SAN CLEMENTE The Nuclear Regulatory Commission will make a presentation at a special San Clemente City Council meeting September 27 at the city’s Community Center at 6:30 p.m. The NRC will discuss the results of its Near-Term Task Force, which reviewed its processes and regulations in light of the disaster at the Fukushima Daiichi Nuclear Power Plant. The NRC will be joined by the Interjurisdiction Planning Committee whose representatives will speak on emergency response plans, evacuation routes and more. Finally, representatives from San Onofre Nuclear Generating Station will review their steps taken following the disaster in Japan. A follow-up meeting is scheduled for October 11 at 6:30 p.m. at the Community Center with a slate of independent nuclear experts. Presentations will be done both by recorded video and live.

DANA POINT Dana Point Chamber of Commerce Board of Directors Chair Russell Kerr on September 15 announced the resignation of Executive Director Laura Ouimet. “She helped the chamber through a difficult period, and we will be sorry to see her go,” Kerr said. Ouimet said she will continue to support the chamber and offer assistance in ensuring its success. “I am leaving to pursue opportunities more closely aligned with my personal goals,” she said. Ouimet was hired March 1, after serving as interim executive director since November 2010. Her last day will be September 30. Ouimet’s resignation came just one day after Assistant Director Kelly Straine’s last day. Straine—who served as events director since February 2008 and was promoted to assistant director in March 2010—left for a new position with the Riverside Chamber of Commerce.

...Ortega Highway Closure?

THE LATEST: Traffic on the east side of town might be slow going Sunday because of street closures to make way for the first Orangeman Half Triathlon, which will run from Dana Point out to Ortega Highway and back.

Bicyclists will ride up the creek trail toward the Ortega, then use La Novia to cut over to Calle Arroyo, where bicyclists will go east until linking with the highway.

La Novia will be closed between San Juan Creek Road and La Novia Avenue from 7 a.m. to noon. The bicycle trail from the city to the beach will also be closed.

Ortega Highway will also be closed east of Antonio Parkway from 7 a.m. to noon.

Lanes will be closed on Ortega east of Avenida Siega, too. There’s also a chance the cyclists will need to use San Juan Creek Road, if the Camino Capistrano construction makes the bicycle undercross unusable.

WHAT’S NEXT: Go Forward Racing, Inc. of Dana Point gained permits from the city and Caltrans for the closure. The city will receive 2.5 percent of the net proceeds of the event, as well as money from the prerace check and fair at Historic Town Center Park on Saturday, said Alan Oswald, Capistrano’s traffic engineer.

...CLC Changes?

THE LATEST: The city is likely to surrender its option agreement for 116 acres in the north part of town, if a proposed retirement community there can get

approvals to access the project from Laguna Niguel, the council decided Tuesday.

The council had an option agreement to buy the 116 acres from Continuing Life Communities for $10 million, the same amount the project would generate in property taxes. But that deal was struck when access to the project would have come over an improved rail crossing at Rancho Capistrano. That isn’t going to work, so the project developer is negotiating to use the same road that accesses the Mercedes Benz dealership.

For those negotiations to go forward, however, the city needed to show the option agreement will likely be dropped, said Troy Bourne of CLC. WHAT’S NEXT: A key element in the discussion is the 20 acres now used as soccer fields. Without the city buying that parcel—it was part of the option agreement—it is likely that property will ultimately be developed.

...Another DA Report on CUSD?

THE LATEST: Capistrano Unified School District leaders acted legally when they discussed restoring a portion of teachers’ salaries, the District Attorney’s Office said in a report released Wednesday.

That finding reverses earlier accusations by the DA that the actions were a violation of the state’s public meeting act.

The DA issued the initial report in May but came back and interviewed all of the trustees and others involved at the request of the school district. In the report issued Wednesday, the DA’s office

said the closed-door discussions, and district’s contradictions on what exactly led to the restorations, gave the appearance of a Brown Act violation, but the close look found none.

The DA did include some harsh words about the atmosphere at CUSD headquarters, though.

“The OCDA’s investigation also revealed what can be described as a seemingly toxic atmosphere within the halls of CUSD,” the report says.

...Economic Impact of the Toll Road?

THE LATEST: Linking the Foothill-South Tollroad from Rancho Santa Margarita to the San Diego Freeway south of San Clemente would create 13,663 jobs in Orange County, as well as inject $160 million annually into state and local government, according to a Transportation Corridor Agencies study.

The report by Los Angeles-based Beacon Economics was released Wednesday, September 14 at a meeting of the South Orange County Regional Chamber of Commerce. Chamber officials there announced a new mission serving as a larger, united voice for business on key issues, as well as the launch of the South Orange County Economic Coalition.

Surfrider, which opposed the toll road’s preferred route, issued this statement in response to the study: “During the 2008 California Coastal Commission consistency hearing in Del Mar, Trans-

THE LATEST: City officials will hold a community meeting in the Camino La Ronda neighborhood off La Noiva, where residents have complained about speeding cars—but then others complained about citations when deputies were sent out to slow them down.

Mayor Sam Allevato and Councilman John Taylor will meet with residents, who have sent letters t o City Hall and appeared at council meetings appealing for help.

“In the past there have been several appeals to the neighborhood to slow down and be more conscious of the increasing safety hazard,” resident Bill Dokos said.

Capistrano couple in battle with city over home Bible studies

L

etters are pouring into City Hall from around the world as news spreads that a Capistrano couple has been fined $300 for holding Bible studies in their Mission Hills home.

Chuck and Stephanie Fromm received at least two citations from the city of San Juan Capistrano. They appealed the tickets to a hearing officer who sided with the city, leading to the August 31 legal challenge in Orange County Superior Court. That hearing is set for October 7.

“How dare they tell us we can’t have whatever we want in our home,” Stephanie Fromm said. “I should be able to be hospitable in my home.”

The city countered with a statement that says Bible studies are not prohibited in homes, and that the Fromms attract as many as 50 people to their home on Sunday mornings. That, the city says, makes the house a “public gathering place.”

Code enforcement officers responded to a neighbor’s complaint.

The city has received dozens of letters, from as far away as Australia, condemning the citations.

While not prohibited, any regular Bible study—or “fraternal” and “non profit”—use in residential neighborhoods requires a conditional use permit, the city code says.

Niguel because they saw it as a good place to raise their children—they have five—and run their business. A historic town with a strong equestrian lifestyle, Capistrano is officially 50 years old but grew up around the 234-year-old Mission San Juan Capistrano. Jr., the son of Calvary Chapel founder Chuck Smith, draws as many as 50. But in the neighborhood of large homes on even larger lots—the Fromms live in a 4,700-square-foot home on a parcel that also has a corral, barn, pool and huge back lawn—Stephanie Fromm said parking was never a problem. Neither was noise, she said.

“There’s no singing or music,” she said. “It’s meditative.”

But according to city records, a codeenforcement officer gave the Fromms a verbal warning about the meetings in May. Citations were issued in May and June, according to city records. San Juan Capistrano City Attorney Omar

Sandoval said the city had not yet been served with a copy of the legal action, so he could not comment.

The Fromms’ citations say they violated section 9-3.301 of the Capistrano Municipal Code, which prohibits “religious, fraternal or non-profit” organizations in residential neighborhoods without a conditional use permit. The footnote on the section says it “Includes churches, temples, synagogues, monasteries, religious retreats, and other places of religious worship and other fraternal and community service organizations.”

Resident Nan Bianchine, who lives across the street from the Fromms, said she complained because of parking and trash issues. She also admitted that she has never gotten along with the Fromms in the 16 years they’ve been neighbors.

She said she doesn’t think the use is appropriate for a residential neighborhood.

Chuck Fromm said he has put cones out to ensure the areas in front of the Bianchine house is left unobstructed. The Fromms have also used their community’s clubhouse for the Bible studies, but under city codes, that would likely require a conditional use permit, too. The permits can be granted by the city after the potential impact of a use are studied and mitigated.

Chuck Fromm said he sees the issue as a “rather to gather” debate that goes beyond Bible studies and could affect Boy Scouts and other groups that regularly have home meetings.

“We don’t like lawsuits, but we have to stand up for what’s right. It’s not just a personal issue,” Stephanie Fromm said.

“Can you imagine anybody in any neighborhood, that one person can call and make it a living hell for someone else?

That’s wrong … and it’s just sad.”

Councilman Says Naming Dog ‘Muhammad’ Not Meant to be Offensive First-term City Councilman Derek Reeve named his dog Muhammad as a testament to free speech, not to disparage Muslims, he told a packed City Hall meeting on Tuesday.

But, he said, he was also “offended” the council was discussing his dog’s name rather than what he saw as important issues facing the city. He did not offer an apology to anyone who might have been offended by the name of his dog. Muslims believe Muhammad is a Muslim prophet on par with Jesus, and those who follow traditional Islamic faith believe a dog’s saliva can disturb the ritual purity required for their daily prayers.

The issue surfaced when Reeve announced the name of his dogs—he has

another named “America”—during a discussion earlier this month about creating a dog park in the city. Some chuckled when he made the statement, but others said later they were offended.

Councilman Larry Kramer wanted “council decorum” discussed at Tuesday’s council meeting.

“At the last City Council meeting the name of a dog was stated from the dais which I personally found to be offensive,” Mayor Pro Tem Larry Kramer wrote in a letter to the council. “While not limiting the free speech of Council Members, if they say something that is inappropriate, the City Council should take immediate action to state their position on the record.

Kramer, a retired Navy captain, said he respects freedom of speech, but a balance must be struck. Mayor Sam Allevato agreed with him, saying the council is the board of directors for the city, and such comments could be seen as disparaging. The city has Muslim employees.

Council members Laura Freese and John Taylor voiced concern, although not as strongly.

Reeve’s comments were condemned by the Council on American-Islamic Relations, and that set the tone for most of the comments at Tuesday’s meeting.

Many of the speakers were from outside of San Juan Capistrano, and came to cast aspersions on CAIR and Muslims in general. Others, including some Capistrano residents, said the council was trying to stomp on Reeve’s free speech rights.

None really addressed the point raised

by Kramer and Allevato—that council members are held to a higher standard, particularly when they are on the dais.

Reeve, who earlier suggested the city lift its ban on handguns in Capistrano parks, was nearly defiant.

“What’s most offensive is that we’re not talking about anything important,” he said. “We’re talking about my damned dog.”

he City Council on Tuesday honored an Orange County Sheriff’s Department veteran who started his career on the streets in Capistrano, and finished them here as a sergeant.

Max Chance joined the Sheriff’s Department in 1981, as a deputy in the main jail. He transferred to patrol in 1984 and was assigned to Capistrano in 1985. He worked here until 1989, after building a reputation as a hard-working deputy who had a nose for finding felons, Capistrano Chief of Police Services Lt. John Meyer said.

In 1989, Chance transferred to specialized sheriff’s units, and seized millions of dollars and tons of narcotics. He was ultimately promoted to sergeant and oversaw the Regional Narcotics Suppression Task Force.

He transferred back to Capistrano in 2009, 20 years after patrolling the

streets here. He was, Meyer said, a great mentor to deputies and also a well liked liaison for the volunteer Associated Senior Action Patrol. He retired July 30.

Chance, honored by the council and ASAPs Tuesday, said he was humbled by the attention.

“I’m taken aback,” he said. “I’m fortunate to have come worked here as a deputy…my family lives here, my folks live here, my children go to school here…I’m just grateful.” CD

A Shocking Interchange

magine as you exit the southbound ramp from the I-5 that a large 60 foot wide metal bridge towers over the roadway showing lane signage. Also imagine a solid concrete roadway that stretches from the corner of Ortega and Del Obispo to the propane tank at the back of the Chevron station by Arby’s. The road will basically double the width of Ortega today and impose an expanse of almost 130 feet of solid concrete.

Welcome to the future entrance to our Historic downtown according to Caltrans I-5 Interchange plans.

To the east of the freeway, the line of old massive pine trees in front of the Forster Mansion will likely be removed, and a retaining wall in front of this historic gem will be constructed of standard issue concrete. No specialized wall that fits with the character of this building on the National Register of Historic Places is offered by Caltrans.

If you are at 24-Hour Family Fitness or in one of the Best Western rooms that faces the freeway, you will be staring into a 24- to 30-foot high retaining wall (about three stories high) that Caltrans

refuses to cover with landscaping or put in vine pockets so plantings can soften the impact and discourage graffiti.

At least all this Caltrans construction, which rips up our interchange for about two years starting in late 2012, will help us improve a few things, right? Do you think the unsightly overhead utility lines by the Shell station and crossing the bridge will be undergrounded by Caltrans? Nope! How about reducing the number of driveways in and out of Del Obispo near Ortega with the rebuilt Del Obispo section? Nope! Make sure the new traffic control boxes are screened and camouflaged instead of being standard galvanized steel? Nope!

Put in some planted medians to break up the 130 foot wide concrete roadway?

Nope! At minimum give us pavers from the bridge leading into the intersection area with Ortega and Del Obispo? Nope!

Can we at least remove the 60-foot wide metal bridge with lane signage that is shown across the southbound exit ramp only 1,000 feet from the Historic Mission?

Nope!

With the remnant parcels of land that will be created from the new roadway configuration, surely the city should have first dibs on acquiring that land from Caltrans for a special entryway into our historic downtown? Same answer—Nope!

On October 4, the staff will be making a presentation to the council on the status of the Interchange Project and Caltrans’ continued refusal to address to the city’s satisfaction some of the issues I have mentioned above. I urge you to look at the facts and the plans that Caltrans will impose on all of us unless we put significant pressure on Caltrans to reconsider. We only have one chance to get this right. Otherwise we are stuck with the result for at least decades to come. I also urge the council and city to rally our representatives in Sacramento (and even Washington with the National Historic Register buildings) to push back on Caltrans. They need to set aside their standard play book and be far more responsive to the unique character and needs of our historic town. We should cajole or even

threaten action if necessary based on Caltrans not being consistent with their own mitigation noted from their Environmental Impact Report. The EIR shows such things as retaining walls needed plants for screening (Mitigation Measure VA-11) and community image and aesthetic issues would be resolved with the city (VA-14). Just because some believe Caltrans is too powerful a state agency to fight doesn’t mean we should roll over.

The government still ultimately works for us and sometimes we may have to raise a ruckus to remind folks of that.

This is one of those times.

While Caltrans did accept some of the city requests, many other key aspects were ignored or refused by them. Often the pat answer is “That doesn’t meet our standards” or “it is not what is designated in the State’s Highway Design Manual.” It is no surprise that the state manual doesn’t take into account the unique character and circumstances that surround the treatment of roads around buildings from the 1770’s, since there

organizations, and individuals that wanted to participate in the vision of this new venture. Attendees far and near imbued us with their friendly are so few of these historic jewels in our State. The Standard Design manual needs to be set aside in these unique circumstances.

In fact, the minutes of the June 1, 2010 council meeting at which the Caltrans Project Manager was present show clearly that the City Council commented that priority was to get First Rights to the remnant parcels, underground the utilities, and keep the rural and historic character of our city.

The City Council further commented that if Caltrans engineering standards and requirements cannot be changed to recognize the uniqueness of San Juan Capistrano and our Mission, then the city needs to reach out to higher representatives in Sacramento and the OC Supervisors. Clearly, the time to escalate this matter is well past.

How I Go is a return to the middle ground between blues and rock, which is what I feel we do best. We worked very hard on this album and all aspects of the recording process, striving to give the listener the best musical experience possible. What kind of set are you planning for The Coach House? Have you played the venue before? The current live show is half new material from the new record, and the other half is songs from previous records that I feel fans want to hear when they come to a KWS band show. Yes, we have played The Coach House before and enjoyed it very much. It has a very intimate feel, which I feel is important to the fans. They want to feel connected to the band and what’s happening on the stage.

What other projects are you involved in currently? The current focus for us is touring in support of the new album. We are touring for the next year and a half with plans to go to Europe in November and other countries next year.

I

t’s a good thing that San Juan Capistrano is more than 40 percent open space. It’s even better if residents use the open space.

That was the thinking behind the Rotary Club’s Ridge Events, which began with a walk in the southern open space off Camino Las Ramblas four years ago.

The event has evolved since then, adding trail runs and a mountain bike ride, and this year, wrapping the walk into the running events.

Ken Friess, a former City Councilman, run organizer and youth supporter, jumped at the chance to work on the Ridge Event with the Rotary, which donates money from the event to the city for trail maintenance and to youth groups.

“I can’t say for sure it’s connected, but there’s more people using the trails now than there were three years ago,” said Friess, himself a runner.

The actual Ridge Event itself, on October 1, is expected to draw about 200 participants on foot, and as many as 60 cyclists.

The day begins at 7:30 a.m. with the 5k (3.1 miles) Trail Run, which climbs the hills overlooking the Pacific. A few minutes later, the 10k (6.2 miles) leaves and follows the ridgeline along Whispering Hills Trail and returns to the Las Ramblas Trailhead. The morning’s events continue at 9:30 a.m., when the 2nd Annual Mountain Bike Poker Ride leaves for a non-timed trail ride to five stops to pick a playing card. The best poker hand at the end of the ride wins a GPS system for bikers or hikers, donated by Buy My Bikes.

Cyclists can also form teams: The team with the best poker hand wins dinner and a movie for two at Vito’s Pizza and Italian Ristorante and VIP seating at San Juan’s Regency Theatre.

Two Important Life Lessons D

oday’s column carries with it a couple of powerful lessons. The first: Opportunity often arises out of adversity, although during the difficult period of adversity we may not understand or be able to see the opportunity until sometime later.

The second lesson reminds me of my mom. She often quoted her version of the proverb from Ecclesiastes 11:1 by saying, “Bread cast upon the waters is often returned in some form.”

Keeping these two lessons in mind, a special woman named Jo, age 51, shared her story.

Jo said, “I’m a widow of five years. My husband passed away from colon cancer at the young age of 46. We were married 23 years with a wonderful life we had created together. Needless to say, I struggled being alone and in the dating world at the age of 50.

“My neighbor’s daddy—whom I’d only met briefly a couple of times—was diagnosed with leukemia. In hearing the news, I felt that pit in my stomach of what cancer news feels like. I love my neighbor dearly and her beautiful little family. I knew I had to go visit her dad, Bruce, in the hospital.

“It was difficult for me to go to the same hospital where my husband was so many times, but my feeling that I needed

to see Bruce was much stronger. I walked into his room and announced that I was his daughter’s neighbor and we talked for a couple hours. We shared many thoughts, On Life and feelings, fears and life Love After 50 stories; I dropped a

“His prognosis was only a 23 percent survival and they were checking family for a bone marrow donor. I left my phone number for his wife to call me. If she needed anything I’d be there. As I walked out of the hospital, I felt a deep sadness. My thoughts at the time were: what an amazing man with an amazing family and life. I wish I could call him ‘friend’ and I regret I’ll never see him again.”

Jo said a few months later she heard the great news that Bruce had received the transplant and was home doing very well and had plans of taking the whole family to Hawaii. However, the story took a bizarre twist.

Jo said, “After they returned from their trip, his wife died suddenly. Everyone was shocked because she was the healthy one and everyone expected he would be first to pass. I attended the

funeral at the same funeral home as my husband’s funeral. It was very difficult but my feelings were strong that I needed to be there.

“Months went by and my neighbor said her dad was asking about me and remembered our visit in the hospital.

I said I would really like to see him and see how he’s doing. We had a few meetings of sharing our grief of our loved ones gone and the horrible experience of cancer.

“He invited me to go horseback riding with him, something we both love doing. When we stopped for our lunch I told him what I loved about the day: that we were doing something I loved, he was sharing his passion with me, and I was getting my wish—my second chance to be able to call him ‘friend.’

“His reply was ‘I want to be your best friend.’ Well, it’s more than friends and we’ve been dating two months. I truly feel my husband chose him for me and keeps reminding me of my wish.”

Jo added that one challenge they face is that his family and friends have a hard time seeing him with a new woman.

She mentioned another factor that enriches this story: “I have a swing on my back patio that is now called

the ‘therapy swing,’ where long and deep conversations happen. Bruce never talked to anyone about his wife’s death till six months after her passing. He shares his Vietnam stories with me that not even his kids have heard. His daughter said she worries about him because he doesn’t talk about things. I told her on the ‘therapy swing,’ it comes out in buckets.

Everyone should have a therapy swing!

“The part I appreciate the most about him is that when someone has looked death in the face they live life to the fullest with no regrets and can appreciate the smallest things in life. As afraid as I am to be with someone who could have a re-occurrence of cancer, I think it’ll be worth it.

Besides, who better to do it? I walked one great man to his end of life and I know I can walk another great man.”

For Bruce, that first lesson we talked about—opportunity arises from adversity—happened. And Jo’s act of kindness to visit Bruce in the hospital—the bread cast upon the waters—came back to her in fulfilling her wish of calling him “friend.”

Mission Gala Nets $204,000 The Capistrano Dispatch

he Mission Preservation Foundation presented its spectacular Romance of the Mission benefit gala on September 16 featuring over 400 guests and netting approximately $204,000 in support of the Gate House Preservation Project and traveling exhibits.

The formal evening featured a concert in the ruins of the Great Stone Church with two-time Grammy nominee, baritone and actor, Rod Gilfry and honored The Reverend Monsignor Arthur A. Holquin.

“The evening was truly magical and we are one giant step further towards realizing the Gate House Project which will preserve the historic Sala building and relocate the gift shop to the street,” said Mission San Juan Capistrano executive director Mechelle Lawrence-Adams.

Tuttle Click 12th Annual Golf Tournament Raises $50,000 For The Boys & Girls Clubs The Capistrano Dispatch

uttle Click Automotive Group raised more than $50,000 for The Boys & Girls Clubs of Capistrano Valley at the 12th Annual Tuttle Click Golf Tournament held September 19.

The Tuttle Click Golf Tournament hosted more than 144 golfers at El Niguel Country Club, including 10 Marines from the city’s adopted 1/11 Marine battalion, who were sponsored to play.

Special guests in attendance included MLB baseball star, Bobby Grich and Henry Ford III. Proceeds from the event directly benefit youth ages 7 – 18 who attend the clubs and support activities and programs that promote and develop literacy, self-confidence, sportsmanship, leadership and character-building.

“We are very proud to sponsor this event and we feel fortunate to help make a difference to the youth in Capistrano Valley,” Saad, vice president of Tuttle-Click Automotive Group, said in announcing the tournament results.

SVCS Launches South County’s Only Middle-School Tackle Football Program Middle schools all over the county are preparing for the upcoming flag football season.

But at Saddleback Valley Christian Schools, players aren’t wearing belts with flags: They are dressed out in full football pads. SVCS is the first school in the area to have a middle school tackle football team. The new program is open to 6th-, 7th- and 8th-grade students and has a 10-game regular season. The Warriors will field a team of 36 players in their inaugural season. Their first game took place on Friday, September 9. The team’s home games will be played at J Serra High School. Saddleback Valley Christian had considered establishing a junior high tackle program for the past three years.
