Spokane Valley City Council April 7, 2020
Under City Code, the City Manager has the authority to negotiate for and purchase real property on behalf of the City with approval of Council. By resolution in 2008, Council granted some authority to acquire real property, but the resolution proved to be unclear resulting in Council having to approve minor items such as stormwater and access easements that should and could be handled by the City Manager’s office. Resolution 20-006 as written clarifies the intent of the City Code in the matter and limit the acquisition authority to $50,000 without Council approval. Motion to approve Resolution 20-006 passed unanimously. Council over the past few meetings has been discussing acquisition of land from Washington State Department of Transportation (WSDOT) to be added to the City’s inventory of developable parkland. That property is located just east of Flora Road, south of the Union Pacific tracks and north of the Spokane River. It encompasses approximately 45.73 acres appraised at $2,091,600. As Council considered the motion to purchase the property, it became apparent that under the City’s uncertain current financial circumstances Council was not inclined to commit to the purchase, but would consider continuing the discussion after the coronavirus threat had passed and the City’s financial condition was more certain. Council reached consensus to revisit that matter in 60 days. However, the opportunity to apply for a grant from the Washington Recreation Conservation Office (RCO) to 1) Assist in the development Balfour Park (possible $500,000) and 2) Assistance with the purchase of the Flora/WSDOT property (possible $1,000,000). The application for the RCO grant(s) does not obligate the City to complete the purchase of the Flora/WSDOT property if financial conditions do not warrant, but a resolution of intent is required. The motion to approve Resolution 20-007 authorizing application for the RCO grant was withdrawn pending more information regarding the wisdom of submitting two possibly competing grant applications. The US Department of Transportation (USDOT) issued a call for projects on February 18th for the BUILD (Better Utilizing Investments to Leverage Development) discretionary grant program. Projects are evaluated on safety, state of good repair, economic competitiveness, environmental sustainability, quality of life, innovation and partnership. BUILD applications are due May 18th. If awarded the funding must be obligated by September 30, 2022. The City’s interest in a BUILD grant would lie with the Pines/BNSF Rail Crossing, but there is not a strong likelihood that a BUILD grant would be awarded for it as a stand-alone project at this time. Another option is to not submit a BUILD application but support the County’s Bigelow Gulch individual application. No consensus was reached. The matter will be considered after additional discussion with the County takes place. Recently a councilmember was approached by a small businessman asking if the City might consider waiving the gambling taxes on punchboards and pull tabs for the first two quarters in 2020 due to the economic hardship being experienced by those small business who rely heavily on those revenues. In 2019, the City collected $76,573 from punchboards and pull tabs. The resultant loss of revenue would be approximately $19,000 for one quarter. Under current closures and reduced hours of operation, that figure promises to be much lower. Gaming revenue in 2019 from individual sources was: Punchboards and pull tabs, $67,000; Bingo and Raffles, 1,000; Amusement games, $13,000; and $285,000 from Card Games. Council directed staff to explore the impact of possibly deferring payment of those taxes until at least after September. Council further discussed the impending reduction in Lodging Tax funds caused by the Governor’s “Stay Home, Stay Healthy” proclamation made on March 24th. Oktoberfest has already announced it would not occur in 2020. Others might follow. Staff will contact the nine grant applicants to ascertain if their plans for the use of the allocated grant money will be carried out. With that information, Council will once again discuss options for equitably apportioning Lodging Tax funds. In compliance with the Governor’s “Stay Home, Stay Healthy” edict, City Hall will remain closed except by appointment through May 4th. Things are quite different in my life, as it is for most others. Not fishing and being able to report on what I learn is basically what I do, so I am doing what I can to keep you engaged in some way with fishing. I hope you appreciate my efforts. Also, the travel ban has me doing all my Commission meeting via Skype and Zoom. It’s awkward but we are getting things done. What I miss is the interaction with fellow commissioners and staff and even more important the ability to receive public testimony in person. I want to remind everyone that there are many ways to communicate with the commissioners and department staff. Just because we are not traveling to your area to hear from you in person, it is important that we hear from you on the various issues we are addressing. Like everyone else I am trying to fill my time being productive in one way or another. I have my boat already loaded with walleye gear and the batteries are on trickle charge. So, for now I am going to attack my garage and try to clean up the mess I have created out there. I tend to grab what I need and then throw it somewhere when I get back and grab what I need for the next trip. It gets to be a real jumble. The photo in this week’s column is of a small corner of my bench and cupboard. What a mess! My wife is convinced that I won’t need to buy any fishing gear this year. I will find enough stuff that I forgot I had to get me through the season. My brother-in-law gave me some cool storage bins that are still empty. These will really help. I will also start going through my tackle boxes and cleaning them out as well. I have some leaders to tie, and I also need to put my walleye leaders in order and even my kokanee leaders. I have some good storage systems for them and once I have them all loaded up I am good to go for a long period of time. I will let you know what I use and see if they may help you, too. I am putting the finishing touches on my Spring E-Letter. In this issue, which is number 50, I did a very lengthy article on kokanee fishing on
Lake Chelan. I wrote another on Billy Clapp Lake that talks about the good rainbow, kokanee and walleye fishing that can be had there. I talked about how much I like using Kokabow Fishing Tackle on Lake Chelan, and it occurred to me that since I am talking about getting tackle organized I should mention the really cool storage bags I have for my blades. These are made by Mauk Fishing
Stuff. I have known the owner Mike for quite a while and met him at one of the Brewster Salmon Derbies years ago. He was making clear plastic and Velcro items that would hold Super Baits then, and now has expanded his line to include a wide variety of stuff that works great for keeping your tackle in order. The one I use for my Kokabow blades can also be used for other kinds of kokanee or trout blades. It is made of heavy-duty, clear plastic and nylon and is stitched together to hold 20 of the large blades. It all folds up and closes with Velcro so it is very compact. It’s perfect for this type of gear. I have that pretty much wrapped up my next E-Letter and it is ready for final editing. It is a monster, with lots of detail in this one. time it’s sent out. You can unsubscribe at any time. With time on my hands to get my tackle organized, I wanted to share with you the device I use for my walleye leaders. They are pretty simple, and there are a couple of companies that make them. The idea is that you anchor the leader by its end, and I usually have a swivel on the end of my leaders, and then wind them on the “tube”. Each tube holds 12 to 15 leaders. I have five of them that all fit in the top of my tackle box. Everything from naked Slow Death Hooks to spinners all go on the tubes. See the photo on my Facebook Page, too. Here is another installment in my tackle organizing series. This time I am showing what I use to store my bottom bouncer weights. It is a very handy, Velcro-closing bag, that holds a ton of these weights on wires. I have bottom bouncer weights from 1/8th ounce to 4 ounces in this bag. This was a gift from my fishing buddy and guide Brian Neilson of Moses Lake, and between the two of us it has years of use and will get many more. If you look at the photo on my Facebook Page, along with this storage bag I also show some measuring tapes and a small, plastic storage box. I am constantly frustrated by hearing reports of fish of a certain size being caught. Then, when I get these same fish, Lake Chelan kokanee for example, they are always an inch or two shorter. I don’t keep a scale in the boat, but I use these tapes to measure fish and leaders and are in every tackle box I put in the boat. In the small storage box at the bottom I have a variety of swivels, plug snaps, slider rigs, rubber beads and clippers. It’s always in the boat for tying what I need. Well, I hope these storage methods give you some ideas about how to keep your gear separated and in order. In addition to getting things organized I will be going through my tackle and replacing old line on reels, getting them lubricated and get them on the appropriate rods. I will have some more tips and tricks for you next week.

It is interesting to watch the ebb and flow of real estate cycles through the years as well as watching the tug-of-war between buyers and sellers. We often talk about whether it is a buyer’s market or a seller’s market and try to determine which it is. The impression is that during a buyer’s market the buyers seem to have more power and during a seller’s market the reverse is likely. Lenders seem to play an important role in the power game as well, since they control the money, so most buyers have to play by their rules. Even though a buyer’s market seems to create an atmosphere where the buyers have more leverage, I believe that it is sellers who have the most power in a transaction. After all, they can simply ignore or reject any offer even if it is above the offering price. In one example a seller alerted the listing agent that they had been having problems with a neighbor who had bullied them. That adjoining neighbor stood to gain the advantage of controlling and protecting their good view if they purchased this property. The seller let everyone know in advance that they would never accept an offer from that neighborhood bully. The seller was well within his rights unless they were refusing the neighbor’s offer because of racial or other prejudice, which is against the law. When a seller receives an offer they have several choices, accept the offer, counter the terms of the offer, reject the offer or ignore the offer by not responding. When multiple offers come in at the same time or in differing time increments, the seller is not obligated to take them in the order they came, nor are they obligated to deal with one first, making the others wait. The seller is free to do what they want and has the power to accept, reject or counter the offers in any way they wish. They can decide not to sell, or decide to raise the price significantly. In other words, they really have the power since they control the real estate. Of course that power may dwindle depending on the forces at work to motivate them to sell. Buyers often mistakenly think that they are in the driver’s seat when the market takes a dip. That would only be true if the seller can’t wait.
