Restrictive Covenants Roseview Estates - Phase 1
Pictou, Nova Scotia
1. Application of Restrictions:
The restrictions herein apply to the lands known as Roseview Estates (referred to as “the said lands”), including the lot described in Schedule “A” attached hereto.
2. Definitions:
a) “Grantor” refers to Roseview Developments Inc. or its authorized agent.
b) “Grantee” refers to the individual, firm, or corporation to whom the said lands are conveyed under this Deed, including their heirs, executors, administrators, successors, or assigns
c) The Grantee agrees that only one dwelling house may be erected or remain on the abovementioned lot
3. Permitted Use:
The lands and structures may not be used for any retail or commercial purposes. The Grantee shall ensure that the lands and structures are used in a manner that does not interfere with the privacy and enjoyment of other properties within the development.
4. Minimum Dwelling Size:
a) No dwelling shall be erected on the lot with a ground floor area less than 1,200 square feet for a single -story dwelling or less than 1,600 square feet for a multi -story dwelling without the written consent of the Grantor.
b) The area measurement will be taken as the outside measurements of the main walls, excluding the garage, porch, veranda , sunroom, attic, and unfinished basement.
5. Approval of Plans:
a) No building, fence, or other structures shall be erected unless plans, specifications, dimensions, and site plans (including setbacks) have been submitted to and approved in writing by the Grantor. Approval shall not be unreasonably withheld.
b) All structures must conform to the approved plans, specifications, and site plans.
6. Building Elevations & Driveways:
a) The Grantee must submit plans showing elevations of all buildings and the location of any driveway for written approval by the Grantor.
b) No construction may begin without obtaining this written approval.
7. Chimneys:
Exterior chimneys must be constructed from brick, stone, or other masonry products. Alternatively, metal or manufactured chimneys must be enclosed with materials matching the dwelling’s siding.
8. Additions:
No additions to any buildings shall be erected without submitting plans and obtaining written approval from the Grantor.
9. Use of Buildings:
a) The lot or any buildings on it shall not be used for any profession, trade, employment, service, manufacture, or business, nor as a school, hospital, or other place of public resort, except for private residential purposes.
b) Activities that cause a nuisance to neighbours are prohibited.
10. Permitted Structures:
a) Only a detached private family dwelling with or without a garage may be erected on the lot.
b) Garages, whether attached or detached, must be designed and finished to match the style and materials of the main dwelling.
c) Detached garages must be situated behind the front line of the dwelling and may not exceed 864 square feet.
d) One storage shed of no more than 180 square feet is allowed, provided it matches the design and materials of the main dwelling and is situated at least 100 feet from the front property line, out of view from the street and adjacent properties.
11. Setbacks:
No dwelling shall be erected closer than 40 feet from the front street line.
12. Fencing:
a) Fences between the home’s front line and the street must not exceed 2.5 feet in height and must be constructed of masonry, iron, or wood.
b) Side and rear yard fences must be under 5 feet in height and can be made of ornamental wire, iron, or wood. Side and rear yard wooden fences can be either open or closed construction.
c) Landscaping screens may be erected with written approval from the Grantor.
13. Tree Removal:
No living tree greater than 5 inches in diameter at the base may be cut or removed from the lands, except within areas to be excavated for building, without an overall site development and landscaping plan.
14. Landscaping:
At a minimum, landscaping must include grass on all disturbed areas, maintained to normal lawn standards.
15. Construction Timeline:
a) Exterior construction must be completed within 12 months of commencement.
b) Landscaping must be completed within 18 months from the start of construction. The construction area must be maintained to normal residential standards.
16. Signage:
No signs, billboards, notices, or other advertising, except for ordinary signs offering the lot or buildings for sale or rent, shall be placed on the property without the Grantor’s consent.
17. Mobile Homes:
No trailer, mobile home, or Mini home may be parked or placed on the lot if it is to be used as a residence.
18. Waste Material:
No building waste or other materials shall be dumped or stored on the land, except for clean earth used in levelling in connection with construction.
19. Animals:
No livestock or animals other than household pets are permitted. Breeding pets for sale is prohibited.
20. Vehicle Storage:
No boat, motor vehicle, trailer, or camper may be kept between the dwelling and the street for more than two weeks.
21. Trucks:
No truck over one ton shall be kept on the property.
22. Survey Stakes:
If any survey stakes are removed or damaged by the Grantee or their agents, they must be replaced at the Grantee’s expense.
23. Vehicle Repairs:
No major vehicle, boat, or trailer repairs may be conducted on the property, except within an enclosed garage.
24. Garbage Storage:
All garbage must be stored in metal or plastic cans or plastic garbage bags.
25. Subdivision:
The lands shall not be subdivided without the Grantor’s express written approval. Subdividing to allow an additional home is not permitted.
26. Utility Easements:
The Grantee consents to the installation, operation, maintenance, and repair of utilities on the lot as required, including access for such work. The Grantee agrees to allow necessary clearing and control of trees, growth, or other obstructions near utilit y easements.
27. Municipal Services:
The Grantee must not damage any municipal services installed by or on behalf of the Grantor. If damage occurs, the Grantor may repair it at the Grantee’s expense.
28. Modification of Restrictions:
The Grantor may waive, alter, or modify these restrictions for any lot in Roseview Estates without notice to other lot owners, if the Grantor retains ownership of any land in the subdivision or adjacent areas.
29. Covenant Transfer:
The Grantee agrees to obtain a covenant from any subsequent grantee or transferee to observe these restrictions, including this clause.
