NEW RIVER – If you live in the northern rural desert foothills communities thank a firefighter because they have been working non-stop this relentless fire season, making sure everything we love doesn’t burn down to the ground. And summer is just heating up. So far since Friday, June 21, Daisy Mountain Fire and Medical’s (DMFM) firefighters have responded to six fires in the area, which included a first alarm wildfire south of Cordes Junction that burned over 2,500 acres. It all started this past Friday afternoon when the DMFM’s

Black Canyon City Station was dispatched to a brush fire near Badger Springs Road on the northbound Interstate 17 at milepost 252. Meanwhile, the Mayer Fire Department was dispatched to a brush fire near milepost 257 southbound on Interstate 17. The fire on the southbound side was contained by Mayer firefighters with approximately 40-acres burned, DMFM officials said. However, Matt Wood, a DMFM firefighter on the scene and spokesman for the

you look at something that appears to be simple it turns out to be very complex.” Rather than dull, zoning questions relating to size and spacing, the issue has taken on epic, constitutional proportions. This was underscored by many references to a skirmish that started when a Gilbert church’s use of directional signs was cited for violating the town’s Sign Code. The

CIVANA Lights Drone Show providing a safe alternative to fireworks in the desert foothills community

CIVANA Resort in Carefree will be putting on a free drone light show on July 6, starting at 8:45 p.m. to celebrate Independence Day. The town will also be hosting a block party.

CAREFREE –The Carefree area will get a modern alternative to the traditional firework show for its Independence Day festivities with an aerial drone light show, providing a safe, sparkless alternative to fireworks while the area remains under high fire risk. The community’s newest wellness resort CIVANA will be hosting its second annual, “CIVANA Lights: Drone Show Spectacular.” The aerial light show will feature 100 custom LED-lit drones beginning at 8:45 p.m. on Saturday, July 6, to celebrate Independence Day. The high-tech show offers an innovative and sustainable alternative to traditional holiday fireworks, along with weekendlong festivities happening in the community. The drone show is open to resort guests and the public. Access is free. Additionally, street side CIVANA and the Town of Carefree will be hosting a festive Community Block Party from 7 to 9:30 p.m. Resort guests and locals alike are invited to enjoy live music, culinary delights, food trucks, tasty beverages by Terras restaurant, family fun experiences and more. MTA announces summer theatre programs ANTHEM – Musical Theatre of Anthem (MTA) announces their 2019 summer camps, productions, and workshops for performers ages 3-adult. As Supreme Court Justice ClarenceThomas wrote, in his majority opinion in the Gilbert case:“A sign ordinance narrowly tailored to the challenges of protecting the safety of pedestrians, drivers, and passengers—such as warning signs marking hazards on private property, signs directing traffic, or street numbers associated with private houses—well might survive strict scrutiny.” Here in Cave Creek, freedom of speech, as powerful as it is, is far from the only concept being scrutinized. At the council meeting, Buffalo Chip Saloon and Steakhouse owner Larry Wendt - conveniently enough, also a Cave Creek resident warned that this sign issue might make residents feel they are battling businesses. “What usually happens when businesses get pitted against citizens,” a petition-wielding Wendt warned the council, “is you guys are gonna be in the middle.” A Cave Creek sandwich, so to speak. Wendt and other fired-up residents and business members came to lobby council on a proposed ordinance that thoroughly rewrote the town’s sign ordinance. What really got some businesses agitated was a new section that outlawed portable signs (commonly called sandwich signs) and demanded “all portable signs shall be professionally produced.” In the public comment section of the council meeting, Wendt complained that the town “keeps pushing businesses down” and warned “We’re trampling on other people’s rights.” Mark Bradshaw, who has owned the biker-friendly

church protested -- all the way to the U.S. Supreme Court (“Reed v. Town of Gilbert”). In 2015, the Supreme Court ruled the town's sign ordinance was unconstitutional. As summarized by the International Sign Association, “The court unanimously found that placing limits on temporary directional signs that were more stringent than these other types of temporary signs was a content-based regulation of speech—a violation of the First Amendment.” Though the ruling was unanimous, several on the court argued it went too far. In a concurring opinion, Justice Elena Kagan snarkily stated Gilbert’s sign ordinance “does not pass strict scrutiny, or intermediate scrutiny, or even the laugh test” - but warned that the majority's opinion would jeopardize "entirely reasonable" existing sign ordinances in hundreds of cities and towns. “Our communities,” she predicted, “will find themselves in an unenviable bind: They will have to either repeal the exemptions that allow for helpful signs on streets and sidewalks, or else lift their sign restrictions altogether and resign themselves to the resulting clutter.” Enter Cave Creek. The Gilbert decision looms over Cave Creek’s signs controversy, which had been smoldering for years, simmering in election seasons; at the mid-June town council meeting, it ignited. Spoiler alert: Cave Creek made no decisions on signs, setting the matter aside for future vote. While critics might groan over the indecisiveness, council members stressed they want to get this complex matter just right

Hideaway bar since 1997, normally is a business rival of Wendt’s. Here, he was on the same team, urging council not to clamp down on signs. “We just have to all work together,” Bradshaw said. On the other side of the sign, one resident said sandwich signs look like the town is having “a continuous garage sale.” Eileen Wright also wanted sandwich signs de-crusted, with exceptions for special events like the popular Hidden in the Hills annual art event. She added the sign saga was not new: “For years and years it has been going from town hall to the attorney, from town hall to the attorney...Let’s get this solved once and for all and done correctly.” After public comments, each of the seven council members shared views that echoed. As council member Susan Clancy put it, “We need to get it right so we’re addressing both sides of the issue - and it’s legal.” Fellow councilor Robert Morris said he was holding out for something “that has a solid legal foundation that can minimize the chance we end up in a very expensive court case.” Mayor Ernie Bunch summarized: “I would prefer to slow down and get this right and make sure we’re not stepping on anybody’s rights.” Council voted 7-0 for the town to consult with conservative/libertarian think tank the Goldwater Institute

The summer travel season is here. First, it seems that many people on planes have kicked off their sandals and then stick their (smelly) feet right in between the seats in front of them. This has caused near fist fights, a

horrified passenger looking at a disgusting foot might do things like pour hot coffee on it. Yes, it is even more disturbing that flight attendants see folks cutting their toenails on flights! Just when I thought it cannot get much worse, there are folks who have removed their pants on flights (for the ultimate comfort), drink too much alcohol and use the tray tables for things we might not discuss in this fine paper. Okay, diaper changes occur, but let’s say I might never pull down a tray table again without a full-on bleach cleaning. Doggies barking, peeing and pooping are not so uncommon on flights. Well, at least they are usually kept in their crates. But if you have ever sat behind a doggy with an upset tummy on a four-hour flight, it is a less than pleasant experience. In fact, in can be doggone stinky! Sometimes babies scream on flights. Okay, we deal with it. But a dog howling throughout the flight is ridiculous. One man said he sat next to a lady with an African Grey parrot. The parrot kept yelling, “Get the h*ll away from me!”. It was sort of funny, but after three hours the man thought he might go mad.

Then there are just rude people who are “space invaders.” They take over the middle armrest, move their leg into your leg space and might even hijack your tray table for an "extra” device or laptop. Then there are those who do not follow an essential travel rule: If you cannot pull it, carry it or lift it – your suitcase is too big. Everyday flight attendants are asked to lift large and heavy pieces of luggage into the overhead bins because the owners won’t or can’t. There have been reports of people on long flights doing yoga moves in their seats, pushups in the aisles and hand-stands (yep, this is true) at the back of the plane. And food? Let’s just say everything from burgers, pizzas and big gulps are finding their way to a seat next to you. One time I got a glob of guacamole in my hair from the guy eating next to me. Flying soon? PEORIA – After 20 years of service to Peoria and three months after resigning, former Councilmember Carlo “Rocky”

Leone passed away on June 19. He was 84. “I am saddened to hear of Carlo’s passing,” said Mayor Cathy Carlat. “He spent many years representing the citizens of Peoria’s Pine District and I am grateful for his dedicated service. On April 16, 2019, Leone announced his resignation to the Peoria City Council after six terms, citing ongoing health issues. Leone was elected to represent the Pine District in May 1999. “It is a blessing that he was able to spend his final months surrounded by those he loved most. My prayers are with his family and friends during this difficult time,” Carlat said.

During his tenure, he was known for his outspoken nature and unwavering dedication to his district and its residents, frequently visiting constituents at their homes and city or neighborhood events. “Carlo was a passionate public servant who cared deeply about the residents of Peoria,” said Peoria City Manager Jeff Tyne. “He was committed to helping make Peoria a wonderful place to live. He will be greatly missed.” Leone lived more than 30 years in Peoria with his family. He is survived by his five children, 13 grandchildren and 19 great grandchildren. Details about Leone’s funeral arrangements are forthcoming.

Memorial Day in Carefree: A day for remembering and expressing thanks

The event honored the 41 veterans interred in the cemetery who served our nation in military service. This special Memorial Day tribute embodied all of the elements a small town holiday honor should include: Local students; humble veterans and their families who seldom share their stories; a young local girl with a beautiful voice singing the National Anthem; local businesses lending a hand, a local Boy Scout troop presenting and posting colors; and a heartfelt thank you from the community to all of those who served and made the ultimate sacrifice with their service. Since Memorial Day, we have lost two local servicemen, both of whom have contributed to past veteran tributes held by the Town.

Pastor Richard Andersen, a Vietnam veteran and the executive director at Spirit in the Desert Retreat Center, passed on June 7, just days after leading the Memorial Day invocation. Major Arden Rowley, a POW and veteran of the Korean War spoke at the town’s Veterans Day Honor in November, and passed away on Flag Day, June 14. For those who attended, read about or viewed the video, Major Rowley’s talk was one of the most memorable presented in the 10 years of the event. Both men will be sorely missed. As a community, we honor, respect and value what all veterans have done to keep our country safe. In the spirit of Memorial Day, remember to reach out and thank them while they are still with us.

Free admission for Peoria’s July Fourth All-American Festival PEORIA – Fireworks aren’t the only highlight of Peoria’s All-American Festival. On Thursday, July 4, there will be games, entertainment, live music from Cadillac Angels and Surfin’ USA and more. The event’s festivities will begin when gates open at 5 p.m., including entertainment, food-eating contests, the 7th annual cornhole tournament, familyfriendly activities, inflatables and two 43foot waterslides to keep everyone cool. New this year, admission and parking are free. No need to park and watch, come inside and enjoy the party. Five-dollar wristbands are available for purchase for kid activities and food concessions and cold beer will also be available. The Peoria Food Challenge, sponsored by Sonic, features three food-eating contests that test contestants with drinking a Route 44 size slush or eating three pounds of tater tots as fast as possible. In the hot dog eating contest, contestants try to eat as many hot dogs as possible in 10 minutes. The cornhole tournament will begin at 5:30 p.m. and features teams of two competing for cash prizes. The Greater Phoenix Economic Council wants California residents and businesses to move to the Valley, and they’re trying their best to make their happen. The Time to Get Out campaign and the #CAstruggles twitter account are both bids by the council to attempt to persuade people to leave California. The campaign and account highlight the high cost of living and the tax burden of Arizona’s glamorous neighbors. The president and CEO of the council, Chris Camacho, says the group has 24 branded cars that are advertising the council’s website to San Francisco residents. “For the last 10 years, we’ve seen a number of companies,

because of the tax and regulatory environment, decide it’s time to expand or relocate out of the California market,” he said. “And so we want to be the location of choice when these companies decide to move knowledge workers out of California into Arizona.” The campaign’s website boasts that 60,000 Californians moved to Arizona in 2017. Two aspects driving Californians to leave the state are housing prices, $256,000 in Phoenix versus $954,100 in San Francisco; and an ever increasing corporate income tax, 4.9% compared to 8.84%. “The TimeToGetOut.io campaign is really focused on giving side-by-side comparisons for the knowledge workers and technology companies to evaluate their options,” he said.

“And we’ve seen over 200 companies over the last few decades move out of the California market into greater Phoenix.” According to Camacho, the Valley’s skyrocketing economic growth and its diversity make it an excellent place for businesses and investments. “There’s a number of young, high-growth companies and a number of major corporations … that continue to add highwage jobs and knowledge worker opportunities in greater Phoenix, and we expect that to continue,” he said.

Large billboard at New River Shell station approved by county BY TARA ALATORRE

PHOENIX – On June 20, the Maricopa County Board of Adjustment approved a zoning variance in a 2-1 vote that will allow the owner of the New River Shell gas station to build a billboard standing 66feet tall, which is twice the size normally allowed. The building permits for the billboard will be applied for within 180 days and construction will be completed within one year. The sign will be constructed on the northwest side of the property located near the Interstate 17 and New River Road, according to the application filed. The billboard, which includes lighting on both sides, will be 14 feet by 48 feet with a total face surface of 672-squarefeet and will be used for off-site advertising. The county received 32 opposition letters, including from the New River Desert Hills Community Association and

a petition in opposition to the variance with 116 signatures, according to county documents. “The proposed sign would be more than double the size and height allowed in the text amendment and would have a disturbing effect on the community in the northwest residential area of I-17 and New River Road,” stated a letter from NRDHCA to the county in opposition to the variance. Maricopa County Board of Adjustment (BOA) Acting Chairman Greg Loper and member Jeff Schwartz voted in favor of approving the variance and member Fern Ward dissented. BOA members Jason Morris and Craig Cardon recused themselves from hearing and voting on the case. There were six stipulations included by the BOA before it passed, some included turning the lights off at 11 p.m. and that light fixtures for the sign must be limited to two fixtures per side. to approve the variance at the June 20 meeting, acting chairman Loper noted that the site was adjacent to a freeway with much higher elevation. So increased sign height and size was necessary to safely view the billboard, stated Maricopa County Planning Services Manager Darren Gérard in an email regarding the BOA's decision. However, the variance request failed to meet the statutory test by the Maricopa County Planning and Development. “The applicant has failed to demonstrate that there is a peculiar condition facing the property because the argument made by the applicant is due to the elevation of the adjacent freeway, not any peculiar condition of the property itself,” stated the findings from a staff report to the BOA . The county planning department also noted that the site of the billboard is a part of the I-17 Natural Scenic Corridor, which has guidelines suggesting no billboards. “Allowing additional height and size for an off-site advertising sign in a scenic corridor would take away from the natural benefits of a scenic corridor,” stated the staff report. “In addition, the reasoning behind the need for

the variance due to the terrain and height of the freeway is part of the reason why the area is considered a scenic corridor.” The variance to the Maricopa County Zoning Ordinance was requested this April by Carolyn Oberholtzer, an attorney representing the owner of the gas station, the Carioca Company, according to the application documents filed. “The 672 sf [square foot] sign face area is allowed in other jurisdictions around the valley including the City of Phoenix approximately one mile south of the property, and will attract higher caliber tenants, which will result in an improved aesthetic appearance,” stated the applicant in its request to the BOA. The county requires the burden of proof on the applicant for variance requests that must demonstrate a peculiar condition related to the land that is not common of other properties, and would give undue hardship to property owners. If the sign was built at 30 feet with an maximum area of 300-square-feet, which is currently the maximum permitted, it would be essentially invisible to traffic on the freeway due to the different grading on the four-acre property, Carioca Co. claimed in its request.

“The sign’s distance from the freeway lanes where it is intended to be viewed limits readability,” the application states. “The applicant cannot alter the freeway configuration with an entrance ramp and median at this location or the embankment between the property and the elevated freeway travel lanes.” A handful of residents from New River attended the meeting on June 20, and all spoke out against the variance, including two young girls. “If the zoning laws were firmly held, the sign project would have failed because it wouldn't be visible from the freeway and of little value for advertising," New River resident David Thompson said in an email to The Focus after attending the BOA meeting. " Instead, they essentially bargained away the night sky to someone that games the system.”

department says that the fire on the northbound side of the highway was much larger and was active in the median by the time crews arrived. Mayer firefighters joined Daisy Mountain crews at the Badger Springs Fire after they extinguished the southbound brush fire, according to Wood. “The fire had crossed over to the northbound lanes of the freeway over to the east side of the I-17,” Wood said in a telephone interview with The Foothills Focus. “It had gone down into the Agua Fria recreation area in about an hour, burning about 100 acres.” Winds coming from the west exacerbated the fire, and crews from the Bureau of Land Management (BLM) arrived on scene with U.S. Forest Service firefighters and air tankers deployed at approximately 4 p.m., according to wildland fire

officials. About 150 personnel were working the fire. The Arizona Department of Transportation (ADOT) closed the highway in both directions near Sunset Point around 6 p.m. that evening. Eventually, law enforcement was brought into direct traffic and reroute cars, according to ADOT’s Twitter. “At one point I looked up and there was a solid stream of headlights, it was insane I’ve never seen anything like it,” Wood said of the traffic caused from the highway closure. ADOT reopened the southbound I-17 around 10:26 p.m. and then the northbound side reopened at 11 p.m. A car burst into flames during the traffic jam after an alleged drunk driver rear ended another vehicle, causing it to catch fire. Crews on scene extinguished the car fire, and two people were evaluated on the roadside, but no injuries were reported, according to DMFM. “We worked the fire from the afternoon until about 11:45

p.m.,” Wood said. “While we were on scene two large air tankers, three single engine air tankers and a helicopter tanker were on scene.” The Badger Springs Fire is currently 80 percent contained and burned approximately 2,500 acres at the time this was written. The fire is expected to be contained by June 26, according to U.S. fire officials. On the same evening that the Badger Springs Fire ignited DMFM was also dispatched to another brush fire west of I-17 on Table Mesa Road that burned for several hours, charring approximately 20 acres. about 6:30 p.m. another brush fire was reported four miles west of the Table Mesa Road, which was extinguished and contained. Not able to catch a break in less than 24 hours from their last dispatch, Daisy Mountain crews kept a brush fire from spreading to homes and businesses in New River on the afternoon of June 24, near 39th Avenue and Circle Mountain Road. It ignited around 3:30 p.m. on Monday, according to residents in the area. By 4:30 the blaze had grown and was still an active fire, with homes and businesses just a stone’s throw away. Phoenix Fire Department arrived on the scene to support Daisy Mountain about 90 minutes into the fire igniting, witnesses said.

“I was impressed, they were on the fire immediately and did not waste any time,” Karen Alexander said, who works in the Riverside Plaza, which is located north of the fire. “The I-17 Frontage Road was closed for several hours while they were working the fire.” Residents say the fire burned for several hours and crews were still monitoring the area and treating hot spots on Tuesday, June 25. The official cause of that fire is unknown at this time, but DMFM says initial reports were that a transformer may have malfunctioned, which is still unconfirmed at this time. Thirty-three acres burned, but no property was damaged. One person was treated and released for smoke inhalation, DMFM Public Information Officer Brent Fenton stated in an email. Four hours later on June 24, DMFM was dispatched, yet again, to another brush fire near 12th Street and Desert Hills Drive, according to the department’s social media. “Crews made a fast, aggressive fire attack and stopped the fire from spreading to any nearby structures,” Fenton stated. “No injuries were reported.” For more information about wildfires in Arizona visit https:// inciweb.nwcg.gov.

1995, that was the year Disney and Pixar Animation Studios released an animated film that would reshape how the animation movie would be developed. “Toy Story” is a seminal cartoon classic, a film that has aged with the many young people who experienced it first in the 90s. For those who may have been children in 1995, the “Toy Story” franchise has been a continuing saga of storytelling. Moving cowboy Woody, spaceman Buzz Lightyear and the rest of the toys through the entire childhood of Andy, who grew up and gave his toys to another young person named Bonnie; who could restart the journey. It’s an accomplished feat of storytelling, a journey filled with fun adventures, countless laughs, boundless amounts of love and ageless life lessons. So, it’s surprising that the tale continues with “Toy Story 4” more than 20 years after the release of the initial film. The quality that exists in this extended story is that many of those kids who first watched “Toy Story,” now have the opportunity to take their young children to experience these characters on the big screen. After the near perfection of “Toy Story 3” it would seem like there is no other way to take the story of Woody and Buzz in a direction that would be satisfying enough to not tarnish the quality of the trilogy that

came before it. Worry not, “Toy Story 4” is exactly what you are expecting it will be, but it is also something unexpectedly different in surprising ways. Woody (Tom Hanks), Buzz Lightyear (Tim Allen), and the rest toys are going on a road trip. But they have a new friend, Forky (Tony Hale) that Bonnie (Madeleine McGraw) crafted during her first day at school. The new adventure has Woody taking care of Bonnie’s new favorite toy Forky, who is consistently trying to escape. During the journey however, Woody has an unexpected reunion with a long-lost friend Bo Peep (Annie Potts), and encounters a new toy named Gabby Gabby

(Christina Hendricks) who has devious plans. Pixar has crafted these animated worlds with such precision and meticulous detail that it’s starting to blur the visual lines between what is real and what is manufactured. A colorful carnival at night with glistening and glowing lights, a dusty antique store filled with cobwebs and creepy ventriloquist dolls and an aggressive feline who purrs as honest as it hisses are exceptionally composed works of animation. It’s simply beautiful to see these worlds operate. What happens when playtime is over? This narrative theme plays throughout the film, specifically with the character of Woody who has been replaced,

almost completely, as the favorite toy of Bonnie’s. The story does a nice job of leaving the home, building a fun road trip adventure that veers in and out of situations with old friends, while supplying new friends to fill some necessary spaces for Woody’s character development. It’s within the journey of Woody and the new struggle he is having with the relationship about his purpose as a toy where the most interesting elements of “Toy Story 4” begin to take shape. It’s reflective and somewhat melancholy, connecting on numerous levels for viewers who grew up with the content, but also for those new to the story. That’s the joy of good storytelling, it connects

with people in different and unique ways. Whether it's the elements related to understanding the role parents have when adapting to maturing children. Or the aspect of being brave while understanding fear for young kids, it’s a nice composition. The “Toy Story” franchise has been around for a long time. Children have grown into teenagers, who have grown into adults, and may have young children of their own now. That’s the best part of having this new tale available, it's an opportunity to experience cinema together as a family. “Toy Story 4” is a film you may not have wanted, but rest assured it’s a film that you will be happy you got.

Development shouldn’t be rubber stamped DINO COTTON, ANTHEM ARROYO GRANDE

ANTHEM – The growth in our area is inevitable, but regulation of that growth is absolutely vital. We cannot allow any more perpetual rubber stamping of new land development without proper planning and infrastructure support. El Dorado Holdings, a prominent local developer, is looking to build 170 new homes in the New River Wash, west of the new Circle Mountain neighborhood [which The Foothills Focus last covered in its June 12 issue]. They want to raise the FEMA restricted river basin up 6 feet on 13 acres of land so that they can squeeze in 47 more houses. This will remove the land from the floodplain, squeezing the river and changing its direction and intensity during flood season. The redirected and compressed rapids will directly impact the neighborhoods downstream

that include Arroyo Grande and West Anthem. I’m hopeful other residents will see the danger in this and feel empowered to contact City of Phoenix Councilwoman Thelda Williams and tell her that we voted for her to protect us. We, her constituents—and not irresponsible developers— should be her priority. If we don’t speak up, no one else will. Her email: council.district.1@ phoenix.gov. The Phoenix City Council plans to meet July 3, at 10 a.m. to decide our fate. If City of Phoenix/Anthem residents can attend that meeting in addition to emailing Thelda, we may stand a chance.
