilduff. “CORE is here to take away at least a bit of the stress,” which is exactly what they did for Jordan Senrick.
FAMILIES IN NEED — UNBURDENED When Jordan put her son Jaxson to bed one night in April 2013, he was fine. But when he woke up, half his body was paralyzed. After a week in and out of the hospital, Jaxson was diagnosed with transverse myelitis, a neurological disorder that interrupts the messages that the spinal cord nerves send throughout the body, it can cause pain, muscle weakness, paralysis, sensory problems, or bladder and bowel dysfunction. Recovery for Jaxson meant therapy six days per week, which kept Jordan from working regular hours. Luckily, her parents own Meister’s Bar & Grill in New Richmond, and she was able to work at the bar when she could, but that wasn’t enough. To further complicate matters, Jaxson’s father took his own life in March 2016.
think much of it at first, she eventually reached out … and she’s so glad she did. “They have helped so much; I can’t even express how much their help means to me and Jaxson,” says Jordan. CORE provided Jordan with a grant to pay four months of rent, purchased an iPad to help Jaxson with his therapy, sent Jordan, Jaxson and Jordan’s best friend on a short, but much-needed getaway, and provided gift cards to help Jordan buy supplies for Jaxson as he started preschool. While Jaxson has made a remarkable recovery, something only about one-third of patients with this disorder achieve, the family stays in contact with the staff at CORE. “You are part of a whole family with CORE,” Jordan says. “It’s amazing to know they are there to take the weight off your shoulders.”
“I was barely staying afloat,” Jordan says of that time. “Everything seemed to be falling apart around me.”
The Tavern League of Wisconsin is an important partner of CORE by nature of the state’s strong food and beverage industry and rich tavern culture. “These bars and taverns tend to be family-owned, smaller-staffed, and more intimate than chain bars or restaurants, which leads to amazing culture and atmosphere but heightened vulnerability when something extreme happens in the lives of food and beverage service employees,” says Kilduff. “We’ve found that Wisconsin employers are eager to find supplemental help for their employees when some life-altering circumstance occurs, and we’re honored to grant support in these areas.”

about CORE; she encourages members to contact the organization for support materials for employees. “When something happens to one of your families, we want to make sure we’re always a backburner resource for Tavern League members,” she says. While CORE is designed to support children, grants are also available to parents and guardians in the food and beverage industry who have at least one dependent. FISHER HOUSE WISCONSIN The last time Fisher House Wisconsin graced the pages of On Premise in earnest, the facility was not yet in existence; plans were still underway and a groundbreaking ceremony was on the calendar for June 2014. But a lot has changed in three years. On April 23, 2016, Fisher House Wisconsin was dedicated and to date, the facility has served more than 1,000 families whose loved ones have received care at Milwaukee’s Clement J. Zablocki VA
The TLW has a long history of supporting Fisher House of Wisconsin, a home for military families with a veteran receiving care at Milwaukee’s Clement J. Zablocki VA Medical Center.
Medical Center. A home away from home, veterans and their families who live beyond a 50-mile radius of the associated medical facility can stay at a Fisher House for free when they’re receiving care at the facility. The Milwaukee VA serves veterans from 23 different states spanning a range of medical needs, and it is particularly renowned for its state-of-the-art spinal cord injury unit. “Many of those patients cannot afford to have their spouse or loved one travel with them due to financial reasons and are faced with the challenge of straining to arrange for travel expenses or perhaps undergoing treatment alone,” says Andrew Roberts, Fisher House Wisconsin President. “Fisher House believes a fam-

HOME AWAY FROM HOME Fisher House Wisconsin is a 16-suite, 13,000-square-foot home with a beautiful patio overlooking the VA grounds. Each suite can accommodate up to eight people and includes a private bathroom and sleeping area. Shared amenities include laundry facilities, a living room with a library and toys for children, and a large common kitchen and large dining area. If all Fisher House Wisconsin suites are full and there is a family in need, Fisher House will cover the hotel charges for the family to stay off campus either until a room opens at Fisher House, or their loved one is discharged. “[Fisher House is] a place of comfort and a support network for families to lean on. The Fisher House Wisconsin organization was instrumental in ensuring all of the amenities that were needed to open and operate the home were put in place so when our first guest arrived, they felt welcomed and supported,” says Roberts. While securing the location and building and opening the facility were small victories unto themselves, the biggest win is how guests have responded. “The look on the faces of our guests says it all when they arrive. There is a sense of awe that there is a facility like ours that is meant just for them,” says Roberts. “A couple of our favorite quotes that capture the sentiment are ‘This is for me?’ and ‘Grandma, I love your new house.’” Operated as a public-private partnership, the work of maintaining Fisher House Wisconsin hasn’t stopped since it opened in 2016; ongoing support is needed. “Our vision is to make Fisher House part of our community, a home we collectively support and use to host our veteran families,” explains Roberts. “Whether it be transportation to and from the airport, food and drink within the home, housing families off campus, or purchasing the various accessories that help

Vetsroll Honors Our Nation’s Heroes New initiative will send those who sacrificed so much to Washington, D.C.
T
he Tavern League of Wisconsin is partnering with VetsRoll Inc.® to help send deserving WWII-era and other senior military veterans and “Rosie the Riveters” to Washington D.C. to view the memorials erected in their honor. Until March 15, 2018 the TLW, and its local leagues, districts and individual members are encouraged to raise funds to send these heroic individuals on this four-day trip of a lifetime. For every $1,000 raised, the TLW will help one vet or “Rosie” make the May 20-23, 2018 trip. A check presentation representing funds raised will occur at the TLW spring conference in Milwaukee. New TLW President Chris Marisicano, who is spearheading the Tavern League’s participation, explains that the award-winning VetsRoll concept was conceived in February 2010 by Mark Finnegan and his family as a way to honor their deceased father, Cy, a WWII Navy motor mechanic and their mother, Barbara, a WWII “Rosie-the-Riveter,” who held jobs in war support, including work as a code-breaker for the Army at the War Department in Arlington, Virginia. After learning of the Honor Flight program, which flies vets to Washington, D.C., the Finnegans decided to create a similar program, but at a slower pace via a caravan comprised of motorhomes from their business Finnegans’ RV Center in South Beloit, Illinois. The four-day trip, as opposed to the one-day honor flight, offers more flexibility for socializing plus at a maximum of three hours on any leg of the trip, the traveling experience is much easier and it eliminates parking garages, long walks and security checks. The first Vets Roll trip departed on May, 17, 2010 with 117 WWII Veterans, eight “Rosie-the-Riveters” and 59 assistants. The group raised the needed funds – nearly $90,000 in just 60 days.

After the initial trip, subsequent journeys have included “Rosie the Riveters” and all honorably discharged veterans through 1963. Each year 200 individuals board a caravan of 10 Badger charter coaches, with a pilot motorhome in the lead and a wheelchair lift support van in chase. On the upcoming VetsRoll 9 journey, the tally for transporting veterans and “Rosies” to Washington, D.C. will reach 1,745, which can include active duty and honorably discharged veterans through 1963. VetsRoll remains a 100 percent volunteer organization, and their mission designates that they pay tribute to these American heroes by honoring them with these memorable trips completely funded by donations. SAFERIDE: A NATIONWIDE MODEL INNOVATIVE PROGRAM HAS BEEN OFFERING SAFE RIDES HOME FOR OVER THREE DECADES ow in its 32nd year, the Tavern League of Wisconsin’s SafeRide Program continues to be a model for the rest of the nation. The Tavern League’s commitment to keep impaired drivers off Wisconsin’s roads is documented in the latest SafeRide Survey of more than 60 counties in the state. In 20162017, TLW-member establishments provided 95,203 free rides home to their patrons, a 15.8 percent increase from the previous year.

According to TLW Executive Director Pete Madland, the program’s status as the largest and most successful alternative transportation program in the country to address the issue of operating a motor vehicle while impaired, is due to TLW members. “We are very proud of our members who volunteer their time to ensure the program continues to thrive. We are also proud to have played a key role in the dramatic reduction in alcohol fatalities throughout Wisconsin.”
Thanks in part to the SafeRide program, Wisconsin has witnessed a 28 percent decline in OWI convictions since 2004 and nearly a 50 percent decline in alcohol-related fatalities since 2003. During that same period, the number of SafeRides provided increased 150 percent, while program operations were expanded to 62 Wisconsin counties.
The Tavern League’s SafeRide program has become so well-known throughout the country, Madland adds, it’s now considered the standard for other states as they strive to eliminate drunk driving on their roadways. In fact, the National Conference of Mayors has recognized the SafeRide program for its effort to reduce alcohol-related crashes and fatalities.
The cost of the SafeRide program, which is nearly $1 million, is shared by hardworking TLW members as well as funds generated by surcharges on OWI convictions.

LEAGUE LEADERS DAY COVERS WIDE-REACHING AGENDA On Aug. 28, 175 Tavern League of Wisconsin members gathered in Oshkosh for the annual League Leaders Day. A full agenda and several speakers resulted in a successful day of information gathering and sharing. T
his fall’s TLW convention truly lived up to its theme. During the four day convention, held October 2-5 at the Radisson Paper Valley Hotel in Appleton, many TLW stars were recognized and tributes were presented to longstanding members. The four-day event, attended by 650 Tavern League members, was full of networking opportunities for members, informative sessions regarding legislative matters affecting the hospitality industry as well as a tradeshow with over 70 vendors exhibiting new products and services. In addition, this fall’s convention marked the end of President Terry Harvath’s term and delegates voted to elect TLW Senior Vice President Chris Marsicano as the new TLW President. TRIBUTES TO LEADERS During Tuesday’s general session some of the most devoted Tavern League members were recognized. Marking their 100th convention were Gene and Helen Loose, owners of aptly named Gene & Helen’s in Potter. The couple has owned and operated the bar for 50 years, but before taking the reins from Gene’s dad there was one stipulation: Join the Tavern League and attend the semi-annual conventions. And as they say, the rest is history.
Also recognized were Tavern League members who represent leagues, districts or establishments throughout the state that offer extra financial support to the TLW. These “Special Club Members” include three levels of support. Platinum Members: Outagamie County, Portage County, TLW 3rd District, and TLW 5th District. Gold Club Members include the following county tavern leagues: Dodge, Door, Manitowoc and Oconto. A Silver Club Member is Repp’s Bar.
FUNDRAISING INITIATIVES The TLW is a sustaining member of CORE – children of restaurant employees, and at this fall’s convention a check for $15,000 was presented to the national charity on behalf of the Tavern League.
The 2017 Member of the Year Honor was awarded to Dennis “Salvo” Salverson, a 45-year TLW member with a long history of community service in Whitewater.
The convention’s keynote speaker, former Green Bay Packers quarterback and Packers Hall of Fame member Lynn Dickey reminisced about the Packers’ teams he was a part of in the 1970s and 1980s, and then conducted an allday autograph signing session, donating all $5,760 raised to CORE. Another fundraising effort that was announced in Appleton was the TLW’s partnership in 2018 with Beloit-based VetsRoll® Inc. The organization’s mission is to send the most senior U.S. military veterans and “Rosie-the-Riveters” to Washington, D.C., each year to honor their service to our country. 2017 Fall Convention summary IMPORTANT ISSUES ON THE HORIZON During the convention members received a first-hand account of industry issues on the federal level from ABL Representative Robert “Bubba” Sprenger as well as ABL President Steve Morris. Both expressed the need for members to stay actively involved in the Tavern League due to the influence the organization has on every level of government from local municipalities to federal agencies. Scott Stenger, the TLW’s lobbyist, spoke about legislation in Madison that could greatly impact how the industry operates in the future. Stenger indicated the three-tier system, which regulates the activities of manufacturers, distributors and retailers, is in jeopardy and urged every TLW member to contact their legislator to oppose a bill being circulated that would eliminate the three-tier system. Another issue that is a hot topic for the TLW is the expansion of winery hours, which also includes provisions for these operations to sell beer in direct competition with member establishments. Stenger commended the six current or former TLW members who are now serving in the Legislature. On hand to address the group included Rep. Dan Knodl (R-Germantown); Rep. Rob Swearingen (R-Rhinelander); and Rep. Rob Summerfield (R-Bloomer.) All spoke about the dangers of complacency and the need for all TLW members to express their concerns about issues affecting their business to their state representatives.
FUN AND CAMARADERIE Throughout the convention’s four days and three nights, members had plenty of opportunities to enjoy each other’s company. The Monday night party at Tanner’s Bar & Grill in Kimberly as well as the Tuesday night party and live auction at the Radisson were both fun diversions and a well-deserved break for these group of hardworking business owners. TLW

LEGISLATIVE NOTES TLW – GETTING IT DONE! BY SCOTT STENGER, STENGER GOVERNMENT RELATIONS
T
he legislative process is the tie that binds the Tavern League of Wisconsin together. Whether it is a large hotel in downtown Milwaukee or a mom and pop tavern in Tipler - they all share a common interest in legislation proposed in Madison and Washington. It is important for us to get the message out that we are all in this together and it is policies, not personalities, that drive the association.
I have been writing this column for over 25 years and the one thing that hasn’t changed is the need for your voice to be heard by decision makers in our state’s capital and the nation’s capital. It is still hard for me to comprehend why someone would not join the TLW. I have heard the predictable line from nonmembers: “What does the Tavern League do for me?” It is hard to believe a business owner would spend thousands of dollars for business insurance to protect their bricks and mortar but not see the wisdom of spending $125 per year to join the TLW to have a voice before the people who make the laws governing their industry. Whether you like it or not, elected officials can change the way you do business and in some cases their decisions may result in you deciding to close your doors. The best way to protect your interests and investments is to be a member of an association that will be your voice before legislators and be a part of the legislative process. You can be sure legislators are hearing from other groups lobbying on issues which are in direct conflict with your interests. I’m not going to attempt to answer the nonmember’s question regarding why he should join the TLW, instead, I want to provide a detailed list of what we have done for You – the Member, because you are the reason there is an association. All we do as an association is made possible because of the involvement and work from the thousands of members of the TLW, the largest association to represent alcohol beverage license holders in the country.
To get a full appreciation of the TLW successes I thought it would be appropriate to take a look back at a list of recent success stories pushed by the TLW. These issues were identified by TLW members through the board as important legislative changes they wanted to see occur.
LICENSE RECIPROCITY LAW The TLW secured passage of a new law that states that a municipal governing body that issues operators’ licenses shall issue a provisional operator’s license to a person who, at the time of application for an operator’s license and payment of the fee, files a certified copy of a valid operator’s license by another municipality. The fee for the license is $15.
MOVE ENFORCEMENT TO DOR Gov. Jim Doyle signed language in the 2003-05 budget act, which eliminated law enforcement’s authority to administer video gambling laws in certain Class B premises. Those provisions provide civil forfeitures for commercial gambling and for permitting premises to be used for commercial gambling if the violation involves the use or set up of five or fewer video gambling machines on premises for which a “Class B” or Class “B” liquor license has been issued. These premises are primarily, though not exclusively, taverns and restaurants.
DRAM SHOP LIABILITY EXEMPTION Without question the biggest accomplishment of the TLW is securing third party civil liability exemption or better known as Dram Shop Liability insurance. Most states require servers of alcohol to carry Dram Shop liability insurance which can range from $8000 - $10,000 a year for a small mom and pop tavern – if an insurance company will even underwrite a policy. After a number of court decisions which allowed claims against servers of alcohol in Wisconsin, the Tavern League sought a statutory change to provide a civil exemption for servers of alcohol. In 1985 the Legislature passed the Civil Liability Exemption statute, which says in part; “A person is immune from civil liability arising out of the act of procuring alcohol beverages for or selling, dispensing or giving away alcohol beverages to another person.”
SMOKING BAN Too often when we discuss our legislative agenda we focus on the defensive issues first. Being proactive and pushing the TLW agenda is where we put our legislative focus and work to pass bills of concern to the membership. The TLW is an association with an aggressive proactive legislative agenda and we work hard to pass bills which help save you money and make your business more valuable.

The TLW worked to revise the original smoking ban bill under the Doyle administration, which Gov. Doyle signed. Instead of taking effect in Aug. 2009, it became effective July 5, 2010. It also: pre-empts local governments from passing restrictions regulating outdoor smoking; gives business owners a warning for first violation and any subsequent violations would be $100 fine per day not per violation; prevents municipalities www.tlw.org
from using any smoking violations to revoke, suspend or deny renewal of a liquor license.
Wisconsin. The TLW successfully lobbied Congress to secure $300,000 in federal funds to be used for SafeRide programs.
TLW LEADS CHARGE TO LOWER PENALTIES
In addition, the TLW successfully lobbied for a change in state law to create an ongoing source of state funding from a surcharge on OWI convictions. The state revenue from OWI convictions is about $1.3 million a year and helps fund the SafeRide Program. We are now partnering with Lyft in addition to local cab companies to provide more rides to TLW customers.
• Video Gaming Penalties – The New Law: The TLW successfully lobbied the Legislature to reduce penalties for operating certain video gaming machines. Through the grassroots lobbying effort of the TLW the Legislature passed and Gov. Tommy Thompson approved more reasonable penalties for the possession of five or fewer video gaming devices on the premise of a Class B retailer. • Sensenbrenner’s Fairness in Music Licensing Act: After being contacted by a TLW member in his district U.S. Rep. Jim Sensenbrenner vowed to change the law over who and what requires licensure by ASCAP, BMI and SESAC. The new law saves you money and puts some sense into the music licensing law. The Fairness in Music Licensing Act contains the following key provisions: 1) Establishments under 3,750 square feet are exempt from paying royalty fees for the use of radios or TVs in their establishments. 2) Establishments greater than 3,750 square feet are exempt from paying royalty fees if they use no more than six speakers of which not more than four are located in any one room or adjoining space, and if there are no more that four TVs of which not more than one is located in any room, and none is greater than 55 inches. No fees are collected if the volume is not on the TV regardless of size and number in a room. 3) Provides for a rate court to operate out of regional federal circuit court to handle rate disputes, instead of requiring disputes to be handled only in the New York federal district court. • Adding Value to Your License: The TLW successfully secured a variety of changes which directly benefited license holders. One key change was an increase in the issuance of new liquor licenses to provide more value to existing license holders. The budget bill eliminated half of the unissued licenses in the state and requires a minimum $10,000 application fee for new license holders. The law does not apply to existing license holders. • TLW and 12 Bottle Bill: TLW successfully lobbied to change the law regarding the purchase of up to 12 liters of spirits per month. The old law required all purchases to be made through a wholesaler and any violation would result in a fine not to exceed $10,000 or up to nine months in prison. The end result is that you may purchase up to 12 one liter bottles of liquor per month from a liquor store if you unexpectedly run out of product.
The TLW also worked to pass legislation to allow advertising state and local SafeRide Programs!
DOUBLE HIT BILL Through the grassroots lobbying efforts of the Oshkosh City Tavern League, the TLW was successful in passing a bill to prohibit a municipality from issuing two citations for a single underage on premise violation as had been the case in Oshkosh. The law states that either the owner or bartender may be fined but not both.
BROWN JUG BILL BECOMES LAW Thanks to the efforts of the Jefferson County League, the Brown Jug Law will allow Class A or Class B retailers to bring a private right of action against an underage person who commits an underage violation on the retailer’s licensed premise.
ID SCANNERS The TLW worked to pass SB 433, which prohibits municipalities from providing ID scanners to alcohol beverage retailers. The bill was in response to municipalities who were providing scanners to taverns in an attempt to obtain personal data from unsuspecting patrons. The bill now goes to Gov. Scott Walker for his signature.
HARD WORK AND COMMITMENT These important changes did not just magically occur and would not have occurred without the work of the Tavern League of Wisconsin. It is because of your commitment to the TLW we have been able to successfully push your legislative agenda. We have also worked hard to elect our members to local town and municipal boards as well as the Legislature. We do not win every battle but the TLW is a strong respected association with success stories to warrant the $125 per year state membership dues. For those who don’t want to join because they don’t know what we can do for them or because they have a conflict with a local league leader, we will continue to stay focused on ensuring your voice is heard in the legislative process. We have a proven track record of success and have provided you – the Member – with the answer to the question: “What has the TLW done for me?” TLW
