Informazioni utili Proprietà di terreni: Il titolo di proprietà è conosciuto in Thailandia con il nome di “Chanote” e viene emesso normalmente in duplice copia, una per il proprietario e per eventuali creditori, e una per il “Land Department”, Ufficio del Catasto. Il titolo di proprietà contiene una descrizione del terreno (estensione, perimetria, etc.), una mappa e la cronologia di tutte le precedenti transazioni registrate riguardanti lo stesso. Il titolo di proprietà del Catasto, o almeno la copia dell’originale, rappresenta la più chiara evidenza di proprietà. Il titolare può effettuare transazioni di proprietà o concedere altri diritti mediante la presentazione del titolo di proprietà originale in suo possesso presso l’Ufficio del Catasto insieme al contratto di vendita, di affitto e di registrazione di eventuali ipoteche. Sotto queste condizioni le transazioni di proprietà o di diritti sulla proprietà vengono di norma effettuati in tempi molto brevi. I titoli di proprietà sono emessi soprattutto per terreni in aree urbane e altre zone edificabili. Certificato d’uso confermato: Questo certificato, conosciuto con il nome di “Ngor Sor Saam Gor” è simile al titolo di proprietà. Certifica che la persona a cui è intestato ha il diritto d’uso della terra, che questo suo diritto è stato confermato, che tutte le richieste per l’emissione del titolo di proprietà sono state eseguite e che tale titolo è in attesa del “Chanote” che avverrà al momento dell’emissione di tutti i titoli di proprietà della zona in esame. Questi certificati vengono trasferiti di norma presso l’ufficio Distrettuale competente piuttosto che all’Ufficio del catasto. Certificato d’uso: Questo certificato, conosciuto come “Ngor Sor Saam”, è simile al “Certificato d’uso Confermato” ma non attesta l’evidenza del diritto di proprietà dell’intestatario in quanto tutte le richieste necessarie alla certificazione del suddetto diritto non sono state ancora eseguite. Prima che il “Certificato d’uso” sia riconosciuto dall’Ufficio Distrettuale comptetente è necessario inoltrare una nota di intento ed attendere 30 giorni, se nessuno accampa diritti o inoltra obiezioni il suddetto “Certificato d’uso” potrà essere confermato. Certificato di possesso: Questo certificato, conosciuto con il nome di “Sor Kor Nung”, indica che una persona è in possesso di un determinato terreno ma il certificato stesso non implica che esistano diritti associati a quel possesso. Un “certificato di possesso” non può essere trasferito ma il titolare di tale certificato può trasferire fisicamente il possesso del terreno ad un nuovo titolare che dovrà richiedere a sua volta un nuovo “Certificato di possesso”. I “Certificati di possesso” sono piuttosto comuni nelle aree rurali. La loro emissione deve precedere quella del Certificato d’uso. Una persona pagando la “Local Development Land Tax” può usare la ricevuta di pagamento come evidenza del possesso. La ricevuta non fornisce alcun diritto ma è utile in sede di domanda per il “Certificato di possesso”. Mero possesso: Una persona può essere proprietario di terra anche senza alcuna documentazione. A parte il tipo di terreno in questione o l’ipotesi di eventuali enti che accampino pretese o diritti su di esso (tra cui anche lo Stato), il mero possesso di un terreno può, passo dopo passo, portare ad ottenere un documento di possesso e successivamente un titolo vero e proprio. Il mero possesso può essere trasferito da una persona ad un’altra mediante un contratto scritto (che non può essere però registrato). Il destinatario viene così ad ottenere nulla più del mero possesso del terreno dal precedente possessore. Prescrizione: La proprietà di un immobile può essere ottenuta anche mediante il possesso di fatto per un periodo di 10 anni. La proprietà ottenuta in questo modo è superiore a quella dimostrata da qualsiasi documentazione. La corte può ordinare l’emissione di un nuovo titolo di proprietà al possessore di fatto dietro presentazione da parte dello stesso della prova del possesso di fatto secondo i termini stabiliti. Usufrutto: Questo è un diritto concesso dal proprietario di un fondo in favore di un usufruttuario nel quale quest’ultimo ha il diritto di possesso e d’uso del terreno e dei benefici della proprietà. L’usufruttuario possiede di regola il diritto di sfruttare le risorse forestali e minerarie del terreno. Le regole che governano l’usufrutto sono simili a quelle riguardanti i contratti d’affitto.
