Born to Ray and Irene Thacker on May 9, 1950 in Spokane Valley. Tom lived his whole life in the Valley. He attended Central Valley schools. He was proud to be a member of his dad’s 1968 championship basketball team. Tom also graduated from EWU with a degree in philosophy. Dad always teased him about communing with the apples. Tom was the last remaining apple orchardist in the Valley. He loved his apple and raspberry customers and the camaraderie. Tom loved his family, holiday get togethers, attending basketball games, bike riding during the summer, Scrabble with his sisters, and making chocolate chip cookies for the grand and great-grandchildren. He was preceded in death by his parents Raymond and Irene Thacker. He is survived by his siblings Linda (Jim) Strom, Honey Conlon, Jim (Jan) Thacker, JoAnne (Doug) Poulson, Mike Thacker, and nieces and nephews who loved him very much. Tom was buried on April 3, 2020 in a graveside service at St. Joseph’s Cemetery. The family is planning a Mass at St. Mary’s Catholic Church in Spokane Valley on May 9th. If that doesn’t happen, we will go later in the summer.

Spokane Valley City Council April 14, 2020
In its first item of business, Council suspended the rules to move past the First Reading of Proposed Ordinance 20005 to directly adopting it. The Ordinance calls for vacating approximately 380 feet of 12th Avenue, 13th Avenue, the alley between 12th and 13th Avenues and approximately 500 feet of Chronicle Road, encompassing 1.58 acres. The requested Right of Way vacation is immediately west of Carnahan Road, south of 8th Avenue and north of 14th Avenue. The request is made to allow development of the entire property without hindrance of ROW requirements. City code requires reimbursement to the City, which in this case amounts to $34,744.84 under the City’s formula. The motion to suspend the rules to proceed to passage without a Second Reading was unanimously approved. At its last meeting, Council considered a request from a number of small businesses asking if the City might consider waiving the gambling taxes on punchboards and pull tabs for the first two quarters in 2020 due to the economic hardship being experienced by those small businesses that rely heavily on those revenues. In 2019, the City collected $76,573 from punchboards and pull tabs. The resultant loss of revenue would be approximately $19,000 for one quarter. The matter was brought forward at this meeting in the form of a motion to suspend the rules and approve Ordinance 20-006 deferring remittance of gambling taxes on all gaming establishments for the first and second quarters of 2020 until September 30th for the first quarter and November 30th for the second quarter. Once again Council suspended its rules, passing the motion unanimously without a Second Reading. The US Department of Transportation (USDOT) issued a call for projects on February 18th for the BUILD (Better Utilizing Investments to Leverage Development) discretionary grant program. BUILD applications are due May 18th. If awarded, the funding must be obligated by September 30, 2022. The City’s interest in a BUILD grant would lie with the Pines/BNSF Rail Crossing, but there is not a strong likelihood that a BUILD grant would be awarded for it as a stand-alone project at this time. Council moved to proceed with the grant application to keep the Pines project visible to those making the grant decisions. Motion passed unanimously. Spokane Valley Meals on Wheels, which feeds so many of our aged and infirm in the Valley, has been financially pressed by the events of these last few weeks. A request for an $8,000 grant to augment their available funding was approved unanimously by Council. Spokane County has a Hazard Mitigation Plan for compliance with the federal Disaster Mitigation Act of 2000. Spokane Valley approved its participation in the original plan in 2007, and an update to that plan in 2014. The plan requires an update every five years, and the City is past the date for renewal. In order to qualify for federal assistance under the Disaster Mitigation Act, the City must officially adopt the Plan. Council reached consensus to place a resolution on a future agenda for consideration. From the time of its construction, CenterPlace’s roof has been beset with problems. Lately a succession of leaks has reached the point of requiring buckets placed at various locations to catch the water. At a budget workshop in 2019, Council, after discussing the problem, directed staff to hire Architects West to provide consulting and design for replacing the roof. The resulting plan was to replace the existing tile roof with a metal roof for an estimated $532,000, which did not include contingencies for replacing the damaged infrastructure supporting the existing tile roof. The three initial bids were rejected. The project design was updated, resulting in new estimates of $935,000 for a metal roof and $760,000 for an asphalt composition roof. These revised prices were based upon the mid-range of the rejected bid prices. The metal roof offers a 50+ year life. The composition roof offers 15-30 years but can be more inexpensively replaced when that becomes necessary. Considering these uncertain financial times, Council reached consensus on the lower cost solution recognizing that the current state of repair/replacement presents a problem that cannot be further delayed. An opportunity to place electric automobile recharging stations at City Hall and CenterPlace has been offered via a grant from the State Department of Commerce. That grant would supply 50% of the cost, with the remaining 50% to be covered by Avista Corporation. Council reached consensus to direct staff to coordinate with Spokane Regional Transportation Commission and Avista on submission of the regional grant application. Please note: 1. City Hall remains closed except by appointment under the Governor’s ‘Stay Home, Stay Healthy’ order. 2. Next week’s City Council meeting (Tuesday, 4/21) is cancelled.

This month just can’t pass fast enough. Hopefully, each day brings us closer to a time when we can get back to “normalcy”, and we can get back outdoors and fishing. Nothing is going to change prior to May 4th, and it can’t get here soon enough. For those who aren’t aware, the annual North of Falcon meetings have been completed. This is when the salmon seasons are set, after lengthy reviews of the forecasts for ocean abundancies and arriving at agreements with Washington’s many co-managing tribes on fisheries in Puget Sound and the coast. Tough decisions are made in this process, particularly in recent years as ocean conditions have depleted our salmon stocks. Here is the word for the WDFW on our projected seasons for the coming year: Continued low returns of some key Chinook salmon stocks are expected to limit numerous Washington salmon fisheries in the upcoming season. The state’s 2020-21 salmon fishing seasons, developed by the Washington Department of Fish and Wildlife (WDFW) and treaty tribal co-managers, were tentatively set today during the Pacific Fishery Management Council’s (PFMC) meeting, which was held via webinar due to concerns related to the ongoing COVID-19 pandemic. “These seasons were determined with the goal of meeting conservation objectives while offering opportunities whenever possible, but we had some tough decisions to make this year,” said WDFW Director Kelly Susewind. “We appreciate the hard work of co-managers and everyone else who sat through long teleconferences and webinars to determine these seasons.” “This was another difficult year with so many depressed stocks as a result of lost and damaged habitat,” said Lorraine Loomis, Chair of the Northwest Indian Fisheries Commission. “I am especially encouraged by efforts this year to include habitat recovery in fisheries planning. Salmon continue to decline because their habitat is being lost faster than it can be restored and protected. Working together to change that trend is the most important thing we can do for salmon recovery.” Season recommendations now move forward for approval by the National Marine Fisheries Service and final rulemaking, including additional opportunity for public comment and consideration of those comments. Puget SounD Low returns of Stillaguamish and midHood Canal Chinook, as well as Snohom-
ish coho limited a number of Puget Sound fisheries in 2019, and created even greater constraints in 2020. That includes closing fishing for winter Chinook in East Juan De Fuca Strait (Marine Area 6), the San Juan Islands (Marine Area 7), Deception Pass and Port Gardner (areas 8-1 and 8-2), Admiralty Inlet (Marine Area 9), Tacoma-Vashon Island (Marine Area 11) and Hood Canal (Marine Area 12), with some exceptions for Chinook
non-retention in Hood Canal in November and December. Summer seasons in Deception Pass and Port Gardner are also closed to protect coho. Susewind said the department recognizes that many of these fisheries have seen continued declines in opportunity in recent years. “This is never the outcome we hope for, but until these stocks rebound, this is an unfortunate reality,” Susewind said. “We continue working alongside the public and tribal, state, and federal partners to address all the factors impacting these critical runs.” This summer, Chinook fisheries are expected to be largely similar to last year, with most Puget Sound marine areas opening for Chinook retention beginning in July or August. Summer Chinook fisheries are expected to begin July 1 in marine areas 5, 6, 7, and 11. ColuMBia RiveR The summer salmon fishery will again be closed to summer Chinook retention (including jacks), though stronger forecasts allow for sockeye retention in 2020, a change from last year. That fishery will need to be closely monitored in-season if returns come in lower than expected, said Kyle Adicks, salmon fisheries policy lead for WDFW. Fall Chinook fisheries will be open under various regulations. Waters from Buoy 10 upstream to the Puget Island will be open Aug. 16-27 for Chinook, and will remain open for coho afterwards. Most of the waters upstream will open Aug. 1, but War-

rior Rock to Bonneville Dam will open Fri., Sat., and Sun. from Aug. 7 through Sept. 6. Steelhead fisheries in the Columbia and Snake rivers this season will again be very limited and additional protective measures will be in place due to continued low returns of steelhead. WaShington’S oCean WateRS Initial ocean fisheries reflect a reduced coho quota due to significantly lower projected returns in 2020. All four of Washington’s marine areas are scheduled to open June 20 for a Chinookonly fishery, then transition to a Chinook and coho fishery beginning June 29. Daily limits and days of the week open to salmon fishing vary between areas. MoRe inFoRMation COVID-19 remains a factor going into the upcoming summer and fall fishing seasons, with the potential to continue impacting fisheries as the year continues, said WDFW Director Susewind. Many of the conversations during this week’s PFMC meeting included consideration of ongoing coronavirus impacts. “The coronavirus remains the biggest unknown as we move ahead in the 2020 and 2021 fishing seasons,” Susewind said. As with every aspect of life these days, we’ll have to be flexible to respond to any public health concerns.” Additional information about this year’s sport salmon fisheries and the North of Falcon process can be found on WDFW’s website at https://wdfw.wa.gov/nof. For information on tribal fisheries, contact the Northwest Indian Fisheries Commission (http://nwifc.org). What does all of this mean to us here in Central Washington? Well, there is some good news—maybe. If the summer run returns are as good or nearly as good as last year, we should be able to fish for summer runs as we did last year. At that time there were a few areas on the upper Columbia opened. They were off the mouth of the Entiat River, at Chelan Falls and in the Brewster Pool. Let’s keep our fingers crossed. Also, it appears that we could have a sockeye fishery, too. Not just on the main stem Columbia River but at Lake Wenatchee as well. The photo in this week’s column is what the Brewster Pool can look like when the sockeye fishery is going on. I also wanted to mention that according to the department folks here in Region 2, fish plants are being made pretty much on schedule in anticipation of the eventual opening of our lowland lakes to fishing. Stay safe. The less we travel the sooner we will be outdoors again.

Residential Construction Should Be Considered an Essential Activity in Washington
We are very thankful to Governor Inslee and his staff for providing invaluable leadership during this unprecedented time. We appreciate the challenges he has taken on to make difficult and quick decisions to ensure our safety. Be that as it may, the current situation with the COVID-19 pandemic and the Governor’s “Stay at Home” order has caused many businesses to have a significant financial and progressional setback. Residential Construction has taken a large hit due to it being considered a non-essential activity. Given this challenge, the leadership of the Spokane Home Builders Association has asked the Governor to reconsider his policy stating that “construction is not considered an essential activity” and therefore not authorized to continue working under the Stay Home, Stay Healthy Proclamation (20-25). Our members have always been dedicated to continuing their education when it comes to safety on the jobsite, and they will take any newly learned precautions to keep their employees and others safe during this time. They are taking this crisis seriously and understand that proper measures must be taken in regards to social distancing. Most of our members are small businesses and the impact of them not being able to continue working at the moment is significant, but we are also worried about the families that are caught in this situation being left to wonder if they will have a home. Many families, when purchasing new construction, sell their current home at the same time under the impression that their new home will be done in time. With residential construction not being able to continue these families are now having to scramble and find somewhere to stay because they won’t be able to remain in their previous home and their new construction will not be done. We are respectfully asking the Governor to reconsider his stance and designate home construction as an essential activity. By following proper distancing and sanitation protocols on our jobsites the risk of spreading the COVID-19 virus is significantly less than many other essential businesses. Doing so will allow our members to finish the homes under construction and continue working to address the severe housing shortages facing our community.

What stays With the house?
During a viewing of a vacant house I noticed that most of the light bulbs were missing along with many other amenities such as appliances. The seller, upon vacating the premises had stripped the home of anything that wasn’t permanently connected. Modern Purchase and Sale Agreements specifically state which of those items will remain with the property upon sale. Items such as stove/ range, refrigerator, washer, dryer, dishwasher, hot tub, fireplace insert, wood stove, satellite dish, security system, attached televisions or speakers are on a checklist that can be readily negotiated by just checking a box. While it is customary in this market for the range, dishwasher and refrigerator to remain, that is often negotiated since mom may have recently purchased a new stainless refrigerator (that she is in love with) and wants to take it to the next place. The boiler plate language of the same standard state-wide Purchase Agreement says that “Any of the following items are included in the sale; wall to wall carpeting, built in appliances, curtains drapes and all other window treatments; window and door screens; awnings; storm doors and windows; installed television antennas; ventilating, air conditioning and heating fixtures; trash compactor; fireplace doors, gas logs and gas log lighters, irrigation fixtures; electric garage door openers; water heaters; installed electrical fixtures; lighting fixtures (light bulbs); shrubs, plants and trees planted in the ground; and other fixtures; and all associated operating remote controls.” An additional addendum lists farm equipment such as fencing, portable panels, water troughs, feeders, chutes etc. Many may think this list is silly while others think it obvious. Just remember the reason these items are included (in writing) is that there has been some sort of dispute or lawsuit concerning each and every one. Experience has proven the importance of specifically listing each item! Another addendum deals with items that are often left behind (much to the dismay of the buyer) including garbage, debris or any other personal items left on the property after the actual closing. Some sellers naively think that they can come back later to remove items of value, (which they have forfeited ownership of, if post-closing removal wasn’t negotiated in writing). Buyers should be careful to do a walk-through of the home and property just prior to closing to assure that negotiated items are still on the property and items slated for removal are gone!
