NORTH VALLEY – The Daisy Mountain Fire Department and Black Canyon City Fire Department’s fire boards discussed options for the districts to merge or consolidate during a public meeting on Jan. 19.

Mark Nichols, DMFD Fire Chief and BCC Fire acting chief, noted that the purpose of the meeting was to gather information.

Each board received documents detailing what different options would look like, including financial data and legalities.

The two fire districts have always worked closely together,

and BCC Fire also receives administrative services from DMFD, under a contract that ends this year. Now, it’s being proposed that the districts join forces, through a merger, consolidation, or under a fire authority. Each of these options would look different in practice: a merger would combine assets, capital, and the fire boards; under consolidation, one entity would be taken over by the other; and with a fire authority, the districts would share a partnership and retain their own boards, under the governance of the fire authority.

Corporation Commission holds public DMFD firefighter killed in off-duty altercation comment hearing for EPCOR wastewater case NORTH VALLEY – Daisy Mountain Fire Department Firefighter Luke Jones, a 12-year DMFD veteran, was killed in an off-duty altercation in metro Phoenix on the night of Jan. 21.

Phoenix Police announced on Tuesday that detectives have developed probable cause and arrested two people in connection with Jones’ death.

Police arrested Brandon Draper on a charge of second-degree murder and Timothy Piegari on charges of hindering prosecution and evidence tampering.

Sun City and Sun City West customers, however, pay about $22 per month, so their bills would increase under full consolidation.

Other options include keeping the districts the way they currently are or deconsolidation, which wouldn’t change Anthem customers’ rates but would further raise other districts’ rates.

DMFD noted in a statement to the community that the main focus of department staff at this time is meeting the needs of Jones’ family; he leaves behind a wife and daughter.

An Advertisement May Not Be an Actual Offer

Before a contract can be formed, there must be an offer and an acceptance of that offer. But what about an advertisement?

Is the person who placed the ad legally obligated by the terms of that ad?

Probably not.

An offer is something that creates a power of acceptance in the receiving party and a liability on the part of the person making the offer. It is different than an expression of intention.

For example, if Fred says, “I’m going to sell my truck for $2,000 and Sandra replies, “All right, here is a check for $2,000, I’ll take it,” then there is no contract because Fred was stating a future intention rather than an offer.

Advertisements often work the same way.

Advertisements, catalogues and similar items containing price quotations are usually considered to be only invitations for offers. They are announcements of what prices the seller is willing to consider. However, if the advertisement is very specific, it may be an offer. There

are also consumer protection laws that apply to this area; but there are two very famous law school cases on this point.

In 1891, a company in England advertised a product called a Carbolic Smoke Ball, that is somewhat similar to a modern smoke grenade. It promised to prevent influenza and to cure a variety of respiratory ailments.

The advertisement offered a reward of 100 pounds to anyone who became sick after using the product as directed.

The ad even boasted that 1,000 pounds had been deposited at a local bank in the event any payments would be necessary.

A plaintiff used the smoke ball for three months until she caught the flu and then filed a lawsuit seeking to enforce what she believed to be a guarantee. Carlill v.

Carbolic Smoke Ball Co., 1 Q.B. 256 (C.A. 1892). However, the court held that the advertisement was not actually an offer and that remains the general rule today.

In contrast, in a more modern case, an advertisement was held to be an offer because it was very specific. An ad reading that a stole worth $140 was available for $1 on a first come, first served basis. A state supreme court upheld that language as being an offer based on containing a combination of “first come, first served” language and a limited quantity.

The first step of any contract is an offer.

Before you accept it and before you sign any contract, make sure that both sides understand the obligations required.

Yavapai County Emergency Management urges drivers to use caution during winter storms YAVAPAI COUNTY – Yavapai County Emergency Management is reminding drivers that if you must drive during a winter storm, safety should be your number one concern. It is best to stay off the roads until conditions improve.

If you must go out, the Emergency Management team is offering some tips on how to get ready for winter driving conditions, and how to handle them once you’re in the thick of a winter storm.

Place some extra clothing and emergency items in your vehicle; these will come in handy if you break down in very cold weather. It doesn’t take much – assemble a basic kit including a pair of gloves, weather-resistant pants and/ or coat, maybe an old pair of boots, a blanket, jumper cables, a flashlight with some extra batteries, and a windshield scraper (and maybe a de-icer), as well has some snacks and water. Some suggest placing a bag of kitty litter in your trunk, to put under the wheels if you find yourself in a slippery spot.

Watch for black ice. While a shiny road surface indicates an obviously wet or icy road, a road covered with black ice will look a little different. Keep an eye out for pavement that is slightly darker and a little duller looking than the rest of the road surface, as this may indicate that black ice is present. Because black ice is so tricky to detect, a driver may not realize there is an icy road surface until his car begins to slide.

Here are some tips on how to drive on black ice and slippery roads: • As soon as your car begins to slide on black ice, take your foot off the gas pedal. In fact, the last thing you want to do is give your car more gas.

It is very important to slow down when you are driving on black ice or in any other winter road conditions.

• Don’t slam the brakes. While it may be a natural instinct to slam on your brakes, this will only cause your car to lose control and slide even more.

Tap the brake pedal lightly instead of pushing down hard on it.

• Look for trouble spots ahead. If you have an idea that there may be black ice ahead (if you see cars ahead of you sliding, for example), downshift to a lower gear before you come onto the black ice. The lower gear will force you to drive more slowly and it will give you better control of your car.

• If your car does begin to skid on the ice, turn the wheel in the direction of the skid. This should help to steer your car back on the right track.

• Leave plenty of space between your car and the other cars on the road. When driving on icy road conditions, stay well behind the car in front of you – at least a couple of hundred feet. This is definitely not the time to tailgate. Even if you feel confident that you know how to drive safely on black ice, that doesn’t mean the driver in front of you does.

Be prepared in case other cars start to slide.

• Even trucks or a big sports utility vehicles can slide. While 4-wheel drive vehicles are great for driving in heavy snow, you’re on your own when it comes to driving on black ice. In fact, 4-wheel drive vehicles have no advantage over regular cars when it comes to driving on black ice, so be sure to take the necessary safety precautions no matter what type of vehicle you are driving.

Other precautions: • Drive with your low beam headlights on even if it is daytime.

This will make your car more visible to the other cars on the road.

• Make sure your tire tread is in good condition as part of your basic car maintenance routine. Worn tires will make it much more difficult for you to drive on black ice. Make sure there is plenty of traction between your tires and the road surface.

• Black ice is most commonly found on roads that run around bodies of water (such as lake and rivers), in tunnels and in shady or rural areas. Bridges and overpasses are also common spots for black ice to form. Use extra caution on bridges and overpasses, where the road surface freezes more quickly. Even if you have been cruising down the highway with no problem, an overpass or bridge can be unexpectedly icy.

• Be sure to wear your seatbelt.

Winter driving is always unpredictable so be prepared for the unexpected and keep yourself safe!

“This proposal would require elderly residents to subsidize more affluent communities,” said Sun City resident David Melrose, calling other districts’ water systems a “Ferrari wastewater system while we have a ’67 Chevy system.”

Sun City resident Roberta Kettles said she and many other residents are living on fixed incomes.

“We don’t have any more money, we can’t get any more money. Not like young people who can go out and get a second, part-time job,” she said.

“I think it’s just unfair,” said Jared Ingram of Sun City.

Residents of other wastewater districts spoke in support of full consolidation, many noting that they too are trying to make ends meet.

The Anthem Giving Circle was created by Bernice Volinsky, and she and Janet Langdon were the first co-chairs. The AGC has grown from five members at inception to over 35 members now.

The Anthem Giving Circle supports families throughout the north valley, receiving most requests through the St. Rose Conference of St. Vincent de Paul. Anthem Giving Circle is a member of the Network of Anthem Area Assistance Providers. According to AGC members, in the past year, they have donated to approximately 63 families. The AGC also provides financial support for the Foothills Food Bank.

They provide support for local schools, donating backpacks, scholarships, gift cards, and supplies. AGC members donate

their own funds to the good works of the organization to support these programs.

“We feel that this organization provides a way of connecting to those in need with those interested in helping,” Anthem Giving Circle members Dianne Christenson, Janet Anderson, and Sharla Powley wrote, regarding the importance of AGC in the community.

“While doing important work, the group wants to have fun doing it and make a difference in our community.”

Verrado resident Rebecca Blue noted that she’s a retired schoolteacher and on a fixed income herself.

“All of EPCOR’s customers should pay the same rate for the same service from the same provider,” she emphasized.

Michael Harris, also a Verrado resident, concurred, stating that by the constitution, they should be charged the same rate for the same service.

“We urge you to make a decision and put this to rest once and for all,” Harris asked the Commission.

Danielle Wylie of the Agua Fria district said she works three jobs in an effort to make ends meet. She said her water bill has gone from $70 to $270, with $150 in service fees before any usage.

“Our community has been asked to pay the cost for neighboring communities.

We are customers of the same water company. We should pay the same services and fees,” she said.

John Balzer of Anthem noted that Anthem is home to many working-class families with kids and that many couldn’t attend the public comment hearing since they would either be at work or caring for families.

He expressed understanding of the Sun City customers’ financial situations.

“We struggle just like everyone else does,” he said, noting that Anthem customers may have financial difficulties, too.

An evidentiary hearing will be held on Feb. 15, furthering the wastewater rate case.

community news Office of Arts and Culture seeks grant review panelists PHOENIX – The Phoenix Office of Arts and Culture is seeking knowledgeable, fair-minded, and responsible individuals representing different points of view and various cultural orientations to serve as arts grant review panel members. If you are an artist, arts professional, non-profit leader, educator or member of the general public interested in the arts, the Arts and Culture office urges you to onsider applying to be a grant review panelist.

Serving as a panelist involves reading applications submitted in a category, then meeting anywhere from a half day to a full day with other panel members to discuss and rank each application using established evaluation criteria.

Phoenix approves bus service to match light rail hours PHOENIX – The Phoenix City Council has approved extending the weekend hours of local bus and Dial-A-Ride starting in April, so bus and Dial-A-Ride hours will match light rail hours every day of the week. This means Friday and Saturday hours will extend until 2 a.m. and Sunday to 11 p.m.

This service day expansion is a major step in the way Phoenix moves. The first step came last October when three hours of service was added to every day of the week, as well as an improvement to frequency to ensure all local routes in now operate at 30 minutes or less intervals, seven days a week. The improvements were planned in two steps to allows Phoenix’s service providers time to hire and train more than 200 new drivers, cleaners, mechanics and other jobs needed to implement the improvements.

Since the T2050 started one year ago, the plan has been instrumental in other service upgrades as well, such as a new bus route, new buses and a contract for a new vehicle location system to replace the existing, aging system.

Whether or how to combine will eventually be put up to a vote of the fire board members.

Public hearings for community input will be held first, and the Maricopa County Board of Supervisors would also have to approve any changes.

Combining the districts in some way would offer administrative savings, improved communication since the districts would then share the same communication system, and offer more buying power for healthcare and other similar large contracts.

The Black Canyon Fire Department is facing serious financial difficulties, as well, and some combination of the districts would ensure the continuity of service in that area, both for residents and for the many drivers on the I-17, which is a common area for serious accidents.

BCC Fire board member Sharon McMahon said at the Jan. 19 meeting that they were on “baby step one” of deciding what to do about the financial difficulties BCC Fire faces.

“We’re looking at whatever we can do that will provide the most service to our community,” McMahon said.

The two major questions that have been asked regarding changing the fire districts’ status quo are: 1. Will this cost anything? and 2. Will this affect response time and service?

Nichols has said repeatedly that no changes will be made unless they are cost-neutral for DMFD. BCC residents also would not be facing any financial changes.

DMFD board member Joe Cantelme addressed an audience member who was questioning costs, saying, “If it costs us money, we’re not going to do it. It’s that simple.”

Cantelme also noted that the districts have always worked in partnership to service the communities.

“I’ve been on this board 20 years,” Cantelme said. “We’ve been going up to Black Canyon City, and they’ve been coming down to help us.”

When an emergency call comes in, a unit is dispatched, and first responders get to the scene as soon as possible, in 4-6 minutes, in general. The focus at this point, Nichols says, is to “stop the clock” for the patient, performing CPR or whatever is necessary to get that patient stabilized for transport to a hospital, if needed. Firefighter/ EMTs arrive on-scene in a fire truck, and an ambulance arrives on-scene, if needed.

“As one station covers another, vacancies are covered,” Nichols explained. He noted that automatic aid “saves a tremendous amount of money” and is highly efficient. When an incident requires specialized units that not every department has, such as a HAZMAT unit, CAT will assign the closest automatic aid partner that has the needed unit available.

“It’s seamless,” Nichols described.

At the Jan. 19 meeting, DMFD Deputy Chief David Maxwell noted that many calls are on the I-17 freeway and don’t have clear jurisdictions.

“If we’re on the same alarm room, we’re probably cutting off a few minutes. This could be better for Black Canyon City, becoming an automatic aid partner instead of mutual,” Maxwell explained.

“I’ve been on this board 20 years,” Cantelme said. “We’ve been going up to Black Canyon City, and they’ve been coming down to help us.” measures for the patient and get needed information, as much as possible for the hospital at which the patient would be admitted.

If combined, BCC Fire would join the automatic aid system of which DMFD is a partner, through which departments around the county are automatically dispatched to help departments that are experiencing a major call or multiple emergencies.

This includes incidents such as a bad crash on the I-17 or water rescues, such as when the August 2014 flood in New River necessitated several rescues; on the day of that flood, units from as far as Buckeye helped cover the north valley, ensuring adequate response for the area.

Automatic aid works through Computer Assisted Dispatch

Citing examples of the frequent I-17 calls to which BCC Fire responds, Maxwell noted that his concern is making sure that Black Canyon City is covered for emergency services when BCC first responders are assisting with a major accident on the freeway or a working fire. Automatic aid would help ensure adequate coverage, which Maxwell noted is county-wide.

“We just want you to dial 911 and get a fire truck with paramedics on it within 4-6 minutes,” he stated, noting that this can “stop the clock” for serious incidents and that the responding paramedics can arrange transport if needed.

Maxwell noted that everyone uses the freeway, no matter which community they’re from and emphasized, “We want there to be the amount of help needed, no matter which side of Table Mesa they’re on.”

Community meeting dates on this issue will be announced as they become available.

Do you have a few hundred thousand bucks to spare? If so, there is some poor parent (no pun intended) who could use it. Evidently the cost to raise a child in America who was born last year will be a staggering $233,000 over the next eighteen years! Not sure how the U.S. Department of Agriculture came up with that figure, but if we do the math, it means we’re spending money almost faster than we can earn it or save it. If you live in the Northeast, you are likely to spend over $345,000 per child. If you live in rural areas, you might only spend $193,000 on each kid. Hey, we all know those tire swings cost a lot less than video games.

One thirty-two-year-old man emailed me to say his wife is pregnant with twins. He said since hearing the “cost report” on CNN he has not had a decent night’s sleep. Over half a million bucks to raise two children and that doesn’t include college. He said his wife has already spent “thousands” on things like cribs, car seats, diapers and clothes and wondered if “pre-birth” costs come off the total figure. I am no accountant, but I warned him that he might want to get used to spending, because it only seems to escalate after the kids are born.

A few generations ago children were seen as costsavers. One more son to plow the fields and another girl to cook the food was a way families could thrive. Of course, there aren’t many crops being planted in suburbia and it seems the average family eats out,

orders in or packs a lunch more than they worry about cooking a meal. Times have changed and so have the way we raise our kids. Cell phones, laptops, sports, healthcare, clothes and food keep parents’ wallets pretty empty. One dad lamented that his food bill jumped from $150 to $300 a week as soon as his three sons became teenagers. He said he is going broke just trying to keep food on the table. Yep, kids like to eat!!

Naturally, we can’t reduce having kids to a financial spreadsheet. Look at all the joy they bring! Guess we need to start thinking in terms of “value added” and not “money spent.” In fact, if we started thinking seriously about the cost of our pets, horses, cars, homes, clothes (shoes) and vacations over the course of eighteen years, it might be a real shocker. One of my neighbors said he “added up” the cost of having two horses for ten years and he realized that he has spent about $46,000 and that doesn’t include the money for the barn

Hmm…perhaps the man having twins might consider this, although last time I checked his homeowners association might not like it.

We can all feel parents’ pain.

But what the “cost report” didn’t point out is that kids do not stop “costing” just because they turn eighteen. Forty percent of all parents continue “assisting” adult kids and about twenty percent of grandparents are a major financial contributor to their grandkids. Gee, no wonder this guy having twins is worried. He should be! Quick, start stockpiling money now because it doesn’t seem like it will get much better any time soon. Babies only grow bigger and imagine what a gallon of milk will cost in ten years!

So enjoy the kids, hold onto your checkbook tightly and remember that when it comes to children, they are really priceless.

movie review PATERSON Directed by: Jim Jarmusch Starring: Adam Driver, Golshifteh Farahani, Rizwan Manji, Barry Shabaka Henley, Chasten Harmon, and William Jackson Harper Monte’s Rating: 4.50 out of 5.00 MONTE YAZZIE MOVIE COLUMNIST

The late, great Leonard Cohen once said, “Poetry is the evidence of life. If your life is burning well, poetry is just the ash”. Cohen is one of the great poets, both in music and literature. If there were a list of great poets in filmmaking, Jim Jarmsuch would be near the top of the list. Jarmusch’s films, like good poetry, have a distinct rhythm and flow that breaths life deeply into the themes and the atmosphere of every frame of the film, which makes everything undeniably unique, undeniably Jarmusch.

“Paterson” is a film about a working class poet and how the rigors and repetition of daily life influence the poetry that he creates. It’s also about the personal aspects of the creative process and the unique development of art. It’s about inspirations found in life, how the ordinary parts of life can become extraordinary with the right words. “Paterson” is a deceptively multifaceted film made by one of the founding

fathers of indie cinema.

Paterson (Adam Driver) is a bus driver working an ordinary nine-to-five job in Paterson, New Jersey. However, this working class man is also a poet, making the most of the small moments in his day to write in his poetry book. Everything about Paterson is simple; he has a daily routine that has become a rhythm to the many pieces of his day. Whether the journey to work, the drive on his transit line, or the nightly walk with his dog, these pieces of the daily puzzle paint a picture that becomes words of insightful poetry for the common man.

Jarmusch builds an interesting form through the commonplace routine in “Paterson”. We see Paterson as he wakes up every morning for an entire week; we are engaged in his routine from the very beginning. It’s throughout this process that Paterson’s words sprawl across the screen, taking space during the routine of his life; we are introduced to the ramblings of the bus driver but also the design of the form and

structure of poetry for a poet.

It’s an interesting construction that Jarmusch develops. The influences that Paterson encounters board his bus, an assortment of ages, genders, and anecdotes about everything from past flings to the history of the city they live in. The influences also interrupt his walk to and from work, like a young girl who is also a poet, and invade his personal space, like bulldog named Marvin; Paterson sees poetry all around him. In a great scene, that is purely Jarmusch, hip-hop artist Method Man

makes a cameo as a rapper trying to find the design of a verse. It’s a small but important scene in the composition of the film that displays the process of an artist, but also how poetry has evolved far beyond the sonnet or limerick into popular culture.

The performances in the film are exceptional. Adam Driver is remarkable, providing a character that is nuanced and restrained. It showcases just how talented the actor is. Director Jim Jarmusch admires these kinds of characters; Paterson is a person who looks deeply into the

world, an admirer of everything around him and a vessel for everything both good and bad.

Golshifteh Farahani plays the muse to the poet, the influence of love that brings healthy doses of inspiration through chaotic patterns that adorn every plain space in their home (an entire article could be dedicated to how pattern influences poetry), indecision with her pursuits of being a cupcake baker on one day and the next day wanting to be a country singer, and change that is an emotional motivation for everything in her world. Farahani is very good throughout, balancing these numerous qualities in one performance effortlessly.

“Paterson” is so much more than the simplistic premise about a week in the life of a bus driver in New Jersey. It’s a film about the development of the poet, the rhythm of daily life, and the influences that shape and mold the structure of art.

“Paterson” displays the talented work of one of cinema’s greatest visual poets.

SCOTTSDALE – February at the Arizona Fine Art Expo begins with a nod to exotic beauty, stamina, and spirit as the 10-week fine art show welcomes special guests from the Scottsdale Arabian Horse show.

The event ‘Up Close with Royal Arabian Horses’ takes place on Saturday, Feb. 4, 1-3 p.m., giving patrons a chance to see two magnificent Royal Arabian horses up close. Claudiaa is a beautiful mare born in Belgium in 2002. She was imported by Gemini Acres Equine a few years back and has been a wonderful asset to Gemini’s breeding program.

Bella Soleil GA was born and raised in Scottsdale on the Gemini farm. This beautiful three-year-old mare has had successes in the show ring and is now being ridden both in the arena and through the desert here in Scottsdale. She is one of the select sale horses at Gemini.

Arizona Fine Art Expo has come to be known as one of Arizona’s best venues for collecting fine art. The event features 110 patron-friendly working studios within a 44,000

square-foot space, where guests have a rare chance to meet the artists, see them in action, and learn about their inspiration and techniques. First responders perform multiple water rescues during weekend storm NORTH VALLEY – Turn around, don’t drown! This message was forcefully reiterated this past weekend, as first responders performed multiple water rescues. Crews extricated vehicle occupants who were stranded in flooded roadways, battling the swift, freezing floodwaters that were sweeping the vehicles away.

Daisy Mountain Fire Department, Phoenix Fire Department, Peoria Fire, and Maricopa County Sheriff ’s Office performed two separate water rescues early Saturday morning, rescuing four people in these incidents. DMFD posted a short video on Facebook, showing an MCSO helicopter hovering just above a vehicle in the flooded New River Wash, getting the occupants of the vehicle out safely.

Rural/Metro Fire Department, in conjunction with the Phoenix Fire Department, responded to a water rescue call at about 8 a.m. that same Saturday morning. Crews worked together to remove two occupants from a vehicle in the area of north 51st street and Cloud Rd.; this vehicle had been pushed about 100 yards down the crossing of

a typically dry wash by extreme runoff, according to Rural/Metro.

“Members of Phoenix Fire Departments Swift Water Rescue team were able to use Phoenix Fire Fox Helicopter to lift the two men off the partially submerged vehicle in the middle of the river,” Shawn Gilleland, Rural/ Metro Public Information Officer, said in an email to The Foothills Focus. “Because of the rapid response of Rural Metro and Phoenix Fire Departments, neither man sustained injuries, each was evaluated

and refused medical treatment at the scene.”

Gilleland noted that the vehicle involved in this water rescue will remain where it is until the water recedes and the car can be safely removed.

“Rural Metro Fire Department reminds everyone of the dangers of crossing flooded washes,” Gilleland emphasized.

“It takes less than 6 inches of fast moving water to move a vehicle. The water levels can change rapidly and even though it is not raining where you are at, flooding can come from miles upstream.”

Jack’s work reflects his passion for painting and his interpretation of the vitality in life’s many forms. By creating in a colorful, non-representational style, Jack allows the viewer to interpret from their own experiences what the piece represents to them. Consequently, Jack enjoys the patronage of a wide variety of collectors. His paintings hold a prominent place in corporate and private collections throughout the United States.

Jack made the leap into the creative world of fine art painting in 10th grade. He went on to earn a Bachelor of Science degree from the University of Wisconsin-Stout with a major in art education and a Masters of Fine Arts, majoring in Painting from the University of Wisconsin-Madison.

During and after his college years, Jack taught art at the University of Colorado, the University of WisconsinMarshfield, and the Sheboygan Area School District in Sheboygan, WI. Through his teaching years, Jack continued to grow and develop his uniquely expressive and colorful interpretative personal painting style.

The result of years of “pushing the envelope” with mixed media and expressively colorful paints has earned Jack a number of exhibit opportunities in shows throughout Wisconsin, Colorado, Missouri, Illinois, and Ohio. He has participated in many invitational shows, including the Tri-International Invitational (USA, Italy, and Japan) in Numazu City Japan.

IRS shares updates for filing 2016 taxes NORTH VALLEY – It’s getting to be that time of year again – tax time. The Internal Revenue Service is sharing some changes for the 2016 tax year for taxpayers to be aware of as they get their taxes ready to file.

Taxpayers will have until Tuesday, April 18 to file their 2016 returns and pay any taxes due. That’s because of the combined impact of the weekend and a holiday in the District of Columbia. The customary April 15 deadline falls on Saturday this year, which would normally give taxpayers until at least the following Monday. But Emancipation Day, a D.C. holiday, is observed on Monday, April 17, giving taxpayers nationwide an additional day. By law, D.C. holidays impact tax deadlines for everyone in the same way federal holidays do. Taxpayers requesting an extension will have until Monday, Oct. 16 to file.

A law change that went into effect this year requires the IRS to hold refunds on tax returns claiming the Earned Income Tax Credit (EITC) or Additional Child Tax Credit (ACTC) until at least Feb. 15.

Still, even with this change, the fastest way to get a refund is to file electronically and choose direct deposit. Even though the IRS will begin releasing EITC and ACTC refunds on Feb. 15, many early filers will still not have actual access to their refunds until at least the week of Feb. 27. The additional delay is due to several factors including the time needed by banks to process direct deposits.

Under this change, required by the Protecting Americans from Tax Hikes (PATH) Act, the IRS must hold the entire refund — even the portion not associated with the EITC and ACTC. This change helps ensure that taxpayers get the refund they are owed by giving the IRS more time to help detect and prevent fraud. Taxpayers should file as usual, and tax return preparers should submit returns as they normally do.

Many Individual Taxpayer Identification Numbers (ITINs) expired on Jan. 1, and affected taxpayers should act soon to avoid refund delays and possible loss of eligibility for some key tax benefits until the ITIN is renewed. An ITIN is used by anyone who has tax-filing or payment obligations under U.S. law but is not eligible for a Social Security number. Under a PATH Act change, any ITIN not used on a tax return at least once in the past three years has expired. Also now expired is any ITIN with middle digits of either 78 or 79.

Starting in 2016, most Olympic and Paralympic winners qualify for a new tax benefit, depending on income; for these taxpayers, the value of Olympic and Paralympic medals and the amount of United States Olympic Committee (USOC) prize money is not taxable.

States are now offering specially designed, taxfavored ABLE accounts to people with disabilities who became disabled before age 26. Originally authorized in legislation enacted in late 2014, these special accounts first became widely available during 2016. Recognizing the special financial burdens faced by families raising children with disabilities, ABLE accounts are designed to enable people with disabilities and their families to save for and pay for disabilityrelated expenses. Contributions totaling up to the annual gift tax exclusion amount -- $14,000, in both 2016 and 2017 -- can generally be made to an ABLE account each year. Though contributions are not deductible, distributions are tax-free if used to pay qualified disability expenses.

The standard mileage rates for the use of a car, van, pickup, or panel truck are: • 54 cents per mile for business miles driven in 2016, down from 57.5 cents in 2015. For those planning ahead, the 2017 rate, for use on a 2017 return filed next

year, is 53.5 cents per mile.

• 19 cents per mile driven for medical or moving purposes in 2016, down from 23 cents in 2015. The 2017 rate is 17 cents.

• 14 cents per mile driven in service of charitable organizations. This rate is set by law and is unchanged.

Beginning Aug. 24, 2016, a taxpayer who inadvertently fails to properly complete a taxfree rollover of a distribution from an IRA or workplace retirement plan to another eligible retirement program can often qualify to use a new selfcertification procedure. Under the procedure, eligible taxpayers, encountering a variety of mitigating circumstances, can qualify for a waiver of the 60-day time limit and avoid possible early distribution taxes. Normally, an eligible distribution from an IRA or workplace retirement plan can only qualify for tax-free rollover treatment if it is contributed to another IRA or workplace plan by the 60th day after it was received. Previously, in most cases, taxpayers who failed to meet the time limit could only obtain a waiver by requesting a private letter ruling from the IRS. Now, a taxpayer who missed the time limit ordinarily qualifies for a waiver if one or more of 11 circumstances apply to them. They include a distribution check that was misplaced and never cashed, the taxpayer’s home was severely damaged, a family member died, the taxpayer or a family member was seriously ill, the taxpayer was incarcerated, or restrictions were imposed by a foreign country.

The deadline for filing the annual Report of Foreign Bank and Financial Accounts (FBAR) is now the same as for a federal income tax return.

This means that the 2016 FBAR, Form 114, must be filed electronically with the Financial Crimes Enforcement Network (FinCEN) by April 18.

This gala is one of the organization’s largest fundraisers of the year. All proceeds benefit the library.

‘Mammoth Hunters’ to be discussed at Archaeology Society meeting CAVE CREEK – Learn about the ancient history of the American Southwest at the Feb. 8 Archaeology Society meeting.

Jesse Ballenger, Ph.D., will present Mammoth Hunters, Water Tables, and the Demise of the Murray Springs National Historic Landmark as a Record of Human Colonization, Climate Change, and Extinctions in the American Southwest.

The Murray Springs Clovis site was excavated over multiple seasons in the late 1960s and early 1970s under the direction of Dr. C. Vance Haynes, Jr. At that time, it was a prime example of mass extinction, the human colonization of North America, and the cyclical nature of wetlands and arroyos in the American Southwest. Years later and despite its importance as a world-class landmark of human and environmental events, it became the receiving end of groundwater injections intended to protect the San Pedro Rover as a viable stream.

Ballenger’s presentation reviews the amazing record of the site, as well as the trade-off between water conservation and national heritage.

Murray Springs is located in southeastern Arizona near the San Pedro River and the site is unique for the massive quantity of large megafauna (i.e. mastodons, mammoths, giant sloths, bison, and saber-toothed cats) processing and extensive

Clovis tool making.

Ballenger is a native of Oklahoma who serves as a Principal Investigator/Project Manager for EcoPlan Associates, Inc. in Tucson. He received his Ph.D. in Anthropology from the University of Arizona.

His dissertation was on the topic of mammoth hunters in the San Pedro River Basin in Cochise County, Arizona, and he was a recipient of the Emil Haury Dissertation Fellowship.

Ballenger’s primary interests include the study of late Ice Age and early Holocene huntergatherers, their archaeological remains, and paleoenvironmental reconstructions. Since 2004, his research at the Murray Springs site has focused on its remarkable archaeological and paleonotological record, and its continued preservation.

He subsequently conducted

an archaeological and paleoenvironmental damage assessment of the Murray Springs National Historic Landmark directly related to a reclaimed water recharge operation upstream from the site.

The Feb. 8 meeting is open to the public. Refreshments will be offered starting at 7 p.m. that night, with the meeting beginning at 7:30 p.m. Meetings are held at The Good Shepherd of the Hills Episcopal Church, located at 6502 East Cave Creek Road, in Cave Creek.

Reese is an adorable female long-haired Chihuahua mix.

This little girl can be a bit timid at first, but once she warms up, she’s just as sweet as can be.

Reese is working really hard on her potty training and is doing well, but she will need someone with a little bit of patience to help her along. She loves playing with her foster siblings and will do well in a house with other dogs.

Reese is approximately a year old. She’s spayed, up to date on shots, and microchipped.
