Editor’s Message Dental Fillins Two of my best friends live in Albuquerque and Denver. As it turns out, we all have daughters the same age, 8. When we get together a couple times a year, we make it a point to include the girls. At their age, a lot of activities center around doing things together. For their “hey, we’re not that old, we’re still cool” dads, it’s more about the being together. Some of trips don’t even have set plans now. Basically, show up and hang out. Less about the “doing” and more about the “being”. Leading up to the trips, the girls are always so excited to see each other that the first day they stay up half the night having the time of their lives. The dads have vigorous conversations exchanging ideas and solving the problems of the world. I’ve learned two important things from these trips. From the girls, it’s how to live in the moment and from my friends, it’s why the AGD is so unique. Dentists tend to be long term planners. Long hours studying and slowly building a practice are not impulsive choices. These long, methodical, calculated ways of planning tend to creep into other facets of your life. It transforms into obsessing over the schedule and production numbers, retirement planning at 25 (because it’s never too early) and having to plan family time/vacations 6+ months in advance.
dental stuff, really have a good talk with your patients. Be fascinated with them, a lot of them haven’t spent most of their life staring at text books and they are more interesting than you. Thank them for being your patient. Then, take your staff out to lunch. Listen and laugh with them, non-judgmentally. Enjoy each other’s company and tell them you appreciate them and why. In front of everyone. You have the best job in the world. Remember to enjoy it sometimes! So, why is the AGD so unique? If you just want CE, you can get that anywhere. AGD helps you grow professionally. With a clear path from dental school to retirement, your TAGD has led the nation in creating study clubs and programs that provide a shared experience for you and your colleagues. For me, it’s less about “doing” the CE and more about “being” with each other in a shared experience, enjoying the camaraderie and pushing each other to be the best that we can be. Join a New Dentist study club or join a MasterTrack. You’ll find that you can’t wait for the next meeting and will enjoy just being with the group. Leadership positions are really just the icing on the cake. Join your local board; they’d love to have you.
Next time you go into work, try the following: Remember the sacrifice and hard work it took to get where you are now. Be as proud as your momma is about it. Next, bring donuts. The good ones. Not the ones from the grocery store. Besides the standard
Member Profile Congratulations to Dr. Paige Sohn on her recent marriage to Martin Sobol! The two exchanged vows in a beautiful ceremony surrounded by friends and family on March 16, 2013 at Stonebriar Country Club in Frisco. Dr. Sohn graduated in 2001 from West Virginia University and then went on to complete a oneyear residency at Baylor College of Dentistry. Dr. Sohn holds her Mastership in the AGD and currently serves as the Secretary/Treasurer on the Texas AGD Board of Directors.

Her husband is a CFO at Baskins Western Wear in Humble and they live together in Irving. Both are avid runners with Dr. Sohn having completed two full marathons. In fact, it was this shared hobby that first brought them together. They met briefly through mutual friends at a run event. Two and a half years ago, their paths crossed again and the rest is history.

Legislative News TAGD is tracking more than three dozen bills affecting general dentists this session. Copies of all bills and the bill status can be obtained at www.capitol.state.tx.us. The legislative session runs through May 27. Here are some of the more significant bills that TAGD is following:
TAGD Position: Support Regulation of Dental Service Organizations SB 151 by Sen. Jane Nelson/HB 1480 by Rep. Senfronia Thompson
Expert Testimony by TSBDE Members HB 405 by Rep. Allen Fletcher
These bills would require Dental Service Organizations (DSO) to register with the TSBDE, and set parameters for contracts between DSOs and dentists. The legislation also provides that a parent or guardian may be present with their child in a treatment room, unless in the dentist’s professional judgment the parent/guardian’s presence is likely to have an adverse effect. TAGD has been working to clarify the language giving dentists the right to exclude a parent/guardian. TAGD Position: Amend-Support
HB 405 would prohibit a member or former member of the TSBDE board from serving as an expert witness in liability cases. Former TSBDE board members could not testify for two years from the end of the person’s board term or resignation. TAGD Position: Support
Due Process for Medicaid Providers HB 1536 by Rep. Bobby Guerra/SB 785 by Sen. Chuy Hinojosa These bills would allow a Medicaid provider facing a Medicaid investigation seeking to recover overpaid funds to have a hearing before the State Office of Administrative Hearings (SOAH). A provider ordered by SOAH to repay more than $50,000, may file a petition for judicial review in Travis County District Court. TAGD Position: Support Deferred Compensation for Medicaid Providers HB 784 by Rep. Ryan Guillen HB 784 would consider dentists who provide Medicaid services “independent contractors” so that they may participate in a deferred compensation program administered by the Employees Retirement System of Texas. TAGD Position: Support Study Feasibility of Student Dental Exams HB 638 by Rep. Diane Patrick HB 638 would create an eight member advisory committee at the Texas Dept. of State Health Services to study the feasibility of requiring dental exams for students entering first grade. Committee members would include representatives from TEA and DSHS, as well as members from TDA, TAPD, TDHA, Texas School Nurses Organization, a member of TSBDE, and a practicing dentist. The committee would report its recommendations by Dec. 1, 2014. TAGD is seeking representation on the advisory committee. TAGD Position: Amend - Support Regulation of Dental Labs HB 1395 by Rep. Susan King HB 1395 would eliminate dual regulation of dental labs by both the TSBDE and the Texas Department of State Health Services (TDSHS) by removing regulation by TDSHS. TAGD Position: Support

Regulation of Teeth Whitening HB 502 by Rep. Ana Hernandez Luna HB 502 would expand the scope of the Dental Practice Act to include someone who “provides or performs, or offers to provide or perform, a teeth whitening treatment or a product or service related to a teeth whitening treatment.” It does not include over the counter products. TAGD Position: Support Electronic Records Training SB 1609 by Sen. Charles Schwertner SB 1609 amends the training requirements set forth under HB 300 from the 2011 session, including giving employees up to 180 days after being hired to complete training. The frequency of retraining must be within one year of material changes in state or federal law (instead of once every two years.) The bill also limits record-keeping for training to six years. TAGD Position: Support Limit Smoking in Public SB 86 by Sen. Rodney Ellis/HB 400 by Rep. Myra Crownover These bills ban smoking statewide in bars and businesses, including “a restroom, lobby, reception area, service line, hallway, elevator, or other common-use area the public is invited or allowed to enter.” TAGD Position: Support Child Support Ordered Dental Coverage SB 774 by Sen. Carlos Uresti SB 774 would provide for mandatory dental support for children subject to child support orders if it can be obtained at a reasonable cost, as defined by the bill. TAGD Position: Support Temporary Volunteer License HB 1491 by Rep. Dan Branch/SB 1130 by Sen. Charles Schwertner This legislation would allow certain dentists not currently licensed to practice in Texas to receive a temporary license to provide volunteer charity care. TAGD Position: Support

Enforcement by TSDBE HB 3201 by Rep. Lois Kolkhorst
Qualifications for Providing Medicaid Orthodontia Care HB 2919 by Rep. Lois Kolkhorst
HB 3201 deals with enforcement at TSBDE, including the use of outside experts to evaluate complaints and directing the board to complete preliminary investigations within 45 days. The bill would add $80 to the licensing fee for dentists to cover expenses associated with implementing these changes. TAGD supports using outside experts, similar to a procedure used successfully for many years by the Texas Board of Medical Examiners. While TAGD would prefer that the funds needed to implement this program come from other sources, TAGD recognizes that there may be a need to increase licensing fees for dentists to support the program. TAGD’s board voted to support a fee increase of no more than $65 provided that fees are used exclusively for this stated purpose. TAGD: Support, provided the fee is lowered to no more than $65, applied only to dentists and used solely for implementing the new complaint review process. TAGD Position: Support
HB 2919 would require Level 1 or Level II Medicaid-reimbursed orthodontic services to be provided by a dentist who has completed a residency in pediatric dentistry, completed 200 hours of CE in orthodontics or is board certified or eligible for board certification by a specialty orthodontic board recognized by ADA. Level III and IV cases must be done by someone board certified (or eligible). HHSC can waive these requirements in rural areas with limited orthodontic care. While TAGD opposes the idea that HB 2919, as filed, would statutorily restrict what services may be provided by a qualified dentist, we understand that Rep. Kolkhorst’s intent is to ensure that Medicaid patients receive quality care by properly trained providers. While we disagree with the approach taken in the bill, we support that general objective. TAGD’s President Dr. Mark Peppard testified neutrally on the bill and made those concerns clear in his testimony. TAGD Position: Neutral

Disclosure of Fees HB 3020 by Rep. J.D. Sheffield
HB 2700 requires health licensing agencies to adopt rules providing patients with good faith estimates of health care costs with varying estimates depending on whether the patient has insurance, participants in a government program, workers’ comp, or is paying cash or receive charity care. TAGD Position: Oppose
HB 3020 would require health care providers to compile pricing info for their 10 most frequently performed procedures. A provider must disclose the highest possible charge and lowest discounted rate. The information shall be made available to the public in a form and manner determined by the provider. Notice of a price change must be revealed at least 30 days before a change is made. TAGD Position: Oppose
TAGD’s Advocacy Council meets regularly throughout the session to analyze bills that may affect dentistry, research issues in-depth and determine whether TAGD should take a position on a bill. The Advocacy Council is chaired by Dr. Jennifer Bone. Other members include: Drs. Marko Alanis, Craig Armstrong, Joey Cazares, John McEntire, Mark Peppard, David Roberts and David Tillman. Drs. Anne Lyon, Donna Miller, Bryan Moore, Fred Phillips and David Umansky serve as component liaisons.

Legislative Day: A First-Timer’s Perspective Manshi Patel, DDS On a cool February morning I boarded the bus with my fellow Advanced Education in General Dentistry residents for what turned out to be one of the most valuable experiences of my residency.
residents and I boarded the bus back to San Antonio, I became aware of how important it is to have that level of commitment to our profession from both experienced and new practitioners alike.
The mood was festive and our energy was matched only by our anticipation, as we rolled through the Texas Hill Country on our way to the Capitol to participate in Texas Dental Association’s Legislative Day. For residents that had grown accustomed to putting on scrubs and performing root canals and extractions, the daytrip was more than just a departure from San Antonio. It was a departure from the practice environment we were used to, and an orientation to a process that, though unfamiliar, was one that we knew directly shapes our profession.
Dr. Manshi Patel is a 2012 graduate of Baylor College of Dentistry. She is currently completing her AEGD residency at the University of Texas Health Science Center at San Antonio.
Our day started with an introduction of dentistry-related legislative bills, including one that encouraged dentists to become Medicaid providers by allowing them to defer a portion of their Medicaid income on a pre-tax basis, and another that responded to the need for dental service organizations to register with the Texas State Board of Dental Examiners. After an informative question-and-answer session, we stepped into high gear and met with various legislators, including Texas House of Representatives Speaker Joe Straus and Representatives Lyle Larson, Dan Branch and Mike Villarreal. We discussed the reasons why we supported the bills presented. In return, the representatives showed that they were engaged and committed to learning about the issues. As the end of the day neared, it dawned on me just how hard dentists work to keep the profession safe and strong. As my fellow

4D’S, ARE YOU READY FOR GRADUATION? For our members in their fourth year of dental school, graduation is just around the corner. Have you given thought to what you will do when school wraps up? The first and perhaps the most important decision involves how to practice. Here are a few basic options for recent dental graduates:
• Associateships:
Starting your career as an associate offers a variety of benefits. It can allow you to earn a steady income as you pay off your debt with limited financial risk. You also have the opportunity to gain mentorship, advice and advanced clinical skills from a veteran dentist. Long-term employment as a partner in the practice may even be an option.
• Purchase a Practice: Obtaining a practice already in existence
comes with advantages as well. You can inherit equipment and/or staff, a patient base and transition into owning your own practice with greater ease. However, besides the obvious disadvantage of the initial cost to purchasing a practice, you must also consider the time you will have to commit right away to being a business owner as well as work to gain acceptance from your inherited staff and patients.
• Start
your own practice: Being your own boss and having autonomy is a natural draw to this option. If you already have a vision for your practice and a solid plan of action to achieve it, then starting your own practice may be very rewarding. However, before you take the plunge, consider your debt load to determine whether you are able to make a large financial investment.
• AEGD
or GPR Programs: Both the Advanced Education in General Dentistry (AEGD) and the Graduate Practice Residency (GPR) are advanced post-doctoral training programs that allow you to fine tune your skills and obtain advanced training in the

dental field. In general, the major distinction between the two is that an AEGD has more of a focus on clinical dentistry while a GPR is based more on medical management in a hospital setting.
Finding an Associateship or Other Opportunity Networking is a great way to begin the process of securing an associate position. Find out when the next meeting is for your local AGD component and become an active member. TAGD also offers free classifieds ads in the TexasGP to our members. Place an ad expressing your interest in finding a position in a particular area! Get involved in a new dentist study club in your area and gain a network of peers while expanding your skills. TEN PRINCIPLES FOR YOUNG DENTISTS’ FINANCIAL SUCCESS Robert A. Ziliak, MS, CFP During the Growth Stage of the first decade of a dental career, young dentists make critical decisions that form the foundation for ultimate financial success. When adopted early in their career, these ten principles can help young dentists build financial freedom long before a transition is within sight.
10 Principles: 1) Financially successful dentists know where their money goes. Needs, wants, and savings must be properly aligned. 2) Financially successful dentists know where their money should go.. From cash flow, savings should be 20%, debt payments 25%, taxes 25%, and lifestyle spending plus large purchases 30%. 3) Financially successful dentists have a retirement accumulation goal. Retirement income needed, savings needed, investment return assumptions, risk assumptions, and desired retirement age must all be established early. 4) Financially successful dentists have an annual savings goal. You should be saving 20% of your income. 5) Financially successful dentists make large financial decisions in light of other priorities. Big financial decisions should be made in the context of how other financial goals will be affected. 6) Financially successful dentists manage debt properly. It is important to have a plan for managing overall debt structure to ensure savings can occur. 7) Financially successful dentists protect their families with insurance. Proper assembly of life, disability, overhead, and umbrella insurance is essential for providing financial security to loved ones, should an unexpected tragedy occur. 8) Financially successful dentists do not use life insurance as a retirement savings vehicle. Life insurance pays a benefit to survivors of the policyholder upon his/her death. Dentists should not be fooled into believing that life insurance is a retirement savings vehicle. 9) Financially successful dentists do not believe debt is evil and must be eliminated immediately. Financially successful dentists must capitalize on the power of compounding growth by saving during their entire career. If debt and retirement savings are managed well, likelihood for financial freedom by age 65 is exponentially higher. 10) Financially successful dentists save for their own retirement before saving for their children’s college education. Partial college funding can be provided to children, student loans or scholarships can be obtained, and children can work to help support expenses. Who can find a loan or scholarship to retire?
The path to financial freedom continues to add more obstacles due to increasingly complex legislation. Business Cards 108.56 Certifications, Degrees, Fellowships, Memberships and Other Credentials This rule specifies the exact way that dentists can advertise their credentials. The credentials must be clearly distinguishable and may not occupy the same line as the dentist’s name and/or dental designation. Abbreviations of credentials may be used but then must also be spelled out. This rule is not only limited to business cards, but also to yellow page ads, websites, signage, etc.

108.55 Advertising for General Dentists In summary, this rule requires that any advertisement listing specific dental services by a general dentist include the wording “General Dentist” or “General Dentistry” after the name of the dentist. General dentists can list services provided as long as they do no imply a specialization. This rule is not only limited to yellow page ads, but also to business cards, websites, signage, etc.
108.52 Names and Responsibilities One of the provisions of this rule requires that the professional degree of each school attended be visible for each dentist practicing in the office. One of the ways this can be fulfilled is by hanging a copy of the professional degree for each practcing dentist in the lobby or main entrance to the front office.
108.59 Website Disclosures According to this rule your website should clearly state who owns the website, what services are provided, addresses and contact information and all information on licensure and qualifications of each practicing dentist and associated health care providers.

Affordable Care Act Update Andrew Lazaris, DDS In March 2010, Congress passed the Patient Protection and Affordable Care Act (PPACA), commonly known as Obamacare, and President Obama signed it into law. There are still many unknowns as to how dentists and dentistry will be affected. Below is a summary of some of the provisions that will affect dentists and dental care. Section 1411, Medicare Payroll Tax (2013) Single taxpayers earning >$200k annually or married couples earning >$250k annually have their Medicare Hospital Insurance payroll tax increase from 1.45% to 2.35% above these thresholds. Section 1411, Unearned Income Tax (2013) Single taxpayers earning >$200k annually or married couples earning >$250k annually subject to a 3.8% tax to investment income, including capital gains on property sales, dividends, rents and royalties. Flexible Spending Accounts (2013) Limit has been decreased to $2,500

Consumers can purchase a medical plan through the exchange that does not cover pediatric dental coverage. Outside of the exchange, rules require that everyone in the individual and group markets must be offered and will be required to purchase qualified health plans with pediatric EHB. Exclusions will be made if qualified health plans are “reasonably assured” that the consumer also purchases pediatric dental coverage through a stand-alone exchangecertified plan. Small Business Employers Businesses with <50 employees will not be required to provide health insurance. Employers may be eligible for a tax credit if they pay at least 50% of employee health premiums and have <25 full time employees with an average wage of <$50k per employee. This tax credit expires in 2016.
