The confetti had barely settled after New Year’s and residents had all but finished celebrating the win of passing Measure R back in November and wouldn’t you know it - Commercial Development came back rearing it’s ugly head filing a lawsuit in federal court attempting to ruin our fresh feelings about the new year. HELLO MONEY is a brilliant opinion piece written by longtime resident David Stansfield which perfectly expresses local sentiment on this high profile issue.

For years I made resolutions: “... get healthy, work out..” and by the end of January, my resolutions were left in the dust of the holiday season. As we get older, we have more patience for the ebb and flow of life and resolutions really become the same goals we have always had. This was the inspiration for the “Five Things” feature, where we asked a group of high powered locals what their “focuses” were for 2015 leaving traditional resolutions in 2014 - where they belong. My “focus” this year? With multiple publications and growing demand it’s pretty obvious - I NEED TO DELEGATE! Happy 2015 everyone!

MEASURE R R E S U R F A C E S Indeed, a nine count complaint was filed in the U.S. District Court by the commercial property owners Steve Soboroff and the Perrenchio Malibu Bay Company. The plaintiffs will claim that the measure violates both the United States Constitution by limiting national retail stores while local retailers are subject to no restrictions what so ever. "This lawsuit raises fundamental questions about how far a law can go in constraining the rights of a select few property owners by detailed and legal land-use rules in a community " said Steve Soboroff. Even though a majority of the City Council did not support Measure R, supporters are hopeful that Malibu City Attorney, Christi Hogan, can defend and enforce the will of the residents. Rob Reiner who helped develop and fund the initial bill along with attorneys are confident that the City can legally and constitutionally follow precedents established in many cities to limit the amount of commercial development and regulate chain stores in all new commercial developments. From the Official Measure R Campaign and the Preserve Malibu Facebook: "Over the past several days, the City Attorney has made clear to us that she intends to defend Measure R from this disappointing and unnecessary lawsuit and that she would welcome our participation in the lawsuit as co-defendants to assist with the defense. Not only are we thankful for this cooperation, but we welcome the opportunity to mount a vigorous defense of Measure R and are eager to represent the many Malibu residents who worked tirelessly in support of the Measure. While the legal process is only just beginning, we are committed to a long-term defense of Measure R, and we will pursue the litigation, including appeals, for as long as it takes to defend the will of Malibu’s residents. Indeed, we expect the City to do the same. We look forward to working with all of you in the days ahead. Thank you for you support." This Lawsuit has the potential to clock some major dollars in lawyer fees on both sides of the court, but the stakes are high . Citizens have spent major dollars to live in a semi rural pristine paradise and do not want out of town developers to destroy Malibu’s coastal small town ambiance with large commercial buildings that will cater to corporate retailers . Many have said the Civic Center and Cross Creek are already over built, and that Malibu is starting to go in the direction of a Rodeo-Drive -By-The-Sea shopping destination that does not cater to locals or local merchants. PCH is already too congested with grid lock Z-commuter traffic and more development would cause an even greater danger for emergency vehicles in peak commuter and summer beach traffic, especially during a fire disaster. On the other hand, commercial property owners have major dollars tied up in land that investors hoped to generate substantial profits as the land was developed. Instead of the land owners dealing directly with the few at the City to get permits to build, they will now be forced have the plans approved on by the voters if the building plan exceeds 20,000 sq. feet. The owners know that getting the residents to vote in approval of a proposed plan will not be as easy as it used to be. The longer a lawsuit last, the more legal expenses will be incurred by both sides . Will it come down to the deepest pockets and how much the plaintiff can gamble to loose ? It will be a very interesting showdown with wide reaching implications as concerned residents will be paying attention and learning more about the Constitution and States Rights. As the new year begins and the lawsuit works its way through the courts, City Officials and its residents need to be reminded of the goal in Malibu's Vision and Mission statement that guides the General plan.

Malibu will provide passive, coastal-dependent and resource-dependent visitor-serving recreational opportunities (at proper times, places and manners) that remain subordinate to their natural, cultural and rural setting, and which are consistent with the fragility of the natural resources of the area, the proximity of the access to residential uses, the need to protect the privacy of property owners, the aesthetic values of the area, and the capacity of the area to sustain particular levels of use.

Rolling Stone's Matt Taibbi famously described Goldman Sachs as “a great vampire squid wrapped around the face of humanity, relentlessly jamming its blood funnel into anything that smells like money.” The squid has come to Malibu. Look at just a partial list of victims as the Greedy Little Men slink in with the chink of silver on their tongues: Malibu Country Kitchen (a local landmark for over 40 years), the Dume Room (34 years), Trancas Gardens Nursery (nearly 30 years), Point Pizza (24 years), Diesel Books, Mail Boxes Etc, and many other such beloved and eccentric local haunts. One by one they fall as the rents rise, to be replaced by the chain gang: Ralph Lauren, James Perse, J. Crew, True Religion, Tory Burch, Intermix, Oliver Peoples, Urban Outfitters, Sephora, All Saints, Maxfield, Mac Cosmetics, Levi's – with Hamburger Hamlet due to set up shop over Malibu Country Kitchen’s dead body just across the PCH from Duke’s. Regarding Duke’s, best not hold our breath waiting for the Hamburger Hamlet leviathan – or any of the other aforementioned chains – to host and subsidize fund-raising events for TheraSurf, SurfAid, the Malibu Coast Life Saving Association, the Young and the Brave Foundation, Life Rolls On, Callie’s Cause and other such charitable causes the way General Manager Josh Morgan has done for these last dozen years. And so it goes: as Rodeo Drive gallops into Malibu, the character and charm (and warm-hearted generosity) of this little town trots out, tail between its low-rent legs. But on one fine day, the citizens spoke up against this march of moolah with what became known as Measure R: “Please sir, may we have a voice in city planning? Please sir, may we vote on what is going on in where we live?” Not since Oliver Twist dared to ask for more did such a storm come down on heads that dared to ask for less. What cheek! What impudence! What unmitigated gall! Who do these people think they are? Blood Funnel’s reaction was swift and sure, slapping the cheeky residents of Malibu with a federal lawsuit, accusing them of violating the U.S. and California constitutions. Felons all. David Waite, BF’s attorney, didn’t mince words: “Under the provisions of this misguided measure, developments are no longer subject to any standards other than the whim of the electorate.” How right he was: this is no time for the whims of the great unwashed, this is time for the Money Men to stand up and be counted. WHAT DO YOU THINK THIS IS, A DEMOCRACY? Waite went on, “Measure R divests the city’s elected leaders of their proper and lawful government functions pertaining to local land use and development.” Truer words were never spoken. This is a genuine disaster for our way of life and everything we hold dear: WE WON’T BE ABLE TO BRIBE THEM ANY MORE! The almost entirely out-of-town Malibu “developers” have revealed themselves for exactly what they are: a microcosm of what is currently going on at the federal government level, where there is nobody and nothing that cannot be bought by the Kochs, the Adelsons and the Goldman Sachs', who spread more palm oil then Exxon. Goodbye democracy, hello money. SUSANNE DANIELS President of MTV Network
Susanne Daniels is an award winning entertainment executive and has developed and produced some of the most memorable series on TV. She started her career as Lorne Michaels’ assistant at “Saturday Night Live” and was promoted to manager of development of Michaels’ Broadway Video, where she helped develop “The Kids in the Hall” TV series and the box office smash “Wayne’s World”. She then went on to work for ABC and later served as vice president of comedy for FOX Television where she shepherded their successful Thursday night comedies “Martin” and “Living Single”. Daniels then became president of the WB Network ( now THE CW ), where she embarked on an incredible run of culture-defining hits including “Buffy The Vampire Slayer”, “Dawson’s Creek”, “Felicity”, “Angel”, “Smallville”, “Gilmore Girls”, “7th Heaven” and “Charmed”. From there Daniels went on to serve as president of Lifetime and their movie network, where she launched the channels’ highest rated drama series in it’s history ( “Army Wives” ) and the acquisition and re-development of “Project Runway”. Before joining MTV as it’s president in 2012, Daniel’s served as consultant for Oprah Winfrey’s OWN Network, where she was credited with helping to significantly boost their ratings. Daniels is based in L.A. where she resides with her husband, writer-producer-director Greg Daniels ( “The Office” , “Parks & Recreation” and “King of the Hill” ).
BK: In the very beginning, what was the first step in your career? Did you go to college and study broadcasting? SD: I went to Harvard and they didn’t have broadcasting as a major…so I did work on a lot of theater when I was there and then briefly flirted with the idea of going in the theater, but what I really wanted to do was work in television, so I got there in a roundabout way. There was nobody I didn’t ask to try and get an introduction to someone in the television business. When I was trying to break in, there was just no stone unturned and nobody I wouldn’t harass.
BK: Persistence! SD: (Continued) And my dad was working on a legal case with another lawyer from a different firm and he was kind enough to ask him if he knew of anybody. And that guy’s brother worked at NBC in the news department and told me I could go in for a general with him and I didn’t really know what a general was.
BK: Why don’t you tell our audience what a general is? SD: Well my advice would be… that a general is always an interview, but I didn’t know that and thought a general just meant chit-chat, but there’s no job, but there could always be a
job, and you have to treat every meeting like it could be a potential interview. But I didn’t. I completely blew it and I just went in there talking about what I like, which wasn’t the news, and at the end of the meeting, the guy said to me “Well I’d never hire you. You don’t want to eat, drink, and sleep the news. I only want to hire people who want to eat, drink, and sleep the news” and I thought, well I’ve blown it once again. Good work Susanne. But then he opened the door that changed my life. I mean I know that sounds dramatic, but he did. Then he paused and said, “I heard Lorne Michaels is looking for an assistant. Would you want me to give your resume to him?” I literally almost fell off my chair because there’s been a book written about “Saturday Night Live” which I had read. Now there’s multiple books, but at the time, I think there was just one and I had read it. I knew who Lorne was and I loved “Saturday Night Live” and I thought “Oh my god.” I said “Yes I want to…Please would you do that?… Really, that’s the most incredible offer ever.” He sent my resume over and
Lorne agreed to interview me.
BK: So you’re sitting outside…the office that is upstairs that overlooks the… for those of you who don’t know, Lorne’s office is upstairs ... at 8-H, the famous eighth floor at 30 Rockefeller Center, and his office has… a sliding glass door out to the seated audience and overlooking the entire stages of “Saturday Night Live…” SD:
…And there was a conference room right outside of his office. So I sat in that conference room…which was fascinating and kind of scary and intimidating all at the same time because …it was a working week. You know, stars of the show were coming in and out to meet him. Al Franken, Kevin Nealon, and Dana Carvey knocking on his door and so … on the one hand I didn’t mind waiting because it was just a fascinating place to be, but on the other hand, I was getting more and more nervous. I was working myself up into quite a tizzy.
BK: And it’s interesting that you said that because obviously nerves and success don’t go together, but you must have pulled it together… SD: …I honestly don’t remember what questions he asked me, but I do remember telling him how enthusiastic I was about the opportunity and how much it would mean to me and how I couldn’t think of any better job to do. It would be a dream come true. So I do remember really expressing my enthusiasm and I talked to him about the book…I had read… about “Saturday Night Live” and I…
BK: ...You did your research. You know, it’s amazing when I… interview people for this show. If they have a book… and I read it and can pull out things from the book… it means the world to them because it lets them know that I really care and I’m really invested…So did he tell you in the room that you got the gig? SD:
No… No…
BK: Now when you left the office and you got on the subway or wherever you were, did you say to yourself, “I got this gig?”
SD: Not at all. No, I really didn’t know. And I had moved home after college and was living with my folks and it was a few days later that they called me. I was on my parents’ couch watching “Jeopardy.” Seriously… and the phone rang and they told me I got the job and I was just so excited.
BK: Incredible… You know Lorne Michaels has had a lot of assistants, but how many assistants do you think have actually been promoted to be the manager of development for his production company? SD: Yeah, I don’t know. It was a great opportunity. He was great to work for. I mean it was a phenomenal three years and… BK: ...But you must of done things that made him feel like Radar O’Reilly made the Colonel feel in “M.A.S.H”.… SD: (Laughing) What a great analogy. Yeah. I don’t know if I was as good as Radar, but I loved working there and I
loved working for him and the biggest take-away for me, for the three years that stayed with me, I think for my whole career, was that attention to detail is important because Lorne would, and I’m sure to this day still does, change things that might appear to sound and feel minor (but they weren’t)…and I’ll just never forget that my whole life…why working for
Lorne was so fascinating, because he really is a genius and its not hype.
BK: Tell our audience the greatest piece of advice Lorne ever gave you, or that you saw him give to anybody, that just stayed with you to this day? SD: You know, I don’t think it was a specific piece of advice, but… I think that one of the things that stayed with me to this day is that Lorne is extremely loyal to the people who work for him. Look at the people who are still there…so many of them…have worked for him for years and he’s very loyal and very respectful and he’s very good to his team. I think they really revere him and he’s created a work family…and you know, you don’t always have that in life, or the work place. To have watched that and been a part of that and seen that, I think that gave me some direction on how to work with, and treat my programming teams over the years.

It is a dream of mine to see one also come to Malibu. I love walking into a restaurant knowing I’m going to eat healthy, amazing food and there were no animals sacrificed in the process. ACTIVISM - Having grown up in South Africa, I have witnessed the beauty of animal roaming
free in their native habitat. In 2015, I am committed to devoting more time to stop the poaching of animals in Africa.
DESIGN - The art of building a home to process of completion - including the interior design aspect - is a big part of what we do at Malibu Design Center. I will be putting more effort into making it the designers resource and the go-to place to create the ultimate Malibu beach home. R & R - I own TIDES REACH RESORT in Fiji, of which I have put in a lot of time and effort into fine tuning the ultimate resort experience. In 2015, adding a state of the art spa will be an important part of this project to enhance the Tides Reach Resort experience.

Stay hungry, positive and tenacious. How lucky am I to sell real estate in Malibu for over 30 years? Focus on that concept everyday. I’m so grateful!

GRAMMER - Cancer free for one year!
This year starts out positive. On January 3rd I celebrated my first year in remission. I’m focused on my continued good health and building up my immune system, eating healthy and working out more. Staying positive and letting go of the past, full steam ahead is very important. I’m also focused on raising awareness for below the belt, so to speak, female cancers. I’m working with the Foundation for Women’s Cancer to raise awareness for education and funding research to save more women’s lives because movements matter. This movement being to raise public awareness of prevention, detection and treatment of gynecologic cancers. Women recently diagnosed and seeking more information, go to info@foundationforwomenscancer.org. I’m very passionate about this cause because I’m the 3rd generation to have a gynecologic cancer. Growing up I have watched my grandmother and mother combat these cancers. My mission is to bring gynecologic cancers to the discussion. It would be nice for these cancers to get as much attention as others. Breast cancer awareness is prevalent, as it should be. But we need to heighten the awareness for gynecologic cancers. These are the silent killers that go asymptomatic until the later stages. By the time these symptoms become present the cancer has usually progressed to stage 2 or stage 3. Routine checkups and early detection are the best prevention. Listen to your body. If something doesn’t feel right, go get checked. My main focus will always be my children. It’s so important to spend quality time with my family, to show them they are cherished and loved and to share special moments and create new memories. Feng shui plays a huge roll in all we do and seeing as most of us Malibu-ites are non-conforming 9 to 5 ers and tend to work from home or other fun places heres a few must do items to ensure the right flow of energy in and around your office space. Some tips: Have your home office as far from your bedroom as possible. If the layout of your house allows, having a separate entry to your home office is ideal. If this is not feasible, create as much division as possible between your office area and your bedroom. Air and quality of light both natural and artificial in your home office is paramount, as these are two good feng shui must-haves. WELLNESS The inner physician has extremely high nutrient and energy demands. That’s probably because it needs lots of fuel for repair and “housekeeping,” cell maintenance, and a wide spectrum of routines to keep us alive and functioning in a polluted world. A study in the Proceedings of the National Academy of Sciences explained, housekeeping is important for keeping brain tissue alive and well and for the many biological and biochemical processes in the body. What kind of nutrients can help the brain and nervous restore itself after exposed to chemical stressors? The answers to these questions may surprise you. Thus, to make this system of healing practical, I had to study the “inner physician nourishment,” and observe the wisdom in nature. And, most of these nutrients had to come from the fermentative actions of over 500 strains of microbes in the gut ecosystem (microbiome). Before I discovered this exciting new aspect of human nourishment, nothing I used clinically could restore inner physician function optimally in any of my clients. If we view the inner physician as functioning in an interlocking "gear-like" connection of neurological, microbiome (ecosystem), and liver-adrenal physiology, we will have the basic framework to understand how to restore and integrate inner physician physiology. We have to understand that each part of the whole—even the lowliest of bacteria in our gut ecosystem—influences on a grand scale how the inner physician works to defend us against stress and to repair and regenerate stress-damaged organs and systems of the body. Inner physician physiology is the dynamic study of life and “vital” functions of living organisms and their organs, cells, systems and microbes. This view of physiology takes a global view of the human body and an integrated understanding of events at every known level of human functioning. It considers how all the interlocking components of the inner physician work “hand in hand” with each other via interdependent actions, shared physiological functions, and how they work in concert to promote healing. 5 dried shiitake mushrooms (about 1/4 ounce) 5 dried wood ear mushrooms (about 1/4 ounce) 1 (32-ounce) carton fat-free, less-sodium vegetable broth (such as Swanson Certified Organic) 2 1/4 cups water, divided 1 tablespoon minced peeled fresh ginger 1 teaspoon minced garlic 1/4 cup rice vinegar 1 tablespoon low-sodium soy sauce 1/2 to 1 teaspoon freshly ground black pepper 1/2 pound reduced-fat firm or extrafirm tofu, drained and cut into 1/4-inch cubes 2 1/2 tablespoons cornstarch 4 large egg whites, lightly beaten $ 1/2 cup chopped green onions 1/4 cup minced fresh cilantro 1 teaspoon dark sesame oil Chili oil (optional)
Preparation Place mushrooms in a medium bowl; cover with boiling water. Cover and let stand 10 minutes or until tender; drain. Thinly slice mushrooms; set aside. Combine broth, 2 cups water, ginger, and garlic in a large saucepan over medium-high heat; bring to a boil. Add mushrooms. Reduce heat, and simmer 5 minutes. Add vinegar, soy sauce, pepper, and tofu; bring to a boil. Reduce heat, and simmer 5 minutes. Combine remaining 1/4 cup water and cornstarch, stirring with a whisk. Stir cornstarch mixture into broth mixture; bring to a boil. Reduce heat; simmer 3 minutes or until soup thickens slightly, stirring frequently. Slowly pour egg whites into broth mixture in a steady stream, stirring constantly but gently with a wooden spoon. Remove from heat; stir in onions, cilantro, and sesame oil. Drizzle with chili oil, if desired.

Having lunch with a friend, day’s after New Year’s, I asked what her new year’s resolution was. Without hesitation she laughed and said “everyday is New Year’s." It does not mean you have to starve yourself and do workouts that are unsustainable, It means we should be diligent in honoring our body, mind and soul. We should live life as though it’s “New Years Day”, and rock our resolutions daily. When people tell me “it’s all about the journey” it’s maddening! I have a different perspective, “what good is the journey without the end result”. It’s a combination of both. How do we continue to implement the changes as seamlessly as possible so we can go forward in life with all the excitement and enthusiasm of a new beginning and not deprive ourselves? The answer is commitment. Our hearts are heavy at The Local and 90265 magazine. We lost a creative collaborator and wonderful friend, Carol Sue Stoddard. Carol Sue sustained devastating injuries in a car accident on Dec. 22 on Malibu Canyon near Pepperdine and never recovered. She passed away on Dec. 26 at 55 years young.

Carol Sue Stoddard, an award winning photographer and videographer. She was given her first camera at the age of 10 and was hooked ever since. After graduating from UCSD, she started her own Production Company to make her own short films and documentaries, many of which have aired on local television. Viewers will never forget her personal documentary as her house was burning to the ground in the Malibu Fire of 2008 which aired all over the world. Her photos have been published in the NY Times, LA Times, USA Today, National Geographic, 90265 Life and Style and many others. She has exhibited at various art galleries, museums and at the Directors Guild in Hollywood, CA.
Carol Sue was a constant traveler in every sense of the word. At ease travelling the world or in her travel van, she was forever looking for the next perfect “shot” and new experience. As her personal mantra, was “Focusing on what makes her heart sing”, her life included, firstly, Being of Service in addition to trips to unknown towns and National Parks, being in nature, riding her horse, Rocky, as well as watching endless movies and immersing herself in novels. Her love of animals filled the universe which was obvious to anyone watching her with her constant companion, Ginger or seeing the endless photos in her portfolio. There isn’t anyone (human or otherwise) who spent time in her presence that hasn’t fallen in love with her in some way. She epitomized and taught us all unconditional love for which we all strive to experience. She taught forgiveness, perseverance, and compassion. She taught us how to never give up on a dream. As her close friend, Kelly Pessis-Breese, stated so tellingly, “When she had a goal, she accomplished it. She didn’t go around the mountain, she demolished it!” As she wrote in her own words, “failures are just successful experiences, therefore, a successful experience is not a failure.” Carol Sue’s endless love for her family and friends will live on in our memories of her as it comforts us now in this sudden, terrible loss. She is survived by her father and step mother, Richard and Marilyn Stoddard, brother Steve Stoddard (almost wife, Nadia Dobrina), brother Craig Stoddard (wife Dana), step sister, Cathy Kort and nephew, Ryan Kort, step brother Steve Morris, nephew Sean Stoddard , nieces Christina Czaykowski and Carissa Stoddard, ….. grand nephew, Dylan…. and hundreds of loving friends here in Malibu and around the world. Carol will always be the brightest star of the night.. shining into our hearts.
