he TRA Director of Tax Payer Services and Education, Mr Richard Kayombo, said in Dar es Salaam yesterday that the tax regulator will begin house to house verifications of rental contracts and fees as basis for establishing and collecting the appropriate tax revenues. “TRA requests landlords and tenants to be honest in stating the correct rental costs as basis for determining the tax revenues,” he said, adding that any fraudulent acts will amount in stern legal measures accompanied by heavy fines. Tenants are supposed to pay TRA tax before paying their landlords the total amount as per their contracts. TRA will always ask for their contracts they entered with their landlords. On revenue collections for the previous month, Mr Kayombo said, “We have surpassed the target compared to the set target and what we collected in July, this year. ” Comparatively, TRA has registered an increment of 15.43 per cent in the month under review to 1.055tri/compared to 914bn/- posted in July 2015. He added that in 2016/17 financial year TRA targets to collect 15.1tri/- compared to 13.32tri/- of the previous year. The taxman has put in place feasible strategies in order to realise and surpass collection targets set by the government. One of the strategies mentioned is registration of new taxpayers as well as updating taxpayers’ information by ensuring that the unused TIN numbers are removed from the TRA system in Tanzania.

“Preparations for updating taxpayers’ information are at final stages, including taking photographs, fingerprints and taking important details of taxpayers to make sure that every business has only one TIN number and correct and reliable information,” he said. Another initiative for the TRA is to visit taxpayers in their areas of business in order to educate them and make sure they implement various tax law amendments, which aim at enabling the regulator to reach its collection targets. With regards to pay as you earn (PAYE), TRA will visit employers in various areas to verify and inspect the accuracy of the workers’ list and payment made to ascertain whether the PAYE is calculated and remitted to the government as intended.” Besides the strategies, TRA will continue plugging loopholes for losses and make sure all businesspeople, who are required to use EFDs do it properly, including inspecting customers coming from shops to ensure they have valid and correct receipts for goods bought. Failure to give or demand receipts may attract a fine of between 30,000/- and 1.5m/-.

KENYA: SAMEER VENTURES INTO REAL ESTATE AMID DECLINE IN TYRE BUSINESS By Victor Juma

yre manufacturer Sameer Africa is set to launch a real estate division to develop commercial property in an effort to diversify from its core business which has recorded a sharp decline. The Nairobi Securities Exchange-listed firm has seen a major drop in sales and profitability in recent years after losing a large market share to cheaper tyre imports from China and India. Sameer said it will use its land holdings to build several real estate projects, predicting that its tyre business is likely to suffer further in coming years. “To cushion the group’s profitability against the volatility of its tyre business, the board is pursuing strategies of unlocking the group’s property potential and diversifying the revenue base,” the firm said in its latest annual report. Among the planned projects are a modern office block in Nairobi’s Westlands and a shopping mall and hotel along Mombasa Road. The company also plans to build more warehouses for leasing. It is finalising plans for the construction of the 15,000 square metre mall along Enterprise Road at its factory premises in Nairobi’s Industrial Area. Sameer’s chief executive Allan Walmsley said the mall and warehouses are priority projects expected to be build from next year. “We will form a joint venture to build the mall where our

Sameer values its land at Sh2.3 billion, noting that land prices in prime locations in Nairobi have more than quintupled over the past seven years. “The group’s land holdings are valued at over Sh2.3 billion and investment properties valued at Sh1.6 billion are available for re-development. The fair value gains of Sh3.7 billion have not been factored in the company balance sheet,” the firm said. The tyre business, which has posted losses, accounts for 96 per cent of Sameer’s total revenue while rentals bring in the remaining four per cent. The increased focus on real estate comes as the company finds it difficult to adapt to a more competitive market that has seen the market share of its flagship Yana/Firestone brand fall from 57 per cent in 2000 to an all-time low of 15 per cent last year.

T
anzania has had some amazing changes since last year up till now. There was a change in the government and a new president, Mr. Magufuli, was elected bringing forth new political strategies, new ideas for development, and a new environment for its society. Understanding these changes, we foresaw an opportunity for “a bright and hopeful future” in the real estate industry. H.E. President Magufuli initiated the development of industries to focus their manufacturing on civilian consumption which in turn will eventually set motion to the real estate industry. In China’s thirty years of development and reformation documentation, it was proven that industrial production and real estate naturally complement each other in improving the entire economy. Therefore, once industrial development starts moving real estate will begin to move as well because the ultimate key to civilian consumption is through the real estate industry. We say Tanzania holds a promising future in real estate is also because H.E. President Magufuli places a lot of importance on the people’s livelihood. The livelihood of the Tanzanian citizens today, don’t have much problem with clothing or food, but there is a great shortage in public facilities. Improving the living conditions of residents is also very much needed because with the improvement of people’s lives and the improvement of socioeconomy, the requirements for housing improvement will also advance. Based on my analysis, Tanzania has not yet reached its peak in the real estate industry. We should work together to ensure

the development of the real estate industry. For example, the Tanzanian government still has a lot of unfair issues concerning the real estate industry and their policy treatment towards foreign real estate developers is especially unfair since they change it ever so often. It’s a problem that has to be solved, we should work together to advise the government to change these policies to fairer standards. Another example is the great lack of information regarding the land market and illegal real estate agencies causing problems, all affecting the development of the entire real estate industry. The government should create a system in which all sales of property are enlisted in a public tender system like China has to achieve order and regulation in the real estate industry. Also, I feel that unlike China’s tier planning, Dar es Salaam does not have a unified urban planning which creates blind spots in the land market and industry. Concerning all of these problems, how do we enhance the science behind them? How do we reduce the blindfolds in the industry? We need the help of the local real estate industry in Tanzania to share a common understanding with us and create an organization where we can coordinate with each other, exchange information, plan research, and optimize decisions. We firmly believe that Tanzania, under the leadership of H.E. President Magufuli, will prosper in the development of all businesses and industries and that all of this will lead to the rise of the real estate industry. As long as we grasp the situation clearly, understand their customs, step by step, slowly and surely, we can achieve our bright and hopeful future!

urrently African economies are growing fast due to the greater political stability and macroeconomic improvements. Growing of African economies lead to rapid urbanization therefore increase in demand for housing. Urbanization is an important factor in the increased demand for housing. Tanzania has urbanization rate of 3.56 percent with urban population of 31.6 percent.
Affordability in housing finance and supply is a major challenge around the continent in housing markets, lack of long term financing, poverty and land management systems are the factors that cause problem in affordability. Housing affordability is normally a function of three things:

• Household’s income, • The price of the house that is available for sale, and • The terms of the mortgage loan for which the household qualifies Housing finance is not on the favor of low income earners, only few people in Tanzania can afford mortgages due to high cost of houses compared to income. The income level inequality is very high, few people have higher income and the majority of the people has a total household income which is barely at subsistence. Prospective borrower required to have some cash approximately to 25 percent of the property value to meet other expenses for mortgage loan such as
down payment and facilitation fees. As of income distribution for urban population, it is about 3% of the population would have a sufficient level of income to afford a mortgage loan on the affordable available property. Due to the problem of affordability, The Tanzanian Housing Bank which established in 1973 and collapsed in 1995, only issued 36,000 loans over a 22 year period. The low level of lending in Tanzania implies that new ways of financing housing and establishment of new mortgage products such as Graduated Mortgage Payment (GMP) and of Pension Backed Housing Loan have to be encouraged if the poor are to be provided with adequate shelter and basic services.

Such mortgage is commonly offered by major brokerage houses and require the borrower to maintain an account with the firm. The lender can access the portfolio of securities in the event of DEFAULT on the mortgage loan. Example: Hot Tip Brokerage, Inc., offers pledged –asset home mortgage that covers 100% of the value of the home. The borrower must maintain a portfolio of stocks, bonds, and mutual funds with market value of 30% or more of the amount of the loan. This account is pledged to the brokerage company against the probabilities of default on the loan. Mortgage in Possession situation in which a lender takes possession and control of mortgaged property upon foreclosure of the loan secured by the mortgage. The lender possesses the property , collecting any income produced, until it is sold at the foreclosure sale. Example: Following nonpayment of debt service for a period of 6 months, Savings Bank filed for foreclosure of the loan. Fearing damages to the property, Saving immediately took possession under an action of mortgage in possession. Life Tenant one who is allowed to use property for life or the life time of another designated person. Example: Graham owns a life estate in a home. as a life tenant, Graham may enjoy full ownership rights to the home during her life time Internal Rate of Return (IRR) the true annual rate of earnings on an investment. Equates the value of cash returns with cash invested. Considers the application of COMPOUND INTEREST factors. Requires a trial – and error method for solution. Example: Abel sells for $200,000 land that he bought 4 years earlier for $100,000. There were no carrying charges or transaction costs. The internal rate of return was about 19%. That is the annual rate at which compound interest must be paid for $100,000 to became $200,000 in 4 years. Example: Baker received $3,000 per year for 5 years on a $10,000 investment. The internal rate of return was about 15%. Fair Value a term embraced by government or professional association to provide a VALUATION standard or definition similar to but not the same as market value. Example: Generally accepted accounting principles may require the fair value of property to be stated based on its market value rather than on a selling price that was artificially inflated by favorable financing. False Advertising describing property in a misleading fashion. Example: Example of false advertising might include: • representing a property as not being in a floodplain when, in fact, it is • stating without caveat, that a property will appreciate in value • denying structural flaws that are known to exist

here are some simple ways to improve the chances of selling your house. If you have a house on the market, or are considering it, read on for seven tips that will make it easier to sell your house and make a smooth transition from one owner to the next. Maintain Neutrality This policy has worked for Switzerland and it can also work in real estate. Customizing your home is great if you plan to stay there, but extreme colors and themed rooms can scare off potential homebuyers. If you have customized every room with extremely bright or dark colored paint, wallpaper or wall fixtures, you may want to consider toning it down a bit. Using neutral colors on the walls can help prospective buyers create their own vision for the house and will also leave them with less work to undo if they buy the house. Less is More Even though you have not moved out yet, removing some of your furniture can help the house move off the market. If you take pictures for your listing, having less furniture can help the home appear more spacious. When potential homebuyers arrive, having less furniture can also provide clear walkways. That New House Smell Honestly, the new house smell isn’t always the most pleasant, but at least it is new. In preparing to show your home, you should avoid strong smells. To avoid odors, make sure to take out the trash and clean the refrigerator regularly. It is also good to be mindful of what you cook in the days leading up to a showing, since certain foods have strong scents. If you have pets, keep an eye on the litter box. Any smell that is too strong could send potential homebuyers running out the door.

Maximize Your “Curb Appeal” The front of your home is the first thing prospective home-buyers will see, so keeping it presentable is a must. If there is a yard, keep the grass to a reasonable height and tree branches under control. The path to your front door should be a clear and welcoming one, not an obstacle course! Don’t Get Too Personal Upon entering your house, everyone will know it is lived in, but they do not need to see all the evidence. Get rid of excess clutter such as newspapers, magazines and mail. Be sure to put away your laundry and shoes.
