SAN CLEMENTE It may be the city tree, but the coral isn’t getting a free pass in San Clemente. On the suggestion of Mayor Jim Dahl at the council’s last meeting, corals on city property will be inspected for dangerous branches, as the trees have a tendency to break limbs. Coral limbs have recently fallen at the Ole Hanson Beach Club and Casa Romantica, both community gathering spots that draw large numbers of visitors, Dahl said. Additionally, cars were damaged by falling coral limbs at the Dana Point Yacht Club. He wants to ensure the trees, which he says “grow like weeds” are cut way back, and recommended residents have their own corals checked by arborist, too. City officials added the inspections to their “to-do” lists.

DANA POINT An Orange County Superior Court judge issued a temporary restraining order November 19, shutting down the Holistic Health medical marijuana dispensary in Dana Point. The closure order stands pending a December 3 hearing. An earlier injunction against the dispensary—based on zoning violations—was temporarily stayed by the state of California.

City officials are cautiously optimistic that the Court of Appeal won’t intervene this time, since the basis for this injunction is the failure of the dispensary to operate in compliance with the California medical marijuana laws, including for-profit marijuana sales, City Attorney Patrick Munoz said. A sign posted at the entrance to the dispensary reads: “Holistic Health is temporarily closed due to our endless battle against the city of Dana Point…Thank you for your continued support!”

…Money for a Dog Park?

THE LATEST: Capistrano Animal Rescue Effort donated $10,000 to the San Juan Capistrano Open Space Foundation toward construction of the planned dog park on a city-owned, 3/4-acre site north of Camino Capistrano and Junipero Serra.

The property was acquired as part of the Open Space land purchase in the early 1990s and was previously leased

by CARE as the site for a planned rescue center. That project never got off the ground, though, and the city terminated CARE’s lease.

City officials and members of the Open Space Committee suggested the site be used as a dog park. CARE quickly supported the idea and proposed naming the park for local veterinarian, Dr. Joe Cortese, a founding member of CARE who donated thousands of hours to help local pets. He passed away suddenly in November 2008 while on a family trip.

WHAT’S NEXT: The money was donated to the Open Space Foundation, a nonprofit agency with most of the same make-up as the Open Space Committee.

The City Council must decide whether to name the park in Cortese’s honor.

“I am thankful to the federal government for providing money for a system that will enhance safety for our residents in South County,” Fifth District Supervisor Pat Bates, also vice chairman of OCTA, said in a statement. “Rail is a vital piece of the transportation network and I look forward to continuing our work with local cities and residents on ways to improve the system.”

WHAT’S NEXT: Work also is ongoing with the city of San Juan Capistrano to improve safety and operational efficiencies, including a potential passing track. Any side railroad track would be approximately less than two miles between the northern city limits to Trabuco Creek.

…A Curfew Sweep?

THE LATEST: San Juan Capistrano was part of the largest-ever Orange County curfew sweep, conducted November 18 by more than 300 law enforcement officers, netting 51 juveniles in violation of city curfew laws. These curfew sweeps, organized by the Gang Reduction and Intervention Partnership (GRIP), aim to prevent juveniles from being victims of or participants in gang crimes. GRIP works to identify at-risk youth, increase school attendance, and decrease gang activity.

Starting late Thursday and continuing into early Friday morning, officers patrolled Orange County cities and unincorporated areas for children ages 17 and under. Curfews in San Juan Capistrano begin at 11 p.m., and last

until 5 a.m.

The minors found in violation of curfew laws were taken in patrol cars to sheriff’s headquarters and held until their parents arrived to pick them up.

They then all met with counselors and law-enforcement officials.

WHAT’S NEXT: The legal consequences of violating curfew laws could include misdemeanor criminal prosecution with penalties ranging from fines up to six months in jail for the parent or juvenile hall for the child, plus the associated financial costs.

…Child Molester Sentenced?

THE LATEST: An intramural sports coach was sentenced this month to 51 years to life in state prison for molesting three boys, ages 11 to 13, after befriending their families and spending time alone with the victims, and for being in possession of more than 2,000 explicit pornographic images and videos of children.

Cameron Joseph Baca, 29, of San Clemente was found guilty August 5 of nine felony counts of lewd acts on a child under 14, four felony counts of distribution of pornography to a minor, one felony count of attempted lewd acts on a child under 14, and one felony count of possession of child pornography.

Between Jan. 2, 2006, and Dec. 18, 2008, Baca molested three boys between 11 and 13 years old. The defendant met the victims while working as their intramural sports coach for football, lacrosse and basketball in South Orange County.

WHAT’S NEXT: A mother of one of the victims submitted a victim impact statement read at Baca’s sentencing. She

wrote, “I trusted you! I loved you like my own children. But you sir are incapable of knowing what love truly is. Instead you were a predator and we were your prey.”

THE LATEST: Orange County is one of three markets where Cox Communications is launching its “Unbelievably Fair” mobile phone service. The OC joins Omaha Neb. and Hampton Roads, Va. The decision comes, company officials said, after Cox’s market research revealed consumers wanted a more fair approach to wireless and Cox is responding with MoneyBack Minutes. Cox is the first wireless carrier to provide cash back on customers’ bills for unused minutes each month—up to $20 a month—a departure from the industry standard in which consumers lose unused minutes or carry them over month-to-month.

Additionally, Cox Wireless automatically provides customers with free text message Usage Alerts when they approach their maximum number of monthly minutes and messages, the company said. Bundling packages with other Cox services is also available.

WHAT’S NEXT: Cox Wireless will debut with Cox features already integrated into many of the mobile devices, such as the ability to program the home DVR and see TV listings from their mobile device.

Additional features include Voice Mail to Text, which converts voice mail messages to text and delivers them to the Cox Wireless devices.

Take a Bow

Playhouse started by BJ and Tom Scott entering 21st year

I

ts first production was in a rented theater in Laguna Beach. Then came the permanent home, a converted old telephone building, where the threat of eviction was ever-present.

But the Capistrano Center for the Performing Arts has lasted 20 full years and is now entering its 21st.

“I never expected it,” founder BJ Scott said Wednesday, sitting on the couch in the playhouse office. “That was probably one of the things I did wrong. I never had the big picture in my mind or imagined it growing into what it is.”

What the Camino Real Playhouse is today is a $200,000-a-year operation that relies on some 300 volunteers—including actors—to put on seven productions.

Since it opened, some 10,000 patrons have laughed, cried and cheered from the audience of the main stage.

BJ Scott started the non-profit playhouse after she and Tom moved to Capistrano from the Los Angeles area.

She worked as a stage manager at Disneyland for a bit, but decided that wasn’t really theater, and the two had started a community theater earlier in the San Diego area.

BJ Scott has since retired to become a “professional grandmother,” while Tom Scott and Vice President Beverly Blake ensure the shows go on.

The playhouse this season will put on seven productions and the Shakespeare Under the Stars series in Historic Town Center Park. Shakespeare started with BJ Scott staging a performance of A Midsummer Night’s Dream in the grass above Salt Creek Beach. That was in 1990.

The first show in the playhouse’s current home, on El Camino Real just south of Ortega Highway, was a melodrama for the Swallows Parade season. That tradition has continued, with Capistrano resident Gary McCarver writing the scripts. Sometimes they’re westerns, this year they were pirates, but they’re all linked to San Juan Capistrano.

Another popular tradition at the playhouse is the script-writing contest, in which playwrights are invited to submit a 10-minute play. The top seven are produced for the stage, and the audience selects the winner.

The contest regularly draws close to 300 scripts.

“For a while, a man in prison in Kentucky was sending his work in,” BJ Scott said. “They were good, but very dark…violent.”

Outfitting the playhouse has required another sort of stage magic. The city provides the building to the theater group for virtually no rent, but it’s up to Scott and his cast to keep it in good www.thecapistranodispatch.com

They’ve patched leaks in the roof in the rainstorm, managed to expand to the entire building after the city finally got rid of a roomful of junk that included the siding and other remains of an old house.

The audience in the first show sat on some leftover chairs and old train benches from the Depot. Matching chairs came later, and now patrons enjoy padded theater-style seats. As you’d expect dealing with folks so connected to the theater, even the seats have a story: A church in San Clemente was getting new seats, and donating its old seats to another church, in 29 Palms in San Bernardino County.

The churches heard about the playhouse’s seating plight, and donated the chairs from the church in 29 Palms.

The main theater seats about 90—so some chairs from the 29 Palms’ church were left over. They went to a community theater in Westminster.

The front lobby was built by volunteers led by Tom Scott, who handles set-building duties, as was the “Black Box” theater in the back.

In addition to the two stages, the Camino Real Playhouse is also home to the Capistrano Acting Academy for children.

And on top of fund-raising and building sets, Scott also finds some time to take on the occasional role. He’s been involved in theater since he was a child, in church plays, schools plays, wherever he found a spot on stage.

Right now, he’s playing the King in The Lion in Winter, in which King Henry II of England wants the kingdom to remain united after his death, even as his three sons each want to rule it. That is on the second stage, while the main stage is preparing to open Greetings, a comedic holiday show directed by Stephen Gomer.

Even the economy hasn’t kept the curtain from rising.

“When we set this up, BJ and I decided to do it on ticket-sales proceeds instead of relying on donations,” Tom Scott said.

“That’s the model we’ve been following and it is because of that we’re not only existing but thriving right now.”

The non-profit did try to raise money to build a Capistrano Center for the Performing Arts a few years ago and brought in a few dollars. And the playhouse has a stable of steady contributors that help, such as Carole and Jim Schenold, Keston and Colleen Barker and Elvin Klein.

And recently, the Camino Real Playhouse partnered with “Loans4Love,” which allows playhouse patrons, volunteers, students, and actors to indirectly donate money to the playhouse when they take out a new mortgage or refinance their home. When a playhouse member takes out a new loan, through the Loans4Love program a donation of 25 percent of their fees go to benefit the Playhouse.

Loans4Love has similar arrangements with many other local charities,

including the Make-A-Wish Foundation of Orange County and Inland Empire, After-School All-Stars, and even the Boys & Girls Club of Capistrano Valley.

“It’s why we got into this business; to help out charities and give back to the community while trying to bring stability and sanity to the current mortgage market,” said Loans4Love Founder David Ludington.

The deal with the Camino Real Playhouse came together while both organizations were helping another non-profit.

Both were at a charitable event to help fight Alzheimer’s Disease this spring.

“We were in side-by-side booths at the event, we got to talking and decided to work together, too,” Scott said, adding that the playhouse has a long history of helping other non-profits and charities.

He said the playhouse gives so much to other charities—as many as 500 times a year—that a volunteer is assigned solely to that task.

And as the theater enters its 21 year, there’s talk again about its future. The city’s proposed downtown master plan identifies the building as the playhouse and parking lot next to it as the ideal location for a parking structure wrapped in retail shops and offices.

Tom Scott said he isn’t worried.

“If you’re not moving, you’re not growing. If the theater has to move, it will just grow bigger and better,” Scott said.

“The theater is not a building. A theater is the people, the actors and the patrons, who make up the organization. And that organization is here to stay.”

The City Council on November 2 approved the Distrito La Novia/San Juan Meadows project with houses, apartments, retail and office space and up to 500 horses. A referendum was launched the following day, which means the signatures of 2,000 registered voters need to be filed by Thursday, December 3.

But the compromises, in response to residents’ concerns, seems to buffering some of the anger about the project and

raising hope a compromise could be reached to avoid the referendum vote.

At a Chamber of Commerce forum Wednesday morning, Julian told project opponents that his company was prepared to go forward with an already-approved 400-home development on the property. That project would generate more traffic, cause more of a historic dump to be disturbed and also allow horses.

While many residents have questioned why the developer didn’t go

ahead with that long-approved project sooner—leading some to believe it wasn’t viable—ARES Vice President Robb Cerruti, himself a Capistrano resident, told The Dispatch the project had been held up by issues related to underground water and geology.

Those issues had just been resolved, he said, when the city approached ARES and asked for a mixed project that would include retail. That led to the Distrito project, which would return more money to city coffers. CD

ithout a doubt, the Christmas Tree Lighting is my favorite night in town, even setting aside my smirk that the city insists on referring to the event as the “holiday” tree lighting ceremony.

Although the event, on December 4 this year, isn’t that many years old, it’s already filled with great traditions. The line for the homemade tamales at the Blas Aguilar Adobe gets longer every year, but the wait is still worth it. The candlelight procession to the Mission is beautiful and solemn, and the Mission’s $2 entry fee this year seems fair.

From the Mission, I make my way down to Sarducci’s, where owner Tom Bogdanski is always out on the street, giving away free hot chocolate. Most of the downtown shops are open that night, too, and also serving drinks and snacks. Another favorite stop: L’Hirondelle for a cup of soup.

Then I work my way across the railroad tracks to the Historic Los Rios District. The O’Neill Museum and Leck House on the Historical Society grounds will be beautifully decorated and open for guests, too. I was quite honored earlier this year to be elected to the Historical Society Board of Directors. Scott Gates also joined the board.

Across from the O’Neill, of course, is Zoomar’s petting zoo, which is home to the living nativity scene and tractor-pulled hay rides. And all along the way are youth groups and other non-profits selling fun items, painting faces, playing music. The evening goes too fast to enjoy everything going on.

There’s still time, though, to peek in a few downtown shops and get some gift items. I remember when I moved to town almost 20 years ago, I would make a point of doing all of my Christmas (sorry, holiday) shopping in town. Try as I might, that’s just not possible anymore. Back then, we had a Blockbuster and a

But even with those gone, it’s still important to shop in town, and this year I’ll make a point of getting gift certificates to local restaurants and the Regency as well as gifts from Whim and a couple of cute little gift shops across from the theater. Every little bit helps.

Have We Chosen Well?

W ith the 2010 election cycle now complete, we can only wonder if Capistrano Unified will continue to solidify its reputation as a district in constant turmoil or if we have come to the point where we can convert our proverbial swords into ploughshares. It will be a while before we truly know the answer to this question, but the election results and more importantly the actions taken immediately following may very well determine if Capistrano Unified will have hope for the future.

In this last election, voters had the ability to choose between two slates, “Children First” and the “Reform Committee,” each supporting five different candidates with control of the Board of Trustees ultimately hanging in the balance. By now we all know the results; neither side swept the election as most people had expected. Instead, the voters chose candidates not because they were associated with one particular slate, but because of their perceived individual qualifications and ability to perform.

Additionally, voters also wholeheartedly supported Measure H, which converts all future Capistrano Unified elections from the “at large” to “by area” methodology.

This means that, for example, all future San Clementebased candidates no longer need to campaign for votes in far-away Mission Viejo and Rancho Santa Margarita. This affords candidates the opportunity to get to be known

in their own community and at the same time significantly lower the cost of running an effective campaign. More specifically, slates of candidates are less likely in future elections as voters will now have the greater ability to focus on the candidates as individuals.

John Alpay The message could not be clearer; voters are not interested in dueling slates and the political bickering that it brings. Such activities may be appropriate in Washington or Sacramento, but they have no place in South Orange County, at least as it pertains to education. The only real question is whether both sides of these recent political battles hear the message. Once again, San Clemente serves as a barometer with all signs pointing to “Yes.” In this hopeful spirit of reconciliation, soon after the election, my opponent Mike Winsten called to congratulate me on my victory. The tone of the conversation was professional, courteous and, above all else, sincere. Also, Mike graciously offered to be available to me for school district matters as I may need in the future. I am sure there will be some well-intentioned, very engaged and committed members of our proud

district family that will take umbrage with his possible continued involvement in Capistrano Unified. However, we should all bear in mind that regardless of which side we fought on during our recent political battles, we all did so because we believed we were acting in the best interests of the school district and its students.

We should also remember the core mission and purpose of Capistrano Unified is to provide a quality education to the generations that will follow. As any teacher will readily admit, true learning is by no means confined to homework assignments and textbooks. How we conduct ourselves in providing an appropriate learning environment will have a far bigger impact on our youth than we may realize. After all, children who live with hostility will learn to fight, children who live with tolerance will learn to be patient and children who live with fairness will learn to be just.

Within Capistrano Unified, we can all work as a team to focus on providing a quality education for our children.

If this is the ultimate district-wide outcome of our most recent election, then the voters will have chosen well indeed.

Letters to the Community Shame on the Stallions —Joyce Lentz, San Juan Capistrano It is my understanding that San Juan Hills High School is having its graduation at the Bren Center in Irvine. The person in charge of this event has stated that the number of tickets available to each student would be only five. This is not acceptable; many families have relatives coming from out of town for this very important event in these students’ lives.

I have two grandchildren graduating from San Juan Hills and over the past 13 years have donated money to the schools and to the district for such things as sporting events, car lotteries, golf tournaments,

magazine sales and jog-a-thons. I have been involved at Malcolm elementary, Ambuehl Elementary, Marco Middle School, Ladera Middle School. I have sponsored girls softball and cross country and football at San Juan Hills High School. Now I may be deprived of attending one of the most important days of my grandchildren’s lives. The people in charge of this important event should make some changes to the limiting of these tickets.

This school has already been a disappointment to these students who were promised a swimming pool and a football stadium; now they are being deprived of having their family attend their graduation. Shame on San Juan Hills High School and on this school district for allowing this to happen.

Ms. McCormick: We wanted to acknowledge how much we appreciated your personnel attention to our daughter Marisa’s 18th birthday party on September 25, 2010. The staff at San Juan Hills Golf Club was outstanding. Every aspect of the event was meticulously planned and carried out to produce a memorable celebration.

How in the World Did We End Up Here?

M

y name is Mike Johnson. Even though I have been involved with the Political Action Committee that is circulating petitions to bring to a vote the City Council’s General Plan Amendment 1011-02-02 approved on November 2, regarding Distrito La Novia and San Juan Meadows, I am writing to you ONLY as a private citizen. I represent no one other than myself in this letter.

About five years ago, Rick Julian, President of ARES, came to the City Council and asked about the possibility of getting a rezone on the Distrito/La Novia parcels his company owns. They responded with, “no, but include reducing the density of the Meadows (which was zoned for 440 dwelling units) in the equation, and we’ll talk.” So two freshly elected City Council members, Lon Uso and Mark Nielsen, were given the task to negotiate with the developer. That is how this all started.

Residents voiced their displeasure over one component, or another, throughout the last four years, and the city has steadfastly told them “we hear you.” Well, they may have heard us, but they ignored what we were saying. If the City Council had done their job right in the first place, and sought to mitigate these issues, this city wouldn’t be facing this current contest.

Rightly or wrongly, as this referendum gained momentum, it has apparently become a referendum on people’s dissatisfaction with growth and the direction of development in SJC. It also feels like it has become a referendum on City Hall, and the perception of a continuance of “business as usual” style of politics.

Please know that when a PAC submits petitions to the city, after verification from the Registrar of Voters, the City Council will have only two choices: They can either rescind the plan, or put the issue to a public vote.

If this project is built in its current form, residents will get a terribly dense and ill-planned project. That much we know. Evidently, approximately 3,000 to 4,000 residents, who have signed the petitions, agree.

If the city council rescinds the plan, the properties would then revert back to their previous entitlements, which is for 440 dwelling units on The Meadows, institutional use on the La Novia parcel (like a school, church, or hospital), and a 200-room hotel, with an approval for a 100-room extension, on the Distrito parcel. Both the new and old plans have negative ramifications. www.thecapistranodispatch.com

The CITY didn’t want the old plan because it viewed 440 homes and apartments as a “net drain” on the city.

They want revenue generation from the Redevelopment Agency Zone, which half of the Distrito/La Novia project is part of, that would go to helping fund future projects within the Redevelopment Agency. A portion of the money collected would go to the city’s general fund, also.

The PUBLIC didn’t want the old plan due to the ridiculous amounts of traffic it would generate, and the fact that most of the dump would have to be dug up, among many other important reasons.

Lastly, the DEVELOPER didn’t want it, because he would have to pay for an expensive road and extensive grading. Additionally, he hasn’t been able to find a hotelier who wants to put a hotel on the Distrito site, in all of the years he has owned it, so anything being built on the Distrito site is a huge benefit to him.

Regarding the NEW plan, a last-minute meeting was held at City Hall, Friday, November 19. As a result of the citywide support for this referendum, the developer offered some last-minute concessions in hopes of avoiding an election. Too bad this wasn’t offered two months ago.

The developer is now: • Offering to eliminate the large parking structure that so many people objected to. It was going to be a HUGE eyesore, figuratively and literally, and it didn’t belong in SJC, let alone perched on a hill that the entire valley would have to stare at forever.

• Offering to eliminate the 50 apartments, the “mixed use” component of the project, from above the retail stores. This accomplishes two things. First, it lowers the retail buildings from three stories, down to one or two. Secondly, it lowers the density of the overall project by having the affordable housing component off sight.

• Agreeing to have attached garages to the condominiums. Previously, people would have had to park in the parking structure, and walk to their condo. Now, a single woman, for example, can pull into her garage at night, rather than having to walk alone through a parking structure.

• Agreeing to have a park/play area for children that live in the condos. Previously, there was only Astroturf on the fifth story of a parking garage designated as “open space.” (Can you believe that the city actually has the parking structure zoned “Recreational Open Space” on this plan’s site map?)

A major issue that hasn’t been addressed, however,

is the equestrian component. While the previous project was not “entitled” for horses, apparently the zoning, and the formula to calculate the number of horses, is open for interpretation. The problem that many people have with new project is that they feel the city ignored the property rights of the people neighboring this project, in the process. Currently, the city is arbitrarily allowing 500 horses, but is not guaranteeing that that number will not go up to approximately 1,000 horses in the future.

WHY did it take citizens forming a PAC, and circulating petitions and the threat of this project being defeated at the polls to get the developer to make some last minute concessions in order to address some obvious flaws in this project? Why didn’t the city use proper oversight to begin with? A PARKING GARAGE zoned Recreational Open Space? Give me a break!

What will happen next? I really don’t see our City Council rescinding a general plan amendment that they just approved earlier this month. Interestingly enough, it would be the quickest way for the developer to reapply with an amended project. He could then make the changes he has offered, and the city could easily oversee their implementation through the various committees’ approval processes that they would have to go through. The developer could amend the EIR, saving him substantial amounts of money, and utilize many of the plans he has already paid for. If the city council could come up with a way to implement these changes and avoid the election, then I’m for it. But that is next to impossible, this late in the process.

Personally, if the developer could be bound to the concessions he’s offered, and the number of horses could be capped at 300, forever, I’d say that would be a win-win-win for all parties involved. Is there a solution that satisfies everyone? No. Heck, over half of the people in the PAC hate me for even writing this letter. Tough. I am my own man, I have my own wellthought-out opinion, and I am entitled to it. Whether you agree, or disagree with me, I feel that the citizens deserve to know what has happened, and what is potentially coming.

Unless the City Council surprises us all, the citizens are going to have the final say in what gets built on those parcels by voting their conscience at the ballot box. I’ll see you there.

an understatement to simply state that everybody enjoyed the Veranda—they loved it. As a result, the party was completely enjoyable and relaxing. My daughter’s friends all had a great time, as did all of our adult guests. You have truly created an outstanding venue with exceptional service. Again, thank you for the outstanding service at a very reasonable price.

We really appreciate the hard work, the attention to detail and the friendly approach to planning the event.

We will not hesitate to recommend San Juan Hills Golf Club to our friends and business associates for their special events. We certainly hope to do business with you again.

hen the terrorists hit the twin towers, their plan was to destroy the lives of many Americans as well as damage our American psyche.

They were mistaken. From that act of evil came an unintended LAURA consequence: Americans grew FREESE close together. We concentrated on all that is good in America, linked arms and focused on the positive.

That time of unity and positive focus is now, sadly, forgotten.

It seems a glitch of human nature that when everything is going well, we focus on the one thing that is going wrong. Then, when a real crisis comes along, like 9/11, we refocus on the positives and re-unify. Why can’t that positive outlook become the norm, rather than be dependant on a crisis to be its catalyst?

As a City Council member, it is disturbing to accomplish something and then, before the moment of achievement is even celebrated, folks focus on the next negative. For example, two months after the movie theater opened, due in part to a city loan and council push, I heard a resident complain about the lack of improvements to the downtown.

The good was deleted from his memory in two short months.

Cheers, Library —Jim Macafee Re. Letters – “Overbooked” (9/10/10) – Criticism of Capistrano Librarians: I have witnessed more than my fare share of wickedness in my 71 years, but always, here and there, spots of goodness. Twice before, looking back, I realized I had been part of an extraordinary gathering of good people—latter-day manifestations of Brigadoon. Now it has happened again, and since I am sensitized to it, I can recognize it while it’s taking place around me. I have been volunteering for six years at our Library and sometimes wondered whether the people who serve there are aware of how lucky they are to have been precipitated together out of the midst!

Now we have Granny Annie, who believes they are surly and dismissive. My whole career was based on my being an astute judge of people. Every one of these is a good person. I know this. Granny Annie has made a mistake and amplified it by besmirching them in the paper. (Was her intent to hurt them? Would she be pleased to know she succeeded? “If you prick us, do we not bleed?”) Let me reconstruct the scene to my liking, according to my own bias: Granny asks for a library card for her grandchild. Library Lady explains that the rules she is bound by preclude it. She offers two alternatives, hoping to satisfy everyone. Granny implies that Library Lady is denying her out of meanness. (This is directly equivalent to belittling the waitress because the chef has overcooked the rutabaga.) Library Lady has spent her life trying to maintain her dignity and integrity, pearls of great price, and resents them being impugned.

The law of gravity now takes over, and requires that they both slip into a vortex that they would rather not be swirling around in. Granny’s refrain in her letter was “I know things have changed when...” Well, actually, things have not changed. I’m still fond of Ben Franklin’s advice, which has stood the test of centuries: “Imitate Jesus and Socrates” (by which I understand him to mean, “Practice compassion; seek wisdom.”) Here’s my idea: Let’s assume that Granny Annie is also a good person, and apologizes to Library Lady. See everyone fall all over one another. “Oh, no, no, don’t even think about it any more. Hold my hand.”

Teach granddaughter about magnanimity! You can call me an idealistic old fool. Been called worse.

Wouldn’t mind. I’m Anne Frank’s spiritual heir, still hoping for human goodness. We have no choice. Meanwhile, props to each one who chooses a helping role, as vocation or avocation, dragging us upward against all those who would drag us down.

Why the Referendum —John Perry, San Juan Capistrano A small group of residents from the east side of San Juan Capistrano began to hear of a project being planned by the City Council and the developer ARES over a year ago. Facts about the project were hard to come by but careful reading of the draft Environmental

Impact Report (EIR) started to provide some clues.

What we found in the EIR alarmed us. The project would involve a General Plan Amendment and a rezone to allow mixed use of the property known as Distrito La Novia involving three-story condominiums, threestory affordable rent apartments built over retail stores, and a five-level parking structure with two levels of underground parking. We also found plans to dig up the closed Forster Canyon landfill to make room for 94 homes and 750 houses including stables and support facilities.

We wrote letters expressing our concerns, attended City Council meetings to hear and see developer presentations, and spoke out about what we were not being told about the project. We even asked the City Council to allow an advisory vote to see if the public really wanted this project.

The City Council justified the project because of the projected revenue the project would bring to the city and refused to even consider an advisory vote.

So the referendum is not the first step, it is the last resort. We tried the public process but only achieved a token reduction in the scope of the project. So now we have exercised a right provided by the California Elections Code and the California Constitution to oppose the City Council’s action by mounting a referendum petition to overturn the resolution that rezones the property.

Using our own money, we sought legal aid to draft the petition, print materials, and have spent many hours at the local Vons and Ralphs markets and DeNault’s hardware store gathering signatures of concerned citizens. The support we have received has been remarkable. People who have never been involved in the political process have joined the fight volunteering their time to collect signatures in their neighborhoods and across the city. We have also received financial support form many of the same folks.

We are not against development; we are not NIMBY’s. We are concerned citizens who are against this

There are lots of good things that have happened in SJC in the last few years.

• Our finances: We have a balanced budget and an AAA bond rating, which only 19 cities in CA have.

• Our safety record: SJC was named by the FBI as one of the safest cities in OC. • Our Economic Development: Even in this down economy, we have applications for hotels, car dealers, restaurants and the expansion of Costco.

New stores are popping up—from Pets Plus to the Hummingbird Café on Los Rios. The downtown is a top priority, to help it become the area where residents and visitors want to eat, shop and meander.

Economic development doesn’t just happen, it must be actively pursued.

• Our quality of life: That which makes SJC special continues. The Los Rios Park, the new movie theater, music in HTC park on summer nights, new open space—the city of SJC has a load of blessings and more are coming!

Sure, there are issues in SJC but don’t believe those who preach hate or a tale of woe. A great deal of good is happening. Let’s not wait for a crisis to solidify us; let’s work together now with a focus on those positive things that make San Juan the best little city in Orange County.

The Democratic Process at its Best...

—Marsha Norman, San Juan Capistrano Residents from San Juan Capistrano, as well as surrounding communities, states and even countries have been very respectful to me and other volunteers that have spent many an hour in front of Vons and other stores in SJC this past week. People have encouraged and thanked us for our time spent, being involved in our community, while working to obtain signatures for the Referendum to bring Distrito La Novia/San Juan Meadows project to a public vote.

It has not made a difference whether someone wanted more information, clarification, lived out of town, lived in town, supported or opposed the project. In some cases we just diplomatically agreed to disagree. But most recognized that we have the right to question our leadership’s decisions when it is done within the bounds of the law. The hope is at the end of this process we will have a project better suited to the “village” concept and “enhance” the neighborhood and community.

The developer is well within his rights to develop his land and know his bottom line to make a profit.

Civic-minded residents also have a right to know their bottom line, to make sure that a project is compatible with their neighborhood, and fulfills the needs of the community. It has been reassuring that such goodness prevails in people and that the democratic process is well and alive in San Juan Capistrano.

2010 in SJC: Signaling a Strong Recovery on the Horizon

T

he word “growth” seems to have two letters too many, as it often elicits the same response as a number of fourletter words.

However, regardless of how you feel about growth, it is a naturally occurring process that in general happens at its own rate. We can, through public policy, shift the way we grow but history has proven that it’s really economics that dictate the rate at which a community grows (or regresses).

In light of that, the past year has indicated that San Juan Capistrano is ready for an

economic rebound. After a few years of seeing increased vacancies, things are definitely picking up with an impressive list of activity in new business.

On the south end of town, car dealerships have been sitting unoccupied, symbolizing the economic downturn. Over the past few months, applications have been submitted to the City for new operations that will fill those empty lots with new dealerships that will reinvigorate our local economy and create much needed sales tax revenue.

2010 also will be remembered as the year two new hotel operations took substantive steps towards being built in San Juan. After years of only having one choice for local

tourists to stay in our City, new hotels will begin construction in the south end of town and in the heart of Downtown. The latter, currently called the “Plaza Banderas,” will feature retail, restaurant and other uses as well and will sit directly opposite our largest tourist attraction, the Mission.

These new hotels will increase the positive impact of tourism. Our local economy will get far more of the per-dollar spending of visitors to San Juan as they eat and stay right here in town. Also, we should see a decrease in traffic as many tourists park their car at the hotel and will simply walk around Capistrano for a full weekend without driving. Finally, these new projects will provide the City with TOT tax revenue, an

extremely important revenue stream that will help provide services.

The City recently approved plans for the Distrito La Novia project (a large residential and commercial project) and is in exclusive negotiations with Home Depot for a new store. In addition to those larger projects, we have new restaurant applications being considered for downtown and other parts of town and Costco is working on an expansion.

2010 proved that the steadfast work on economic development by the City, the local business community and the Chamber is paying off. However, the more positive and important sign is what the economics say; that San Juan Capistrano is a smart and desirable place to do business and invest in.

Stacks Pancake House has been open for three weeks now and, according to co-owner Ovita Wijaya, “It’s been going great!” Ovita and her husband, Nixon Tanuwidjaja, are first-time restaurant owners but Nixon has been in the restaurant industry for almost 20 years. Nixon has a background in Japanese cuisine and spent three years in Hawaii working as a breakfast chef. The Hawaiian influence shows in the menu, which features many traditional items like Moco Loco (a hamburger patty on rice with eggs and gravy), Spam and eggs, Kalbi short ribs, Portuguese sausage and the must-have pancake and French toast topping of Hawaii—coconut syrup. Coconut syrup is hard to come by on the mainland and the fact that Stacks has it makes for some very excited customers indeed. The syrup tastes great on the popular Captain Mac Nut French toast (made with Hawaiian sweet bread and topped with Cap’n Crunch cereal and macadamia nuts), as well as the already famous Stacks pancakes. Please relate to our readers the essence of your upcoming retrospective multi-media show and how the evening will progress.

It is kind of a multi-faceted one-man show. Following Gordon’s untimely death, I was not willing to accept that I could never sing those songs again at all, even though there could never be another Peter & Gordon concert.

So I assembled this mixture of storytelling, music and memorabilia to perform in NY and LA. I am bringing a great band, some rare video clips and photos and all of my hazy recollections of the sixties and beyond. So it includes live music along with the multi-media elements—and a lot of what I sincerely hope will be interesting and even revelatory insights into an era of significant musical and social change.

What process did you go through to condense and/or decide which events in your long and storied career to include in the show?

I suppose a lot of it depended upon what I remembered!

And I tried to pick events and moments which I thought might be less well-known to the general public or might be interesting and amusing.

Hospice Focuses on Life November is National Hospice Month; training for new volunteers scheduled

“T

hey were so wonderful to me!” Marilyn Jennings, volunteer for the Hospice Care of California, said of the hospice staff members who came to her house when her husband was sick. She had a social worker to handle logistics, a nurse to administer medication to her husband, a caretaker to help him with daily activities and volunteers ready to help.

During this time, Jennings needed the emotional support just as much as all the medical and logistical support. “A small gesture, like a hug or a talk, can just mean the world,” said Jennings, which is why she now offers her time as a volunteer for Hospice Care of California.

“Hospice care helps patients and families focus on living by allowing more time together with less stress and greater comfort,” said Ann Hablitzel, founder of Hospice Care of California.

Hospice provides a team of people to care for a patient, as Jennings saw firsthand. A San Clemente resident and nurse for 21 years, Tana Larson, recently joined the hospice team “because it’s more than just administering medicine, I’m caring for the person as a whole and their family.”

Hospice is a Medicare benefit for those no longer seeking curative treatment, and most private insurances work with hospice as well.

“There are many myths associated with hospice care,” explained Gary Tucker of San Juan Capistrano, who spent many years as a hospice chaplain. “But an important aspect to understand is that a patient can revoke hospice care at any time if they want to try a new treatment, and they can come back on the program at any time as well.”

While some may think hospice means a patient has given up on life, “those of us who have worked in the field have seen firsthand how hospice care can improve the quality of life,” said J. Donald Schumacher, president and CEO of the National Hospice and Palliative Care organization. “There is even a growing body of research showing that hospice care may prolong the lives of some people who receive care.”

And an integral part of hospice care, for both the patients and the staff, are the volunteers. Volunteers allow nurses or family members to take a break, as well as being a much needed diversion or friend to the patients.

“The beauty of being a volunteer,” said Barbara Amavisca, Volunteer Coordinator for Hospice Care of California, “is that while doctors, nurses, and social workers have an agenda they need to complete, volunteers just

go, visit and be a friend.”

At 84 years old, Robert Arnold from San Clemente has spent at least one day a week for three years visiting hospice patients as a volunteer. Sometimes he reads to the patients, takes them for a walk, or plays a game, but most often he finds himself chatting with the patients over a cup of tea. “They like to talk and tell you about their lives, their friends and family,” Arnold said. “They have all led very interesting lives and enjoy telling you about it.”

Arnold appreciates volunteering for hospice because it’s personal and you can see the results. Although he has run successful companies and raised a large family, volunteering with hospice “always makes me feel like I accomplished something,” he said.

It’s not uncommon for volunteers to become great buddies with the patients they visit. Jennings, who used to be a hair stylist, never visits her patient without bringing her curling iron. “Last week I cut and curled her hair and she just loved it!”

November is National Hospice Month, recognizing that over 1.5 million people receive care from the nation’s hospices every year, according to the National Hospice and Palliative Care Organization.

“Although November is a valuable time to raise

awareness, the time a family might need us doesn’t occur only during this season,” Hablitzel said.

A volunteer training seminar with Hospice Care of California will be held early next year to train more volunteers for this special aspect of hospice care. The seminar will prepare volunteers so they won’t feel scared or insecure. Training covers topics such as bereavement and dying, as well as state-mandated topics and anything else a volunteer might come up against. By the time volunteers go out and visit, they have a good idea of what to expect either visiting patients or giving caregivers a break.

Time commitments differ for each volunteer, but the goal is that each patient who has requested a volunteer will get a visit once a week.

“If you have the time, volunteering for hospice is something that is very, very rewarding because you are doing something directly for someone else,” Arnold said.

“And there is always a need for volunteers.”

The training session is January 21, January 28, and February 4 from 10 a.m. to 2 p.m. at the Aliso Viejo Library on 1 Journey in Aliso Viejo. All sessions are mandatory for those considering visiting patients. Social justice activist and fine art photographer opens new gallery

S

an Juan’s Los Rios District may be the oldest neighborhood in California but its historical significance certainly doesn’t prevent the buzzing yet bucolic area from producing fresh, new, progressive ideas.

“This street is magical,” said new Los Rios gallery owner and San Juan resident Tim Rusmisel, scanning over his quaint neighboring storefronts, cafes and glowing, lit courtyards as another sunset turned into dusk. “I’ve always been drawn to this area.” Rusmisel, a photographer since his high school days, had his eye on the small cottage—previously a retail shop selling knick-knacks and antiques—that now houses the Tim Rusmisel Gallery.

“I had visualized this property as a gallery for years,” he admitted. On a summer bike ride with friend and fellow photographer, Carly Slawson (who’s now one of Rusimisel’s featured artists), the pair spotted a For Rent sign in the cottage’s window and, naturally, the wheels began turning. “It went from an idea to a conversation to actually opening the doors,” all within a few days time, Rusmisel said. That fated bike ride fell on a Saturday “and I was open the next Thursday,” he recalled, almost in disbelief.

He timed his opening with the reopening of the Montanez Adobe and filled the space with his own work, to start things off. A strict vegan, Rusmisel swore off traditional film because of the use of gelatin in the material and, a decade ago, was turned on to the somewhat rare and archaic process of wet plate photography by a then-coworker at White Coyote Photo (now closed) in San Clemente. Back then, digital photography wasn’t without its problems and Rusmisel fell in love with the anachronistic method (although he employs digital photography as well, now). The result is a unique image with a handcrafted, detailed and intimate look. In the world

of photography, only a relative handful of fine-art photographers work with the wet plate technique.

“It’s easy for someone to have a camera that produces great images,” he said, “but you can’t always give it your signature. [Wet plate photography] lets me be way more involved with the finished product; it’s an amazingly beautiful process.”

And this sort of integrity, seemingly inherent in Rusmisel’s personality, reaches far past his sense of aesthetics. Because the self-proclaimed “social justice activist” had been showcasing his work off and on in other people’s galleries for years, he wanted a chance to let others show their work and to run a gallery with a sort of moral compass that he hadn’t always encountered. Part of his goal included promoting local artists without reaping an unfair percentage of their profits.

But perhaps an even bigger aspiration was to allow them to use their talent and money for good causes.

Rusmisel aligns every show with a different purpose and relevant organization. For instance, his first group

show, which opened on October 30, entailed a mix of work from all vegan-only artists and proceeds go to Animal Acres (www.animalacres.com), a rescue sanctuary for farm animals. Other organizations on Rusmisel’s future wish list include Lora’s House, the Surfrider Foundation, a local, struggling community garden as well as an exciting group show featuring the art of the Sea Shepherd crewmembers (of Whale Wars fame).

It’s a full plate for someone who already has another fulltime job. “I have no free time,” he joked. “It’s been a lot of hard work but I love every minute of it. This is a dream to make it work.”

In addition to his planned showings, Rusmisel rents the building’s ample courtyard space to artists to show their work and processes off, be it painters, sculptors or jewelry makers, giving them a chance to sell as well.

Although JSerra prides itself in being strong in all areas academically, we are earning a special reputation for our strength in science and math. Our popular science department chair, known for his wry sense of humor and uncanny ability to make complex courses such as chemistry, physics and pre-calculus accessible, shares my observation about the evolution of our students.

It’s not just academics. There’s a lot to cheer about in athletics. Recently, four JSerra baseball players signed letters to play ball at major universities, and two female athletes signed up in other sports. Clay Williamson will play baseball at Cal State Fullerton, Austin Hedges at UCLA, Tyler Krause at UCI and Trent Boras at USC. Swimmer Casey Mims signed on at UC Berkeley, and Katherine Delaney, a member of the Trinity League champion girls’ cross-country team (a JSerra first), plans to run at Berkeley.

Meanwhile, members of the JSerra Chamber Choir prepare for a trip to Rome in April. Our choir has been granted the esteemed honor of singing for Pope Benedict XVI, and has been busy learning new music for this once-in-a-lifetime performance. The 10-day trip will include an audience with the pontiff as well as a religious pilgrimage.

Capo Boys & Girls Club Gets Donation, Grant The Capistrano Dispatch

I

t’s been a good few weeks for the Boys & Girls Clubs of Capistrano Valley, financially. The club received a $25,000 grant for youth-mentoring programs and a $10,000 donation from the Dana Point Community Cycling Foundation.

The $25,000 grant comes from the Boys & Girls Clubs of America’s federally funded effort to participate in youthmentoring programs.

The club has partnered with the Office of Justice Programs (OJP) and the Office of Juvenile Justice and Delinquency Prevention (OJJDP) for the beneficial youth-mentoring programs in our community. OJP and OJJDP aim to make a positive impact by strengthening communities and thus the nation as a whole. In 2009, San Juan Capistrano was designated a “gang-injected city” because of increased gang activity reported by local law enforcement.

Truancy at local schools increased and the Boys & Girls Clubs of Capistrano Valley was asked to provide services to help keep kids in school and off the streets in an effort to cut down on delinquent behavior. The BGCCV strives to provide one-to-one mentorships for youth members who are failing in school or on the brink of delinquent behavior.

The club said the $25,000 grant will directly support BGCCV youth-mentoring programs to include Gang Reduction Intervention and Prevention Program (G.R.I.P.), Triple Play Athletic Programs, Homework Help and Tutoring Programs. Boys & Girls Club staff will work with community volunteers to provide one-on-one mentoring, setting an example that through hard work anything is possible.

Programs in place will be exponentially impacted by these funds, club officials said. Through Homework Help and Tutoring, club members receive academic support and guidance from peers and adults.

Triple Play and Athletic Programs teach youth that teamwork can lead to success and help build confidence.

already involved in delinquency and gangs.

“We are thrilled to receive this grant,” James Littlejohn, Executive Director of the Boys & Girls Club of Capistrano Valley, said in a statement. “Funding from OJP will help us expand and integrate our mentoring program into all of our programs. It will help us continue to develop meaningful relationships with our youth and show them that they can succeed.”

Earlier, on November 15, the Dana Point Community Cycling Foundation presented the Boys & Girls Club of Capistrano Valley a $10,000 donation from proceeds of last year’s Dana Point Grand Prix of Cycling.

Cycling Foundation Executive Director Russell Ames said that the Foundation and the Boys & Girls Club is an ideal partnering with regard to the annual Grand Prix event. “The Boys &

Boys & Girls Club Board of Directors President Bill Cole expressed his thanks to the foundation upon receiving the check and said that it will help with their mission to serve more than 300 kids a day and it will be used to help run several programs simultaneously, such as early morning and teen programs.

“We are absolutely planning on being involved in future Grand Prix events. This is a great partnership. We love it!” said Cole. “Our involvement with the Grand Prix is a great way for us to support the community and also to brand the club and get the club’s message out to more and more people. Not to mention; it’s a lot of fun and we really enjoy it.”

Littlejohn said that he is especially fond of the partnership between the club

and the foundation because the Boys & Girls Club makes an effort to provide opportunities for kids that expose them to a healthy lifestyle and that bicycling in the event is a great way to introduce kids to a sport that can do just that.

Cycling Foundation Board member Cyndi Elders added that, as the Grand Prix grows, so does the need for volunteers. “We are trying to get the word out to the community and are asking for individuals as well as new clubs or service organizations to join in the effort through our website. he South Orange Country Patriot Jr. All American football program has held a long tradition of championship teams—and this year is no exception.

Even Cincinnati Bengal quarterback Carson Palmer, a Heisman Trophy winner at USC, is a former Patriot.

Stallions Playoff Run Short

A magical season for Capistrano Valley Christian School’s football team ended in the first-round playoffs against the Laguna Blanca Owls.

The Eagles, who play eight-man football, went through Empire League play undefeated, but fell to the Owls in the first round 28-12.

“There were just too many mistakes tonight,” CVCS Coach Chris Fore said as he watched a touching on-field ceremony in which the team said goodbye to its seniors. “We were always one injury away from disaster, but it was a great season.”

One injury away indeed—at times the Eagle’s trainer was the team’s MVP and as many players were on the medical bench as on the sidelines. The Eagles were ahead in an early-season game but had to forfeit when two players were injured— on the same play—and the team didn’t have enough players to go on.

But Fore credited the leadership of his seniors and the heart of his team overall in their playoff run. The team earned the first football title since 2002.

The San Juan Hills Stallions made a valiant showing in their first trip to the CIF football playoffs Thursday but ultimately fell to Cypress 63-37.

The Cypress Centurions were the favorites, coming into the game with an 8-1 record, but the Stallions fought hard. San Juan Hills made the playoffs by trouncing Capistrano Valley High School, entering the game with Cypress with a 6-4 record.

The Stallions scored first, on a 40-yard field goal by George Winckel. The team’s leaders, Will Acromite, Michael Perryman, Kyle Bauer and others, put up points— Perryman had four TD receptions—but the Cypress offense was overwhelming.

This season marked the first time the Stallions played with seniors on the team, as the San Juan Capistrano high school opened just four years ago. Ironically, the playoff game was in Anaheim because neither Cypress nor the Stallions have a home stadium.
