TIME HAS COME TO COMPLETE MORTGAGE FINANCING REFORMS

A

few years ago banks were reluctant to participate in mortgage finance because of a number of limitations such as the fact that their sources of funding (deposits) were short term and housing finance by nature is long term. Other limitations included:

To solve the short-term source of funding, the government, through the Bank of Tanzania, established the Tanzania Mortgage Refinance Company Limited (TMRC) on January 29, 2010 to provide long-term liquidity to participating banks in order for them to offer long-term mortgage products to individuals.

Unfriendly land laws;

Participating banks own TMRC. There are, so far, 11 member banks of TMRC, each contributing no less than Sh500 million and the World Bank financing over $30 million. Further financing is expected to be from corporate bonds.

Absence of real estate developers High costs of collateral enforcement A court system that tended to favour borrowers High level of borrower moral hazard 8 The DarProperty MAY - JUNE 2013

The enactment of the Mortgage Finance (Special Provisions) Act 2008 and the Unit Titles Act of 2008 brought about the most

practical reforms to facilitate mortgage financing, consolidating the reforms of 2004. The reforms included a 60 days’ notice of intention to sell mortgaged property, down from 90 days; permitted the sale of collateral in respect of a dwelling house or any land for agricultural use purposes without recourse to the courts. The reforms provided statutory right of immediate possession to a buyer of a mortgaged property purchased through the exercise of the power of sale upon accepting the bid in a public auction. Where a bank takes action to take possession of the mortgaged property or

MORTGAGE FINANCING

a borrower takes action to stop a sale, the court may exercise the power under the Land Act to stay the sale but it has to be certain that the borrower is likely to be able, within a reasonable period, to pay any sum due under the mortgage and that there is sufficient value in the mortgaged property that despite the delay, in the event that the borrower fails to pay the sum due, the bank will likely recapture the amount of its entire claim from the sale of the property

loan was not taken.

The Unit Title Act 2008 introduced, for the first time, sectional property ownership including the right of a unit owner to mortgage his unit and for the unit to be transferable.

• Permit real estate developers to own right of occupancy over the properties in their names so as to transfer them easily to individuals. Currently, a foreign real estate developer has to obtain a derived title from Tanzania Investment Centre. The problem for such a developer would be how to transfer title from a company that holds a derivative title to individual Tanzanians entitled to nonderivative title. In Tanzania nobody owns land. It is owned by the President on behalf of the people. A derived title offers no further protection and is strange to our laws.

Perhaps one of the most significant reforms is the amendment to the Civil Procedure Code to provide for summary procedure for suits arising from Mortgages in order to shorten the time it took to realize collateral. Too often borrowers misused court process to buy time making it very costly for banks to realise collaterals. The amendment restricted the grounds by which a borrower may be allowed to defend himself to two namely that the loan has been repaid or that the

What more reform? • Provide legislative framework for proper transfer of mortgages. The current provisions require payment of the underlying loans which makes the transfer of mortgages impossible because if the loan is repaid what mortgage charge could a paid lender have to pass on.

• Relax the limit on long-term mortgage loan repayment period from current 20 years maximum to 30 years as current period of 10-15 years is too short given average salaries. • Amend the definition of “public interest “in the Land Acquisition Act, R.E 2002. Currently, property may be acquired to be given to another person and no provision for recognition of a bank’s interest in such property. • Amend the Evidence Act to provide for electronic evidence admissibility, which is necessary for the secondary mortgage market. Given that Tanzania has one of the lowest mortgage debts to GDP at 0.30 per cent ratio and that the estimated demand for housing is estimated at 2.2 million units, there is a case for Tanzania to complete the reforms. 6 TIPS FOR SELLING YOUR HOME FAST

I

6 Tips For Selling Your Home Fast

n a declining real estate market where supply outstrips demand, a person can generally sell a house faster by lowering the price. But there are other ways to enhance a home’s attractiveness besides lowering the asking price. If you’re looking to sell your home in a cooling real estate market, read on for some tips on how to generate interest and get the best price possible. Differentiate From the Neighbors In order to attract attention and to make your home more memorable, consider custom designs or additions, such as landscaping, high-grade windows or a new roof. This can help improve the home’s aesthetics, while potentially adding value to the home. Any improvements should be practical and use colors and designs that will appeal to the widest audience. In addition, they should complement the home and its other amenities, such as building a deck or patio adjacent to

an outdoor swimming pool. However, while it can pay to spice up your home, don’t over-improve it. According to a 2013 article in a Realtor Magazine, some renovations, such as adding a bathroom or putting new shingles on a roof, might not always pay. The data suggests that the nationwide average amount recouped for a bathroom remodel is about 58%. For a new roof, it’s even less. If you’re going to invest in home improvements, do your research and be sure to put your money into the things that are likely to get you the best return. In addition, if you have added any custom features that you think buyers will be interested in, make sure they are included in the home’s listing information. More than ever, in a down market you should take every small edge you can get.

because buyers need to be able to picture themselves in the space. This might include removing some furniture to make rooms look bigger, and putting away family photographs and personal items. You may even want to hire a stager to help you make better use of the space. Staging costs can range from a couple hundred dollars for a basic consultation to several thousand dollars, particularly if you rent modern, neutral furniture for showing your home. Many people feel that stagers can make a home more salable, so hiring one deserves some consideration.

Sweeten the Deal Another way to make the home and deal more attractive to buyers is to offer things or terms that might sweeten the pot. For Clean the Clutter example, sellers that offer the buyer a couple It is imperative to remove all clutter from the of thousand dollars credit toward closing home before showing it to potential buyers costs, or offer to pay closing costs entirely

Home Selling Tips will in some cases receive more attention from house hunters looking at similar homes. In a down market, buyers are looking for a deal, so do your best to make them feel they’re getting one. Another tip is to offer a transferable home warranty, which can cost $300 to $400 for a one-year policy and will cover appliances, such as air conditioners and refrigerators, that fail. Depending on the policy, other appliances and house gadgets may be covered as well. A potential buyer may feel more at ease knowing that he or she will be covered against such problems, which could make your home more attractive than a competing home. Finally, it’s important to note that some buyers are motivated by the option to close in a short amount of time. If it is possible for you to close on the home within 30 to 60 days, this may set your deal apart and get you a contract. Improve Curb Appeal Sellers often overlook the importance of their home’s curb appeal. The first thing a buyer sees is a home’s external appearance and the way

It’s not always imperative to be the lowest priced home on the block, particularly when aesthetic and other significant improvements have been made. However, it is important that the listing price is not out of line with other comparable homes in the market. Try to put yourself in the buyer’s shoes and then determine what a fair price might be. Get Your Home in “Move In” Condition Aesthetics are important, but it’s also important Have friends, neighbors and real estate that doors, appliances and electrical and professionals tour the home and weigh in as plumbing fixtures be in compliance with well. current building codes and in working order.
