Minor offenders should not have lifelong blots on their records – CJ applauds Rehabilitation of Offenders 2014 Bill BY OLIVIA ROSE CHIEF JUSTICE Margaret Ramsay –Hale has lauded the Rehabilitation of Offenders 2014 Bill as an impactful legislation that will give minor offenders in the Turks and Caicos Islands a clean slate. These sentiments were expressed at the opening of the 2017 legal year on Wednesday (January 11) at the Myrtle Rigby Court House in Providenciales. The CJ applauded the Attorney General’s Chambers for some74 pieces of legislation. She pointed out that some minor offences negatively influence the offenders acquiring employment or other services. Ramsey-Hale said the Rehabilitation law: “Is to ensure that people do not have lifelong blots on their records because of relatively minor offences in their past, which may impact negatively in such persons acquiring employment or other services. “The intention of the Ordinance is to exclude any prejudice which may occur because of disclosures of person’s relatively minor past convictions or offences; and to aid the reintegration and resettlement of ex-offenders into employment by not requiring them or any other person to disclose or answer questions regarding their spent convictions.” The rehabilitation of offenders Bill 2014 permitting some criminal convictions to be ignored after a set period was passed in the House of Assembly in May 2014. full support behind the bill when the Attorney General, Rhondalee Braithwaite-Knowles presented it for passage. According to the bill, rehabilitation refers to the period of time that passes between the offender’s date of conviction and their rehabilitation. The bill does not specify what sentences are eligible; it only looks at the period of the sentence. However, rehabilitation does not apply to offences related to children and the vulnerable. In addition, those who have committed sexual offences against a person of either one of these groups, regardless of the period of sentence would not have the ability to be rehabbed. There is however no specific bar or exception in respect of sexual offences for persons outside of those two groups, the Attorney General told the house. She said that this might be something the members would wish to consider further as this sort of legislation is always under constant

review, as evidenced in other jurisdictions. For a sentence of imprisonment for a term exceeding one year, but not exceeding two years, the rehabilitation period would be six years from the date of conviction. While a sentence of imprisonment for a term exceeding two years but not exceeding three years, the rehabilitation period would be seven years from the date of conviction. The bill provides for the rehabilitation of offenders who have not been reconvicted within the specified rehabilitation period. The Attorney General cautioned that having one’s conviction expunged is not the same thing as what the bill is proposing. She said:”This bill proposes that after a period of time certain offences are spent, which means that it prevents the unauthorized disclosure of information about spent convictions, but it does not cause a conviction to disappear.” She added: “It merely says how it should be treated and how it should affect the person and whether it should be disclosed. “The conviction remains a part of the record, so in the official record maintained by the Commissioner of Police or by the court, there would still be a record of the offence.”
THE PROVO Chamber of Commerce is working assiduously to collaborate with other chambers across the Turks and Caicos Islands to establish the first National Chamber of Commerce. According to a recent release from the Chamber, which highlighted several plans for the New Year, the establishment of a national chamber of commerce has been outlined as a chief priority. The release stated that: “With the appointment of a new Government we intend to engage in constructive conversation from the onset on the roll of the Chamber and our stakeholder representative in the community. “We also plan to foster partnerships with the various established organizations that currently exist. “We have very defined milestones for hiring a full time Chamber representative, and moving forward swiftly to partner with other Chambers in the Turks and Caicos Islands to establish the Turks and Caicos National Chamber of Commerce.” According to the Chamber, 2016 has been a transitioning year for the organization which saw a newly appointed board of directors and a new president.

The Providenciales Chamber of Commerce is strong, dynamic and progressive, and we plan to make significant strides this year and beyond to keep our businesses and community thriving, the release read.”
Gov’t looking to resolve vendor/Carnival cruise issues WORK has already started to attempt to resolve the years-long contentious relationship between Carnival Cruise and local vendors in Grand Turk. This is according to the Premier Sharlene Cartwright-Robinson during a press conference in Providenciales on Wednesday (January 18). The Premier said that one of the pressing issues for her government in Grand Turk – where the new government held its first town hall style meeting – is to properly and successfully address the contentious relationship between Carnival and the vendors.
“We have had a very successful meeting [with vendors], we had strong attendance. We believe that we reached a wonderful place actually, where both government and vendors realise and appreciate the importance of the cruise ship industry to the island of Grand Turk. “And I am pleased to report that I will also be sitting with Carnival members on Monday (January 23) to address a way forward.” The Premier noted that it is critical that they resolve some of the issues that have been brewing for a long time. Some of these issues, she said, relates to interactions between
vendors and guests, and vendors and carnival operators. Meanwhile, she said that her government has also reviewed the Grand Turk master plan and are now looking at projects that they can fund through the infrastructure fund (a joint fund between Carnival and Government). Cartwright-Robinson noted that through the fund her government hopes to transform Grand Turk, making it the island that will pull the TCI’s international ratings back up, and increase cruise ship numbers, which are in decline. Government updates on first month in office Astwood has also began engaging the private sector on how they can get involved in the economic growth and creation of jobs in the TCI. The Premier also stated that the public can expect a major statement on border control in the not too distant future.
BY DELANA ISLES ONE MONTH after the new government was elected in the Turks and Caicos Islands, the Premier and her ministers met with the local press corps to update the public on what they have been doing over these past few weeks. The government hosted its first press conference in the Providenciales government offices – the Hilly Ewing building on Leeward Highway on Wednesday (January 18). The Premier reported that they are all working on key issues and that in line with this all of the ministers have begun travelling around the country. She said that ministers have for the most part completed tours of all of the islands where they have offices, where they met with the various heads of departments. MINISTRY OF TOURISM – RALPH HIGGS The Premier said that the top priority for the tourism ministry is getting the gaming legislation pushed through to the House of Assembly. That legislation will see the introduction of a gaming commission, better regulation and better regulating of that industry. Pointing to the party’s Change Document (manifesto) Premier Cartwright-Robinson said that throughout the next four years and into the next eight the public will hear frequent references to the document, stating that her government intends to stick “slavishly” to their 100 day goals. She added that in line with this the ministry of tourism has already began reviewing the national tourism strategic to ensure that it reflects the policies that the government would like to see. Higgs is also working to ensure that ‘Team TCI’ is reinstated, that there is director to lead in the cruise industry, the revival of the roots campaign for the young people through the culture department and the re-establishment of the TCI Cultural Commission.

MINISTRY OF HOME AFFAIRS – VADEN WILLIAMS The Premier noted that her government had committed to the people of the Turks and Caicos Islands that daily inspections around the country will begin, and so far instructions have already been handed down to get the ball the rolling. “We see through this ministry already that the minister has begun meetings with taxi drivers. Top priority is getting the juvenile centre open; he (Williams) has already began work on expanding social services and that is through the famous home health program. “He is already reviewing road safety and how we can improve the database there. And in his constituency we will be organizing a meeting very soon regarding the issues of Priton Home Development,” the Premier said. MINISTRY OF EDUCATION – JOSEPHINE CONNOLLY The Premier reported that minister Connolly has begun and almost
completed her tour of the schools around the islands. Adding that further to the change document she will be ensuring that the youth listening tour begins soon, and that the national youth services for volunteer services also begins. Connolly is also continuing the review of the school curriculum which was emphasized very strongly in the Change Document with particular emphasis on civics, environment and tourism. There is also a review currently being conducted of tertiary education and training, Cartwright-Robinson said. MINISTRY OF INFRASTRUCTURE GOLDRAY EWING The Premier said that Ewing has so identified a badly damaged avenue in the Blue Hills area to be graded and paved soon. He has already began work on the alternative access road out of the Blue Hills community and he has so far commissioned the work for the infrastructure plan to get the project
underway. Ewing is also set to begin a Blue Hills beautification project, which the Premier said will be done through private funding. MINISTRY OF BORDER CONTROL AND EMPLOYMENT - SEAN ASTWOOD Cartwright-Robinson recalled that the top five priorities for the first 100 days under this ministry includes restoring the public trust and confidence in that ministry. She said that there is now a comprehensive review being conducted of operational policies and procedures. Astwood is reviewing the current systems and the implementation of the soon to be rolled out IT systems. The Premier said that the minister has also completed the initial assessment of staff in their work environment, leading to a meeting between the government and the deputy governor and the governor on how they intend to bring change to the ministry of border control.
OFFICE OF THE PREMIER AND MINISTER OF FINANCE “As Premier I have taken on the ministry of finance and I believe that the country would appreciate that the Budget will certainly not be delivered before the end of the financial year. “There has been some delays, but to the benefit of a new government we are able effect a bit of change to what we have to submit to the UK (as the FSPS) and we have begun to identify capital projects very early.” She noted that some of these capital projects identified are ones that were already in previous budgets and which they have deemed could proceed. The others, which she said will become priority for her government, are still being looked at. The Premier promises another major statement soon, this one on finance, to be delivered when the first House of Assembly meets for business. She noted that for the finance ministry the matter of the national health insurance was priority upon assuming office. This matter, she said, they have managed to resolve as far as possible, pointing to the current shortage of funding that the government had hoped to secure from the budget, and which has been done. The other pressing issue for the ministry of finance outside of the budget and NHIP, is the position now taken by Europe to have an open register. The Premier said that this is something that the TCI has to pay keen attention and which she will be addressing the country on soon. She added that in the first week CONTINUED

That’s a pretty good start. It will help to protect our only industry of tourism and give comfort to the people living here. Maybe, have a look at the existing taxes and how they affect small businesses (particularly the threshold limits at which they become payable).. If those could be reduced for them it might alleviate some of the hardship some people are undoubtedly feeling right now. Not everyone is making money hand-over-fist, like some of the bigger players here.
Jobs, more jobs
Jobs, jobs and more jobs for Turks and Caicos Islanders. Stop using work permits as a source of government revenue so that our people can get back to sustainable employment!!!
Crime is number one
We agree crime is the number one priority. Our people, businesses and tourists must feel secure. Number two must be the state of our finances. We have not been told the truth for 13 ½ years. What do we owe, what bills are coming due? What about the cost of our health plan? Why are we paying so much and not getting first class service at home? When the plan was sold to us we were not told we would be shipped away for every illness. How can InterHealth Canada employ 34 doctors and still spend 18 million a year on overseas care? Now that election is over the elected candidates phones are turned off! We need
information bad or good!
Weekly meetings
We need communication. The campaign is over and now the new representatives and ministers must be accessible. We need weekly public meetings on the state of the government and where we are going. We need to re-establish TCI as a place to safely invest. The British and our new tourist minister need to make this number one because we need expansion of our tourist industry and lower taxes. We need to support the national trust and hold them accountable to develop our historical sites which is eco tourism.
Lower electric bills
Communication between this government and the people must be the number one priority ! Akierra survived the election because she was easier to reach than Ezra Taylor. How about government and private projects in the twin islands. We are tired of Provo and want to go home. Lower electric bills please.
Keep guests coming
As tourism is the number one source of revenue, it would be logical to make sure that all the islands have an initiative to be litter-free. As well it is a big turn-off to see starving wild dogs and strays. Keeping guests coming back is number one priority.
Inward investment
Would be good if her government can boost inward investment into the country. For the past few years the TCI has seen little to no major developments under the PNP and the country needs more business coming in which will in turn provide jobs for locals. They also need to do something about the SIPT, how long is the country expected to sit back and watch this farcical trial unfold while the tax payers bleed? When is it going to end? How much more is it going to cost us? It would appear that the Government in spending more to prosecute these defendants than what they allegedly stole. The prosecutor can say all he wants that
justice has to appear to be served for the country to progress, but at what cost to the people of the country?
Cost of living
Cost of living is high, no jobs, no investments, no nothing, but we are paying through the nose for a never ending process to appease the British overlords. What does the PDM intend to do about the 12 storey Ritz Carlton hotel that the PNP had in the pipeline for the past couple of years? The smaller hotels are fighting this development in the courts but what is the new government’s position on increasing our building height and encouraging bigger brands into the country? Crime and security are well and good, but what are they planning to do about our economic and social issues? How long do we have too wait for them to address that? I hope they don’t fall in Washy’s and PNP tunnel vision of big surpluses while the people continue to suffer. It’s one thing to oppose, it’s another thing to lead. We need change across the board. The ball is your court now, PDM.
Border control
The List is exhaustive but for the moment here are quick thoughts on Crime and Security: Crime and security goes hand in hand with border control and Immigration Management. How will the efforts of the Premier correlate with that of the Governor under whose remit the matters of police and security falls? Crime and security is not a matter that should be dealt with in isolation of the other social ills in our society, there must be a comprehensive plan to deal with immigration and border control, police training and recruitment, civic awareness, unemployment, truancy, vagrancy, over-crowded schools, undocumented immigrants, housing violations, work permit violations as well as an orientation process for work permit holders and other extended stay categories.
Orientation
All applicants for a work permit or
other extended stay category should be required to undergo a ‘Welcome to Turks and Caicos Orientation’ wherein the applicants are introduced to and become familiar with the civil society norms and expectations of a TCI Resident. We must formally introduce our new residents to our expectations of them and not set them to pasture in their untutored state. Our population is sufficiently small to allow for a useful evaluation of the sources and causes of our violent crime experience and thereby develop mechanisms and processes to mitigate the occurrence of violent crime. As a quick example the recent reports surrounding the murder of a businessman on Providenciales reveals that police have arrested four Dominican nationals. It begs the question as to how be our immigration officials screening those individuals who seek to live among us?
Background checks
Are we executing background checks within the country of origin of those who seek work permits and other extended stay authorizations? And if background checks are executed how is the resulting data used to inform the decision making process? Crime and Security should not be prioritized in isolation but should be part of a comprehensive and integrated social impact Aden. The Governor must also be seen and heard as an integral participant in this matter of crime and security as it fall within his portfolio and he too is on our payroll with significant fringe benefits; for him this should not be a vacation in our Paradise.

More than 89 criminal cases heard in Supreme Court in 2016 BY OLIVIA ROSE THE SUPREME Court dealt with some 89 criminal cases in 2016 down from 92 the previous year. This was revealed by Chief Justice Margret Ramsay-Hale at the third formal opening of the legal year for the Supreme Court on Wednesday (January 11) at the Myrtle Rigby Court House in Providenciales. The 2017 legal year opened with much fanfare and traditional parade by The Royal Turks and Caicos Islands Police Force, dressed in
ceremonial uniform. Chief Justice Ramsay-Hale disclosed that for the year 2016, 67 of those cases were new and 22 were cases brought forward from 2013. One of those matters was a retrial, the defendant having succeeded in his appeal. She said: “All of the 22 cases which were brought forward were disposed of during the year, of the 89 cases which were before the Court for trial, 26 or nearly a third were disposed of by way of guilty pleas. “Of the remaining sixty-three 63

of February she will travel to United Kingdom for a Brexit strategy meeting, where she will air several concerns that the TCI has. The Premier also recounted her meeting with the clergy in Grand Turk, in South Caicos on Thursday and in Providenciales on Friday, with meetings planned for next week Friday (January 27) in North and Middle Caicos and then Salt Cay on January 30. She further stated that her government is committed to ensuring that there is a strong second industry, prompting a recent meeting with financial industry stakeholders. “We have together agreed that the government should review its role and not just concentrate
on being that of a regulator but also a promoter and true partner in promoting this industry.” Meanwhile, the premier noted that she has yet to meet with the commissioner of police, but will soon be doing so during an upcoming national security council meeting where the government intends to raise the security issues on which they campaigned. Those issues include – the need for resources, a the need for a strategic plan and the need for a better working relationship with the public. She assured that the government will certainly be committing itself and the resources as much as possible to crime fighting initiatives.

CJ to hear election petition in March BY DELANA ISLES CHIEF JUSTICE Margaret RamsayHale will on March 6 preside over the hearing of an election petition protesting the award of electoral district (ED) six to former government minister Porsha StubbsSmith after a tie breaker. The petitioner, George Pratt, filed the documents on December 22, 2016 in the Providenciales Supreme court, seven days after the general elections, court documents obtained by Weekly News showed. Pratt is represented by attorney at law Alvin Garland, the respondent Stubbs-Smith is being represented by Queen’s Counsel Ariel Misick, while the Attorney General is appearing on behalf of the Supervisor of Elections, and the returning officer and the presiding officer for ED6. Last Thursday, when the case came up before the Chief Justice for a date of the hearing to be set, many supporters of both candidates and members of government were in attendance in the Leeward Highway courthouse to observe the proceedings. The issue came to head after a 284 tie for votes between Pratt and Stubbs-Smith led the ED6 returning officer to use the constitutionally allowed tie -breaker – that of the placement of the candidates’ names into a container and then a blind drawing of one – subsequently leading to the PNP member’s name being selected. A dissatisfied Pratt told the press on the announcement of the winner on December 16 that he was not entirely pleased with the overall process at the polling station, naming what he saw as discrepancies in the voting and subsequent selection process. Court documents clearly outlines Pratt’s grievances. Those documents state that pursuant to section 21 of the Elections Ordinance the register of electors for 2016 was published by the supervisor of elections on or about January 2016, and during the month of March 2016, the supervisor heard the claims and objections with respect to the register. The claims and objections hearing for ED6 was heard on March 2. It further outlines that pursuant to the Ordinance, the supervisor was required to amend the electors list to give effect to his decisions with regards to the claims and objections. On March 2, the supervisor forwarded to Felix O Delancy his decision of a list of the names of persons that were objected to by the PDM in ED6. On or about March 31, following the claims and objections process, the supervisor published the final 2016 register of electors, including the voters that were removed and added

during the claims and objections process, the Pratt documents claim. He further outlined that it is during the claims and objection process that registered voters can be added or removed from the register of an electoral district and once the process is completed there is no further mechanism under the Ordinance for adding or removing registered voters from the register of an electoral district. Pratt states that on the morning of election day, before the polls opened, the supervisor delivered to the returning office for ED6 the register of voters, which became “the official lists of voters” relating to the electoral district for which he was appointed. He added that a person is not entitled to vote in a polling division unless his name appears on the official list of voters for the electoral district in which the polling station is situated. He said that after the polls had opened on December 15 and the official lists of voters had been delivered to the returning officer, and after voting had begun, sometime during the day he was told by the presiding officer that three registered voters from Leeward, ED5 would be allowed to vote in ED6. Upon being informed of this, Pratt said he immediately objected to these individuals being allowed to vote in his district. However, he said the returning officer denied his objection and approved the voters to vote. The three registered voters that were approved to vote in ED6 were: Kirlyah Dominique Rigby, Lucille Sonovia Gardiner and Bcrniquea Ikisha Smith. According to the court documents, Kirlyah Dominique Rigby and Berniquea Ikisha Smith subsequently

voted in ED6, while Lucille Sonovia Gardiner, voted in ED5. Pratt further adds that on or about December 13 the supervisor of elections published a notice to the Governor headlined ‘Additional Correction to 2016 Electors Register Published’. The additional corrections to be made and included in this list were a transfer of the above name three already registered voters from ED5 to ED6. Pratt said he was never informed of the publication. However, he claims that the supervisor’s publication to the Governor on December 13 is unlawful, and on its true construction does not make corrections to the register of electors in accordance with section 22 of the Ordinance with regards to the three voters. He said that Section 22 (l) only permits the supervisor to correct the register under two conditions: (i) is to add a person on the register that is not on the register whom he believes is entitled to be registered, and (ii) to give effect to a decision on a claim or objection made with respect to the electors lists. It is only under these circumstances that the supervisor can make corrections to the register, Pratt pointed out, as such the notice to transfer the voters to ED6 is unlawful. “This is exactly what the claims and objections process mechanism is designed to be used for. “Mainly, candidates and other persons can claim and object to registered voters in any electoral district during the process, once this process is concluded the Supervisor has no authority to move voters from one electoral district to another, on his own accord, after the claims and objections process have concluded,”

It adds that at the time the final list of voters for ED6 was delivered to the returning officer on polling day, the three voters were not on the list as electors for district six and were therefore not entitled to vote at that polling station. Pratt stipulates that the two of the three voters unlawfully voting in district six may have affected the result of the election, and makes it uncertain whether the StubbsSmith has really been elected by the majority of persons voting at the Bight polling station. REJECTED AND SPOILED BALLOTS He also pointed out that during the counting of the ballots for ED6 three ballots were rejected and three ballots were spoiled. He said that one of those ballots was clearly marked for him, and that it was a perfectly good ballot with a clearly marked X in the center of the box next to his name. Pratt said he had objected and requested that the ballot be included into the count as a valid vote for him. However, his objection was denied by the returning officer and the ballot was place into the designated envelope with the other rejected and spoiled ballots and sealed. He further claims that the disputed ballot was not marked ‘spoiled’ by the presiding officer and should have been included as a valid ballot for him. “Had the one ballot not been rejected or declared spoiled, the results would have been different, with the petitioner winning the majority of the overall votes cast, and being returned as duly elected to the House of Assembly,” Pratt stated. The PDM member also objected to the procedure for selecting a

candidate when the votes are tied between candidates. He said the procedure carried out by the returning officer for electing the candidate is flawed, unreliable and or unsafe. “The returning officer folded both papers himself put them into the box and draw the winning name himself.” He stated that the returning officer should have used the presiding officer or another official agent to draw the name from the box. As a result of this, Pratt said he cannot accept the procedure performed by the returning officer as a reliable and safe procedure. He stated that the final result and the election of Stubbs-Smith is unsafe, and she should not be returned as the elected member for ED6. Instead, he should be return as the duly elected member of the House of Assembly, or alternatively the election must be declared void. He is seeking the following relief from the court- that the spoiled and or rejected ballots be open for scrutiny; that the final voters list that was used during polling day, for ED6, and ED5 be scrutinized; that the counterfoils to the ballot papers and/or the ballots be scrutinized. That it may be determined and declared that the Stubbs-Smith was not duly elected as a member of the House of Assembly for ED6; that her election and return as a member of the House of Assembly for ED6 be declared null and void and that Pratt was duly elected as a member of the House of Assembly for ED6. He is also seeking costs of the petition and he may have such further relief as may be just and equitable. Stubbs-Smith’s lawyer has up to January 19 to file a response to Pratt’s election petition with the court.

Government will invest in training for early childhood and special needs education teachers – Education Minister BY OLIVIA ROSE THE NEW Government will invest heavily in training early childhood and special needs education teachers. These sentiments were expressed by the New Education Minister, Hon. Josephine Connolly during her recent visit to departments under her portfolio. She visited primary schools, Sporting Complex, Youth Department and Library in Providenciales on Monday, January 9, to discuss issues and challenges facing the various departments according to a Ministry release. The Minister gave assurance to the principals, staff and head of departments that it is her goal to ensure that all schools and
departments have the necessary support and resources to enhance teaching, learning and efficiency. Minister Connolly said her Government is committed to promoting the development of education professionals. As part of her commitment to strengthen the lines of communication between the ministry and its departments, the Minister addressed the students and staff of the schools. She visited classrooms and chatted with excited students who were eager to meet her. Connolly reminded her team that in order to build a viable and sustainable education system, we have to ensure that the foundation has to be solid. She said: “This is the reason why
my government will continue to invest in the training of early childhood and special needs education teachers and also to promote the development of education professionals. “Through spiritual growth, personal development and professionalism, the Ministry is committed to serve and seek to achieve greater accomplishments in the near future. “The Ministry aims to make a difference in the lives of those we serve and to whom we work with, to improve their performance in the standard of Education.” She remarked that the visits served as energizing start to her journey in education, youth, sports and library services. Following her visits on Providenciales she conducted similar visits in Middle Caicos and North Caicos. The Minister during her tour visited
schools on the Island of Grand Turk, South Caicos, and Salt Cay. On Friday, January 13, the Minister met with principals, staff and students of the schools, libraries and the youth department in Middle Caicos and North Caicos. The Minister and her team spent engaged and connected with students, teachers and staff of schools and departments within her portfolio. Addressing the staff she said; “I am concerned about of the people who will determine the future of the Turks and Caicos Islands and will remain committed to providing all the necessary tools and resources needed to give them the best opportunities available to develop their full potential”. While visiting the schools on the island of Grand Turk, the Minister was given the pleasure of reading to the students at the primary schools.
She spoke with the students at the Turks and Caicos Islands Community College encouraging them to put their full efforts into their studies while taking advantage of the resources available to them. She noted that the greatest challenge for the college is not only to focus on formal education but to develop young people to become responsible leaders in the Turks and Caicos Islands. Connolly promised the staff and students at these institutions that she will continue to strive for excellence in providing opportunities for education and development of the whole child. She told the principals and staff that she will visit within the next month to speak again with them and will review all the notes concerning all challenges and request to make the teaching learning environment more conducive.

Cabinet agrees to formalise TCI`s CARPHA membership CABINET has agreed to formalise the Turks and Caicos Islands membership of the Caribbean Public Health Agency (CARPHA). This is according to the post Cabinet media statement issued last week. His Excellency the Governor, Dr John Freeman, chaired the first meeting of the Cabinet on Wednesday, 11 January 2017, at the N J S Francis Building on Grand Turk. All Ministers were present at this meeting. Cabinet took note of an information paper from the Ministry of Finance on the budget timetable for 2017/18 and received an up-date on the current financial situation
from the Chief Financial Officer (CFO); Cabinet received an information paper on actions taken and plans going forward to address issues faced by the National Health Insurance Board (NHIB). Cabinet noted the recommendations of the Public Procurement Board to award contracts in line with the Public Procurement Ordinance 2012 as follows – TR 16/30 Construction of a new block at the Eliza Simons Primary School; TR 16/32 Consultancy to oversee the development of terms of reference and a draft tender for an integrated electronic land administration system. Cabinet advised His Excellency
the Governor to approve the issuing of a tender notice for a lease of Crown Land Parcel 50500/90 on North Caicos for the construction of a boutique hotel development and multi-complex recreation and events centre. Cabinet further agreed to request a letter of entrustment from the British Government to enable the TCI Government to negotiate in its own right with third parties under the terms of the Multilateral Convention on Mutual Administrative Assistance in Tax Matters including on implementation of the Common Reporting Standard (CRS) and on the G20/OECD Base Erosion and Profit Sharing (BEPS) initiative on tax information exchange.
The Hope Foundation to host third annual ‘Back to School’ workshop BY DAISY HANDFIELD THE HOPE Foundation for Autism Awareness will be hosting a workshop for parents, caregivers, teachers and others who are interesting in learning more about coping with autistic children and those with other behavioural disorders. The workshop is scheduled for January 28, 2017 and will be spearheaded by guest speaker Mr Michael McGinty at the Mills Institute in Long Bay in Providenciales from 10 am to 1pm. Learning supports and social skills in regular education classrooms for students with learning disabilities, ADHD, increasing positive behaviour, Aspergers and high functioning autism are some of the topics that will be covered during the workshop. Director and chairman of the Hope Foundation for Autism Awareness, Maxcia Rigby, said in
an interview with this publication that the workshop is important because this workshop will cover a wide range of disorders, teach skills and give training on how to handle autistic children. She said: “This workshop is very important because teachers who teach in general education classrooms and even special needs classrooms have a diverse group of students. “It is also very important for parents to continue the work that the teachers are doing in the classroom, at home. “Usually children with disorders function better when there is a level of consistency, so if what is done in the classroom is mirrored at home, children and students are more successful in their development. “So we believe that putting on this workshop, not only for children with Autism, but children that suffer from and have challenges
with other disorders like ADHD and Aspergers can learn and develop and grow from this type of training.” Mrs Rigby encourages teachers and parents to attend the workshop so that that they can grow and be developed, in order to help their children or someone else’s child. The Hope Foundation for Autism Awareness began in April of 2013, to provide awareness to the community, support to parents and teachers and HOPE to all of the families and children affected by autism in the TCI. Dear Editor In response to the Statement made regarding the appointment of the Hon Floyd E Seymour as Chief Executive Officer (“CEO”) of the National Health Insurance Plan (“NHIP”), I say it is time to “get over it”. As a people we like to find fault for no reason at all. Yet In fairness to the Honourable Mike Misick, he is just stating his opinion and really now, where things stand he is more relevant that his former party, the PNP. So we must cut him some slack here. I do not see the Hon Floyd Seymour as one who holds grudges or a victimizer as stated by the former Premier-Misick. As Director of NIS, PNP Chairman, no-one said anything. Albeit there were no serious scandals except that $20 Million of our monies were “way-layed” from NIS to set up the failed TCI Bank and we have seen those monies “No-More”. Now the former Premier is going to accuse the Hon Seymour of being “a very vindictive man is known to hold grudges and has the temperament of an angry man when he cannot get his way “. Well the Hon Seymour was the Leader of the Opposition between 2007 and 2009 and I have never seen this behavior on his part. Besides that was over Eight (8) years ago and we all can Change. I cannot think that the Hon Seymour is still possessed of the same disposition- even if that was true. No-one can prove that. On the other hand, We all know him as a passionate man. After allHon Misick, you came back home, ran in the last election, did us all a
favour by helping us get rid of the PNP and you campaigned on the idea that you have changed. So let us cut the Hon Seymour some slack here. I am sure he has changed and I challenge you to show that he has not because over 1,600 people voted for you on the idea that you have changed. Now the Hon Seymour is a CPA, owner of a Real Estate Company, holds eminent qualifications and degrees.These are his qualifications first and a Politician second. I am sure he can look at a PNP, a PDA, an Independent first through the eyes of a human being when deciding to send them off. After all it is public funds, our monies, that he will be dealing with. There is a reason we need to cut the Hon Seymour some slack though: He is a former party leader, a policy man with some vision. Being a CPA, I am sure he can project a course on how to return the NHIP to some solvent path. Who else can deal with a $6 Million deficit? Even though one does not want to contradict the Hon Misick, it is time to cut some slack and give the Hon Seymour a chance to turn the NHIP around. It is competence that the Premier is seeking when she appointed the Hon Seymour to the position of CEO of NHIP. That is the mandate: Solvency, good service and a return to commonsense. North Caicos man jailed for incest A 53-year-old man, John Lightbourne, has been convicted and sentenced to eight years in Her Majesty’s prison in Grand Turk for incest and buggery of his own eightyear-old daughter. Lightbourne, who appeared in the Supreme Court in Grand Turk on Monday (January 16, 2017) before
Judge Robert Schuster, confessed to sexually assaulting the primary school child in July of 2016. Lightbourne, who is a fisherman and carpenter, is a resident of North Caicos and the child in question is a resident of Providenciales. The two sentences for incest and buggery, will run concurrently.
Senior police placed on administrative leave after rape allegations surfaced A SENIOR officer of the Royal Turks and Caicos Islands (RTCIPF) has been placed on administrative leave after a new recruit, with the Force, alleged that the officer attempted to rape her. Although the details are still sketchy the Commissioner of Police, James Smith, issued a statement on Wednesday (January 18, 2017), confirming that he received a
complaint of misconduct by a senior officer. He said: “We take our complaints seriously, and an investigation has been launched, due to the circumstances of the allegation, we will not comment any further until the outcome of the inquiries.” Mr Smith added that the officer will remain on leave until the investigations are completed.

often deprived of their liberty in the circumstances where there was in fact, on the information in the hands of the police and the prosecution, an insufficiency of evidence to show that they had committed the offences with which they were charged. “I think this is an improvement which is worthy of note.” “Unhappily, the figures provided to me suggest that some 26 matters were brought forward into the New Year, which might have been avoided if pleas of guilty were entered at the earliest stage. “Too often the plea is entered so late in the day that the Registry is unable to put another matter for trial in its place, which results in the Court being idle and matters being carried forward to the next year. “Of course this could be mitigated by the Registry creating a ‘warned’ list of matters which are trial-ready, in the event that the trial of the scheduled matter breaks down for any reason.” The CJ reminded that while guilty pleas assist the administration of justice, as they save costs when the evidence and Counsel’s instructions are available, many defendants wait to plead guilty on the date of the trial. “While a late plea assists in the effective administration of justice, the machinery of issuing juror summons and empanelling a jury will have already taken place with the attendant costs, which might have been avoided had the plea been entered at the appropriate time.”

CJ Ramsay-Hale further noted that in 2016 the Magistrate’s Court on Providenciales, 512 criminal matters were filed, down from 709 criminal cases were filed in 2015. She said: “This is a statistically significant decrease. I am not sure if it means there was less crime or simply fewer prosecutions, but it is a noticeable reduction, which may bear some further analysis. “794 traffic matters were filed, down from 1266 in 2015. The disposal rate of traffic matters was 90%. “There were 366 civil proceedings up from 290 civil proceedings in 2015. There are 157 domestic proceedings pending in the Courts, of which only 49 are new so there would seem to be a significant backlog in dealing with those matters, which I am confident will be addressed by the Chief magistrate.” In the Magistrates Court in Grand
Turk, 209 new criminal matters were filed up from 150 last year, 93 of those have gone forward into the New Year and 78 new civil claims were filed. Turning her attention to the Court of Appeal for the year 2016, it was noted that the Court of Appeal presided over three sessions in the months of January, May and September. A total of 44 appeals were filed consistent with the number of appeals filed in 2015 (43) and 2014 (49).” It was noted that Sir Edward Zacca, who was the President of our Court of Appeal up until January 2015, unhappily fell ill before the May session of the Court, which would have been his last before he retired. CJ Ramsay- Hale said: “Much to our regret, we were unable to celebrate Sir Edward’s long career on the TCI Court of Appeal, and
in law generally, at the end of the session as we had planned, but we take this opportunity to acknowledge Sir Edward’s dedication to the law, his immense scholarship, which is reflected in his judgments and the extraordinary example he set for other judges. “We thank him for his exceptional service to the Islands. Sir Edward was appointed to the Bench at the age of 26 and had a judicial career that spanned nearly fifty years, which included serving as Chief Justice of Jamaica.” She revealed that the Court has a new President, Mr. Justice Mottley QC, who has been a member of the Court for some years. As it relates to the trial of persons on remand, the Chief Justice pointed out that a decision was taken by the administration to try Providenciales cases on Providenciales. She said: “There were many good reasons for this. Flying witnesses and jurors to Grand Turk and housing them there and providing meals for them for as long as they are needed, is both an administrative and a financial burden for the police, the Crown and for the Courts. “Sometimes witnesses, jurors and lawyers choose to fly back and forth which may cause delays in the trial process when flights are delayed. “We were also concerned that defendants, and indeed witnesses, may wish to have family or friends present to lend them support and in many instances, this will not be possible because of the costs of attending a trial held on Grand Turk.
“For those of you who have never had any involvement in the criminal justice system, whether as an accused or a witness, it may be difficult to understand just how frightening, how intimidating the experience can be. “One consequence of that decision was that defendants on remand had to be brought to Providenciales from Grand Turk every day for their trial. This placed a huge burden on the Prison service and created a risk to other persons travelling by air. “Several years ago I raised the issue of building a Remand Centre on Providenciales, where prisoners being tried on Providenciales could be housed for the duration of their trial. No action was taken in response to that proposal from the Judiciary. In the meantime, certain developments have caused us to reconsider our decision to try all Providenciales cases on Providenciales, as we have come to regard the practice of transporting prisoners to Providenciales on the private airlines as posing an unacceptable risk.” Highlighting some of the challenges facing the judiciary, the CJ noted that the judicial administration is short-staffed in every area. She said: “Only 23 of 32 staff positions are filled. Every member of staff has had to wear a number of hats and for their willingness to do so the administration extends its thanks to every member of the staff.” She expressed hope that a number of positions will be filled before the end of the budget year.

Middle Caicos time Middle Caicos, once called Grand Caicos, has suffered for decades. People moved away, small businesses floundered and people have died. A huge government building project which nobody understood sits incomplete overlooking the ocean next to the clinic in Conch Bar. Government vehicles purchased new and abused by government employees are seen abandoned. The former government building given for a time to a cable TV operation sits in shambles. Government cisterns are in disrepair. The police residence and office is currently unusable needing restoration. The airport shut down barely able to land a medical emergency flight on its unlighted crumbling runway. Only the tiny airport restaurant/bar

David is a retired mobile hydraulic engineer and business executive. He has been married to Middle Caicos native Yvette Robinson Tapfer for 27 years and has lived in Conch Bar, Middle Caicos, since 2002. David formerly served as branch chairman of the PDM from 2008 to 2011
remains open. Two of the three settlements are down to less than a dozen residents. The last of three primary schools, Doris Robinson school has only12 students and lots of room. Church enrollment hangs by threads. Middle Caicos, TCI’s largest most beautiful island, is geographically in the middle of all the islands. Promises of causeways to East Caicos and South Caicos dried up with the wind. The first
stepping stone to Joe Grant Cay sold to the owner of Dellis Cay, another abandoned island and investor long gone. Lorimers settlement, once the largest TCI settlement hosting 750 families, is nearly a ghost town. Even Guru Alton Higgs grew old and abandoned his home. We all know who is responsible because enough was enough. Now it is up to new PDM Minister Higgs to light a torch and show the way.
Does hope exist ? Those that remain and/or connected are full of ideas. The unfinished giant building has a dormant but uncanceled government building contract. It could be used as a tech school, university, hotel.... ....something ! It will not take much funding only vision and commitment. With people coming back, and Doris Robinson populated again could Conch bar become a wonderful quiet college town ? Bambarra Beach rivals Provo’s Grace Bay but no monster resorts please. Low profile only ! The road to the beach and boating area needs to be opened and graded to start. Conch bar clinic started and pushed by Governor Todd, built by PDMs Derek Rolle, is beautiful and well equipped. All we need is a real health plan and Doctor. Then maybe a retirement development for expats and treasured native
seniors. Bambarra has Armstrong Pond, undiscovered except by US college professors. Important ancient Indian artifacts could draw tourists. Haul-over plantation ruins feature the remains of 18th century plantation days. Conch Bar Cave has long needed a Fortis hookup for its welcome center. With tourists drawn to these sites so will investors and native private infrastructure. Half a Creek development stalled for 13 years is now underway. A shadow of what was planned prior to 2004... but a beginning. These ideas are the start of a launching place we have finally reached. Middle Caicos will some day become Grand Caicos again ! Let us start today to expedite tomorrow !

Hope and Unity focus of Methodist Church 205th Convocation BY OLIVIA ROSE SPREADING the message of hope, unity and creation will be the focus of the Bahamas and Turks and Caicos Islands (BTCI) Methodist Church 205th Annual Convocation. The North TCI Circuit of the Bahamas, Turks and Caicos Islands Conference of the Methodist Church in the Caribbean and the Americas is hosting the 205th Annual Conference of the BTCI under the theme; “Lord, Make Me an Instrument of H.O.P.E. (Healing, Opportunity for Positive Expectations). President of the Methodist Conference, BTCI, Bishop Theophilus Rolle, along with the Conference Secretary, Rev. Claire Robinson and Superintendent Minister for North TCI Circuit, Rev. Frednor Toussaint, hosted a press conference on Tuesday January 17 to update the media on the conference and what it seeks to achieve. Bishop Theophilus Rolle said the conference is used to review the work of the church, and provides a platform for recommendations to be made in an effort to strengthen the church`s role in the community. He said: “Our conference this year will run from the 16th of January to the 22nd of January, each day, there are specific features to the conference but for the most part we use our conferences to report on the work of our church. “Reports will be given in relation to the mission, evangelism and growth of our church, work that’s taking place as it relates to our chaplaincies , the work of our schools , the work within the prison outreach ministries that we conduct , the
feeding programmes of our church. We will also have reports as it relates to our Christian education , the organizational work within our church , the women’s work , men’s work , youth work , children’s work , we`ll have reports given on all of these areas.” He noted that the conference gives the church an opportunity to make projections and implement strategies that can fortify the work of the church going forward. “This year our main thrust is on the whole notion of hope, but that hope in particular from an individual perspective, Lord make me an instrument, an agent of Hope within the community. “We find ourselves living today in difficult times, and as a result of the times we find ourselves living in, we believe that the message of hope needs to be a clarion call within our community. “That people will come to understand and appreciate that no matter what circumstances they face life is not over , because God is our hope he`s still in control and we wish to ensure that that message reverberates right across our communities in the Bahamas and the Turks and Caicos Islands. Superintendent Minister for North TCI Circuit, Rev. Frednor Toussaint in his brief remarks noted that the theme is apt given the gloomy outlook most people have on life these days. He added that: “I do believe that the theme for this year is well chosen, because we are living in a time where people are hopeless, and they need to see that they have support. “Even right here in Providenciales

Rev. Claire Robinson pointed out that in addition to getting the message of hope out to the people it is imperative for the church to move beyond its four walls and reconnect with communities. “We have to begin to work with other agents who are doing the work
out there to assist young people, to assist single parents and all those persons who are coming to our shores to make a livelihood for themselves being separated from families and other loved ones and trying to assimilate coming into a new place, to be able to bring our community together to see how we will address some of the vices that are prevalent right now in our community. “And deal with issues of fear based on crime that people are experiencing in our islands something that they`re not used to in this day and age but something that we defiantly have to address. “Begin to work with our governments in the Bahamas and in the Turks and Caicos Islands to do what we can to enhance our islands and make it a better place for our people to live.” The convocation will also place special emphasis on connecting with youths on a deeper level to bring them back to a place of worship.
Health department continues fogging and inspection to prevent and control Zika BY OLIVIA ROSE THE ENVIRONMENTAL Health Department (EHD) has conducted over 300 premises inspections and fogged approximately 400 swamps in the Turks and Caicos Island in an effort to prevent and control the dreaded Zika virus. This was revealed when the Ministry of Health, Agriculture and Human Services updated the general public on initiatives taken to prevent and control the spread of Zika and Dengue within the Turks and Caicos Islands. According to the Ministry it has also served more than 100 notices to premises.
Coupled with this, the Health Promotion and Advocacy Unit continues to educate residence on vector borne illnesses. The ministry also pointed out that those climatic conditions over the past 2 week was not ideal for fogging, so the Environmental Health department focused its efforts on the vegetative areas to prevent breeding sites. “All active swamps were treated and residents in vulnerable areas were provided with insect repellents. Once conditions improve, the department will immediately initiate its fogging activities. “EHD has also conducted a general assessment of all the islands and has identified a number of
areas for the cleanup efforts to be conducted by Public Works. “In addition, both garbage trucks on Grand Turk have been functional and working on a daily basis. The department has not received any complaints for the delay of services or the lack of garbage collection.” “There has only been one confirmed case of Zika during pregnancy in 2016; the mother has since delivered without complications, and mother and baby are doing well. There have been no other suspected or confirmed cases of Zika among pregnant women.” “The Ministry continues to advise the public to wear protective clothing; loose, light colored long sleeves shirts and blouses and long

pants.” The Ministry is urging the general public keep home environments, work places, recreational places and places of worship free of standing water where mosquitoes breed. “As the Ministry of Health
Agriculture and Human Services continues doing its part to prevent and reduce the spread of Zika through its media campaigns, which educate the general public on how to prevent the spread of Zika, we encourages the general public to do its part.”

Nutrition in Demand hosts sixth annual Movea-thon fundraiser BY DAISY HANDFIELD NEARLY 200 participants either walked, ran or cycled during the sixth annual Move-a-thon fundraiser, an initiative that raises funds on an annual basis to educate students and residents on the importance of eating healthy and exercising. The event kicked off at the Kids Park in the Lower Bight in Providenciales on January 14, 2017 at 6 am. Participants donated in the form of a registration fee, with all proceeds going towards all of the services that Nutrition in Demand offers. Tamika Handfield, Executive Director of Nutrition in Demand told this publication on Wednesday (January 19, 2017), that she was
pleasantly surprised by the turnout, but was grateful for all of the support that she received from those that attended and from her sponsors. She said: “Thank you to everyone that came out and made this event possible. This would have not been able to go on in this fashion without the support of the community.” Attendees had the option of choosing between the five kilometres distance, 10 kilometres distance or half marathon distance; all starting at the Kids Park in the Lower Bight. The five kilometres started at the park and continued on the Alexandra’s Resort and then back to the Kids Park; the 10 Kilometres started at the park and continued to Ocean Club West and then back to the park and the half marathon
Police warn residents against sharing of obscene videos THE DISSEMINATION of a number of pornographic images and videos on social media outlets, featuring residents of the Turks and Caicos Islands, has led Police to issue a warning to culprits. According to a Police press statement, in some instances a few of these individuals appear under the age of consent, classifying these images as child abuse or what is commonly known as pornography. The statement read: “Anyone in possession of these videos or pictures or who forwards them on in any format is committing offenses under the obscene publications Ordinance and upon summary conviction can be liable to a fine of $5,000 or a term of imprisonment of six months, or both such fine and imprisonment.” Kevin Clarke, Police press liaison officer said that the circulation of nude and explicit images, including videos, are much more common than most parents realize. He explained that children under the age of consent with cellular phones are vulnerable to sharing these images with a friend who they think they can trust. “Once that photo is out there, it can be posted to a social website or sent to every cell phone in the
school, across the country, and around the world. We cannot tell people what to do during their sexual encounters. However, as an adult if you allow recording of the act, it is important to be informed about revenge porn. Revenge Porn is defined as the sharing of private, sexual materials, either photos or videos, of another person without their consent via any medium and with the purpose of causing embarrassments or distress. The victims of this humiliating, unacceptable and degrading act can be any age, men or women. This practice has also been described as a form of domestic violence and sexual abuse and is normally carried out by an exlover because a relationship has been terminated,” Mr Clarke said. Police are urging anyone with information of any nude images or pornographic videos circulating online, WhatsApp or Instagram and can assist in identifying either the people in the videos or those involved in their production or dissemination to contact the Sexual Offences Unit at 3385901 or visit the Internet Watch Foundation Turks and Caicos Islands reporting Portal at http:// www.report.iwf.org.uk/tc to report anonymously.

We had people from the Health Promotion Unit who spoke on Zika, as well as HIV prevention. There was information for everyone,” Mrs Handfield said. During the interview, Mrs
Handfield elaborated on what the funds would be used for, stating that a portion would be used to implement a fitness and exercise camp. Fourth suspect charged for alleged involvement in Gary Mead murder BY DAISY HANDFIELD JOSE Martinez, a Turks and Caicos Islander of Dominican decent, is the fourth suspect to be arrested and charged in connection with the murder of well-known business man, Gary Mead. The 25-year-old was formally charged on Wednesday (January 11) and cautioned with conspiracy to commit robbery. He appeared in the Magistrates Court last Thursday and has been remanded to Her Majesty’s prison in Grand Turk until his sufficiency hearing, which has been set for March 3, 2017. Meanwhile, three additional men from the Dominican Republic have been remanded after appearing in the Magistrates Court number 1 in Providenciales before Chief Magistrate Tanya Lobban Jackson on November 15, 2016, for charges relating to Gary Mead’s death. Carlos Peña, who was represented by attorney Ashwood Forbes, is charged with the murder of Mead on September 30, in the parking lot of the Slots-O-Fun casino, airport road Providenciales. Peña was also charged with robbing Mead of a box containing

money and items valued between US $21,000 and US $31,000 and a firearm. The second accused, Alexander Cuesta was charged with two counts of keeping a firearm, one count of keeping 10 rounds of ammunition and for conspiracy to rob Mead. The firearm which Cuesta was
charged with, fits the description of the gun court officials believe was stolen from Mead before he was killed. The third accused, Joselito Lafontaine Campusano, was charged with conspiracy to rob Mead. The three men will appear in court on January 27, 2017 for a sufficiency hearing.

Sonic fill - the next generation of filling technology Further to my attending the Greater New York Dental Meeting at the end of November 2017, I am introducing a new restoration (filling) technology to the clinic. This technology is exciting as it allows me to do a higher quality tooth restoration, faster and more efficiently. These fillings are still tooth-coloured (white fillings) and so give the appearance of natural teeth. I find it incredible that many dentists are still placing the old amalgam (mercury) fillings. Amalgam fillings were invented in 1819 and were first used in USA in 1830. Whilst concerns about mercury toxicity were raised as early as 1840, in the US it was not until 1990 that the general public started to become aware of the health concerns of this type of filling. Whilst I was trained to place metal fillings when I originally qualified (back in 1988!) I have not placed at metal filling since 1997. Composite (white) fillings
are not only a safer option they are also better from an aesthetic perspective. Composite fillings are constructed by building up layers and curing (setting) the material each time. Traditionally, a filling might be built up in two or three layers depending upon the size of the cavity. One of the main benefits of this new technology is that the material does not have to be ‘built up’ but can be placed in one application and cured (set) just once. Thus, making the application process faster, without compromising quality. Being able to fill a tooth and cure the composite in a faster time has benefits in various different scenarios. For example, in the instance of having a child in the chair (who may not be too happy about being there!) or when placing fillings in the back teeth of an adult who may be uncomfortable maintaining a wide open mouth for the period of

Bahamas: PM eager for another term AS he gears up for a leadership challenge at the Progressive Liberal Party’s first convention since 2009, Bahamian PM Perry Christie spoke of his energy and eagerness to serve another term, as he urged party supporters not to “squander” the opportunity to win the general election. Speaking before a crowd of jubilant supporters at a PLP Women’s Branch meeting on Sunday, Mr Christie brushed off his critics as he spoke of plans his administration looks to finalise before voters head to the polls this year. Highlighting many of his party’s achievements, Mr Christie contended that the PLP has done and continues to do “everything possible to move The Bahamas forward”. He also urged party supporters to show the country how strong and unified the PLP is at its upcoming convention. He suggested that despite efforts by a section of his party to unseat him as leader, he will not relent in the forward progress of the country, nor his political work. Touching on details of several initiatives including airports in North Eleuthera and Exuma, plans to construct a modern care facility for children with special needs and disabilities, and multiple public/ private partnership agreements that would see the construction of roadways, government buildings and other national projects, Mr Christie declared that the “work of country” would not slow due to “those that challenge our progress.” Mr Christie, 73, said despite his

He added: “Many times when some of my colleagues begin to bitch and complain, I ask them, I say suppose you were me?” Making note of the vicious criticism he has faced during this current term he said: “They curse me every day. And when they get tired of cursing me, they curse my wife and my daughter; my children. Listen, they even cursed Adam (Mr Christie’s autistic son) and Adam can’t even hurt a fly. “But this is what it is all about, you have a leader with big shoulders. One who understands governance in the Commonwealth of the Bahamas and one who wears his integrity right out in the open. Last Thursday the PLP announced that it would complete its candidate ratifications ahead of the party’s national three-day convention slated for January 24 to 26.
Moravian church leaders in Jamaica resign amid deepening sex scandal THE fallout from the sex scandal rocking the Moravian Church in Jamaica worsened on Thursday when two of the most powerful members of the church administration stepped aside. President of the Moravian Church in Jamaica the Reverend Dr Paul Gardner and vicepresident, the Reverend Jermaine Gibson, have both moved away from all positions in the church amid the sex-abuse scandal rocking the religious body in Jamaica. The resignations were tendered to Bishops Stanley G. Clarke and Devon Anglin, the spiritual leaders of the Provincial Elders Conference of the Moravian Church in Jamaica and Grand Cayman, following a string of problems besetting the church, including the fact that one of its ministers is before the court on an alleged sex charge and a series of emails such as a seven-page email to Bishops Clarke and Anglin, written by a woman two days ago, titled “The Shame is Yours”. The email details damning allegations and the bishops disclosed that the church is to set up an independent committee to

Guy Philippe: Former Haiti coup leader pleads not guilty in US court A HAITIAN former coup leader, Guy Philippe, has pleaded not guilty in a US court to drug trafficking and money laundering charges. Mr Philippe, 48, was arrested after appearing as a guest on a radio programme in Port-au-Prince last week. He was flown to the US to face the long-standing charges. Dozens of his supporters attended the hearing in Miami, demanding his release. Mr Philippe was recently elected to his country’s senate, “We are here to support Senator Guy Philippe. We all feel like he is innocent,” said Haitian Senator Evince Francois. “We are here to let him know we stand up behind him. We think this is all politics,” he told the Associated Press news agency. Until last week, the US Drug Enforcement Administration (DEA) listed Mr Philippe as a wanted man on charges of conspiracy to import cocaine and money laundering His arrest, on 5 January, came days

THE Ministry of Home Affairs has said that it welcomes the policy announcement by the US this week that the Obama administration has ended what was known as the ‘wetfoot, dry-foot’ policy of allowing Cuban migrants who make it to dry land in the US to stay legally. Cayman government officials said they believe it will reduce the number of migrants from the neighbouring island landing there. But the ministry was also quick to confirm that it will not affect Cuban migrants currently living in the Cayman Islands. “We welcome the policy change
and are hopeful that as a result we will see fewer numbers of migrants arriving on our shores and that ultimately it will lead to a decrease in the loss of life at sea,” said the acting chief officer for home affairs, Kathryn Dinspel-Powell. She said that members of the multiagency mass migration management committee have a meeting set for this month, where the US policy change will be discussed further. But the Cayman government will continue to manage the arrival of Cuban migrants in accordance with relevant local and international obligations.

T&T government moves to end child marriage THE Trinidad and Tobago Government is making moves to divorce itself from the decadesold practice of authorising child marriages. Last week, lawmakers began debate on the Miscellaneous Provisions Marriage Bill 2016 that seeks to raise the age of marriage to 18. It will render null and void, the Hindu, Muslim and Orisha Marriage Acts, which permit marriages from the ages of 12, 14, and 16, respectively in the case of girls. Attorney General Faris Al Rawi told the Senate the country recorded close to 3,500 child marriages between 1999 and 2016, with marriage certificates showing that some girls as young as 11 and 12 were married to men as old as 36, 42, and 56. He lamented that the twin-island
republic was one of only eight countries in the world where a child could be married as young as 12. Once passed, the bill will criminalise the marriage of people under 18 by a marriage officer, who would be punished with a $50,000 fine along with a seven-year prison sentence. According to the Trinidad Guardian newspaper, the Attorney General strengthened his case for the practice to be abandoned by presenting data showing a high number of child pregnancies. Rubbishing suggestions from some religious groups that early marriages protected young girls from sexual morality and unwanted pregnancy, Al Rawi revealed that between 1999 and 2015, hospital records showed that 15,231 girls gave birth.
Colombia expelled more than 20,000 Haitians in 2016 ON Sunday, authorities in Colombia revealed that, during 2016, they had expelled from their country nearly 34,000 illegal migrants, including: 20,366 Haitians, 8,167 Cubans, 874 Indians, 570 Congolese and 553 Nepalese, HaitiLibre reported. Foreign migrants were arrested mainly in the departments of Antioquia (North-West), Nariño, Valle del Cauca, Cauca (Southwest) and Risaralda (Center), said Christian Krüger, director of immigration in Colombia, who explained that the main road corridors used by human trafficking networks are located in these departments. “The number of irregular migrants reported by the Colombian migration services in 2016 is almost four times more than in 2015,” he noted. Colombia, Krüger said, because of its geographical position, is an obligatory route for all migrants seeking to reach Central America or North America. “We are not the cause, nor the origin
of this phenomenon, but to ensure the safety and integrity of these migrants we have had to increase our controls and work on regional strategies to combat this phenomenon and we have a zero tolerance policy against all individuals (smugglers) who benefit from these migrants to make a profit,” he said, adding that on average each irregular migrant pays between $2,000 and $2,500 to these networks to cross the country. In addition, Krüger said that, in 2016, his agency had identified new routes for migrant trafficking, using as entry points the Putumayo Departments, which border Ecuador and Amazon (border with Peru and Brazil). Also it was discovered that the Caribbean island of San Andres, was used by networks of traffickers as transit. On the island the groups of foreigners arrive with false documents, pretending to be Colombians, in order to take boats to destination in Central America. (Caribbean News Now)
CAYMAN Islands attorney general has revealed that government is planning to amend the marriage law over the coming year with a view to creating a single ground for divorce. Samuel Bulgin said that changes to the Matrimonial Causes Law will introduce the concept of the irretrievable breakdown of the marriage, abolishing fault-based grounds. Announcing the planned change during the opening of the Grand Court this week, it came ahead of comments from the chief justice about the high number of divorces here and the challenges they present. Chief Justice Anthony Smellie said that “remarkably for a population of our size, we see an average of some 250 divorce petitions each year in the Grand Court and some 200 family related applications in the Summary Courts.” He also emphasised the challenges that these cases present when a significant number of them involve parents and children from overseas. “When one party or the other leaves the jurisdiction, the difficult question – who should have the primary custody and care of the child? – will arise,” he said, as he spoke about the work of the family court and the gradual introduction of
mediation as an alternative way to resolve family challenges caused by divorce. CJ Smellie pointed out how frequently the questions of custody arise after children have been taken away from the jurisdiction by one parent against the wishes of the other, sometimes in contravention of a court order of the court. Dependent on the Hague Convention against child abduction, he said it was fortunate that there was a network of Hague Convention judges willing to work with each other to resolve cross-border family cases and who were accepting decisions made in the Cayman court and helping with the return of children. But he said the case management of family cases presented its own kind of challenges, which the court is beginning to tackle through mediation. Although the court was succeeding in getting cases before a judge within the targeted six weeks from the date of filing, the introduction of the Mediation Rules has already resulted in some successful dispute resolution, which the chief justice said would continue to be encouraged this year. He
revealed that the number of divorce filings for 2016 was at 245 but said the number was exasperated because family case are notoriously timeconsuming because the reluctance of parties to accept the court’s findings can, in some cases, see them drag on for years. “A judicially imposed solution is often resisted because one side or the other is reluctant to accept it and this results in these cases often coming back before the courts over the course of several years,” he said. “They require constant judicial case management and attention.” This is why all local judges and magistrates have now been certified to mediate in family and civil cases, the chief justice revealed. “The result is that the judiciary will now offer to mediate in cases coming before the courts, especially family cases where that is appropriate, and the parties agree to submit to mediation. Some cases have already been successfully mediated and attendance at Mediation Information and Assessment Meetings (MIAMS), at which the process and benefits are explained, is now mandated by Rules of Court for all matrimonial disputes brought before the courts,” he added. St Lucian schoolchildren warned of prosecution after drugs, weapons seized SHARP knives, cutlasses, scissors, screwdrivers and small bags of marijuana and crack cocaine are not unusual seizures for law enforcers in St Lucia. The problem is, these drugs and weapons are increasingly being confiscated from the bags of the nation’s students. Determined to arrest the alarming trend, the Community Relations Branch (CRB) of the Royal St Lucia Police Force has served notice that children who commit any serious criminal acts will be prosecuted. Last week, police laid bare the disturbing finds, which were seized during random searches conducted in 2015 and 2016. Forty-seven knives, including pen knives; five cutlasses; 46 scissors; nine screw drivers; and 14 lighters were recovered, along with 16 marijuana sticks, thirteen five-bag portions of the drug, 104 foil wraps of marijuana, and three foil wraps with crack cocaine. The offenders were, however, spared prosecution and placed in a rehabilitative programme coordinated by their schools. Officer Ted King of the CRB told reporters that students as early as Form One age were involved.

“The offenders and victims are getting younger and younger at an alarming rate, which is a cause for concern,” he said. King suggested that adults may be encouraging children in deviant behaviour, and he warned that anyone introducing students to the sale and use of drugs would face the full brunt of the law. rolling out a crime prevention initiative dubbed School Crime Watch. “We will ensure that our young people are not taken down the path of destruction or to a point of no return,” King said. “We will continue our proactive approach to assist and guide you. World News Brexit: UK to leave single market, says PM THERESA May has said the UK “cannot possibly” remain within the European single market, as staying in it would mean “not leaving the EU at all”. But the prime minister promised to push for the “greatest possible” access to the single market following Brexit. In a long-awaited speech, she also announced Parliament would get a vote on the final deal agreed between the UK and the European Union. And Mrs May promised an end to the UK’s “vast contributions” to the EU. The prime minister used the speech to announce the UK’s priorities for Brexit negotiations, including: Maintaining the common travel area between the UK and Irish Republic A customs agreement with the EU New trade agreements with countries outside the EU Continued “practical” sharing of intelligence and policing information “Control” of immigration rights for EU citizens in the UK and UK citizens in the EU A “phased approach” Mrs May said there would not be a “blow-by-blow” account of negotiations, set to get under way after Article 50 of the Lisbon Treaty is invoked by the end of March. It was not her intention to “undermine” the EU or the single market, she added.

EU leaders had warned that the UK cannot “cherry pick” access to the single market while restricting the free movement of people. Kenyan women urged to withhold sex in vote drive A KENYAN MP has asked women to withhold sex from their husbands until they register as voters for the 8 August elections. Mishi Mboko, the women’s representative for the coastal city of Mombasa, says it was the best strategy to shore up opposition votes. “Women, this is the strategy you should adopt. It is the best. Deny them sex until they show you their voter’s card,” she said. The registrations ends on 17 February. Ms Mboko said sex was a powerful weapon and would encourage reluctant men rush to register as voters in the exercise that began on Monday. She said her husband would not be affected by the boycott as he had already registered, the Standard newspaper reports. World News Eight men own same as poorest half of world: Oxfam EIGHT men own the same wealth as the poorest half of the world’s population, a level of inequality which “threatens to pull our societies apart”, Oxfam said on Monday ahead of the World Economic Forum opening in Davos. The wealth of the world’s poorest 3.6 billion people is the equivalent to the combined net worth of six American businessmen, one from Spain and another from Mexico. Picked from Forbes’ billionaires list, they include Microsoft founder Bill Gates, Mark Zuckerberg who co-founded Facebook, and Jeff Bezos, founder of Amazon. Oxfam pointed to a link between the vast gap between rich and poor and growing discontent with mainstream politics around the world. “From Brexit to the success of Donald Trump’s presidential campaign, a worrying rise in racism and the widespread disillusionment with mainstream politics, there are increasing signs that more and more people in rich countries are no longer willing to tolerate the status quo,”

Trump attack on Merkel rebuffed by French president FRENCH President Francois Hollande has brushed off stinging criticism of Germany’s liberal migrant policy by US President-elect Donald Trump. “[Europe] has no need for outside advice to tell it what it has to do,” Mr Hollande said. Mrs Merkel said the EU should decide for itself and US State Secretary John Kerry questioned Mr Trump’s remark. “I thought, frankly, it was inappropriate for a president-elect of the United States to be stepping into the politics of other countries in a quite direct manner,” he told CNN. “He’ll have to speak for that. The shooting occurred at Memorial Park in Northwest MiamiDade around 4 p.m., two hours after a Martin Luther King Jr. parade had ended, police said. Juan Perez, Miami-Dade police director, took to Twitter to condemn the shooting by calling it “shameful” and “not what the followers of Dr. King Jr. want out of our community.” Detectives evacuated the park and arrested two suspects as well as
recovered two weapons, police said. Police say among the eight people shot were three adults and five minors. An 18-year-old woman and 30-year-old Michael Clarke remain in stable condition while 20-year-old Jerome Battle is in critical condition, the Miami Herald reports. A motive behind the shooting and if other suspects remain at large are unclear. BISHOP Eddie Long, a controversial megachurch pastor, has died at the age of 63 after a battle with an aggressive cancer, according to his Atlanta church. Long had been reportedly battling health issues for the past few months and in September 2016, Long released a statement that said he was recovering from a “health challenge” in response to reports that he had been recently hospitalised. He never publicly disclosed what his illness was. “I am confident through my belief in God that my husband is now resting in a better place,” said Long’s wife, Vanessa. “Although his transition leaves a void for those of us who loved him dearly, we can celebrate and be happy for him, knowing he’s at peace.” The pastor delivered his last sermon on New Year’s Eve. Long had pastored the church, which at its peak had 25,000 members, since 1987, but in 2010 four young men accused

Prince’s estate has until Saturday to file an estate tax payment for the late rock superstar, and the taxes are expected to ultimately swallow nearly half the estate’s estimated $200 million value, meaning a likely windfall of roughly $100 million for the government. Estate law experts say Prince could have prevented that. Here are the issues: WHY THERE’S SO MUCH MONEY Prince left no known will when he died in April of an accidental painkiller overdose, and apparently did nothing to shelter his assets from the taxman. So, federal and state taxes will claim roughly half of it, said Mark Bakko, leader of the tax practice in the Minneapolis office of the accounting firm Baker Tilly, which is not involved in the case. The value of Prince’s estate when he died is subject to a federal tax of 40 percent and Minnesota’s tax of 16 percent. With exclusions and deductions, the total bite will be closer to 50 percent. The estate can seek an extension for filing the return but can’t delay the first payment.
DAMAGE COULD HAVE BEEN LIMITED Experts say Prince could have set up an estate plan with trusts to benefit any relatives and charities he chose — while leaving little if anything to be taxed. “The reality is there are only three options,” said Robert Strauss of the Los Angeles estate law firm Weinstock Manion, which isn’t involved either. “There’s family and friends, there’s charity, and there’s Uncle Sam. And most clients would rather that Uncle Sam got less.” Instead, Prince’s six siblings are expected to equally split what’s left. Estates worth under $5.45 million for individuals and $10.9 million for couples aren’t subject to federal estate taxes. But David Herzig, a tax law professor at Valparaiso University, said the case is a reminder that there are good reasons to have a will and estate plan, even if taxes aren’t an issue, because they can set up trusts that keep assets private and out of the probate process. “(People) think they have to be as rich as Prince before they need estate plans,” said Jeffrey Scott, a St. Paul
estate attorney. “If your net worth is a couple hundred thousand dollars, you need some kind of estate plan.” COMING UP WITH THE CASH The estate doesn’t have to pay the entire bill by Saturday. Big estates can make payments over time. That helps because Prince wasn’t very liquid. A recent inventory listed about $110,000 in cash, about $830,000 in gold bars but no stocks or bonds. It also listed real estate worth about $25.4 million. That inventory doesn’t include his entertainment assets, which are still being valued. LESSONS FROM MICHAEL JACKSON It’s not clear whether the IRS and Prince’s estate will agree on the value of his music catalog because it’s difficult to put a dollar value on such assets. The experience of Michael Jackson’s estate suggests a long slog in court if they can’t agree. Jackson died in 2009. The tax case finally goes to trial in Los Angeles next month over more than $700 million in taxes, interest and penalties. (Dailymail)

on Earth’. The owner of the Ringling Bros. and Barnum & Bailey Circus
announced that the show will close forever in May.
The iconic American spectacle was felled by a variety of factors,
including declining attendance, high operating costs, changing public tastes and prolonged battles with animal rights groups. The show has been a staple of American family entertainment since the 1800s but attendance had a ‘dramatic drop’ when elephants were removed from performances last May. ‘There isn’t any one thing,’ said Kenneth Feld, chairman and CEO of Feld Entertainment. ‘This has been a very difficult decision for me and for the entire family.’ The company broke the news to circus employees Saturday night after shows in Orlando and Miami. Ringling Bros. has two touring circuses this season and will perform 30 shows between now and May. Major stops include Atlanta, Washington, Philadelphia, Boston and Brooklyn. The final shows will be in Providence, Rhode Island, on May 7 and in Uniondale, New York, at the Nassau County Coliseum on May 21. The circus, with its exotic animals, flashy costumes and deathdefying acrobats, has been a staple of entertainment in the United States since the mid-1800s. Phineas Taylor Barnum made a travelling spectacle of animals and human oddities popular, while the five Ringling brothers performed juggling acts and skits from their home base in Wisconsin. The Feld family bought the Ringling circus in 1967. The show was just under 3 hours then. Today, the show is 2 hours and 7 minutes, with the longest segment — a tiger act — clocking in at 12 minutes. ‘Try getting a 3- or 4-year-old today to sit for 12 minutes,’ he said. Feld and his daughter Juliette Feld, who is the company’s chief operating officer, acknowledged another reality that led to the closing, and it was the one thing that initially drew millions to the show: the animals. Ringling has been targeted by activists who say forcing animals to perform is cruel and unnecessary. In May of 2016, after a long and costly legal battle, the company removed the elephants from the shows and sent the animals to live on a conservation farm in Central Florida. The animals had been the symbol of the circus since Barnum brought an Asian elephant named Jumbo to America in 1882. In 2014, Feld Entertainment won $25.2 million in settlements from groups including the Humane Society of the United States, ending a 14-year fight over allegations that circus employees mistreated elephants. By the time the elephants were removed, public opinion had shifted somewhat. Los Angeles prohibited the use of bull-hooks by elephant trainers and handlers, as did Oakland, California. The city of Asheville, North Carolina nixed wild or exotic animals from performing in the municipally owned, 7,600-seat U.S. Cellular Center.

Eating disorders can strike in mid-life Capsaicin, the substance that makes chilies hot, may not just be for pepper spray and topical creams — it could be the key to longer life.
Red hot chili peppers may prolong life: study SOME like it hot — and may live longer because of it. Eating chili peppers has been tied to living longer in a new study published in the Public Library of Science journal, PLoS ONE. More than 16,000 adults were surveyed on their background, eating habits and current health from 1988 to 1994, and were followed up on for a period of 18 years. Total mortality rates for patients who consumed chili peppers were 21.6% compared to 33.6% for those who didn’t. It’s still unclear what exactly causes the hot peppers to extend life, states the PLoS study, but its authors notes that capsaicin may be the miracle worker. Capsaicin, the component that makes a chili hot, can affect the body
in many ways. It can metabolise fat breakdown and storage for energy in different organs, protecting against plaque buildup, high cholesterol and obesity. This, in turn, can also reduce hypertension and type 2 diabetes, as well as deactivate certain regulators of cellular growth, which could stop tumours. Different types of hot peppers also contain B, C and pro-A vitamins, antioxidants and antiinflammatory effects. The study specifically asked participants whether they ate “hot red chili peppers,” but that doesn’t necessarily mean that hot green and yellow peppers don’t pack the same benefits. The PLoS ONE study referred to two prior studies that supported the belief that hot peppers were key to longevity.
EATING disorders, including anorexia and bulimia, affect a small but substantial number of women in their 40s and 50s, UK research suggests. The study, involving more than 5,000 women, found just over 3% reported having an eating disorder. Some said they had experienced it since their teens, others developed it for the first time in their middle age. Julie Spinks, from Beaconsfield, is 48. She was not involved in the study, but can relate first-hand to its findings. She developed anorexia for the first time when she was 44. “It was a complete shock at the time,” she recalls. “I knew that I was restricting my food but I didn’t ever think I had anorexia. “I’d been really unhappy at work and had very low self-esteem. To begin with I just thought I had lost my appetite. “I felt depressed, like I was not worth feeding or existing. I wanted to disappear and fade away.” Julie started to lose weight quite quickly and began to exercise as well. She realised something was very wrong one day after she had been to the gym. “I’d run for about an hour and burnt off about 500 calories. I remember thinking that’s about the same as a chocolate bar. That’s when I started to link food and exercise.”

Julie still did not recognise she had anorexia though. “I thought anorexia was something that happened to other people. It didn’t occur to me that I might have it.” After a breakdown at work she went for a mental health assessment. Her doctors then diagnosed her with anorexia and depression. Julie was given antidepressants and began therapy sessions to help with her eating disorder. She says it has been an incredibly difficult time - at one point she had to be hospitalised because her weight became dangerously low - but she is now back to a healthy weight and is doing well. “I’m much better but I would say it is always in the back of my mind.
I have good days and bad days. The whole eating process is a struggle,” she explains. “Before I knew about eating disorders I thought anorexia was a teenage thing. I thought it was a thing that affected people who wanted to look good or be a model. But it’s not about looks, it’s about how you feel.” Dr Nadia Micali, lead author of the study that is published in the journal BMC Medicine, said: “Many of the women who took part in this study told us this was the first time they had ever spoken about their eating difficulties, so we need to understand why many women did not seek help.” Tom Quinn from the charity Beat says social stigma is part of the issue.

Scientists learn why women go through menopause by studying killer whales SCIENTISTS allege in a recent study that menopause, when females no longer produce eggs to bear children, was an evolutionary development that helps end conflict between mothers and daughters. In the study, the researchers state that menopause helps alleviate strife between females and keeps them from being a sexual threat to their offspring. The study was conducted at the University of Exeter and examined one of only three species on the planet that undergo menopause — killer whales. Human females, of course, and pilot whales also experience menopause, and the Exeter researchers have made what they feel is a connection.
Professor Darren Croft, who led the study, wrote the following: “Our previous work shows how old females help but not why they stop reproducing. Females of many species act as leaders in late life but continue to reproduce, but this new research shows that old females go through the menopause because they lose out in reproductive competition with their own daughters.” Essentially, Croft and his team believe that if female killer whales were able to continue to bear offspring, it would harm the survival of the whale pod group. Older female whales are seen as leaders and caretakers, sharing their food and how to survive.
HUMANS may have been living in North America 10,000 years earlier than previously suggested, a new study has proposed. The team from the University of Montreal in Canada analysed artefacts from the Bluefish Caves in Yukon, which lie in an area called Beringia, a dry mass of land now mostly found underwater. The site stretched from Yukon to Alaska over the Bering Sea leading to Russia almost 24,000 years ago during the last ice age. The new testing suggested this as the time when humans lived near the caves, setting back 10,000 years the known timing of human entry into North America via the Bering Strait. Once confirmed, the findings on the new carbon aging tests on the ancient animal bones — first discovered in the caves in the 1970s — would place the caves as the oldest known North American archaeological site, and the bones would emerge on record as the earliest proof of human settlement
there. Archaeologist Jacques CinqMars excavated the site from 1977 to 1987, radiocarbon-dating the animal bones and hypothesising that humans settled in the area as far back as 30,000 years ago. But it was a controversial finding as there was no direct proof that the presence of the bones in the caves represented actual human activity. After examining about 36,000 bone fragments from the same site for two years, the University of Montreal team saw marks of human activity in 15 bones and probable traces of the same activity in about 20 others. “We have lots of lines of evidence that are converging on what looks like quite a coherent story of what looks like human presence,” said anthropologist and study author Ariane Burke, citing a series of straight, V-shaped lines on bone surfaces as made by stone tools meant for skinning animals. The team performed added testing
via radiocarbon dating. A horse mandible, the oldest in the samples and displaying marks from a stone tool believed to have been used to remove the tongue, was radiocarbondated at 19,650 years and equated to 23,000 to 24,000 years ago. Pollen found in the caves, too, was confirmed to be from the same time period. According to Burke, certain findings in population genetics studies have demonstrated that a group of a few thousand people from Central Asia lived in Beringia — a massive region that stretched from the Northwest Territories’ Mackenzie River to Russia’s Lena River — isolated from other groups 24,000 years ago during the last ice age. Their new results, she said, confirmed the standstill theory, which argued that the region was shut close from the rest of the continent by steppes and glaciers not conducive to humans. It was likely a place of refuge, the researcher added.

Footballers Goodwillie and Robertson ruled as rapists A FORMER Scotland international footballer and his ex-teammate have been ruled to be rapists and ordered to pay £100,000 damages despite never facing a criminal trial. Denise Clair, who was left “devastated” by a Crown decision not to prosecute, sued striker David Goodwillie. She also sued Goodwillie’s then Dundee United colleague David Robertson. She claimed they raped her at a flat in Armadale, in West Lothian, after a night out in Bathgate in January 2011. It was the first civil rape case of its kind in Scotland. Ms Clair, who previously waived her right to anonymity, said she could not remember what happened after being in a Bathgate bar and woke up in a strange flat the following morning. The 30-year-old originally sought £500,000 in compensation, but damages were later agreed at £100,000 in the civil action at the Court of Session in Edinburgh. The mother-of-one maintained she was incapable of giving free agreement to sex because of her alcohol consumption, but Goodwillie, 27, who now plays with Plymouth Argyle, and Robertson claimed that intercourse had been consensual. A judge said: “Having carefully examined and scrutinised the whole evidence in the case, I find the evidence of the pursuer (the woman) to be cogent, persuasive and compelling.” Lord Armstrong said: “In the result, therefore, I find that in the early

Goodwillie had gone to join Robertson in Bathgate after the pair had played for Dundee United against Aberdeen on 1 January during which Goodwillie scored an equaliser. He maintained that he did not think Ms Clair was too drunk to consent to sex. However, a security firm employee working at the nightclub told the court that she had been in need of an ambulance.

MANCHESTER City midfielder Yaya Toure has turned down a £430,000-a-week offer from China. Toure, 33, was the subject of interest from the Chinese Super League last summer. He decided against moving then and gave the same response when he was contacted again to say the offer remained open during the current transfer window, which closes on 31 January. Smith looking to improve on the track – Has serious political aspirations TERAY Smith didn’t realise his picture had just been broadcast around the globe until he returned to the Olympic Village in Rio de Janeiro, Brazil last August. “The opening ceremony was amazing,” said Smith, a senior on Auburn’s track and field team. “I didn’t know it was live on TV. When I got back to the Village, I had a bunch of people sending pictures of me on TV.” Smith (a former national junior athlete from the TCI) ran the 200 metres in the Rio Olympics for the Bahamas, despite injuring a hamstring three months earlier in the SEC Championships. “I wasn’t able to compete at regionals because I got injured at the SEC meet,” Smith said. “It was a blessing to know that even though I didn’t make it to nationals, God had something different in store for me, which was something bigger, the Olympics.” Everywhere Smith looked in the Olympic Village, he saw famous faces such as NBA stars Carmelo Anthony, Kyrie Irving and DeMarcus Cousins. “What really amazed me is when I got to see the US basketball players,” Smith said. “I was like, `Wow. These guys are at the same place as me. I guess I’m great as well.’” For Smith, the Olympics were part competition, part reunion. “My teammates from the Bahamas, then my friends who run college track and field who made teams for their country. We all linked up,” he said. It felt kind of like home.” Home, for Smith, is Freeport, Bahamas. He attended high school in Miami and holds dual citizenship. Where he grew up, track is a big deal. “You know how ya’ll view football? That’s how we view track,” he said. “Track is very big. “When the Bahamas is running, every bar, every restaurant, every place that

has a TV, they’re watching. They’re really supporting their athletes.” That notoriety makes Smith something of a celebrity. “I get love when I go home,” he said. “I’ve been on a lot of national teams. I won a few medals as a junior as well.” Smith ran a 20.66 in the 200 metres in Rio, close to his season best of 20.62. “It just motivates me going into my senior season to work hard,” he said. “No days off. It motivates me. Because when the World Championships comes, I want to be in the finals. I want to be in contention to represent my country to get a medal, and to represent Auburn.” So far, so good. Smith won the 200 in last week’s Commodore Invitational indoor meet in Nashville in 21.22 “I’m in the best shape of my life, thanks to my coaching staff at Auburn and the trainers,” he said. Smith wants to take aim at his outdoor best of 20.34, hoping to qualify for the World Championships in London in August. “My personal goal is to become the first Bahamian to run sub-20,” he said. “If I run sub-20, I’ll be in the finals. That’s a big goal, to be the first Bahamian athlete to ever run 19 seconds, and I know I can do it.” Speaking of big goals, Smith, a public administration major, has one away from the track. “I’m going to run for prime minister of the Bahamas one day,” Smith said. “That’s my goal. People might laugh at me but that’s a goal I have. I just want to help the people. Do it for the people.” Before Smith trades in his tracksuit for a politician’s suit, he plans to return to the Olympics in 2020 in Tokyo. “I’m just getting started,” he said. “I’m just putting my foot in the door.” (Reprinted from Auburntigers.com)
Sharks opened their campaign with a win.
Sharks open PPL with come-from-behind win THE SWA Sharks opened the 2017 season of the Gilley’s Enterprises Provo Premier League with a come-from-behind 3-1 win against Beaches last Saturday evening at the Academy Ground. Saturday had four of the seven teams in action with defending champions AFC Academy drawing 3-3 with Cheshire Hall in the main clash. In the opener both teams had chances early, but Beaches drew first blood in the 12th minute of play after Romaine Small took advantage of a confused Sharks’ defence and a miscued clearance by the keeper. The header was cancelled out by Alex Bryan just before half time. The Sharks were able to play better football in the second half. They took the lead after a free kick was taken just outside the penalty area. Quinn Hawkins took the kick
which Alex Bryan headed on and Brian Gregg volleyed in superbly from an angle. Sharks wrapped up the game later in the half when Gary Bell crossed from left and Dave Dooley swept the ball into the net. CHESHIRE HALL FIGHTBACK The rivalry in the feature clash was evident from the opening minutes as defender Alex Cea brought down Academy striker Raymond Burey, which resulted in a penalty and a red card. The penalty was smartly taken into the roof of the net by the Academy goalkeeper, Evelsen Jean, to open the scoring in the sixth minute. The defending champs looked solid as Burey finished a well-placed through ball to make it 2-0. Cheshire Hall conceded another as Patrick Alouidor ran at the defence from the
left and slotted the ball in the right hand corner. During this time things were even on the field giving that Markenly Amilcar was also sent off (two yellows). Cheshire Hall were in danger of collapsing at this point, but managed to re-group and play some more measured football with Ketroy Rose and Fritz Gerald Norvius taking charge. This improvement resulted in a goal just before half time to make it 3-1 after a good finish from Wilwood Telford. Soon after, Cheshire Hall scored another with a great header by Rose. In the second half, the game was more evenly balanced, but tense. Cheshire Hall kept improving and were rewarded with an equaliser from Telfort. They, however, went down to nine men when one of their better players, Jeanlis Job, was sent off after picking up his second yellow card in the 79th minute.
Sauver records third personal best in as many meets NATIONAL athlete Helcy-Ann Brianna Sauver has recorded her third personal best this season. The 19-year-old Jamaican based athlete ran the 200M out of lane one to finish fourth in her heat at the Kirkvine JAA/Puma Development Meet, which was held at the Windalco Kirkvine Sportsclub in Manchester last Saturday. Sauver’s 25.34s tops her previous best which was 26.19s made at the 2015 Inter-High School Championships. “Because I picked a bad lane, knowing that I struggle to run a good curve, I’m not happy with

Flyers suffer mix fortunes in competitive Midget Division THE Villa del Mar Flyers registered an emphatic win over the Saunders Greyhounds and then were beaten badly by the Gansevoort Gators in the very competitive Midget Division of the Provo Hockey League. When the dust had settled last Saturday in the first week of play for 2017, after a month’s break for the holidays, all three teams had four wins and an equal amount of losses for a three-way tie. The Midget Division started with the Flyers registering a strong opening leading. Their 5-1 first half lead was led by Darius Coakley, who scored three of his five goals in the period. Coakley is leading the league with 39 goals. His teammate Tristan Grandsire added two goals and three assists in the 10-6 win. The Greyhounds were led by Dylan Ayer (two goals and three assists), Joshua Saunders (two goals) and Zachary Scholar (one goal and
two assists). Coakley then led the Flyers to a 2-0 lead in the other clash, before Gators took control and scored 10 unanswered goals. Bradley Ayer led the winners with five successful strikes, while Jake Whent and Ronin Maclaren added two each and Sebastian Turbyfield one with two assists. In the Novice Division the Grace Bay Car Rental Islanders recorded their second draw after holding the Scotiabank Sailfish to a 1-1 scoreline. The Islanders, who are chasing their first win, scored the opening goal four minutes into the second period (via Dylan Wells). Jake Haggie levelled the score four minutes after. In the second clash the Grace Bay Resorts Conchorers defeated the Sailfish 3-2. The Conchorers, who are four points ahead in the division, took the
lead via a Jemima Osmond goal in the seventh minute before Haggie scored the first of his double for a 1-1 half time score. Joshua Fielding scored upon resumption and three minutes later to register the team’s sixth win in eight games. In the Bantam Division Jaden Robinson scored four goals, including three in the first half as the Projetech Penguins recorded a 4-1 win over the Digicel Comets. Sean Mcgurk scored the Comets’ goal. In the other clash, the Coco Bistro Bruins defeated the Turkberry Hurricanes 7-6. The, top of the table, Bruins were led by Kurt Rivers and Olivia Park with three goals and an assist and two goals respectively. Max Scholar added a goal and two assists. Maddox Zaidan Jones (three goals and an assist) and Valentine Osmond (two goals) were the main attackers for the Hurricanes.

fifth in the event, cleared 1.80M—the same mark that he jumped at CARIFTA in 2015. The Grand Turk born, Jamaica College student, will focus on the 100M, the 200M and the high and long jumps this season.

Jean fires Stallions to big win CLIFTON Jean was on fire last Saturday night as he led the GT Stallions to a 21 point win 94-73 over the Nazarene Kings in the Provo Amateur Basketball Association (PABA) Night League. The competition which resumed last weekend at the Gus Lightbourne Sports Complex court after a break for the holidays saw the talented Jean explode with a game high 42 points, two rebounds and two steals. Levenskay Missick added 15 points and five rebounds. Lofton Seymour and Dwayne Hamilton led the Kings with 15 points and two assists and 14 points, five rebounds and three steals respectively. In the second clash the Spartans recorded their first win this season when they got past the Predators 5746. Devon Williams led the Spartans with 20 points and five rebounds, while Emanio Williams added 14 points. The Predators were led by Carlo Bassett with 12 points, three rebounds and three steals. UNBEATEN On Friday night the Flyers recorded
a thrilling overtime win against defending champions the Knights. When the two Five Cays teams met last year in their first meeting of the season, they battled to double overtime. In the game (82-80), which had several lead changes, Anthony Cash led the Flyers’ attack with 20 points, six assists and four steals. Anthony Pratt chipped in with 11 points and four rebounds. Last season’s MVP Melvin Elsie Jr. made his return to the league with 22 points and six rebounds. Andujar Gardiner also scored 22 points, while Harry Cooper chipped in with 13 points and 10 rebounds for the Knights. Earlier in the night Jordan Garland banged a three-pointer off the backboard in the dying seconds, some distance from the line, to give the HAB Sonics a one-point win 5049 over rivals the Hustlerz. Dudley Lightbourne led the Sonics with 14 points, while Alvardo Parker had an all-round game with nine points, six rebounds, three assists and four blocks. Kirk Adams led the Hustlerz with 19 points and seven rebounds. Troy Saunders added 12 points.
Forbes signs with San Antonio FC TCI’s senior national football captain Billy Forbes has signed with the San Antonio FC for the upcoming United Soccer League (Division II) season. The attacking midfielder, who spent two years (2014-2015) for the now-defunct San Antonio Scorpions of the North American Soccer League, and one year (2016) with Royo OKC, was elated to return to Toyota Field (the venue of the team). As a formality the signing is pending approval from the league and the US Soccer Federation. Despite this, San Antonio FC (into their second year as a club) seem to have Forbes as one of the centre pieces of the team.
The football website is littered with information about Forbes’s return to the city, with one article even referring to him as Billy “the Kid”. “We are really glad to have Billy back in San Antonio,” San Antonio FC coach Darren Powell said in a press release. “He is an exciting player who we feel can be one of the best players in the USL. He can create opportunities for himself and other players especially in the attacking half. We hope that we can continue to help with his development here in San Antonio.” Forbes, who turned 26 last month, made his mark while at the Scorpions. In total he
scored nine goals and added a club-best 15 assists during his two seasons with the club. He also helped the team win the NASL title in 2014. “I am so excited to be back home in San Antonio and join an organisation as impressive as this one,” Forbes said. “I have incredible memories of playing in front of these amazing fans at Toyota Field and I can’t wait to experience that again. I look forward to working with the team and everyone else involved to help bring a USL championship to San Antonio.” Prior to the Scorpions, Forbes played for Western Texas College and Lubbock Christian University.
Singh scores five in Small World PPL victory PROLIFIC scoring from Lenford Singh fired new team Small World to victory in the Gilley’s Enterprises Provo Premier League (PPL) on Tuesday night. In their opening game at the Academy Ground, Singh fought back from a goal down to lead his side to a 6-4 win against Full Physic. The national player scored five goals—the most of his club career. “I feel very focused right now and am confident with my new team,” the 31-year-old told the Weekly News. Singh’s previous best was four for OHS Express against the Sharks in 2009. Fred Dorvil, who opened the scoring for Full Physic, finished with three goals.
