Manchester Ambassadors make September visits Submitted by Manchester Area Chamber of Commerce

The Manchester Area Chamber of Commerce Ambassadors made three visits in September. The first stop was to Black Hills Energy where the Chamber Ambassadors greeted Operations Supervisor Lori Scovel. Scovel joined team members Gas Supervisor Andy Westhoff and Customer Service Associate Diane McElliott at the local office six months ago. Formerly Aquila, the local gas utility was acquired in 2008 by Black Hills based in Rapid City SD. A new office and warehouse opened in Manchester in 2013. The second visit was to the Delaware County Jail to hear Sheriff John LeClere discuss the problems and

Dental Associates of Manchester shortcomings of the present jail facilities and explain how a new addition combined with remodeling the current jail would correct the issues. The third visit was to Dental Associates of Manchester to meet new associate Dr. Zach Stecklein. Stecklein graduated from the University of Iowa School of Dentistry and considers himself fortunate to have had Dr. Tim Collier as a mentor and Dr. Gordon Goettsch as an instructor.

Senior Center hosts birthday/anniversary lunch Buchanan County Healthy Lifestyles (Senior) Center held its monthly birthday/anniversary lunch Oct. 8 with 65 people attending. Americans are proud of their heritage and honored when properties in their communities and states are entered in the National Register of Historic Places, the official list of the nation’s cultural resources worthy of preservation. Listing properties in the National Register often changes the way communities perceive historic resources and gives credibility to efforts of private citizens and public officials to preserve them as living parts of our communities. Historic preservation programs are a tool to help promote downtown revitalization or to protect or stabilize and revive 19th- and early 20th-century neighborhoods, which can provide an authentic foundation for heritage tourism. Downtown Independence was “rebuilt” in 1874 after a devastating fire and several of the buildings are now listed on the National Register, creating the possibility that the downtown business area could become a historic district. Listing in the National Register can assist in preserving historic properties in the following ways: • Recognition that a property is of significance to the nation, state or community; • Consideration in planning for federal or federally assisted projects; • Eligibility for federal tax benefits; and • Qualification for federal assistance for historic preservation when funds are available. ISU Extension to host Farm Bill Program Overview meetings

Farmers and landowners will learn about the new programs authorized by the Agricultural Act of 2104 (Farm Bill) at meetings by Iowa State University Extension and Outreach and local USDA Farm Service Agency. •Friday, Nov. 14, 9-11 AM, Heartland Acres Agribition Center – Great Spaces • Monday, Dec. 1, 6-8 PM, Heartland Acres Event Center • Tuesday, Dec. 2, 1-3 PM, Heartland Acres Event Center Meetings will focus on the Price Loss Coverage (PLC) and Agricultural Risk Coverage (ARC) that will be administered by USDA Farm Service Agency, and the Supplemental Coverage Option (SCO) administered by USDA Risk Management Agency through federal crop insurance providers. “Extension farm management specialists are prepared to discuss decisions farmers and landowners will need to make in the coming months regarding Price Loss Coverage, County Agricultural Risk Coverage, and Individual Agricultural Risk Coverage options,â€? said Kristen Schulte, farm management specialist with ISU Extension and Outreach. “Joining Extension and Outreach at the meetings will be local FSA staff members who administer the programs.â€? Additional topics covered during the meetings include base allocation, yield updating, Dairy Margin Protection Program (MPP), and Noninsured Crop Disaster Assistance Program (NAP). The timeline for when decisions need to be made along with information about online Farm Bill decision tools will also be shared at the meetings. Although the annual Quasqueton Haunted House is not for the faint of heart, there is nothing scary about this fundraiser’s benefit to the community! Sponsored by the Quasqueton Community Club, the annual event raises funds to support East Buchanan Dollars for Scholars, playground equipment, Easter Bunny and Santa Claus events, Boy Scouts, and more. Approximately 20-30 volunteers help bring the haunted house to life each year. Organizers are grateful for their help and welcome anyone else who wishes to volunteer. They also appreciate that the haunted house present location does not have to be moved every year. Mayor Chad Staton said that at its previous location, it took over seven hours to set up. There are two weekends left to have a frightfully good time touring the haunted house, 7-11 PM Friday and Saturday, Oct. 17-18 and Oct. 24-25 at 600 S. 3rd Street, Quasqueton (watch for signs). Admission is $9; however, cost is reduced by $1 if a canned food item is brought to donate to the local food pantry. (Christine Dale Photos)

SECTION MODIFIED. Section 47.03 of the Code of Ordinances of the City of Winthrop, Iowa, 2011, is repealed and the following adopted in lieu thereof: 47.03 CIGARETTES AND TOBACCO. It is unlawful for any person under eighteen (18) years of age to smoke, use, possess, purchase, or attempt to purchase any tobacco, tobacco products, alternative nicotine products, vapor products, or cigarettes. Possession of tobacco, tobacco products, alternative nicotine products, vapor products, or cigarettes by a person under eighteen years of age shall not constitute a violation of this section if said person possesses the tobacco, tobacco products, alternative nicotine products, vapor products, or cigarettes as part of the person’s employment and said person is employed by a person who holds a valid permit under Chapter 453A of the Code of Iowa or who lawfully offers for sale or sells cigarettes or tobacco products. (Code of Iowa, Sec. 453A.2) SECTION 2. SECTIONS MODIFIED. Section 160.01, 160.02, 160.07 and 160.08 of the Code of Ordinances of the City of Winthrop,

Iowa, 2011, are repealed and the following adopted in lieu thereof: 160.01 DEFINITIONS. For use in this chapter the following terms are defined: (Code of Iowa, Sec. 453A.1) 1. “Alternative nicotine product” means a product, not consisting of or containing tobacco, that provides for the ingestion into the body of nicotine, whether by chewing, absorbing, dissolving, inhaling, snorting, or sniffing, or by any other means. “Alternative nicotine product” does not include cigarettes, tobacco products or vapor products, or a product that is regulated as a drug or device by the United States Food and Drug Administration under Chapter V of the Federal Food, Drug, and Cosmetic Act. 2. “Cigarette” means any roll for smoking made wholly or in part of tobacco, or any substitute for tobacco, irrespective of size or shape and irrespective of tobacco or any substitute for tobacco being flavored, adulterated or mixed with any other ingredient, where such roll has a wrapper or cover made of paper or any other material. However, this definition is not to be construed to include cigars. 3. “Place of business” means any place where cigarettes or tobacco products are sold, stored or kept for the purpose of sale or consumption by retailer. 4. “Retailer” means every person who sells, distributes or offers for sale for consumption, or possesses for the purpose of sale for consumption, cigarettes, alternative nicotine products, or vapor products, irrespective of the quantity or amount or the number of sales, or who engages in the business of selling tobacco, tobacco products, alternative nicotine products, or vapor products to ultimate consumers. 5. “Self-service display” means any manner of product display, placement, or storage from which a person purchasing the product may take possession of the product, prior to purchase, without assistance from the retailers or employee of the retailer, in removing the products from a restricted access location. 6. “Tobacco products” means the following: cigars; little cigars; cheroots; stogies; periques; granulated, plug cut, crimp cut, ready rubbed and other smoking tobacco; snuff; cavendish; plug and twist tobacco; fine-cut and other chewing tobaccos; shorts or refuse scraps, clippings, cuttings and sweepings of tobacco; and other kinds and forms of tobacco prepared in such manner as to be suitable for chewing or smoking in a pipe or otherwise, or for both chewing and smoking, but does not mean cigarettes. 7. “Vapor product” means any noncombustible product, which may or may not contain nicotine, that employs a heating element, power source, electronic circuit, or other electronic, chemical, or mechanical means, regardless of shape or size, that can be used to produce vapor from a solution or other substance. “Vapor product” includes an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or similar product or device, and any cartridge or other container of a solution or other substance, which may or may not contain nicotine, that is intended to be used with or in an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or similar product or device. “Vapor product” does not include a product regulated as a drug or device by the United States Food and Drug Administration under Chapter V of the Federal Food, Drug, and Cosmetic Act. 160.02 PERMIT REQUIRED 1. Retail Cigarette Permits. It is unlawful for any person, other than a holder of a retail permit, to sell cigarettes, alternative nicotine products, or vapor products at retail and no retailer shall distribute, sell, or solicit the sale of any cigarettes, alternative nicotine products, or vapor products within the City without a valid permit for each place of business. The permit shall, at all times, be publicly displayed at the place of business so as to be easily seen by the public and the persons

authorized to inspect the place of business. (Code of Iowa, Sec. 453A.13) 2. Retail Tobacco Permits. It is unlawful for any person to engage in the business of retailer of tobacco, tobacco products, alternative nicotine products, or vapor products at any place of business without first having received a permit as a retailer for each place of business owned or operated by the retailer. (Code of Iowa, Sec. 453A.47A) A retailer who holds a retail cigarette permit is not required to also obtain a retail tobacco permit. However, if a retailer only holds a retail cigarette permit and that permit is suspended, revoked, or expired, the retailer shall not sell any tobacco, tobacco products, alternative nicotine products, or vapor products, during such time. 160.07 PERSONS UNDER LEGAL AGE. No person shall sell, give, or otherwise supply any tobacco, tobacco products, alternative nicotine products, vapor products, or cigarettes to any person under eighteen (18) years of age. The provision of this section includes prohibiting a minor from purchasing tobacco, tobacco products, alternative nicotine products, vapor products, and cigarettes from a vending machine. If a retailer or employee of a retailer violates the provisions of this section, the Council shall, after written notice and hearing, and in addition to the other penalties fixed for such violation, assess the following: 1. For a first violation, the retailers shall be assessed a civil penalty in the amount of three hundred dollars ($300.00). Failure to pay the civil penalty as ordered under this subsection shall result in automatic suspension of the permit for a period of fourteen (14) days. 2. For a second violation within a period of two years, the retailer shall be assessed a civil penalty in the amount of one thousand five hundred dollars ($1,500.00) or the retailer’s permit shall be suspended for a period of thirty (30) days. The retailer may select its preference in the penalty to be applied under this subsection. 3. For a third violation within a period of three years, the retailer shall be assessed a civil penalty in the amount of $1,500.00 and the retailers’ permit shall be suspended for a period of 30 days. 4. For a fourth violation within a period of three years, the retailer shall be assessed a civil penalty in the amount of $1,500.00 and the retailer’s permit shall be suspended for a period of sixty (60) days. 5. For a fifth violation within a period of four years, the retailer’s permit shall be revoked. The Clerk shall give ten (10) days’ written notice to the retailer by mailing a copy of the notice to the place of business as it appears on the application for the permit. The notice shall state the reason for the contemplated action and the time and place at which the retailer may appear and be heard. Drivers alert, as deer activity increases Shorter days and cooler fall temperatures are reminders to Iowa drivers. The risk of deervehicle collisions will rise in the coming weeks. On the plus side, the chance of hitting a whitetail has dropped over the year before. Deer activity increase through the first half of November, as the peak of the rut – or deer breeding season – approaches. This comes as more drivers are on the road during dawn and dusk and as the crop harvest opens more fields … pushing deer toward remaining cover. Though drivers should still remain alert, deer populations have been reduced in the last seven years and are at or below levels recorded in the mid-1990s. Since 2006, that has pushed the reported harvest down 33% and the number of road kills down by 39%. That reduction has come through emphasis on harvesting does through the county by county antlerless tag format and seasons available to hunters. In its annual report on vehicle-deer claims, State Farm Insurance indicates Iowa drivers are 5.5% less likely to hit a deer in the coming year than they were last year. Iowa dropped on

State Farm’s list of “high incidence” states to fourth this year, down from third last year. Further reduce the chance of hitting a deer by remaining alert near potential deer crossings, slowing down during dawn and dusk – high deer travel periods – and not veering out of the lane if a deer strike appears imminent. By “veering for deer,” drivers may leave the roadway, with the risk of striking a pole, bridge abutment or other hazard … or facing oncoming traffic in another lane. Likely deer funnels include creeks, fence lines or trees leading up to road crossings. Deer are likely to follow them before crossing the short stretch of open road to the other side. By watching the road shoulders and fence lines drivers can better detect a deer near the road. Remember, too, if one deer crosses the road; chances are couple more are nearby. As the peak of the rut approaches in early November there will be increased activity, as bucks begin following does are often oblivious to roadway traffic. That means deer will be seen more frequently in daytime as breeding pressure knocks deer out of their normal nocturnal patterns.

ORDINANCE 14-02 ASSESSMENT OF WIND ENERGY CONVERSION PROPERTY BE IT ENACTED BY THE BOARD OF SUPERVISORS OF BUCHANAN COUNTY, IOWA: SECTION 1 PURPOSE. The purpose of this ordinance is to provide for the special valuation of wind energy conversion property pursuant to Iowa Code Section 427B.26. SECTION 2 DEFINITIONS. For use in this ordinance, certain terms and words used herein shall be interpreted and defined as follows: Net acquisition cost means the acquired cost of the property including all foundations and installation cost less any excess cost adjustment. Wind energy conversion property shall mean the entire wind plant including, but not limited to, a wind charger, windmill, wind turbine, tower and electrical equipment, pad mount transformers, power lines, and substation. SECTION 3 AUTHORITY TO ESTABLISH. The Buchanan County Board of Supervisors is authorized, pursuant to Iowa Code Chapter 427B.26 to provide by ordinance for special valuation of wind energy conversion property as provided in Section 4. SECTION 4 ESTABLISHMENT. Pursuant to Iowa Code Section 427B.26, a special valuation of wind energy conversion property is allowed in lieu of the valuation assessment provision in Iowa Code Sections 441.21(8)(b) and (c), and Iowa Code Sections 428.24 to 428.29. only apply to wind energy conversion property first assessed on or after January 1, 1994, and on or after the effective date of this ordinance. SECTION 5 AMOUNT OF VALUATION. Wind energy conversion property, first assessed on or after the effective date of the ordinance, shall be valued by the Buchanan County Assessor for property tax purposes as follows: For the first assessment year, at zero percent (0%) of the net acquisition cost. For the second through sixth assessment years, at a percent of the net acquisition cost which rate increases by five percent (5%) each assessment year. For the seventh and succeeding years, at thirty percent (30%) of the net acquisition cost. SECTION 6 DECLARATION OF SPECIAL VALUATION. The taxpayer shall file with the Buchanan County Assessor by February 1 of the assessment year in which the wind energy conversion property is first assessed for property tax purposes, a declaration of intent to have the property assessed at the value determined under Section 5 in lieu of the valuation assessment provisions in Iowa Code Sections 441.21(8)(b) and (c), and Iowa Code Sections 428.24 to 429.29. If the taxpayer does not file with the Buchanan County Assessor by February 1 of the assessment year for which the person files a declaration of intent to have the property assessed as provided above, then

the declaration of intent shall be considered as a declaration filed for the following year. SECTION 7 REPORTING REQUIREMENTS. The following reports shall be filed annually with the Buchanan County Assessor by the taxpayer, in the first year, with the declaration of intent prescribed in Section 6; and by February 1 of each year thereafter: Copy of Asset ledger sheet to IRS; Engineering breakdown of component parts; Tower numbering system; Name of the contact person, phone number, fax number, and mailing address; Report of all leased equipment, the name(s) of the company(s) it is leased from, and the agreement between the lessor and lessee regarding who is responsible for the property tax on the leased equipment. SECTION 8 REPEAL OF SPECIAL VALUATION. If in the opinion of the Buchanan County Board of Supervisors continuation of the special valuation provided under Section 4 ceases to be of benefit to Buchanan County, the Buchanan County Board of Supervisors may repeal the ordinance. Property specially valued under Section 4 prior to the repeal of the ordinance shall continue to be valued under Section 4 until the end of the nineteenth (19th) assessment year following the assessment year in which the property was first assessed. SECTION 9 REPEALER. All ordinances or parts of ordinances in

conflict with the provisions of this ordinance are hereby repealed. SECTION 10 SEVERABILITY CLAUSE. If any section, provision, or other part of this ordinance shall be adjudged invalid or unconstitutional, said adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or other part thereof not adjudged invalid or unconstitutional. SECTION 11 EFFECTIVE DATE. This ordinance shall be effective after its final passage, approval, and publication as provided by law. Passed and approved this 6th day of October, 2014. CITY OF BRANDON SPECIAL CITY COUNCIL MEETING MINUTES OCTOBER 6, 2014 The City Council of Brandon, Iowa met in special session on Monday, October 6, 2014 at City Hall. PUBLIC NOTICE IS HEREBY GIVEN to the qualified electors of Buchanan County, State of Iowa that a General Election will be held in the several election precincts of said county on Tuesday, November 4, 2014. Valid identification such as a driver license, nondriver identification card or student identification card (all showing a color photograph and signature) will be required of voters under these circumstances: (1) a voter moved from one voting precinct to another without updating their voter registration record (2) any voter whose voter registration mail was returned to the Election Office undeliverable by the United States Postal Service and (3) voters who registered for the first time in Buchanan County, by mail, after January 1, 2003 and did not provide a driver license number or the last four digits of their social security number which could be verified. National Physical Therapy Month

Physical therapy has been practiced for centuries. Physical therapy is a health care specialty involved with evaluating, diagnosing, and treating disorders of the bones, muscles, and joints of the body. It is useful in treating several medical disorders, including sports or orthopedic injuries such as a joint sprain or low back pain, or neurological conditions such as a stroke. The ultimate goal of physical therapy is to restore function and independence of each patient and to prevent the same injury from reoccurring. To achieve this goal, the physical therapist determines a plan of care that suits each patient’s needs. Treatments can include modalities such as deep heat and/or ice, tissue massage, electrical stimulation, therapeutic exercises, and stretching. Training and education is also a large part of the therapy session as well, which addresses ways to eliminate the disorder and prevent future injury. Physical therapy is provided by a licensed physical therapist. The physical therapist evaluates and manages the treatment plan customized to the patient’s needs. A licensed physical therapy assistant may also provide treatment following the physical therapist’s set plan of care.

McEnany named BCHC chief nursing officer Submittted by BCHC

Buchanan County Health Center (BCHC) announced Dr. Tara McEnany, DNP, ARNP, has accepted a new position of chief nursing officer. McEnany most recently served as clinical coordinator at BCHC. As chief nursing officer and member of the Senior Leadership Team, McEnany will help to set the overall direction for the BCHC Nursing Departments. These departments include Med/Surg, Surgery, and Emergency; Rehabilitation; and Patient Education, Care Coordination and Clinical Support Departments for Radiology, Diabetes Education, Laboratory, Pharmacy and Respiratory Therapy. McEnany will participate in strategic planning goals and direction for the health center and integrate overall vision within Patient Care Services. She will also represent patient care issues as an active participant in Senior Leadership, the Board of Trustees and Medical Staff Committees.

“Tara’s natural leadership ability, her extensive knowledge of health care, and its best practices, as well as her experience in several different roles within BCHC, made her an ideal candidate for this position,” explained CEO Steve Slessor. “In this new role, she will have the opportunity to impact our organization in many other areas and will be a big part of our continued transformation.” McEnany began working at BCHC in 1997. She holds a doctorate in nursing practice from the University of Iowa, graduated from Allen College with a Master of Science degree in nursing and is an advanced registered nurse practitioner, board certified in family practice. She completed a post-masters certificate and is board certified as an acute care nurse practitioner. McEnany and her husband Kevin reside in Independence with their two children, Shae and Teegan.

Card party to benefit BCHC Auxiliary Everyone invited to join in the fun

Attention all 500 and Bridge card players! Buchanan County Health Center (BCHC) Auxiliary will hold a Card Party Fundraiser on Oct. 24, beginning at 1 PM at the Oak View Senior Living Complex. All card players are welcome. “We thought this might be a great way to give people something fun to do at a time when we all begin to feel a bit of cabin fever,â€? explained organizer Bette Butler, BCHC Auxiliary membership chair, “as well as raise some money for our Auxiliary and all the important work we do!â€? In the past year, the list of Auxiliary accomplishments includes: • Donating almost $500 to the Wellness Department to provide Safe Sitter babysitting classes. Safe Sitter is a comprehensive babysitting training program with over 650,000 graduates nationwide. Graduates are able to handle emergencies when caring for younger children and are equally equipped with the tools needed to stay home alone safely. Financial assistance is available for families unable to afford class fees.
