SAN CLEMENTE The Orange County Board of Supervisors approved a settlement Tuesday in the case brought by the family of Sgt. Manuel Loggins, the Marine shot to death in February 2012 at San Clemente High School. The clerk for the board confirmed that the supervisors had unanimously agreed to a settlement in closed session. Deputy Darren Sandberg was cleared of any criminal wrongdoing by the Orange County District Attorney’s office last October.

The Association of Orange County Deputy Sheriff’s issued a release noting increased emphasis on training with non-lethal options. The DA’s office investigation noted that Sandberg did not have a taser or any less lethal options available at the time of the shooting. The settlement is still “subject to the final approval of others,” according to the clerk of the board.

DANA POINT Local advocates seized the public comment period at last week’s meeting of the Dana Point City Council meeting to urge leaders to address a lack of resources available to area homeless.

The largest shelter in the area at Capo Beach Church closed its doors shortly after the city began enforcing a 10-bed zoning restriction in 2010, something members of the San Clemente-based iHope have asked the city to reassess. Joseph O’Connor, a 40-year resident of Dana Point, spoke to the council and displayed the death certificate of Brandi Fox, a woman who died in a Capistrano Beach alleyway in February, as proof of the city’s need for an emergency shelter. City Manager Doug Chotkevys said he had also reviewed Fox’s death certificate and found she had died of alcohol poisoning, not as a consequence of homelessness.

...the Support for Local Businesses?

THE LATEST: The City Council on Tuesday, April 16, showed further support for local businesses affected by the Interstate 5/Ortega Highway interchange construction project by unanimously approving citywide fee reductions, new wayfinding signs and relaxed sign standards.

The council expanded its March 19 decision to cut special activities and park use fees in half citywide for all non-sports events. The reductions previously applied only to activities within the Historic Town Center area, which comprises most of downtown.

In separate agenda items, the council also approved flexible standards for temporary signage for citywide businesses and the installation of new wayfinding signs at key intersections to direct traffic toward businesses. The Orange County Transportation Authority will foot the $6,000 cost for the wayfinding signs.

WHAT’S NEXT: The relaxed standards are effective immediately and are good for 45 days. They can be extended for up to two years. The city will also be providing a uniform banner template businesses can use without a permit or fee.

…the Zoomars Dinosaur?

THE LATEST: Zoomars Petting Zoo owner Carolyn Franks has agreed to give up her controversial apatosaurus replica to the owner of the Grand Canyon Caverns, The Capistrano Dispatch April 26–May 9, 2013

located on historic Route 66, in Peach Springs, Ariz.

The Grand Canyon Caverns encompasses 800 acres and is the largest dry cavern in the country. It was formerly known as “Dinosaur City” and still features several dinosaur replicas.

Following the City Council’s decision on April 2 to deny an appeal to save the dinosaur, Franks said she was flooded with phone calls, emails and letters from interested buyers, including theme parks, car dealerships and schools.

Franks said she decided to give up the dinosaur to the Grand Canyon Caverns at no cost—despite remaining payments on an initial $12,000 purchase—because of the attraction’s previous life as Dinosaur City.

WHAT’S NEXT: The city has given Franks until May 3, at 1 p.m., to remove the structure. Franks said the dinosaur will likely remain at Zoomars until the end of April.

…the Northwest Open Space Park?

THE LATEST: The City Council on Tuesday, April 16, reviewed 3-year-old plans for a proposed 13-acre park on 60 acres in the Northwest Open Space.

Conceptual plans for the first phase of the park, along with a $2.8 million price tag, were approved by the council in 2009. Those plans were effectively shelved when in 2010, when city staff was reassigned to develop a new park in the East Open Space.

City staff sought the council’s input to

update the plans since other additions nearby have changed the landscape of the area. The cost of the project has also gone up, after a budget adjustment pushed the price up to $3.68 million, of which $2.45 million is funded.

The council made adjustments to the existing plans, including cutting the number of community gardening plots in half to add organic gardening, reducing the number of horseshoe pits to two and adding two bocce ball courts.

WHAT’S NEXT: The city is currently in discussions with the Moulton Niguel Water District to extend an existing sewer line to service the park, according to Keith Van Der Maaten, the city’s utilities director. The plans will now move onto the commission review process.

…CUSD Staff Cuts?

THE LATEST: The Capistrano Unified School District Board of Trustees on Wednesday approved cutting 61 nonteaching positions due to budget reductions, although only 32 employees will actually be affected by the cuts.

Jodee Brentlinger, assistant superintendent for personnel services, told the board that nearly half of the positions were currently vacant, and with funding uncertain it was best to eliminate them.

Among the staffed positions being eliminated, a number were instructional assistant jobs and positions in the district’s bilingual programs. Trustee Ellen Addonizio opposed the measure.

proved spending more than $1.6 million to outfit 36 additional campuses with wireless internet connectivity upgrades.

Twenty schools, including San Clemente, Dana Hills and Capistrano Valley high schools, were upgraded between 2010 and 2012. The district will be going to bid this winter on connectivity services.

…the Delayed Harkey Jury Trial?

THE LATEST: Opening arguments in the civil trial against the husband of State Assemblywoman Diane Harkey began Monday, April 15, in Santa Ana. Dan Harkey is being sued by a number of investors in Point Center Financial, his real estate investment company.

Investors claim funds from the company were used to fund a lavish lifestyle for the Harkey family, as well as Diane Harkey’s political career. After Diane Harkey announced intentions to run for the State Board of Equalization in 2014, the same investors called on her to resign from office.

WHAT’S NEXT: Attorneys for Dan Harkey maintain investors were not victims of fraud, but instead lost money as others did during the real estate crash. They also contend that Diane Harkey had no involvement with the company. The trial is ongoing.

No Stopping This Kid Bright future ahead for Boys & Girls Club state Youth of the Year winner

B

ack in the fall of 2000, on what was his first day of school at Del Obispo Elementary, young Yossymar Rojas was so frighteningly lost, he couldn’t utter his own name during the morning roll call.

How could he? After all, English was still a new language to Rojas, who was born in Mission Viejo but only spoke Spanish at home with his parents, Luis and Lourdes, immigrants from Pueblo, Mexico.

So when the teacher and nearby students asked him, “What’s your name?,” all Rojas heard was jargon. What’s worse, he was in the wrong class.

“I spent the first two hours in the fourth grade and I didn’t know they were asking me for my name,” Rojas said. “Other kids started catching on and asked me my name in Spanish.

That’s when they realized and took me to the kindergarten area.”

Just getting to school that morning had been a puzzling experience, said Rojas. His parents knew the bus—not the school’s but the Orange County Transportation Authority’s bus—would take their son in the general vicinity of the school, so they put him aboard and sent him on his way.

“My parents had no knowledge of the education system. They probably thought a teacher would be outside and say, ‘Welcome to Del Obispo Elementary,’” Rojas said. “I was completely confused.”

The first few weeks and months were “a blur,” Rojas said. By the third grade, he had made the transition from speaking intermittent English to speaking it with more fluency. But communication with teachers and schoolmates still proved challenging and made him a target for bullying.

“When I look back, it must’ve been because I was different. I couldn’t get my ideas across,” Rojas said. “The bullying led to a sense of shyness.”

Whatever reservations Rojas felt didn’t stop him from succeeding in the classroom, where he excelled in math and was placed into an accelerated course. By the time he reached the sixth grade at Marco Forster Middle School,

Rojas, who’s known by friends and family as “Yossy,” had become fluent in English and more comfortable speaking with others.

It’s around that time that fate dealt Rojas a fortunate hand—or rather, the image of two hands clasped—in the form of the Boys & Girls Club.

Rojas’ parents, who both worked long and irregular hours—Luis as a restaurant busboy and Lourdes as a nanny— didn’t want their son walking home alone from school. Instead, they sent their son to the Boys & Girls Club of Capistrano Valley, just across the street from Marco Forster.

“I remember just looking at the club from the outside and seeing hundreds of kids walk in. Just because I was bullied as a kid, I thought anyone of the kids could bully me,” Rojas said. “In fact, they were all inviting and genuinely kind. I seriously think it was just a week in that I realized the kids were alright and the staff was amazing.”

To say Rojas simply did well at the Boys & Girls Club would be a gross understatement. As a member of the club’s teen program, Keystone, Rojas has become a leader among his peers and to the club’s younger members. Through Toastmasters, he’s shed his former shyness and has become an adept public speaker.

What’s more, Rojas has broken new ground at the club. In February, Rojas, now a senior at Dana Hills High School, Page 4

was named the club’s Youth of the Year. In March, Rojas’ story of overcoming a language barrier, shyness and bullying earned him the county Youth of the Year honor—just the third member in the club’s history.

And it hasn’t stopped there.

Just this month, Rojas became only the second Capistrano Valley club member to win the state Youth of the Year award, beating out eight other contestants. Along with the award, Rojas received a $15,000 scholarship from the Boys & Girls Club of America, two round-trip tickets to anywhere in the country and an additional $10,000 scholarship from the California Youth of the Year Alliance. In total, Rojas has received more than $27,000 in scholarship money. He’ll have a chance to add to that in July, when he faces off against eight other state Youth of the Year winners in the Pacific Region competition.

“This is one of the best highlights, not just for me, but for the entire club,” said James Littlejohn, who’s been the executive director of the Capistrano Valley club for 12 years. “I was able to learn a lot about Yossy throughout this process. The future is so bright for him, but he’s very humble. He knows where he wants to go, but he hasn’t forgotten where he comes from.”

Rojas has a small handful of people to thank for their help and mentorship, most notably his family and the staff at

the Boys & Girls Club. It started with his older cousin Julio Moreno, who Rojas calls a “trailblazer” in his family.

When Rojas was still learning English, Moreno, who is four years older and recently graduated from San Francisco State, tutored his cousin and helped him with his homework.

“He was always more of a brother,” Moreno said. “In a way, he’s kind of become the representation of our family and having contributed to that is such a great feeling. I’m very proud of him.”

Throughout the Youth of the Year process, which involves public speaking and interviews, Rojas had the advantage of having some experienced coaching on his side. His mentor, Navid Rastin, was a club member turned staffer who won the county Youth of the Year award in 2007.

“We connected because he was so competitive, not just in the gym, but in everything,” Rastin said. “When he started high school, that’s when I started to see him really focus on what he was doing and where he wanted to go.”

Where Rojas is now is near the top of his class. Rojas has a 3.92 weighted GPA to his credit, along with nine Advanced Placement classes and four years of track and field and cross country.

Where Rojas is going is UC Irvine, where he intends to study biomedical engineering.

“A simple explanation would be I’d help amputees,” Rojas said. “I’ve been taught that helping out people is an amazing thing, so biomedical engineering was something I was really interested in as a potential career.”

When he graduates in the spring, Rojas will become the first person in his family to earn a high school diploma.

Lourdes Rojas said her oldest son has become a role model for her youngest children, Yaradset, 15, and Luis, 8.

“The values we instilled in him at a young age have made all the difference.

I’m happy to see the seed we planted has borne fruit,” Lourdes Rojas said through her son.

“Looking back, I know I couldn’t have done everything without those people— my family and the Boys & Girls Club,” Rojas said.

Even after he moves on to college, graduates and continues along his upward path, Rojas said he’ll remain an active presence with the club. One of his goals, he said, is to become financially successful enough to support the club in the future.

“I want to make sure this club never closes its doors,” Rojas said. “If the Boys & Girls Club could change that shy and confused kid into the person I am today, they can do that with everyone.” CD www.thecapistranodispatch.com

Marco Forster LA Marathon Runners Recognized

Police Services Offers Prescription Drug Take-Back Day

The San Juan Capistrano City Council on Tuesday, April 16, recognized 33 Marco Forster Middle School students, along with teachers and volunteers, who participated in the LA Marathon on March 17.

“They endured blisters, sore limbs and ‘the wall,’” said Mayor John Taylor, whose own daughter Claire, a former Marco Forster student now at San Juan Hills High School, ran the 26.2 miles through Los Angeles. “It’s a life changing event. I know it was for my daughter … Taking part in the marathon helps students feel a sense of belonging, and they learn to set long term goals in a society where everyone wants instant gratification.”

Taylor presented each student with a certificate of recognition and also acknowledged the teachers and volunteer coaches, who led students in workouts, three to four times a week, in preparation for the marathon and ran alongside their pupils on race day as well.

“It’s really amazing to see kids who are 12, 13 and 14 years old, training for six months to do something that’s extremely painful,” Principal Carrie Bertini said. “The sense of accomplishment when they finish is the reward for the work that we do with them.”

City Recognizes Retired Fire Chief Rick Robinson, San Juan Capistrano’s fire chief since 2007, was recognized by the City Council on Tuesday, April 16, for his retirement after more than 35 years of service with the Orange County Fire Authority.

Robinsons served as fire chief for Division 3, which covers San Juan Capistrano, Dana Point, Mission Viejo, Rancho Santa Margarita, San Clemente, Modjeska Canyon, Trabuco Canyon and portions of Cleveland National Forest.

“To say that he met his quota for public service is simply an understatement,” Mayor John Taylor said. “This is a man who has seen and done it all and has been Page 6

committed to the safety of others for more than three decades.”

Robinson recalled that as a youth, he and his father often visited San Juan Capistrano from their home in Garden Grove.

He later moved to south Orange County, attended San Clemente High School and said he often visited the drive-thru theater in San Juan.

Before becoming division chief, Robinson worked out of Station 7 in San Juan Capistrano twice before, first as a paramedic in 1982 and then as a captain a few years later.

“San Juan Capistrano has always been a special city to me,” Robinson said. “Much like the swallows, San Juan Capistrano is a place I keep returning to. Hopefully, you will allow me to keep returning.

“I’m very excited to watch the growth.

Thank you for letting me be a part of this city,” Robinson said.

Chief Kirk Wells took over Robinson’s post late March.

Equestrian Coalition Hosts 3rd Annual Kentucky Derby Hat Party The San Juan Capistrano Equestrian Coalition’s 3rd Annual Kentucky Derby Hat Party will take place Saturday, May 4, at Regency Theater.

Guests are encouraged to wear their fanciest derby hats to celebrate the 139th running of the Kentucky Derby, known as “the greatest two minutes in sports.” The guests with the best hats will be eligible for prizes. The race will be displayed live on the big screen and will be followed with a screening of National Velvet.

Deputies responded to a vandalism call and arrested a suspect. A 46-year-old male construction worker was taken into custody and booked into the Intake and Release Center. He remains behind bars at Central Men’s Jail on $20,000 bail and is scheduled to appear in court on April 26.

TRAFFIC ACCIDENT Ortega Highway/Rancho Viejo Road (5:38 p.m.) Deputies responded to a three-car traffic accident involving a 1999 silver Mercedes, a white Nissan Altima and a black Toyota Tacoma, between Rancho Viejo Road and Interstate 5. No injuries were reported.

or more than two centuries the American nation has been evolving its way through an astonishing central thesis: that every human is endowed with inalienable rights, the most essential of which are electing representatives and living in a free, self-governing society.

What most governments have always feared was that giving every citizen full freedom and equal rights, would result in loss of all control—where those who were not in the “ruling class” would run riot in a state of anarchy. The United States proved them wrong.

But the proof that humans can self-

govern in a land of liberty is rooted not in our ability to exercise our freedoms to the extremes, but to restrain from pushing the envelope to the breaking point. We are currently WAVELENGTHS

Whether we cheat on our taxes, drive after drinking, pad our expenses, let our dogs out without a leash, abuse drugs, pour our used motor oil down the storm drain or just exploit a loophole that won’t be quickly noticed, our lack of self-restraint slowly erodes our freedom. But when we allow our financial institutions to steal billions from our savings, our politicians to be influenced by the highest bidder, or our corporations to endanger our safety, we run the risk of a collective failure of control.

It is easy to be excessive, undis-

ciplined, greedy, selfish or reckless.

What is the great challenge in a free and open society is to have the selfcontrol not to be all of these things. It is the great experiment of the American century. Can we actually do the right thing without being involuntarily forced to do so? The final answer remains to be seen.

Each time we as individuals or corporations fail to show self-restraint or practice honesty in our own actions, we push others to do it for us. When we as businessmen or citizens do not exercise self-control and respect for the safety of others, we invite regulation to insure these things are secured. And our collective failure to impose ethical behavior on ourselves brings increased rules and restrictions.

Want a financial system that does not have Feds breathing down financier’s necks? Have Morgan Stanley’s brokers stop betting against the home loans where if the home owners failed,

brokers made more money than if they made their payments.

Want a set of elected representatives who do the best thing for our country or our city? Don’t shout them down when they have the courage to come and openly discuss the problems we all face.

It’s been said that one of the penalties for refusing to participate in society is that you end up being governed by your inferiors. In people as in nations, selfcontrol is the quality that distinguishes the fittest to survive.

Letters to the Community NEW GUN LAWS UNNECESSARY —Charles Bolt, San Clemente A lot has been said, done and promised in the last couple of months concerning gun control. First to point out the obvious, what is needed is people control. Guns are inanimate objects that only do what people make them do. Secondly, and probably more important, is the fact that we have over 28,000 gun laws already on the books and it is still believed that we have a gun problem in this country.

we will do what? Let me remind us all of the true definition of insanity: Doing the same thing over and over and expecting a different result. All new gun laws do is remove firearms from the hands of law abiding citizens—not from those who will use them randomly or without forethought as to the consequences of their actions.

Owning firearms is not a privilege as is driving. A right can only legally be forfeited by neglect or abuse. We do not enforce the laws that we have on the books now, so putting more on the

books will not solve the problem but make it harder for law enforcement to their job.

The problem is we are no longer a nation of laws but a nation, and more importantly a state, of lawyers.

Politicians promise the moon only to deliver platitudes and faux finishes. It is very much like giving the homeless person a dollar at the freeway off-ramp and say in our heads that we made a difference today. That dollar may help to ease our discomfort about the way we live our lives or make us feel good

in the moment, but it really does little to truly help a person without a place to sleep.

Passing laws in the light of recent tragedies only serves to make us feel better in the short term but does nothing to truly change the problem of the status quo. Remember the difference between the rut and the grave is that often we settle for doing things the way we have always done them. Letters to the Community ZOOMARS OWNER DIDN’T FOLLOW THE RULES —Marie Evans, San Juan Capistrano I was reading your article on the dinosaur and find it amazing that there is so much to say about a 40-foot-long dinosaur.

You might ask, “What does a dinosaur have to do with historic San Juan Capistrano?” Nothing at all. The fact that Ms. Franks has spent thousands of dollars on this case is amazing. She could have saved herself all this by simply going to the city and getting a permit and permission to bring a dinosaur into the Los Rios Historic District. She had to get a permit to open Zoomars, so she knows what the city require permits.

Most cities do, but she chose to ignore this simple fact.

This is simply a case of “Do what you want and ask for forgiveness later.” I applaud those on the city council that voted against this dinosaur. If this was allowed to stay, one might ask themselves, “What’s next?”

FAITH A FUNDAMENTAL PART OF NATION’S HISTORY —Steve Cotugno, San Juan Capistrano In Patrick O’Brien’s guest opinion article (“‘In God We Trust’ Letter Exposes Right Wing Play,” April 12, 2013), Mr. O’Brien quotes from the U.S. Constitution and implies that the words “In God We Trust” in a public space are somehow unconstitutional. In fact, the U.S. Supreme Court has never so ruled. The words “In God We Trust” are the national motto of the United States of America, adopted by Congress July 30, 1956. The phrase has appeared on America’s coins for over 150 years.

America’s founders did not intend to eliminate all reference to God in the public sphere. Rather, acknowledgement of God at all levels of government has existed since the founding of the republic. At the beginning of each Supreme Court hearing, the Court Marshal cries out, “God save the United States and this Honorable Court.” The U.S. House and Senate have chaplains who open each session with prayer.

Many city council meetings, even in California, begin with prayer. And the state constitutions of all 50 states acknowledge God. In addition, here are just two of many quotes of our founders that support acknowledgement of God in our government: On October 11, 1798, President John Adams, in a letter to the 1st Brigade, 3rd Division of Massachusetts’ militia declares point blank, “Our Constitution Page 11

was made only for a moral and religious people. It is wholly inadequate to the government of any other.”

On November 11, 1179, Thomas Jefferson, as Virginia’s governor, proclaimed a day for “Public and solemn thanksgiving and prayer to Almighty God … that He would establish the independence of these United States upon the basis of religion and virtue.”

Those who would seek to remove all reference to God in public places are simply guilty of the same intolerance they claim to abhor. They seek to isolate and alienate people of faith and impose atheism on the rest of society. No doubt their efforts have had a significant impact, but it is time for people of faith to stand firm against this intolerance and very anti-historical understanding of who we are as American citizens.

The founders recognized the societal good that comes from acknowledging a benevolent creator greater than ourselves. They recognized rights are inalienable because they come from God. If rights came from man, then man could simply take them away. Failing to acknowledge the source of our human dignity and fundamental rights is then a dangerous threat to our democratic way of life.

IN DEFENSE OF ‘IN GOD WE TRUST’ —Ben Townsend, San Juan Capistrano In response to Ruth Clark’s initial letter and others just recently, i.e. Janet Holtz and Patrick O’Brien, it appears they are lacking in their understanding of this country’s biblical heritage. But of course, with the current course of direction this country has taken from the liberal and secular left, it’s not surprising. Clark comments, “the ‘In God We Trust’ display … has no place in our City Council chambers,” and I disagree whole-heartedly, as our country has forgotten its historical roots and foundation. These words are our reminders of our founding fathers’ guidance for this nation.

Clark wrote that the John Birch Society, Tea Party, the Birthers and religious right are chipping away at our freedoms—wow, Ruth. These organizations are the very ones trying to instill and restore our rights. The liberal left and secular humanists are the ones taking the liberties of this country away.

Fact: Just recently, a high school in California, along with others throughout the country, restricted students from using the word “Easter” with respect to the past holiday, and we all know and hear about the “Happy Holiday” (Cont. on page 12) www.thecapistranodispatch.com

(Cont. from page 11) expression replacing “Merry Christmas.” I can guarantee you, Ruth and others, that the Tea Party or religious right had nothing to do with that. The secular humanists are forcing this down our throats. So, Ruth, who is the real force behind us, living their way of life?

In regard to her comment that “American is going bankrupt like Greece”—That, my dear lady, is all due to our government becoming a country of entitlement and not the wonderful country of hard working people as she expresses. As you so endearingly commented, yes, back in the Depression era, our countrymen worked hard and labored hard for their freedoms and way of life, all without the entitlement programs or taxes we now endure and suffer.

Mr. O’Brien wrote, “the Constitution of the United States provides for a separation of church and state. Some folks don’t seem to get that. Our city council doesn’t.” Well, let me correct him a bit.

First and foremost, the term “separation of church and state” is nowhere mentioned in our Constitution. Thomas Jefferson penned those words to the Danbury Baptist of Connecticut in 1802 to dispel fears of the Connecticut government instituting a state religion and thus keeping the state out of the business of the church, not the other way around. The real words of the Constitution read, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.” This is why the people left England and ventured to the Americas for free exercise of their religious beliefs. Our founding fathers drafted the Constitution to keep government out of the state affairs of religion—not to keep religion out of the affairs of the state.

But unfortunately, liberal judges and their ideological ideas have interpreted to be just that and thus given cause for debates as such. However, the fact remains that the clause “separation of church and state” is not in our Constitution.

So, Ms. Clark, I’m surprised a lady in her 80s, having endured the Depression era, has forgotten what really made this country great—hard work and a moral conscience, which this country has completely lost since 1963. That was the year the secular left removed the Bible and prayer from our school system. Let’s see—how great is our country doing?

health care. Google how the US ranks with respect to the world on teen pregnancy. Yep, you guessed it. We are on top. For you educators out there, what picture does this paint?

It’s not rocket science to see that since the free love movement of the 1960s that our children and our heritage have gone in the toilet. Our school children are exposed to violent video games and music and know more about the ingredients in a Big Mac or last year’s winners of “American Idol” than the heritage of this great country. And yet many wonder why suicide and violence among our children and adults are so prevalent in this country.

Lastly, Ms. Clark mentions her entitlement of opinion deemed protected by the First Amendment, which of course is very true and a great quality of the foundation of this nation. But opinions are just that—opinions. So let’s look at the facts, and here’s one for you all.

Read the words of California’s state constitution: “We, the people of California, grateful to Almighty God for our freedom, in order to secure its blessings, do establish this Constitution.”

This reference, whether it be “God,” “Creator” or “Supreme Leader,” is in all 50 state constitutions.

So, Ruth, if we want to continue on polluting our nation with immoral values and a toilet lifestyle, then by all means, let us remove “In God We Trust” from our city council chambers and let’s see where it gets us. Let me make a prediction here: Our country is only going to get worse, and a lot worse if we don’t restore this nation to “In God We Trust.”

Everything is sold now or for sale, as I try to recoup my monies lost with Dan Harkey of Dana Point—husband of Assemblywoman Diane Harkey, who is running for the Board of Equalization—and his trust deed company, Point Center Financial of Aliso Viejo. The $40 million suit is for fraud, financial elder abuse and running a Ponzi scheme.

As politicians banter about less regulation needed in business, I blanch at the devastating prospects of just such a move.

Recently I heard Diana Henriques, author of The Wizard of Lies: Bernie Madoff and the Death of Trust speak in Rancho Mirage.

She also bemoaned the fact that there is such talk, and warned of many more Ponzi schemes out there since savings account interest is so low.

“Even a 2 percent return from a shady firm will seem attractive,” she warned.

I am embroiled in litigation, delays and costly maneuvers because Point Center Financial declared bankruptcy.

Recently, Dan Harkey wrote me a letter accusing me of “sleazy tactics” for contacting newspapers about the litigation.

I would think he would love his day in court to prove his innocence, but it has been delayed year after year after year.

I wonder why there is talk of colonizing the moon when there are so many problems right here on our earth. The earth I was so fortunate to have seen while I could.

THE WORLD THE WAY I SEE IT —Kurt Sipolski, Palm Desert When I was a little boy bedridden from polio, my parents did everything they could to lift my spirits while other little boys were outside playing.

They flashed on the idea of foreign coin collecting. My stepfather gathered his European coins from WWII. My grandfather, who was a Colonel, in WWI sent his. Relatives and neighbors gave me theirs, scavenged from some corner of a drawer.

Soon I had rubles from Russia, a coin from Zanzibar (Where was that?

I searched my globe) and paper pesos from Japan (Japan had pesos?) and hundreds of others.

It was a hobby that became my life.

Many years later, and free from the constrictions of leg braces, I set out to see the world from whence those coins came. I collected other things along the route—a pale white bowl from the

We have done fine without San Onofre for over a year now. Those responsible for making sure that our electricity is available to us have confirmed that we will have a surplus of energy even without San Onofre coming back on line.

San Onofre was originally slated for permanent shutdown in 2013. We must accept that it will not last forever, even though its tons of radioactive waste most certainly will.

Japan’s ongoing nuclear disaster proved that man’s ability to predict the forces of nature is woefully inadequate.

Old nuclear power plants in earthquake and tsunami zones are a bad idea.

The Nuclear Regulatory Commission (NRC) clearly has shown that it favors the industry over public safety. How else can you interpret their recent declaration that San Onofre poses “No Significant Hazard” if it is allowed to operate at 70 percent power, but can’t run safely at 100 percent?

The NRC has recently opened the door for Edison to experiment with restarting a defective nuclear reactor before having to undergo any further scrutiny from a license amendment hearing. If we, the people, do not intervene on our own behalf, Edison could begin their five month nuclear testing as early as June.

Senator Barbara Boxer (D-Calif.) and Rep. Ed Markey (D-Mass.) responded to the NRC’s proposed decision with outraged statements. Boxer called it “dangerous and premature” and “beyond irresponsible” and Markey said the contention that the license amendment is unrelated to the future decision on whether to restart the plant is “like saying that giving someone a driver’s license has nothing to do with allowing them to drive a car.”

If there was a major release of radiation from the plant, a recent report from the Government Accounting Office found that people living beyond the official 10-mile evacuation zone might be so frightened by the prospect of spreading radiation that they would flee of their own accord, clog roads and delay the escape of others.

Putting our health and property in jeopardy is the only way that Edison can prove it is safe to operate a defective nuclear reactor without first fixing it. Is that a gamble you are willing to take?

AT THE MOVIES: ‘OBLIVION’ IS UNINTRIGUING It’s the mark of a true movie star when an actor can open a No. 1 film at the box office based simply on his name. Even in 2013, no one is a better example of this than Tom Cruise. At almost 51 years old, Cruise is still at the top of his game physically, in the public eye and as an actor.

While he has chosen to play it safe with the action genre the last three years, save for Rock of Ages, there are still times when he can deliver something a little different. Universal Pictures’ Oblivion returns him to science fiction for the first time since 2005. In 2077, Jack (Cruise) and Victoria (Andrea Riseborough) are sent back to a post-apocalyptic Earth to clean up any remaining human resources before relocating © Universal Pictures with the rest of humanity to Titan. But one day, he discovers a crashed spaceship with unidentified creatures and a woman (Olga Kurylenko) who has been in his dreams lately. Like Cruise’s Minority Report, Oblivion is visually captivating, but like the film’s director Joseph Kosinski’s previous film, Tron: Legacy, it lacks an intriguing plot. Cruise is fine and comfortable as usual as the lead, and Riseborough adds another impressive performance to her resume, but Kurylenko, Morgan Freeman and Nikolaj Coster-Waldau are underused and wasted on screen.

Women Should Avoid Misconceptions about Single Men Mistaken beliefs about the opposite sex could mean missing out on something good

N

early every week, I receive an email from a woman telling me the reason she doesn’t date much is that men are intimidated by her beauty, intelligence and confidence. In last week’s newsletter, Rose mentioned that a friend had told her that.

Maria, age 68, responded to Rose’s comment, “When we are happy with ourselves, we won’t see the need to change who we are by thinking that men are intimidated by intelligent, confident and attractive women. I don’t think most men are intimidated, but find women of this nature to be more interesting. Don’t cut yourself short ladies, just to fit an image you think men have. Be authentic.”

Bravo to Maria for saying that. And since she opened the discussion on men not being intimidated by women, let’s look into it further.

Not one single, older man I know is intimidated by a woman’s intelligence, beauty or confidence. Take, for example, my friend Ken, a retired man, who visits my deli often. He’s tall, intelligent, good looking, a great dancer and financially comfortable. Ken is not intimidated by women with those qualities. In fact, he will only date women with them.

Women who believe they intimidate quality men because of their intelligence, confidence and beauty are kidding themselves. Quality men appreciate those characteristics and other qualities such as kindness, consideration and thoughtfulness as well. Men I know do not look for women they can manipulate. They look for women who are equals.

Maria said after moving to California, she dated for a year and then stopped: “I decided this wasn’t the fault of California men (and I did a lot of blaming), but it was me and my negative attitude. I realized I had subconsciously put up a ‘no vacancy’ sign.”

“I’m waking up now, changing my attitude to a more open frame-of-mind and trying to figure out how to get to know men again with my confidence intact. (It’s why I’ve signed up to get these newsletters—good practical doses of reality and advice). There are plenty of high-energy, spiritual men around who are older.”

With such sage wisdom, and a revamped attitude regarding men, Maria’s dating path will be much brighter than in

previous years.

Capistrano Valley Christian senior pitcher Aaron Anast tossed a perfect game against Fairmont Prep on April 16. We caught up with Anast to relive his big day and break down what was going through his mind while he struck out 11 batters, gave up no hits or walks and helped lift the Eagles to a 10-0 victory.

The Capistrano Dispatch: There’s always superstition surrounding perfect games while they’re in progress. What was going through your mind during the game?

Aaron Anast: It was just like every other game for me. I didn’t feel any-

thing special and I kind of just went out there like it was any other day. I didn’t even know anything was going on

until later in the game when someone pointed it out to me.

What inning was that in? The last inning I went out there (laughs).

So what happened during that inning? Did the pressure get to you then? No, the only time it really bugged me was when I had a full count with one out. I was thinking if I walk this guy, there goes my perfect game … He struck out.

Was that your best pitching performance of your life? Results-wise, I think so. I only threw 48 pitches through five innings, which is like nine pitches per inning. —Steve Breazeale

ith runners at second and third and one out in the bottom of the sixth inning, San Juan Hills senior shortstop Colby Schultz laced a two-RBI single down the right field line, scoring what would be the go-ahead run in an important 2-1 Stallions victory over Sea View League opponent Dana Hills on April 23.

Both teams were forced to scrape together whatever runs they could in what was a clinical pitcher’s duel between San Juan Hills’ Evanne Wilkes and the Dolphins’ Grant Dyer. Both pitchers went the distance. Wilkes scattered two hits and two walks over seven innings of work while punching out six. Dyer matched his counterpart by dealing out five hits, two strikeouts and no walks in six innings.

The Stallions (13-11, 4-4 league) entered the game in a three-way tie for second place in the Sea View League and broke that tie with the win. But a 1-0 loss to Dana Hills and their senior pitcher Blake Taylor, in what was the series finale between the two teams on April 24, set the Stallions back at .500 and into third place. San Juan Hills now trails Aliso Niguel by one game in the standings with four games to play.

Two of the Stallions remaining games will be against the Wolverines. The first of the two-game series is a home match set for May 1. CD

Early Crash Mars Foust’s Hope for X Games Gold

C

apistrano Beach resident Tanner Foust looked to be in good position to challenge for the Ford RallyCross Championships at the 2013 X Games in Foz do Iguacu, Brazil on April 21 but suffered a string of bad luck as a packed 10-car scramble and dust-up through the first turn ended his chance at a gold medal.

Foust, a veteran RallyCross racer and host of the popular television show “Top Gear USA” on the History Channel, was among the top qualifiers leading into the event and started in the No. 2 position at the gate.

But a dramatic, and dusty, logjam heading into the first turn of the first lap resulted in several of the extremely fast and expensive cars to crash into one another. Foust could be seen

spinning a full 180-degrees down the track after the crash took place behind him. He was able to gain control and get back into the race, but the damage was already done.

Before the race could become official, the red flag came out, signaling a restart, and the competitors were forced to stop. Pit crews were allowed time to fix minor damages to the cars but Foust’s was deemed beyond repair and he was unable to finish the race. Foust was one of four racers in the field who did not return to the track following the crash.

American Scott Speed, who started in the pole position, wound up winning the event.

Foust had barnstormed his way to the finals by being the fastest finisher in the seeding session (heat No. 2) and was tops in preliminary heat No. 3 to earn his berth to the championship race. CD www.thecapistranodispatch.com

Experienced Staff, Players Have Eagles Baseball Soaring

W

hen Clemente Bonilla hung up his baseball cleats for good in 2006, he was eager to try his hand at coaching. The switch-hitting middle infielder out of El Toro High had decided that five years in professional baseball was enough.

Bonilla, 33, landed the head coaching job at small, relatively unknown Capistrano Valley Christian that same year.

What he found was a program that had been somewhat competitive, but not to the degree that Bonilla knew they could be. By infusing his own knowledge of the game and bringing along decades of experience in the form of his assistant coaches, Bonilla has transformed the Eagles into a contender.

In seven short years, Bonilla and the Eagles have compiled a 122-60-2 overall record, with five trips to the CIF-SS playoffs on their resume. Last year the team made it all the way to the CIF-SS Division 6 Championship game for the first time ever.

One would be hard pressed to find a team in the area with as much professional experience as the current Eagles coaching staff, which includes Bonilla’s father Clemente Bonilla Sr., a former second-round draft pick in Ryan Jones and Capo Valley Christian alum John Miles. Combined they have nearly 30 years of experience playing at the highest of levels and the Eagles players have been soaking up as much information as possible.

“You learn so much as far as the mental side of the game … They’ve done a really god job in making us understand that we need to play games against ourselves,” said senior pitcher Aaron Anast, who leads the team with five wins. “That’s how we go into every game, whether that outcome is a win or a loss, we go and play a game against ourselves.”

Anast described how the team has taken on the mindset of being accountable for each other, comparing and contrasting stats to make sure they are performing at the right level.

One way in which Bonilla has changed the way his players think involved something as simple as scheduling. When he got there, year-round baseball did not exist. Players reported in the spring but did not play in the fall or winter. Bonilla quickly changed that.

Players were also encouraged to think long-term. Bonilla brought in his father and Jones, who was drafted by the Toronto Blue Jays in 1993, to help the players map out their baseball careers, The Capistrano Dispatch April 26–May 9, 2013

be it at the high school level or beyond.

The method paid off last year, when former Eagles pitcher Sam Eichler became the first player in school history to go straight to Division 1 out of high school. Eichler currently pitches for East Tennessee State University.

“The success is because of the fall and winter schedules and because the kids themselves are buying into it and working hard and believing that they can achieve at a higher level,” Bonilla said.

This season is also the first time the school has fielded a junior varsity baseball squad and Bonilla brought on a former player of his, Miles, to be their coach. When Miles graduated in 2009, there were only 12 players on his varsity team. The current Eagles varsity squad boasts 18 players with another 11 being groomed at the junior varsity level.

Bonilla was a very proactive player and translated that to his coaching style. He jumps in the batting cages to instruct, takes grounders with the infielders and even hits the weight room with the team on occasion.

Bonilla, who stands 5-foot-9, loves a challenge. He admits he was not born with the incredible physical abilities of some, but he worked hard to hone what advantages he had. He developed a keen batting eye and led Division 1 baseball in walks in 2001 and boasted a lifetime .383 on-base percentage as a pro.

The Eagles have stormed their way to an 8-0 San Joaquin League record this season, which Bonilla is proud of. He’s also proud of their 7-7 non-league record Page 22

against opponents like San Clemente, Laguna Beach and Santa Margarita out of the Trinity League.

Players like seniors Daniel French (.295 batting average, three home runs) and Jacob Upton (.333) have helped lead the team in 2013 and have seen the program grow since their freshman year.

“Each year we’ve been progressively getting better, we’re attracting a lot more players,” French said. “A lot more people are getting to know about the school … It’s been really cool.” CD

Eyeing First Place, Stallions Volleyball Loses in Four to Wolverines

he San Juan Hills boys volleyball team needed a win over Aliso Niguel on April 23 in order to stay in sole possession of first-place in the Sea View League. But following the team’s four-set loss to the Wolverines, they are now tied with Mission Viejo at the top of the standings.

Games one and two went to Aliso Niguel 22-25 and 20-25, respectively. But in the third game San Juan Hills was able to pull out a much needed 25-23 victory.

The fourth and final game was neck and neck, right down to the wire. The Stallions (11-7, 5-2 league) were at match point at 24-22, until Aliso made two big kills in order to tie the game up.

From then on, points were exchanged until Aliso Niguel’s top scorer Lief Lona took over, tallying the final kills of the set to close things out at 29-27.

Lona would tally a game-high 21 kills on the night.

“We were our own worst enemies,” San Juan Hills head coach Matt Prosser said.

San Juan Hills junior Ryan Schickling led the way with 19 kills. Senior Parker Gentry defended the Stallions net up front, contributing a team-high five blocks.

“We had our backs up against the wall and we just didn’t play harder than Aliso Niguel,” Prosser said.

The Stallions last league game of the year is set for April 25, when they will host Laguna Hills. CD www.thecapistranodispatch.com
