ANDREW PALAMARCHUK apalamarchuk@insidetoronto.com Every morning Kevin Brooks wakes up, there’s a wheelchair beside him that reminds him of his “nightmare”: killing his friend in a drunk driving crash. It began as a typical warm Saturday in June 2000. Brooks, then 21, was hanging out with his high school sweetheart and watched her ride in a horse show. He then went to
his youngest sister’s ballet recital. After the event, Brooks attended a house party where he thought he’d have a few beers and then call it a night. But that never happened. “I ran into some old school hockey friends I’d grown up with, and one thing led to another, and we were down to have a wild night,” Brooks said. And they hopped from one party to another. At one point during the night, Brooks
returned home to get more beer. The British Columbia resident wasn’t yet “blackout drunk” and stopped in front of his car thinking something bad could happen. “We all have that voice inside that warns us at times,” Brooks said. “That was one moment where I was still consciously aware of what was going on and had that opportunity to make the better choice and chose not to.” Brushing off the warning, Brooks con>>>A MISTAKE, page 8
Two Toronto mosquito pools test positive for West Nile Two mosquito pools in Toronto have tested positive for West Nile virus, marking the first positive test for the virus in the city this year. “The positive test result is a good reminder for Toronto residents to take precautions to protect themselves from mosquito bites and to remove standing water from their properties to prevent mosquito breeding,” Dr. Barbara Yaffe, Toronto’s acting medical officer of health, said in a release. West Nile virus is a mosquitoborne illness that can cause encephalitis or swelling of the brain. The majority of people infected with the virus show no symptoms, although one in five people infected will have symptoms that may include fever, headaches, nausea, vomiting and body aches, which can be accompanied by a skin rash and swollen glands. Symptoms can last anywhere from a few days to weeks. About one in 150 people infected will experience serious symptoms including neck stiffness, extreme confusion, disorientation, muscle weakness, vision loss and numbness. >>>TORONTO, page 6

Kevin Kane For more than 17 years, the Regent Park School of Music has been helping kids in underserved communities enjoy top-notch music lessons with professional instructors. With heavily subsidized lessons for students in Regent Park, Parkdale and Jane/Finch, the school relies heavily on fundraising. The upcoming Closer to the Heart VIII show, taking place at the Hard Rock Cafe, 279 Yonge St., at 8 p.m. Aug. 13, features performances by noted Canadian artists such as singer/ actor Sean Cullen (The Producers) and musicians Tara Slone (Joydrop), David Diamond (The Kings) and Kevin Kane (Grapes of Wrath). We asked Toronto resident Kevin Kane a bit about his involvement with the show.

1. How did you get involved with the Regent Park School of Music/Closer to the Heart fundraiser? A few years ago I was part of a tour called The Songs Of Nick Drake and Karen Pace was the tour’s road manager. Karen has been involved with Closer To The Heart from the beginning and asked me to take part in one a few years ago, and it’s great to be asked back. 2. What about the organization and

the fundraiser appeals to you, either as a musician or on a personal level? Both my wife and I are longtime music educators and we’ve seen how music lessons enrich and improve lives in so many ways. It’s an honour to be involved in a cause we believe so strongly in. 3. What projects are you working on currently? Several! There’s Grapes Of Wrath (on tour in Manitoba as I type), Kane & Potvin with Northern Pike Bryan Potvin (new album drops end of September), FAUXKNOW (a shoegaze/dream pop project with my wife Nadia – we just released our debut album, “tactics”), and I play guitar on the new Brendan Canning album, out Aug. 12.
4. What can guests at Closer to the Heart VIII expect from your set? Will you be performing old favourites from your Grapes of Wrath days, new material, a mix of the two? Nadia and I started learning Canadian cover tunes as a project for ourselves, so when Karen’s request came we already had a couple of songs in mind: one by The Weakerthans and the other by Treble Charger. 5. What are you most looking forward to about the show? Performing, hearing other folks’ performances, and the fine array of backstage snacks (this is probably my current state of hunger talking though...)
Visitors to Driftwood Parkette will soon be able to slide, swing and climb thanks to a new playground set to be built Saturday, Aug. 13. The playground, built in partnership with Toronto Parks, Forestry, and Recreation, Foresters Financial and non-profit KaBOOM!, will serve more than 400 children and their families in the community near Driftwood Avenue and Jane Street. The new playground will be made up of a spiral slide; monkey bars; bridges; letters and numbers activity panel; scavenger hunt activity panel; wall climber; balance stepping buttons; a swing set; turtle spring toy; seesaw; and an accessible ramp for access off the adjacent pathway. The playground’s design is based on drawings created by community youngsters at a special design day event in June. The drawings were used as inspiration for the final design. Doug Bennet, spokesperson for Toronto Parks, Forestry and Recreation, said this is the third playground in three years the city has partnered with KaBOOM! on, with the other two located at Heron and McGregor parks in Scarborough. “There are a lot of kids in that area,” he said of Driftwood Parkette. “I think it’s a fantastic addition to the neighbourhood. Not only for kids to play, but for the community to meet each other.” The community will have

a chance to come together to help with building the playground Thursday, Aug. 11, when 40 volunteers are needed for prep work. Volunteers are also needed on standby Friday, Aug. 12 in case all prep work wasn’t completed the previous day. t’s sad we still have to warn people about the dangers of impaired driving; one would have hoped the message had been received loud and clear by now, but that is unfortunately not the case. In today’s editions of our papers, we look at the consequences of impaired driving, from the standpoint of a woman whose life was forever altered after being struck by a driver who was impaired, and from the perspective of a young man who killed one of his best friends after crashing a car while driving drunk. These are tragic stories, and in both cases they could have been avoided. It’s critical for all to remember that alcohol is not the only cause of impaired driving. As our stories show, there’s growing concern among police about what impact Canada’s new marijuana laws will have on impaired driving. Police are preparing for a spike in drivers “one toke over the line”, and the Ontario Provincial Police are training officers to specifically detect drug-impaired drivers. Clearly, as the federal government moves toward relaxing Canada’s marijuana-use laws it will have to take into account how drug-impaired driving is determined by police, and what standards the courts will be setting for criminal charges. It is critical that the message gets out that drugimpaired driving is as socially and morally unacceptable as drunk driving. Further complicating the dangers on our roads is the “grey” area of those driving (often unknowingly) under the influence of prescription drugs. Patients and doctors must improve their level of understanding about the impact of prescription drugs and medications on the ability of a person to drive, and make sure that information is available. We all need to take a greater level of responsibility about our actions, and the decisions we make, before we get behind the wheel of a vehicle.

Bloor bike lanes address city’s growing cycling needs I’m usually pretty careful riding a bike on Toronto streets, but last week I had a near thing. Riding down Coxwell Avenue on my way to a Mayor John Tory press event, I thought I could make it past some road work that pushed very close to streetcar tracks, and as it turned out, I couldn’t, not quite. So when the front tire slipped into the streetcar track, it went over and I nearly did too; somehow managing to get off the bike without really falling myself. Lucky me. Seriously. Lucky me. In July, a study by Ryerson University and the University of British Columbia on bike accidents in Toronto found that fully a third of the serious ones were caused by cyclist’s tires either getting caught in the tracks or slipping across them. Usually, there were no
david nickle the city bike lanes and the cyclists reported trying to maneuver around parked cars or other obstacles. And it happens a lot. Between 2005 and 2014, the city has charted 1,232 cyclist collisions – a number that doesn’t include simple mishaps. The whole thing adds a bit of perspective to the new pilot project that got underway this week to try out separated bike lanes on Bloor Street. There are no streetcar tracks on Bloor Street, but there are an awful lot of cars, and the stretch through the Annex is a well-documented hazard for cyclists trying to get across town. It’s been a pain for auto drivers, during this relatively short construction period, with two of the
four lanes of traffic there shut down, and there will probably be some more pain – or at least mild discomfort – as the pilot runs its course. Drivers are going to have to get used to it, because the status quo is a precarious place right now. More people are choosing to bike to and from work than ever. And while the city has provided some good cycling infrastructure – a total of 558.4 kilometres of on-street bike lanes, before the Bloor project is counted – Toronto also has 82 kilometres of those tirecatching streetcar tracks to contend with. Cycling is safer in Toronto, but it’s hardly as safe as it might be. The authors of the study that appeared in the BMC Public Health journal in July had a couple of recommendations short of getting rid of all those streetcar tracks. Bike lanes, obviously,
are crucial – but they also recommend fully-separated streetcar tracks, like those on Spadina or St. Clair. The city can do other things, too. Simply patching potholes on well-cycled routes – or all routes, for that matter – would go a long way to making a safer, smoother commute for cyclists. Providing more places to safely lock bikes might not make things safer, but might be more effective. But in the short term, running a successful pilot project along one of the great, city-spanning streets, and working diligently to build out the bike plan that Toronto Council approved earlier in the summer, is an excellent step toward syncing the city’s form with the needs of a growing number of its residents.

It’s a welcoming network for women to come together to develop their interests, discuss current affairs and most importantly, to empower each other. Founded in 1951, The University Women’s Club of North York is one of the branches of The Canadian Federation of University Women (CFUW), which is comprised of more than 100 clubs for women in the country. Through general meetings with guest speakers, interest groups and workshops, members of the club aim to improve the social status of women and to advocate for quality public education. Barbara Betts has been a member of the club for three years, and is now the communications co-ordinator for the club. “These are great opportunities for women to come out, have interesting conversations and provide support to their fellow members,” said Betts. “It’s an inspirational and educational community.” The club has been involved

On Oct. 31, freelance writer and film critic Kevin Courrier will take the audience back in time to discuss women in filmmaking prior to the 1930’s. A mistake that lingers, more than 16 years later >>>from page 1 tinued drinking and partying hard. “By the time we were leaving the last house party, we were all really drunk,” said Brooks. “We were double digit drinks for sure. I’d say well over 10, probably pushing 20.” Three of Brooks’ buddies got in a cab, but before it left, one friend, Brendon, got out and opted to travel with Brooks. “I was like the stubborn idiot who wanted to drive drunk,” Brooks said. “From what I’ve heard, people were trying to get my keys away from me, but I had an extra pair in the glove box. ... In hindsight, too bad somebody didn’t just punch me out.” Brooks and Brendon were speeding to another party. “Going 110 to 130 in a 70 zone, just stupid. Beers are open, tunes cranked, totally not paying attention,” Brooks said. “I don’t remember what happened. I missed a corner, and the car hit a road divider and went airborne, hit the ground and rolled multiple times.” Weeks later, Brooks woke up in an intensive care unit and learned that he had been in a crash and that he was paralyzed from the chest down. “A little bit later, I asked about who was
with me and found out my buddy Brendon passed away. That was the worst thing I’d ever heard in my life,” Brooks said. “He’s gone and dealing with that was a nightmare.” Brooks contemplated suicide but was confined to a bed, too weak to even move. With the support of his family, best friend and Brendon’s family, Brooks’ outlook began to change. “It allowed me a chance not to totally give up,” he said of the support. After a two-month hospital stay, Brooks was transferred to a rehabilitation centre where he learned to dress himself, roll over in bed, sit up and get around in a wheelchair. It was a new life for Brooks, who had been an active man. “I could play every sport decently. I skateboarded, I snowboarded, I played hockey. I was just go, go, go, and then all of a sudden, boom, I’m in a chair.” His future career as an electrician was over, his girlfriend of two-and-a-half years left him and he faced criminal charges from the crash. “And dealing with the fact that I killed a buddy, there was so much to deal with,” he said.

Brooks pled guilty to dangerous driving causing death; a charge of impaired driving causing death was dropped. “I lost my licence for three years. There were community hours and probation but no jail time,” Brooks said. “I still look at it as light.” Brooks said he felt something good had to come from the tragedy, and about two years after the collision, he began sharing his story at schools in the hopes of preventing drinking and driving. “I used to be a server and I’d be scared if I had 10 people at a table, so getting in front of an entire gymnasium of teenagers was terrifying, but once I started talking, I just sunk into a bit of a groove,” he said. “Then after, I was just mobbed by kids and they were crying, thanking me and shaking my hand. There was a connection made.” Brooks has now delivered more than 1,000 presentations across Canada and the U.S. “It’s been a saving grace for me to have a positive outlet for what happened,” he said. “I can’t say I’m proud of the journey that led me on it, but I found it and I just keep looking forward.”

Mayor Tory outraged by tree removal at development site fannie sunshine fsunshine@insidetoronto.com Martha Russel was devastated when she saw dozens of trees torn down at the property adjacent to her York Mills Road and Bayview Avenue area home July 22. “There were 50 birds in my yard that looked panicked,” she said. Several dozen trees at 103 and 108 Bayview Ridge appeared to be removed without a permit by real estate developer Format Group to make way for a townhouse and two single dwelling developments. Mayor John Tory, who visited the site last Thursday, said he was “horrified” by the site riddled with logs and a torn-down Linden tree thought to be more than 100 years old. Speaking to reporters at the site off Bayview Avenue, just south of York Mills Road, Tory said the removal is the “biggest single infraction of its kind that we’ve ever seen in the city” without a permit

and would like to see a potential fine of at least $1 million to send a strong message to developers. In an emailed statement, Format Group said its arborist had submitted a complete report that has been approved by the city’s urban forestry department, which outlined
the number of trees to be removed. Having been told by the city’s building department the building permit would arrive “in short order”, the company “started the process to prepare the site following the arborist report so that we were in a position to begin
excavation,” the statement read. “We assumed we were allowed to follow the report and prepare the site in anticipation of the building permit, since it was clear that the documentation was imminent,” the statement continued. “We are fully cooperating
with the city forestry department.” Anyone removing a tree with a trunk larger than 30 centimetres requires a permit or faces a maximum fine of $100,000 per tree, though convictions in provincial court typically result in fines of about $5,000 per tree.
Tory said that wasn’t stiff enough in this case. “I hope our lawyers go forward and prosecute...to the maximum fine,” said Tory, adding he didn’t buy the idea an experienced developer wouldn’t know a permit was needed. “A judge will decide what’s appropriate.”

Bunny pals Kirk and Ellie and Janelle, an American bulldog, need homes This month, our featured pets hail from the Toronto Humane Society. You’ll meet the bunny team of Kirk and Ellie as well as Janelle an American bulldog who prefers to take things slow when meeting new people. KIRK AND ELLIE Little Kirk and Ellie are best pals who are looking for their new forever home together. They love to explore and taste the world around them. Because of this, they are best suited for experienced owners. These two are absolutely adorable and closely bonded so a home for both bunnies is required. With the proper enrichment and exercise, they are sure to shine in their new home. Kirk is a four-year-old neutered male Silver Marten Dwarf and Ellie is a threeyear-old spayed female Holland Lop. Please note, to keep any rabbit happy, it’s important to give them big cages. When picking out a cage for your future rabbit, or
lorraine houston critter chatter custom building one yourself, aim for a cage with minimum dimensions of four-foot long by four-foot wide by 36 inches high for a single, dwarf-sized rabbit. Dog pens are ideal for larger or multiple rabbits. Remember that all rabbits need at least four hours a day of playtime outside of their cage each day. JANELLE Two-year-old Janelle, a spayed female American bulldog, will surely melt the hearts of all who see her with her soulful eyes and her striking beauty. She, however, can be a little more difficult to win over! This hardy girl does not believe in love at first sight, and would prefer to take things slow and take time to get to know you. Janelle will also need a little help learning to share her food, and when it comes to introducing her
to your human and canine friends, she is a big believer in manners and space. Once her barriers are down, a whole new side of Janelle will start to emerge. The goofy side of this girl comes through and you’ll see how she loves to zoom around the park, play fetch for hours and she is the perfect companion for long leisurely summer walks. Once comfortable with you, she likes to take up residence against your leg, while you lavish her with affection. Behind this stoic face, a lovely lady is just waiting to bounce into your life. The Canadian member of Friends of the Earth International is partnering with Bumble Bee Watch to deliver the first Great Canadian Bumble Bee Count. All it takes is a simple snap of a picture of bumble bees you see in your garden, park or campsite and upload to Bumblebeewatch. org Bumble Bee Watch, created by scientists from the Xerces Society, York University and Wildlife Preservation Canada, is an ambitious citizen-science project that asks people to take pictures of bumble bees when they see them, note their location and upload them online, where they will be verified by a team of researchers. Help Bumble Bee Watch’s researchers by seeing how many bumble bees can be found across Canada from now until Aug. 15. Bumblebees are effective pollinators for many of the crops and for many of the wildflowers in fields and forests, but several of their species are dramatically declining.
