NSSF EMBARKS ON LOW COST HOUSING N

SSF embarks on law cost housing NATIONAL Social Security Fund ( NSSF) has embarked on low cost housing project to enable its members own modern houses at affordable price and improve their living standards. The scheme has taken into account some important factors. The majority of Tanzanians, more than 80 per cent live in rural areas and depend on agriculture for food and income. Due to the use of traditional farming methods and unreliability of rainfall, there is often low agricultural production, which in turn leads to low food and cash crop production Consequently, many farmers experience

food insecurity and inadequate income and because of this they cannot afford a decent house. In the workplace, the majority of workers belong to (using International Labor organization’s phrase) the working poor’ category). That is they may be nominally earning a decent salary, but due to the fact of having many dependants, in reality each earns less than $1.25 a day Although Tanzania’s economy is growing given the fact of its long time political stability, abundant natural recourses and investment projects in various sectors of the economy (micro- economy), this growth has not been

translated into the lives of ordinary people (micro economy). That is why there is a widening disparity between the rich and poor. As a result the majority of Tanzanians are still in abject poverty and in poor or inadequate housing although this shouldn’t have been the case. To substantiate this, one has only to visit suburbs and rural areas across the country. To address this situation, the government has been coming up with various poverty reduction strategies meant to transform the nation into a middle- income economy (National Vision 2025) and enable

Dr. Ramadhani Dau, Director General: NSSF Tanzania Tanzanians to lead a decent living and improving their housing status – the latest being Kilimo Kwanza and Big Result Now. To complement government efforts, each fiscal year National Social Security Fund (NSSF), has been setting aside at least 75 per cent of its investible funds for investment purposes. The remaining 25 per cent is spent on benefit payments and administrative and capital development purposes. “NSSF commits its resources into high yield investments to be able to offer meaningful benefits to its members. This means all undertaken investments, as far as possible, provide a positive rate of return, to maintain the value of members’ funds. We are committed to enabling our members to own decent houses,’ the NSSF director general, Dr Ramadhan Dau told this reporter during an exclusive interview. He said one of such investments was NSSF’s long – term project to construct low cost houses for its members and their families, a move that could drive millions of Tanzanians out of inadequate housing. “ In Kijichi, Temeke District, Dar es Salaam, NSSF has contracted 297 low cost houses which may be purchased or loaned,” he said these houses were formerly loaned through Commercial Bank of Africa (CBA), but now NSSF will loan them at an interest rate of 11.44 per cent per year and the loan will be repaid in 15 years. They are of two to four bedrooms each and the price is fixed at Sh 64,875,310 to

112,500,000 (VAT exclused) respectively. “NSSF members interested in purchasing the low cost houses may go to NSSF offices at Benjamini Mkapa Towers to enquire about a purchase procedure,” he further said. According to Dr Dau, there are 10 types of house designs comprising two to four bedroom houses. The average size of each house is between 75 and 125 square metres. “The houses are differentiated on the basis of built –up area, the number of rooms and extra-facilities incorporated in each house, for instance, carports, solar water heating systems and provision of house,” he explained. Members, who intend to purchase any houses using out-right purchase arrangements are required to get an application form at a nonrefundable fee of sh.5,000 from any of the NSSF’s offices fill in all requisite information about their membership and return it for pre qualification. After pre qualification, a letter of offer will be issued and the prospective buyer will be required to complete all purchase formalities and full payment for the house within seven working days since the issuance of the offer letter. Any delay beyond this time frame will lead to automatic termination of the offer and forfeiting of any amount so paid,” he said. For her part, chief public relations and customer service Eunice Chiume told reporters in Dar es Salaam recently that NSSF would continue addressing housing challenges for its members.

She noted that due to high housing demand NSSF would continue to construct low cost houses to members to enable them to live in permanent houses,” After completing phase I and II of 297 houses, we have seen that there is a need to continue addressing this problem and in phase III will involve constructing 900 houses, which will cost about 23bn/ Said Chiume She added that statring on 24th day of this month, NSSF expected to start issuing application forms for purchasing 498 surveyed plots in Kiluvya A Madukani, the plots that will be sold in collaboration with Kisarawe District Council.This is a new residential area, which will have basic social services, she said The plots will be sold to NSSF members and to members of the public at an average of sh 15,000 to Sh20,000 per square metre depending on plot use. NSSF, which is a compulsory scheme providing a wider range of benefits based on international accepted standards, was established by the Act of Parliament No. 28 of 1997 to replace the defunct National provident Fund (NPF). Ask the Expert Real Estate Laws FOREIGN INVESTOR Q: I came to Tanzania in 2012 as an employee in one of the auditing firms in Dar-es salaam. I have grown to love the country and recently I have been thinking of buying land to start a real estate business. My firm’s driver, a Tanzanian, has a plot at Mbweni Mpiji and is keen on selling it to me, but my boss says what he knows is that a foreigner can’t buy land in Tanzania. Is this so? Please Advice. BM, Dar es salaam, Tanzania A: Greetings BM, well your boss is correct but only to the extent that under the laws of Tanzania, a foreigner cannot own land. However, a foreigner can own land if it’s for investment. The Land Act 1999 under section 20(1) states that, “for avoidance of doubt, a non-citizen shall not be allocated or granted land unless it is for investment purposes under the Tanzania Investment Act, 1997”. This can be through obtaining derivative rights from the TIC, application to the Commissioner for Lands, sub-leases, licenses from the Government, and purchasing from holders of rights of occupancy. However, if the foreign investor decides to purchase the land from a holder of a right of occupancy, a lawyer’s services is needed for the process. The lawyer will draft a Sale Agreement and the seller provides the necessary documents/information (site verification, vendor’s disclosure, conduct official search, evaluation, and many others) that confirm s/he has a right of occupancy on the property and that it is clear of any encumbrance. The above, especially having a properly drafted agreement, will protect you. For other processes and ways to protect yourself, we suggest that you consult your attorney. MORTGAGE Q: Hello! I am a Tanzanian citizen employed as a manager at one of the factories in dare s salaam. There is a property that I want to buy but it’s mortgaged. Kindly assist me on the procedures and how to go about it? JR, Arusha, Tanzania A: Hello JR. Well, the procedures are straight forward. In light of your situation, a mortgage can be discharged or transferred so as to affect sale. Upon payment of all moneys and performance of all other conditions and obligations in the mortgage; the mortgage must be discharged from liability. The discharge is made at the instance of the mortgagor requesting such a discharge at any time. The mortgagor can request the morgagee to transfer the mortgage back to him upon 18 The DarProperty 27th NOV 2013

discharge or to another person. Such a request must however, be in writing . Section 123 of The Mortgage financing (special provisions) Act, stipulates that it is vital to obtain the consent of the Mortgagee. Under regulation 9 of the land (Mortgage Financing) Act, “where the mortgagor wishes to transfer a mortgage, he shall seek consent of the mortgage. Upon negotiation between buyer(you) sellor and the mortgagee, consent shall be given. On discharging the mortgage, an application shall be sent to the registrar of Mortgage. Once the mortgage has been discharged then what follows shall be to convey the property to your name. This procedure will involve signing of Sale agreements, disposition forms, transfer of property, approval from the registrar of lands on the registration of the right occupancy, processing of the title deed. LAND TRANSFER Q: I bought a house six years ago. I recently decided to sell it but to my surprise the buyer refuted to purchase my house and told me that I was a fraud because he found out that the house belonged to someone else who actually was the person who sold the house to me. How can this happen? AM, Dar es salaam,Tanzania. A: There are several stages in conveyance, the first stage being the pre-contractual stage, then the contractual stage and the last stage is the post completion stage. You haven’t told us the whole story but the most obvious assumption is that, you only passed through the first and second stage but had failed to finish the second and last stage which is very important. A sale agreement of land is not complete until the title deed has passed to you. Hence, you have to execute a deed of transfer which will transfer the title from the previous owner to you, and register the same. The post completion stage comprises of the following requires that after the sale agreement is executed, you have to prepare the deed of transfer and go to pay the necessary fees .You will then obtain a certificate of the same and thereafter the transaction is approved. A registration of register the deed at the appropriate registration office is a process that will follow as to render completion of the whole transition. You can’t sell without a title deed that has your name on it. CONTRACTS Q : Hi, I am a businessman, but I am new in real estate business. I worry that since in my other business dealings I have run into a lot of contract/agreements disputes; it might also be the same for me in the real estate

business. Can you please tell me on how I can protect myself and reduce the risk of such atrocities? Thanks. GH, Dar es Salaam A: Dear GH, What you should know about agreements that are entered in the real estate business is that first of all, an agreement for the must be in writing like agreements for sale of land with an exception to short-term leases, and be signed by both contracting parties. Also before signing an agreement for sale of land you have to afford yourself sometime to do due diligence where you will search the necessary information concerning the property and assure yourself of any encumbrances before purchasing it. You should also take careful note of the covenants therein. The agreement must also indicate; cost payable by each party, whether price includes VAT and, the timing of the payments, clause that the purchaser is at contentment with the property being bought, fixtures and fittings, and any implied obligation of the purchaser. Most importantly all contracts should have these essential elements Competent Parties, mutual consent, Legal Consideration, Lawful Object, Property Description, Price, Signatures.
