And so it goes. On June 24, 2005, the Sangguniang Panlalawigan of Marinduque passed Resolution No. 264 s. 2005, authorizing Governor Carmencita O. Reyes to enter into a Special Outside Appointment and Engagement Contract with legal counsel Walter J. Scott on the lawsuit against Placer Dome, Inc. to be filed in a country where jurisIt's the Marcopper minesite, folks! diction can be had for the damage it caused to the people of Marinduque and the province’s ecosystems, ―specifically the Boac and Mogpog Rivers, Calancan Bay and the surrounding coastal areas.‖ The authorization was subject to the following conditions: 1..Pursuant to the authority conferred by this resolution the provincial Governor shall forthwith cause the appointment and sign the contract of engagement of the services of outside counsel, in the person of Atty. Walter J. Scott and to exercise such powers and perform such acts as are incidental and necessary for the accomplishment of the objectives and purposes for which this authority is intended; 2. The appointment and engagement of the services of the herein outside counsel for the remuneration of his services shall be dependent upon successful litigation of the case or recoveries as defined in the contract of engagement, subject to the following percentage sharing: a) 1st $15 Million - 10% plus reimbursement of not more than $500,000.00 b) Next $35 Million - 40% plus reimbursement of not more than $ 1,000,000.00 c) $50 Million and above – 33% plus reimbursement of not more than $ 1,500,000.00; 3. The Office of the Provincial Governor shall upon signing by the parties of the appointment and engagement contract of special outside counsel referred to above, submit the same to the Sangguniang Panlalawigan for legislative concurrence. 4. Any amendment or modifications of the terms and conditions of the signed agreement shall only be affected by mutual agreement of the parties thereto, subject to the ratification of the Sangguniang Panlalawigan." From 2007 to 2010. The case against Placer Dome filed in 2005, was removed to U.S. District Court at the request of Placer Dome. Then U.S. District Judge Brian Sandoval dismissed the case in June 2007, citing an improper choice of forum or court. In late September 2009, the U.S. Court of Appeals for the Ninth Circuit reversed the District Court decision dismissing the case in favor of Canada on forum non conveniens grounds. The defendants moved for a reconsideration of that ruling by the judicial panel that had decided it and the request for reconsideration was denied. The case was returned to the Nevada state court where it was originally filed.

A board member (Mel Go), declared in a recent Barrick Gold open forum in Marinduque: "We have been kept in the dark!" If there is such a contract, who were the signatories? Better yet, can the Office of the Governor be furnished a certified copy of such a contract/agreement? "3. What are the obligations of the Provincial Government financially and otherwise if we were to extend their service? "4. Is there an SP resolution authorizing/creating the SP Liaison Committee as mentioned in the fax letter of Mr. James D. McCarthy? If so, can the Office of the Governor be furnished a certified copy?" Questions that apparently remained unanswered by the SP during the term of Gov. Bong Carrion, probably all in the name of ‗confidentiality‘. So was Carrion also kept in the dark? But the so-called SP Liaison Committee stated in No. 4, above may never have been authorized or created by the SP to act as such in the first place.

'Bird-watching and nature appreciation trip' isinagawa Music and Arts Festival, By Luis T. Cueto LUNGSOD NG CALAPAN, Oriental Mindoro, (PIA) -- Bilang pakikiisa ng Oriental Mindoro sa pagdiriwang ng International Wetlands Day, isinagawa ang Bird-Watching and Nature Appreciation Trip sa Naujan Lake National Park kamakailan. Ayon kay OIC Orlando B. Tizon ng Provincial Tourism Investment Enterprise Development Office (PTIEDO), layunin ng gawain na maitaguyod ang pangangalaga sa kapaligiran at kalikasan ng Naujan Lake National Park, upang maproteksyunan ang mga ibon at iba pang hayop na matatagpuan dito at maisulong ang iba't ibang ecotourism at tour-guiding activities na maaaring makapagkaloob ng dagdag-kita at kabuhayan sa mga pamayanang nakapalibot sa lawa. Ang Naujan Lake National Park ang ika-lima sa pinakamalalaking lawa sa buong Pilipinas. Matatandaan na idineklara itong isang “Wetland of International Importance” noong 1999 ng Ramsar Convention sa pagiging isa sa mga natukoy na lugar sa rutang dinaraanan ng “migratory at endemic wetland birds” sa bansa. Ayon sa tala ng Provincial Tourism Office, may lawak ang Naujan Lake na 9,500 ektarya at matatagpuan sa may hilagang silangang bahagi ng isla ng Mindoro na napapalibutan ng mga bayan ng Naujan, Victoria, Pola at Socorro. Ang bird-watching at nature appreciation trip ay pinangunahan ng Mindoro Biodiversity Conservation Foundation, Inc. (MBCFI), sa pamumuno ni MBCFI Executive Director Grace Diamante at ng Department of Environment and Natural Resources (DENR)-Protected Areas Management Bureau (PAMB), sa pakikipagtulungan ng Community Environment and Natural Resources Office (CENRO-Socorro), ng pamahalaang panlalawigan, sa pamamagitan ng ENRO at ang PTIEDO. Ayon pa kay Tizon, nakasama nila sa bird-watching at pagiikot sa lawa ang PAMB members, ang mga kinatawan ng lakeside communities, municipal planning development coordinators, mga kapitan ng barangay, Science teachers mula sa Department of Education (DepEd) Calapan City Division at iba pang mga konsernadong indibidwal. Ang bird-watching ay itinuturing na isang istratehiya para sa likas-kayang kaunlaran dahil umaambag ito sa pagbabalanse ng “biodiversity conservation” at “economic development” at humihikayat sa mga mamamayan na makiisa sa pangangalaga at pagbibigay proteksyon sa kalikasan. Ipinahayag din ni Tizon na nauna na rito ang bird-watching ng dalawang British bird watchers noong buwan ng Enero. Sa pagtataya ng mga ito, nasa may 5,000 tufted ducks ang matatagpuan sa lawa, bukod pa sa ibang uri ng mga ibon gaya ng osprey, whistling wandering ducks at iba pa. Ang gawaing ito ay dinarayo ng libu-libong turista na dagdag-promosyon sa turismo ng bayan ng Puerto Galera at ng Oriental Mindoro. Ngayong taon, inaasahang mas maraming bilang ng mga kilalang international at local artists at performers ang darating. Sa mala-amphitheater na venue sa bulubundukin ng Barangay Balatero isinasagawa ang international musical event na inoorganisa ni Hubert D’ Aboville, isang French national. Inaanyayahan ang lahat ng music and art enthusiasts na dumalo at makisaya sa nasabing pagdiriwang. 'Groundbreaking' ng RPC 2 'Fisheries Law Enforcement Training' isinasagawa sa Central, isinagawa By Orlan C. Jabagat By Voltaire Dequina

SAN JOSE, Occidental Mindoro PIA) -- Isinagawa ang groundbreaking ng kaunaunahang AgriPnoy Rice Processing Center (RPC) 2 sa Sitio Mabuhay Barangay Central, bayan ng San Jose dito sa lalawigan kamakailan. Isang modernong post harvest facilty na proyekto ng Provincial Agriculture Office sa ilalim ng National Rice Program na nagkakahalaga ng P16 milyon. Ang RPC 2 ay kumpletong pasilidad na may drying at rice milling facility at 550 metro kuwadradong sukat na warehouse. Ayon kay Engr. Rudolf Asejo ng Department of Agriculture, kakayanin ng drying facility nito ang makapagtuyo ng 600 kaban ng basang palay, katumbas ng 30 tonelada sa loob ng isang araw. Ang rice mill naman ay may kapasidad na makapagprodus na 1.2 tons kada oras samantalang makapaglalaman naman ng 2,000 kaban ng palay ang warehouse. Dahil ito ay isang kumpletong pasilidad, mangangailangan na lamang ng mga mamimili ng bigas ang Coconut Farmers of Occidental Mindoro Multi Purpose Coopertive na siyang benipisyaryo nito. Tatanggap din naman ang kooperatiba ng mga ibebentang palay mula sa mga magsasaka na papasok sa 50 kilometer radius mula sa nasabing proyekto. Sa kasalukuyan ay hinihintay na lamang ang "layout" mula sa kontraktor ng RPC 2 upang mapasimulan na ng kooperatiba ang paghahanda sa lote na may sukat na 3,000 metro kuwadrado. PUERTO PRINCESA, Palawan, (PIA) -- Isinasagawa sa lalawigan ang "Fisheries Law Enforcement Training" na naglalayong mabigyan ng pangunahing kaalaman ang mga magiging "deputized fish warden" sa pagpapatupad ng batas pangingisda. Ang tatlong araw na pagsasanay ay unang isinagawa sa Bgy. Liminangcong, bayan ng Taytay kamakailan lamang. Magkatuwang na isinagawa ito ng Office of the Provincial Agriculturist (OPA) at Bureau of Fisheries and Aquatic Resources (BFAR) sa pakikipagtulungan ng Malampaya Foundation. Ayon kay Dr. Romeo Cabungcal, assistant provincial agriculturist, ang mga dumalo dito ay kinabibilangan ng mga opisyales ng Fisheries and Aquatic Resources Management Council o FARMC at lokal na opisyales ng barangay Liminangcong. Ipinaliwanag ni Dr. Cabungcal na sa pagtatapos ng pagsasanay ay bibigyan ang mga nagsitapos ng pagsusulit at kung kanila itong maipapasa ay maaari na silang maatasan ng BFAR bilang "deputized fish warden." Tungkulin ng isang fish warden ang magpatupad ng mga batas at regulasyong pangisda sa kanilang nasasakupang lugar. Kahalintulad din na pagsasanay ang isasagawa sa bayan ng Linapacan sa Pebrero 27 hanggang Marso 1 . Samantala, kasabay ng nasabing pagsasanay sa naturang bayan ang pagsasagawa ng Coastal Resource Management (CRM) Planning Workshop para sa pagbuo ng CRM plan para sa dalawang barangay sa Poblacion ng Linapacan. Ani Dr. Cabungcal, mahalaga ang CRM plan para sa pagbibigay ng direksyon kaugnay ng implementasyon ng epektibong pamamahala ng coastal resource. Marinduque State College lab school wins Oral Math Challenge by: Mayda N. Lagran BOAC, Marinduque (PIA) -- The new Marinduque State College Secondary School for Teachers Education (MSC-SSTED) Laboratory School bagged the Medal and Certificate as champion of the 2013 Oral Finals Competition for Math Challenge Divison Level, sponsored by Metro Bank Foundation. This was the first time that the MSC-SSTED Laboratory School joined such competition since the college's secondary school program started only last June. Fifty-four schools competed during the elimination round last January and MSC was among the first 20 schools that got in during that round. For that particular round, Marinduque National High School (MNHS) got the first place, SSTED-Lab school won second. Recently, the Math Challenge Division Level was held at the Dolores National High School and MSC representatives Jayson Mampusti and Paula Thersa Apalya emerged as champions. Mogpog Comprehensive High School got the second place, MNHS was the third both for the 7th grade level competition. For the 8th, 9th and 10th levels competition, MNHS took the first place. "The grade seven students were really good in math and to think its oral math, they did not even use pens and papers but they did it with excellence," proudly declared by the winning team's coach, Ma. Theresa Chavez. Chavez added that she was so inspired by this achievement that she committed herself to coach the students until they finish their secondary studies and become bets for other contests in the future. Chavez is also optimistic as the college looks forward to the Oral Math Challenge National Level Competition, which will be held before the end of February in the province. Carlos Tecson na bumuo ng grupo para makapagbigay kasiyahan tuwing sumasapit ang kapistahan ng Patron na si San Isidro Labrado. MIMAROPA regional games offically open By Dinnes Manzo

ROMBLON, Romblon (PIA) -- The 2013 MIMAROPA Regional Athletic Association Meet formally opened Sunday, February 17 at the Romblon National High School Grounds in Romblon, Romblon. The opening ceremony was held after the parade of the delegations from the seven school divisions all over the region competing in various sports categories. This year's sports event scheduled on February 17-21 is hosted by Department of Education (DepEd) Division of Romblon co-hosted by the Municipality of Romblon and the Provincial Government of Romblon. The MIMAROPA RAA MEET is a friendly sports competition among the different school districts of Occidental Mindoro, Oriental Mindoro, Marinduque, Palawan, Puerto Princesa City, Calapan City and this year’s host, Romblon. Winning athletes in the year’s meet will represent the MIMAROPA region in the 2013 Palarong Pambansa, scheduled in Dumaguete City this summer. Invited as keynote speaker at the opening ceremony is Congressman Eleandro Jesus F. Madrona with former Las Piñas Representative Cynthia Villar, representing Senator Manny Villar. MOGPOG: Kangga Festival Ang kangga ay isang katutubong sasakyan na ang paggamit ay mula pa sa mga ninuno ng mga taga-Marinduque. Ito ay gawa sa kawayan na hinihila ng kalabaw at maaaring pagsakyan maging ng mga produktong pang-agrikultura. Sa pagnanais na mapangalagaan ang kanilang kultura at magbigay parangal sa mga magsasaka lalo na sa Patron ng kanilang bayan na si San Isidro Labrador, pinasimulan ni G. Jun Lavares ang Kangga Festival sa Mogpog sa tulong na rin ng noo'y miyembro ng Sanggunian Bayan na si G. Senen Livelo, Dr. Reynaldo Menorca, Dr. Homer Montejo, G. Galileo Lavares at G. Florito Molbog. At dahilan sa kasigasigan ng mga taga-Mogpog sa paglinang ng kanilang mga matandang kaugalian at relihiyosong tradisyon, naging isang matagumpay na pagdiriwang din ang Kangga Festival na ngayon ay maligaya at may taus-pusong pasasalamat na idinaraos tauntaon para sa Panginoon.. STA. CRUZ: Eco-Tourism Maraming kahanga-hangang likas-yaman ang bayan ng Sta. Cruz na sadyang may malaking poitensyal para sa pagsusulong ng eko -turismo. TORRIJOS: Tubaan Festival Ang bayan ng Torrijos ay kilala sa “TUBA”, isang uri ng lokal na alak na nagmumula sa mga umuusbong na bulaklak ng puno ng niyog. Ang bulaklak na ito ay tinatalian at saka pinupungusan upang tumulo ang katas sa nakasahod na tukil. Ang katas o dagta mula sa mga bulaklak ng niyog ay natural na alak at ito ay nilalagyan ng pinulbos na balat ng tangal upang matanggal ang medyo mapaklang lasa. Ang tuba ay hindi lamang nagsisilbing alak, ito rin ay ginagawang suka at ang pawis ng tuba kapag nagdadaan na sa isang proseso ay siya ring nagiging lambanog, Ngunit, dahilan sa pagsulong ng teknolohiya at pagsubok mula sa mga natural na kalamidad, naapektuhan ang industriya ng tuba sa lalawigan. Fun run na pinangunahan ng Red Cross, naging matagumpay By Dinnes Manzo ODIONGAN, Romblon (PIA) -- Tagumpay na idinaos ang "Million Volunteer Run Part 2" ng Philippine National Red Cross (PNRC)- Romblon Chapter kamakailan na ginanap sa bayan ng Odiongan at may temang: “I choose to run to save lives.” Ang naturang fun run ay pinangunahan ni PNRC Romblon Chapter chairwoman Alice C. Fetalvero. Ayon kay Fetalvero, ang fun run na ito ay naglalayong mahikayat ang mga kabataan na maging makatao at responsableng mamamayan ng bansa. “Likas sa ating mga Pilipino ang pagiging volunteer o mapagkawanggawa para makatulong sa kapwa kaya ganun karami ang bilang ng mga lumahok,” ani Fetalvero. May 1,800 ang unang nagparehistro sa fun run, ngunit bago masimula ang takbuhan, humigit kumulang sa 2,000 katao ang nadagdag sa mga nagsilahok rito. Lumahok din ang ilang matataas na opisyal sa lalawigan sa pamumuno ni Governor Eduardo C. Firmalo, provincial director ng mga national government agencies, mga department heads ng provincial government, mga guro, doktor, pulis, empleyado ng lokal na pamahalaan, mga estudyante at ilang pribadong mamamayan ng Odiongan. Marinduque college execs ready to face raps over fatal Benguet road crash By: Gerald Gene Querubin, Inquirer Southern Luzon SANTA CRUZ, Marinduque, Philippines— Marinduque State College officials are ready to face investigation or any charges that may be brought against them after three students and two teachers of the academic institution died and 28 others were injured in a vehicular collision in Tuba, Benguet Thursday night. In a phone interview, Dr. Leodegario Jalos Jr., vice president for academic affairs of MSC, said they were ready to face inquiries or charges against them because the field trip was duly approved by the Commission on Higher Education (CHEd). “We were able to comply with the requirements of CHEd relating to the conduct of the educational tour as proven by the permit given to us by Ched,” he said. On the other hand, Jalos said, the MSC administration was contemplating on filing charges against St. Barachiel Travel and Tours Agency, the tour operator that hired the wayward bus. “The provincial legal officer is currently gathering evidence that will establish the criminal and civil liabilities of the tour operator,” said Jalos. The 28 injured students are still confined at the Baguio General Hospital and Medical Center. One of them, Joanna Pizarra, remained in critical condition. Jalos said 10 of the students might be discharged by Saturday or Sunday. “Vehicles are on standby to bring the students and their parents back to Marinduque,” he said. Jalos said the bodies of the five fatalities would be brought back to the province as soon as transportation concerns are settled. He said they were arranging with the Philippine Military Academy and the Baguio City Mayor’s Office to provide the trucks to transport the coffins. “As of now, we are concerned with the needs and safety of our students and their parents. We are still asking for your prayers for the students’ quick recovery,” said Jalos. “May this incident serve as a lesson to all of us,” he added. Jalos reiterated that the college would provide for all the needs of the victims. MSC officials and parents of the students arrived at around 5:30 a.m. Saturday in Baguio City after a 15-hour trip from Marinduque.

The Bottom-up Budgeting (BuB) Program is an approach used by the administration to empower the poor and alleviate poverty at the same time. The DILG IV-B, head of the Regional Poverty Reduction Action Team (RPRAT), sent representatives to the province for their Local Poverty Reduction Action Team (LPRAT) Orientation on BuB for FY2014 . The Orientation of LPRATs of the Province of Marinduque was held in the conference hall of the newly renovated Municipal Hall of Boac. The six (6) LGUs of Marinduque are among the BuB covered LGUs for FY 2014. In each municipality, the seven (7) key members of the LPRAT, namely, the Municipal Mayor, elected CSO representative as co-chairperson, Municipal Planning and Development Coordinator (MPDC), the three (3) CSO signatories and a representative from the business sector, were invited to learn more about the BuB process, the financial policies and the menu of programs with the help of twelve (12) RPRAT members’ representatives from DILG, DBM, DA, DAR, DENR, DepEd, DOH, DOLE, DSWD, DTI, TESDA and MARELCO. The event started with Mayor Roberto M. Madla of Boac, Marinduque welcoming the participants to their new “house.” He was also thankful that his long awaited desire to empower the people has materialized through the BuB. Provincial Director Ma. Victoria Del Rosario formally opened the program emphasizing the importance of the LPRAT in the BuB process before introducing the participants. It was followed by the presentation of the DBM-DILG-DSWD-NAPC Joint Memorandum Circulars No. 2 & 3, Series of 2012 by LGOO VI Ma. Teresita G. Iglesia. DBM Budget Specialist Gemma Rivera also discussed the financial policies of the BuB for FY 2014. In the afternoon, the program resumed with an open forum. The following were the major concerns raised and adequately answered: 1. The administrative costs of the BuB project implementation can be charged as an LGU counterpart. 2. The projects unspecified in the menu can be included in the 20% of the budget cap. 3. The questionable program in the menu of DAR was clarified. They would not be undertaking projects creating school buildings or daycare centers. Instead DAR would be into irrigation projects.

The LGU counterpart can be charged entirely from the 20% development fund as long as it follows the guidelines for its utilization. 5. For FY 2014, there will be no budget ceilings for the participating NGAs/GOCC unlike in the previous BuB implementation, hence, the LPRATs will be free to choose their projects under any participating agency for as long as it does not go over the LGUs budget cap for BuB. Afterwards, the participating agencies’ representatives presented their menu of programs allocating time for questions after each presentation and all concerns raised with regard to the listed projects were sufficiently clarified. LGOO V Agnes M. Salamanca, the MLGOO of Boac, closed the event expressing her gratitude to all the participants who seemed very eager to start planning and she also emphasized the schedule of the Local Poverty Reduction Action Plan (LPRAP) Workshop for each municipality which will start on February 4, 2013.
