Who Needs Laws Anyway?
Imagine the scene: You’ve just arrived home from school – first your Mum tells you off because you’re a bit late, then she mentions it’s your turn to help with the dinner preparation and then you remember the big maths assignment that’s due tomorrow. So many rules, you think, who makes them and why do we need them anyway? Wouldn’t it be great to get home when you wanted, play computer games all afternoon and not worry about any rules anyone tried to enforce? You probably wouldn’t have to go to school; you could stay up all night if you felt like it and your weekends would be totally job-free. Sound good?

Well, it would be good if you also liked a world where there is no protection from murder or assault, where anyone could steal your stuff and get away with it and no one actually ran the country! Rules and laws are important to the operation of society. In fact, rules, laws and customs have controlled most of the school day you have had so far.
Customs:
Laws:
Sometimes our behaviour is based on our usual way of doing something. We act not because there are rules or laws that control us, but because it is expected of us. For example, there is no rule or law that says in Australia you must eat with a knife and fork – some people do, some people instead eat with chopsticks. What we do is our custom.
Whilst rules apply to certain groups of people laws apply to everyone. Laws are made by the government and are important to everyone in society. Laws protect people, their property and their rights and freedoms. People who live in society have rights but they also have responsibilities. Rights can be taken away from people if they do not show responsibility.

Rules:
Anarchy:
Rules are more formal than customs and usually apply to a certain group of people. They could be said to be a more dominant custom. Schools, classrooms, sporting associations and families are all likely to have rules that apply to the members of that particular group. If you play football or netball, for example, there are rules that apply to how the game is played. Every player must play by the rules or accept the game’s penalties.
Anarchists are people who believe that there is no need for government or laws. Anarchists believe individuals would do the right thing without any laws.

You might have heard of the Y2K virus or millennium bug. In 1999 people were worried about a possible computer error which might occur as the year turned from 1999 to 2000. Thinking it was the year 00 many computers might wipe out all information from 1900 onwards. Luckily this didn’t happen – imagine the chaos! Banks could be pouring money from automatic teller machines, traffic lights would jam, prisoners would be accidentally unlocked from their prison cells … it would be as if the world we know never existed. Governments would need to be established and rules and laws would need to be made for a very different society – what a great script for a movie. Imagine you are a scriptwriter. You know that the Y2K computer virus would make a fantastic disaster movie – not only would there be chaos when the virus hit but then afterwards everything on Earth would have to be set up again with new governments and laws. Now you just need to convince a movie producer to make your film. Write an outline of your script idea in the storyboard on Page 9. Where Did Our Laws Come From? From the time you could talk you would have been aware of rules and laws. In fact even when you were a baby there were probably rules that you couldn’t throw food from your high chair! Where did our rules and laws come from? Many civilisations realised that for there to be order they needed to make laws based on what was important to them. According to the Bible, for example, the Ten Commandments were written on stone and handed to the Jewish Holy man, Moses, as laws for the Jewish people to follow.

The ancient civilisations of Greece and Rome also had legal codes for their citizens to follow. Draco drew up the earliest Greek legal code in 621 BC. These laws were very harsh and even today, extremely severe laws are known as Draconian.
Between 100BC and 400AD the Roman Empire was a significant part of the world and laws were drawn up to deal with people living both in Rome and under the Roman Empire but in other parts of the world. It was the Romans who started the belief that people are innocent until proven guilty. The area that is now known as the Middle East contained the ancient civilisations of Mesopotamia. It is these people who are believed to be amongst the first to draw up codes of law. The oldest written set of laws is the Code of Hammurabi written by King Hammurabi of Babylonia (which is now Iraq). These laws – there were more than 280 of them – were carved in stone and placed throughout the city so that people would know about them. The laws dealt with issues like private property, business and family relations, work and personal injury. The punishments for breaking the code were very severe – this is where the saying “an eye for an eye” comes from.

When European settlers arrived in Australia in 1788 the many groups of Aboriginal people living here already had a well-established system of laws. The rules of behaviour that Aboriginal people were expected to live by were handed down from generation to generation through stories and ceremonies that came from the Dreaming. Often different groups of people had different laws. Some of the types of laws in Aboriginal society included how people should behave towards each other, how the land should be cared for and who could marry whom. There are still some places in Australia where Aboriginal laws exist and in some cases judges have allowed traditional law to be applied to court cases. When Europeans arrived in Australia they brought with them many of their traditions from their home country so now much of Australia’s legal and parliamentary system is similar to that in the United Kingdom.

Every citizen is required to obey a number of laws. Not only are there local laws and laws that apply to a particular state or territory in which a person lives, but there are also national (or federal) laws and international laws. Who makes them all up?

Originally laws were made from something known as precedent. If a case came to court (say for a theft) then the next time a similar case came along the previous judgement would be examined. Decisions in similar cases would then be continually developed. This is known as common law. If the circumstances of a case were different then the decision may be different and the new decision would become a precedent for the next similar case.

Sometimes cases may come before the court where parliaments have not made any laws so court cases are decided according to common law. In matters where there are laws, judges must follow those laws. If there is ever any conflict between the two types of law then statute law is followed.

Civil law doesn’t affect everyone. This type of law is between two people about a matter which affects only them. For example, a dispute between you and your neighbour about their barking dog could be dealt with in a court if the matter could not be settled any other way.
Criminal Law
Murder, burglary and physical assault are all examples of criminal acts and the law, which deals with them, is criminal law. Criminal law involves a situation in which a person has done something which is seen as a threat to the whole community. The government (also known as the “State”) takes responsibility for taking people accused of these crimes to court to answer for what they have done. When the accused appears in court it is said to be “‘the State versus the person”.

Crime and Punishment – The Police The government is responsible for making laws. This is known as the legislative function of government. This is one of three functions, or arms, that a government has. Laws exist to protect the community so it is important that they are carried out or enforced. Enforcing the Law – The Courts The third function of government is known as the judicial function. This involves the settling of disputes in courts. Not every dispute, however, comes before the formal

courts of Australia. In addition to courts there are other bodies, which are designed to hear complaints and decide on issues, which are more minor. Some of these are: The small claims tribunal; The ombudsman.
If a case does get to court there are many different courts depending upon the seriousness of the crime. For example, someone who has sprayed graffiti on a wall is not likely to be dealt with in the same court as someone who has committed murder.

There are two levels of courts in Australia – the federal courts and those in the states and territories. The highest court in Australia is known as the high court. This court hears cases to do with the states and international law. Each state and territory has its own hierarchy of courts with the Supreme Court generally being the highest. As well as hearing more serious cases the higher courts in each state are also able to hear appeals from people who have already had their case heard in the lower courts. There are special courts dealing with, for example, family issues and juveniles.

From Democracy to Dictatorship
Nazi Germany is probably the most recognised form of dictatorship in the world. The nation of Germany is a democracy now and was a democracy before the dictator Adolf Hitler came to power. In fact ordinary people voted for Hitler! Once Hitler took over complete control many aspects of life changed in Nazi Germany. For example:

Laws no longer protected people and Hitler ruled by terror. A secret police force was set up to find out who opposed Hitler and get rid of them; The army was built up because Hitler knew that there would be wars with other countries;

Federation

Prior to 1901 Australia was a collection of six separate colonies each with their own governments. Australia’s present system of government came into being on 1 January 1901 with the joining together of the separate colonies. This process was known as Federation and the first federal government was elected in 1901. Federation was not achieved easily. Each colony wanted to keep some of their strength and power and compromise was difficult to reach. Some of the arguments for Federation included strength and protection against foreign threats, better trade between the states, and a stronger position for Australia in world affairs. On the other hand arguments against Federation included the concern that majority rule would favour the stronger states. Some of the key players in the achievement of Federation were:

Henry Parkes – Often called the “Father of Federation” he made a famous speech in 1898 supporting federation;
Sir Edmund Barton – Played an important role in developing Australia’s constitution and was Australia’s first prime minister; and Alfred Deakin – A great supporter of Federation and served as prime minister of Australia three times.

Government in Australia There are three levels of government in Australia:
Federal
State
Local
Matters of importance to the nation as a whole are the responsibility of the national or federal government. This government is located in Canberra and the building itself is known as the parliament. The federal government is made up of two houses:

The house of representatives (or lower house); and The senate (or upper house).

Both houses have very different roles. Any parliament that is made up of two houses is known as a bicameral parliament. England and the USA also have two houses of parliament. In Australia the people elect each house. Each state and territory also has its own government, which deals with issues specifically relating to the state. Elections are generally held every four years and the people of the state elect politicians to represent them in government.
Many day-to-day issues are the responsibility of local government. A local government represents the residents of a local area. There are more than 800 councils throughout Australia. Your local government may be known as a shire, town or city.

Local governments look after the people in the local area and provide local services like parks, recreation centres and libraries. The laws of local government are known as by-laws. Each state and territory in Australia is divided up into areas with its own local government. There are more than 800 local government authorities across Australia. In Australia both the smallest and largest local government areas are found in the state of Western Australia. Each local government is further divided up into wards. Councillors are the representatives of the residents of their particular wards and are elected by the local people (citizens over 18 years old) for a term of two years. One of the councillors is then elected to become the leader (called a president in a shire and a mayor or lord mayor in a town or city).

The states and territories of Australia have always had their own governments. Initially Australia was made up of separate colonies with separate governments. Before Australia joined together (federated) in 1901 the colonies all held their own elections for government and made different laws. In 1901 Australia became a federation of states (six states and two territories), which meant that although the states had control over some areas, a federal government controlled matters to do with Australia as a whole. In each state except for Queensland there are two houses of parliament – the lower house (or Legislative Assembly or House of Assembly) and the upper house (called the Legislative Council). The head of government in the states and territories is known as the Premier or Chief Minister. State governments receive funding to run the affairs of the state or territory from taxes on specific goods (such as petrol and alcohol), stamp duty, grants from the federal government and payroll taxes. Federal Government
There are three parts to the federal government – The Queen (who is represented by the Governor-General in Australia) and the two houses of parliament, based in Canberra. THE TWO HOUSES OF PARLIAMENT ARE: The House of Representatives The Senate

The House of Representatives is traditionally the more powerful of the two houses. The prime minister must come from this house and its most important role is to form the government. The government is formed by the political party with the majority of members in the House of Representatives. Usually proposals for laws start in this house and it is this house (the lower house) that is responsible for laws to do with taxation and spending money. The 150 members of the House of Representatives represent the people who live in their electorate and they often spend a large part of their time in their electorate dealing with local issues. Members are elected for a period of three years. The House of Representatives is always green in its decorations.
The Senate is sometimes known as the State’s House. When the idea of Federation (the joining of the colonies together) was proposed many of the smaller states were worried that their interests would be overlooked and their concerns not listened to. The Senate was established as a “State’s house” where each state would elect the same number of senators regardless of the size of their population. As political parties have grown over the years the role of the senate as a State’s house has changed with senators often voting according to the views of their political party rather than their state. The Senate also operates as a house of review for proposed laws (called bills). For a bill to become law it must be voted for by a majority in both houses. There are 76 senators (12 representing each of the six states and two senators representing each of the two territories). Members are elected for six-year terms. The Senate is always red in its decorations.

Australia is known as a representative democracy. This means that representatives are chosen to run the country and represent citizens in matters to do with Australia. Elections in Australia are held every three years to elect the 150 members of the House of Representatives and half of the 76 senators. The constitution is the document that explains the rules for holding federal elections. Australia is one of very few places in the world where voting is compulsory for citizens 18 years of age and over. Once it has been decided that an election will be held the Governor-General must give the instruction for it to go ahead (known as issuing the writ). Our Constitution 1
When Australia became a federation in 1901 it needed to have a constitution or set of rules, which stated exactly how Australia would be governed. Australia’s constitution is a large and complex document containing eight chapters with 128 sections. The constitution describes how parliament is made up, how it works, how power is divided and things such as the role of the High Court of Australia. One of the more controversial sections of the constitution is that which lists the areas in which the federal government can make laws. The constitution can only be changed by a referendum, which is a vote by citizens aged 18 and over. A majority of voters in a majority of states have to vote YES for the constitution to be changed.

World Government – The United Nations In recent times the world has become much smaller. High-speed aircraft transport, mobile phone technology and the development of the Internet are just some of the new innovations that have sped up communication for people around the world and encouraged country-to-country interconnections. We are all linked to other people and places through things like the food we eat, the music we listen to and the TV programs we watch. In Australia we are lucky enough to live in a country, which is considered to have many advantages especially compared to other places in the world. Not all citizens are so lucky.

The United Nations is an international organisation that in some senses acts as the government of the world. The purpose of the United Nations is to bring all nations of the world together to work for peace and development for all people. There are currently 191 members of the United Nations. They meet in the General Assembly, which is the closest thing to a world parliament. The United Nations headquarters is in New York City but the land and buildings are international territory. The United Nations has its own flag and postage stamps and six official languages are used (Arabic, Chinese, English, French, Russian and Spanish). The United Nations European headquarters is in Geneva, Switzerland. THE AIMS OF THE UNITED NATIONS ARE:
The United Nations has many different sections and a number of different international roles. One of these roles is world peacekeeping. The Security Council (like a special committee) of the United Nations is responsible for the maintenance of international peace and security. The Security Council acts as a mediator and tries to resolve disputes by peaceful means first. If this is not possible and countries have broken out into fighting then it can issue ceasefire orders or send in peacekeeping forces. The Council has 15 members – five, which are permanent and ten which are elected for a period of two years.

ARREST An arrest is the process of bringing someone into police custody so that they can be charged with an offence.

CRIMINAL LAW A type of law where the accused person is seen to have done something against the whole community or ‘state’. There are four types of criminal law – laws which protect property, laws which protect people, laws, which protect society and laws, which protect the nation and legal system. EXECUTIVE FUNCTION OF GOVERNMENT This part of government is responsible for making sure that laws are carried out or ‘enforced’. FEDERATION The joining together of the separate colonies of Australia. This took place in 1901.
