SAN CLEMENTE Residents are asked to continue using water wisely and efficiently, especially from June 8 through June 15 while the Metropolitan Water District of Southern California (Metropolitan) shuts down the Allen-McColloch Pipeline (AMP Pipeline) to repair several sections of this major supply pipeline. Officials from Metropolitan and the Municipal Water District of Orange County (MWDOC) made the precautionary water-saving request on May 27 as Metropolitan prepares for the shutdown of the AMP pipeline, which is a regional water line serving communities from Yorba Linda south to San Clemente. The 26-mile AMP Pipeline extends from the water district’s Robert B. Diemer Water Treatment Plant in Yorba Linda to the El Toro Reservoir in Lake Forest, typically delivering up to 100 million gallons of water a day in the month of June for Orange County residents.

On behalf of Malinda Traudt—a severely ill 29-year-old San Clemente woman who on May 18 filed a lawsuit alleging that the City of Dana Point’s attempt to shut down the Beach Cities Collective, where her mother obtains her medical marijuana, is unconstitutional— attorney Jeff Schwartz, on May 24, requested that the court speed up proceedings saying that his client may not live long enough to see the case through. Schwartz’s request was accompanied by a letter from Traudt’s physician stating that she could not be medically certain that her patient will survive longer than six months. Dana Point City Attorney Patrick Munoz, the same day, filed an opposition asking that Schwartz’s request be denied. Superior Court Judge Tam Nomoto Schumann granted Schwartz’s request to expedite proceedings.

A trial date was set by Judge Schumann for September 20.

…Open Space Deals in the Works?

THE LATEST: Privately held land in Capistrano is among those under final consideration for open-space purchase by the Orange County Transportation Agency, which buys land to mitigate for road projects.

The property is just west of Saddleback Valley Christian School, and key in an effort to create a connective corridor of open space, according to members of the Open Space Committee who discussed the effort during the committee’s June meeting.

Saddleback Valley Christian Schools has agreed to sell the land if the money becomes available, and officials have toured the property. The committee has also secured “will sell” letters from property owners along Trabuco Creek on the east side of the freeway.

Hunt, the one-time San Clemente Chief of Police Services who was forced to retire from the sheriff’s department after challenging then-sheriff Michael Carona in an election. Hutchens was appointed to replace Carona in 2008 when he resigned to fight federal corruption charges.

Hutchens received 144,920 votes, or 51.9 percent of the ballots cast. Hunt received 78,276, or 28 percent, while Craig Hunter got 56,036, or 20.1 percent. About 316,000 of Orange County’s 1.6 million voters cast a ballot, for a turnout of just under 20 percent.

THE LATEST: Motorists can now get traffic information, even how long it will take to travel point-to-point, just by dialing 5-1-1 from any phone. The automated system managed by transportation officials in Los Angeles, Orange and Ventura counties, can tell motorists what the traffic is like at hot spots, what travel times will be or public transit information, said Joel Zlotnik, a spokesman for the Orange County Transportation Agency.

The system’s corresponding website, www.go511.com, also works as a trip planner and integrates public transportation options across counties, Zlotnik said. For example, if you wanted to take public transportation from Capistrano to Los Angeles, the system could tell you where to catch a bus to the Capistrano train station, which train to take to LA, then what bus or light-rail system you’d need to get to your final destination.

The website also has vanpool and carpool information and pairing.

The OCTA will pay about $59,000 a year to maintain the system, which is part of a national network. The funding comes from a $1 transportation-services charge paid with vehicle registrations.

…Fire Authority Fees?

THE LATEST: The Orange County Fire Authority, which serves San Juan Capistrano, delayed passing its budget this month after board members questioned a plan to raise fees to cover raises for non-firefighting employees.

The proposal called for a 3.9 percent increase in things such as fire inspections, the fees charged when paramedics stand by at special events, ambulance services, even public-records requests.

The authority is governed by City Council members from cities served by the authority, including Mark Nielsen in San Juan, and Orange County Supervisor Pat Bates. The proposed increases angered the development community, as well as some elected officials.

“During these difficult economic times, I do not feel a fee increase is appropriate or justified,” Bates said in her newsletter. “I believe responsible government should not balance its budget on the backs of taxpayers.” Nielsen agreed it was not the time to raise fees.

The increase was to have covered a 3.86 percent increase in salaries and benefits mandated by earlier contracts approved in 2006, according to the staff report.

WHAT’S NEXT: Fire Authority staffers will scour the budget for ways to cover the hikes without fee increases. The board next meets June 24.

man faces trial in Orange County Superior Court for stabbing and murdering an acquaintance in a park after an argument over who was a better singer.

Julian Sermano, 58, San Juan Capistrano, is charged with one felony count of murder, one felony count of aggravated assault, and a sentencing enhancement for the personal use of a deadly weapon. If convicted, he faces a maximum sentence of 26 years to life in state prison. Opening statements were expected to begin

Co-defendant Maurico Molina, 34, San Juan Capistrano, pleaded guilty September 4 to one felony count of voluntary manslaughter. He was sentenced to 11 years in prison. Molina is expected to testify in the jury trial.

About 9:30 p.m. on June 6, 2007, Sermano is accused of being in Historic Town Center Park with acquaintances Molina and Blas Gutierrez, 39. The three reportedly drank and sang in the park together.

Sermano is accused of getting into an argument with Gutierrez, who complained about Sermano’s singing and boasted he was a better singer.

Sermano is accused of getting into a fight with Gutierrez, which Molina attempted to break up. Molina began fighting with Gutierrez, pulled out a pocket knife, and stabbed Gutierrez twice.

While Molina and Gutierrez were fighting, Sermano is accused of taking out a knife and attempting to stab the victim, missing and inadvertently stabbing Molina instead. When Molina fell to the ground, Sermano is accused of again turning on Gutierrez and repeatedly stabbing him after chasing him through the park.

Controversial Housing, commercial and equestrian project goes before council on June 15

I

t was one of the first bold strokes by newly elected councilmen Mark Nielsen and Lon Uso: To put together a committee a residents and city officials to work with a developer in an effort to craft a project that would be acceptable to everyone.

That was in 2006, and the test case was the San Juan Meadows project, where an earlier City Council had given virtually timeless approvals to a 440-home development. The property owner, Advanced Real Estate Services, could go ahead with the 440 homes on the 135 acres, but also had purchased 18.7 acres across La Novia from the home site.

A 300-room hotel was already approved for the site on the north side of La Novia, but owners could never get a hotel operator to bite.

The council’s reasoning was a combined, coordinated project would be better overall, and including residents in the process early would help ensure all views were considered. The committee met several times before rolling out the new plan: 94 single-family homes, 90 condominiums, 50 apartments, retail space, commercial space and an equestrian center.

“We’ve been working in good faith for the city,” said Robb Cerruti, a Capistrano resident who is vice president of ARES. “We took their challenge to come up with the better plan. I think we’ve done that.”

But not everyone agrees. The Planning Commission recommended the City Council turn down the plan, saying too many questions about traffic mitigation are left unanswered and the project’s design doesn’t fit into Capistrano’s image.

And residents, most who live off La Novia or San Juan Creek Road, have become vocal critics at meetings and in letters to the editor in Capistrano newspapers.

testimony on the project at its Tuesday, June 15 meeting, although Mayor Lon Uso will be absent, so no decision is expected to be made that night.

Traffic, as usual, is a primary issue raised. But the project, San Juan Meadows on the south and Distritio La Novia on the north, is also unlike any other Capistrano has seen. On the north side, the living units and retail and commercial would be integrated into a mixed-use development. That’s by no means a new concept—homes-over-stores existed on Capistrano’s main street generations ago—but it’s back in vogue in planning and Distritio La Novia is the first to propose it here. And even on the south side, the homes bring a twist: An equestrian center for as many as 750 horses.

Cerruti says that is about the same number of horses on the same amount of acreage as found in the stables that line San Juan Creek on the west side of town. The town allows up 25 horses per acre, he said, and the Meadows proposal only calls for 18 horses per acre.

Still, the number scares some.

“That many horses lined up nose to tail they would create a line 1 mile long and with them comes other problems such as: Feed and manure management, fly’s and odor,” Ira Rosenbaum says in a letter to The Dispatch. “…I hope the City Council will not be blinded by the allure of tax revenues but will agree that this particular development is not right for San Juan but will also continue to look for other development projects that will serve the city.”

Equestrians have been quick to say proper management practices will head off any issues. Manure, Cerruti told about 40 people at a public meeting Wednesday, will be stored in roll-off bins contained in closed garages. They will be hauled off daily, he said.

Cerruti also promised the Meadows project will include trailheads open to the public—equestrians flooded Monday’s Open Space Committee to demand more trailheads that will allow them to trailer in horses to take advantage of the city’s trail system. The Meadows project opens into the south trail system, Cerruti said, adding the overall project is 62 percent open space.

Resident Trevor Dale, however, is one of the residents on the original committee that helped conceive of the new project. Now he’s one of those against it. Active in the battles against Whispering Hills and the proposed housing on the golf course, Dale has read the draft environmental-impact report and attended meetings on the project. Sure, he’s concerned about the proposed traffic count—8,000 trips a day—and the number of horses, as well as plans to draw underground water from the area and cap off a long-closed dump, but he sees the battle more about the rights of residences verses the rights of the property owners. The density might have been reduced, Dale said, but the intensity has been increased.

When folks moved into the area, Dale said, many looked at the zoning for the open areas and what was planned

there. They, he said, made decisions based on the potential for homes and a hotel. Property owners have no right to get zone changes, and Dale thinks the City Council should honor the quality of life for the residents there over granting changes for the property owners.

“Is this really a good deal for San Juan?” Dale said. “Residents don’t see any advantage to this, they don’t support it … they expect the council members they voted into office to respect that…The council does not have to rezone this property.”

How much the project could worth has been computed, Cerruti said. But right now, the property is valued at $5 to $6 million. When the project is finished, he said, the new tax base will be valued at $200 million. On top of that, the retail space is expected to attract high-end retailers such as those identified in the city’s recent Buxton retail-needs study.

That would mean more money for city coffers through sales tax. And even before any of that: The developer would pay $10 million in permit, building and other fees.

Valerie Drey is a realtor who lives off La Novia and also attended the public meetings. She liked the idea of a boutique hotel off La Novia and isn’t thrilled with the plan as it is, but sees some things she likes.

“They need to tweak it, back down on the number of horses and cut down on the density,” she said. “I’m in favor of this being built, but it needs to be tweaked.” CD www.thecapistranodispatch.com

City Hit With $6.7 Million Verdict on Development Delay Scalzo family wants to build 31 homes on Del Obispo

T

he city is weighing its options after an Orange County Superior Court jury on June 1 awarded a longtime family more than $6.7 million over conditions the city imposed on the family’s plan to build houses on its property.

The verdict, in favor of the Scalzo Family Trust, could be especially devastating to the city because it is not covered by insurance and would have to come from the city’s operating funds and reserves. The city’s general fund reserves are about $10 million.

Additionally, the Trust can also seek attorneys’ fees.

In a statement issued after the verdict, the city said “The city continues to believe this jury verdict is not supported either by the law or the facts, and will continue to vigorously oppose it.”

The decision, however, was the culimination of a four-year legal battle between the city and the Scalzo Family Trust, which owns 16.14 acres on Del Obispo Street, across from the Farm-to-Market.

In 2003, the Scalzo Trust attempted to develop 31 homes on the land, calling the proposed development “Belladonna Estates” After 28 months of wrangling with the city concerning the proposed development, in December 2005, the city approved the project, but imposed 121 development conditions, including a condition that the Scalzo Trust dedicate property to the city to widen an existing city public drainage easement, according to a release issued by the

The development proposal was complicated by several issues from the onset. Between the Scalzo property and the development to the north, Sun Ranch, is a drainage area. When the Scalzos began investigating the potential to build on their land, they

he public on Sunday, June 13 is invited to spend a day at the Rancho Mission Viejo Riding Park in San Juan Capistrano, the property purchased with money from the openspace bond.

The city’s free “Family Fun Day” is from noon to 4 p.m. and features games and activities for all ages, including bounce houses, pony rides and a Grand Prix Horse Show at 2 p.m. Community members will be able to take walking tours of the complex and riding facility, which is part of 132 acres at the southwest corner of Ortega Highway and La Pata the city bought in January.

The riding park is renowned for its year-round equestrian events, especially hunter/jumper shows. It is a premier venue for competitive recreation events and other activities in Southern California such as English horse shows, Western horse shows, the annual Rodeo, soccer tournaments, antique car shows, dog shows, and several other youth athletic events.

discovered the property was very wet.

The city ultimately discovered a reservoir at the top of the drainage area was leaking and had to pay $2.9 million.

But Sun Ranch residents and city staffers insisted the drainage channel was a naturally occurring creek and should be protected as a wetlands. On top of that, the slopes to the north side of the channel were slipping, causing damage to homes in Sun Ranch.

Finally, some Sun Ranch property owners had constructed unpermitted encroachments into the channel, which the Scalzos showed was largely unmaintained, overgrown and filled with silt.

It was the battle over the drainage easement that led to the jury’s verdict.

As a condition of approval, the city told the Scalzos to dedicate land to improve the drainage channel and create a maintenance road. The Trust objected to the dedication requirement as there was no nexus between the proposed project and the city’s need to expand its drainage easement, the Trust attorneys argued. The Trust filed suit in March 2006 to challenge several conditions and seek compensation for inverse condemnation.

Chuck Krolikowski and Carol Zaist of the law firm of Newmeyer & Dillion, LLP represented the Scalzo Trust in the action. Longtime Scalzo Trust attorney Marc Goldstein also assisted in the case.

The case went to court in two phases. After a judge ruled that the

city could have imposed mitigation measures short of requiring the dedication of a drainage easement, the city removed the drainage easement condition. The case headed to a jury trial to determine damages after a judge held that a temporary compensable taking of property had occurred during the time the easement dedication condition was in place.

The trust argued that even though the city removed the condition, the damage was done; the Trust could not develop its property for almost three years.

After a two-month bench trial, the court ruled that the dedication condition constituted a temporary taking of the Trust property, and that Trust was entitled to seek compensation for the period in which the dedication condition was in place. The Trust submitted evidence from engineers, a water expert and a real estate appraiser to support the temporary taking claim.

On May 3, the jury phase of the case to determine the amount of compensation owing to the Trust started. Before the jury, the Scalzo Trust presented evidence that the compensation should be set at $6,768,000, as the Trust lost the use and could not develop its property for almost three years. The city claimed that the compensation was either $0 or about $55,000.

Letters to the Community DIFFERENT PARKS FOR DIFFERENT TASTES —Tracie LaMee, San Juan Capistrano I am not sure which residents Carolyn Schneider is speaking of when she talks about San Juan residents not being able to use open space land. All city land is not available for every person to use as they want. She thinks that Oaks/Blenheim should be open to all residents, but to do what? I do not own a horse or ride, but I think keeping the property in its current use fits with the traditions of San Juan. I live by the Sports Park, but have no young children or play soccer or baseball.

So I guess I am denied the usage of this park.

I also have a plot in the community gardens, which was set up through the open space program. Not everyone can use that space. There is a fee and the waiting list is years long. Each park is designed for different pursuits. If you want to do something, go to the park that is intended for that activity. Personally, I would like to have an off-leash dog park, but San Juan does not have one. As for fees, when you sign up for organized sports, you are charged a fee. Part of that fee goes to the city to rent the field for games and practice. That is on top of the taxes you paid to buy it, through the open space initiatives. To each his own

park in SJC. Find the one nearest to you that provides what you want and leave the rest to your neighbors to pursue their own form of happiness.

Not to mention the In-and-Out Burger idea for Del Obispo. Again, it’s all about revenue.

Can I remind you this is not Santa Barbara or other larger cities. This is a rural town where people have come to live here for the rural small town atmosphere.

Good Bone Structure in the Downtown

I

Per Studio One Eleven, the firm that is doing our updated Master Plan of the Downtown, SJC has “good bone structure.” Those words should be music to one’s ears, just as they would be to a woman contemplating a face lift.

LAURA “Good bone structure” means that FREESE San Juan Capistrano’s downtown has an excellent starting point for revitalization. All we need to do is add those important details that make our city “village like”, “pedestrian friendly” and the place that you want it to be—as well as a city that will attract residents and visitors alike.

Wednesday, Thursday and Friday night of this week, Studio One Eleven held workshops for the residents. They actually held their first workshop on May 26 when they received some excellent input from about 70 residents, who have asked for everything from more access streets, to downtown bike lanes, to window boxes to showcase red geraniums. Since I am writing this article on Tuesday evening, I don’t know Page 10 • The Capistrano Dispatch • June 11–23, 2010

what the outcome will be, but I do know that these meetings, called charettes, consist of intensive planning and design sessions held in a collaborative way bringing together members of the community, technical and design professionals, stakeholders and businesses to create a shared vision for San Juan’s downtown. Tonight, Friday, the draft plan will be presented as developed from the prior two days of input.

This is a request that those of you who love the core of SJC and want your opinion heard, please attend tonight’s meeting from 5 to 7 p.m. for the first viewing of the draft plan. It is still only a draft but it is an important first step.

When I ran for City Council a year and a half ago, I ran on a platform to revitalize the downtown and push economic development. I am doing my part. Now you need to do your part, if it is important to you, and provide the designers with your vision of the San Juan Capistrano that you want to be your home.

or the past eight years, Jonathan Volzke has dedicated his life to helping make San Juan Capistrano a better place to live as the founder and editor of The Capistrano Dispatch. Last Friday afternoon, the City of San Juan Capistrano said thank you by honoring Jonathan by adding him to the Wall of Recognition in the Community Center, Norb Garrett along with Shig Kinoshita and Kathy Hooper. Needless to say, all of us here at the Dispatch and sister newspapers San Clemente Times, Dana Point Times and El Despacho congratulate Jonathan as well as Shig and Kathy for receiving this terrific honor.

Community journalism is alive and well thanks in large part to journalists such as Jonathan. Helping make a community stronger through reporting in a local newspaper (and website) is what drives people like Jonathan to put in the late hours and deal with printing deadlines, and it’s truly rewarding when one’s own community recognizes them for their effort.

Arizona Law has Some Merit, Some Flaws

A

gain, in the spirit of facing uncomfortable issues head on, I would like to share with you my thought on the Arizona immigration law. Although I am not as big a fan on how it is written as some of my friends, I strongly believe that Arizona has a LON USO right to put in place laws that it feels are necessary for the welfare of its citizens. Those California legislators who criticize Arizona see the straw in their neighbor’s eye but not the log in their own.

Through their socialistic, anti-business, tax and spend policies, they have taken a state that once had the seventh-largest economy of any country in the world and brought it to near bankruptcy—and therefore have no legal or moral standing to be critical. I would say the same of our federal legislators such as Loretta Sanchez, who insists that this law was passed and promoted by “white supremacists,” since the great majority of Americans support that law.

My biggest problem with the Arizona law is the use of cops to do immigration enforcement. I believe

that it is ultimately flawed because it hampers law enforcement for more serious crimes. This is also the position of most law enforcement agencies in the country.

I propose to you a different solution; we would start by making the use of E-verify a state law (federal would be better). We would then take away all social programs for those not here legally. This would include health services except for life-saving emergency services which would require repatriation as soon as the patient is stable. I would not include education in this for these reasons: Children should never suffer for the sins of the parents, it would cost more in police services to have these kids loose on the streets getting in trouble as unsupervised youth often do, and finally, because without jobs or welfare 90 percent of their families would go home and the burden on school districts would be greatly reduced.

We can have a well managed work program that would allow workers from industries that are booming to enter legally to work for a period of time requiring background checks, drivers’ licenses, insurance, payment of certain income taxes, etc. to protect our

Caltrans, Please Hear Our Plea

he proposed I-5/Ortega interchange is visually quite shocking.

Picture an increase in the Ortega/ Del Obispo roadway width where Jack in the Box is currently located to over 120 feet. This is the equivalent of a ten lane highway! Also imagine all the MARK large mature trees near the bridge or NIELSEN along the southbound I-5 on ramp being removed and replaced with bushes or ground cover.

Now picture a four lane plus median entrance to the Del Taco parking lot at a four-way signalized intersection on Del Obispo. Quite a massive entrance into a single fast food restaurant. Crossing that intersection southbound on Del Obispo you will go from four lanes to two in front of Taco Bell.

The bridge across the I-5 will be a more modern concrete bridge with chain link “suicide” fencing along both sides of the bridge across the full expanse of the freeway.

The width of the bridge will increase from today’s size and with the removal of the mature trees, the starkness of this massive bridge will be quite apparent. Not exactly the kind of entryway one would envision to a rural and historical community.

The original drawings from over a year ago for the Option 3 design that has the single cloverleaf on the southeast side of the interchange probably looked OK with the small concept drawing, but in the real world, folks will be shocked by the visual impact. The city recently appointed an Aesthetics Committee to work with Caltrans to change the design of the “standard Caltrans engineering” to be more reflective of the unique character of this historic city and Mission, which are only a block away from the interchange.

This committee has four city staff, two Planning Commissioners and a Design Review Committee member.

Unfortunately, much of the input from this Aesthetics Committee appears to be falling on deaf ears.

The interchange is estimated to cost over $67 million to build and acquire needed right of way (including the taking of property currently used by two gas stations, Denny’s, Arby’s and Jack in the Box). The construcPage 12 • The Capistrano Dispatch • June 11–23, 2010

tion is expected to begin in October of 2012 and go on for two years, ending by late 2014. While the need to improve the interchange is evident, the extent to which the plans widen and force changes are really quite excessive and unnecessary. For example, the southbound exit ramp has a bridge across the ramp roadway with overhead signs showing turn directions for each lane. Painted arrows on the pavement of each lane is certainly more in keeping with the historic character of San Juan Capistrano, but Caltrans seems insistent upon keeping the overhead signage. Reducing the amount of concrete at the entrance to Del Taco from the proposed 4 lanes plus median would save money and greatly improve the appearance. In fact, the aesthetic team has tried to have Caltrans consider using that entrance to provide a back road to access not only the Del Taco, but also the Carl’s Jr. and McDonalds. Such a road would remove curb cuts from Del Obispo and alleviate one of the major traffic issues with those drive-through restaurants. Again, Caltrans is resistant.

While Caltrans has been willing to work with the team on some issues, the major ones on the bridge and trees and over-engineering of some of the roadway have been shut down. The aesthetics team tried to argue that the bridge should be made to look more historic along with rail treatments more custom to the historic character instead of chain link. Neither of these had positive responses.

While it is clear that the Caltrans staff has limited flexibility to make exceptions to the standard engineering requirements, this location is unique in Orange County and warrants other than the typical treatment when we have the Jewel of the California Missions practically adjacent to this interchange. There will also be negative impacts on the East side, as the current plans will likely take out the row of trees in front of the Forster Mansion along Ortega.

This interchange project will be something that we all must live with for decades to come. Caltrans is understandably only concerned with getting as much traffic on and off the freeway as efficiently as possible.

However the city (and county, including OCTA) should

Yes, I feel sorry for those folks who come here illegally to try to make a better life for their families, but it does not change the fact that they are breaking the law. Stand in line and pay your dues like my parents did and then you can reap the rewards of this great nation. Come here ready to be an American, learn the language and the culture, and sacrifice so that your children can thrive. This does not mean that you must give up your native tongue and culture. It is that blend of fabric that makes this country stronger and better but we need that common thread of language to help us communicate and bridge the gap.

Regarding a proposed retail and office space plan, what about the vacancies of many offices and retail stores already in our little town. Do you really think a new retail center at another location is going to help the retailers in town? Can we really afford all these new proposals? Are we really a misinformed, vocal minority with ridiculous misconceptions? Is the old saying true, “You Can’t Fight City Hall?”

This reminds me of our present administration who are all out for elevated taxes and revenue to run a bankrupted country and not the least bit concerned about what the majority of Americans feel is the best for this country.

It’s politics as usual…

And by the way, even the Swallows have decided they’ve had enough of San Juan Capistrano and have found themselves a new and welcoming home in Chino Hills. Good for them.

be more concerned with the impact it will have on the entryway to this historic community and Orange County’s only mission. We have the chance to enhance the experience for all coming to our community and this historic treasure. A little extra time and effort now can make all the difference in the world. I urge you to look at the current renderings and help us get the attention of our State legislators and county and OCTA representatives to step in and help us direct Caltrans to be more sensitive to preserving the unique character that is threatened by their “standard engineering guidelines” being used to design the I-5 interchange. The difference may mean having an interchange that encourages visitors to actually stop here as opposed to merely using the road as a driveway to and from the freeway.

A full bar, with plenty of stools, is great for a quick meal, or to settle in and have a drink while watching a sporting event on the 13 large flat-screen televisions lining the walls. The adjoining banquet room has a sliding glass wall that can be opened to the patio, which has also been rebuilt, with an outdoor fire pit and views of Capistrano’s open hillsides. The menu offers dishes named after golf terms such as “the par,” or “the eagle.” Some of the popular breakfast items are the French toast and huevos rancheros.

Hamburgers, nachos and chicken Caesar salads are the lunch favorites, served until 8 p.m. daily. A dinner menu is anticipated, along with a later closing time.

The Doctor Is In Dr. John & The Lower 911 to perform at The Coach House

ailing from New Orleans, quintessential blues rolls into The Coach House as legendary Dr. John and The Lower 911 are set to perform June 12. We caught up with Dr. John for thoughts on his upcoming album and performing at one of south county’s most enjoyable venues.

On the heels of your Grammy winning 2009, “City that Care Forgot,” what can we expect on your latest release, “Tribal,” due out August 3? All kinds of funk and hopefully some important messages for the world.

Describe your work with various organizations such as New Orleans Musicians’ Relief Fund and New Orleans Musicians’ Clinic and how your life has been impacted since Hurricane Katrina with them. Are the relief efforts that are still ongoing to this day an integral part of your life and show? Anybody that does anything for the musicians, I find it’s a good thing. To help people, the world would be a better place to live in. I pray somebody will one day come up with an organization for the thousands of people all over the country that can’t come home to New Orleans. And I hope that somebody can fix this oil spill. We try to do what we can do to keep organizations going because of horrible budget cuts.

Will patrons see the ever-popular “Dr. John, the Night Tripper” in full regalia or some other fantastic incarnation?

Well, no. We only play Nite Tripper gigs when we are booked to do that in particular and it’s a lot of work, but we will be doing a special show and giving previews of the new stuff.

What kind of set is in store for will the audience? Will it include the venerable hits like, “N’awlinz Dis Dat or D’udda” or “Such a Night”? We change the show every day, but we’ll try to include at least one.

What is your favorite part about touring, especially at venues like The Coach House that are more intimate with dinner and cocktails as part of the ambiance?

It’s a great thing to play intimate venues. Anything that can bring us closer to the audience is near and dear to our hearts.

KATE ROBERTS: Sustainable Living

Take Back the Tap

A

round the world more than 1 billion people do not have access to clean water. For those of us who have traveled to the developing world, it’s KATE essential to drink bottled ROBERTS water when the local water source is unhealthy.

Luckily, our local water is some of the cleanest in the world. The U.S. Environmental Protection Agency (USEPA) and the California Department of Public Health (CDPH) are the agencies responsible for establishing drinking water quality standards. The city vigilantly safeguards its water supply, and the water delivered to our homes meets or exceeds the standards required by these

regulatory agencies. In some cases, the city goes beyond what is required by testing for unregulated contaminants that may have known health risks. (You can download the latest annual Water Quality Report from the city’s website: http://www.sanjuancapistrano.org/ Index.aspx?page=1197.)

On the other hand, bottled water is far less regulated than tap water. Environmental scientist and author Peter Gleick recently wrote the book, “Bottled and Sold: The Story Behind Our Obsession with Bottled Water,” which includes more than 100 bottled water recalls on everything from mold contamination to algae, bacteria, glass particles and—believe or not—crickets. And in thousands of taste tests held throughout the country, bottled water often actually

tasted worse than the local tap water.

The good news is that our tap water is a fraction of the cost and tastes good too!

According to Annie Leonard on www. storyofbottledwater.org, 500 million bottles every week are sold in the U.S. It takes the same amount of oil and energy to manufacture those bottles as it does to fuel one million cars for an entire year. That doesn’t include the environmental impact of shipping and transporting them. And 80 percent of them end up in landfills, not being recycled. If I told you I had a product to sell you that is inferior, has a hugely negative environmental impact and costs a lot of money, would you buy it?

So what can you do about it? Grab a re-useable bottle and fill ‘er up! Encourage your family members, friends,

schoolmates, and co-workers to do the same. Give re-usable bottles as gifts, or a water pitcher that could be used with groups and in meetings. Ban water bottles at local events you’re involved in, to save money and to promote our highly drinkable tap water. Ask for tap water when dining out. I’m sure you could come up with more ideas. Be part of the solution that is reducing waste and pollution … and saving money too!

JSerra’s Growth Continues Despite Challenging Economy

T

he budget crisis affecting the state’s public schools sadly turned into a recent street side spectacle in south Orange County.

The five-day teacher FRANK strike in the Capistrano TALARICO Unified School District underscores the grave challenges facing the public education system.

And while 2,200 teachers in Capo Unified are dealing with the realities of 10.1 percent pay cut, their public outcry is symbolic of widespread frustration with the fiscal state of California’s public education system.

No one likes to see teachers hoisting picket signs. Unfortunately, the standoff in Capistrano Unified could be a sign of things to come.

Fortunately, JSerra Catholic High School continues to thrive, buffeted from the budgetary storms that are www.thecapistranodispatch.com

ravaging public schools.

Despite a harsh economy, enrollment at JSerra is up 100 students compared to the same time last year. No teachers at

JSerra are in danger of losing their jobs because of the economy. In fact, there’s talk of expanding job benefits.

Bottom line, the quality education provided at JSerra is not being compromised despite the challenges of the economy. In fact, our school, closing in on wrapping up its seventh year, continues to thrive on all fronts, from academics to athletics to the arts.

Starting with the latter, the hills definitely are alive. The JSerra Theater Program recently presented the beloved musical “The Sound of Music” to the delight of families and the community.

Also on the arts front, the JSerra Chamber Choir and Advanced Women’s Ensemble recently traveled to New York City to compete in the invitationonly Elite Performance Series of the Festival at Carnegie Hall during the Festival of Gold Heritage Series.

Turning to recent academics achievements, Junior Chloe Kempf was recognized by the National Merit Scholarship

Corporation (NMSC), having scored over a 201 on the Preliminary SAT/ National Merit Scholarship Qualifying test in 2009. She is among the 50,000 highest-scoring participants from some 1.5 million applicants. Kempf will also be part of our first pre-med magnet program classes, a unique new curriculum geared at training the next generation of medical professionals.

On the athletics front, we continue to make headlines. Our boys soccer team earned our first CIF championship in any sport—and our baseball team was ranked among the county’s best.

Thankfully, for the sake of Capo Unified and public schools everywhere, teachers and district leaders reached agreement and got back to the business of educating our youth. Fortunately, at JSerra, that vital mission remained uninterrupted.

‘Flag on the Hill’ Again Flying Proudly

Zorro Left Mark on Mission San Juan

echelle Lawrence-Adams has taken the Historic Mission to a new level. Not content to be a world-class landmark, nor the JAN oldest religious site in SIEGEL Orange County, the Mission is now officially a museum.

Following on the heels of the traveling exhibit on the Gold Rush, the new exhibit which opened June 1 and can be seen until August 31, 2010, traces the cultural and romantic days of early California through the eyes of Zorro.

“Zorro Unmasked” shows how this cult figure came into being from the pen of Johnston McCulley to the swashbuckling of Douglas Fairbanks on film to the folk hero created by Disney.

McCulley first wrote the “Curse of Capistrano,” as Don Diego was called, as a short story for a pulp magazine in New York in 1919. At the time of the writing, McCulley had never been to California, much less San Juan Capistrano. But the Curse of Capistrano has a nice alliterative lilt to it. In the first chapter of the book Don Diego was named “the curse of Capistrano—curse of the entire highway and the whole Mission chain” by the local soldiers.

McCulley probably did not plan to write more than that first short story about Zorro, but following the Fairbanks movie in 1920, “The Mark of Zorro,” McCulley reissued his story and changed the title to the movie name. He continued to write additional stories about Zorro for the pulp magazine market.

Artifacts that are part of this exhibition are from film and television. They

include costumes, masks, swords, and scripts from the films. From television came the marketing genius of Disney, who used items such as lunchboxes, toys, puzzles, shoes, jewelry and books to promote the TV series. Zorro was one of the first TV programs to market advertising items as promotion for a show.

This exhibit is for everyone. Parents and grandparents can enjoy viewing scenes from the old films which include actors Douglas Fairbanks and Tyrone Power. Parents can also recall their childhood when viewing the Disney paraphernalia. Children will enjoy seeing items from one of the first super heroes and being able to take pictures in the cutouts that makes everyone Zorro.

On Sundays, during the summer, volunteers will help girls make paper flowers in the Spanish tradition, and boys make the mask of Zorro. Activity books which will include coloring pages, and puzzles will also be available.

Information about the life and times of Zorro is well documented on posters that circle the exhibit Catherine Hayes, Museum Conservator and Archivist, has well researched and chronicled the history of Zorro and his place in the lore of San Juan Capistrano.

So, this summer spend a Moment In Time at our Historic Mission and enjoy this very special exhibit on the life and times of California’s own super hero. The Zorro exhibit is free with your entrance fee to the Mission.

flag has been flying on an open space ridgeline above La Novia ever since September11, 2001.

No one knows who hung the original small flag on a rusty fence post.

Over the years it had been maintained, replaced, protected and upgraded by a ‘Flag Team’ of residents who hike the area in the city’s southern open space.

In 2005 Eagle Scout Ryan Pickell installed the first permanent pole as a tribute to the heroes of 9-11. It was visible from several surrounding cities and became a destination point for hikers, equestrians, runners and cyclists (The Flag Team).

The gale-force winds blew down the flagpole on January 19 of this year, but Ryan’s younger brother, Kyle, decided to replace it as his Eagle Scout community service project.

The flag is back up, with solarpowered lights to keep it bright. It was in place for Memorial Day this year, and many hiked there to commemorate. CD

om Lunnen, an original member of the Open Space Committee who played a key role in negotiating some of the effort’s greatest successes, has stepped down from the post because his family moved out of Capistrano.

The Open Space Committee, which was created nearly five years ago, honored Lunnen with a proclamation at its

June 7 meeting.

Tom, with his wife Barbara, raised his kids in Capistrano, coaching sports teams and becoming an active equestrian. A developer by trade, Lunnen also believed passionately in preserving the Open Space that makes San Juan a wonderful place to live. He used his expertise in helping negotiate deals such as the 2008 open-space acquisition of 109 acres for $2.1 million. He also helped untangle a web of easements and entitlements in other deals. NCL Honors Seniors Mother-daughter organization focuses on community service The Capistrano Dispatch

ational Charity League, Inc. (NCL) Capistrano Coast Chapter presented 17 seniors at Laguna Cliffs Marriot Resort and Spa in Dana Point. The young ladies have each completed hundreds of hours of community service in this 7th-through-12th -grade motherdaughter organization.

The Capistrano members are Alexandra Mandala, Amanda Radusovsky, Lily Rhodes, Kelly Skvarna and Kate Weirath.

Mandala served a total of 564.5 philanthropic service hours during her six years in the chapter.

Last year, she spent a lot of her service hours at Ronald McDonald Center, making the families of children receiving care at Mission Hospital more comfortable with home cooked meals and some of the comforts of home. Mandala was also the recipient of the Yellow Rose Bouquet Award for working more than 100 hours for a single charity.

NCL Capistrano Coast Chapter serves 26 local philanthropies in Laguna Niguel, San Juan Capistrano, Dana Point and San Clemente. The philanthropies include Laura’s House, Family Assistance Ministries, Ocean Institute, Boys and Girls Club of San Juan Capistrano, Dana Point and San Juan Capistrano senior centers, Mission

Capistrano Youth Scoring in Competition Marschall in team championships on June 26

an Juan Little League player Kaleb Marschall, 10, is winning his way through the Major League Baseball, Pitch, Hit & Run skills competition sponsored by Aquafina.

The competition is held for all boys and girls ages 7-14 around the country,

giving them a chance to go to the competition national finals held at the 2010 MLB All-Star Game.

Marschall, participating in the 9-10 year-old division, has won the local and sectional levels and will be competing in the team championship on Saturday, June 26 at Angel Stadium. There, he will compete against other finalists in his division for the chance to go to the national finals. CD

Stallions Plan Stampede The Capistrano Dispatch

T

he 2010 football season promises to be an exciting one for San Juan Hills High School. The Stallions have performed well in recent campaigns, and 2010 will mark the first time the Stallions take the field with seniors, as the school will be entering just its fourth year.

To kick off fundraising and generate excitement about the upcoming season, the Stallions are holding a Stampede on June 19. The day includes fitness classes, a scrimmage between the team’s Blue and Gold squads, and finally, a barbecue with a live classic rock band.

The entire day costs $15 per person or $50 for a family of four, with $5 for each additional person.

The day begins at noon with fitness and fun classes taught by professionals, and include a menu that includes Pilates and yoga, basketball camps, fitness classes, a fitness boot camp, a cheer workshop, a speed and agility workshop, dance classes and weighttraining classes. The offerings are for men, women and children.

Those run until 3:45 p.m., then the Blue and Gold squads take the field at 4 p.m. for the Stallions’ first major scrimmage of the year. When that winds down at 6 p.m., a barbecue dinner will be served, and “Two Drink Minimum” will crank out classic rock songs.
