SAN CLEMENTE San Clemente will ask federal agencies for more regular reports of radiation levels in the area, a decision that fell short of nuclear power foes’ expectations. The City Council voted unanimously Tuesday to ask its Congressional delegation for legislation that would increase the frequency of radiation reports. But the anti-nuclear contingent called for independent monitors and more of them.

Gary Headrick of San Clemente Green said the Nuclear Regulator Commission lacked credibility. After a presentation by city Emergency Planning Officer Jen Tucker on area radiological monitoring, City Council members said enough data existed but they wanted it sooner.Gene Stone of Residents Organized for a Safe Environment said his organization would organize a volunteer network to produce a real-time map of radiation levels.

Two burglars were filmed by video surveillance cameras as they broke into The Coffee Importers store at the Dana Point Harbor on Monday.

The two are believed to be responsible for a string of break-ins at Harbor businesses the same morning, authorities said. According to Orange County Sheriff’s Department spokesman Jim Amormino, deputies responded to a silent alarm at Coffee Importers just before 4:30 a.m. The burglars pried open the cash register, found it empty and left. The same men are believed to be responsible for burglarizing Jon’s Fish Market and El Torito as well as an attempted break-in at Harpoon Henry’s the same morning. A description of the subjects is expected to be released after authorities examine the surveillance footage from Coffee Importers and Jon’s Fish Market. Anyone with information about the burglaries should call 855.TIP.OCCS.

...Reusing a Historic Home?

THE LATEST: Hamilton Oaks Winery can use the city-owned 1923 Swanner House on Camino Capistrano for wine tasting, weddings and other events, the City Council decided Tuesday.

Hamilton Oaks offered $3,000 a month to use the property, which was purchased by the city after the 1990 Open Space Bond. The bond money limits how much revenue the city can generate through non-open-space uses on the land, but the city is nowhere near the cap.

The council approved the use unanimously, despite concerns voiced by Al King and Tom Ostensen, two members of the Open Space, Trails and Equestrian Commission. The men contended the proposals did not go through the proper commission vetting process, and the city needs an open space overall plan.

WHAT’S NEXT: The council directed City Manager Karen Brust to negotiate a contract with Hamilton Oaks, which was selected over a consortium of wine sellers and arts group for use of the property, north of Junipero Serra Road.

A special meeting of the open space and parks commissions was called for 6 p.m.

...Dumping the Desalter?

THE LATEST: San Juan Capistrano on Tuesday pulled out of a multi-million-dollar project aimed at turning sea water into drinking water.

The city had already put $662,961 into the project, which was launched in 2008 with San Clemente, South Coast Water District, Moulton-Niguel Water District and Laguna Beach. Municipal Water District of Orange County is providing the engineering and staff.

Capistrano’s decision came after member agencies were asked to pony up an additional $23,000 to finish mapping the groundwater basin, among other things.

The members will ultimately share a construction bill of more than $200 million.

A test phase is now drawing water from beneath Doheny State Beach.

Although Capistrano needs the study to determine how the desalter might impact the city’s Groundwater Recovery Plant, council members said the project has grown too expensive. The city’s GWRP operation is carrying a $5.3 million deficit.

WHAT’S NEXT: Karl Seckel, MWDOC assistant general manager, said the other participants will pay $28,000 each to make up for Capistrano’s absence.

Capistrano could recover all of its money if another agency buys in or if the project is ever built. Larry Kramer and Laura Freese supported the Utilities Commission recommendation to pay the $23,000, but the council majority rejected it.

... I-5 Carpool Lanes?

THE LATEST: The addition of carpool lanes on Interstate-5 from Avenida Pico to San Juan Creek Road will affect 10 properties in Dana Point and San Clemente.

Orange County Transportation Authority directors this month approved the acquisition of the two parcels in Dana Point and the other eight in San Clemente. The project will expand the freeway with high-occupancy vehicle lanes in both directions and reconstruct the Avenida Pico interchange.

The estimated cost to acquire the property is estimated at $6.335 million and the OCTA will offer to purchase the land based on their appraised value.

Property owners may counter offer, the staff report says.

...Changes at the Oaks?

THE LATEST: A proposal by Shea Homes to build 34 homes on the Oaks property off Ortega Highway could be the city’s first public vote on an open-space use change under Measure X. Shea Homes proposes building 34 homes and a commercial equestrian center on the 20-acre Oaks, which Joan Irvine Smith is selling. But the current proposal requires trading some privatelyowned land designated open space for other land within the project the area.

The amount of open space would actually increase from 10.3 acres to 10.5 acres.

Measure X requires voter approval to change the general plan designation for any land identified as open space.

WHAT’S NEXT: Shea’s formal application is not in, but the city is launching the general plan amendment in hopes the

issue can appear on the November ballot.

If the question is on the November ballot, the city picks up the cost, estimated at $10,000 to $20,000, while the developer would pay for any election, which could cost four times as much the staff said.

...A Potential Claim?

THE LATEST: The family of a teen killed in a fiery crash off Del Obispo Street is trying to file a late claim against the city, after their attorneys filed the claims with two wrong agencies.

Brian Ferguson was killed August 16 when the Jeep he was riding in sped north on Del Obispo Street, reportedly ran a red light at Camino Del Avion, then careened down the embankment toward the Marco Forster sports field. The Jeep slammed into a concrete building, however, and burst into flames. Ferguson was killed—sheriff’s deputies and others who tried to help could hear his cries but were stopped by the flames—while the driver, Alexander August Goodrich, 21, survived.

He was ultimately charged with vehicular manslaughter.

If allowed, the claim on behalf of Ferguson’s mother, Jo Anne, would allege a defect in the road or its design, the legal documents say. It seeks an unspecified amount, but more than $25,000.

WHAT’S NEXT: The council discussed the issue in closed session Tuesday. Goodrich has pleaded not guilty and has a hearing on March 29.

First Homes on Rancho Mission Viejo Expected in 2013 The Capistrano Dispatch

C

onstruction has started on the first village in Rancho Mission Viejo, comprised of more than 17,000 acres of permanent open space and 6,000 acres of future residential and mixeduse development, Anthony R. Moiso, president and chief executive officer of Rancho Mission Viejo, LLC, announced Wednesday.

The first village on the Ranch, just east of San Juan Capistrano, will be Sendero, scheduled to open in summer 2013.

Encompassing approximately 690 acres and offering approximately 940 attached and detached homes and 200 apartment units, Sendero will include the gated active adult enclave of Gavilan. That community will be 285 single-level residences adjacent to a private clubhouse and recreational facilities. Among the amenities planned for all Sendero residents are a central community hall, clubhouse and recreational core, a 15-acre community park, neighborhood parks, hiking/biking trails accessing Reserve trails and a County Regional hiking and biking trails network, a 10-acre retail plaza, fire station and a child day care center.

Rancho Mission Viejo, Orange County’s last working ranch, has been held in the O’Neill/Avery/Moiso family since 1882. Pursuant to a comprehensive County of Orange-approved open space preservation and land use management plan for the Ranch, approximately 75 percent will be preserved as part of a larger habitat conservation area known as The Reserve at Rancho Mission Viejo and 25 percent will be developed into multiple villages.

Combined with additional open spaces already dedicated by the Rancho Mission Viejo family, The Reserve will grow over time to nearly 21,000 acres. Ultimately, The Reserve will be combined with county-owned lands to form the 33,000-acre Southern Subregion Habitat Reserve, one of California’s largest and most diverse habitat reserves.

“Our partners, DMB Associates, and all of us at Ranch Headquarters, are honored, proud and excited to make this announcement today,” Moiso said in a statement. “For nearly 50 years, our family has kept our ranch intact, perpetuating our ranching and farming heritage while helping the region meet and manage its growth through the establishment of the planned communities of Mission Viejo, Rancho Santa Margarita, Las Flores and Ladera Ranch. Today, with the start of construction at this new village on the Ranch and the phased enrollment of land into The Reserve at Rancho Mission Viejo, this legacy of land stewardship continues.”

Multiple villages are planned to be developed on 6,000 acres of the Ranch. Collectively, over the next two decades, these villages are expected to offer 14,000 homes (including 6,000 active adult residences) and 5 million square feet of non-residential uses. In addition, schools, parks and recreational facilities, shopping and employment centers will be developed, as well as an inter-connected system of arterial roadways and hiking/biking trails carefully integrated with some of the Ranch’s agrarian spaces and natural habitat.

“Since 1882, our family has understood that the blessings of landownership are matched by our obligation to be a good neighbor and a responsible contributor to the community,” said Moiso. “This culture of care has been at the heart of every community we’ve created. It is the foundation of the ongoing development of Rancho Mission Viejo.”

Planning the Parade

Fiesta Association members donate about 10,000 hours getting ready for Saturday’s event

T

he theme of this year’s Swallows Day Parade is “How the West was Fun.” But after 53 years, getting hundreds of entrants ready to parade through downtown Capistrano in front of tens of thousands of spectators provides more challenges than chuckles for the all-volunteer Fiesta Association.

Like old West gunfighters, the Fiesta board of directors has dodged plenty of bullets this year. Within weeks of the parade, Capistrano was in the news for a highly contagious equine herpes outbreak, pistols were banned from a decades-old tradition and the City Council mandated the board allow a participant in a motorized wheelchair.

“There’s been more challenges than usual this year,” said Realtor Steve Weekes, the group’s El Presidente.

“We’ve never had, that I know of, new rules on Hoos’gow Day; never had to deal with equestrian herpes and never had to accept a motorized wheelchair before.”

But the equine herpes outbreak, which led to a stable being quarantined, is over. More than a dozen Fiesta members have spent about $100 for replica pistols to fire around town because of a new law that banned their real guns and those who use medically required wheelchairs are classified as “pedestrians” in the law, so the parade can continue its claim as one of the largest non-motorized in the country.

That list is on top of the usual worries: bringing in the $155,000 it costs to put on the annual parade. Fiesta counts on sponsors, who account for about $55,000. This year, just as he did last year, Ron Hanson of Sycamore Trails Stables donated $10,000—which Weekes said was critical to the parade.

Fiesta also has to marshal volunteers, from among its 175 members and the community, for parade day. They do everything from direct traffic to check in entrants. In an effort started last year to keep the parade on pace, volunteers will also walk the route carrying two signs, one reading “Whoa,” another reading “Giddy Up,” to spur entrants on.

So come 11 a.m. Saturday, some 3,900 walkers, 420 horses and 11 bands will be ready for the 54th Swallow’s Day Parade. They’ll be led by the western re-enactment group “Spurs and Satin,” as always, followed by a Marine Corps color guard and band, along with the city’s adopted battalion, the 1/11. A little more than two hours later, spectators who line the route will see the festive masked figures of La Danza del Chinelos and know another parade has drawn to a close.

Ben Dixon is this year’s Fiesta Parade Chairman, but the task of deciding who follows whom in the parade largely falls on the shoulders of Brenda Toomey.

Troxel, who has been sorting out the parade lineup for more than a dozen years.

There are a few rules she has to follow—the Marines, El Presidente and the City Council are up front, space the bands and equestrians apart to avoid scaring the horses and finish with the popular Danza del Chinelos—but for the most part there’s more art than science

to the work.

“Four of us sat down and spent three hours one Sunday night working on the lineup,” Weekes said. “There’s no formula, it’s more Brenda’s memory of what the entries are and where they should go that we count on.”

A Lake Forest resident, Troxel joined the Fiesta Association in 1994. She had attended the parade for several years before that, but didn’t think she could join Fiesta because she didn’t live in town.

Her future husband, Charley Troxel, had been involved with the parade for many years, but left for a job in Colorado in 1993 (just before Brenda joined).

Charley Troxel was a Señor San Juan in 2000 and his children were junior dignitaries as well; son Nick was Jr. Señor San Juan in 1991 and daughter Krystal was Jr. Miss Fiesta in 1992.

It wasn’t until parade day March 21, 1997 that Brenda and Charley happened to be in front of the Swallows Inn and struck up a conversation about someone who had a bit too much to drink. They were married just over three years later, on December 30, 2000, and have been involved with the Swallows Day Parade and Fiesta Association throughout their marriage.

Brenda was on the board in 1999/2000 as assistant parade chair and in 2001, she took over preparing the parade script and lineup for Mary Tryon, who had some health issues.

Through her tenure, the entry process has been moved to computers, allowing the information to be moved into a database, rather than culled by hand. About 98 percent of this year’s 165 entries—up from last year—were

entered electronically.

To organize the parade, Troxel and the volunteers sort all of the entrants into like categories—walking, horsedrawn floats, equestrians, bands, etc.

Then they lay in the required spots and begin sorting the other entrants, balancing the different categories over the four divisions. After the lineup is determined, volunteers write the scripts that 11 announcers read along the route.

“We move things around so it’s interesting throughout the parade, with a nice little flow of entrants from each category,” Troxel said. “We don’t put large groups of horses behind children, either. We try to be as safety-conscious around the horses as possible.”

Troxel’s seen changes in the parade entries over the years. When she started, maybe a dozen entrants were in horse-drawn floats. Now that number is up to 30, she said. And after budget cuts hit schools, the number of bands dropped to five or so around 1998. This year, there are 11 bands.

But there are some old standards, too. Yvonne Camarena, an equestrian rider, has appeared in 36 parades. The Shriners have been in about 25.

Troxel’s ready for a change, too. She’s starting to transition out of the lineup work, ready to turn over the reins to someone new. Maybe not surprisingly, her philosophy about moving on also could apply to the parade.

“When I came in, I made changes for automation,” Troxel said. “Now, a new person can come in, or a committee, and come up with new exciting ideas. It’s always important to keep things moving.” CD www.thecapistranodispatch.com

Council Deals with Bull

S

ome elected officials may believe they put up with a lot of bull. Some members of the voting public may believe elected officials create a lot of bull. But there was no doubt Tuesday at San Juan Capistrano City Hall, where the city was discussing bull.

One bull specifically—Romeo, who for the past few years has occupied a spot at the Camino Real Playhouse during the March 24 Swallows Day Parade, billed as one of the nation’s largest non-motorized parades. But this year, the city wanted a permit for the bull, and one parade official objected to the idea of any more bull around town that day.

“I am not trying to be a bad neighbor to (playhouse president Tom) Scott,” wrote Kathy Hooper, who oversees the Mercado sales area on parade day. “I

just am not comfortable having a live full size, tame or not, unpredictable bull at this site.”

Scott said the playhouse, on El Camino Real fronting the Mercado area, doesn’t make any money off Romeo, but folks like to take their photo with the bull and kids can climb on him. He was bullish on Romeo, who generates publicity for the nonprofit.

Scott said he’d paid a bull fee of $60 to the city, another $80 to the county and had secured a $1 million insurance policy—a bull rider.

“The council deals with more than enough bull under normal circumstances and the issuance of this bull permit should be granted with a minimum of investment of time from the council,” Scott wrote to the city.

That was enough for the council majority, which voted 4-1 to approve the bull. CD

JAN SIEGEL: Moments In Time

March is Famous for Swallows—and More M ore than just the swallows have made news in San Juan Capistrano in March. And in 1969 a lot more happened.

It really starts with JAN SIEGEL Giovanni da Capistrano.

He was born on June 24, 1386 and died October 23, 1456. He was known as a preacher, theologian, inquisitor, lawyer, judge, governor, and ambassador. He earned the nickname “Soldier Saint,” when in 1456 at the age of 70 he led a successful crusade along with the great Hungarian general, Janos Hunyady, against the Ottoman Empire’s siege of Belgrade.

After being captured and spending time in prison, during a war between Perugia, where Capistrano served as governor and ambassador, and Malatesta in 1416, he started studying theology. He entered the Franciscan order on October 4, 1416.

He was beatified in 1694 and canonized in 1724. However, he was not mentioned as a feast day until 1890 when the Roman Catholic calendar of Saints assigned March 28th as St. John of Capistrano feast day. In 1969, Pope Paul V1, moved his feast day to October 23, the day of his death. According to Monsignor Art Holquin of Mission Basilica, feast days of a Saint are normally on the day of their death, which celebrates their birth into heaven. Ironically, October 23 is when, by tradition, the swallows leave San Juan Capistrano.

Also, on March 22 1969, Richard Nixon rang the Bell of San Rafael at the Mission to commemorate the return of the swallows. This was also the first time that Nixon ate at El Adobe

Following this visit, Nixon purchased a Spanish style estate in San Clemente that became known as the Western White House during his presidential years. During his visits to San Clemente, he always made time to dine at the El Adobe. There still is a menu listing of the President’s favorite foods.

In 1969, the Swallows Day parade was scheduled for March 15. President Nixon is listed in the program as a special guest along with the Grand Marshall, George Putnam. The Secret Service would not allow the President

to ride in an open carriage, so he was allowed to ride in a car. However, the parade that year was canceled because of a tremendous rain storm that hit southern California. It was the only time that a parade was actually canceled. But, because the President was in town, he was able to go to the Mission. Interestingly, the Fiesta de las Golondrinas Coastline Dispatch edition of 1970 features President and Mrs. Nixon on the front page signing the Mission register the year before.

And the Swallows Day Parade in 1969… that was held on Saturday, April 19.

ON STAGE: TODD SNIDER COMES TO COACH HOUSE Todd Snider’s music isn’t the sort you have playing in the background on a peaceful evening. That’s because Snider doesn’t want his music to relax you; he wants it to inspire you—to fight conventional norms, to think a little differently or just feel better if you already do. To those who have never heard him, the newest album title from the Oregon-born, East Nashville-based singer-songwriter is a good insight into what he delivers: Agnostic Hymns & Stoner Fables. It’s Snider’s 12th album. In the album, Snider credits the church with sustaining peace by noting that, “We still need religion to keep the poor from killing the rich” (In The Beginning). There’s one on warped karma, “Good things happen to bad people,” he sings in New York Banker). There’s one happy love song, called Brenda, about Snider’s favorite couple, Keith Richards and Mick Jagger. That’s another Snider hallmark: He’s witty and he’s funny. And in this album, he’s honest. “This record doesn’t come from good times,” Snider said in a release. “I wanted to sound the way I feel, which sometimes means sounding like a Courtesy photo broken soul. Thousands Turn Out for St. Joseph’s Day at Mission Jonathan Volzke The Capistrano Dispatch

B

eautiful blue skies—and even some of Capistrano’s famous swallows—welcomed thousands of visitors to the Mission’s St. Joseph’s Day Celebration on Monday.

The day was filled with music, history and good food. Mission Executive Director Mechelle Lawrence-Adams welcomed visitors as the bells were rung in a traditional manner throughout the day.

Mission Basilica School’s Erica Delamare and Sean Agbayani presided over the school’s 2012 Royal Court during the traditional festivities and will also appear in the Swallow’s Day Parade Saturday, March 24.

The 2012 Royal Court consists of eight eighth-grade students who embody “excellence” on all levels, academically and spiritually, and represent the finest youth of MBS’s pre-K through eighth grade student-body. Princesses are Sarah Allender, Gigi Hernandez and Natalie Najera. Princes are Conrad Hirose, Robert Forster and Jared Wit. Delamare, 14, of San Juan Capistrano was selected as Queen of the Royal Court because of her exemplary scholastic achievements and commitment to

community service. Erica is president of the Student Council, historian for the SJC Youth Advisory Board, a principal character in the school’s upcoming production of the musical “Seussical Jr.,” an altar server, musician and cantor. Not surprisingly, Erica’s grades rank highest honors. She reflected on her years at MBS by commenting, “I am forever grateful to Mission School for the leadership opportunities it has provided; it has given me confidence to strive for the best.”

Agbayani, 14, of Trabuco Canyon, has an equally glowing record at Mission Basilica School. He is the recipient of the notable St. Francis Scholarship Award for math and science, which was underwritten by Art and Gaye Birtcher of Capistrano. He is the Spelling Bee first place winner, Academic Decathlon Logic captain, an avid soccer player, and is working on his Boy Scout Eagle Rank. Sean’s grades also rank him as a highest honors student and he is quoted as saying “MBS is unique,” Sean said. “I think that faith-filled environment, supportive faculty and numerous accelerated programs provided an environment that inspired me to work hard and to set lofty goals.” Sean said his success “is the result of God’s love because with God, all things are possible.” CD

COUNTRY WESTERN BBQ AND CONCERT SET The Capistrano Dispatch

he Silverados, a country western band that recently opened for Tim McGraw, will headline a dance, barbecue and concert at the Mission Basilica on April 14.

Proceeds from the event benefit the Msgr. Paul Martin Council Knights of Columbus.

Tickets for the barbecue start at $10, while concert tickets run from $15 to $50, depending on the package.

JSerra Takes Hockey Title The Capistrano Dispatch

A

naheim-JSerra Catholic High School defeated Santa Margarita Catholic 3-2 to capture the Anaheim Ducks High School Hockey League (ADHSHL) championship on March 6 at Honda Center.

More than 1,000 fans watched the championship games.

Santa Margarita went undefeated in league play (8-0), finishing atop the league and earning a bye to the championship game. The Eagles were the highest scoring team in the league with 46 team goals. JSerra advanced to the finals after defeating Servite High School, 2-1, in the semifinal contest on Feb. 25.

JSerra came into the championship game as the underdog but jumped out to an early 1-0 lead with a goal from Joseph Pauluzzi, but Santa Margarita came back to tie the game with a power play goal from Kyle White.

“Joe (Pauluzzi) has been a true leader for us all season,” JSerra Head Coach Mike Perkins said. “It is fitting that he scored the first goal and then cleared the puck out of our zone with five seconds remaining to ensure our victory.”

FL Flag South Orange County has a few spots remaining for their Spring Season of flag football beginning April 21 at Capistrano Valley Christian School in San Juan Capistrano.

The season runs for seven Saturdays, with the final tournament on Friday night June 15, under the lights at Dana Hills High School.
