BUSINESS LAW This type of law helps individuals or businesses navigate the tricky path of properly filing a bankruptcy. Bankruptcy is the legal status for an individual or company unable to pay off outstanding debt. It is a status that can only be granted by a state or federal court. Generally, personal bankruptcy is considered a last resort for people inundated with loans or bills. Although going bankrupt may be an effective way to wipe out most or all debt obligations, there are long-lasting consequences. Bankruptcy will negatively affect your credit and future ability to use money. It may prevent or delay foreclosure on a home and repossession of a car. It can also stop wage garnishment and other legal actions of creditors attempting to collect debts. A “personal” or consumer bankruptcy is the type filed by most individuals. However, “business” or non-consumer bankruptcy is available for individuals and businesses who seek help with debt incurred primarily from profit-seeking business endeavors as opposed to consumer purchases for things such as food, clothing, and shelter. Although a business bankruptcy is an efficient process that can help a financially distressed business get back on its feet—or, when necessary, wind-down in an organized fashion—it can have serious, permanent consequences. A business bankruptcy tends to be more complicated than one filed by an individual consumer—in part because of the significant differences that exist between the two types. Making an appointment with an attorney in your state who specializes in this type law is a smart first step.

CIVIL LAW Civil Law is the system of law concerned with private relations between members of a community rather than criminal, military, or religious affairs. In the broadest sense, civil law is a body of rules that delineate private rights and remedies, and govern disputes between individuals in such areas as contracts, property, and family law; distinct from criminal or public law. Civil law deals with disputes between private parties, or negligent acts that cause harm to others . For example, if individuals or companies disagree over the terms of an agreement, or who owns land or buildings, or whether a person was wrongfully dismissed from their employment, they may file a lawsuit asking the courts to decide who is right. As well, the failure to exercise the degree of caution that an ordinarily prudent person would take in any situation may result in a negligence claim. Depending on the circumstances, a person may be held responsible for any damages or injury that occurs as a result of their negligence.
Challenges to decisions of administrative tribunals, allegations of medical malpractice and applications for distribution of the estates of deceased persons are other examples of civil cases. The party who brings the legal action is known as the plaintiff or applicant, while the party being sued is the defendant or respondent. The courts may dismiss a case, or if it is found to have merit, the courts may order the losing party to take corrective action, although the usual outcome is an order to pay damages - a monetary award designed to make up for the harm inflicted. The state plays no role in civil cases, unless the government launches a lawsuit or is the party being sued. Parties retain an attorney to gather evidence and present the case in court.

CRIMINAL LAW Criminal law deals with acts of intentional harm to individuals or property, but which, in a larger sense, are offenses against society at large. It is a crime to break into a home because the act not only violates the privacy and safety of the home’s occupants - it shatters the collective sense that people are secure in their own homes. A crime is a deliberate or reckless act that causes harm to another person or another person’s property, and it is also a crime to neglect a duty to protect others from harm. Criminal offenses are wide-ranging - from vandalism to murder - and the range of punishments also vary widely. Since crimes are an offense against society, normally the government prosecutes criminal allegations on the victim’s behalf. The police gather evidence and, in court, public prosecutors present the case against the person accused of the crime. For someone to be convicted of a crime, it must be proven that a crime was committed and, for many offenses, that the person meant to commit the crime.

A common expression you may have heard is “probating a will.” This describes the process by which a person shows the court that the deceased followed all legal formalities in drafting his or her will. FAMILY/DIVORCE LAW The vast majority of family law proceedings (also called “matrimonial law”), come about as a result of the termination of a marriage or romantic relationship. Family law attorneys help their clients file for separation or divorce, alimony, and child custody, visitation, and support. Divorce is the termination of a marriage by court judgment. A judicial decree is awarded declaring the marriage to be dissolved. It leaves both spouses free to marry again. Many states refer to it as Dissolution of Marriage. “Family law” is the term lawyers use to describe laws that affect families. The most common types of “family law” cases are divorce (with or without children) and parental rights (where non-married parents address issues relating to their children). “Family law” also includes adoption, state termination of parental rights, protection from domestic abuse, and other family-related issues.

REAL ESTATE LAW Real Estate and Real Property Law encompasses a number of different legal disciplines. Real estate law governs who may own and use the land. Real Estate and Property Law covers an extensive legal area, which is regulated by federal and state statutes, as well as common law. Many aspects of this area overlap with contract law. The terms “real estate”, “realty” and “real property” are generally used interchangeably, although many people associate “real estate” more closely with the structures or buildings and the land. However, real property/real estate encompasses more than just the obviously tangible aspects. It comprises land and that which is attached to or belongs with the land, such as the immovable structures like buildings, houses, trees, bushes and minerals permanently affixed to the land. It also consists of the interests, benefits and rights that are legally considered attached to the real property, which can include certain rights to the air above the land, to drill in the ground beneath it, rights to live on the property for a specific timeframe or to acquire the real property in the future. The practice area of real estate and property law deals with a variety of related issues, including the following: rights and interests in real estate and real property; sales, purchases and other transfers of real estate and real property; legal aspects of rental property and landlord issues; tenants’, renters’ and homeowners’ rights; title to real property; settlement of claims against property rights; property development; zoning and land use; related agriculture issues; home loans and foreclosures; and various other relevant topics. This is a complex practice area, further complicated by the significant inconsistency in the laws throughout different cities and states. Real estate attorneys are versed in many different activities, from the mundane drafting of deeds and filing of liens, to handling boundary and zoning disputes and even assisting families in court when threatened with foreclosure.
