‘Weed’ out laws exactly one year after the legalization of medical marijuana in oklahoma, we take a look at what the medical marijuana laws look like for our state and how they could change in august.

The Alcohol and Medical Marijuana Summit at Oklahoma State became a hot spot for discussion as the future of Oklahoma’s medical marijuana laws were discussed by several speakers and members who attended.

On June 26, 2018, about 507,000 Oklahomans voted yes on State Question 788, legalizing medical marijuana in the state.

The initiative for the legalization of medical marijuana began as a petition by a group called Oklahomans for Health.

The group gathered around 67,000 signatures to have their volunteer-written state question put on the ballot.

When SQ788 passed, voting Oklahomans passed what is being called the most progressive medical marijuana laws in the United States.

Once SQ788 passed, Oklahoma’s Medical Marijuana Authority had 60 days to set up a program.

Once set up, by 5 p.m. on Aug. 25, 2018, more than 1,500 applicants applied for the multiple medical marijuana licenses available. By 8 a.m. on Aug. 27, over 2,100 applicants. By Dec. 31, over 36,000 applicants.

Most applicants were applying for a patient license, but applicants could also apply for a temporary license, caregiver license, dispensary license, processor license and commercial grower license.

Currently, having an Oklahoma patient license allows you to possess three ounces of marijuana on your person, six mature marijuana plants, six seedling plants, one ounce of concentrated marijuana, 72 ounces of edible marijuana and eight ounces of marijuana at home. The cost of acquiring a patient license is $100, or $20 if on Medicaid. Oklahoma’s possession limits are 6.5 times felony limit in Colorado.

Oklahoma is also the only state that does not have qualifying conditions for patient licenses.

A caregiver license is for people who take care of homebound patients. This could be an elderly patient or a young child and anyone in between. Caregivers are allowed to possess, grow and buy marijuana for the patients they are taking care of. Caregivers, right now, have no limit on the amount of patients they can take care of. So, if a caregiver is taking care of 10 patients, they could potentially grow up to 120 plants in their home.

Caregivers also do not have to do their own applications. If a patient puts their caregivers’ name down on the application website, that person is then designated as a caregiver and can then possess all the medical marijuana a patient could possess.

Dispensary licenses cost $2,500. The dispensary has to be at least 75 percent owned

by Oklahomans who have had residency status for two years.

Flippin Farms Dispensary is located on South Main Street in Stillwater. because it deals with food and food products. The Food Safety Standards Board was created to oversee what happens with processed marijuana when converted into an edible form. It costs $2,500 to obtain this license.

The commercial grower license is also $2,500, which is low compared to Arkansas, which has a $100,000 license fee plus a $500,000 performance bond. There is no limit right now on how much marijuana can be grown.

As of June 3, 129,085 patient licenses, 818 caregiver licenses, 1,479 dispensary licenses, 3,026 grower licenses and 811 processor licenses have been approved.

This means that Oklahoma has one dispensary license for every 87 patient licenses, and two growers for every one dispensary.

What’s next?

Because of the way SQ788 was written, disputes with employment and what kind of actions employers can take began to arise.

Per section 6(B) of SQ788 “Employers may not take action against the holder of a medical marijuana license solely based upon the status of an employee as a medical marijuana license holder or the results of a drug test showing positive for marijuana or its components.” This means patients with a medical marijuana license, even those who work in safety sensitive positions, could avoid the consequences of drug testing for marijuana products.

This also means that, currently, someone could be fired for having marijuana on their person at work, but cannot be fired for being high at work.

On March 14, Gov. Kevin Stitt approved House Bill 2612, also known as the “Unity Bill.” This bill was created to increase some of the restrictions on certain aspects of SQ788 while also clarifying some of its language.

HB2612 clarifies that federal law preempts state medical marijuana programs required to follow federal drug-free workplace guidelines. Employers still may not discriminate against marijuana patients, but may discipline or fire employees who fail drug tests if they are in a safety sensitive position. The bill further states that insurance carriers are not required to cover the cost of medical marijuana.

Previously, in SQ788, property-owner consent was not necessary for growing marijuana. So, if you were renting property you would not need landlord consent to

grow on that property. Now, HB2612 will require propertyowner consent for homegrow operations, and homegrow operations must not be viewable by a normal person with 20/20 vision.

The bill also requires seedto-sale inventory tracking, so every commercial business will now have to track their product throughout the system.

HB2612 will allow businesses and property owners the right to prohibit the use of smokable medical marijuana and clarifies that licensees are subject to the same restrictions as tobacco under the “Smoking in Public Places and Indoor Workspaces Act.” Multiple public health concerns were also addressed in HB2612 including laboratory testing, child safety guidelines and more.

HB2612 is set to take effect on Aug. 29. On March 29, Callum v. Bates was filed by attorney Julie Ezell. This lawsuit is asking the court to hold HB2612 as unconstitutional. As of right now, there has not been any progress on this case.

Coming off of what was a disappointing fall season followed by a less than, but still disappointing winter season, Oklahoma State athletics looked to finish the school year strong with a solid showing from the spring sports.

Below is an overview of the ups and downs for the main three OSU spring sports during what was far and away the most successful five months of the school year.

Men’s golf OSU men’s golf was coming off of the program’s 11th national title which was won at Karsten Creek, the home course for the Cowboys. With this accomplishment and four of the five starters on the national title team returning to the men’s golf team came into the season with astronomical expectations and largely lived up to the hype.

The Cowboys won two regular season tournaments and placed within the top-4 in all five. Led by sophomore Matthew Wolff, who won the individual title in two events, and Viktor Hovland who won the individual race once in five tournaments.

in which they won by four strokes after coming back from an eight-stroke deficit The Cowboys advanced to the championship as heavy favorites and exceed expectations during strokes play. OSU dominated the field and came away with the No. 1 seed heading into match play thanks to a 31-stroke lead. Not only did OSU dominate stroke play as a team, Wolff also came away with the individual national title shooting a 10-under 278 to give OSU it’s first individual tile since 2006.

Heading into stroke play it looked as though OSU would repeat as champions following the dominant stroke play performance.

Unfortunately for the Cowboys that is not how their season would end.

OSU defeated SMU, 4-1, in the quarterfinals to set up a match against Big 12 foe Texas. The match was tied 2-2 with Zach Bauchou forcing an extra hole which he eventually lost to end the Cowboys historic season.

This Cowboy’s golf team would have gone down as the greatest collegiate golf team of all-time had it come away with a national title. Instead it will be a team that had the NCAA individual champion, Jack Nicklaus award winner, and Fred Haskins award winner in Wolff, the Ben Hogan winner and Big 12 player of the year in Hovland, and two All-Big 12 selections in Bauchou and sophomore Austin Eckroat that fell

short of the ultimate goal.

UP NEXT: This summer, the O’Colly will be taking a positionby-position breakdown look at what the OSU football team will look like for the 2019 season. This is the second installment of our series “Scouting Ahead.”

Over the past couple of seasons, Oklahoma State’s secondary defense has been considered a weakness with young corners and safeties, but this season it will be one of its strength.

In an interview with Pistols Firing Blog back in March, defensive coordinator Jim Knowles was encouraged by the secondary and was ready for them to have a good season.

“I’m most excited about our secondary,” Knowles said.

“We played a lot of young guys there last year, and you know, ‘school of hard knocks.’

They had some tough experiences, but they are going to be light-years better and we have two great corners in my opinion.”

OSU returns both their cornerbacks in Rodarius Williams and A.J. Green along with safeties Kolby HarvellPeel and Malcolm Rodriguez.

Green should have a standout senior year as he has improved each year he has been at OSU. Green has become the shutdown corner for the Cowboys.

When Green has gone up

against great receivers he limits their number of catches and holds them in check.

For example, he held Texas receiver Colin Johnston to five receptions on 13 targets and West Virginia’s David Sills to four receptions on 11 targets.

Redshirt junior Williams will complement Green on the other side of the field. Williams has been encouraged by the cornerback competition this spring.

“We have a lot of guys with a lot of experience,” Williams said. “The fresh faces last season are coming in as sophomores now, and it is great having a lot of depth.”

Also, keep an eye on Kemah Siverand, who has already been at OSU for a year now after graduating from Texas A&M. Siverand made a solid impact last season catching an interception against Missouri in the Liberty Bowl.

Green and Williams have the starting corner position on lock down, and the same can be said for safeties Rodriguez and Harvell-Peel. Rodriguez had a break out sophomore season with 83 tackles during the 2018 season, the second most on the team.

Rodriguez will provide confidence as an experienced secondary that will be the backbone of the defense this fall.

Harvell-Peel also made a big impact during the 2018 season as a true freshman.

Harvell-Peel had a career-high nine tackles against Missouri in the Liberty Bowl. HarvellPeel also had seven tackles in three games during the 2018 season.

Look for Jarrick Bernard to continue to play a good amount as he had 59 tackles as a freshman for the Cowboy’s defense. Bernard made an impact on special teams with a blocked a punt against Boise State and 14 tackles against Texas Tech as a freshman.

Bernard has experience that will help the Cowboy secondary have a great season.

With depth at the safety position, another player to watch for is Tanner McCalister. McCalister played in 12 games as a freshman on defense and special teams. McCalister will be more experienced, having already gone through the learning curve of division Devin Lawrence Wilber/O’COLLY I football.

In the upcoming season, Knowles will have to rely on the secondary to get the job done because they are his most experienced group on defense.

After going through the growing pains and installing the new defense, the secondary looks to cause a lot of turnovers and limit the number of big plays in the passing game by opponents.

A student lineman paralyzed last spring when he fell during a practice climb has sued the Oklahoma State University Institute of Technology for $2 million.

sion in April 2018. He was near the top of the utility pole when he adjusted his safety belt, lifting it over the top of the pole. He fell about 40 feet to the ground, suffering broken bones and multiple spinal injuries, according to his lawsuit.

Electrical power line installers and repairers have one of the highest fatality rates by occupation in the country, according to the U.S. Bureau of Labor Statistics. In 2017, 26 were killed on the job, according to the bureau.

Griffin’s lawsuit, filed in Payne County in January, claims negligence, breach

of contract, premises liability and ultrahazardous activity by OSUIT. The suit argues, in part, that the school is responsible for his injuries because instructors encouraged the “untrained” students to practice the “ultrahazardous activity” without supervision and safety devices.

Attorneys for both sides declined to discuss details of the case. But an OSUIT spokeswoman denied that instructors encouraged students to practice climb without teachers present.

“I can say unequivocally that OSUIT has not, nor ever will, encourage unsu-

pervised activity at the pole yard,” Shari Erwin wrote to a reporter.

At the Lansing (Michigan) Community College lineman program, students aren’t allowed to climb without an instructor present, the coordinator said.

“We check the retractable harnesses every time the students are instructed,” Rex Peckens said. “And the pole yard is checked for issues that might have taken place while we weren’t there.”

Erwin said safety is a high priority for OSUIT’s program.

obviously, it’s a dangerous occupation,” she said. “But we really make it an important aspect of classroom curriculum from day one.

With each of our technical programs, safety is one of our core components.”

Because the climbing yard isn’t electrified, the university is not required to have OSHA or another outside agency inspect it, Erwin said.

Lineman today often have the option of using a lift to reach power lines, which decreases the risk of falling. But not every scenario allows for that option, so climbing skills and

safety are still stressed in training programs.

Pete Anders of Stamford, Texas, has been a lineman for 40 years. Regardless of the safety risk, he said climbing to reach the power lines is his preferred method.

“I like climbing,” Anders said. “You got more reach and you can do more (while climbing) than you can out of a (lift).”
