Happy February readers! I am overjoyed to introduce myself to you officially as the new Editor-in-Chief of The Hemp Connoisseur. I have been with THC for five years, since day one, and have been in the cannabis industry for over six years. We have grown as a company over that time and I have witnessed so many changes, good and bad, to the medical/recreational cannabis industry as well as the tremendous growth in the industrial hemp industry through the years. It has been quite the roller-coaster of regulation wins and losses. We are all experiencing a very unique and exhilarating time that our children and grandchildren will read about in history books, similar to the prohibition of alcohol.

In 2016 THC will be delivering you the cannabis and hemp related content you crave in new and exciting ways. David Maddalena has stepped out of his role as Editor-inChief to focus on the innovative new projects THC has planned for 2016, including our newly launched video division, THC Entertainment. I am excited to be jumping into this new role. As Art Director I have been tirelessly working, along with the rest of our amazing staff, on each and every issue of THC to bring you the most informative, best looking, and highest quality content available. 10mm Errl Can Rig by 420 Science reviewed by Samuel Farley, Twitter and Instagram @THC_Samuel One of the newest creations by 420 Science, the Errl Can rig, is a delight to dab from. Normally, I am not a huge fan of smaller flower pieces or oil rigs simply because I enjoy inhaling with a more open draw or chug. However, for an oil rig that stands only six inches tall, the Errl Can rig provides a smooth draw, and most of all it’s a lot of fun to use. Shaped like a traditional oil can, it’s easy to see the attention to detail and quality in manufacturing. Although tiny in stature, the piece feels like it was made well and does not feel as fragile as other smaller glass pieces I’ve held in the past. The percolation slits are located on the bottom side of the downstem, helping to minimize the amount of water needed while ensuring consistent percolation and filtration. The Errl Can rig comes in two sizes (10mm and 14mm) and four color options including white, black, blue and green with the downstem and mouthpiece featuring the colors.

After my first dab I immediately noticed how clean the hit was for how small the oil rig is. During inhalation, it didn’t feel like it was a tiny rig and had the space during the draw of slightly larger pieces. The hit was full of flavor and lacked any trace of harshness, which always seems to be a problem with smaller rigs. It’s the perfect travel rig or backyard barbecue piece for afternoon dabbing by the bonfire. Cypress Hill's Phuncky Feel Tips by ROOR reviewed by Monocle Man Cypress Hill and ROOR have teamed up to bring us the Phuncky Feel Tips. These German hand-blown glass tips take rolling joints to a whole new level. There are different sizes and colors to choose from along with a couple multi pack options. The Dabsolute Concentrate Pen reviewed by Monocle Man The staff here at THC digs using concentrate pens and Dabsolute has quickly become a staff favorite. Its unique style and features make the Dabsolute a must buy for anyone who vapes their concentrates. You can enjoy your shatter and waxes on the go; they even included a lanyard that it connects to.

The Dabsolute kit is everything you will need. It comes with the Dabsolute Dab Atomizer (Made in the USA), Smart Mod battery, micro USB charging cable, neck lanyard, 510 to eGo atomizer adapter, and user’s manual. It’s easy to use and allows full control of the wattage. The OLED screen shows the voltage, wattage, ohms, and the battery level. It goes from 5W to 36W but the user manual recommends not going over 17W, as doing so can damage the heating coil. You don’t want to run it too hot anyway or you will burn away those beautiful terps. Once you dial in your preferred wattage you’ll savor smooth, sweet dabs with the touch of a button. The heating element will only run for 10 seconds, it even keeps track of the time on the display screen. To turn the Dabsolute on and off you just have to press the power button five times.

Cleaning the Dabsolute is a breeze. Simply screw off the coil housing from the battery and the mouthpiece, which the user’s manual instructs to set in 91 percent Isopropyl alcohol for a few minutes. Make sure everything is dry before reconnecting the battery. When loading the heating chamber, only put small BB sized amounts on the coil. Putting too much in will gum up the heating coil and prevent it from performing at its best. The Dabsolute is one of the best concentrate pens that we have had the pleasure of trying.

One of my many jobs at THC Mag is to find an artist every month to feature, which is so fun for me as an art-lover to discover new talent. A couple months back I was browsing Instagram and discovered Brian Scott Hampton, which led me to the Threyda collective, which led me to Peter Westermann who was last month’s featured artist (thank you Instagram).

Brian (and Peter) showed a great deal of enthusiasm to be featured in THC Mag and was thoughtful in his answers, which is so appreciated. His style has a very soothing yet powerful look to it, like the universe is trying to communicate a message to you through his artwork.

Who are you and what do you do?

My name is Brian Scott Hampton and I create for a living, mostly as a studio artist.

Are you a Colorado native?

No, I was born in El Paso, Texas and raised in Owasso, Oklahoma.

What mediums do you use to create your pieces?

I prefer to focus on what I feel adds to the sustainability of this creative journey, and goals are always evolving as we evolve. So at the moment, one of my largest goals is to simply be an influence.

Last month, I featured Peter Westermann. What is your perspective or thoughts on the Threyda artist collective here in Denver?

I’ve felt as though Denver literally pulled Threyda here, along with myself.

The look and feel of the group seems perfectly suited to the city of Denver, and we are reminded of that quite frequently.

What artist, if any, do you identify most with?

The answer to that question depends on which part of my creative persona is dominant that day.

What do you think is the most inspiring place in Denver?

I use acrylic paint and spray paint mostly, but nothing is off limits.

Well, as a visual artist I would say the RiNo district. It’s tough to top all the creative scenery there.

What’s the longest you’ve ever spent on one piece?

Where can interested buyers find your work to purchase?

I prefer to finish work quicker, so probably a few months at most.

Can you tell us a bit about your artist process? How do you get in the groove and what keeps you motivated?

My process involves a lot of letting go, and letting exciting things outside of myself happen. I prefer to focus on expression and spontaneity, rather than perfection and technique. Good music always helps me get in the groove, along with a potent indica. I generally get a good amount of motivation from observing inspiring aspects of the world we live in. Inspiration is all around us.

Upon opening the package of the 50/50 CBD Black Cherry bar by Incredibles from Lush dispensary, the delightful smell of cherries and chocolate permeated the air and even without reading the label it’s clear that the chocolate bar is filled with ripe cherries.

Clearly marked dosages make these bars a literal “snap” at getting a correct dosage (10 mg is recommended). After eating ten milligrams, I patiently waited for the effects to kick in. The delicious black cherry and chocolate flavor made it difficult to stop eating after two squares. Similar to the other Incredibles products, the flavor of cherries and milk chocolate came through clearly and there was no hash-like aftertaste. Preferred Organic Therapy Grape Cherry Stomper Shatter by Craft 710 reviewed by Samuel Farley I had the chance to try the Grape Cherry Stomper shatter from Preferred Organic Therapy that was processed by Craft 710. Craft 710 is leading the industry with their quality and extraction techniques, and they do an incredible job with their in-house Panacea line.

However, they also do processing for dispensaries. The result of the pairing between Preferred Organic Therapy’s fantastic hybrid flowers and Craft 710’s extraction resulted in a clear golden shatter that provided a strong head buzz and a concentrate that had great flavor. After my first dab I noticed the relaxing effects and couldn’t wait to take my second.

The consistency of the shatter was easy to work with and I found it simple to measure out a proper size dab (no stickiness or goo-like texture). Following my second dab I began to notice the slight calming effects it had to my body and I would say it’s the perfect concentrate for a daytime dab session. The Grape Cherry Stomper provides a nice combination of head high and slight body relaxation to make it a great pair for an afternoon of video games or watching movies on the couch. The concentrate does not provide a very motivating buzz but its also not a couch lock effect either. Karma Couch Lock Bubble Hash (120 & 90 Micron) by Karmaceuticals reviewed by Samuel Farley

Karmaceuticals, a Denver-based medical only dispensary, provides a large selection of flower and other cannabis products. I had the chance to try their Karma Couch Lock Bubble Hash, one of many products they offer. Although I am not a regular bubble hash consumer, I was very pleased with the effect of the Karma Couch Lock hash. To get the full experience of the bubble hash, I added a decent portion of the 90 micron Karma Couch Lock hash to a large joint of Gorilla Glue #4. Gorilla Glue #4 is one of my favorite strains and one that I smoke regularly so I felt like I could feel what the bubble hash added compared to a strain I wasn’t as familiar with. The combination resulted in a pretty heavy body high and substantial euphoric head buzz that really took away my normal sense of go-mode and allowed to me to relax for a few hours from the single joint. I found myself not having the motivation to finish the other things I had planned for the night, like a sink of dishes. Hemp Eats Ravioli with Smashed Tomatoes, Fresh Herbs, Hemp Seeds and Goat Cheese Serves 4 Ingredients:

1 24-oz package frozen ravioli 3 pints mini Heirloom tomatoes 1 large tomato, chopped 2 large garlic cloves 2 Tbsp hemp oil 1 Tbsp lemon juice, fresh squeezed ¾ tsp salt + a pinch more ¼ tsp black pepper, freshly ground 3 Tbsp hemp seeds ½ cup torn herbs, basil, parsley, sage, etc.

8 oz goat cheese, crumbled

Directions:

Heat broiler to high and move top rack down about 5 inches from broiler.

Fill large stock pot with water, lightly salt and bring to a boil.

While water is boiling place tomatoes and garlic on a lined baking sheet, cover with hemp oil. Toss gently with clean hands. Broil 6-7 minutes, stirring halfway through, until tomatoes are charred.

When mixture is done, add to a glass bowl. Add in lemon juice, salt, pepper, hemp seeds and the fresh herbs. Using a wooden spoon, stir until combined and so that some of the tomatoes burst and their liquids come out.

Once water comes to a boil, add ravioli and cook according to package directions.

When ravioli are done, carefully remove with a slotted spoon and place in a strainer. Once drained, add to individual serving bowls, top with tomato mixture andgoat cheese. Serve right away.

Strawberry Champagne Hemp Cupcakes

Makes one dozen Cake Ingredients: ¾ cup fresh strawberries, stems removed and berries halved 1/3 cup hemp seeds 1 ½ cups all-purpose flour 1 teaspoon baking powder ¼ teaspoon salt 1/4 cup hemp milk ¼ cup Rosé champagne ½ cup coconut sugar 1 large egg 2 large egg whites 1 teaspoon vanilla extract Frosting Ingredients: 1 cup unsalted butter, room temperate 3 tablespoons fresh strawberries, pureed and strained to remove seeds (optional) ½ teaspoon real vanilla extract 4 cups powdered sugar ¼ cup rose champagne Directions: Preheat oven to 350˚F. Line muffin tin with cupcake liners.

In a food processor or blender, combine strawberries and hemp seeds until smooth and pureed. Separate out 1/3 cup of this for the batter mix and set both batches aside.

In a medium bowl combine flour, baking powder and salt. Next, cream butter with electric mixer on medium until fluffy. Add sugar gradually until you have a smooth mixture. Reduce mixer speed and add the egg products one at a time. Add vanilla extract.

Mix together the champagne and 1/3 cup of strawberry and hemp seed mixture.

Add a little of the flour mixture, then a little of the champagne and strawberry mixture bit by bit until all has been added.

Scoop a heavy tablespoon of batter to each prepared cupcake liner. Bake 20-25 minutes or until a toothpick comes out of the center clean.

While cupcakes are baking make the frosting.

In a mixing bowl cream butter until smooth and fluffy. Add in the strawberry and hemp seed puree that you set aside earlier, then add the vanilla, making sure everything is mixed well. Gradually add in powdered sugar until desired consistency is reached. Add salt if needed. Make sure to scrape down the sides of the bowl while mixing in powdered sugar. Add champagne and mix well. You may need to add more powdered sugar or champagne to get the consistency desired.

Cannabis News Bill Introduced to Designate Cannabis as Pesticide Free A new bill is aimed at addressing pesticide issues in Colorado cannabis. The bill, introduced into the state House of Representatives by Rep. Jonathan Singer (D-Longmont) and Rep. KC Becker (D-Boulder), would create labeling standards certifying cannabis as “pesticide free” and allow private companies to certify cannabis as such under oversight from the Colorado Department of Agriculture. The language of the current bill would provide labeling for both hemp and marijuana.

The issue of pesticide contamination has gained notoriety over the past year, with health officials in Denver placing holds on potentially contaminated crops and issuing massive recalls of products made by companies found to be using pesticides not approved by the CDA. Current regulations require that recreational producers list all ingredients used in cultivation of adultuse cannabis on labels, but only the U.S. Department of Agriculture is capable of certifying crops as organic. This means that producers of hemp and marijuana in Colorado have no means of certifying their crops as such, as cannabis remains federally illegal. Labeling cannabis as “pesticide free” would actually be more far reaching than simply “organic”, as organic pesticides can still be used in certified organic production.

Virginias Look to Allow Commercial Hemp Farming A bill to fully legalize the commercial production of hemp in Virginia has sailed through the state’s House of Representatives with overwhelming support. House Bill 699 passed unopposed, with a vote of 98-0 in favor.

Meanwhile, a bill introduced into the West Virginia House of Delegates is poised to open the door for commercial hemp farming there as well.

House Bill 2807 would allow the state’s Agricultural Commissioner to issue licenses for commercial hemp farms, expanding the program from that outlined under the federal Farm Bill. Currently, hemp farming is limited to pilot programs run by state departments of agriculture and recognized institutes of higher education. HB 2807 would expand this to commercial farmers. The bill, which is sponsored by four Democratic delegates and one Republican, is currently awaiting approval from the House Agricultural and Natural Resources committee.

If these bills were to be enacted, the Virginias would join nearby Kentucky and Tennessee in allowing hemp farming beyond what is outlined in the Farm Bill.

Top Mexican Lawmaker Urges Legalization of Marijuana As part of a continuing debate of marijuana policy in Mexico, president of Mexico’s Chamber of Deputies Jesus Zambrano recommended the full legalization of marijuana for both recreational and medical uses, according to Latin American news service teleSUR. The politician urged that Mexico follow the example set by countries such as Colombia to address the issues of drug policy and undercut criminal organizations.

“The topic has its international component and efforts need to be combined,

particularly between the United States and Mexico, to have common rules, laws that are essentially identical, though each with its own modalities, because we are distinct, but the United States must help our country apply, for instance, legalization of marijuana for medical and recreational use,” said Zambrano, according to teleSUR. Over the past decade, Mexico has been a hot bed of drug war violence, due largely to U.S. demand for illegal drugs coming out of the country. A recent decision by the Mexico Supreme Court legalized possession, use and cultivation of marijuana, but the ruling only applied to the plaintiffs in the case.

Study Discredits Marijuana’s Effect on IQ A recently published study in the Proceedings of the National Academy of Sciences casts doubt on findings from an often-cited study published in PNAS in 2012. While the 2012 study seemed to show a drop in IQ of persistent marijuana users, the latest data seems to show that other factors could be at play in declining IQ scores as subjects aged. The study followed sets of twins in which one twin reported habitual marijuana use while the other did not. Researchers tested subjects during adolescence then again in late teens, and found that declines in IQ were similar across users and non-users. The results prompted researchers to conclude that there was in fact not a causal relationship between teenage marijuana use and a decline in IQ, and that the results demonstrated in the earlier study may have been the result of familial factors that also underlie early use.

“This is a very well-conducted study … and a welcome addition to the literature,” said Valerie Curran, a psychopharmacologist at the University College London, according to Science magazine. Curran was one of the authors of another recent study published in the Journal of Psychopharmacology that also showed similar results.

Anti-cannabis activists have frequently cited the 2012 study as reason for keeping marijuana illegal. What effect the most recent findings will have on this argument remains to be seen.

Bill to Start Commercial Hemp Program Introduced in Hawaii A pair of bills introduced in the Hawaii legislature would allow for the licensing of commercial industrial hemp farming in the island state. House bill 1969 and its accompanying Senate counter part, SB 2757, are receiving widespread support from citizens and lawmakers alike, with the House version cosigned by over 30 representatives, according to Hawaii news station KHON2.

“There is a huge groundswell of support from the general public and members of the agriculture sector to legalize industrial hemp,” said Rep. Kaniela Ing, according to KHON. Currently, Hawaii has a single test crop of hemp being grown by researchers at the University of Hawaii.

Cannabis Banking Lawsuit Dismissed A U.S. District Court judge has thrown out a lawsuit filed by Coloradobased Fourth Corner Credit Union over access to a Federal Reserve master account. Fourth Corner has tried to establish itself as the first bank for cannabis businesses, which have been operating without widespread access to banking services due to the plant’s federally illegal status. In the lawsuit Fourth Corner sought access to Federal Reserve services, which would have allowed the credit union to operate akin to other banks. Without the Federal Reserve charter, Fourth Corner is without the ability to conduct standard banking practices such as deposits and transfers, and would lack federal deposit insurance.

Guidelines issued from the U.S. Department of Justice seemed to indicate that banks servicing state-legal cannabis operations would not risk prosecution for money laundering, but the Federal Reserve denied Fourth Corner’s application for charter last year and the judge in the case validated the decision.

“In short, these guidance documents simply suggest that prosecutors and bank regulators might ‘look the other way’ if financial institutions don’t mind violating the law. A federal court cannot look the other way. I regard the situation as untenable and hope that it will soon be addressed and resolved by Congress,” wrote U.S. District Judge R. Brooke Jackson in his opinion on the ruling.

Vermont Governor Wants to Legalize Marijuana Vermont Gov. Peter Shumlin voiced support for marijuana legalization during his annual State of the State address last month. Citing the failure of the war on drugs, particularly with regard to marijuana, Shumlin advocated policy based around preventing access by children, taxes modest enough to keep prices competitive with the black market, tight DUI laws, and using tax revenue to strengthen addiction programs. He also suggested banning edible marijuana sales until the state can decide on the proper course of regulation.

“These illegal dealers couldn’t care less how young their customers are or what’s in the product they sell, or what illegal drugs you buy from their stash, much less whether they pay taxes on their earnings,” Shumlin said, according to the Washington Post.

New York Sets Guidelines for Hemp Research New York will soon be added to the list of states with hemp pilot programs.

The New York Department of Agriculture and Markets published final regulations last month governing licensing and administration, paving the way for colleges in the state to begin growing experimental crops. Under the guidelines, only ten schools would be granted licenses, but would be able to contract their hemp growing to off-campus farmers. So far, both Cornell University and SUNY Morrisville have expressed interest in establishing research crops. Licenses will extend for a three-year duration.

jobs,” said New York State Sen. Tom O’Mara, according to Pressconnects.

Alabama Deputies Claim They Were Fired For Not Providing Sheriff With Pot Two sheriff ’s deputies in Winston County, Alabama claim that they were fired after they would not provide the sheriff with marijuana. According to a lawsuit filed by the two deputies, Winston County Sheriff Hobby Walker asked them to acquire marijuana for his cancer-stricken aunt, alleging that Walker asked them to skim marijuana from evidence acquired in drug busts. The deputies took their concern over the request to various higher law enforcement agencies, such as FBI and state attorney general’s office, and claim they were fired after they declined to continue assisting the sheriff.

New York Begins Medical Marijuana Program January marked the beginning of New York’s long-awaited medical marijuana program. A handful of dispensaries opened their doors for the first time but were limited to serving only the 51 patients approved by the state Department of Health so far, according to information acquired by The New York Times.

The state’s medical marijuana program was signed into law in 2014, but harsh restriction on providers and patients have made the program hard to navigate on both ends. Under the program, production is limited to five companies operating 20 dispensaries across the state. Doctors writing marijuana referrals must also get approval from the state to do so, and smokable flower is not allowed.

“I think the glass is three-fourths full, maybe two-thirds full, and that is that it is going to benefit a lot of very seriously ill people,” said Assemblyman Richard N. Gottfried, who has pushed for medical marijuana in the state since the 1990s, according to The New York Times. “But I think we can do better.”

NORML Plans Social Use Initiative in Denver The National Organization for the Reform of Marijuana Laws is jumping into the issue surrounding the glaring lack of venues at which to consume cannabis in Denver. The organization announced plans for an initiative similar to the one put forward and shortly thereafter pulled last year by the Marijuana Policy Project and law firm Vicente Sederberg. Whether the NORML proposal would be as broad as that initiative in allowing for consumption in designated areas at bars, or simply be limited to creating regulations for private cannabis clubs is unclear.

“The need is obvious as residents and visitors continue to have no legal place other than private homes to enjoy a legal product with like-minded adults,” said Jordan Person, executive director of NORML’s recently formed Denver chapter, according to The Denver Post.

The backers of last year’s proposal, which had collected more than 10,000 voter signatures and was headed to the November 2015 ballot at the time it was pulled, claim that they are working with city officials to create a compromise, but would bring the issue before voters in 2016 if a solution could not be reached.

the crumbles. I heated a small pan to medium-high heat and cooked the patty for five minutes on each side. As advised by Carla, I cooked the patty in a small bit of oil to create a crisp on each side. Served it on a bun (pictured) and ate it just like a regular burger. It was delicious, filled me up and gave me great energy to survive the rest of the workday. I recommend the standard burger fixings plus avocado.

Serve with some sweet potato fries and you have yourself a delicious and indulgent health-conscious meal.

Meiko and Joey Perez and The Unconventional Foundation for Autism

We had the pleasure of sitting down with Meiko Hester Perez and her son Joey back in 2012. So much has happened since then that we at THC Mag thought we would catch up with them and talk about their new biggest development.

Our story begins on December 19, 2010, at an event called Kushcon II held at The Colorado Convention Center. Kushcon II was the day that all of us in the Colorado Cannabis Community were first introduced to an incredible young lady named Meiko Hester Perez and her son Joey. Meiko had traveled to Denver to promote the foundation she was starting called The Unconventional Foundation for Autism (UF4A.ORG).

The mission statement of the organization expresses two main goals: to raise awareness and compile functional data to support medical professionals and families afflicted with this mysterious and misunderstood condition known as Autism, and to provide functional support of the (IDEA) Individuals with Disabilities Education Act to parents in need.

When asked about the reasoning behind starting Joey on medical cannabis as a possible treatment for his autism in 2009, Perez stated, “My stance was pro-life… my son needed a better quality of life or he was going to perish from these medications used t o treat autism.” After completing her research and beginning the cannabis treatments for Joey’s autism, Perez explained, “He was on a combination of 13 different prescription drugs, and his weight had dropped down to 46 pounds.

He was diagnosed with anorexia and malnutrition, second to his autism. Ultimately, his doctors gave him six months to live. I was devastated. And I was determined I would figure out a way to extend his life.”

She did!

Meiko Hester Perez is a true pioneer in the medical cannabis movement worldwide. Her initial unconventional treatment of her son’s conditions opened the doors for other parents to begin exploring cannabis as an alternative medicine for some of the conditions adversely affecting their children. Her first public interview with regard to cannabis and Joey’s treatment was on Good Morning America in 2012.

In 2015, Perez continued her mission to enlighten families and medical professionals to the benefits of cannabis as a medicine. She has reached

an international audience through the ABC, NBC, CBS, Telemundo and Univision news organizations. Perez has been awarded Congressional recognition for her work with the special needs community. She also sits on the board of NORML’s Womens Alliance, an organization that assists special needs families, universities and medical professionals on a national scale with cannabis policy development and reform.

Recently, Perez’s alliance with Aaron Justice, (President – Buds and Roses Collective) his genetics company, (Kushman Genetics) and master cultivators Tyler Wadleigh and Kyle Kushman has created a high-quality herbal medicine with just the right combination of cannabinoids and terpenes for Joey. This was achieved through specialized breeding and cultivation techniques. It’s appropriately called “Joey’s Strain”.

At a time when the FDA only supports the trial of CBD-rich cannabis extracts and does not support legalization of cannabis for medical use, it is important to keep the work of pioneers such as Perez closely in mind. Studies suggest that THC improves the body’s natural ability to produce endocannabinoids, which help to correct behavioral issues related to the most common genetic cause of Autism “Fragile X Syndrome”. CBD alone does not.

Perez and Justice have also teamed up with Acology Inc. and developed a patented, child-resistant, FDA-approved bottle for children’s cannabis.

Unlocking Intimacy With Cannabis N

et’s be honest: sometimes having sex can be a chore. Couples over the span of time have sought ways to un-chore their sex lives, trying everything from known aphrodisiacs like oysters, dark chocolate and red wine, to lubes, sultry lingerie, role play, etc., ad nauseum.

Practically every magazine and website has a column dedicated to spicing up your sex life, each piece of advice seeming to contradict the other. And forget about the legions of books showing acrobatic sex positions only a contortionist could pull off but is, they promise, a sure-fire guarantee to a mind-blowing orgasm. But what if finding intimate time with your partner is really the last thing on your mind?

Women, with their myriad emotional, mental, and physical demands may also feel some pressure to be amazing in the sack. The FDA recently approved a “pink Viagra” designed to increase desire, but its warning label says that it can cause dangerously low blood pressure and fainting when combined with alcohol. So much for wine with dinner. It has been shown over and over that a woman’s psychological and emotional state can affect for better or worse the sexual experience, from the psychological to the physiological.

Some cannabis-centric magazines have columns dedicated to enjoying cannabis with your partner, but many of them seem to be answering questions for the “stoned boner” crowd only. What about real sex for real women with real lives?

“What is female libido? It’s desire! For a man it’s between his legs but for a woman it’s between her ears!” exclaims Nick Karras, a sex therapist based in San Diego, California. Karras is the author of “Passionate High,” a book that deeply explores cannabis as an aphrodisiac, a topic he studied for more than two years. As Karras sees it, “We’re a very left-brained society. We as human beings are way too in our minds and not enough in our bodies to fully enjoy the sexual experience.” Karras believes that including cannabis can intensify a couple’s sex life in very positive ways.

becomes lubricated and breasts become fuller. In the plateau phase, genital swelling continues and the clitoris becomes very sensitive. Breathing, heart rate, and blood pressure keep climbing, and then, hopefully, orgasm, the wonderful release of sexual tension. Last but not least, resolution, where the body’s response returns to normal and feelings of well-being and intimacy increase. This is the happy ending version of the female sexual experience.

The unhappy ending was reported in a study titled “Biology of Female Sexual Function” (authored by Drs. Ricardo Munarriz, Noel N. Kim, Irwin Goldstein, Abdul M. Traish) published by the Boston University School of Medicine. They found that a staggering 76 percent of adult American women have some type of sexual dysfunction. So what exactly is that?

Lack of lubrication, decreased vaginal swelling, fewer orgasms — if any — and painful intercourse, assuming you get excited about having sex at all. WebMD writes that these dysfunctions can be brought on by workrelated stress and anxiety, concern about sexual performance, menopause, depression, guilt, or the effects of a past sexual trauma, and can include, as the Boston report found, negative sexual experiences.

There’s a lot of snake oil out there when it comes to how to supercharge women’s sexual experiences and increase female libido, but the folks at Denver-based GH Labs think they may have the antidote. Vance Dugger, the founder of GH Labs, and his Director of Scientific Development Daniel Hernandez have created the K-puff pink, a disposable Kanna-Vape, with just women in mind. The K-puff pink strain, GH-169 (patent pending), intends to balance all three female sexual hormones: estrogen, progesterone, and counterintuitively, testosterone, which seems to play a big role in a woman’s sexual desire and arousal. Small amounts of cannabis raises testosterone, heart rate, respiration, and releases dopamine, a neurotransmitter associated with pleasure. Hernandez explains that GH169 will give men a “vitalizing effect”, and 87 percent of female GH-169 users self-reported that their libido was enhanced and they had a more intense sexual experience, one even describing her experience using GH169 as “primal”. Dugger is currently working with a major university on constructing a clinical study of GH-169, so convinced is he of its efficacy.

But, using cannabis as part of your lovemaking can be equal parts trouble and bliss. Anecdotal evidence shows that if the THC levels in your delivery method of choice are too high then female hormones can become “antagonized” and the sexual experience, from the physical to the mental, can become too intense. If men consume too much THC, the experience can be, well, a little droopy. Karyn Wagner of Paradigm Cannabis Group in Humboldt, California, branded a sativa-indica variant of Mr. Nice called Sexxpot. After an incredibly intense sexual experience using the Mr. Nice blend, she learned that it was about 14 percent THC. Sexxpot was branded to help her clients have the same experience, and they have also reported positive results.

Karras says that cannabis is only one piece of the sexual satisfaction puzzle for both men and women.

“We’ve gone too far into our heads and we’re too disconnected from our bodies. We eat too fast, talk too fast, and people aren’t slowing down.

But cannabis slows you down.” And when he says “slow down”, he means it. He strongly encourages avoiding edibles and instead to microdose, wait and see how you respond, then perhaps another microdose followed by a little more waiting. But, the wait may be where the fun begins. “Just try different things,” he suggests. “Take a bath, take a walk together. Cannabis quiets left brain thinking and lets you see each other in a new way.” Taking a page from Timothy Leary, Karras encourages couples to think about (mind)set and setting. “Make a ritual of the experience! You can role play, or dress up.” Or go strain hunting and try different varietals together. “Like wine,” he continues, it takes time to find the kind you love.”

“Yeah, yeah,” you’re thinking, “I can barely brush my teeth before I fall asleep on the couch in my gym clothes watching “Colbert”. Who has the time or energy to create ‘rituals’ around their sex life?” In Karras’ view, perhaps we should change the definition of what “making love” is. “Sex can be just laying [sic] around, giggling, and having a good time. You have to decide that you want to have sex and that it has value,” he counsels. “You find intimacy and joy in the things you choose.”

n 2016 social media will continue to be an omnipresent aspect of many peoples lives. With the additions of applications including Pinterest, SnapChat and MassRoots over the past few years to an already existing list of social media juggernauts including Twitter, Facebook and Instagram, one can safely assume that social media is here to stay. The millennial generation has been raised on technology and the upcoming generations will only have more advanced technology and access to social media platforms at earlier ages. As wonderful as social media can be in certain aspects, including being able to connect with family, stay in touch with friends, among other benefits like simply being able to share your day-to-day life, there are some other aspects that are less than noteworthy.

In recent years as cannabis has become legal in various forms throughout the country, there seems to have been a shift in how social media platforms, especially Instagram, view cannabis related accounts or businesses. Many cannabis related accounts have been and continue to be shut down by Instagram with no warning or message. Instagram provides no details for individual accounts or company accounts in terms of what a business may have done to violate their terms of service or if there is an aspect of specific content that an account owner can fix.

Instead of allowing an open line of communication to cannabis related businesses so accounts can keep their followers, spread their business and use the platform properly, Instagram removes their pages and forces many to start their social media presence again from scratch.

One of the many examples of cannabis related account deactivation includes the story of Herbal Remedies, a state compliant medical only cannabis facility in Denver, Colorado. During a conversation with Nic Guthrie, the manager at Herbal Remedies, he mentioned, “We have had our accounts shut down three times and the worst part is that all of the work we put in just disappears, which is very frustrating.” Another one of the interesting aspects of the situation with cannabis and social media, and something Nic brought up during our conversation is the idea that Instagram doesn’t seem to have a problem with other questionable content including in some cases nude women, guns and other more dangerous drugs. The examples of cannabis related or associated Instagram accounts getting removed goes beyond just legally operating Colorado dispensaries and includes personal accounts and accounts geared towards cannabis activism as well.

Coral Reefer, a popular and sometimes controversial cannabis related social media personality and figure from Alameda, California, has had many issues with her accounts being removed. Similar to others in the cannabis community, she did not have any contact from Instagram before her account was shut down. Coral’s first Instagram account was removed at 102k followers, which isn’t a small feat to obtain. Another interesting aspect of Coral Reefer’s story is that her original account was later restored, with no communication from Instagram regarding why the account was initially removed or why it was being placed back online. Coral Reefer’s Instagram account currently sits at 147k followers.

Cannabis, its use, and the culture surrounding it are here to stay.

Therefore the limiting or unofficial targeting of cannabis related accounts by Instagram and other social media platforms isn’t necessary.

If social media platforms have issues with cannabis related businesses or accounts than everyone participating in the realm of cannabis would appreciate an open dialogue. What types of posts are permitted and what type of specific content should be avoided? By opening that line of communication, both social media platforms and their customers (the users who create the accounts) could be happier and more successful with the service while not unknowingly failing to abide by company policy. Overall, cannabis and the accounts associated with its education and use will always be created and recreated. Hopefully the unspoken war on cannabis waged by social media outlets ends in 2016.

Creating the Future of Commercial Cannabis

Pueblo County positions itself to be at the forefront of the legal industry

It’s

a sunny day in eastern Pueblo County. The clear blue sky is dotted with the few lingering wisps of clouds, the characteristic Colorado sun is warming the ground, and the recent snowfall has all but melted away turning this sprawling expanse of land into a soggy mess. The crops that grow here have long since been harvested, but looking across the 36 muddy acres, one gets a sense of the potential that resides inside the high fences that surround this farm.

The industrial scale is intended to meet the ever-growing demand for the crops grown here: recreational cannabis. While most consumers would think of their bud as coming from a “grow”, this is a farm in every sense of the word. The vast acreage here makes the massive warehouse set ups that have come to represent the face of legal cannabis production, in most of the industry, seem like the clandestine project of an underground grower trying his best to hide his crop. Here, commercial agriculture meets adult-use marijuana, and it’s unlike just about anything else in the country. This is Los Sueños farm, and it may in fact be the largest legal marijuana growing space in the world.

The grounds are home to a variety of tractors and other farm equipment, as well as two pump-driven wells. The water rights owned by Los Sueños are an integral part of a farm of this scale.

Securing these rights can be tricky in Colorado, but it’s a necessity in any form of commercial agriculture.

In order to fully take advantage of the land, satellite photos and soil samples are used to determine soil content, allowing the farmers to plant each of the 250 different strains that are grown here in the soil with the nutrient content that most closely matches its needs.

“This is about the future of Pueblo, and creating sustaining jobs. It’s not just about dispensaries but something deeper and bigger than that. It’s about research, it’s about cultivation.”

The land is broken into four separate tracts, each with its own barn serving as a nursery for recently sprouted clones. Several massive trimming machines are on sight as well, a necessity in the processing of the massive amounts of cannabis that is produced here. Los Sueños has only been in operation since April of last year, but in their first harvest the farm chopped down two tons of usable cannabis between the bud, shake and trim. It’s a massive amount in an industry that usually measures harvests in pounds. All told, the harvest lasted for a full three weeks, and required the work of 60 people.

Growing plants outdoors seems like a natural way of doing things, but when it comes to marijuana in Colorado, the idea is a bit of a revelation. In most of the state, growing outdoor marijuana isn’t allowed. All production is limited to secure, closed facilities with walls and roofs. But here in Pueblo, growing the plant has returned to a more natural course.

“Everyone’s trying to recreate nature indoors,” says Michael Cadwell, Los Sueños’ director of sales. “They’ve spent millions upon millions of dollars on these grows.” The artificial growing environment that is necessary to legally grow cannabis in so much of the state brings with it its own perils. Grows need to be handled with extreme care, as contamination can lead to pests, mold and other issues that, in this pseudo sterile environment, can spread quickly, knocking out a crop and costing the manufacturer thousands of dollars. The common solution is to douse plants with pesticides and fungicides when problems arise, a course of action that is very publicly playing out in Denver in the form of recalls, much to the chagrin of manufacturers.

necessity in Pueblo, which has historically been one of the poorest parts of the state since the collapse of the steel industry here in the 1980s.

“We’ve had one of the highest unemployment rates, lowest per-capita income, high teenage pregnancy — going down the list. We’ve been in a sustained recession since the ‘80s, and cannabis has played a big role in helping us inch out of it,” says Pueblo County Commissioner Sal Pace.

According to the Bureau of Labor Statistics, the unemployment rate in Pueblo has dropped more than a full percentage point over the past year, down to the lowest rates there since 2007. “There’s thousands of people working in the industry, and that makes a big difference in our community,” says Pace. The more than 2,000 people badged to work in the industry by the Marijuana Enforcement Division in the county serve as tangible proof that marijuana is providing the area with jobs, he says.

But the number of people currently working in the legal marijuana market is just part of the picture, and the number of badge holders doesn’t reflect those working in the hemp industry, or the associated ancillary businesses.

“There’s so many other tangential jobs, whether it’s construction or electricians. It’s hard to pinpoint the exact number,” says Pace. He’s quick to point out that 36 percent of new construction in Pueblo County is marijuana related.

“There are folks who have some sort of moral problems with cannabis, most of the time I think they’re misinformed. Even if you had a moral objection, if you look at it pragmatically, there’s always going to be folks who consume ... isn’t it better to have the activity in the legally regulated marketplace than the black market controlled be the cartels?”

Out here, says Cadwell, nature can take its course. Larger predatory insects shortly handle any pest infestation, and Cadwell says he watched this circle of life play out during the first harvest.

The other obvious advantage to growing like this is the Colorado sun, graciously provided the proverbial 300 days per year free of charge. Pueblo lies in the state’s banana belt, with a warmer climate making it ideal for cannabis. While the climate here may literally be well suited for growing cannabis, the political and economic climate may be the truly defining feature of the area that makes it so attractive to these types of businesses.

Unlike so many other municipalities in the state, Pueblo has looked to seize on the economic opportunities provided by legal cannabis in the state. It’s a

A creeping insinuation as of late has been the idea that marijuana businesses are somehow preying on low-income areas, a claim due at least in part to a recent Denver Post report on data from the MED that showed a majority of marijuana businesses were located in poorer areas of Denver. But Pace says he doesn’t see welcoming cannabis in Pueblo in that light. “If you look at it rationally, you see that Amendment 64 didn’t create any new users.

It only took [cannabis] out of the black market and regulated it, made it safer and put the revenue toward good activities in the community,” he says. “There’s going to be communities that make a lot of money off of cannabis, and I’d rather it be us than somewhere else. An abundance of cheap land and a local government willing to let marijuana growers produce their crops on it in a manner similar to other agricultural commodities is just part of what is enticing cannabis business to Pueblo. County regulators have also taken steps to regulate male hemp plants grown for fiber and seed, ensuring that any farm is at least five miles away from one of the county’s outdoor marijuana or female hemp farms so that cannabinoid content is not threatened by cross pollination. “By putting restrictions on where and when male plants can be produced, we’ve made our community a haven for those who want to [grow] medicinal hemp, and put some protections and assurances in place for those who want to invest large sums of money in cannabis, whether it’s hemp or marijuana,” says Pace.

“Why the hell would you want to grow an agricultural product in a warehouse? It doesn’t make sense,” he says. “We’ve got more cultivation square footage in Pueblo than anywhere else in the state. If we’re not already cultivating more in Pueblo than Denver, we will be soon. When the federal government legalizes we’re in a stronger position to be a major exporter and create sustaining jobs there.”

“We are incredibly excited about the economic boom that’s happening in our community,” says Pace. “And it’s not just based on the sale or cultivation, but also the research of cannabis.”

Indeed, the most exciting prospect for cannabis in Pueblo may be the proposed Institute of Cannabis Research at Colorado State University’s Pueblo campus. It’s an idea that aligns nicely with the area’s recently minted designation as the “Silicon Valley of Cannabis”, and would help

But sacrificing economic opportunity in a county that has been deprived of it for decades is not something he says he’s willing to do just to satisfy the few lingering critics clinging to a poorly conceived notion of civic morality. “I can’t judge every decision by what’s going to make me the prom king. That’s not why I’m in office,” says Pace. “My job is to improve Pueblo, create jobs and leave a community behind that’s better than the one I inherited.”

“This is about the future of Pueblo, and creating sustaining jobs. It’s not just about dispensaries but something deeper and bigger than that. It’s about research, it’s about cultivation,” says Pace. “The research piece is the critical piece. A dispensary can certainly make some money, a retailer selling CBD oil can make some money, a cultivator whose cultivating, and perhaps in the future shipping all over the country, can make more money — an exponential amount of money. But the real profit and the real opportunity for significant economic growth is in the research and development side.”

Out at Los Sueños, the opportunity provided by doing business in this welcoming environment is real. Across the road, another 130 acres of property that is also owned by the company beckons for development, offering the potential to more than quadruple the already impressive farm.

Under the bright Colorado sun, a national industry is growing on a scale not seen before in the legal market. Colorado, already at the forefront of the movement, will undoubtedly be a major component in the national market and for residents of Pueblo that could be a very good thing. The trends that will dictate the shape of the industry and the business practices that form around them are developing here. Whatever the future holds, Pueblo will likely be an example that others will follow, and for Pace, that’s exactly where he’d like to be. “We’re trying to be the best example possible of what we can be,” he says. establish Pueblo as a forerunner not just in cannabis cultivation, but in the understanding of the plant as a whole. A recently approved excise tax on marijuana grown in the county, which Pace was instrumental in putting in front of voters, assures that some $220,000 will be provided for the institute directly from marijuana cultivators in the area. “Let’s research the risks,” he says. “Let’s be honest. Let’s look at the pros and the cons. Research the best ways to cultivate, let’s research the economics and the political impacts.”

The institute will not only provide a much-needed opportunity to advance understanding of cannabis, helping to shape a debate that has largely been guided by misinformation and conjecture over the past 80 years, but will help to establish Pueblo as an economic and intellectual Mecca for the burgeoning hemp and marijuana industries. It’s something that Colorado has been in a position to create since the passage of Amendment 64 in 2012, and local officials in Pueblo are seizing on the opportunity. In October of last year, the Pueblo city council voted to grant $8 million in economic incentives to help fund CBD Bioscience’s processing plant in a city-owned building that formerly served as a Boeing rocket production facility.

The funds would come from the city’s half-cent sales tax, and would go toward building the hemp-oil processing center that could help turn the county’s medicinal hemp crop into an exportable product. According to the city’s estimate, the facility —a joint venture of O.pen Vape and Thar Process Inc. — would create 163 jobs, each paying an average of more than $40,000 a year. The idea behind the facility is to create a Global Hemp Center of Innovation, which will “provide technical expertise on extraction, purification, analysis and formulation, and will support local farmers,” as reported by The Denver Post.

All things considered, Pace says there has been over $100 million dollars of investment in high tech cannabis cultivation in the county. “This is really exciting. You build an epicenter and all the tangible benefits pop up because of it,” he says.

The Black, White and Gray of Cannabis Regulation

alk about cannabis, especially in the realm of industrial hemp, invariably leads somebody to offer up the bromide that there are “gray areas” of the law. The law is vague and confusing, so it is said, which creates uncertainty about what is legal and what is illegal. But when I read the black letter of the law, I find little if anything that anyone would ever call gray. Federal drug laws may be a lot of things, including silly, counterproductive, and downright bad, but they are not vague or confusing. I find no shades of gray.

Make no mistake about it, cannabis plants, all cannabis plants, are classified under federal law as marijuana, a Schedule I controlled substance. Not only that, but most parts of the cannabis plants are also considered marijuana; in particular, the leaves and flowers. Nor does the law stop there. “Every compound, manufacture, salt, derivative, mixture, or preparation” of marijuana is also classified as marijuana.

All varieties of cannabis plants contain dozens or hundreds of chemical constituents. These include cannabinoids, nitrogenous compounds, amino acids, proteins, glycoproteins, enzymes, sugars, hydrocarbons, alcohols, aldehydes, ketones, simple acids, fatty acids, esters, lactones, steroids, terpenes, non-cannabinoid phenols, flavonoids, vitamins, and pigments.

To the extent that any are derived from the leaves or flowers of cannabis, federal law classifies them as marijuana. One might challenge the wisdom of that definition all day long, I certainly do, but disagreement over what the law says does not make it any less clear.

Colorado is experiencing a boom in the market for cannabinoid products derived from cannabis. Most noteworthy perhaps is Δ-9 tetrahydrocannabinol, the multisyllabic psychoactive goody that we have all come to know and love as THC, popularly consumed throughout the ages for its recreational and medical benefits. But there is a veritable alphabet soup of cannabinoids found in cannabis besides THC, dozens or hundreds of them. They include tetrahydrocannabivarin (THCV), cannabidiol (CBD), cannabinol (CBN), cannabichromene (CBC), cannabigerol (CBG) and a host of others. Every single cannabinoid meets the federal definition of marijuana, because they are all derived from the leaves and flowers of cannabis. Every single one of them is a Schedule I controlled substance, making their unauthorized manufacture, possession and distribution a federal crime.

There is a flawed popular perception that the key to illegality in the world of cannabis is THC. But THC appears nowhere in the federal definition of marijuana. Federal law does not care whether a cannabis plant is chock full of THC or has any measurable concentration of the substance at all. It simply does not matter whether the stuff made from cannabis could give one a buzz or not. It is all equally illegal in the eyes of the law.

Many wish to believe that industrial hemp is different. A number of states, including Colorado, define industrial hemp to mean cannabis with a below-threshold concentration of THC in the plant tissue, generally recognized as no more than 0.3 percent by dry weight. Other than the narrow exception for academic research and development articulated in the 2014 Farm Bill, no similar distinction exists in federal law. But low concentrations of THC in industrial hemp does not help the plant avoid the onus of federal prohibition. Cannabinoid products are all classified as marijuana, regardless of the variety of plant from which they were made and regardless how much or how little THC the plant or the product made from it might contain.

Manufacture of cannabinoid products in Colorado is booming. But they are not being regulated in a consistent manner. Cannabinoid products made from what the state has defined as marijuana are strictly controlled under complex and pervasive regulations promulgated and administered by the Marijuana Enforcement Division in the Department of Revenue. In contrast, the only aspect of state-defined industrial hemp that is subject to regulation is cultivation, by the Department of Agriculture. regulated at all. In fact, Colorado law actually accords statutory immunity to anyone who processes and sells products made from legally registered and cultivated industrial hemp. Section 108(2) of the hemp regulatory statutes provides as follows: “[A] person engaged in processing, selling, transporting, possessing, or otherwise distributing industrial hemp cultivated by a person registered under this article, or selling industrial hemp products produced therefrom, is not subject to any civil or criminal actions under Colorado law for engaging in such activities.�

The stark difference in Colorado between the regulation of marijuana and industrial hemp presents a particular challenge to federal drug enforcement. In a now-famous memorandum authored by Deputy Attorney General James M. Cole on August 29, 2013, the U.S. Department of Justice effectively gave the nod to states such as Colorado to experiment with regulated cannabis markets. Federal law enforcement policy since issuance of the Cole Memorandum generally has been to avoid prosecution in states where cannabis is legal, provided that actors play by state rules and avoid implicating certain federal law enforcement priorities. One of the enumerated law enforcement priorities is to prevent the diversion of marijuana from a state where it is legal to another state where it is not.

Therein lies the problem in Colorado. Diversion of cannabinoid products made from industrial hemp is now occurring on a large scale.

Transporting cannabinoid products made from industrial hemp across state lines places them in the stream of interstate commerce, where federal law, not Colorado law, controls. And federal law is clear: any product made from the leaves or flowers of any cannabis plant is marijuana. Interstate sales of cannabinoid products cannot be characterized as anything other than trafficking in a Schedule I controlled substance. Such activities not only break federal law, but they implicate at least one of the law enforcement priorities set forth in the Cole Memorandum, against diverting marijuana out of state.

So far, the federal government has been remarkably tolerant of interstate sales of cannabinoid products, other than for those rich in THC. Relatively few attempts have been made to impede their transport outside of Colorado.

But that does not reflect any change in the law, only a relatively lax attitude by

the current administration in Washington. That could change dramatically with the next administration, or for that matter, at any time. The current situation cannot continue. It exposes the regulated cannabis market in Colorado to the risk of significant intervention by federal law enforcement.

Recent calls have been made in some circles in Colorado for implementation of regulations that would apply to all cannabinoid products, without regard to the source material from which they were made. Such regulations would include licensing, standards for quality and content, labeling, and prohibitions against export out of state, as long as the products remained federally illegal. Not surprisingly, some in the industrial hemp sector have reacted with vehement indignation to such proposals. The very thought of having their industry lumped in with marijuana offends their self-image of moral superiority and entitlement to special protection. But the reality is otherwise. There is but one plant, cannabis. There is but one body of federal law against it. Cannabis has but one future. We must all sink or swim from the same boat.

Federal drug laws are bad and need to be changed. Prohibitions against cannabis, all cannabis, both marijuana and industrial hemp, should be abolished. But until that day comes, the State of Colorado must rationalize its current regulatory system to avoid implicating federal law enforcement priorities set forth in the Cole Memorandum.

As an industrial hemp attorney, I support regulation of the processing and sale of cannabinoid products, including those made from industrial hemp.

I have little doubt that it is coming. Resistance to regulation might delay the day of reckoning, but cannot forestall the inevitable. The industrial hemp sector can choose to be part of the problem, by denying that there is one. Or it can be part of the solution, by working to create a sound, reasonable and fair system of regulation. I would respectfully counsel the latter.

The Racial Divide in Legal Cannabis

The marijuana industry is a grand new frontier, creating an unparalleled opportunity to overturn existing business paradigms and creating a more diverse workplace with more inclusive policies.

The nascent industry has a unique opportunity to shift the status quo by including African Americans, nurturing black entrepreneurs and investors, and opening legal marijuana businesses in black communities. But will this truly be the case? And will African Americans be willing to take the risk?

There are sound reasons for the mistrust and cynicism many African Americans may feel toward the marijuana movement. When a state approves legal adult-use or medicinal establishments, it sends a perplexing message to black communities, many of which have been decimated by punitive drug policies. Larry Gabriel wrote in the Detroit Metro Times that, “Brothers are afraid to stick their necks out on this issue because when the powers that be decide to start chopping heads off, they know which heads are going to roll first.

Given the history of the war on drugs and the fact that AfricanAmericans get arrested for marijuana at more than three times the rate of whites, it makes sense to be paranoid.”

Jonathan Rothwell wrote for Brookings that, “The social mobility of black Americans has suffered collateral damage from the ‘War on Drugs’. Being convicted of a crime has devastating effects on the employment prospects and incomes of ex-felons and their children.”

He goes on to explain that, “Our criminal justice system unfairly punishes black Americans—often for victimless crimes that whites are at least as likely to commit.”

with law enforcement, and loads of capital. Opening a cannabis establishment isn’t cheap, with New York paving the expensive way with a cost of up to $10 million to open a dispensary. Art Way of the Drug Policy Alliance is the Senior Director of the National Criminal Justice Reform Strategy and Colorado State Director. Way believes that the regulations concerning licensing in the marijuana industry may discourage investors of all kinds, but in particular black investors, who studies show are often discriminated against when applying for loans. And if they do get that loan, they can expect to pay more interest, on average 0.31 percent higher than their white counterparts, according to a study published in the Journal of Real Estate and Finance Economics, thus relying more frequently on their own personal wealth.

“I think the issue of course is that when you look at the black community, more people lack capital,” says Ken Williams, a former Boston area homicide detective and representative for Law Enforcement Against Prohibition (LEAP). “The black community has double digit unemployment. But we’re talking about a day and age where the CDC (Centers for Disease Control) says marijuana has therapeutic value and the FDA (Federal Drug Administration) is evaluating it for its efficacy. As long as people are doing it lawfully and legally, who wouldn’t want to be a part of the upcoming 21st century pharmaceutical industry?”

But Williams senses a strong disconnect among African Americans with regard to their perception of the marijuana industry, and the war on drugs- a war that has wreaked havoc in their families and made felons of millions. Williams explains that, “I think for older folks, like in their 60s or 70s, they can’t forget about history. But there’s not a marijuana addiction that causes of wave of crime like heroin

and crack cocaine, which really afflicted the black community.” And some, with the gift of hindsight, may be hesitant about stepping into activist roles. In crime-riddled 1970s Harlem, black leaders along with working and middle-class families started to push back against vagrancy and drug use in their neighborhoods, lobbying for harsh penalties for pushers and abusers. Nelson Rockefeller, then running for governor of New York, was happy to oblige. Wanting to be seen as tough on crime, Rockefeller called for mandatory minimums of 15 years for drug dealers and addicts, even those caught with small amounts of cocaine, heroin, and marijuana. The Rockefeller Drug Laws easily passed and are credited with being the model for the War on Drugs declared by President Nixon.

While marijuana reform organizations are striving daily to change marijuana laws, they may have a giant blind spot by choosing to focus on “big picture” views of public health and not paying much attention to marijuana’s role in black communities. Drug Policy Alliance board member and professor at Columbia University Carl L. Hart wrote for The Nation about reform organizations that, “From their rank and file to their advisory boards, the membership consists almost exclusively of white, privileged and devoted marijuana smokers. Not that there’s anything wrong with that, per se, but it helped me understand why racial equality is not a central priority for them. Most of these individuals would like to light up without fear of personal legal consequences—a self-interested goal that could make it difficult to empathize with those who are actually vulnerable to racially motivated marijuana law enforcement.”

Way agrees, noting, “The marijuana reform community has been historically silent on issues of race. That reality has naturally permeated the industry.” The federal government, though

traditionally a terrible marijuana reform partner, has enacted a few policies to create a more equal societal foothold. One is “ban the box”, which removes the “conviction question” from job applications, thereby providing more opportunity for sound employment and improved finances. The Obama Justice Department, though run by the first-ever black female Attorney General Loretta Lynch, has taken a hard line against legalization, but is going to let the states decide how to enforce marijuana policy.

With increasing public acceptance of marijuana policies and an increasing number of states creating legal and medicinal markets, the stage is set for established black entrepreneurs to enact radical diversity and for reform organizations to “set the bar for inclusion for those with drug offenses, as well as set the bar concerning sensible drug testing policies within the workplace.” On International Business Times list of marijuana leaders, only two were black: Wanda James, owner of Simply Pure edibles and President and Director of the Cannabis Global Initiative, a marijuana marketing and communications firm, and rapper and “gangapreneur” Snoop Dogg, whose efforts include a media outlet called Merry Jane and Leafs by Snoop, a cannabis product line. Way sees changes happening in Washington DC and California as black business people work to move legitimate marijuana businesses into African American communities. Perhaps it is time for African American leaders, especially prominent ones such as Ms. James and Mr. Dogg, to focus some of their efforts on educating African Americans about the opportunities of the marijuana industry in its current state and the value of legal establishments in their cities. Williams observes, “If you take away the value of a narcotic, there would be no need to have a drug dealer on the corner, and no need to carry a weapon to protect drug turf.”

Ethan Nadelmann:

Hardest Working Man in Drug Policy Reform

Ethan Nadelmann is a tall drink of water with perked-up bat ears, youthful freckles on his face contrasting his thin, greying mustache, and a jaunty spring in his step. His voice rolls out with the bravado of native New Yorker; staccato, short, and right on target. Rolling Stone described him as a “wonky intellectual in dad jeans,” but at a gathering of marijuana legalization supporters in downtown New York City, Nadelmann doesn’t look wonky per se, but more like the guy whose picture you would see on a bus bench selling insurance. The son of a Yonkers rabbi is standing alone and smiling in the back of a well-meaning, co-working space full of environmentally friendly tchotchkes. Despite the cold weather outside, the gathered group is larger than usual and definitely abuzz, waiting for his grand entrance.

Nadelmann has a BA, JD, and PhD from Harvard and a master’s degree from the London School of Economics. He could have chosen to work in politics, international relations, or continued in academia. But instead, Nadelmann turned his traditional, ivy league education on its ear, using his time as a professor at Princeton to write articles on drug policy that were published in the decidedly staid Foreign Affairs and American Heritage magazines, among others. Like many of his peers coming of age in the ‘70s, he used marijuana at a time when more than 53 percent of college freshmen supported legalization, during a Carter administration that expressed support for a looser grip on marijuana policy. And though he was enjoying his time with cannabis, in the 1980s he began to feel a strong sense of unease about the government’s sledgehammer approach to drug policy and its wildly disproportionate response to drug use and its ramifications on mass incarceration and public health.

Nadelmann recalls, “I had this amazing issue I was impassioned by, and in the late summer of ‘89, I realized, this was gonna be my life, educating people around the world about what was wrong with the way we dealt with drugs and drug laws and the policy around that.” The start of his 15 minutes

of fame came in 1987, when he was invited to speak at a conference on interdiction at the Defense Intelligence Agency in 1987. All the top brass of the drug war were there; the FBI, state department, and DEA. He sealed his fate when he said to the audience, “You guys are no different from the prohibition agents in the 1920s. Your policy isn’t working any better, and it’s probably doing more harm.” And he never looked back.

His ballsy speech at the height of drug war mania caught the attention of billionaire investor George Soros, who helped Nadelmann fund the Lindesmith Center, a drug policy institute. They later merged with the Drug Policy Foundation founded by activists Kevin Zeese and Arnold Trebach. The new group, now headed by Nadelmann, became the Drug Policy Alliance (DPA), and though there are many organizations out there dedicated to reforming marijuana laws, DPA stands apart from its peers.

Nadelmann explains, “Marijuana policy is only a little more than a third of what we do. The other third is ending mass incarceration, and the other third is treating drug use and addiction as a major health issue, so we have major objectives in what we’re doing.”

With an industry that has been repeatedly compared to the Wild West, Nadelmann is acutely aware of the industry’s shortcomings. “At this point,” he says, “the industry is quite heterogeneous, there’s [sic] many conflicting interests among people within the industry. They’ve not been very effective at getting out and together on advocacy.” The fractured nature of the industry also lends itself to invasion from people and companies whose interest in marijuana lies not in wellness or social justice but in money. Now that marijuana has seen the stunning successes of legalization and with the big prize, California, getting its ballot initiative on for this election year, never before has the industry looked so tantalizing. People who have no skin in the game, no connection to the work and people that fought for legalization are licking their chops and waiting for a seat on the gravy train.

“There’s a sense that this industry is like, ‘whoa, manna from heaven, gold in the streets and we didn’t have to spend a penny because we have a bunch of do-gooders like Nadelmann bringing all the money and look at these wonderful profit opportunities they brought...who are they again?... but God, I love ‘em ‘cause we’re gonna make some money!’” Nadelmann pauses for effect before he adds with a Larry David-like flair, “but what I really wanna say to them is, ‘you guys...I’m your fucking daddy.’”

and Central America. Even though marijuana initiatives will be crowding the ballot, Nadelmann warns that “it is not a done deal.” He intones two words for those interested in seeing marijuana legal: be responsible.“If you’re involved in marijuana one way or another, do so responsibly. If you consume, do so responsibly. If you are a parent, do so responsibly. If you sell, do so responsibly. Responsible behavior on the part of as many participants as possible is what’s gonna clinch this thing for us.”

And he’s right, the DPA has had a hand in pretty much every marijuana reform victory you can think of, such as the glamorous legalization wins in Oregon, Alaska and Uruguay. But they also dig into the hard work of rolling up their sleeves to undo mass incarceration, three strikes reform, bail reform, harm reduction, and public information and awareness campaigns.

Without the work of the DPA, their allies, and their wealthy donors, the ones that Nadelmann and his peers work hard at courting and keeping, the onus of building a thriving, money-making, and united industry falls on the shoulders of those not necessarily interested in doing so.

As for the future of the industry, the stated message of the DPA is to end federal prohibition, but Nadelmann has some reservations, saying, “Personally, I feel a little more ambivalent about this mission because I worry about what that will mean for the shape of legalization in this country.”

What would federal legalization look like? Small businesses thriving under the current regulations would certainly be at risk. A legal federal market would likely open the door for big pharma, big alcohol, and big tobacco with their enormous budgets and large production capacities, muscling in on the businesses that have laid the legal road. Nadelmann adds, “I’ll also say when I talk to people in the industry, some of them are all for legalization at the state level but not the federal level.” He would like to see marijuana states follow the model that repealed alcohol prohibition, leaving alcohol management up to each individual state. A federal repeal also endangers the livelihoods of people like those in Humboldt County who have been making money in the industry for generations, and even those in the inner city who, he says, “Are disproportionately victimized by marijuana, and one of the few benefits they received by it, you know, modest, even significant levels of employment in a grey market industry.”

Ever aware of minding the store, Nadelmann knows that the power for reform lies in the messaging, and making sure those messages appeal to voters that are smack in the middle. “The initiatives have to be supported by the swing voters,” explains Nadelmann. “The most important thing is ensuring that the people in the middle — the soccer moms, the ‘proverbial’ soccer moms who have never smoked marijuana, or maybe they smoked it when they were younger but don’t smoke it now, the people that are worried about their kids and are on the fence but recognize that marijuana prohibition has failed, that they’ve had no success in reducing access to young people — it’s making sure that those people, the swing voters, the ones who are ambivalent feel that this is the kind of initiative that they can support in good faith.”

Nadelmann bemoans the well-meaning yet off-message toker activists who show up on the steps of state capitols to do smoke-ins, show up in weed costumes, and otherwise subvert more palatable reform campaigns.

In Nadelmann’s view, the key to marijuana reform messaging is medical marijuana, which blew open in ‘96 with the victory of Proposition 215. “Twenty years ago in California, it was the first time we showed that we could play ball in American politics.

We stunned the opposition.” Lawmakers accused supporters of not caring about patients and using the initiative as a front to get legally high without legitimate medical conditions. “And the answer is, there’s some truth to that,” Nadelmann laughs, “But the fact of the matter is, for me and many others, is that we were in this for two reasons: the first is that when it came to medical marijuana that the persecution and prosecution of people who were really using medical marijuana for medical purposes was one of the most egregious aspects of the war on marijuana, and if anyone deserved to be the first in line to get access, it was them.

The moral obligation to people who use it as medicine really remained paramount.”

Nadelmann bemoans the well-meaning yet off-message toker activists who show up on the steps of state capitols to do smoke-ins, show up in weed costumes, and otherwise subvert more palatable reform campaigns.

When the media shows, as Nadelmann describes it, a 17-year-old high school dropout with long dreadlocks and hemp leaves in his hair, then they unwittingly play right into the hands of the opposition who point happily to their lawlessness and disregard for societal norms. But when the media start showing images of hardened right-wing lawmakers tearing up at speeches from people in wheelchairs suffering from MS, older people living with AIDS, or a child being ravaged by epilepsy, the conversation shifts and the media starts to humanize marijuana.

Election year 2016 has the potential to blow marijuana reform wide open, especially if they score a win in California, potentially tripling the size of the legal marijuana market. A legal recreational market in California could also have a huge global impact, paving the way for meaningful reform in Mexico

Don’t get Nadelmann wrong. He wants a strong and thriving legal market, but he wants it be the right kind of market. “I don’t want to meet everyone who wants to make marijuana legal,” he explains. “I only want to meet a few of you and I only want to meet people who are interested in meeting two criteria: the first is that you make a shitload of money in this industry in the right way, and the second is you have or will acquire a social justice consciousness so that you carry on the bigger issues of what we’re fighting for.” Civil justice, human rights, racial justice, and social justice are high on his list of these bigger issues, and he cautions strongly against an industry driven by pecuniary interests, saying that, “Greed can produce a lot of money. Greed can make people stupid. Greed can make people with a lot of money stupid.”

In an ideal legalized world, Nadelmann says he would love to see the marijuana industry emerge as a new role model for responsible business practice, where social responsibility, a conscience, and a sense of giving back to the community is built into the business models. No matter how the 2016 election dust settles, the hard work of drug policy reform must continue and he predicts that it’s going to be a long slog. Nadelmann sighs, “Sometimes things can go backwards. This is not in the bag yet, overconfidence is one of the greatest things we have to fear.” As Nadelmann finishes his speech, the room once again comes alive, humming with excitement and discussing his call to action. It turns out that the guy who looks like your insurance salesman is an unlikely celebrity; confident, politically agile, socially adept, funny, and perhaps the most influential and well-respected person in drug policy reform.

Pot-litically Incorrect

Award season is upon us. The new year brings with it a chance to reflect on the outstanding work of 2015, be it film, music, or any other cultural medium. It’s a time to identify the efforts of those who worked tirelessly to tug at our heart strings and stir our minds, a time to lavish praise upon those whose work truly made an impact and stoked the fire of emotion in the boiler of our souls.

But some people are notably left out of this experience. While 2015’s end brought with it a wealth of recognition for those working in the creative industries — as well as those working in the cannabis industry — a segment of the population working with equal vigor went notably un-lauded. Their ideas crafted with care, manifested with due consideration, this segment of the public rarely gets the recognition of the efforts they put forward.

Instead, they are the subject of ridicule and derision. Smarmy analysts condescendingly pick apart their carefully concocted craftwork, dismissing these efforts and attacking their auteurs. This segment, of course, would be the prohibitionists.

This was a busy group during 2015, and their efforts didn’t go unnoticed.

With cannabis legalization expanding, and public perception now more on the side of reason than ever, it’s increasingly hard work to convince yourself that legalization is the wrong thing to do. So I offer this, my humble recognition of the outstanding effort put forward to dodge basic reason and common sense on the issue of cannabis, and present the ideals held by prohibitionists most deserving of recognition; the medal ceremony in the mental gymnastics of prohibition.

Participation Award: Weed Harms the Brain Certainly, in a competition such as this, with so much recognition and stature on the line, it would seem foolish to adhere to the practice that has helped create a generation of entitled fuckwits by handing out an award just for showing up. But it takes courage to enter the public debate, especially when you have no idea what the actual fuck you are talking about.

This year saw plenty of efforts by prohibitionist pundits to link marijuana use to problems with brain development and mental illness.

Notably, Team Prohibition latched onto a study from King’s College in London that seemed to show daily users of “skunk” had less density in their corpus callosum than nonusers and users of slightly less dank shit. The study looked at brain scans of fewer than 100 people and also failed to factor in users of “kind bud”, “dat fire”, “the doe doe” and “kryptonite”, which would have helped illuminate if these results were limited just to users of “skunk”. Moreover, the snapshot provided by these MRI scans doesn’t actually demonstrate any kind of causality, as is generally the case with studies linking marijuana usage to brain damage and mental disorders.

Nonetheless, the prohibitionists latched onto this study as evidence supporting their century-old claims.

While it’s not hard to allow some dick in a lab coat to claim causation when at best there is correlation, I admire the tenacity required to stick with the outdated arguments of greats like Harry Anslinger. Broadcasting this belief is equivalent to the untrained gymnast showing up for competition with just the encouragement of the grizzled Soviet-era coach who opines for the

good old days before the wall came down, only to be hurled mercilessly at the uneven bars of reasoned discourse. It doesn’t take much effort to make no attempt to grasp at the bars before slamming back to the mat like a dead fish, but just showing up earns these prohibitionists a nice pat on the head.

Bronze Medal: Prohibition is Working The underpinning argument of all other prohibitionist contentions is that the status quo of locking people up for possessing, manufacturing, or distributing a plant is the appropriate course of action. It’s a position that takes some bravery given the glaring racism demonstrated in the enforcement of drug laws in the United States —which isn’t to say that it’s brave in any kind of admirable way. Every argument against legalization contains in its core this sentiment: we’d rather be ruining lives than allowing people an alternate method of recreation and medicine.

It takes a bit of intellectual maneuvering to believe that prohibition thus far has achieved the desired results; marijuana is still sold in every state in the country, and anyone who desires has access to it. But being that most of these courageous prohibitionists don’t dare make this point explicit (rather just undeniably implicit in all their actions) this sentiment doesn’t quite pull off the jaw dropping contortion of reason as our first and second place winners.

Silver Medal: Legalization Causes Crime This belief takes some serious effort. The idea that putting the most widely used illegal substance in the world under the regulatory control of the government will lead to an increase in crime flies in the face of not just the data provided by test cases like Colorado and Washington, but basic reason itself. In fact, it seems that legalization is already having a detrimental effect on the multi-billion dollar marijuana trade run by Mexican drug cartels, or so says nearly every reputable media source in the country.

But for this argument, the prohibitionist must grip tightly to the belief that marijuana use constitutes criminal activity, even when it has been legalized. The prohibitionist must hold the catch-22 of “marijuana will ruin your life, so we must keep it illegal and ruin your life for using it,” all while dismissing the entrepreneurs eager to make headway in this highly regulated and taxed industry as criminal suspects looking to launder their drug money. This belief holds that the miniscule flow of marijuana from legalized states into non-legal areas is in some way equivalent to the murder machine of cartel production that claims thousands of lives a year in Mexico.

Holding this belief is a challenge, and I for one recognize it as such. So for the expert contortions of logic required, this belief takes home the silver.

Good, but not the best logical fallacy that prohibitionists have to offer.

Indeed, Colorado may have achieved this distinction simply due to a decrease in usage by teens in other states. The data may also reflect that attitudes in Colorado — which has historically been at the top of the list of recreational drug using states — may cause teenagers to be more open about their marijuana use than in other areas. While the slight increase in teen usage rates doesn’t indicate the monumental victory that cannabis

advocates were hoping for, it certainly is not indicative of the multi-million dollar industry pushing harmful and addictive products to children that the guys at Shit Approaches to Marijuana (SAM) would like to perpetuate.

The skillful display of logic avoidance comes from insisting that marijuana sales should be handled exclusively by drug dealers, and that said drug dealers are less likely to sell to teens than business owners whose licenses and livelihoods are dependent on checking IDs at the door. Insisting that this is the case, while claiming some sort of “think of the children!” moral superiority must require an Olympic level of dedication to self-delusion.

Well done Team Prohibition, you never cease to amaze and inspire.

The medals have been distributed and the champions of mediocrity have been crowned. The hard work that these tireless prohibitionists continue to put in to waging this broken drug war shall stand amongst the greats like Lance Armstrong. It’s not easy defying basic reason and deduction, but this outstanding group continues to make it look easy. It will surely be inspiring to see how these folks outdo themselves in the future.

Gold Medal: Legalization Means Greater Access for Kids Truly an awe-inspiring logical leap, claiming that legalization of marijuana actually improves underage access to marijuana wins the gold medal at this year’s tournament. The claim has been made repeatedly by the prohibitionist crowd, most recently in regards to data collected as part of the 2013-2014 National Survey on Drug Use and Health, which showed that Colorado had the highest rate of marijuana usage by kids aged 12 to 17 in the nation. It’s thought provoking data, a solid logical platform from which to cast off into the mesmerizing back flips of logic needed to equate a thriving black market with youth safety.
