hurdles involved in establishing a well-developed collective are vast and varied. From marketing and advertising to courtroom battles, staying in business is more difficult than

many patients may realize. Nevertheless, no dispensary operator’s concerns should rank higher than the safety and security of their patients. The longevity and well eing of the cannabis industry depends on its ability to operate without the negative (typically criminal) connotations often associated with dispensaries, patients, and cannabis in general.

As more and more patients make the decision to purchase their meds from dispensaries, criminal elements that once relied on illegal distribution have seen a drop in profits, resulting in an increased rate of violent, retaliatory attacks on dispensaries and their operators.

Many dispensary operators are aware of these risks and attempt to negate them through the use of passive security measures such as CCTV cameras and alarm systems. While these systems fill integral roles in securing a location by alerting the business owner of a crime in process or providing a means of capturing evidence of a crime that has already been committed, these passive systems rarely deter potential criminals from carrying out their crimes. By utilizing uniformed security officers, dispensaries gain the benefit of a preemptive visual deterrent; both discouraging potential criminal 4

activity and providing a sense of safety and security for their patients. Additionally, while law enforcement should always be notified after a criminal incident, already lengthy police response times are often further lengthened by a number of unpredictable variables; including traffic, weather, and the number of simultaneously occurring crimes in the area. By having properly trained security officers on site, dispensaries can operate with the peace of mind that any criminal incidents will be met with an immediate response.

Arguably one of the primary causes for the cannabis industry’s security deficiency is an unwillingness on the part of security companies, to deal with dispensaries. As a result, dispensary operators are generally left with two options; hire questionable and often unlicensed security guards, or operate without security at all. San Diego Law Enforcement Attitudes

Medical Marijuana

In 2014, members of the San Diego Narcotics Task Force raided a medical marijuana collective in Imperial Beach. During the raid, one of the officers was spotted wearing a T-shirt with “Marijuana Eradication San Diego, CA” written on it, and writing just below that read “F*$k the growers… Marijuana’s still illegal.” Members of the collective claimed that their operation was legal, but this didn’t stop the task force from destroying all of the plants and seizing dried product and other items from the location. Unfortunately, this scenario is not unique, and is representative of a larger problem in our county.

The T-shirt incident highlights the problem with having multijurisdictional task forces comprised of both state and federal agents.

While state agents are responsible for upholding California law, federal agents are responsible for eradicating the medical marijuana industry. As a former prosecutor, and current criminal defense attorney representing individuals accused of marijuana-related offenses, I have seen first-hand the disrespect for California medical marijuana laws by state and federal agencies. It ranges from those who are ignorant of the laws and have no real desire to learn them, to those who disagree with these laws and will take whatever interpretation of them that will serve their goals of suppressing the industry. Unfortunately, in San Diego, these attitudes are shared by not only the law enforcement agencies raiding grows and arresting state-compliant individuals, but also by prosecutors, judges, and local politicians. We have seen landmark appellate medical marijuana cases originate in San Diego courts, with the results often being that the local district attorneys and judges were incorrect in their interpretation and application of the laws. The T-shirt incident is yet another example of the attitudes shared by many influential people in the San Diego law enforcement community.

Fortunately for San Diego residents, these views are not shared by all members of law enforcement. I have worked on dozens of cases where local prosecutors have made the decision to dismiss marijuana charges, or to refrain from issuing charges, in situations where the accused appeared to be in compliance with California law. I have been successful in having large quantities of marijuana, cultivation equipment, and cash returned to individuals and groups of individuals operating in compliance with California law. I have also attended inspections of cultivation locations with members of local law enforcement agencies where no arrests were made, no property seized, and no cases submitted to the District Attorney’s office for prosecution. There are still members of the law enforcement community who believe in their oath to uphold California state law, and who will make the right decision when confronted with a state-compliant operation. However, for the sake of the people of California, these decisions need to be made by all members of law enforcement at an early stage of the investigation.

No more resources spent on planning and carrying out raids of these state-compliant locations; no more innocent people having their doors kicked in and guns pointed at their families; no more forcing innocent people to spend days in jail, post bail, and use all of their money on attorneys; no more clogging the jails and the courts with cases based on conduct that is clearly what our voters and legislature intended when they enacted California medical marijuana laws. This is a culture in San Diego that will have to be changed from the top down, and it starts with our elected officials. It also starts with our voters.

Know Y ur Rights How much can I possess or grow?

Who may cultivate under Prop. 215?

Under Prop. 215, patients are entitled to whatever amount of marijuana is necessary for their personal medical use. However, patients are likely to be arrested if they exceed the SB 420 guidelines.

SB420 sets a baseline statewide guideline of 6 mature or 12 immature plants, and 1/2 pound (8oz.) of processed flower per patient.

National City has an ordinance outlawing any cultivation, even on private residential property.

The City of San Diego (Including Chula Vista) allows up to 24 plants (total) in up to 64 square feet indoors. Outdoor cultivation is only allowed in covered, secured, and locked green houses. Patients may possess up to one pound processed cannabis (16 oz.)

Individual cities and countries are allowed to enact higher, but not lower, limits than the state standard. Patients can be exempted from the limits if their physician specifically states that they need more for their own personal use; but beware of physicians offering “cultivation” licenses for large amounts.

Patients with a physician’s recommendation and their primary caregivers, defined as, “ The individual designated by the person exempted under this act who has consistently assumed responsibility for the housing, health, or safety of that person.” According to a state supreme court decision, People V Mentch (2008), caregivers must supply some other service to patients than just providing marijuana.

As an alternative, SB 420 allows patients to grow together in non-profit “collectives” or cooperatives/ Collectives may scale the SB 420 limits to the number of members, but large gardens are always suspect to law enforcement. In particular, grows over 100 plants risk five- year mandatory minimum sentences under federal law.

Where can I grow medicine?

Although Prop 215 allows patients to grow their own medicine, landlords are not legally obliged to allow it. If you rent or lease please be advised your landlord does have the right to evict you. Many cities and counties have passed zoning ordinances that restrict where patients grow, in some cases outlawing outdoor cultivation altogether.

Can I grow or use medical marijuana with children in the house?

There is nothing in state law against this. However its advised to keep you medical marijuana away from children. Make sure that you don’t leave edibles around where kids can get them, and keep gardens away from where they play.

In rare cases Child Protective Services has become involved, mostly in cases with large plant number, evidence of sales, neglect, or messy divorce proceedings. In such cases, CPS tends not to be understanding about medical marijuana and can always allege child management.

Where can Marijuana not be smoked?

SB420 bars marijuana smoking in no smoking zones, within 1000 feet of a school or youth center except in private residences; on school buses, in a motor vehicle that is being operated, or while operating a boat.

Patients are advised to be discreet or consume oral preparations in public.

Can patients be drug tested at work?

The California Supreme Court has ruled that employers have a right to drug test and fire patients who test positive for marijuana, regardless of their medical use (Ross v RagingWire, 2008). Some employers will excuse patients if they present a valid 215 recommendation. Others won’t. Marijuana use is never permitted in jobs with federal drug testing regulations, such as the transportation industry.
