Liberal incumbent Borys Wrzesnewskyj plans to run again in next election CYNTHIA REASON creason@insidetoronto.com In a split 4-3 decision, the Supreme Court of Canada ruled Thursday morning to allow Conservative MP Ted Opitz to retain his seat in the highly contested riding of Etobicoke Centre. In an interview with The Guardian Thursday afternoon, Opitz said he was pleased with the decision, thanking the court for “so carefully” considering it. “As we’ve said from the beginning, 52,000 people voted and that needed to be respected – it was important to enfranchise the electors of Etobicoke Centre,” he said. “I think the message is that, regardless
of who they voted for, those 52,000 people did the right thing: they came out and voted. And although there were some errors that were pointed out, the Supreme Court obviously didn’t think they were sufficient to overturn the election.” Canada’s top court’s ruling stood in stark contrast to one that came down in May, when Ontario Superior Court Justice Thomas Lederer declared the election results in Etobicoke Centre – where Opitz narrowly defeated Liberal incumbent Borys Wrzesnewskyj by just 26 votes – “null and void” under the Canada Elections Act, on the basis of a number of voting irregularities. Resident resurrects Neighbourhood Watch program TAMARA SHEPHARD tshephard@insidetoronto.com A Thorncrest Village resident has resurrected and expanded Neighbourhood Watch in numerous central Etobicoke neighbourhoods. Julie Martin launched Central Etobicoke Neighbourhood Watch a year ago after vandals attacked and
damaged her home and property. “It was major vandalism,” said Martin, a local realtor with Harvey Kalles Real Estate. “The barbecue was thrown in the pool. The pool was damaged. The cabana was damaged. I was so angry. I contacted police.” Since, some 40 members have joined Martin’s Neighbourhood Watch.
“There is all kinds of crime going on that nobody reports,” Martin said. “Nobody has the vehicle to report it to the community. That’s where Neighbourhood Watch comes in. If the neighbourhood knew what was going on, everybody would be more vigilant. If something is occurring, I send an email out to my network.” That network includes the

Students sing song of praise at park renaming First black MPP Len Braithwaite honoured with namesake playspace CYNTHIA REASON creason@insidetoronto.com

fter successfully lobbying Etobicoke North Councillor Vincent Crisanti for new playground equipment at his neighbourhood park, nine-yearold Nathaniel Gunter thought maybe, just maybe, they’d name the improved playspace after him. But when he found out one of his new heroes – the late Len Braithwaite, Canada’s first black MPP – was also in the running for the honour, Nathaniel quickly bowed out. “I’m just a kid, and he was a really responsible guy,” the Grade 5 Melody Village Junior School student said shrugging at Wednesday’s park renaming ceremony. “We learned all about him. He would have been a cool guy to meet.” Nathaniel’s voice was just one in a chorus of singers from Melody Village who came together to celebrate Braithwaite in song at the hour-long event, attended by Crisanti, Braithwaite’s son David, former Etobicoke mayor Bruce Sinclair, Dr. Rosemary Sadlier, president of the Ontario Black History Society, and Etobicoke North Trustee John Hastings. Inspired by the life and accomplishments of Braithwaite, ‘Responsible Leonard’ – a bluesy song penned by the students themselves – highlights the Kensington Village area native’s rise from a Second World War veteran to Etobicoke’s representative

at the provincial legislature, where one of his crowning achievements was getting a law allowing for racial segregation in Ontario schools repealed. “Responsible Leonard, that’s your name; Responsible Leonard, your claim to fame; You were raised in the Market of Kensington; And you were workin’ in provincial government; You were a fighter fightin’ in World War II; You were responsible for ending segregated schools,” Melody Village’s grades 3, 4 and 5 students sang. Braithwaite’s accomplishments, however, were many more than
could fit in one song. Born during the Depression in 1923, Braithwaite served bravely in the Royal Canadian Air Force during the Second World War. Upon his return, he turned his attention to education – graduating from the University of Toronto with a Bachelor of Commerce degree in 1950, from Harvard with a Masters of Business Administration in 1953, and from Osgoode Law School in 1958 – and a career in law. After becoming the first black lawyer elected as a member of a governing council of the Law Society of Upper Canada,
Braitwaite embarked on a political career in his adopted home of Etobicoke. Braithwaite served for two years on the Etobicoke Board of Education starting in 1960, and by 1962 had graduated to Etobicoke council, where he served as alderman. It was the following year, however, when Braithwaite made history by becoming the first African Canadian to win a seat in the provincial legislature – a seat he held for three terms until 1975, serving as Liberal party critic for Labour and Welfare. Before passing away in March at age 88, Braithwaite was
appointed the Order of Canada (1997) and the Order of Ontario (2004), and was also awarded with the City of Toronto’s 2011 William P. Hubbard Award for Race Relations. More than just a list of accomplishments, though, Braithwaite was also an “all-around amazing guy,” said Sinclair, a longtime family friend and colleague. “Any good cause, and there was Len,” Sinclair said, noting that Braithwaite was one of the “prime movers” in getting Etobicoke General Hospital established in north Etobicoke. “He was a peach of a guy.” That sentiment was echoed by Crisanti, who said it was only fitting that Braitwaite be honoured with a park, given his commitment to children. “Among the many of Len Braithwaite’s accomplishments – and what I believe defined him as a leader and a role model – was his commitment to work with our youth,” Crisanti said, adding that Braithwaite sponsored a great many boys and girls sports teams, known as the Braithwaite Legal Eagles, in Etobicoke. “It seems fitting, then, that a place in this community where children that represent the great diversity of our city come to play freely would be named after him.” In closing, David Braithwaite encouraged the gathered students to work hard, like his dad did, to achieve their dreams. “The one thing I never heard my father say is that life owed him anything...” he said. “In life you have your ups and downs, but you have to do everything within your power and within yourselves to pave your own way in life – to do that comes with hard work. There’s no substitution for it.”
Life-saving heroics earn men Toronto police award CYNTHIA REASON creason@insidetoronto.com Three Etobicoke men – one who saved a toddler from drowning, another who rescued a man and his dog from a fiery death, and still another who delivered a stabbing victim to safety – were honoured by Toronto Police Services as heroes over the weekend for their bravery and selfless acts. Ladislav Rudolf, Jason Palladino, Phillip Livingston – along with 36 other recipients from across the city were honoured Sunday. LADISLAV RUDOLF Rudolf was fixing his bedroom
window on Daniels Street in 22 Division on Sept. 14 when he began hearing screams for help. The father of two quickly sprung to action, driving around until he found the source of the trouble – a drowned toddler in a backyard around the corner from him. Rudolf immediately began first aid on the “white-blue” complexioned boy, prying open his mouth and squeezing his abdomen so that water could escape and the boy was able to breathe again. In recognizing Rudolf for reviving the boy, police lauded his “dedication to the safety of his neighbours and quick thinking in saving the life of an infant.”
But for Rudolf, knowing the boy is happy and healthy because of his actions is all the reward he needs. “I didn’t need an award, I was just glad I saved the boy,” he said, noting the incident drove home for him the importance of first aid training. “It was powerful because it could have happened to me, too. It could happen to anybody...somebody told me that I’m a hero, but I don’t feel that way. Everybody should do the same thing.” JASON PALLADINO Palladino was praised by police for his “keen observation” and for risking his life to help save a sleeping man from a burning house.
On Monday, July 18 Palladino drove past the burning home in 22 Division. Noticing flames coming from the house and without hesitation, Palladino stopped, ran to the front of the house, kicked open the door and ran in, calling out to possible occupants of the house. Upstairs, the lone male resident of the house was awoken by Palladino’s cries, and was able to safely exit the home with his dog. PHILLIP LIVINGSTON Livingston was at home in his 23 Division apartment on Saturday, Aug. 6, when a family dispute between a woman and her emotionally disturbed brother broke out down the
hall from him. During the altercation, the woman was stabbed twice with a kitchen knife – once in the chest and once in the stomach. Bleeding, the woman was able to stumble down the hall to the apartment of her mother, who cried out for help. Responding to those pleas, Livingston sprung to action – picking up the victim and carrying her to the safety of his apartment and away from the imminent danger still posed by her brother. Once in the apartment, Livingston applied pressure to the woman’s wounds until emergency services arrived. He was recognized by police for his “prompt actions and willingness to help another in distress.”

To the editor: I suggest enacting a 10 cents per litre gas tax, GTAwide, doubling of parking rates throughout the GTA and enacting paid parking in every parking spot, even in the suburbs, to properly fund transit and subway expansion. esterday marked two years since longtime Etobicoke North Councillor Rob Ford became Mayor Rob Ford – a victory that seemed to immediately divide the city into two factions: the suburbs and the downtown. Unfortunately, Ford has done little to assuage this reality. However, not all blame should rest on his shoulders; councillors on the ‘left’ have done very little to lift the decorum at City Hall. In his first term, Ford took quickly to his election agenda, which included cancelling Transit City, getting down to finding metaphorical gravy on the city hall train, and taking on the city’s various unions. Ford found much success that first year – even if that success caused our view consternation at council. But year two has been far less Mayor has successful. chance to Ford seemed listless, lacking vision, except to further alienate redeem in the media and get caught up in ridiculous situations unbecoming the mayor of a major city like year three Toronto. With a new mayoral year ahead, Ford should find another issue to champion – and there are many in Toronto: 1) Driving economic development is an area rarely discussed at city hall. There are empty storefronts across Toronto that need filling – surprisingly many are in commercial retail strips once filled with customers. Working with business owners and fellow councillors to create reasons for business to return is essential to the city’s prosperity. 2) Housing and homelessness is another. The city’s most vulnerable citizens should not be treated as criminals and forced into shelters. They should be treated with respect, affording them a clean place to live, healthcare, and opportunities to feel like they are a part of society. 3) But the most important issue of all for the next two years, and a legacy all Torontonians could be proud of, is transit. Not the off-handed ideas of years past, but solutions that involve everyone and consider the harsh economics of what building public transit means now and in the future. Speaking to all levels of government and our fellow Greater Toronto and Hamilton Area politicians is key. These and other issues give Ford the opportunity to help mould a city into something incredible. But, he must put aside his obvious bias toward those councillors on the ‘left’ and work with them to further our mutual progress as a city. Party politics taking hold in Toronto

ere we are facing the beginning of fall and without question the resignation of Ontario Premier Dalton McGuinty and the prorogation of the government is significant. Plain and simply, this is going to be the year where the political status quo is in for a big shake up at all levels of government. The beginning of all this was the municipal election of 2010, which showed us that from here on in the municipal governance model of the new City of Toronto will increasingly be focused on formal party politics. This is not surprising as its introduction has been quietly in the works since the announcement of our forced amalgamation 10 years ago in 1997. However, rather than making the running of the city a smooth and rational affair, formal party politics has created an adversarial environment of unnecessary blunders and crisis. Already we are seeing emergence chronic dysfunction at city hall based upon an entirely arbitrary “left wing/right wing” dichotomy.

All of this is entirely ironic, given the fact that the justification given for amalgamation was that it was supposed to make people work together at city hall. Yet now, more than 10 years after the fact, we are still hearing complaints that things are still not working to the satisfaction of the minority who wanted amalgamation in the first place! To the editor: I endorse a one per cent corporate and union tax to bail out public transit. Some want property taxpayers to suck it up with yet another new tax or toll road tax. My position is that it is time for our corporations and unions to pay a one per cent new tax for the sole purpose of funding our public transportation systems. Peter Clarke
Privatizing TTC would come at price of service To the editor: Re: ‘TTC should be privatized,’ Letters, Oct. 5. The TTC probably needs that shake-up, but this civic corporation exists because of the private corporations who initially ran the public transportation service in Toronto were so inept at the job that Toronto had no choice but to take over and establish the Toronto Transportation Commission. According to notable Toronto historian Mike Filey, the private transportation companies refused service to areas deemed unprofitable, which apparently did not sit well with the Toronto taxpaying citizens. Privatize the TTC and see how fast service to non-profitable routes are chopped. The TTC puts service first, something that private companies cannot afford to do. Bill Tee

City plans consultations on ban of plastic bags

Public meetings to take place until Nov. 27 DAVID NICKLE dnickle@insidetoronto.com Toronto Council has approved a plan to consult with retailers, the plastics industry and the general public before final approval of a bylaw banning single-use plastic bags from Toronto retailers. But the chair of the city’s public works and infrastructure committee Denzil Minnan-Wong said the consultation won’t be much more than “a stage production.” “The original report was adopted by council in the summertime,” said Minnan-Wong. “That created the ban. So if we heard from all the deputants and all of them said we don’t want the ban, we couldn’t then change the bylaw. Our lawyers are telling us, you can’t change the bylaw.” Minnan-Wong made the comments two days after he and fellow councillor Peter Milczyn attempted to convince council to re-open the decision they’d made in July, to ban all plastic bags. Council had done so by supporting an amendment by Willowdale
Councillor David Shiner, on the same matter that Mayor Rob Ford had held down to end the five cent fee the city requires retailers to charge for each plastic bag. Ford had opposed that fee since it was put in place by former Mayor David Miller’s council. He also opposed the ban, and earlier this month, tried and failed to muster the two-thirds vote of council he needed to rescind the ban. Now, council has only to vote on the specifics of the bylaw, which staff have yet to draft. Under council’s procedures, it’s impossible to amend that bylaw significantly. But council could, in theory, refuse to support it. “That certainly is an option and we’ll have to see what happens,” said Minnan-Wong. Shiner, meanwhile, insisted that the consultation is necessary to protect the city against a legal challenge— and he believed it would be possible to make small changes to the bylaw based on feedback from stakeholders. Consultations will happen between now and Nov. 27, when council will consider the new bylaw.

As announced on March 12, 2012, OLG is modernizing Ontario’s lottery and gaming industry. The effort will increase revenue for the province and create jobs while continuing to support municipalities through a new consistent funding model for towns and cities that host an OLG gaming facility. “OLG gaming sites continue to provide substantial benefits to host communities and Ontario families,” said Shafiq Qaadri, MPP for Etobicoke North. “The modernization of Ontario’s lottery and gaming businesses will result in new employment opportunities, increased tourism and additional revenues for the province to protect important public services like health care and education.” The OLG modernization effort will help create some 2,300 net new industry jobs and about 4,000 service sector jobs. It will improve how lottery and gaming is delivered in Ontario, and expand OLG’s high standards approach to Responsible Gambling. In 2012-2013, the province will allocate $120 million in gaming revenue to support charities through the Ontario Trillium Foundation, which helps build strong and healthy communities. In addition, every year the Government of Ontario allocates funding to the province’s problem gambling prevention, treatment and research programs. The amount for 2012-2013 is $41 million. OLG is a provincial agency responsible for province-wide lottery games and gaming facilities. Since 1975, OLG lotteries, Casinos, Slots, and Resort Casinos have generated more than $36 billion for the benefit of the Province of Ontario. Gaming proceeds support Ontario’s hospitals, amateur sport, recreational and cultural activities, communities, provincial priority programs such as health care and education, and local and provincial charities and non-profit organizations through the Ontario Trillium Foundation.

Martin is advertising her meeting through the distribution of 7,000 flyers in the M9A, M9B and M8X postal codes in today’s edition of The Etobicoke Guardian. Martin said she plans to walk the Central Etobicoke Neighbourhood Watch neighbourhoods with Toronto police officers and CPAT representatives in the next two months to conduct a CPTED (Crime Prevention Through Environmental Design) safety audit. The audit is a proactive crime prevention strategy that aims to deter crime and to increase people’s ability to be seen through actions such as trimming trees, hedges and bushes and improving street and outdoor lighting. “The result is people realize their neighbourhood is not as safe as they think it is,” Martin said of Neighhourhood Watch. “I don’t want to scare

While there was never any allegations of fraud, corruption or illegal practices, nor any suggestion of wrongdoing by either candidate before either the Superior or Supreme court, Lederer’s ruling nevertheless set the stage for a byelection in Etobicoke Centre. Opitz, who asserted all along to have run a “fair, honourable, honest campaign,” appealed that decision at a Supreme Court hearing back in July. On Thursday the court ruled in his favour, restoring 59 of the 79 votes previously thrown out. “This leaves 20 votes that have not been restored. Under the magic number test, 20 votes is less than the winner’s plurality of 26...” the 102-page Supreme Court ruling reads, noting that the court has “no reason to believe that any of
the 20 voters were not in fact entitled to vote.” “For these reasons, we would allow (Opitz’s) appeal and dismiss (Wrzesnewskyj’s) cross-appeal,” the ruling further states. As a result, Opitz will avoid a byelection and retain his seat. “At the end of the day, I won the election,” Opitz said. “I won it on election night, it was validated by Elections Canada at the recount, and it now has absolutely been certified by the Supreme Court.” Wrzesnewskyj, meanwhile, said he will return to Etobicoke to continue running his family-owned business, Future Bakery, while also committing to continue working on behalf of Etobicoke Centre residents. In an interview the same day the ruling came down, Wrzesnewskyj said he doesn’t see the Supreme Court’s decision so much as a loss for himself, but a win for all Canadians. “What I do know is the
next federal election will be run very differently and that means that democracy wins and that every Canadian won,” he said, giving thanks to the many supporters who stood by his side over the last few months. “I put myself forward to run for public office not to roll with things when problems arose or things got worse, but to address those problems and to work towards building a better Canada, and that’s why I made the decision (to appeal the election results),” he added. “I’m encouraged by the fact that Elections Canada has said that, due to what happened in Etobicoke Centre, they will run things very differently from now on.” Wrzesnewskyj, who said he intends to run again in the next election, spent somewhere between $250,000 and $500,000 out of pocket contesting the election results – even though he was told he had less than a 10 per cent chance of winning, he said.

Wear a costume, raise money and awareness for food issues This Halloween, wear a costume to one of four Toronto Chipotle Mexican Grill location and raise funds and awareness for food issues. The annual Boorito will see costume-wearing patrons receive a burrito, bowl, salad or order of tacos for $2 between 4 p.m. and closing with proceeds up to $1 million to benefit the Chipotle Cultivate Foundation. The Chipotle Cultivate Foundation is a non-profit organization committed to creating a more sustainable and healthful food supply and to raising awareness of food issues, according to a press release. The foundation supports family farmers and their communities, educators and programs that teach younger generations about food matters, along with support for ranchers and farmers who are working to develop more sustainable practices. “We have always believed
that good food should be affordable and accessible to everyone, and our annual Boorito fundraiser is a great opportunity for customers to enjoy a $2 burrito while supporting a great cause,” said Steve Ells, founder, chair and co-CEO of Chipotle in a release. “By using this program as a fundraiser, we have already raised $2 million to support farmers and organizations that make sustainable and humanely raised food possible, and we’ll add to that total this year. Toronto residents are being asked to give more than a treat this Halloween. They can also hand out Change for Kids coins that give trick-or-treaters a chance to win prizes while supporting Holland Bloorview Kids Rehabilitation Hospital, Canada’s largest hospital for disabled children. “This is the first year we’ve ever run this program,” said Tracey Bailey, president of Holland Bloorview Kids Rehabilitation Hospital Foundation. “Our goal is to raise $100,000.” This is how the Change for Kids initiative works: People can buy an activated Change for Kids coin card for $5 at any Scotiabank branch in the Greater Toronto Area. Cards obtained from other distributors such as Spirit Halloween, Costco, Toys “R” Us, newspapers or magazines can be activated for $5 by visiting www. changeforkids.ca. People can then pop out the coins from their card and
give them to trick-or-treaters. Children and parents should be told to visit www. changeforkids.ca and enter their coin PIN code for their chance to win prizes. “The PIN number is important because Scotiabank will make an extra $5 gift to Holland Bloorview every time a PIN code is entered,” Bailey said. There are more than 500 prizes, including a weekend stay at the Great Wolf Lodge for your family and nine other families of your choice. weekend events Change for Kids also features two events this weekend: a Halloween party at the Ontario Science Centre Saturday night (Oct. 27) and a “Monster March and Fun Fair” at Holland Bloorview on Sunday (Oct. 28). midnight. The march and fun fair runs 11 a.m. to 3 p.m. Tickets are $12.50. The march consists of a twokilometre walk around the Holland Bloorview property. “About every 10 feet along the two-kilometre walk, there are treat stations and trick stations and all kinds of fun things for kids to do,” Bailey said. Net proceeds from Change for Kids go to Holland Bloorview. The hospital, located at 150 Kilgour Rd. in the Bayview and Eglinton avenues area, provides specialized programs and clinical care for youth with rehabilitation and complex care needs. It has about 600 inpatient admissions and 53,000 outpatient visits each year. “Change for Kids is not only about raising money right now for the programs and services of the hospital,” said Bailey. “But the word ‘change’ has been very specifically selected because it means that everyone is doing their part to change attitudes towards disability and to make the world more accessible for everyone.”
